Call to Order - Mr. Davis called the meeting to order at 6:00 pm. 2. Roll Call - A quorum was declared present. YEA: Bausch, Davis, Ramey, Cunningham NAY: None Motion carried: 4-0 and the meeting adjourned at 6:06 p.m. Wendy Kramer, Recording Secretary "4010 REAL People • REAL Character • REAL Community TO: The Owasso Board of Adjustment FROM: Wendy Kramer, City Planner SUBJECT: OBOA 26-01 - Variance: 9580 North Garnett Road DATE: June 12, 2026 BACKGROUND: The Community Development Department received an application for a variance from Section 18.5 of the Owasso Zoning Code, to allow for the construction of one additional ground sign on Commercial Shopping (CS) -zoned property located at 9580 North Garnett Road. The subject property is approximately 1.42 acres and is platted as Lot 1, Block 1 of Bank of Oklahoma Business Center One. The property is currently zoned CS under OPUD 02-01. SUBJECT PROPERTY DATA: Property Size 1.42 acres +/- Current Zoning Commercial Shopping (CS) Current Use Commercial Land Use Master Plan Commercial Within PUD? Yes; OPUD 02-01 Within Overlay? No Water Provider City of Owasso Sewer Provider City of Owasso APPROVAL PROCESS: According to Appendix B, Article XIII, Section 3 of the Owasso Zoning Code: "The Board shall hold the public hearing and, upon the concurring vote of three (3) members, may grant a Variance only upon a finding that: a. The application of the Code to the particular piece of property would create an unnecessary hardship; b. Such conditions are peculiar to the particular piece of property involved; c. Relief, if granted, would not cause substantial detriment to the public good or impair the purposes and intent of the Code or the Land Use Master Plan; and d. The Variance, if granted, would be the minimum necessary to alleviate the unnecessary hardship. The Board, in granting a Variance, shall prescribe appropriate conditions and safeguards, and may require such evidence and guarantee or bond as it may deem necessary to enforce compliance with the conditions attached." A Variance which has not been utilized within one (1) year from the date of the order granting the Variance shall thereafter be void." ANALYSIS: The 1.42-acre property is currently zoned CS, and currently has one ground sign (pole mounted) located near the northeast corner of the property which is also the southwest corner of the intersection of North Garnett Road and East 96t" Street North. OBOA 26-01 Page 2 • The subject property borders properties that are also zoned CS on all four sides. • Per the Owasso Zoning Code, a maximum of one ground sign is permitted for CS -zoned properties. Both pole signs and monument signs are interpreted as types of ground signage, as defined in the definitions of the Zoning Code. 0 This property is under OPUD 02-01; however, the Planned Unit Development (PUD) states that sign standards for CS -zoned properties will conform to the current City of Owasso sign ordinance. • The applicant is requesting a variance from the City of Owasso Zoning Code - Section 18.5, "Permitted Signs", to allow for the construction of one additional ground sign on CS - zoned property. Specifically, the applicant is asking to construct one illuminated monument sign to be placed northeast of the building. The proposed height is shown is 6'-9 '/2" tall from the base and 5'-5 '/4" wide. The sign area of the proposed sign is 31.26 square feet. As with any variance request, the determination must be made that the request meets each of the four (4) criteria outlined in Oklahoma State Statute and the City of Owasso Zoning Code. Attached with the staff report are the applicant's justifications for each of the four criteria. After reviewing said criteria, staff has made the following findings for each of the listed criteria: 1. The application of the ordinance to the particular piece of property would create an unnecessary hardship. Upon review of the property and applicant's responses, staff does not find that this piece of property has an unnecessary hardship that would be created by the application of the signage regulations found within the Zoning Code. The current ground sign on the property is located prominently on the northeast corner of the site and is clearly visible from the intersection as well as both major roads adjacent to the property. 2. Such conditions are peculiar to the particular piece of property involved. Staff does not find that there are any peculiar conditions to said property itself. The property is a standard double street frontage commercial lot and does not have any peculiarities in terms of shape, topography, line of sight, or access. The subject property as well as adjacent properties to the southwest and north, were developed under a previous iteration of the Owasso Zoning Code. The adjacent commercial properties to the east and northwest of this property are in the US-169 Overlay District. Since they do not have frontage with US-169, they are not permitted pole signs and are limited to 10' tall monument signs. Additionally, the current pole sign for the Bank of Oklahoma location appears to be the second tallest ground sign within the intersection. 3. Relief, if granted, would not cause substantial detriment to the public good, or impair the purposes and intent of the zoning ordinance or the Comprehensive Plan. Staff does not believe that this request would cause detriment to the public good. However, due to lack of justifiable hardship, Staff does not believe that the requested variance would meet the intent of the Owasso Zoning Code. 4. The variance, if granted, would be the minimum necessary to alleviate the unnecessary hardship. Staff believes there is not a justifiable hardship with this request. • In conclusion, staff finds that this particular variance fails to meet all four (4) of the criteria of the State Statues and Owasso Zoning Code, outlined above. OBOA 26-01 Page 3 0 Justifications from the applicant regarding the four criteria are provided within the agenda packet. Letters were mailed to all property owners within three -hundred (300) feet of the subject property and the request was advertised in the Tulsa World, per State Statute. As of the writing of this report, staff has not received any comments or concerns from adjacent property owners. These are the questions and responses. 1. AppLication of the Owasso Zoning Code requirements to this particular property will create unnecessary hardship. The proposed Beacon sign is intended to improve visibility and wayfinding for the Bank of Oklahoma location at a highly active commercial intersection. Due to the scale and visual prominence of adjacent commercial signage - including the Large Fairway Market pylon sign immediately neighboring the property - the bank's visibility is diminished from key vehicular approaches. This creates potential confusion for customers attempting to identify the bank location and locate the primary building entrance. The requested variance would allow the addition of a modest, pedestrian -scaled brand identifier that improves customer recognition and safe navigation to the site without substantially altering the character of the corridor. The sign is intended to function as supplemental wayfinding and brand identification in response to the unique visual conditions surrounding the property. 2. There are conditions peculiar to this property that do not apply to other properties in the same zoning district. This property is uniquely impacted by the intensity and quantity of surrounding commercial signage located at and near the intersection. Nearby properties, including the quil<Trip located across the street, utilize multiple sign types and sign placements, including multiple ground -mounted signs, building -mounted signs, and canopy -mounted signage. These surrounding visual conditions create a more complex commercial environment than is typical for similarly zoned properties. As a result, the Bank of Oklahoma site experiences reduced visibility relative to neighboring businesses, particularly at the pedestrian and vehicular approach level. The requested Beacon sign is intended to address these site -specific visibility and wayfinding challenges in a manner appropriate to the scale and function of the development. 3. The variance, if granted, will not cause substantial detriment to the public good or impair the purpose and intent of the Owasso Zoning Code or the Owasso 2030 Land Use Master Plan. The proposed Beacon sign will not negatively impact the public good, surrounding properties, or the intent of the Owasso zoning Code. The sign is designed as a high -quality architectural brand element that complements the building and enhances customer wayfinding without creating excessive visual clutter. The Beacon sign serves as a recognizable Bank of Oklahoma brand feature and assists visitors in identifying the primary entrance and navigating the site safely and efficiently. The addition of this sign will contribute positively to the overall customer experience while remaining consistent with the commercial character of the surrounding corridor and the broader goals of thoughtful development and clear site identification envisioned within the Owasso 2030 Land Use Master Plan. 4. The variance, if granted, would be the minimum necessary to alleviate the unnecessary hardship. The requested variance is limited and represents the minimum necessary to address the site's visibility and wayfinding challenges. The proposed Beacon sign is modest in scale and is intended to serve as a supplemental identifier rather than a primary or dominant signage element. The design has been intentionally kept proportional to the building and overall site, providing improved visibility without introducing unnecessary signage or visual clutter. The Beacon sign provides a focused solution while avoiding the need for larger or more prominent signage elsewhere on the site. This approach provides a solution to the identified hardship while maintaining compatibility with the overall character of the corridor. The subject property is located south of 10350 East 86th Street North and is an expansion of the business located at 10400 East 86th Street North. The property is currently unplatted. SUBJECT PROPERTY/PROJECT DATA: Property Size 0.797 acres +/- Current Zoning Commercial General (CG) / Commercial Shopping (CS) Proposed Use Warehousing and Self -Storage - Outdoor Vehicle Storage (expansion) Land Use Master Plan Commercial Within an Overlay District? No Within a PUD? No Lots/Blocks Unplatted Water Provider City of Owasso Sewer Provider City of Owasso APPROVAL PROCESS: According to Appendix B, Article XV, Section 4 of the Owasso Zoning Code: "The Board of Adjustment shall hold the public hearing and, upon the concurring vote of three (3) members, may grant the Special Exception after finding that the Special Exception will be in harmony with the spirit and intent of the Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. The Board, in granting a Special Exception, shall prescribe appropriate conditions and safeguards and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached." ANALYSIS: The subject property currently contains a restaurant on its northern portion and a vacant grassy area on its southern portion. This Special Exception request deals with the vacant grassy area specifically. The subject property is owned by the same entity that owns the mini -storage facility located on the adjacent property to the east. OBOA 26-02 Page 2 o This existing mini -storage facility, on the adjacent property, was developed under a previous iteration of the Owasso Zoning Code and is currently considered a legal non- conforming use. o This subject property is covered by two zoning districts. The adjacent residential properties are adjacent to the portion of the property that within the more intense zoning district (CG). A small portion of the subject property is zoned CS and it is located on the eastern side adjacent to the current self -storage use. o The subject property also includes a 25' portion of Right -of -Way (ROW) that is not being used currently for public purposes. Per the Public Works Director, the applicant is able to utilize this portion of ROW. • The applicant wishes to expand the aforementioned storage use to the southern vacant portion of the subject property, to allow for storage for small Recreational Vehicles (RVs), boats, and other vehicles. o Under Section 6.3.2 of the Owasso Zoning Code, storage -related uses are permitted in CG zoning districts so long as they are a part of a larger Planned Unit Development (PUD). However, under Section 6.3.1, storage -related uses are not permitted in CS zoning districts. o Thus, the applicant is asking for a Special Exception from the Owasso Zoning Code (Chapter 6, "Commercial District Provisions"; Section 6.3.2, "Permitted Uses in the CG District" and Section 6.3.1, "Permitted Uses in the CS District") to allow for the expansion of a use associated with warehousing and self -storage onto the property • After review of this Special Exception application, Staff has determined that the request would not be injurious to the surrounding neighborhood or negatively harm the intent or spirit of the Owasso Zoning Code. o The applicant has indicated in their application that no buildings would be constructed as part of this expansion; if approved, new hard -surface parking would be installed within the vacant grassy area. o The applicant also intends to replace the current fencing along the western and southern sides of the vacant area, and build a privacy fence along the perimeter of said area. These fencing improvements will provide additional buffering between the proposed expansion and the adjacent residential properties to the west and south. o The outdoor storage use would be further buffered from adjacent residential properties via the landscaping requirements found within Chapter 19 of the Zoning Code. ■ This would include a 10' landscape buffer, plantings of trees and shrubs along the western and southern property boundaries. ■ A site plan application will need to be provided to Staff, pending approval of this Special Exception, in order for Staff to verify these requirements. • Letters containing notification of this case were mailed to all property owners within three hundred (300) feet of the subject property, and notification was also posted in the Tulsa World in accordance with State Statute. o At of the time of the writing of this memo, staff has received no questions or comments regarding this application.
