Tuesday, February 2, 1999
The Owasso City Council met in regular session on Tuesday, February 2, 1999 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted
on the City Hall bulletin board at 4:00 p.m. on Friday, January 29, 1999.

the purchase of a restaurant -type range for the Community Center, and authorization for the Mayor

Fund Budget, increasing estimated revenues by $1450 and increasing estimated expenditures in the

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR CITY COUNCIL APPROVAL OF A FINAL PLAT FOR COUNTRY
ESTATES III AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY,
OKLAHOMA.
Mr Rooney presented the item. A & W Land Development has submitted a revised final plat for
Country Estates III. Country Estates III is a 17.37 acre development adjacent to Westport on the
west and the other phases of Country Estates on the north and northeast. The subject site will
contain 61 lots in an existing RS -3 zoning district. The Technical Advisory Committee reviewed
the plat at their December 23, 1998 meeting and their recommendations have been incorporated into
the final plat. The Owasso Planning Commission approved the revised final plat at its January 12,
1999 meeting, and construction plans have been approved by the Public Works Department. Water
and sanitary sewer plans have been approved by the Oklahoma Department of Environmental
Quality. Ms Barnhouse moved, seconded by Mr Smith, to approve the revised final plat for Country
Estates III

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR LIGHTING AT THE OWASSO SPORTS
PARK.
Mr Rooney said that the 1998 -99 Park Maintenance Budget contains an appropriation for the
purpose of providing lighting for one ball field at the existing four -plex utilized by FOR baseball.
A bid packet for the lighting of the T -Ball field was developed in December. Three contractors
supplied bids for the light of the field, and a review of the bids indicated that Shawnee Lighting
Systems of Shawnee, OK submitted the lowest bid. Mr Wilken moved, seconded by Ms Barnhouse,
to award a contract for the lighting of T -Ball Field 91 at the Owasso Sports Park to Shawnee
Lighting Systems Inc, Shawnee, OK, in the amount of $21,720.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR CONSTRUCTION OF FOUR
SOFTBALU/BASEBALL FIELDS AT THE OWASSO SPORTS PARK.
Mr Rooney presented the item. One of the projects included in the 1997 bond issue for capital
improvement projects was the construction of a new four -plex facility at the Owasso Sports Park.
The project was advertised and bids were opened on October 20, 1998. Three bids were received,
all of them considerably over the budget. The project was redesigned and the scope reduced and the
project was re -bid. The second series of bids was opened on January 18, 1999, with a total of six
bids being received, all of them significantly lower than the first set of bids. Award of the bid will
allow for the construction of the new four -plex, lighting two of the newly - constructed fields, and
installation of all underground conduit, wiring, and necessary controls for the lighting of the
remaining two fields. All bids have been reviewed and staff recommended award of the bid to the
lowest bidder. Mr Wilken moved, seconded by Ms Barnhouse, to award a contract for the
construction on the additional Owasso Sports Park four -plex to Frix & Foster Construction,
Muskogee, OK, in the amount of $267,308, representing the base bid and alternate #1.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR A SUPPLEMENTAL APPROPRIATION TO THE GENERAL FUND
COMMUNITY DEVELOPMENT DEPARTMENT BUDGET.
This item requested an appropriation for an additional building inspector. Mr Rooney said that
increases in both commercial and residential permit activity over the last several years have resulted
in the need for an additional inspector to perform accurate and quality inspections. Staff believes
that building permit revenues have increased enough to cover the expense of an additional inspector
for the remainder of the fiscal year, if coupled with several minor changes of departmental priorities.
Mr Wilken moved, seconded by Ms Barnhouse, to approve a supplemental appropriation to the
General Fund budget, wherein building permit revenues are increased by $6000 and expenditures
in the Community Development Department Personal Services are increased by $6000.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
ORDINANCE #604, AN ORDINANCE GRANTING AN ELECTRIC PERMIT TO
VERDIGRIS VALLEY ELECTRIC COOPERATIVE.
' Mr Rooney presented the item. He said that in order to provide utility service within the City of
Owasso, utility providers must first have a franchise or permit to provide that service. Either option
generally provides for the establishment of a fee for such privilege and sets forth terms and
conditions for the utility provider. Ordinance #604 provides Verdigris Valley Electric Cooperative
with an Electric Permit within the City of Owasso. The permit will allow VVEC to serve residents
' living within The Greens at Owasso and the Owasso Golf and Athletic Club. Ordinance #604 also
provides for the payment of a permit fee to the City of Owasso as compensation for the right and
privilege of service. This fee is equal to the sum of two percent of the gross receipts from the sale
of electricity within the service area, and equal to the fee paid by the City of Owasso's other electric
utility provider. The permit is revocable at any time for cause, but in no event will the term exceed
25 years. Mr Wilken moved, seconded by Mr Smith, to approve Ordinance #604.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR THE ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE
#604.
An emergency clause has been attached to Ordinance #604 to allow for the ordinance to become
t effective immediately upon passage by the City Council. Mr Wilken moved, seconded by Mr Smith,
to approve an emergency clause to Ordinance #604.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
DONATION OF EQUIPMENT.
Deputy Chief Stuckey said that one of the pieces of equipment needed by the Fire /Ambulance
Department is a rescue trailer of adequate size to house all of the department's rescue equipment.
Firefighter Mike Holcomb met with the Board of Directors of Verdigris Valley Electric Cooperative
in August 1998 to discuss the donation of a trailer for rescue operations. In October 1998, VVEC,
in cooperation with Classic Trailers of Catoosa, OK, agreed to donate a 16 -foot fully enclosed cargo
trailer. That donation will allow the Owasso Fire /Ambulance Department to provide services that
otherwise would not be possible. Deputy Chief Stuckey thanked the Board of Directors of VVEC

and Classic Trailers for the donation, and TrimRite of Tulsa for providing the lettering. Ms
Barnhouse moved, seconded by Mr Smith, to accept the donation of the rescue trailer from Verdigris
Valley Electric Cooperative.

MINUTES OF SPECIAL MEETING
Tuesday, February 9, 1999
The Owasso City Council met in special session on Tuesday, February 9, 1999 in the Lower Level
Conference Room at City Hall per the Notice of Public Meeting called on Monday, February 2,
1999, and Notice and Agenda filed in the office of the City Clerk and posted on the City Hall
bulletin board at 4:00 p.m. on Monday, February 8, 1999.
ITEM 1: CALL TO ORDER AND ROLL CALL.
Mayor Bode called the meeting to order at 6:35 p.m..
' Councilors present: Denise Bode, Mayor; Mark Wilken, Vice Mayor; Mary Lou Barnhouse,
Councilor; Melinda Voss, Councilor; Duston Smith, Councilor. Others present: City Manager Jeff
Hancock, Assistant City Manager Tim Rooney, City Clerk Marcia Boutwell, City Attorney Ron
Cates, Public Works Director Robert Carr, Support Services Director Jim McElrath, Police Chief
Maria Alexander, Capital Projects Manager Dwayne Henderson, Morris Strom, and Roger Voss.

A quorum was declared present.
ITEM 2: DISCUSSION OF RADIO BIDS.
Chief Allen gave some background information concerning the procedure followed in determining
what radios are needed and the use of an engineering consultant in preparing bid documents and
assisting in evaluating the bids received. Mr Morris Strom of EIS Communications presented an
analysis of the bids and the recommendation to purchase an 800 MHz system. He said the that
purchase and installation of the system will be less than the $200,000 budgeted amount. He said the
bid submitted by Total Radio comes closer to APCO 16 compliance than the Kenwood system.
Even though all of the APCO 16 features are not a part of this system, the radios will be APCO 16
compliant when they are used on the Tulsa system. Other discussion included range of the system
and "dead spots ". Chief Allen said that the City of Owasso will be able to utilize Tulsa's towers.
Mr Strom said that the recommendation to purchase the system will be subject to the City being able
to obtain licensing.
ITEM 3: DISCUSSION RELATED TO REFUSE TRUCK MAINTENANCE SCHEDULE.
Mr Rooney said a review team has looked at what has been spent on repairs to the refuse vehicles.
With the limited number of vehicles, it has not been possible to rotate vehicles out of service to do
preventive maintenance. The purchase of the new vehicle will allow for a rotation and that schedule
is being developed. One vehicle at a time will be rotated out of service for review, with each review
taking approximately one week. Councilor Voss asked if a maintenance plan has been established
to be utilized after all vehicles have been reviewed and repaired. Mr Rooney said that a maintenance
plan is still being developed.

ITEM 4: DISCUSSION RELATED TO LECHATE DISPOSAL/LANDFILL AGREEMENT.
Mr Carr said that costs for waste disposal will probably be going up because BFI plans to go out of
business, leaving only Waste Management. For that reason, there is a need to enter into a long -term
(20 -25 year) agreement with Waste Management. He also said that Waste Management will pave
the road to the lechate disposal site. Referring to the last study session, he said that the cost for
disposal of one truck load of sludge is $600, and the City is exploring other options.
ITEM 5: DISCUSSION RELATED TO INTERLOCAL AGREEMENT WITH TULSA
COUNTY FOR GOLF COURSE PARKING LOT AND DRAINAGE WORK AT
VARIOUS LOCATIONS.
Mr Carr discussed the proposed Interlocal Agreement with Tulsa County to pave the parking lot at
the new clubhouse at the golf course. The City of Owasso will provide materials and traffic control
and Tulsa County will provide the labor and equipment. They will also do some drainage work.
ITEM 6. DISCUSSION OF ITEMS RELATED TO PROPOSED CITY HALL, POLICE
FACILITY, AND BOND ISSUE.
Mr Henderson said that the award of a bid for the Community Center re -roof project will be on the
February 16`h City Council agenda. There were some minor problems with the submission of
requested forms in the bid of the recommended contractor, but those have been addressed. Councilor
Voss expressed concern regarding their attention to detail. Mr Henderson also addressed the issue
of contracts with a program management team for the bond issue projects. Those contracts will be
addressed on the March 2 °d City Council agenda. Mr Henderson and Mr Hancock discussed the City
Hall /Police Facility project. Mr Hancock recommended that the Council proceed with Option #16,
which is to delete the Council Chambers, relocate Public Works to the PSO Building and build a
combined City Hall and Police Station at the Main Street location. He also recommended continued
communication with the public, and noted that while staff has reduced an original deficit, better
figures will be available in last spring. Financing was discussed at some length.
ITEM 7: REPORT FROM CITY MANAGER.
Mr Hancock briefly went over the February 16`h agenda. The final sewer easements for the Elm
Creek project will be on that agenda. Mr Rooney addressed several zoning issues.

SUBJECT: PERSONNEL POLICY AMENDMENT, CHAPTER 7, SECTION 7 -6,
SEXUAL HARASSMENT

BACKGROUND:
On June 26, 1998, the Supreme Court issued decisions in two separate cases (Faragher v. City
' of Boca Raton & Burlington Industries v. Ellerth). In both cases, the Court decided an
employer is liable for its supervisors' sexual harassment, even if it did not know about the
misconduct. Those decisions have led to a renewed awareness of sexual harassment and
recommendations for employer actions to minimize their liabilities in sexual harassment law
suits.

In the two decisions, the U.S. Supreme Court has given a clear signal that vicarious liability
will be found against employers, including municipalities, for the wrongful actions of
supervisory employees under Title VII. Vicarious liability will apply not only where there has
been an actual tangible job detriment, but also in those scenarios where the hostile work
environment has not resulted in actual tangible loss, such as demotion, termination or the like.
Fortunately, the Supreme Court has also set forth in fairly clear language, the limited defenses
which may be available in those cases where there has not been tangible job detriment. The
defenses apply when a City (employer) has taken adequate precautions before the alleged
wrongful activity has occurred.

Both legal and lay review of the most recent decisions have resulted in virtually the same set of
recommendations for employers to be able to assert affirmative defenses to vicarious liability
claims. Those recommendations are:
1. Employers should have a formal, written sexual harassment policy, written in
language understood by the ordinary person that prohibits sexual harassment.
2. The policy should contain a supervisory by -pass procedure so an employee making a
complaint of sexual harassment can by -pass the alleged harasser.
3. The policy should explain, again in easily understood language, the procedures for
filing a complaint and outline protection for the complainant.
4. The policies and procedures must be disseminated to all levels of employees.

5. All employees should have some level of training on sexual harassment, including
what constitutes sexual harassment, conduct expected of employees in the workplace,
and the methods of making a complaint.
6. Records of policy dissemination and employee training should be kept. I
A revision of the City's sexual harassment policy has been prepared to meet the
recommendations above and has been reviewed and approved by Ron Cates. The draft policy t
was provided to staff and employees for review and comment and to serve as notice of the
intent to modify policy as is required in Chapter 1, Section 1 -3 of the Personnel Policies
Manual. '
EFFECTS OF THE AMENDMENT:
If approved, the amendment will replace current policy found in Chapter 7, Section 7 -6 of the '
CITY OF OWASSO, OKLAHOMA, PERSONNEL MANUAL. The amendment will comply
with the directions provided by the United States Supreme Court creating limited defenses to
sexual harassment. It also places on administration, the burdens of policy dissemination, staff
training, and record keeping as required by the policy amendment and the Court's
recommendations.
RECOMMENDATION:
Staff recommends approval of the sexual harassment policy amendment.

7 -6 SEXUAL HARASSMENT AND INAPPROPRIATE SEXUAL CONDUCT
A. Policy:
1. Sexual harassment of employees or any other person and inappropriate sexual conduct is prohibited and
will not be tolerated in the City workplace or in City activities and programs wherever they occur.
2. Retaliation of any kind against individuals who, in good faith, report instances of sexual harassment, or
who assist or participate in any manner in an investigation, or participate in or are witnesses in any procedure to
redress a complaint of sexual harassment is prohibited. Individuals who are found to have violated this provision of
this Policy will be subject to disciplinary actions.
3. It is further a violation of this Policy for anyone to make an intentionally false accusation of sexual
harassment or related retaliation through the use of City procedures. Any employee who is found to have made an
intentionally false accusation of sexual harassment or related retaliation will be subject to disciplinary action.
B. Objectives and Philosophy
It is the objective and philosophy of the City:
1) to provide employees with a working environment free as possible from unlawful sexual harassment,
inappropriate sexual conduct and sexual discrimination;
2) to prevent inappropriate sexual conduct and prevent sexual harassment of employees by co- workers,
management, supervisors, vendors, contractors, elected and appointed officials and the public;
3) to prevent retaliation against any employee;
4) to encourage prompt reporting of sexual harassment, inappropriate sexual conduct and retaliation and to
resolve complaints promptly, confidentially and at the lowest management level possible.
C. Definitions:
1. The Equal Employment Opportunity Commission (EEOC) defines sexual harassment in employment as
unwelcome sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual
nature. These acts constitute sexual harassment when:
* submission to such conduct is made either explicitly or implicitly as a term or condition of an individual's
employment
OR
* submission to or rejection of such conduct by an individual is used as the basis for employment decisions
affecting such individual

* such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or
creating an intimidating, hostile, or offensive working environment.
Under the EEOC's definition, there are 3 types of sexual harassment:
a. Quid pro quo harassment
Quid pro quo harassment occurs when an employment decision is conditioned upon the granting of sexual
favors or where an employee is punished for refusing to grant sexual favors.

Examples of quid pro quo harassment include: offering an employee a benefit, such as a job, promotion,
pay increase, or trip out of town for agreeing to sexual demands; or conversely, punishing an employee
for not agreeing to a sexual advance by discharging or refusing to hire the employee, assigning the
employee to disagreeable tasks, not promoting the employee or not granting him or her a salary increase.
b. Hostile environment harassment
Hostile environment harassment occurs when an employer creates or permits the existence of an
atmosphere of sexually offensive conduct or speech so pervasive and offensive that a reasonable employee
could not tolerate working under such conditions. In such a case, the employee does not have to show that
the offensive conduct affected his/her promotion, job, or other employment benefits. Such a situation
might exist where supervisors or employees are continually propositioning or fondling their subordinates
or other employees, telling vulgar jokes, and making demeaning comments, while not withholding any
employment benefits.
c. Sexual favoritism
Sexual favoritism occurs when an employee has been denied a benefit because another employee has
submitted to the sexual advances of a supervisor.
2. The terms "sexual harassment" and "inappropriate sexual conduct" in the workplace as used in this Policy
mean:
a) Unwelcome, offensive or workplace inappropriate verbal or physical conduct of a sexual nature or
directed to an individual based upon his or her gender when:
i) submission to the conduct is implicitly or explicitly made a term of employment;
ii) submission to or rejection of the conduct is used as the basis for an employment decision affecting the
individual; or
iii) the conduct has the purpose or effect of unreasonably interfering with an individual's work performance or
creating an intimidating, offensive, hostile or inappropriate working environment.
b) Examples of sexual harassment and inappropriate sexual conduct which are prohibited in the workplace
include, but are not limited to:
i) sexual innuendo, suggestive comments, insults, threats, jokes; '
ii) suggestive or insulting noises, staring, leering, whistling, or making obscene gestures;
iii) propositions or pressure to engage in sexual activity; '
iv) sexual assault or coercing sexual intercourse;
v) touching, pinching, cornering, or massaging or brushing body; '
vi) inappropriate comments concerning appearance;
vii) sexual or sexually insulting communications, or public posting, including electronic media, telephone calls
and written documents;
viii)displaying, viewing, possessing or bringing to the workplace magazines, books, videos, TV programs,
music, or pictures with a sexual connotation;
ix) hiring or promoting sex partners over more qualified persons;

x) any harassing conduct, whether or not sexual in nature, that is directed toward a person because of the
person's gender including, but not limited to, hazing employees working in non - traditional work
environments; or
xi) harassing conduct which occurs during non - working hours but is directed at a co- employee, such as
harassing telephone calls made during off -duty hours.
3. Retaliation means:
a) any form of retaliation against an employee because he or she has made a report of alleged sexual
harassment or discrimination; has testified against or participated in any manner in an investigation of a report
of sexual harassment; or has opposed any practice prohibited by this Policy or made unlawful by Title VII of
the Civil Rights Act of 1964, as amended.
b) Examples of prohibited retaliation may include, but are not limited to:
i) failure to hire or promote or withholding pay increases;
ii) poor performance reports;
iii) onerous work assignments;
iv) withdrawing friendly courtesies, spreading rumors;
v) demoting, discharging, abolishing position;
vi) further sexual harassment.
D. Reporting Procedure:
1) If any employee has been a victim of or observed sexual harassment or inappropriate sexual conduct in the
City workplace, he or she should clearly tell the harasser that such conduct is offensive and to stop the
conduct.
2) If any employee has been a victim of or observed sexual harassment or inappropriate sexual conduct in the
City workplace, he or she should and is encouraged to report the conduct as soon as possible after the alleged
harassment occurs to any or all of the following:
i) the immediate supervisor or the first level supervisor who is not involved in the alleged harassment; or
ii) any Department Director; and
iii) the City Human Resources Director; or
iv) the City Manager.
3) All management or supervisory personnel who have received a report of sexual harassment or
inappropriate sexual conduct ( "Report ") shall immediately report such to the Human Resources Director, who
shall make arrangements for the prompt and proper investigation of such report, and to the victim's and
alleged harasser's department director.
4) In order to stop sexual harassment and inappropriate sexual conduct in the City workplace, all
management and supervisory personnel are under an affirmative duty to report and take appropriate action on
sexual harassment and inappropriate sexual conduct of which the are aware, even if the complainant desires
confidentiality and desires that no formal complaint or report be filed. Supervisory and management personnel
may be disciplined for failure to report such harassment or inappropriate conduct.
5) Any employee who reports alleged sexual harassment or inappropriate sexual conduct should provide
specific facts about the conduct including:
i) what was the specific conduct;
ii) who committed the conduct;
iii) when and where the conduct occurred;
iv) who the witnesses to the conduct are;
v) frequency of the conduct;
vi) when and where notice to the harasser or person committing the inappropriate conduct was made for them
to cease the conduct, who made the notice, and who witnessed the notice.
6) Employees are encouraged to report sexual harassment and inappropriate sexual conduct to the above -
listed City officials or supervisors in order that the City can take immediate corrective action.
7) Unlawful sexual harassment may also be a violation of state or federal law and may be reported to the
U.S. Equal Employment Opportunity Commission or the State Human Rights Commission.
E. Investigation of Alleged Sexual Harassment /Inappropriate Conduct:
1) When a report of alleged sexual harassment or inappropriate sexual conduct is received, the Human
Resources Director, Department Director (or City Manager, if the allegations are directed against the
Department Director) immediately shall be notified and an investigation shall be conducted by the Department
Director and Human Resources Director as soon as possible. '
2) The investigation shall include, but not be limited to, interviewing the individuals who are believed to have
knowledge of the matter including the alleged victim and the alleged harasser and reviewing any relevant '
documents.
3) Employees named in Reports will be given sufficient information about the allegation to provide them a I
reasonable opportunity to respond before any corrective action or discipline is imposed.
4) Employees named in Reports should not be assumed to have violated this Policy unless and until the Final
Report of Investigation reports that they have done so.
5) All employees shall cooperate in any investigation or may be subjected to discipline for failure to
cooperate in a lawful City investigation.
6) Upon receipt of a Report, the City will take all appropriate steps to prevent the alleged conduct from
continuing, pending completion of the investigation. The City will determine the steps to be taken by
balancing the rights of the alleged victim including the severity of the alleged conduct, and the rights of the
alleged harasser.
' F. Final Report of Investigation:
1) The investigating supervisor shall issue a written report of his or her investigation which shall include all
the facts ascertained in the investigation and a finding of whether or not a violation of this Policy has occurred
( "Final Report ").
' 2) The investigating officer shall provide a copy of the Final Report to the complainant, the alleged harasser,
their immediate supervisors or department director and the Human Resources Director.
G. Confidentiality:
' 1) All reports, all investigations and Final Reports shall remain as confidential as possible and shall be
disseminated only to persons having a need or right to know that outweighs the privacy of the individuals
involved.
2) Employees involved in any investigation, whether as complainant, alleged harasser, witness or
investigator, should keep all discussions or communications confidential.
' H. Corrective or Disciplinary Action:
' 1) If the Final Report states that there is insufficient evidence that a violation of this Policy occurred, the City
will inform the parties and the matter is concluded.
' 2) If the Final Report states that a violation of this Policy occurred, the City will take appropriate corrective
or disciplinary action reasonably calculated to end the harassing conduct, including but not limited to:
' i) counseling and training;
ii) transfer or reassignment;
' iii) reprimand, suspension, demotion, termination;
iv) negative performance evaluation.
3) If the Final Report determines a violation of this Policy occurred that does not result in termination, the
City shall, at minimum, carefully explain this Policy to the harasser, suggest ways to correct conduct and
' inform him or her that further instances of harassment may result in termination.
4) If corrective or disciplinary action is taken against any employee as a result of a Report, appeals by the
' employee disciplined shall be subject to the terms of the employee's collective bargaining agreement and /or
the Due Process Policy and Procedures of the Personnel Manual.
I. Policy Dissemination:
1) All employees, regardless of type of employment appointment (Part-Time /Temporary, Full -Time, Acting,
or Federal Grant employees) shall be provided a copy of this policy.
2) Each employee shall sign an affidavit of receipt of this policy. Employee affidavits shall be a part of
employee's personnel files in Human Resources.
3) A copy of this policy shall be posted on City bulletin boards in areas frequented by employees.
J. Staff Training:
1) All employees shall receive training minimally to include:
i) what constitutes sexual harassment;
ii) what constitutes inappropriate sexual conduct;
iii) what conduct is expected of all employees in the workplace;
iv) methods of reporting sexual harassment and /or inappropriate sexual conduct; and
v) potential penalties for violations of this Policy.
2) All Supervisors and Management shall receive training in addition to the above to include:
i) supervisor's and manager's responsibilities when an allegation of sexual harassment and /or inappropriate
sexual conduct is made to them or made known to the them;
ii) investigative techniques; and
iii) responsibilities when the Final Report determines a violation of this Policy has occurred.
K. Record Keeping:
1) The following records shall be kept in individual personnel files in Human Resources:
i) acknowledgment of receipt of this Policy; and
ii) records of training as specified above.
2) The following records shall be kept in confidential files in Human Resources:
i) alleged victim reports of harassment and /or inappropriate sexual conduct;
ii) investigative reports and notes; and
iii) Final Reports.
3) Reports that may become a part of a disciplinary action may at that time become a part of employee
personnel files.
4) At the conclusion of the investigation and /or disciplinary actions and noted appeals processes, all records,
notes, reports, and other documents relating to the issue shall be made a part of the appropriate file(s) in
Human Resources. No records, notes, reports, and other documents relating to the issue shall remain in
departmental files.
L. Modifications of Policy:
The City reserves the right to change or modify this Policy at any times subject to the policy modification
procedures in the Personnel Manual. This policy is not intended to be part of any contract of employment
between the City and any person.

SUBJECT: JIM DOBRINSKI WORKERS' COMPENSATION SETTLEMENT
BACKGROUND:
Mr. Dobrinski began employment as a police officer with the City of Owasso on September 1,
1992. On March 28, 1997, he suffered an injury to his back while moving evidence boxes. He
was first treated for a cumulative trauma injury (cubital tunnel syndrome) to the left hand on April
21, 1998. At the time or both injuries, he was employed as a detective. Mr. Dobrinski terminated
his employment with the City on September 29, 1998.
SETTLEMENT OF CLAIM:
Because of the nature of the injuries, permanent partial disability rating and /or on -going medical
expenses could be incurred. Therefore, a settlement by joint petition was negotiated in the amount
of $2,000 for injury to the back and $5,000 for injury to the left hand. The joint - petition
settlement totals $7,000, plus associated court and legal fees, and will eliminate any future claims
against the City as a result of the two injuries.

Staff recommends approval of a negotiated settlement by joint petition with Mr. Dobrinski, in the
amount of $2,000 for injury to the back and $5,000 for injury to the left hand for complete
elimination of future medical claims against the City, plus associated court and legal fees, and

BACKGROUND:
The subject subdivision is located on North Mingo road about one -half mile north of 86�'
Street North (see attached location map). These utility systems include an 1,800 LF, 12"
off -site water line, 3,150 LF of 6" water , 650 LF of 4" water and 4,100 LF of 8" sewer
lines. ODEQ permits have been issued (see attached).
FINAL INSPECTIONS:
Public Works personnel conducted a sanitary sewer final inspection with the construction
contractor on December 10, 1998. A punch list of items requiring correction were given
to the contractor on that date. A water system final inspection was conducted on January
19, 1999. All punch list items for both systems have been corrected. The contractor has
provided one -year maintenance bonds for both utility systems (see attached).
RECOMMENDATON:
Staff recommends acceptance of the Fairways V water and sanitary sewer systems.

SYSTEM

BACKGROUND:
Approximately twelve (12) years ago, the City of Owasso purchased a new radio
communications system. The new system was complete with both mobile and hand held radios
and allowed us to change from 150 MHz to 450 MHz (UHF) frequencies. However, because the
current radio system has far surpassed its life expectancy, we are continually experiencing radio
problems and our radio system is not reliable for emergency service communications.
Due to the continual radio problems we were experiencing, a radio communications project team
was created in July 1997. Project team members conducted a review, an evaluation, and
researched the following objectives:
A. Is our present radio system adequate for future needs?
B. What benefits would an 800 MHz system provide?
C. What benefits would a 450 MHz system provide?
D. Determine the advantages and/or disadvantages of a "stand alone system" or use
another radio system. Example: Tulsa, Broken Arrow, or P.S.O.
E. Research APCO 16 to determine the current status.
F. Identify the future needs of the police and fire departments radio communications.

In October 1997, the project team decided that an engineering firm would be necessary to
effectively determine what radio system the City of Owasso should utilize. The project team
developed a "Request for Proposals" to provide telecommunications engineering service for the
City of Owasso. After reviewing the proposal from three engineering firms, EIS
Communications in Tulsa was selected.
In January 1998, EIS started the process to analyze independently the current radio systems in
use in the police and fire departments and provide formal recommendations with regard to
improvements or change. Also, EIS conducted a review with all police and fire department
personnel to identify and determine specific operational needs for both departments.
After reviewing and evaluating the data collected, EIS recommended that a "stand alone" 800
MHz radio communications system would best fit the needs of the police and fire departments.
For several weeks, Mr. Hancock, Chief Alexander, Chief Allen and Morris Strom (representative
of EIS) discussed the recommendations of EIS, the monies appropriated and considered other
alternatives available.
Because it was very probable that the City could not afford an 800 MHz system, Mr. Hancock
recommended that EIS develop specifications for a radio communications system that would
allow all vendors to bid on either a 450 MHz or 800 MHz system. Bid specifications were
developed and submitted to vendors in November 1998 and the bid opening was set for January
9, 1999.
We received two (2) bids as a result of the specifications sent to various vendors. The bid
responses were from Total Radio of Tulsa, Oklahoma and Kenwood Systems Group of Houston, '
Texas. Attached for your review is the Overview of Proposals provided by Morris Strom from
EIS Communications.
RECOMMENDATION:
The staff and consultant recommend City Council authorization for the purchase of a radio
communication system from Total Radio, Tulsa, OK in the amount of $167,293, and that this
authorization be contingent upon the City obtaining five (5) 800 MHz frequencies. Upon City
Council authorization, an application for five (5) 800 MHz frequencies will be filed.

OVERVIEW OF PROPOSALS
The City of Owasso received two bids as a result of the RFP sent to various vendors and
suppliers in November. The bid responses were from Total Radio of Tulsa, OK and Kenwood
Systems Group of Houston, TX. Total Radio bid $167,293.00 and Kenwood Systems Group bid
$261,290.00, which included a dispatch console not requested on the bid submittal page for
$44,850.00. The effective difference in the bids was 5511705.00. In addition to the price the
Total Radio proposal clearly meets the needs and requirements for the City of Owasso for many
years. The purpose of this report will be to discuss the components of this radio system and
make a comparison to facilitate the decision making process.
Central Site Equipment
Both systems meet the bid requirements based on the information provided in the RFP. The
Total Radio bid includes all material and labor for the installation of the equipment located in the
area of the water tower. The Kenwood proposal does not include the labor for the installation of
the antenna and transmission line. The estimated cost of this would be in the area of $1,000.
Both bids have included the cost of an UPS capable of providing 30 minutes of standby power.
Further research has concluded the resources allocated for the UPS may be better allocated by
providing a standby generator (natural gas) instead of the 30 minute UPS. The logic is, in the
event of a major power failure the 30- minute UPS is not acceptable and the need for the
communications system is of greater importance when there is no power. The recommendation
is that consideration be given to the funds allocated for the LIPS are used to purchase a standby
generator.
The Total Radio bid is compatible with the City of Tulsa radio system and the interoperability
issues that are important for both police and fire are resolved. The Kenwood System does not
address the Tulsa system as their proposal is a 450 MHz system and is not compatible. The
Kenwood system would require cross patching in the console, which is not the preferred method
of access.
Total Radio provides 3 channels of telephone interconnect, while Kenwood provides for 2
channels. The RFP called for 2 channels of interconnect.
The warranty stated by Total Radio was 3 years parts and labor. Kenwood did not state their
warranty. The RFP calls for 3 years on all products.
Both systems are rated for continuous duty service (100% duty cycle) and reliability is simply
not an issue with either manufacturer.
The operating system formats for the two systems are different with the Motorola system being a
Privacy Plus system which will provide for several of the APCO 16 features. These features
include Emergency Button, PTT ID, Out of Range, Private Call, Call Alert Paging. The
Kenwood system is an LTR format that will offer all of the grouping and sub -fleets requirements
that are a part of the trunking concept. The APCO 16 features listed above would not be a part
of the Kenwood system.
A lot of discussion is centered on APCO 16 compliance, which should be considered as a part of
this proposal. Based on the information we have today it appears that the radio system proposed
by Total Radio comes closer to APCO 16 compliance than the Kenwood system. Even though
all of the APCO 16 features are not a part of the Owasso system, the radios will be APCO 16
compliant when they are used on the Tulsa system, since their system meets APCO 16 standards_
APCO 16 was established to be a benchmark for local governments and particularly public safety
when they are selecting those features needed in a radio system The issue that must be raised is
the fact that a radio system as defined in APCO 16 is a rather large radio system with many
complicated components. The City of Owasso does not need a system with the complexities of
the APCO 16 standard. The proposed system by Total Radio has some APCO 16 features that
are important to the operations of the public safety, which make the Total Radio proposal the
preferred proposal. Please understand that APCO 16 was not a part of the bid package, because
this bid requirement would have effectively reduced the number of bidders to Motorola and GE,
and the cost of the system would be significantly more expensive. An approach that could be
adopted for the City of Owasso is that we are working toward being APCO 16 compliant and
must take this in logical steps. if one reads the Project 16 material you will notice that there are
requirements for the dispatch center as well as the central site equipment, mobiles, and portables_
The understanding we have at this time is that the plans are being developed for the dispatch
center at this time.
Mobiles and Portables
Both proposals have mobiles and portables that are acceptable for the operations of public safety
for the City of Owasso. The issue that makes the Total Radio bid most preferred is the ability of
the mobiles and portables to migrate over to the Tulsa systen-L Also, the added value of the
APCO 16 features makes the Total Radio proposal the preferred radio. Total has stated the
mobiles and portables will be covered by a 3 -year parts and labor warranty as per the RFP. As a
part of this proposal the accessories are listed as options to allow for the configuration of the
exact number needed for each department. The equipment proposed by Total Radio is now
being used on the City of Tulsa system by some of the users of that system other than their police
and fire departments_
Conclusion and Recommendation
The recommendation is that the City of Owasso accepts the proposal of Total Radio with the
understanding that more equipment (accessories) will be needed other than what is listed on the
submittal page. The objective of this bid process was to level the playing field and determine
who was going to bid on the system and what choices the City of Owasso would have. The RFP
was made broad enough to allow all types of systems to come to the table, including APCO 16
compliant systems. Neither of the bidders proposed a system that was totally APCO 16
' compliant. Total Radio did the best job with both price of the system and the features that were
proposed. The recommendation is that by accepting this proposal the City of Owasso can
construct and install this system for less than their $200,000 budgeted amount. This will allow
' for the purchase of ample accessories and also the adding of generated power at the central site
location.

permanent easement for the Elm Creek Interceptor Sewer. The following commitments are
made by the City for your provision of a temporary and a permanent easement (a copy of such
being attached to this agreement and deemed a part thereof) to construct and maintain the Elm
Creek Interceptor Sewer on your property located at Lot 8, Block 3, Graceland Acres, a
subdivision in Tulsa County, Oklahoma:
1. You will receive a cash payment of $1,984.00 for the easement.

3. You will receive a cash payment not to exceed $300 as reimbursement for review of
the easement document by your attorney.
4. Following pipe installation, the construction contractor shall hand rake the area to
remove all rock to a condition equal to the surface which existed prior to construction.
All excess excavated material shall be removed from the site. All areas which have been
disturbed, such as that caused by equipment tracks, shall be carefully filled and repaired
as though it were a part of the actual trench excavation. No rock shall be left on the
ground surface. All disturbed areas shall be seeded, fertilized and mulched to obtain
ground cover equal to the adjacent property.
5. Temporary fencing will be provided in work areas for the protection of persons, pets
and livestock.
6. The City will pay an amount of $200 to include the easement in your abstract.

7. No manholes will be located on your property.
8. The City of Owasso, Oklahoma, shall hold harmless and indemnify Clyfton A.
Raeuber, as well as any administrators, executors or heirs, of and from any and all
causes of action, claims, damages, expense or loss, including attorney fees incurred
arising out of or in any way resulting in any action or claim brought by any person or
organization, public or private, when such action results from the construction,
installation, operation, maintenance, deterioration, repair, replacement or any deficiency
due to the mere presence of the sanitary sewer line on his property. This shall include,
but not limited to, any leakage or noxious odor emitting therefrom. Further, the City
of Owasso, Oklahoma, after notification of any deleterious condition as pertains to the
sanitary sewer will respond and initiate remedial actions within twelve (12) hours of such
notification. Completion of any remedial actions required shall occur promptly as soon
as is practicable thereafter under the circumstances.
9. The right to enter and use of the permanent easement by the City of Owasso,
Oklahoma, its officers, agents, employees and all persons under contract with it
encumbers the City with the responsibility for any and all detrimental conditions or
effects due to the presence of the line. The City of Owasso, Oklahoma, shall be
perpetually responsible for repair and or restoration of any damage to property,
structures, landscape, or turf due to any and all maintenance or repair operations.
10. The City of Owasso shall be perpetually responsible for repair of the line due to
damage caused by any commercial or private stone quarry or other blasting operation.
11. The City will pay for any tree considered of value to the owner which is either
removed during construction or dies due to construction activity within two years
following completion of construction. The value of trees will be based on guidelines
established by the Oklahoma State Extension Service. One large Stewart Papershell
Pecan tree valued at $3,420 has been identified.
12. Two large, partially -dead willow trees will be removed prior to start of construction
without expense to the landowner or charge to the City.

as soon as possible. If the above commitments comply fully with your requirements, please sign
the acknowledgement at the end of this letter.

excavation in the construction of said sanitary sewer and for all other necessary and reasonable uses in
connection with the construction of said sanitary sewer. The right to enter and use of the temporary easement
by City of Owasso, Oklahoma, its officers, agents, employees, and all persons under contract with it

It is further understood that the City of Owasso, Oklahoma, and its successors, assigns, officers, agents,
employees and all persons under contract with it shall be perpetually responsible for the operation and
maintenance of the Elm Creek Interceptor sewer line and shall be liable to, and forever hold harmless and
indemnify, Clyfton A, Raeuber and his assigns, as well as any administrators, executors or heirs, of and from
any and all causes of action, claims, damages, expense or loss, including attorney fees, incurred arising out
of or in any way resulting from the construction, installation, operation, maintenance, deterioration, repair
or replacement or any deficiency relative to the mere presence of the sanitary sewer line on the property,
including, but not limited to any leakage or noxious odor emitting therefrom. Further, the City of Owasso,

on the property.
Temporary fencing shall be provided during construction for protection of persons, pets and livestock. No
manholes shall be located on the Raeuber property. The City of Owasso, Oklahoma, shall pay for loss of one
Stewart pecan tree (valued at $3,420) should the tree die within two years following completion of
construction. Two partially -dead willow trees shall be removed by the City of Owasso contractor prior to
trench construction. The line shall be at a minimum depth of eight (8) feet. The easement shall be cleaned
of rock and debris following construction.
TO HAVE AND TO HOLD such easement and right -of -way unto the said City of Owasso, Oklahoma, its
successors and assigns, forever.

This letter is to identify City of Owasso commitments deemed acceptable by you for your
provision of a temporary and a permanent easement (a copy of such being attached to this
agreement and deemed a part thereof) to construct and maintain the Elm Creek Interceptor Sewer
on your property located in the SW4 NW4 SW4 in Section 33, Township 21 N, Range 14 E:
1. You will receive a cash payment of $9,447.00 for the easement. This payment
includes $500.00 lump sum plus the cost of a service line extending to your compound.
The cost to construct the service line from the Elm Creek Interceptor Sewer line has been
established as $8,947.00. This amount will be paid to you directly for your payment to
the construction contractor. The service line will be installed in or before May 1999.
2. You will receive one additional service riser within the tract containing the line
alignment at no cost to the owner, owner's assigns or successors in interest. The
locations of the risers will be determined by the owner, owner's assigns or successors
in interest.

which the owner holds as having value. Trees which will be removed during

construction activity will be reimbursed at a rate based on the Shade and Ornamental
Tree Appraisal pamphlet published by the Oklahoma State University Extension Service.
7. The City will reimburse you an amount not to exceed $200.00 for a survey to verify
your northwest property corner.
8. Access for construction and maintenances shall be limited to the easement granted and
the area north of the Elm Creek Bridge at 129th E. Avenue. No access will be permitted
through the private drive located at 6905 N. 129th E. Avenue.

BACKGROUND:
This project is in conjunction with the FY98 -99 Street Division Capital Outlay Budget.
The contract includes the repair of 19 sites at various locations within the City (see
attached location map and project list). The construction contract was awarded to
Magnum Construction, Inc. on October 21, 1998 in the amount of $133,510.20. The
Notice to Proceed was issued on November 11, 1998.
Two previous payments have been made in the amount of $98,110.21. No Changes
Orders have been issued.
PROJECT FUNDING:
Funding is provided by Streets Division Capital Outlay (Line Item 51- 410 -5461) in the
amount of $147,067. The contractor has submitted a final pay request in the amount of
$28,639.33 for remaining amount due plus return of retainage. The final amount to be
paid is therefore $126,749.54. The final payment is less than the amount of contract
award due to variations in actual repair surface areas and contingency repair items not
used. These contingency items included such items as possible additional repair depth
for unacceptable existing base material).
FINAL INSPECTION:
Public Works conducted a final inspection with the contractor on February 8, 1999. All
' punch list items have been corrected. The contractor has provided a one -year
maintenance bond (see attached).
RECOMMENDATION:
Staff recommends acceptance of the FY98 -99 Streets Repair contract and final payment
to Magnum Construction in the amount of $28,639.33.

' permitted by ODEQ (see attached).

FINAL INSPECTIONS:
Public Works personnel conducted sanitary sewer and water systems final inspections
with the construction contractor on January 22, 1999. Punch lists of items requiring
correction were given to the contractor on that date and all items have been completed.

The contractor has provided one -year maintenance bonds for both utility systems (see
attached).
RECOMMENDATON:
Staff recommends acceptance of the Kelley Ann water and sanitary sewer systems.

Pursuant to O.S. 27A 2 -6 -401, the City of Owasso is hereby granted this permit to construct 2,160
' L.F. of eight (8) inch sewer lines and appurtenances to serve the Kelley Ann Addition, located in
part of E -1/2 of E -1/2 of SW -1/4 of Section 18, T -21 -N, R -14 -E, I.M., Owasso, Tulsa County,
Oklahoma, in accordance with the plans and specifications approved on October 24, 1997.
' By acceptance of this permit, the permittee agrees to operate and maintain the facilities in
accordance with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the state
certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted
t thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new
' project.
3) That no significant information necessary for a proper evaluation of the project has been
omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
' sanitary protection will be provided in accordance with OAC 252:655- 9 -1(h) of the
Standards for Water Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines
will prevent excessive infiltration and that the leakage will not exceed 200 gallons per inch
of pipe diameter per mile per day.

6) That the Oklahoma Department of Environmental Quality shall be kept informed of
occurrences which may affect the eventual performance of the works or that will unduly
delay the progress of the project.
7) That the permittee will take steps to assure that the connection of house services to the
sewers is done in such a manner that the functioning of the sewers will not be impaired and
that earth and ground water will be excluded from the sewers when the connection is
completed.
8) That any deviations from approved plans or specifications affecting capacity.. flow or
operation of units must be approved by the Department before any such deviations are
made in the construction of this project.
9) That the recipient of the permit is responsible for the continued operation and maintenance
of these facilities in accordance with rules and regulations adopted by the Environmental
Quality Board, and that this department will be notified in writing of any sale or transfer of
ownership of these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or
liabilities which the permittee may be under pursuant to prior enforcement action taken by
the Department.
11) That any notations or changes recorded on the official set of plans and specifications in the
Oklahoma Department of Environmental Quality files shall be part of the plans as approved.
Failure to appeal the conditions of this permit in writing within 30 days from the date of-issue will
constitute acceptance of the permit and all conditions or provisions.

in Public Water Supply Construction Standards (OAC 252:625- 17 -4), respectively, the
sewer shall be designed and constructed equal to water pipe, and shall be pressure tested
to the highest pressure obtainable under the most severe head conditions of the collection
system prior to backfilling in accordance with Water Pollution Control Construction Standard
(OAC 252:655 -9 -1 (h)).
12) That any notations or changes recorded on the official set of plans and specifications in the
Oklahoma Department of Environmental Quality files shall be part of the plans as approved.

BACKGROUND:
In October of 1997, the citizens of Owasso approved a 10 million dollar bond issue for Capital
Improvement Projects within the City of Owasso. Projects included for funding within that bond
issue included street and intersection improvements, a New City Hall, remodeling of the existing
City Hall for the Police Department, improvements to the Owasso Sports Park and improvements
to the existing Community Center. Improvements to the Community Center included a new roof and
' the replacement of carpet and ceiling tiles because of waster damage.
The architect/engineer (A/E) for the project, CH2MHill/ Page•Zebrowski prepared sketches and
performance specifications for the Phase I of the project, which included the removal of the existing
roof, the application of a new 20 year warrantied roof, replacement of damaged insulation,
replacement of all skylights, removal and disposal of the inoperative solar panels originally used to
theat water in the facility, raising the curb around the perimeter of the building and installation of
a new decorative coping, repainting of the existing screens around the roof mounted heating and air
conditioning (HVAC) units and cleaning of the existing roof drains.
The project was advertised on December 10, 1998 and a Pre -Bid Conference was held on January
7, 1999. Bids were opened on January 18, 1999 and six (6) bids were received. The bid totals are
listed below. The bid tabulation and bid submittals are included as Attachments A and B,
respectively.

BID ANALYSIS:
After the bids were opened and the bid tabulation prepared, the unit prices for each line item were
compared. The architect noticed a significant difference in the low bid and requested that Guarantee
Roofing of Joplin, Missouri, submit the materials that they bid to use on the project. The coping
materials submitted were inferior to those specified by the architect and their bid was disqualified.
The second low bidder, Shelton Metro of Tulsa, Oklahoma was also asked to submit their proposed '
materials and the architects confirmed that the materials are equal to those specified. However,
Shelton Metro did not acknowledge the last two addenda in their bid submittal. The two addenda
were to notify the contractors of a material clarification and a change in the bid opening time. '
Shelton Metro has informed the architects that they will acknowledge the addenda and that there will
be no change in their bid. The City Attorney was contacted about the scenario and he has approved �-
the contractor's request to execute the addenda after the bid opening.
FUNDING:
Funding for this project is available in the 1998 Bond Issue in the amount of $75,800.00.
RECOMMENDATIONS:
Staff recommends Council award of the bid for Community Center Re- Roofing Project to Shelton
Metro in the amount of $75,800.00

Dear Dwayne:
I have reviewed the low bids for the re -roof and recommend that we award the bid to Shelton
Metro Roofing, Inc. They submitted the second lowest bid but appear to have met the
qualifications of the specifications. I have reviewed the roofing system they are proposing and it
meets the 20 year warranty requirement. They are claiming they did not receive addendum #3
and #4 but I am sending them copies of these today for their review. I do not expect the price to
go up.
Guarantee Roofing who was the original low bidder at the opening but did not submit the
specified coping and fascia system. We recommend not re- negotiating their bid.
I spoke with the City's Attorney and he did not have any problems with the bids as they stand
including the discrepancy in the roofing spec.
I f you have any questions or we need to do anything else at this point please do not hesitate to
call. When I hear back from Sheldon on Addenda 3 and 4 1 will give you a call.

second lowest bidder (Shelton Metro Roofing, Inc.) be awarded the project.
The apparent lowest bidder did not meet the specifications on the coping and fascia
systems, and were eliminated on this basis.

BACKGROUND:
' In order to reduce costs of construction of the new Clubhouse at the Bailey Ranch Golf Course,
Tulsa County was asked to provide construction equipment and labor to pave the parking lot.
' The attached Agreement provides for this work to be performed by Tulsa County under the
following conditions:
' The City of Owasso shall provide all required materials and traffic control;
■ Tulsa County shall provide all necessary labor and equipment to complete the
project; and
' Duration of the Agreement shall be for a period equal to the time necessary to
complete the project.
In addition to the above work, the city has periodic requirements to perform drainage ditch
maintenance. The County Engineer (Ray Jordan) recommended the use of specific County -
owned construction equipment be included in the Agreement. Therefore, wording also has been
included for the County to provide drainage assistance at various locations in the City.
SCHEDULE:
Should the weather conditions stay warm, it is anticipated that the base course of the asphalt
parking lot at the golf Course will be constructed in the near future. The final course would be
applied when temperatures stay consistently warm.

FUNDING:
Funding for the paving materials to be used by Tulsa County is included in the clubhouse
construction budget.

Staff recommends Council approval of the Interlocal Agreement with Tulsa County for paving at
the Bailey Ranch Golf Course and assistance on drainage -type projects and authorize the Mayor

Board of County Commissioners of Tulsa County, Oklahoma, hereinafter called "County"
and the City of Owasso, Tulsa County, Oklahoma, hereinafter called "City ".
II WITNESSETH:

WHEREAS, by virtue of 69 O.S., 1981, Section 1903, the Board of County Commissioners
improve, and repair
is authorized to enter into agreements with municipalities to construct,
any of the streets of such municipalities, and;

WHEREAS, the County is desirous of participating in projects and the provision of services
mutually advantageous to the County and other units of government;

THEREFORE, in consideration of the covenants and conditions hereinafter contained, the
hereto as follows :

1. The duration of this Agreement shall be for a period equal to the time necessary to
complete the project described herein.
2. The purpose of this Agreement shall be to provide street paving assistance for the City at

BACKGROUND
Charles E. Norman, applicant and attorney for purchaser, is requesting a rezoning of 4.26 acres,
' more or less. The rezoning is described as follows:
1. A.79 acre tract from OL (Office Low Intensity District) to CS (Commercial
' Shopping Center District),
2. A 2.42 acre tract from RS -3 (Residential Single - Family High Density District) to CS,
3. A 1.05 acre tract from RS -3 to OL.
The subject property is located north of E 96"' Street N, west of the Owasso Expressway. The
rezoning is relatively small and proposes to "square off' a tract that can then serve as a site for
new commercial development planned to front on the north side of E 96"' Street N.
The rezoning is consistent with previous zoning actions on the Johnson property and no barriers
to development were noted at the staff review. Notice was published in the Owasso Reporter, a
sign was posted on -site, and letters were mailed to property owners within 300 feet of the subject
property. Staff has received no letters or calls in opposition to the proposed rezoning.
The Owasso Planning Commission unanimously approved the rezoning request at the February
9, 1999 regular meeting. The complete staff report for rezoning case OZ -99 -01 is attached for
your information and review.
' RECOMMENDATION
Staff recommends approval of OZ- 99 -01.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Charles E. Norman, applicant and attorney for
purchaser.
REQUESTED ACTION AND PURPOSE: A request for rezoning of 4.26 acres, more or less,
from OL (Office Low Intensity District) to CS (Commercial Shopping Center District) (.79
acres), from RS -3 (Residential Single - Family High Density District) to CS (2.42 acres), and from
RS -3 to OL (1.05 acres).
LOCATION AND SIZE: The subject property is located north of E 96"' Street N, west of the
Owasso Expressway. The subject tract is located in the interior of the SE /4 (NW /4 SW /4 SE /4)
of Section 17, T -21 -N, R -14 -E. The rezoning is relatively small and proposes to "square off' a
tract that can then serve as a site for a new commercial development planned to front on the north
side of E 960' Street N. The rezoning proposes to create 3.21 acres of CS property, to be
surrounded a 1.05 acres buffer strip of OL zoning.
The OL portion of the proposed rezoning will join with an existing buffer strip to the north, as
well as OL property to the south. The buffer strip is only 50 feet wide. This strip is suitable for
a landscape easement that will separate commercial from abutting residential property.
A map of the proposed rezoning and legal description of the subject property and proposed zoning
districts are attached for your information and review.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The surrounding property is undeveloped. To the northwest of
the subject property (approximately 300 feet at its nearest point), Bailey Ranch Estates II is under
construction. The proposed rezoning, which includes a 50 foot OL (landscape) buffer, makes
adequate provisions for the separation of land uses.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 4 "Residential District Provisions ", Chapter 5 "Office District

SITE INFORMATION: The site is relatively flat and serves as agricultural land. The proposed
rezoning may ultimately result in the realignment of a small drainage ditch to follow the landscape
easement. This item can be addressed, if necessary, during the platting, site planning, and
construction drawing phases of the planned development.
Although the subject property lies within the service area of the Rural Washington Water District
'
43, there is also a City 12 -inch water main available on the north side of E 96" Street N. An 8 -inch
sewer line is available to the south of the subject property approximately one - eighth mile to the
west of the subject property. No obvious barriers to development were noted in the staff review.
ANALYSIS
The 1985 comprehensive plan update indicates high intensity industrial uses to be appropriate for
the subject property as well as for property to the east to the Owasso Expressway. The Johnson
rezoning has rendered this portion of the comprehensive plan obsolete. Instead, the Johnson
rezoning (April 1998) provides for a combination of commercial shopping center and single -
family high- density residential. Light office district serves as a buffer between the contrasting
uses. In some places the OL zoning can accommodate office development, but in most areas the
` OL zoning is too narrow for development and serves to provide room for a landscape easement.
-� A conceptual master development plan was submitted with the April 1998 rezoning. The
original plan indicates that the major commercial shopping facility would front on the Owasso
Expressway. The proposed rezoning represents a minor change that would allow the major
tenant to front on E 96' Street N. This change in zoning is consistent with the previous zoning
actions and will result in only a minor change in the previous development plan.
The continued development of this property will require careful planning. The inclusion of
landscape easements, access points, and acceleration/deceleration lanes during the platting
process will be critical for the successful development of the property. The proposed zoning
change is consistent with previously approved changes, and there are no obvious barriers to
development noted at this time.
RECOMMENDATION
Staff recommends approval of OZ- 99 -01.

BACKGROUND
Charles E. Norman, applicant and attorney for purchaser, is requesting a rezoning of 9.46 acres,
' more or less, from OL (Low Intensity Office District) to OM (Medium Intensity Office District).
The subject property is located on the south side of E 86' Street N, east of N 129`' E Avenue
(east of the Albertson's site). The purpose of the request is to increase the FAR (Floor Area Ratio
' = Floor Area - Lot Area) from 25% to approximately 30% to allow for the construction of a
large, two -story, medical office facility.
The rezoning is consistent with previous zoning actions on and near the subject property and no
barriers to development were noted at the staff review. Notice was published in the Owasso
Reporter, a sign was posted on -site, and letters were mailed to property owners within 300 feet of
the subject property. Staff has received no letters or calls in opposition to the proposed rezoning.
' The Owasso Planning Commission unanimously approved the rezoning request at the February
9, 1999 regular meeting. The complete staff report for rezoning case OZ -99 -02 is attached for
your information and review.

APPLICANT AND STATUS OF APPLICANT: Charles E. Norman, applicant and attorney for

REQUESTED ACTION AND PURPOSE: A request for rezoning of 9.46 acres, more or less,

LOCATION AND SIZE: The subject property is located on the south side of E 86' Street N,
east of N 129' E Avenue. The 9.46 acre subject tract lies to the east of and abuts ROC Owasso
Addition.
A map of the proposed rezoning and legal description of the subject property and proposed zoning
districts are attached for your information and review.
EXISTING LAND USE: The subject property is currently undeveloped and is planned to contain
a large, two -story medical office facility.
SURROUNDING LAND USE: Albertson's is currently under construction to the west of the
subject property. Albertson's will serve as an anchor for a larger shopping center containing stores
on either side. The entrance to the Greens at Owasso lies to the east of the subject property and the
apartments of the Greens are located to the south.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 5 "Office District Provisions ".
SITE INFORMATION: The site is relatively flat and currently undeveloped. Water is available
to the subject site via a 12 -inch water main on the north side of the site and the Elm Creek
Interceptor will ultimately serve the site. No barriers to development were noted in the staff review.

IANALYSIS
' The 1985 comprehensive plan update indicates low intensity residential at the subject site.
Subsequent rezoning by the Kaiser Francis Oil Company (October 1995) established a higher
intensity land use pattern on the south side of E 86' Street N. The southeast corner of E 86'
Street N and N 129"' E Avenue was zoned commercial (the Albertson's site). To east of the
commercial property, office zoning was established. The Lindsey rezoning (January 1998)
continued the trend towards higher land use intensity in the area by establishing multi- family
residential zoning to the south of the subject property at the Greens at Owasso. These rezonings
represented a coordinated effort to increase the land use intensity in a very large area (344 acres)
r - and this rezoning now serves as the ruling guide for the subject property. The present land use
pattern will ultimately be reflected in the City comprehensive land use plan that is now in
development.
' The rezoning request from OL (Office Low Intensity) to OM (Office Medium Intensity) is
consistent with the established land use pattern for the area and represents only a minor change.
The purchaser plans a large, 2 -story medical mall on the site. The proposal would change the
' maximum allowable Floor Area Ratio from 25% to 50 %, however landscaping and high parking
requirements for medical offices will limit the potential FAR on the site to approximately 30 %.

' agenda. A copy of the ROC Owasso plat with Lot 8 highlighted is attached for your information
and review.
The partial plat vacation is the second step in a series of requests included in this agenda that are
required to create a planned two -story medical mall:
1. Request the zoning change,
2. Request to vacate portion of existing plat,
3. Propose a new, one -lot plat.
The Owasso Technical Advisory Committee reviewed the plat vacation at its January 27, 1999
regular meeting. There were no concerns voiced with the proposal.
The Owasso Planning Commission unanimously approved the rezoning at its January 9, 1999
regular meeting. Because Kaiser Francis Oil Company and their co- owners are the sole owners of
100% of ROC Owasso, the partial plat vacation can be accomplished by City Ordinance.

Albertson's, Inc. ( "Albertson's "), being the owners of all lots and blocks in ROC
Owasso, an Addition to the City of Owasso, Tulsa County, State of Oklahoma, included
and embraced in the plat and dedication of said Addition, filed in the Office of the
County Clerk of Tulsa County, Oklahoma, as Plat No. 52$2, do hereby revoke, cancel,
annul and forever vacate said Plat and Dedication in its entirety including the easements

The City of Owasso has received a request to review a final plat for ROC Owasso II, a 1 lot, 16.85
' acre subdivision located on the south side of E 86' St. N east of N 129th E Avenue. The proposal
will replat the easternmost portion of ROC Owasso and will plat additional land to the east. A
location map is attached for your information and review. Vacation of Lot 8 of ROC Owasso,
which underlies the western portion of the proposed plat, will be by separate instrument.
The subject property is zoned CS (Shopping Center Commercial) and OL (Office Low Intensity),
' with a proposal to rezone the OL portion of the subject property to OM (Office Medium
Intensity). In the subsequent review of development plans, staff anticipates difficulty with
having two sets of bulk and area requirements for the same lot. Therefore staff recommends that
twith respect to bulk and area requirements only, the most restrictive zoning district shall govern
the manner in which the entire property is developed and maintained.
As the proposed plat contains one lot and will not require any internal infrastructure improvements
that would benefit from an interim review, staff recommended to the Technical Advisory
Committee and Planning Commission that preliminary and final plat review procedures be
combined, and that this item be considered as a final plat. The Technical Advisory Committee
reviewed the final plat at the January 27, 1999 regular meeting. Easement requests are shown on
the plat within this packet. Additional recommendations are as follows:
1. That Block 1, Lot 8, of ROC Owasso Addition be vacated by separate
instrument,
2. That acceleration/deceleration lanes and sidewalks be installed along E 86`'

SUBJECT: PRICE FOR SALE OF CODE OF ORDINANCES

BACKGROUND:
Section 8 of the Adopting Ordinance for the City of Owasso Code of Ordinances provides that "The
City Clerk is hereby authorized and directed to sell copies of the code of ordinances to the public at
a price determined from time to time by motion or resolution of the city council ". No action has
been taken by the City Council either by motion or resolution to establish such a price.
' -• The City Clerk was recently approached by a local attorney with a request to purchase a copy of the
Code of Ordinances. Therefore, it has become necessary that the City Council establish a price for
the sale of copies of the Code should they be requested.
Contact was made with four communities in the metro area (Jenks, Bixby, Sand Springs, &
Claremore) to determine what those communites charge for a complete Code of Ordinances. None
of the communities has established a price - most supply only portions of the Code, generally at a
25 cent per page copy fee.
Based on the number of pages in our Code book (approximately 300 front and back), the cost to copy
those pages, the cost of a binder and dividers, and the time involved, we believe that a price of
$50.00 is fair.
' RECOMMENDATION:
The staff recommends that the City Council establish by motion a price of $50.00 for the sale of
' copies of the Code of Ordinances.
