WHEREAS, Since 1991, Youth Services of Tulsa has provided Safe Places for youth in Tulsa
County; and
WHEREAS, The Owasso Fire Station and QuikTrip stores are designated as Safe Place Sites in
Owasso for teens in crisis; and,
WHEREAS, Volunteers are available through Youth Services of Tulsa to respond to Safe Place
calls; and,
WHEREAS, The week of March 14 -20, 1999 has been designated as National Safe Place Week,
NOW, THEREFORE, I, Denise Bode, by virtue of the authority vested in me as Mayor of the City
of Owasso, do hereby proclaim March 14 -20, 1999 as

Dear Mayor Bode:
National Safe Place Week will be celebrated during the third week of March. I am
writing to request that March 14 -20, 1999, be proclaimed Safe Place week in
Owasso.
The Owasso Fire Station and QuikTrip stores are Safe Place sites in Owasso for
teens in crisis. Also, we have presented information about Safe Place to students at
the Owasso Eighth Grade Center Health Fair.
I have enclosed a proclamation draft. If possible, we would like to have this
proclamation by Friday, March 12. We would appreciate any assistance you can
provide in this matter. Thank you!

What is Safe Place?
Safe Place provides anetwork of locations where
young people in crisis or at risk can get help
quickly. Through the partnership of volunteers,
QuikTrip, fire stations, and Tulsa Transit buses,
Safe Place sites are located throughout the Tulsa
metropolitan area. Safe Place is a project ofYouth
Services ofTulsa.
How does Safe Place Work?
When ayoung person goes into a Safe Place and
asks for help, a trained employee will call Youth
Services of Tulsa Employees are trained to
respond to youth in crisis and provide a safe
environment until a volunteer arrives. The Youth
Services staff will phone atrained volunteer to go
to the Safe Place site to assist the youth. The
volunteer will either wait with the youth until a
parent arrives, transport the youth to the shelter, or
take other appropriate action.
Where are Safe Places?
Approximately 60 QuikTrip stores, Tulsa, Bixby,
Benyhill, Jenks, Keystone, Broken Arrow and
Owasso Fire Department stations, Broken Arrow
Police Department and all Tulsa Transit buses in
the Tulsa area are designated Safe Places.
How is Safe Place funded?
Youth Services of Tulsa operates with funds from
the state and federal governments, United Way,
and community support through private and corpo-
rate donations. A special thanks to QuikTrip for
their support of Safe Place.
Why Safe Place?
• Teens may attempt to handle
problems by running away,
substance abuse, suicide,
or conflicts at home.
• Teens may be experiencing
danger at home or in peer
relationships.
• Often teens do not know about
services available to them or do
not have transportation to get to
services.
Safe Place offers neighborhood access
to teens who need help immediately.
Through crisis intervention and counseling,
youth will have a Safe Place to stay while
working toward resolving the issues that
brought them to Safe Place.
How can I help?
• Become a Safe Place volunteer!
Volunteers are called to respond to youth
who request help at a Safe Place site in
their neighborhoods. Eight hours of
training is provided to volunteers.
Volunteers present information about
Safe Place, Youth Services of Tulsa,
and personal safety to youth in home-
room settings. Presenters receive 12
hours of training.
A small time commitment can make a
great difference to a young person in
crisis. YST screens volunteers who are
then provided training and periodic in-
service training.

Tuesday, February 16, 1999
The Owasso City Council met in regular session on Tuesday, February 16, 1999 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted
on the City Hall bulletin board at 4:00 p.m. on Friday, February 12, 1999.

FOR APPROVAL OF THE CONSENT AGENDA.

Mr Wilken moved, seconded by Mr Smith, to approve the consent agenda. The consent agenda
included minutes of the February 2, 1999 regular meeting and the February 9, 1999 Special Meeting,
Owasso City Council February 16, 1999
by reference made a part hereto. Item B on the consent agenda included the following claims:
(1) General Fund $46,640.42; (2) Collision Self- Insurance $1,951.80; (3) Workers Comp Self -
Insurance $9,514.02; (4) Ambulance Service Fund $4,600.18; (5) City Garage $11,085.39; (6)
Capital Improvements $14,834.20; (7) Ambulance Service Capital Improvement $17,390.43; (8)
Bond Projects Fund $51,140.65; (9) Interfund Transfers $4,277.11; (10) Payroll $157,550.73; (11)
City Garage Payroll $3,636.06. Item C requested a modification to the Personnel Policies and
Procedures Manual, adopting a Sexual Harassment Policy. Item D recommended approval of a
negotiated settlement by joint petition with Jim Dobrinski, wherein the City would pay $2000 for
injury to the back and $5000 for injury to the left hand, such payment in return for complete
elimination of future medical claims against the City of those injuries; and authorization for payment
of the claim, plus associated court and legal fees. Item E requested acceptance of the improvements
to the water and wastewater systems constructed to serve The Fairways V, an addition to the City
of Owasso, Tulsa County, Oklahoma.

ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR THE PURCHASE OF A RADIO
COMMUNICATION SYSTEM.
Chief Alexander presented the item. She said that the radio system currently used by the City of
Owasso is approximately 12 years old and is experiencing problems related to its age. A radio
communications team was created in July 1997 to review and evaluate the current system and project
future needs. Proposals were received from engineering firms to determine what system would be
best for the City. EIS Communications was selected to complete the analysis. After reviewing and
evaluating the data collected, EIS recommended a stand alone 800 MHz system. Because of the
expense of such a system, specifications were developed that would allow vendors to bid on either
a 450 MHz or 800 MHz system. Two bids were received, with both systems meeting the bid
requirements. After reviewing the bids, Chief Alexander, Chief Allen, and Morris Strom, EIS
Consultant, recommend the purchase of an 800 MHz system from Total Radio, Tulsa, OK. The
amount for the purchase is under the projected budget. Mr Smith moved, seconded by Ms Voss, to
approve the purchase of a radio communication system from Total Radio, Tulsa, OK in the amount
of $167,293, contingent upon the City obtaining five (5) 800 MHz frequencies.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
tACCEPTANCE OF RIGHT -OF -WAY EASEMENTS FROM CLYFTON A
RAEUBER AND MICHAEL A & CINDEE S TREAT, AND AUTHORIZATION
IFOR THE MAYOR TO EXECUTE THE DOCUMENTS.
Mr Lutz said that these are the final easements needed to complete the Elm Creek Sewer Interceptor
Project. Mr Wilken moved, seconded by Ms Voss, to accept the right -of -way easements mentioned
above, and to authorize the Mayor to execute the documents.

ITEM8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT
FOR FY 1998 -99 STREET REPAIRS AT VARIOUS LOCATIONS, BETWEEN
THE CITY OF OWASSO AND MAGNUM CONSTRUCTION INC, AND
' AUTHORIZATION FOR FINAL PAYMENT.
' Mr Lutz presented the item. He said that a contract was awarded to Magnum Construction Inc on
October 21, 1998 for FY 998 -99 street repairs. The project has been completed and the contractor
has submitted a request for final payment. The final payment is less than the amount of the contract
due to variations in actual repair surface areas and contingency repair items not used. A final
inspection was conducted on February 8, 1999. All punch list items have been corrected, and the
contractor has provided a one -year maintenance bond. Mr Smith moved, seconded by Ms
Barnhouse, to accept the work performed under a contract with Magnum Construction Inc for FY
1998 -99 Street Repairs at Various Locations, and to authorize final payment in the amount of
$28,639.33:

ADDITION IN TULSA COUNTY, OKLAHOMA.
' Staff advised Council that the street and maintenance bonds have not been received for this project.
Mr Wilken moved, seconded by Ms Voss to table this item under such time as the bonds have been
received.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR THE COMMUNITY CENTER RE -ROOF
PROJECT.
Mr Henderson said that the Community Center Re -Roof Project was advertised on December 10,
1998 and a Pre -Bid Conference was held on January 7, 1999. Six bids were received and opened
on January 18, 1999. The lowest bidder was $20,000 lower than the next low bidder, and the
architect requested that the low bidder submit a materials list used to bid on the project. That list
showed that the coping materials submitted were inferior to those specified by the architect and the
bid was disqualified. The second low bidder was also asked to submit their proposed materials, and
the architect confirmed that the materials are equal to those specified. Mr Groth asked about a
pitched roof. Mr Henderson said that the cost of a pitched roof would be more than is budgeted, and
that the roof that was bid will have a 20 -year warranty. Mr Wilken moved, seconded by Ms
Barnhouse, to award a contract for the re- roofing of the Owasso Community Center to Shelton Metro
Roofing Corp, Tulsa, OK, in the amount of $75,800.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO REQUEST
FOR COUNCIL APPROVAL OF AN INTERLOCAL AGREEMENT WITH
TULSA COUNTY FOR PAVING AT THE GOLF COURSE PARKING LOT AND
DRAINAGE WORK AT VARIOUS LOCATIONS.
Mr Carr presented the item. He said that in order to reduce cost of construction of the new
clubhouse at the golf course, Tulsa County was asked to provide construction equipment and labor
to pave the parking lot. The Interlocal Agreement provides for the work to be performed by Tulsa
County, with the City of Owasso providing all materials and traffic control. In addition, the City has
periodic requirements to perform drainage ditch maintenance. Wording has been added to this
agreement for the County to provide drainage assistance at various locations in the City. Ms
Barnhouse moved, seconded by Ms Voss, to approve the Interlocal Agreement with Tulsa County.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FROM CHARLES NORMAN ON BEHALF OF THE OWNER (JOHNSON) TO
REZONE PROPERTY LOCATED NORTH OF EAST 96TH STREET NORTH AND
WEST OF THE OWASSO EXPRESSWAY; FROM OL (OFFICE LIGHT) AND
RS -3 (RESIDENTIAL SINGLE - FAMILY HIGH DENSITY) TO CS
(COMMERCIAL SHOPPING CENTER) AND FROM RS -3 (RESIDENTIAL
SINGLE- FAMILY HIGH DENSITY) TO OL OFFICE LIGHT), CONTAINING
4.26 ACRES, MORE OR LESS.
Mr Warlick said that the applicant is requesting the above - mentioned rezoning on property located
north of East 96`h St N, west of the Owasso Expressway. The rezoning is a small area and proposed
to "square off' a tract that can then serve as a site for new commercial development planned to front
' on the north side of E 96Th St N. The Owasso Planning Commission unanimously approved the
rezoning request at their February 9, 1999 regular meeting. Mr Wilken moved, seconded by Mr
' Smith, to approve the rezoning request.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FROM CHARLES NORMAN ON BEHALF OF THE OWNER (KAISER
FRANCIS OIL CO) TO REZONE PROPERTY LOCATED ON THE SOUTH SIDE
OF EAST 86TH STREET NORTH APPROXIMATELY 700 FEET EAST OF THE
INTERSECTION OF EAST 861-H STREET NORTH AND NORTH 129TH EAST
AVENUE; FROM OL (OFFICE LIGHT) TO OM (OFFICE MEDIUM),
CONTAINING 9.46 ACRES, MORE OR LESS.
' Mr Warlick presented the item. He said that Charles Norman, applicant and attorney for the
purchaser, is requesting a rezoning of 9.46 acres, more or less, located on the south side of E 86`h St
N, east of N 129`' East Ave (east of the Albertson's site). Plans are to construct a large, two -story,
medical office facility on the site. The Owasso Planning Commission unanimously approved the
rezoning request at their February 9, 1999 regular meeting. Ms Voss moved, seconded by Mr Smith,
to approve the requested rezoning.

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR PARTIAL VACATION OF A FINAL PLAT FOR ROC OWASSO.
Mr Warlick said that the owner, Kaiser Francis Oil Company, has requested a vacation of Block 1,
Lot 8, ROC Owasso Addition. The subject property is located on the south side of E 86`h St N
between the Albertson's site and the property rezoned in item 13. The partial plat vacation is the
second step in a series of requests that are required to create a planned two -story medical mall. The
Owasso Technical Advisory Committee and Owasso Planning Commission have both unanimously
approved the partial plat vacation. Ms Voss moved, seconded by Ms Barnhouse, to approve the
vacation of Block 1, Lot 8 of the final plat for ROC Owasso.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR CITY COUNCIL APPROVAL OF A FINAL PLAT FOR ROC OWASSO II,
AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA.
Mr Warlick presented the item. He said the City has received a request to review a final plat for
ROC Owasso II, a one -lot, 16.85 acre subdivision located on the south side of E 86`h St N, east of
N 129' East Ave. The proposal will replat the easternmost portion of ROC Owasso and will plat
additional land to the east. The Technical Advisory Committee and Planning Commission have
heard and approved the request subject to the following conditions:

BAPTIST CHURCH AN ADDITION TO THE CITY OF OWASSO, TULSA
COUNTY, OKLAHOMA.
Mr Warlick said that this item is a request to review a final plat for Friendship Baptist Church
Addition, a one -lot subdivision containingl 5 acres, more or less. The subject property is located on
the south side of E 86' St N, west of N 1451 East Ave. It is zoned RS -2 (Residential Single - Family
' Medium Density). In 1996, Friendship Baptist Church received a Special Exception from the
Owasso Board of Adjustment permitting them to build a church in a residential district. The
Technical Advisory Committee and Planning Commission have both reviewed the plat and
' recommended approval subject to the following condition:
1. That acceleration/deceleration lanes and sidewalks shall be provided on E 86 " St N.

to the "Parts for Resale" line item has already been exceeded. It has been determined that an
additional $60,000 will be needed in this line item in order to cover the cost of repairs that have
already been authorized by the departments or will be authorized before the end of the current fiscal
year. Ms Barnhouse moved, seconded by Mr Smith, to approve a supplemental appropriation to the
Garage Fund Budget, increasing revenues and expenses by $60,000.

FOR THE CITY COUNCIL TO SET A FEE FOR THE SALE OF COPIES OF THE
CITY OF OWASSO CODE OF ORDINANCES.
Mr Cates said that the adopting ordinance for the City of Owasso Code of Ordinances provides for
the sale of copies of the Code to the public at a price to be determined by motion or resolution of the
City Council. The City Clerk has received a request from a local attorney to purchase a copy of the
Code, and it is necessary to establish a sale price. Four communities in the metro area were
contacted, but none of them have an established price for the sale of copies of their Code of
Ordinances. Therefore, based on the cost to reproduce the Code book, staff believes that a price of
$50.00 is reasonable. Mr Smith moved, seconded by Mr Wilken, to establish a price of $50.00 for
each copy of the Code of Ordinances sold to the general public.

The Owasso City Council met in special session on Tuesday, February 23, 1999 in the Lower Level
Conference Room at City Hall per the Notice of Public Meeting called on Tuesday, February 16,

bulletin board at 11:00 a.m. on Monday, February 22, 1999.

Mayor Bode called the meeting to order at 5:04 p.m.
Councilors present: Denise Bode, Mayor; Mark Wilken, Vice Mayor; Mary Lou Barnhouse,
Councilor; Melinda Voss, Councilor; Duston Smith, Councilor. Others present: City Manager Jeff
Hancock, City Clerk Marcia Boutwell, City Attorney Ron Cates, Human Resources Officer Allan
Harder, and representatives of the FOP Lodge and their attorney.
A quorum was declared present.

BACKGROUND:
At the February 16, 1999 meeting, the Owasso City Council approved a request to rezone
property located within the Southeast Quarter of Section 17, Township 21 North, Range 14 East.
The subject property is unplatted land generally located north of E 96' Street N, west of the
Owasso Expressway containing 4.26, more or less. The rezoning request changes the zoning on
the subject property from RS -3 (Residential Single - Family High - Density District) and OL (Office
Low Intensity District) to CS (Shopping Center District) and from RS -3 to OL.
Attached is a copy of Ordinance No. 605 which formally adopts the City Council's action of
February 16, 1999; thus establishing the change in zoning designation from RS -3 and OL to CS
and from RS -3 to OL.
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 605.

BACKGROUND:
The subject project is located in Tulsa County north of 96t` Street North abutting the west
side of El Rio Vista subdivision (see attached location map). These utility systems
include 3,031LF of 6" water, 214 LF of 4" water and 2,160 LF of 8" sewer lines. These
' systems have been permitted by ODEQ (see attached).
This item was pulled from the February 16th Council agenda. The Policy Statement
'
adopted by the Council in July 1997 requires that all infrastructure connected to City
utilities but outside the city limits be complete and operational prior to acceptance of the
utilities. A maintenance bond for streets has not been provided to Tulsa County or the
City. Staff met with the developer on February 24th to discuss the situation (see attached
memo). The developer proposes to provide the bond prior to the March 2 "d Council

meeting, and failing this, to request a waiver.
FINAL INSPECTIONS:
Public Works personnel conducted sanitary sewer and water systems final inspections
iwith
the construction contractor on January 22, 1999. Punch lists of items requiring
correction were given to the contractor on that date and all items have been completed.
The contractor has provided one -year maintenance bonds for both utility systems (see
'
attached).

RECOMMENDATION:
Staff recommends acceptance of the Kelley Ann water and sanitary sewer systems
contingent upon receipt of a street maintenance bond.

On Wednesday, February 24, 1999, staff met with Mr. Burris at his request regarding
when he would be able to obtain water and sewer taps for several homes under
construction within the Kelly Ann Addition.
It was explained to Mr. Burris that according to the Policy Statement adopted by the
Owasso City Council in 1997, the extension of municipal utility services to subdivisions
outside of Owasso's Corporate Limits is possible, provided that all existing infrastructure
(water, wastewater, streets, and storm sewer) is totally completed and operational.
Furthermore, it was communicated that while it is my understanding that the City of
Owasso has inspected and is ready to accept water and wastewater improvements that
have been made in the Kelly Ann Addition, the City could not do so until such time that
the streets are completed.
Mr. Burris explained that it was his intention to have the streets completed and a
maintenance bond (or its equivalent) secured by Tuesday evening, and could this item be
placed on the agenda for approval. Additionally, Mr. Burris also wanted to be afforded
the opportunity to seek a "waiver or deviation" from the policy in the event that the
streets were not completed. Mr. Burris was infanned that he could request deviation
from the Council but that it could not be supported by staff.
Developers of residential property within the City of Owasso are not afforded the
opportunity to obtain building permits in their additions until such time that water and
wastewater are accepted. and either the streets and storm sewers are constructed and a
maintenance bond is submitted, or a performance bond is submitted for their
' construction. 'ro offer Mr. Burris a deviation from the adopted policy would not be
equitable to those who develop within our limits and according to our standards.
' Also, the primary reason for this requirement is to require that the infrastructure for this
addition be built to City of Owasso standards. Quite simply, the streets are not totally
completed and the only manner in which the City of Owasso can ensure that they will be
!" completed is to withhold the water and sewer taps.

Pursuant to O.S. 27A 2- 6-401, the City of Owasso is hereby granted this permit to construct 2,160 '
L.F. of eight (8) inch sewer lines and appurtenances to serve the Kelley Ann Addition, located in
part of E -1/2 of E -1/2 of SW -1/4 of Section 18, T -21 -N, R -14 -E, I.M., Owasso, Tulsa County,
Oklahoma, in accordance with the plans and specifications approved on October 24, 1997.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in
accordance with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the state
certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted
thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and '
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of '
approval or the phases not under construction will be resubmitted for approval as a new
project.
3) That no significant information necessary for a proper evaluation of the project has been
omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with OAC 252:655- 9 -1(h) of the
Standards for Water Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines
will prevent excessive infiltration and that the leakage will not exceed 200 gallons per inch 61
of pipe diameter per mile per day.

By acceptance of this permit, the permittee agrees to operate and maintain the facility in
accordance with the Public Water Supply Operation rules (OAC 252:630) and to comply with the
State Certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted
thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new
project.
3) That no significant information necessary for a proper evaluation of the project has been
omitted or no invalid information has been presented in applying for the permit. '
4) That the Oklahoma Department of Environmental Quality shall be kept informed on
occurrences which may affect the eventual performance of the works or that will unduly '
delay the progress of the project.
5) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with Public Water Supply Construction 4
Standards (OAC 252: 625- 17 -4).
6) That before placing this facility into service, at least two samples of the water, taken on ,
different days, shall be tested for bacteria to show that it is safe for drinking purposes.

February 24, 1999
Project for intersection improvements at 86a' Street North and Main Street and 86"' Street North
and North Mingo Road are included in the 1998 Bond Issue. Design of the 86th Street North and
Main Street improvements was originally completed in 1988 and revised in 1997. Subsequent to
the revision of the plans, the Oklahoma Department of Transportation (ODOT) has provided
$750,000 of local government funds toward the overall construction. Total construction cost is
estimated to be approximately $2,458,230, which includes right -of -way acquisition, utility
relocation and contingency. The 86h Street North and North Mingo Road project has been
submitted to ODOT for the same type of funding and presently is being designed. The 861'
Street North and Main Street project is currently on the ODOT bid letting schedule for late
Spring or early Summer 1999. The 86a` Street North and North Mingo Road is not currently on
an ODOT bid letting schedule but is anticipated to be bid by the City in the Summer 1999.
Acceptance of the ODOT funds requires specific design and procedural criteria to be followed
with respect to public involvement, project notifications and right -of -way acquisition. City staff
have had limited experience with the required procedures for rights -of -way acquisition using
ODOT funds. In addition, staff time necessary to develop acquisition documents, contact
property owners and conduct other real estate - related services is limited. Therefore, a Request
for Qualifications for real estate and right -of way acquisition services for this and other projects
was prepared.
REAL ESTATE AND RIGHTS -OF -WAY ACQUISITION PROCEDURE:
To proceed with bidding and have construction initiated in accordance with the ODOT schedule,
temporary and permanent rights -of -way for construction are required. Following discussion with
City Council and staff, a procedure for real estate and right -of -way acquisition has been

developed for use on projects (see Attachment 1). The procedure combines real estate
acquisition professional services for collection of various data and uses city staff as the point of
contact with property owners.
REQUEST FOR QUALIFICATIONS:
Request for Qualifications for real estate and right -of way acquisition services for these and other
projects was prepared. Four (4) firms were sent Requests for Qualifications and responses were
received from three (3) of these firms. Staff reviewed the qualifications statements and selected
Cinnabar Service Company as the most "Qualified and Highly Responsive" firm. Specific future
projects would be identified and price proposals submitted as professional services, thereby not
requiring competitive bids.
A meeting was held with representatives from Cinnabar to discuss potential projects. At that
time a request for a letter proposals were requested.
LETTER PROPOSALS:
86'' Street North and Main Street
Prior to formalization of the acquisition procedure, a letter proposal was submitted on December
14, 1998 for consideration (see Attachment 2). Included in the proposal is a per parcel statement
of fees to conduct the following services:

The stated fee is projected based on per parcel costs associated with each activity and is expected

' phase of work will identify property owners. Donation requests will be made by the city
followed by an assessment of the magnitude of detailed appraisals required prior to entering
negotiations. Appraisals will serve as a basis for property valuation.

A letter proposal was submitted dated February 15, 1999 for consideration (see Attachment 3).
Included in the proposal is a per parcel statement of fees to conduct the following services:

The above proposal will be reduced by $4,500 with city staff handling negotiations. The

Other proposals
Fee proposals for 86th Street North and 145th E. Avenue (Attachment 3 in the amount of $720)
and 761h Street North and 129th E. Avenue (Attachment 4 in the amount of $1,830) have been
received. These proposals are within the spending authorization limit of the City Manager and
are not included with this recommendation.
FUNDING:
Fees for each proposal will not be exceeded without approval of the City of Owasso. Each
project will be monitored to define which work tasks are to be assigned the consultant versus use
of city staff. Should additional consultant services be needed as work progresses, further funding
authorization will requested.
Funding for these services is included in the 1998 Bond Issue as part of the 86th Street North and
Main Street and 86th Street North and North Mingo Road Intersection Improvements project.
RECOMMENDATIONS:
Staff recommends Council approval of a letter proposals for Right -of -way Services for the 86th
Street North and Main Street Intersection Improvements in an amount not to exceed $14,750 and
86th Street North and North Mingo Road Intersection Improvements in an amount not to exceed
$6,060 with Cinnabar Service Company.

REAL ESTATE AND RIGHT- OF- WAY/EASEMENT ACQUISITION PROCEDURE
Overview and Purpose
A primary objective for the City of Owasso is to provide improvements to the infrastructure
(water, sewer, streets and drainage). Periodically, these improvements involve construction on
or adjacent to privately -owned lands that requires a subsurface easement for the construction,
operation and maintenance and temporary or permanent surface right -of -way to enable adequate
area for construction and the improvement.
The City of Owasso will take all reasonable effort to keep from having to request right -of -way
and /or easement in order to construct improvements. Designs will incorporate practical
alternatives to minimize property acquisition. There will be times, however, that property
acquisition will be unavoidable..
Acquisition of real estate can become formal and insensitive to the property owner. The City of
Owasso desires to maintain a personalized approach to the process as much as possible. The
policy has been developed to blend the use of contracted professional services for data collection
and city staff involvement for property owner contact and project - specific discussion.
The purpose of this policy is to establish the framework for the methodology in obtaining the use
of the subject property for proposed infrastructure improvements. The following steps have been
identified:
Preliminary Data Collection
1. Final project design drawings will be utilized to determine pipeline route alignment
and /or the limits of construction. The intent is to use detailed drawings and legal
descriptions that should minimize the probability of adding to or subtracting from the
required real estate acquisition in the future.
2. Legal descriptions serve as the basis for to determine property ownership. To
facilitate data collection, it is anticipated that a company specializing in real estate
professional services will be utilized. The company will be responsible for
performing title and easement research on the property.
3. Data collection will include determination of the existing property owner, mortgage
information and obtaining a copy of the warranty deed for each property These data
will be compiled by the real estate service company and a separate file established for
each property.
Donation Requests
4. Each property owner will be provided a request to donate the subject property by the
City of Owasso. A letter requesting the donation will be prepared for each property
owner identified in the data collection phase. Those properties not obtained as a
donation will require negotiation and /or condemnation.

Mortgage Subordination
5. All mortgage holders identified during data collection will be contacted by the City
Attorney and asked to subordinate their mortgage interest to the City of Owasso for
the purpose of obtaining the requested acquisition.
Negotiation
6. Those properties not obtained as a donation will require negotiation of value.
Analysis of area comparative sales will be performed by the real estate service
command will serve as the basis of property value for negotiation
7. Prior to initiating the negotiation phase, a status meeting will be held with City
Council to present findings and establish criteria for the negotiation phase. Each
property will be presented and negotiation criteria developed on a case -by -case basis.
8. Negotiations will be performed by City of Owasso staff.
9. In the event that there is failure to negotiate mutually acceptable provisions for the
real estate acquisition, staff may recommend modification to the design to change
alignment or limits of construction. Another option may be to initiate condemnation
proceedings.
Condemnation
10. At the recommendation of the City Attorney, condemnation proceedings may be
initiated for properties that could not be acquired through negotiation. Condemnation
will be approved by the City Council in advance.
11. Concurrent with the first steps in the condemnation process, the real estate service
company will be directed to prepare comprehensive narrative appraisals for each
remaining property. These appraisals will be performed at the direction and to the
level of detail required by the City Attorney. A professional review of the narrative
appraisals will be required for projects using Federal funds to assure procedural
compliance to determine value.
12. Initial steps in the condemnation process prior to having the ability to utilize the
subject property could take from 90 -120 days.
13. Condemnation procedures are established by State of Oklahoma statute and will be
directed by the City Attorney. I

The City of Owasso will receive qualifications statements from firms pursuant to entering into a contractual
agreement for the performance of real estate and right -of -way acquisition services for various projects and
locations as outlined below.
The qualifications statements will be received in the Public Works Administration offices (320 S. Dogwood)
until 2:00 p.m., November 6, 1998. Following submittal, each statement will be reviewed by a Selection
Committee.
BACKGROUND
The City of Owasso/Owasso Public Works Authority has various projects that have been or are being designed
that will require real estate and/or rights -of -way acquisition. These projects consist of, but not be limited to, road
intersection signalization, street lane expansions, wastewater collection system improvements and new building
construction. Successful construction of these projects may require land purchase, permanent right -of -way or
temporary easement acquisition. The Firm selected for these services must be qualified to assist in negotiating
easements and rights -of -way, conducting property ownership analyses and performing land value appraisals.
I. GENERAL INFORMATION
A. The purpose of this Request for Qualifications (RFQ) is to obtain professional real estate
appraisal and right -of -way /easement acquisition services.
All qualified proposals will be considered without regard to age, race, creed, color sex, handicap or
national origin.
B. INSTRUCTIONS AND SUBMISSION OF STATEMENTS
1. Closing Submission Date
Statements must be submitted prior to 2:00 p.m. on November 6, 1998. The submittals
will be referred to a Selection Committee who will evaluate each statement in
accordance with the evaluation criteria stated later in this RFQ.
2. Conditions of the Submittal
All costs associated with the preparation of a qualifications statement in response to
this RFQ will be the responsibility of the offerer and will not be reimbursed by the City
of Owasso.

II. QUALIFICATIONS STATEMENT CONTENT
All sections A through H must be included in the following format:
A. Cover letter
B. Qualifications of the FIRM
This section shall discuss prior relevant experience of the firm. Particular mention should be
made regarding previous experience on similar projects. The section shall also include a
discussion of projects performed within the past twelve (12) months. The discussion of each
project shall include information concerning a description of any similar work, project
schedules and special circumstances encountered. All current or pending litigation against the
firm shall be provided.
C. References
References shall be provided, with current names, addresses and telephone numbers included
for all appropriate points of contact.
D. Present Projects
This portion of the submittal shall also include a listing of all projects currently in progress by
the firm and their anticipated completion date.
E. Firm Organization and Staffing
This section shall discuss staffing showing key personnel. Resumes of key personnel shall be
included as an appendix.
F. Detail of Billing Rates
The firm shall provide detailed information concerning billing rates for each person. Included
shall be a description of other direct fees, charges and expenses anticipated (i.e., mileage,
telephone, and reproduction). An explanation of the conversion of direct labor rates to billing
rates to determine the multiplier used by the firm is to be provided.
G. Description of Additional or Supporting Services
The firm shall submit a description of other capabilities to provide the City with additional
information which may be used as a reference should they desire the firm to perform additional
or supporting services.
H. Proposal Affidavit
The attached proposal affidavit shall be completed, executed and included with the proposal.

III. REVIEW CRITERIA FOR THE PROPOSALS RECEIVED
Qualifications statements will be reviewed in terms of content and completeness. Any or all references
may be contacted. Each required item will be reviewed and the following factors will be assessed:
' 1. Experience and competence of the firm and staff in the required areas of expertise.
2. Capacity to perform all required services.
' 3. Ability to expedite the completion of the project in a timely manner.
4. Evaluation of record on similar projects which shall include quality of work and cost
control.
All submittals that have been received by the deadline and in the manner required in this RFQ will be
opened and evaluated by a Review Committee. Based upon this evaluation, the Review Committee will
identify a firm as the most "Qualified and Highly Responsive Firm ".
As project locations are identified, the selected "Qualified and Highly Responsive Firm" will be
requested to submit a letter proposal of services and fee for specific services. If warranted, the terms
of the agreement for services will be negotiated.

' AND CLOSING COSTS AND RELATED FEES FOR PROPERTY
NECESSARY TO CONSTRUCT A NEW CITY HALL

tBACKGROUND:
' On December 1, 1998, the City Council accepted Purchase Option Agreements from six property
owners at the Main Street site proposed for the construction of a new City Hall., and authorized
the Mayor to execute the agreements. The Purchase Option Agreements indicated that the City
' Council would need to approve contracts to purchase the properties no later than January 19,
1999. The City Council approved those contracts for the purchase of real estate on January 5,
1999 and authorized the payment of earnest money, if applicable. The Council did not authorize
' payment for the property at that time.

The Contract for the Sale of Real Estate on each piece of property contained a date on which the
property would close. When the contracts were approved, no provision was made for the
payment of closing costs and related fees. Four of the properties will close on March 15, 1999,
and the closing costs must be paid at that time. The closings are being handled through Delta
Title & Escrow, Owasso, OK, and the City has been provided with estimated closing costs and
fees. Exact costs will not be known until fee amounts are received from the attorneys examining
the titles. The City has selected two local attorneys, Mr David Charney and Mr Noble
Sokolosky, to do the title work and obtain the title insurance. It is estimated that total closing
costs and related fees for all six properties will be less than $6000.
The impending closing also requires that authorization now be given for the payment of the six
properties.
RECOMMENDATION:
Staff recommends City Council approval of closing costs and related fees for the purchase of
property proposed for the construction of a new City Hall and authorization for payment in an
amount not to exceed $6000. Staff further recommends Council authorization for payment of the
properties as provided for in the Contracts for Sale of Real Estate approved on January 5, 1999.
