Action Relating to the Extension of a Contract for Auditing Services for FY 1998 -99 Attachment #6 -C The staff recommends Council approval of a one year extension of a contract with the firm of Michael A Crawford Inc, Oklahoma City, OK, for the fiscal year ending June 30,1999. D. Action Relating to a Request for Council Acceptance of a Grant to Fund the Purchase of a Restaurant -Type Range for the Community Center. Attachment #6 -D The staff recommends Council acceptance of a grant from the Tulsa Area Agency of Aging in the amount of $1450 to be used for the purchase of a restaurant -type range for the Community Center, and authorization for the Mayor to execute the document. E. Action Relating to a Request for a Supplemental Appropriation and Amendment to the General Fund Community Center Department Capital Outlay Budget. Denise Bode, Mayor i OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, January 19, 1999 The Owasso City Council met in regular session on Tuesday, January 19, 1999 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 15, 1999. ITEM 1: CALL TO ORDER Mayor Bode called the meeting to order at 6:32 p.m. ITEM 2: INVOCATION The invocation was offered by Officer Kenny Yount of the Owasso Police Department. ITEM 3: FLAG SALUTE Councilor Voss led in the flag salute. Action Relating to Ordinance #600, an Ordinance Amending the Defined Contribution Retirement Plan for the City of Owasso. Mr Wilken moved, seconded by Ms Voss, to approve the consent agenda. The consent agenda included minutes of the January 5, 1999 regular meeting and January 12, 1999 Special Meeting, by Owasso City Council January 19, 1999 reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $83,825.48; (2) Workers Comp Self- Insurance $3,501.76; (3) Ambulance Service Fund $2,530.79; (4) City Garage $4,118.73; (5) Capital Improvements $1,786.50; (6) Capital Projects Grant $156,600.00; (7) Bond Projects Fund $91,327.94; (8) Interfund Transfers $4,110.54; (9) Interfund Transfers $47,147.21; (10) Payroll $157,159.53; (11) City Garage Payroll $3,631.17. Item C requested acceptance of the streets and stormwater drainage systems constructed to serve The Fairways IV. ITEM 6:- CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE PRESENTATION OF AN INDEPENDENT AUDIT OF FINANCIAL TRANSACTIONS FOR THE GENERAL FUND AND OTHER FUNDS FOR FY 1997 -98, AND A REQUEST FOR THE COUNCIL TO RECEIVE THE AUDIT REPORT. Mr Frank Crawford presented the 1997 -98 annual audit to the City Council and reviewed the audit findings. He commended city staff on the reporting procedures in place and for having such a good audit. Mr Wilken moved, seconded by Mr Smith, to receive the audit for review and information. AYE: Wilken, Smith, Voss, Bode NAY: None Motion carried 4 -0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE AWARD OF A CONTRACT FOR THE PURCHASE OF TWO MANUAL DEFIBRILLATORS. Chief Allen presented the item. He said that the manual defibrillators in use have exceeded their life expectancy and are in need of being replaced. Specifications were developed and bids received for Life Pak 12 manual defibrillators. One vendor responded and met all the requirements in the specifications. Ms Voss moved, seconded by Mr Smith, to award a contract for the purchase of two Life -Pak 12 manual defibrillators to Physio - Control Corporation of Redmond, VA at a total cost of $18,470.80. u if Owasso City Council January 19, 1999 AYE: Voss, Smith, Willken, Bode NAY: None Motion carried 4 -0. ' ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM A & W LAND DEVELOPMENT FOR ANNEXATION OF AN APPROXIMATE 71.62 -ACRE PARCEL OF LAND LOCATED NORTHWEST OF NORTH 109TH EAST AVENUE ADJACENT TO THE COUNTRY ESTATES II SUBDIVISION. Mr Warlick said that A & W Land Development has submitted a petition requesting annexation of approximately 71.62 acres located to the northwest of N 109`h East Ave, adjacent to the Country Estates II subdivision. The Owasso Annexation Committee reviewed the request on January 11, 1999 and recommended annexation by a vote of 4 -0. The Technical Advisory Committee also reviewed the request, discussing water and sewer service to the area, as well as street access. It appears that these issues can be easily resolved. The Planning Commission reviewed the request on January 12, 1999 and recommended approval by a vote of 5 -0. Ms Voss moved, seconded by Mr Wilken, to approve the requested annexation. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM THE LARKIN BAILEY FOUNDATION TO REZONE PROPERTY LOCATED BETWEEN MINGO ROAD AND GARNETT ROAD AND EAST 96TH _ STREET NORTH AND EAST 106TH STREET NORTH; FROM AG (AGRICULTURE) TO RS -3 (RESIDENTIAL SINGLE - FAMILY HIGH ' DENSITY) RM -2 (RESIDENTIAL MULTI - FAMILY) OL (OFFICE LIGHT), CG (COMMERCIAL GENERAL) AND CS (COMMERCIAL SHOPPING CENTER), CONTAINING 408.7 ACRES, MORE O_ R LESS. Mr Warlick presented the item. This item first appeared on the December 19, 1998 City Council agenda. However, there was an error in the legal description, and an error was also discovered in the legal description appearing on the December 8, 1998 Planning Commission Agenda. The Council tabled hearing the item until it could be taken back to the Planning Commission. That occurred on January 12, 1999, and the Planning Commission approved the request by a vote of 5 -0. Ms Voss moved, seconded by Mr Wilken, to approve the requested zoning. ei Owasso City Council January 19, 1999 AYE: Voss, Wilken, Smith, Bode NAY: None Motion carried 4 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM KOURTIS PROPERTIES LLC FOR COUNCIL APPROVAL OF A PLANNED UNIT DEVELOPMENT. Mr Warlick said that this is the same property contained in the previous item and also contained an erroneous legal description on the December 19, 1998 City Council agenda and December 8, 1998 Planning Commission Agenda. It was also referred back to the Planning Commission, who reheard the case on January 12, 1999. The Planning Commission recommended approval of PUD #18 with the following conditions: 1. That the applicant's Development Tex and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. That unless specifically set out in the standards and conditions of this PUD, all development in the proposed subject site shall be in accordance with the overlaying zoning districts as described in OZ -98 -14 and shall meet all the necessary requirements of the respective overlay districts. 3. That a subdivision plat be approved by the Owasso City Council and filed with the Country Clerk's office prior to the issuance of a building permit. Said covenants shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 4. That a reference on Page 23 of the PUD text pertaining to a lien being placed on a property owner's association member's "personal property" be changed to "real property ". 5. That minor transfers (15% increase in a development area's density) of dwelling units from one residential development area to another can occur if a significant change in the character of either development is not created. 6. That no building permits be issued within any portion of the PUD until all items in Chapter 8 "Building Permits" of the Owasso Subdivision Regulations are fulfilled. 7. All conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 8. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. 9. That within the PUD, the maximum number of dwelling units shall not exceed 1898 units. 10. That acceleration/deceleration lanes will be required at intersections with PUD collector streets on East 96`h Street North, East 106`h Street North, Garnett Road, and Mingo Road. 11. That the developer shall incorporate access management techniques in the development of ' commercial areas. Such techniques may include, but not be limited to, unified circulation rd II Owasso City Council January 19, 1999 and parking plans, joint access and parking lot cross access, restriction of the number of driveways per parcel, controlling driveway spacing, sight distance, and corner clearance. 12. That a barrier fence be erected between the SKO Railroad tracks and proposed commercial area near the corner of East 106" Street North and Mingo Road and the abutting multi - family area. 13. Detailed landscaping plans (type, species, size, location, and irrigation) shall be required to be submitted with site plans of any commercial development. Said plans will be reviewed by staff and must be approved by the Planning Commission. 14. That sidewalks be provided on all road frontage within the subject property, including East 96" Street North, East 106' Street North, Garnett Road, and Mingo Road. 15. That the minimum side yard of any corner lot be no less than 25 feet. 16. That all landscaping plans for the entrances shall be reviewed and approved by the Owasso Planning Commission and installed prior to the occupancy of any building. 17. That no flag lots are permitted within any portion of the PUD. 18. If needed, commercial areas may be required to provide on -site detention. This is to be determined at site plan review for commercial property. The developer was present and stated that he concurs with the conditions listed. Mr Wilken moved, seconded by Ms Voss, to approve the Planned Unit Development with the 18 conditions listed. AYE: Wilken, Voss, Smith, Bode NAY: None Motion carried 4 -0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO MAYOR'S APPOINTMENTS REQUIRING CONFIRMATION BY THE CITY COUNCIL. Mayor Bode said that John Phillips has moved out of the city limits and has submitted his resignation from the Board of Adjustment. She submitted the name of Dewey Brown to fill the opening created by that resignation. On November 17, 1998, the City Council confirmed appointments to a committee to provide guidance and assist in the drafting of an update to the Owasso Comprehensive Plan. One of those appointments was Joyce Kastner, representing citizens - at- large. Ms Kastner has found it necessary to resign for personal reasons, and Mayor Bode submitted the name of Mary Kelley to replace Ms Kastner on that committee. Mayor Bode moved, seconded by Mr Wilken, that Dewey Brown be appoint to the Board of Adjustment, and Mary Kelley be appoing to the Comprehensive Plan Update Committee. 5 Owasso City Council January 19, 1999 AYE: Bode, Wilken, Voss, Smith NAY: None Motion carried 4 -0. ITEM 12: REPORT FROM CITY MANAGER Mr Hancock thanked everyone for the flowers, cards, notes, and other expressions of kindness he received upon the death of this father. He also introduced his son, Clay, who was attending the council meeting as part of the requirements for a Boy Scout badge. Mayor Bode called the meeting to order at 6:33 p.m. Councilors present: Denise Bode, Mayor; Mark Wilken, Vice Mayor (in at 6:36); Mary Lou Barnhouse, Councilor; Melinda Voss, Councilor; Duston Smith, Councilor. Councilors absent: none. A quorum was declared present. ITEM 2: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING 1 PERSONNEL MATTERS RELATING TO THE OFFICE OF THE CITY MANAGER SUCH EXECUTIVE SESSION PROVIDED FOR IN O.S. 25, SECTION 307(B)(1). Ms Voss moved, seconded by Ms Barnhouse, to move into executive session for the purpose of conducting the City Manager's six -month performance review. AYE: Wilken, Barnhouse, Smith, Voss, Bode NAY: None Motion carried 5 -0 and the meeting was adjourned at 9:46 p.m. Marcia Boutwell, City Clerk Denise Bode, Mayor OWASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Tuesday, January 26, 1999 The Owasso City Council met in special session on Tuesday, January 26, 1999 in the Lower Level Conference Room at City Hall per the Notice of Public Meeting called on Monday, January 11, 1999, and Notice and Agenda filed in the office of the City Clerk and posted on the City Hall bulleting board at 4:00 p.m. on Monday, January 25, 1999. ITEM 1: CALL TO ORDER AND ROLL CALL. Mayor Bode called the meeting to order at 6:35 p.m. Councilors present: Denise Bode, Mayor; Mary Lou Barnhouse, Councilor; Melinda Voss, Councilor; Councilors absent: Mark Wilken, Vice Mayor; Duston Smith, Councilor. Others present: City Manager Jeff Hancock, Assistant City Manager Tim Rooney, City Clerk Marcia Boutwell, City Attorney Ron Cates, and Public Works Director Robert Carr. A quorum was declared present. ITEM 2: DISCUSSION OF WASTEWATER TREATMENT PLANT DESIGN ENGINEERING SERVICES. Mr Carr discussed the procedure followed in the selection of an engineering firm to design the next phase of the wastewater treatment plant improvements. No action was requested or taken. ITEM 3: DISCUSSION OF RIGHT -OF -WAY ACQUISITION POLICY. Mr Carr explained the reason for the need of a right -of -way acquisition policy. .. ITEM 4: DISCUSSION RELATED TO SLUDGE REMOVAL. W im 9 Mr Carr explained that the drying beds are full and that some solids will need to be removed. He estimates that ten truckloads will have to be removed each day for 2 -3 weeks and then one truckload each week. He anticipates having a proposal to present to the Council at the second meeting in February. ITEM 5: DISCUSSION RELATED TO PRECISION COMPONENTS. Mr Hancock updated the Council on talks with Precision Components related to their purchase of the building they occupy and some anticipated expansion. Owasso City Council January 26, 1999 ' ITEM 6. TULSA TECHNOLOGY CENTER UPDATE Mr Hancock updated the Council on talks with Tulsa Technology Center to locate a campus in the Owasso area. He said that Robert Tobias is working on a proposal. ITEM 7: REPORT FROM ASSISTANT CITY MANAGER Mr Rooney reported on several items, including a permit for Verdegris Valley to service customers in certain parts of Owasso, an expenditure for an additional building inspector, award of bids for two projects at the Owasso Sports Park, and the purchase of a vehicle for the additional building inspector. ITEM 8: DISCUSSION OF ITEMS RELATED TO PROPOSED CITY HALL AND POLICE FACILITY. Mr Hancock discussed the options that have been discussed relating to the construction and /or relocation of a city hall and police facility. The options are still be looked at. In February of 1998, the city accepted proposals for auditing services from accounting firms. Those proposals included a fixed fee for each of five years. The firm ' of Michael A. Crawford, Inc. was selected and a one -year contract was approved by the City Council. The auditors, Michael A. Crawford, Inc. have requested that their firm be retained at this time to enable them to schedule their audit plan for the coming year. The Audit Contract Cost Summary and Audit Engagement Letter are attached. The not -to- exceed fee of $21,200 itemized in the contract is consistent with the fees in the original five -year audit proposal. Finance department staff is pleased with the quality, expertise and cooperation provided by the firm and wishes to continue to utilize the services of Michael A. In fulfilling this responsibility, estimates and judgments by management are required to assess the expected benefits and related costs of the controls. The objectives of internal control are to provide management with reasonable, but not absolute, assurance that assets are safeguarded against loss from unauthorized use or disposition, that transactions are executed in accordance with management's authorizations and recorded properly to permit the preparation of general - purpose financial statements in accordance with generally accepted accounting principles, and that federal award programs are managed in compliance with applicable laws and regulations and the provisions of contracts and grant agreements. As part of obtaining reasonable assurance about whether the general - purpose financial statements are free of material misstatement, we will perform tests of the City of Owasso, Oklahoma's compliance with applicable laws and regulations and the provisions of contracts and grant agreements. However, the objective of our audit will not be to provide an opinion on overall compliance with such provisions, and we will not express such an opinion. Our audit will be conducted in accordance with the standards referred to in the second paragraph. An audit of financial statements conducted in accordance with generally accepted auditing standards, Government Auditing Standards, the Single Audit Act Amendments of 1996 and OMB Circular A- , 133, is not designed to detect whether a City's systems are year 2000 compliant. Further, we have no responsibility with regard to the City's efforts to make its systems, or any other systems such as those of the City's vendors, service providers, or any other third parties, year 2000 compliant or provide assurance on whether the City has addressed or will be able to address all of the affected systems on a timely basis. These are responsibilities of the City's management. However, for the benefit of management, we may choose to communicate matters that come to our attention relating ' to the Year 2000 issue. Our fee for these services will be at our standard hourly rates plus out -of- pocket costs (such as ' report reproduction, typing, postage, travel, copies, telephone, etc.) except that we agree that our gross fee, including expenses, will not exceed $21,200. Our standard hourly rates vary according , to the degree of responsibility involved and the experience level of the personnel assigned to your audit. Our invoices for these fees will be rendered each month as work progresses and are payable on presentation. The above fee is based on anticipated cooperation from your personnel and the ' assumption that unexpected circumstances will not be encountered during the audit. Another grant was received from TAAA in September of 1998 in the amount of $3466, to be used ' for the purchase of a commercial deep freezer for the Community Center. I The staff has applied for another grant from the TAAA in the amount of $1450 to be used to purchase a restaurant range for the Community Center. Notification has been received that all guidelines have been met, and that this grant has been awarded to the Center. A contract and an ' affidavit for the 1999 funding has been signed and returned to the Tulsa Area Agency on Aging. The staff requested and received three quotes for the range purchase, with the lowest quote received from Curtis Restaurant Supply Co. It is anticipated that the range currently being used at the Community Center will be transferred to the Fire Department to replace the aging range in use at that facility. RECOMMENDATION: The staff recommends City Council action to accept a grant from the Tulsa Area Agency on Aging in the amount of $1450 for the purchase of a restaurant range for the Community Center. The staff further recommends Council approval of a supplemental appropriation and amendment to the General Fund Budget, increasing estimated revenues by $1450 and increasing expenditures in the Community Center Department's Capital Outlay Budget (Machinery & Equipment line item) by $1450. JEFF HANCOCK CITY MANAGER 1 �1 u° FROM: M.A.ALEXANDER, CHIEF OF POLICE SUBJECT: REQUEST APPROVAL FOR SUPPLEMENTAL APPROPRIATION TO POLICE DEPARTMENT BUDGET DATE: January 25, 1999 BACKGROUND: I� In May of 1998, the Owasso Police Department competed for and was awarded a contract from the Owasso Public Schools to provide searches of the public schools by utilizing the police drug ' detector canine. This service was to be provided to the schools for a cost of $10,000 for the 98 -99 school year. Even though this commitment reassigned a full time police officer that would normally be working patrol duties, the department felt the commitment would have a positive ' impact for the police department, the public schools and the community. The $10,000 received from the school was a source of income not budgeted or expected during the last budget process. The intent of the use of these funds would be to purchase a second canine, in the event that the ' current canine becomes unable to perform his daily duties. These funds can also be used for additional training or other needs within the police department budget. Secondly, the Owasso Police Department participates in Drug Asset forfeiture programs with adjoining law enforcement agencies. When property, vehicles, etc., are confiscated from suspects involved in drug activity, the assets are divided and shared between all participating agencies after appropriate judicial process and review. The funds received from this account must be used in criminal investigation purchases as mandated by state statute. The Criminal Investigations Unit requested approval to use these funds toward the purchase of computers and equipment over one year ago. Since the City of Owasso was in the selection process for computers and equipment, the request from the CIU was postponed. Recently, the police department received four (4) new computers. These computers were identified for placement in high volume use areas. Since the CIU received no new computers or equipment, approval was granted for these funds to be used to purchase the needed equipment. The new computers are the exact make, model and style of the new computers recently installed within the city. �. I I Supplemental Appropriation Request January 25, 1999 Page 2 The computers and equipment were purchased with city funds initially, although complete reimbursement has been received from the U.S. District Attorney's office. Therefore, staff requests the amount of the purchase of the computers ($4,856.00) be returned to the Police ' Department line item 51- 310 -5441. Lastly, in October of 1998, the U.S. Air Force requested the use of the firearm range for the 1 98 -99 military fiscal year. The military paid the City of Owasso $2,000.00 for the use of these facilities. These funds will be used to provide targets, target stands, clips, etc. for range use as , agreed and approved by the City Council. Staff requests that $2,000.00 be placed in the Operating Supply line item 52- 310 -2441 for purchase of these items. RECOMMENDATION: Staff recommends Council approval on a supplemental appropriation to the Police Department Budget in the amount of $16,856.00. Country Estates III is a 17.37 acre development adjacent to Westport to the west, and the other phases of Country Estates to the east and northeast. The subject site is proposed to contain 61 lots in an existing RS -3 (Residential Single - Family High Density) zoning district. POINT BY POINT ANALYSIS 4.1 Computer Models - Test Stations 4.1.1 Infield test stations for the horizontal field measurements shall consist of 25 points covering 80'x 80' on an equally spaced 20'x 20' grid (commending 10' outside each baseline). ' 4.1.2 Outfield test stations for the horizontal illumination levels should cover the entire outfield area to fence starting 10' outside the foul strip. LUMINAIRE STRUCTURE 7.1 Factory Construction 7.1.1 The lamp and reflector mounting device shall be factory assembled to the crossarms and the crossarms shall be attached to a section of the pole by the manufacturer. 7.2 Single Photometric Unit 7.2.1 Each reflector shall be attached to the crossarm in such a way that its aiming position has been determined relative to all other fixtures on the pole so that in the factory all luminaires on the assembly are oriented to form a single photometric unit. 7.3 Lamps 7.3.1 Lamps shall be 1500 watt metal halide and shall be manufactured by GE, Philips, or Sylvania. Venture lamps will not be used and no other type of lamps will be considered. 7.3.2 The reflector shall be fastened to the lamp cone with a reinforcing retaining ring containing an acrylic compressed fiber ring which centers and stabilizes the lamp in the reflector and provides heat shield to protect the lamp socket from heat. 7.4 Lens 7.4.1 A removable lens of impact and thermal resistant glass with silicone gasket shall be centered in a stainless steel lens rim and attached to the reflector with a hinged cable or chain. 7.5 Aiming 7.5.1 The manufacturer shall provide a memory positioning device for each luminaire on the assembly. The device shall provide for automatic repositioning of the aiming after relamping. 7.6 Field Alignment 7.6.1 Luminaire assembly shall be provided from the factory to the job site as a unit which may be universally oriented in a manner that the entire luminaire assembly can be field aimed as a single unit. The fixtures that will be added to the existing Al, A4, and B 1 poles will be field aimed by the contractor according to existing aiming diagram, to be compatible with existing facilities. PROJECT SPECIFICATIONS 1298 00900 - Page 5 of 17 8.2 Strain Relief Slippage 8.2.1 There shall be protection around the conductors, in addition to the insulation, to protect from damage from the wire mesh grip and also to avoid slippage of the grip on the wire harness. The wire mesh grip shall also be clamped to the harness with a cable tie at the bottom of the grip to avoid loosening. 8.3 Pole Attachment 8.3.1 The wire mesh grip shall be mechanically attached to the pole to an enclosed mounting loop so that it cannot accidentally be removed in any direction. 8.4 Spiral Winding 8.4.1 The harness being supported by the wire mesh grip shall consist of multiple 14 gauge THHN conductors and shall be continuously spiral wound and bound with mylar wrap to prevent slippage of individual conductors within the wiring harness. Additionally, a cable tie shall be tightly wrapped around the harness at not more than 10' increments. 8.5 Abrasion Bumper 8.5.1 There shall be provided a 2' below the wire mesh grip and then at not more than 10 ft intervals along the entire length of the wire harness, an abrasion protective bumper ' device of soft, durable abrasive resistant material not less than 2" in diameter attached around the wiring harness to protect the harness from striking and being abraded by the interior surface of the pole. 8.6 Labeling ' 8.6.1 All wiring harness conductors shall be color -coded and clearly labeled. 8.7 Plug -Ins 8.7.1 Each end of the wire harness shall be terminated into a plug -in with conductors sequenced consistent with the pattern of the wiring schematic provided by the manufacturer. ' 8.8 Testing 8.8.1 All conductors and plug -ins shall be tested for resistance underload, for continuity, schematic sequence, and for insulation integrity. Manufacturer shall ship with the wire harness a copy of the test results. PROJECT SPECIFICATIONS 1298 00900 - Page 7 of 17 II 8.9 Grounding 8.9.1 There shall be included within the wiring harness one conductor for use as a grounding conductor. The grounding conductor shall be equal in size to the load carrying conductors. 8.10 Harness for the Existing Structures - Pole A1, A4, B1 8.10.1 Harnesses for the existing structures will also be provided by contractor in this contract, and shall be compatible with existing structure. ARTICLE 9. ELECTRICAL COMPONENT ENCLOSURE (ECE) 9.1 NEMA 3R 9.1.1 The ECE shall be a NEMA 3R rated gasketed enclosure to house the ballasts, capacitors, fuses, thermal magnetic circuit breaker, and distribution lugs. 9.2 Two Compartments 9.2.1 The ECE shall be divided into two compartments. The upper compartment shall house the ballasts, capacitors, and fuses. The lower compartment shall provide for the thermal magnetic circuit breaker, distribution lugs, and connection of all circuits coming into and out of the ECE. 9.3 Galvanize 9.3.1 The ECE shall be heavy hot dip galvanized to ASTM A -123 standards after fabrication to a thickness of not less than 3 mils. Continuous galvanized materials will not be accepted. 9.4 Stainless Steel 9.4.1 All latches, hinges, and non - current carrying fasteners, either outside or inside the enclosure, shall be stainless steel and shall further be coated with a clear thermoset polymer coating such as Empigard to prevent galvanic interaction. 9.5 Hinged Door Access 9.5.1 The access door to the ECE shall be attached by a full - length stainless steel hinge and shall be secured when closed by lockable stainless steel latches. PROJECT SPECIFICATIONS 1298 00900 - Page 9 of 17 9.13 Wire Harness Connection 9.13.1 The wiring harness circuits from the lamps shall be attached to the ECE circuits by U.L. recognized plug -in connectors. 9.14 Grounding 9.14.1 There shall be provided in the ECE located in the lower compartment of the enclosure one equipment grounding lug rigidly fastened to the enclosure, sized to accept up to a 1/0 conductor. There shall also be provision in the upper compartment for a ground terminal of sufficient size to permit connection of the grounding conductors from the capacitors and the ground wire from the wiring harness. 9.15 Ballast Type 9.15.1 There shall be an individual ballast for each luminaire. The ballast shall be a lead peak auto - regulating ballast and be available for use with 480 volt supply. The ballast shall be located remote from the luminaire crossarm and shall be placed approximately ten (10) feet above ground level. Ballast box must be a NEMA 3R enclosure and must be manufactured by the luminaire assembly manufacturer and all mounting hardware shall be included with the ballast box assembly. The remote ballast system described above shall be located on the same pole as the luminaire assembly in the NEMA 3R enclosure with the capacitors and the capacitors shall operate in ambient air not to exceed 70 degrees. C. The assembly design shall be adaptable to various standard ballast and must retain U.L. listing. 9.16 Drawings Attached 9.16.1 The manufacturer shall provide an electrical schematic of the ECE circuits, which schematic shall be of a durable materials and affixed to the inside of the ECE door for use by maintenance personnel. 9.17 Location 9.17.1 The ECE shall be attached to the pole with the lower end approximately 10 feet above grade at the pole foundation. 9.18 U.L. Listing 9.18.1 The ECE shall be listed by U.L. both for use with 90 degrees C rated supply conductors and as suitable for use in wet locations. PROJECT SPECIFICATIONS 1298 00900 - Page 11 of 17 10.5.3 All exposed steel components of the pole shall be at least 18" above the surface of the ground to avoid exposure of the steel to the heavily moisture and oxygen laden air, both above and below the surface. There shall be a cap to cover the top of the pole so that rain will not enter the interior of the pole. 10.5.4 To avoid stress corrosion of the pole, there shall be no critical stress points of the steel portion of the pole within 18" of the ground. ARTICLE 11. FOUNDATION - B6 POLE ONLY 11.1 Safety Factor 11.1.1 Broms safety factor of three (or UBC) shall be used in the foundation design. 11.2 Foundation Strength 11.2.1 Any concrete portions of the pole in which steel components that provide tension strength are contained, shall be allowed to harden for a minimum of 28 days before stress loads of pole attachment are applied. 11.3 Concrete Material 11.3.1 The foundation of the pole shall be constructed of not less that 9500 psi pre - stressed centrifically cast concrete such that the steel reinforcement within the concrete shall be protected from slippage and exposure to oxidation through voids in the concrete or exposure of the steel through porous concrete material. 11.4 Soil Conditions 11.4.1 The design criteria for these specifications are based on soil conditions with 2000 psf soil at the surface. It shall be the contractor's responsibility to notify the owner of soil conditions other than the design criteria. The owner shall then be responsible and absorb the additional costs associated with: 11.4.1.1 Providing engineered foundation/embedment design by a registered engineer in the State of Oklahoma for soils other than specified soil conditions. 11.4.1.2 Additional materials required to achieve alternate foundation. 11.4.1.3 Excavation and removal of materials other than normal soils, such as rock, caliche, etc. PROJECT SPECIFICATIONS 1298 00900 - Page 13 of 17 12.4.5 The contractor shall furnish to the owner of the facility 5% extra lamps and 6 extra fuses for future use. ARTICLE 13. INSTALLATION - B6 POLE ONLY ' 13.1 Weight and Size 13.1.1 To permit ease of handling of material at the job site and to avoid damage to the ' existing facility, no single component of the pole shall be in excess of 1840 lbs, nor greater than 41' in length. ' 13.2 Backfill ' 13.2.1 The pole base shall be installed in an excavation as prescribed by the Broms or UBC standards for foundation design. Concrete backfill is required. ' 13.3 Assembly 13.3.1 The pole base shall be separate from the pole such that the base may be installed, ' properly plumbed, and enlarged as to the bearing surface by concrete backfill, allowing for inspection prior to the attachment of the steel pole. ' 13.4 Electrical Wiring 13.4.1 The pole and the luminaires shall be designed such that all wiring remains ' underground before entering the base of the pole, and that no wiring shall be exposed to sun or weather as it transitions through the pole and to the ballast and on to each lamp. 13.4.2 There shall be provided anon-threaded hot -dip galvanized steel or concrete - enclosed raceway for transition of the pole feeder conductors from the trench to the ECE. 13.5 Field Connections 13.5.1 All field electrical connections on the pole shall be achieved by U.L. listed plug -in or lug method of attachment from the load side of the breaker /disconnect to the lamp socket. The feeder and grounding conductors from the service entrance to the pole shall be connected at the pole by landing lugs. ARTICLE 14. PATENT RIGHTS AND INFRINGEMENT 14.1 There are various established performance criteria throughout this request for products and services. (Refer to 7.9 "Structural Strength "). 14.7 Complete UL Test Report - Bidder shall supply for the owner's review and retention a copy of the Underwriters Laboratory report covering the luminaire assembly being bid. 14.8 Manufacturer shall submit in writing a minimum of five similar lighting projects in the state of Oklahoma where the specifications outlined have been met. Include the project name, contact person and telephone numbers. 14.9 Manufacturer shall submit a letter guaranteeing that footcandle levels and uniformities as specified will be met. In addition, manufacturer's remedy to deficiencies will be noted. 14.10 There shall be provided by the pole supplier sufficient data and calculations to show that the specified criteria will be met. 14.11 Manufacturer shall submit a test report confirming that capacitors operate at 70 degrees Celsius. CAPITAL PROJECTS MANAGER TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: AWARD OF BID FOR THE PROPOSED FOUR -PLEX FACILITY OWASSO SPORTS PARK DATE: January 25, 1999 BACKGROUND: In October of 1997, the citizens of Owasso approved a 10 million dollar bond issue for Capital Improvement Projects within the City of Owasso. The projects included for funding within that bond issue included street and intersection improvements, remodeling and expansion of existing facilities and improvements to the Owasso Sports Park. Included as one of the Sports Park improvements was the construction of a new Four -Plex Facility. The architect /engineer (A/E) for the project, C112MHill/ Planning Design Group prepared plans and ' specifications for the project under the direction of City Staff. The Four -Plex project consists of adding four new softball/baseball fields to the site on the southwestern corner of the Sports Park. The original project scope was to construct the four fields, which included clearing and grubbing the existing trees on site, grading, drainage ditches; install new fighting, backstops, fencing, dugouts, sod, and imported "infield" dirt; and to include an irrigation system and paved walkways, if funds allowed. Bids were submitted for consideration and were opened on October 20, 1998. Three bids were received and the low bid was $144,677.60 over the Four -Plex budget. In order to reduce this deficit, surplus funds remaining from the parking lot construction earlier this year were added to the Four Plex budget. This resulted in a "new" deficit of $30,875.91 over the available project funds. Therefore, staff recommended that Council reject all bids and authorize a re -bid of the project after reductions in project scope were made. Staff met with the designers and reduced the project scope to construct four fields without fighting for night play. The fighting of two fields and electrical controls for all four fields were included as Additive Alternate One (Al), the lighting of the remaining fields was included in Additive Alternate Two (2) and sodding of the outfields was included as Additive Alternate 3 (A3). The alternates were included in the event that a low bid was submitted that would allow extra work to be performed. The second series of bids for the four -plex were opened on January 18, 1999 and a total of six (6) bids were received. FUNDING AND ADDITIONAL COMMENTS Funding for this project was included within the package of Sports Park Improvements that were approved by the voters in the fall of 1997. $215,700 was available after Project Coordinator and Engineering/Architectural Fees were deducted. An additional $61,220 is available to be applied to this project as a result of cost savings from the construction of the gravel parking lot earlier this year. Staff has reviewed the submitted low bid and is comfortable that all bid requirements have been met by Frix and Foster Construction. The bid submitted by Fixx and Foster Construction allows for both the base bid (construction of the four -plex) and the Add Alternate #1 (Lighting for two of the four fields and underground conduit, wiring, and necessary controls for the remaining two fields) to be awarded at this time. Increases in both commercial and residential permit activity over the last several years, as well as significant increases in inspection activity within the last six months, have resulted in the need for the Community Development Department to add an additional building inspector position in order to continue to perform accurate and quality inspections. Information regarding the history of permit activity for the City of Owasso, as well as recent inspection activity, is attached for your information and review. ' A review of the Community Development Budget, the amount of funds existing within that budget and the amount of funds needed in order to successfully add another building inspector, indicates a need for a Supplemental Appropriation of $6,000 to the Personal Services series of that budget. If a supplemental ' appropriation of $6,000 is provided by the Council, coupled with several minor changes of departmental priorities, adequate funds would then be available for the remainder of the fiscal year. Currently, Building Permit Revenue within the General Fund is budgeted at $196,000. As of December 31, 1998, after completion of 50% of the budget year, 67% of the revenues had been received. Projections ' for the remainder of the budget year are for this revenue source to remain at or slightly above normal. If Building Permit Revenue is increased $6,000 to $202,000, 62% of the necessary revenues to meet that budgeted amount have been collected as of December 31, 1998. Staff is anticipating no concerns in ' meeting that revenue expectation. If the Supplemental Appropriation is approved, it will also be necessary to purchase an inspection vehicle in order to provide transportation for the new position. Over the last two budget years, carry-over funds have been requested for the Community Development Department budget in anticipation of the need to purchase a vehicle for this reason. Currently, $17,000 is contained within the Capital Outlay portion of the Community Development Department budget for this purchase. No additional funding will be needed. Either option generally provides for the establishment of a fee for such privilege and sets forth terms and conditions for the utility provider. Proposed Ordinance No. 604 provides Verdigris Valley Electric Cooperative with an Electric Permit within the City of Owasso. The permit would allow Verdigris Valley Electric Cooperative to serve residents living within The Greens at Owasso and the Owasso Golf and Athletic Club. ' In addition to providing a permit for the above described service area, Ordinance No. 604 provides for the payment of a permit fee to the City of Owasso as compensation for the right and privilege of service. This ' fee is equal to a sum of two percent (2 %) of the gross receipts from the sale of electricity within the above described area and is equal to the fee paid by the City of Owasso's other electric utility provider, Public Service Company of Oklahoma. The permit is revocable at any time for cause but in no event will the term exceed twenty -five (25) years. ,.. An emergency clause, which is required to be acted on by the Council as a separate item, is attached to Ordinance No. 604. This allows for the collection of the permit fee upon passage and is the next item on the Council agenda. GRAN] OF PERMIT There is hereby granted by the City of Owasso, a municipal corporation of the State of Oklahoma, (hereinafter referred to as the "Permittor "), unto the Verdigris Valley Electric Cooperative, an Oklahoma Rural Electric Cooperative, its successors and assigns, (hereinafter referred to as the " Permittee") the nonexclusive right, power and authority to use the streets, alleys, avenues, ways and other public places of Permittor, located within the Greens at Owasso and the Owasso Golf and Athletic Club, a subdivision within the City of Owasso, Tulsa County, Oklahoma, according to the recorded plat thereof, as well as the right of way on the western side of 129"` East Avenue from East 76' Street North northerly to the entrance of the Greens as well as a road bore thereat into the Greens as depicted on Exhibit "A" hereto, for the purpose of building, equipping, maintaining, extending, owning and operating a plant and /or system for the manufacture and /or distribution and sale of electricity for lighting, heating, and power purposes as electric energy may be put, in and to the Permittor and the public generally. SECTION 2, TERM OF PERMIT All rights and privileges granted by this ordinance shall extend and be in force between the Permittor and the Permittee from and after the acceptance of this ordinance, unless revoked, as hereinafter provided, but in no event shall such exceed twenty -five (25) years. s[ ' SECTION 3 TERMS APPLICABLE TO StJCCFCCORS ANn ASSIGNS All provisions of this ordinance which are obligatory upon or which inure to the benefit of the Verdigris Valley Electric Cooperative, shall also be obligatory upon and shall inure to the benefit of the successors and assigns of the Verdigris Valley Electric Cooperative, and the word "Permittee" in this ordinance shall include and be taken to mean not only the Verdigris as used Valley Electric Cooperative, but also its successors and assigns, for which assignment consent is hereby given. SECTION a gFGUn ATIONS OE P1;�R_M1TTE Permittee shall have the right to make and enforce reasonable rules and regulations for the ' sale, delivery and metering of its electric energy and the conduct of its business, and may reserve in such rules and regulations the right to disconnect service to customers whose meters, wires, with, or who have failed to pay for ' switches, or appliance are found to have been tampered to enter upon the premises of its customers at all reasonable times for the purpose electricity, and of inspecting, repairing or reading meters or for removing wires, meters, switches or appliances be in conflict with law or the rules and Provided that such rules and regulations shall not time to time made by the Corporation Commission of the State of Oklahoma or regulations from by other regularly constituted regulatory authority. SECTION 9 PERMIT FEE From and after the approval and acceptance of this ordinance, the Permittee shall pay, and in consideration of the granting of this Permit agrees to pay, to Permittor as a permit fee, and as a compensation for the right and privilege enjoyed hereunder, a sum equal to two percent (2 %) of its gross receipts from the sale of electric energy within the city, payable monthly on or before the 20ih day of each month, on such receipts for the preceding calendar month, which fee shall be in lieu of all concessions, charges, excise, franchise, licenses, occupation, privilege or taxes, except assessments for special improvements and ad valorem taxes. SECTION 10 ACCEPTANCE BY PFRMITTEE This ordinance shall be in full force and effect from and after its acceptance as hereinafter provided, upon its passage and publication. It is understood and agreed that the Permittee shall within thirty (30) days after passage hereof, file with the Clerk of the City an acceptance in writing duly executed according to law, accepting this ordinance SECTION I I REVOCATION OF PERMIT The permit herein provided for may be revoked by the City Council at any time, after thirty (30) days notice to .Permittee and an opportunity for hearing thereon, for Permittee's failure to perform in accordance with the terms of this ordinance SECTION 12 EMERGENCY Due to the imminent need for provision of electric service to the areas herein referred to an emergency is hereby declared to exist whereby the provisions hereof shall become effective immediately upon passage and publication as provided by state law, APPROVED this 2d day of February, 1991), with the Emergency Clause voted upon and approved separately. Cates, City Attorney 2780 -387 ord vve r i EXHIBIT "A" N An� (3q�G f III r 7G '" MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: BOB ALLEN FIRE CHIEF SUBJECT: DONATION OF RESCUE TRAILER DATE: January 20, 1999 BACKGROUND: During the last two (2) years, the Capital Outlay and Equipment Team has worked to develop a list of equipment that is required for special rescue situations. Last year we were able to purchase approximately $3500 of rescue equipment. However, none of the vehicles currently assigned to the department have adequate storage space available to house all of the department's rescue equipment. In order to have all the necessary equipment available, several vehicles now need to respond to a special rescue situation. The Equipment Team requested that a rescue trailer be purchased. Due to the cost of the type of trailer needed, monies would not be available for several years. In August 1998, Firefighter/Intermediate Mike Holcomb met with the Board of Directors of Verdigris Valley Electric Cooperative, (VVEC), with the idea of donating a trailer for rescue operations. In October 1998, VVEC, in cooperation with Classic Trailers, located in Catoosa, agreed to donate a sixteen (16) foot fully enclosed cargo trailer to the Owasso Fire Department for use with the Special Operations Team. Due to community spirit and the desire to enhance the emergency services for Owasso and surrounding cities, we are now able to provide a service that would not otherwise be possible for several years to come. The staff recommends the City Council's acceptance of the donated rescue trailer from Verdigris Valley Electric Cooperative. Estimated value of this rescue trailer is $9300.
