Consideration and Appropriate Action Relating to Change Order #1, a Change Order to a Contract Between the City of Owasso and Frix and Foster Construction of Muskogee, OK for Construction of a Four -Plex at the Sports Park. tMr Henderson Attachment #7 ' The staff will recommend Council approval of Change Order #1, increasing the contract by an amount not to exceed $7000 for undercutting unsuitable soil material. 8. Chief Allen Attachment #I I Staff has completed the bidding process, reviewed the bids received, and will recommend a contract be awarded to Excellence Ambulance, Fayettevile, AR, for the purchase of one new Chassis and Modular (box) Type I Ambulance at a purchase price of $150,175.15. t 12. Consideration and Appropriate Action Relating to the Award of a Contract for the Purchase of Self- Contained Breathing Apparatus. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND WASTEWATER SYSTEMS CONSTRUCTED TO SERVE KELLEY ANN ADDITION IN TULSA COUNTY, OKLAHOMA. Mr Lutz presented the item. The subdivision is located north of 96" St N, west of El Rio Vista, and is outside the city limits. A Policy Statement adopted by the Council in July 1997 requires that all infrastructure connected to City utilities but outside the city limits be complete and operational prior to acceptance of the utilities. Tulsa County confirmed on March 15' that the developer had complied with the water and sanitary sewer systems maintenance requirements, but that the subdivision pavement had not been completed. The final paving was completed on April 1St to the satisfaction of Tulsa County and the City. Public Works has conducted final inspections and all punch list items have been completed. Mr Smith moved, seconded by Ms Barnhouse, to accept the water and sanitary sewer systems constructed to serve the Kelley Ann Addition. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF A FINAL PLAT FOR NOTTINGHAM ESTATES III, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA. Mr Warlick said that this item, as well as Item #8, were tabled to this meeting from the March 16, 1999 agenda because staff had not received the necessary water and sewer permits from the Department of Environmental Quality. Those permits still have not been received and staff requests that these two items be withdrawn from the agenda. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF A FINAL PLAT FOR NOTTINGHAM ESTATES IV, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA. Ms Voss moved, seconded by Ms Barnhouse, that this item be withdrawn from the agenda. AYE: Voss, Barnhouse, Smith, Wilken, Bode NAY: None Motion carried 5 -0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE AWARD OF A CONTRACT FOR THE PURCHASE OF AN INSPECTIONS VEHICLE FOR THE COMMUNITY DEVELOPMENT DEPARTMENT. Mr Rooney presented the item. He said that an additional vehicle will be necessary in the inspections area when an additional building inspector is hired. That position has been approved by the Council and has been advertised. Specifications were prepared and bids were solicited from seven vendors in the metro area. Four vendors responded with bids ranging from $15,261.95 to $16,219.68 for a 1999 half ton pickup truck. Because the three low bids were so close, the building inspector inspected all three vehicles for size and comfort, and preferred the vehicle from Reliable Chevrolet at a cost of $15,481. Mr Wilken moved, seconded by Ms Voss, to award a contract for the purchase of a 1999 dark blue half -ton Chevrolet pickup truck to Reliable Chevrolet, Tulsa, Ok, in the amount of $15,481. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST ' FOR CITY COUNCIL APPROVAL OF A "DETERMINATION OF CATEGORICALLY EXCLUDED/NOT SUBJECT TO 24 CFR 58.5 ", AND THAT THE MAYOR BE AUTHORIZED TO EXECUTE SUCH DOCUMENTS AS REOUIRED BY CDBG CONTRACT NUMBER 8095 CDBG 97. I' Mr Henderson said that the City of Owasso received a Community Development Block Grant from the Oklahoma Department of Commerce to make improvements to the Community Center, in 11 3 Owasso City Council April 6, 1999 conjunction with the re- roofing project. The grant amount was $35,000, and has been earmarked for new carpet. Since the CDBG program uses federal funds, the project is required to have an environmental review. INCOG, the administrator of the grant, has determined that the National Environmental Policy Act considers carpet replacement to be "categorically excluded" because it is not likely to have a significant impact on the environment and is not in a floodplain nor in a wetland. INCOG has requested that the City of Owasso approve the "Determination of Categorical Exclusion/Not Subject to 24 CFR 58.5 ". Mr Wilken moved, seconded by Ms Voss, to approve the Determination of Categorically Excluded as required by the CDBG grant and that the Mayor be authorized to execute the document. AYE: Wilken, Voss, Barnhouse, Smith, Bode NAY: None Motion carried 5 -0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO MOWING CONTRACTS FOR CITY PROPERTIES. For the past nine years, the City of Owasso has utilized private sector contractors for the purpose of providing mowing services for city properties during the summer growing months. This program continues to be cost effective. Mr Roberts said the 1999 mowing bid packets were sent to 30 prospective mowing contractors and the bid was advertised in the Owasso Reporter. Bids were received from seven contractors. The bids received for mowing city parks showed a decrease of $33.00 per mowing from the 1998 season costs. The bids for easements, medians and right -of -way areas showed a slight increase of $16.00 per mowing. Total expense for all the contracts for the mowing season will be $27,396, a savings of $630 over the 1998 season. Ms Voss moved, seconded by Ms Barnhouse, to approve the following contracts for the 1999 mowing season: 1. Rayola Park - Larry Turner at $214.00 per mowing 2. AYE: Wilken, Barnhouse, Smith, Voss, Bode NAY: None Motion carried 5 -0, and the meeting was adjourned at 6:45 p.m. Marcia Boutwell, City Clerk 5 Denise Bode, Mayor 1 i 1 1 1 1 OWASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Tuesday, April 13, 1999 The Owasso City Council met in special session on Tuesday, April 13, 1999 in the Lower Level Conference Room at City Hall per the Notice of Public Meeting called on Tuesday, April 6, 1999, and Notice and Agenda filed in the office of the City Clerk and posted on the City Hall bulletin board at 4:00 p.m. on Monday, April 12, 1999. ITEM 1: CALL TO ORDER AND ROLL CALL. Mayor Bode called the meeting to order at 6:30 p.m. Present: Denise Bode, Mayor; Mary Lou Barnhouse, Councilor; Melinda Voss, Councilor; Duston Smith, Councilor; HC "Will" Williams, Councilor- Elect; City Manager Jeff Hancock; Assistant City Manager Tim Rooney; City Clerk Marcia Boutwell; City Attorney Ron Cates; Finance Director Sherry Bishop; Public Works Director Robert Carr; Director of Information Systems Frank Knight; Fire Chief Bob Allen; Capital Projects Manager Dwayne Henderson; and staff from Frank-Crawford and Associates. Absent: Mark Willken, Vice Mayor. A quorum was declared present. Because some presenters were not present at the beginning of the meeting, the Mayor presented the items out of posted order. ITEM 3: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A WORKERS COMPENSATION CLAIM AGAINST THE CITY OF OWASSO BY MAX DOWNING. Mr Harder presented the item, stating that Mr Downing is retired under disability resulting from a work - related injury on January 14, 1997. Because of the nature of the injuries and possible on -going treatment and other costs, the staff has been in the process of negotiating with Mr Downing's attorney to settle his workers compensation claim on a joint petition. A joint petition offer has been received in the amount of $7000 plus associated court costs and legal fees. This settlement will eliminat further liability for the City of Owasso, or any further benefits to Mr Downing resulting from this injury. Ms Barnhouse moved, seconded by Ms Voss, to approve the joint petiton settlement as presented. AYE: Barnhouse, Voss, Smith, Bode NAY: None Motion carried 4 -0. ITEM 4: DISCUSSION RELATED TO THE PURCHASE OF COMPUTER SOFTWARE AND HARDWARE. Mr Knight gave an update of the bids received for a financial and administrative services software package. He said that staff has visited several sites where vendors have software that was bid. There will be an item on the next regular City Council agenda that will allow the staff to negotiate a contract for the purchase of the software. Networking hardware will be addressed at a later time. Owasso City Council April 13, 1999 ITEM: 7 UPDATE ON PUBLIC WORKS DEPARTMENT ITEMS A. Sludge Hauling B. Sewer Flow Monitoring C. Commercial Refuse in Residential Areas Mr Carr said that staff is preparing an agreement for sludge hauling. That agreement should be ready for action within the next month. He explained the procedure for sewer flow monitoring and said that there will be an action item on the next regular OPWA agenda to rent and purchase equipment for sewer flow monitoring. Mr Carr said that there has been concern expressed regarding commercial refuse vehicles in residential areas. Commercial refuse containers are used where there are apartment complexes. There is a potential for the vehicles to tear up newly constructed or repaired streets getting to those containers. The staff is exploring utilizing residential refuse containers in those areas. ITEM 5: DISCUSSION RELATED TO FIRE /AMBULANCE ITEMS. A. Review of Ambulance Bids B. Review of SCBA Bids Chief Allen reviewed the bids received for the purchase of a new ambulance and for the purchase of breathing apparatus. These items will be on the next regular City Council agenda for action. ITEM 6: REVIEW OF BOND PROJECTS. A. Main Street project B. Change Order #1 to Four Plex Project C. Change Order #2 to Street Construction Projects Mr Henderson briefed the Council on options related to a proposed Main Street project. He also discussed a change order to the four -plex project. The contractor has uncovered two old ponds, and that soil needs to be removed and stabalized. A change order to the street rehabilitation projects was also discussed. The latter two items will appear as action items on the next regular City Council agenda. ITEM 2: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PERSONNEL MATTERS RELATING TO THE OFFICE OF THE COURT CLERK, SUCH EXECUTIVE SESSION PROVIDED FOR IN O.S. 25, SECTION 307(B)(1); AND FOR THE PURPOSE OF DISCUSSING POSSIBLE LITIGATION INVOLVING THE CITY OF OWASSO AND OWASSO INVESTMENTS INC, SUCH DISCUSSION ALLOWED PURSUANT TO 25 O.S., SECTION 307 -B(4); AND FOR THE PURPOSE OF DISCUSSING THE ACQUISITION OF REAL PROPERTIES RELATED TO THE NORTH OWASSO SEWER SYSTEM, SUCH DISCUSSION ALLOWED PURSUANT TO 25 O.S., SECTION 307 -B(3). DISCUSSION RELATED TO A RENTAL CONTRACT WITH THE CHAMBER OF COMMERCE. Mr Hancock briefly discussed a proposed agreement with the Owasso Chamber of Commerce for ' lease of the building now occupied by the Chamber and owned by the City. ROONEY ASSISTANT CITY MANAGER SUBJECT: OPWA RESOLUTION NO 99 -01 ORDINANCE NO. 608 WATER RATE DECREASES FOR RURAL CUSTOMERS DATE: April 15, 1999 BACKGROUND: In June of 1998, staff was contacted by Mr. Witt, a resident of the Pleasant View addition, regarding the disparity between water rates charged to customers. Mr. Witt was specifically concerned about the difference in the rates for customers that resided within the corporate limits of Owasso as opposed to those that did not. Upon Mr. Witt's presentation to the OPWA, staff was directed to review water rates for those customers and possible adjustments. ' HISTORY: Historically, the OPWA funded improvements to the water system through the utilization of property taxes. Because the OPWA could not apply a property tax on property outside of the corporate limits of Owasso, the city charged a higher usage rate for water. This insured that all users of the water system shared equally ' in the expense of the improvements; with the city customers having a lower usage rate and a property tax, and the rural customers having a higher rate and no property tax. ' In 1992, the OPWA began the process of earmarking additional revenues generated by water and sewer rates to fund capital improvement projects and their associated costs and/or in order to pay debt service on indebtedness relating to improvements. In 1993, the OPWA adopted a policy of a "phased in' program to equalize the rate difference between "in city" and "rural" customers. The program was based on the concept that the city no longer utilizes property taxes to fund water improvements. At that time, rate increases passed on to the OPWA from the City of Tulsa were no longer passed on to our rural customers. The current rate structure has rural customers paying 62.391/o more than the "in- city" rate. PROPOSED RATE CHANGES: ' Staff conducted a review of the rates between the two o types of customers over the last several months. In While certainly it can be determined that a 62.39% rate difference between the rural rates and the city rates is not equitable, it was determined that a modest difference between the two rates should remain in order to encourage development within the city limits. For instance, if there is no rate difference between rural ' and city rates and development can "tap on" to city water and sewer, what encourages a developer to develop within the city limits? Without at least a slight benefit of a less expensive water rate, there is no incentive and the city loses all sales tax revenue from infrastructure materials to building materials. Several different rate scenarios were reviewed and staff is comfortable with a rate difference of 20% between the "city" customers and the "rural" customers. This represents an approximate 25% reduction in the current rural rate, and providing the customer uses less than 14,000 gallons of water per month, is slightly below the rate that Washington County Rural Water District #3 charges its customers. The rate decrease represents an annual impact to OPWA revenues of nearly $37,738, however the entire customer base is growing and the impact of $37,738 in 1999 is not what it would have been in 1993 and can be absorbed. ADDITIONAL COMMENTS: Unchanged by this rate decrease are all customers within the city, all those customers of Rural Water District #3 Rogers County acquired prior to November 1, 1993, and all sewer rates. City ordinance also provides for a 20% discount for low - income families who meet established criteria and these discounts would not be effected by this rate change. In order to clarify all water and sewer rates charged by the OPWA, all have been included within OPWA Resolution 99 -01. There is no change in sewer rates. RECOMMENDATION: Staff recommends OPWA adoption of Resolution 99 -01, establishing the water and sewer rates for all customers as set forth within Resolution 99 -01. Necessary documents were returned to the City Clerk's office and the construction of the improvements began on Monday, March 29, 1999. The total contract amount for the improvements was $267,308.00. The contractor has stripped the grass and top soil from the site and has started grading the fields for drainage. On April 7, 1999 the contractor called City staff to show us an old pond that he had uncovered on the Four -Plex site. He told us that the pond was small enough that he would excavate the unsuitable material in the pond bottom and replace it with material from our borrow pit at no i extra cost. On April 9, 1999 the contractor found the remnants of a larger pond on the site. The second pond is so large that the contractor will need compensation to excavate the unsuitable material. The contractor estimates that approximately 4000 cubic yards (c.y.) of unsuitable material will need to be excavated and transported to the waste area adjacent to the parking lot constructed last year. Jim Crosby with Planning Design Group, the Project Architects, visited the site and verified that the material was unsuitable and suggested an alternative of mixing the unsuitable soil with the existing borrow material, but the contractor stated that it would be least costly for him to remove and dispose of the material than to handle the same material twice. The contractor has proposed to remove and dispose of the unsuitable material for a cost of $1.75 per c.y. for a cost not to exceed $7000.00. However, the contractror has proposed to transport and backfill the large pond and use as much of the unsuitable material as possible to reinforce the Sports Park detention pond berm at no extra cost. Inc., of Owasso for the purpose of reconstruction of several streets as part of the Bond Projects. Necessary documents were returned to the City Clerk's office and the construction of the improvements began on November 30, 1998. The total contract amount for the improvements was $836,954.95 On December 15, 1998 Change Order No. 1 for this project was approved by City Council for a not to exceed cost of $19,270.94 for the use of quick -set flowable fill to stabilize the subgrade under 11 to Street because of ground water problems. Since Change Order No. 1 has been approved, the contractor has completed l Vh Street, is 90% complete with Atlanta and is approximately 25% complete with Carlsbad/Beaumont. Since the initial change order was approved, several field changes have been made to add and decrease individual line item quantities on the projects. Staff has also worked with the contractor on proposals to add a geotextile fabric on Atlanta to reduce the asphalt cracking; replace two collapsed storm sewer lines on Atlanta; and to revise the underground storm drainage work on Carlsbad. IPROPOSED CHANGE ORDER # 2: I Itn Street - Staff made several field changes on this project after the subgrade of this project was exposed. The field changes were made to assure proper drainage and an adequate road base. The additional cost after the final quantities on 11th Street were tallied is $4,069.31 Atlanta - Staff reduced several of the large roadway repairs that initially appeared to be causing the asphalt cracking. After closer study, the asphalt cracks in several large areas were ' a result of asphalt failure not subgrade failure. In order to keep the cracks from reflecting through the new paving, a reinforcement fabric is proposed for the street. 11 5 Page 2 Request for Approval of Change Order No. 2 1998 Bond Issue Projects - Street Rehabilitation Projects April 13, 1999 Staff also directed the contractor to remove and replace 174 lineal feet of storm drainage pipe , at 5th and Atlanta that had collapsed and was not allowing proper drainage of the intersection. The cost associated with the changes on Atlanta resulted in a savings of $2,715.61. M Carlsbad/Beaumont - In order to keep the drainage costs to a minimum on this project, the storm drainage on Carlsbad was originally designed to flow across the 13th fairway on the ' Bailey Golf Ranch Course, instead of underneath Carlsbad. But, the flows witnessed since construction began indicated that the fairway could be damaged by the water velocities. Staff and the project engineers researched another option, which will allow the storm drainage pipe , to be placed on private property between the fairway and the residence along Carlsbad. The property owners have been contacted and staff is negotiating the rights -of -way for this change in alignment. The additional cost to construct this storm drainage is $79,670.64. That review was completed and Frank Crawford presented a report to the City Council on April 13, 1999. A Computerization Task Force was formed at that time and data was collected towards the computer /software needs assessment of the City of Owasso. An Information Systems Director was hired in January 1998 and the Computer Management Team (CMT) was formed in July 1998. The CMT worked to produce an all- inclusive schedule for the computerization of the City. The initial step in this schedule /plan was the acquisition of computer hardware. This was accomplished in October/November 1998. Under City Code 7 -107 the City is allowed to purchase equipment at a price not exceeding that set by the State Purchasing Agency. A total of forty computer workstations were ' purchased from DELL Computer Corporation at a cost of $68,280 and a savings of $20,000 to $100,000 from State Contract SW84040 for Computers and Peripherals. tThese computers are installed and are utilizing Microsoft Office 97 desktop automation products. Tulsa Technology Center was hired to provide education on Windows 98 and the Microsoft Office 97 ' products through their Mobile Lab. This ongoing education has covered all the basics for over fifty different employees and is continuing with advanced classes in each application. The next step in the schedule was to acquire software for a Financial and Administrative Software System. In January 1999, the City Council gave their approval to the City to submit a Request for Proposal for this type of system. Eleven RFP's went out on January 18, 1999 and were accepted on ' February 19, 1999. 1 STATUS UPDATE Incode, Pentamation, and Creative Computer Solutions were selected as possible solutions to the City's current and future needs. Following are the steps used in determining which vendor offered the best solution: • Vendors were evaluated based on their response to the RFP and how many applications were available to fill the City's needs • Software demonstrations were held at City Hall for each vendor and their applications and were viewed by the CMT and several City employees • Meetings were then held to discuss the `plus and minus' side of each vendor's software applications • Site visits to cities in Oklahoma and Utah were attended by the CMT where `live' demonstrations were viewed and long discussion groups were held with the employees of the cities using the software • Multiple telephone interviews were held with the vendor's submitted references on the RFP • Other telephone interviews were held with some of the existing clients on the vendors client list • A strong emphasis was placed on how the clients /references responded to questions about support • Research was done on the operating systems and database platforms through the Internet, companies associated with the City of Owasso, and consultants that live in or near Owasso • Software, training, and installation pricing (attached) The three vendors provided software applications/systems that were far in advance of the current platform being used by the City of Owasso today. Each would be a step forward. Incode provided a solution to the current needs of the City, but it was determined that Pentamation and Creative Computer Solutions provided a better integration between applications, more efficient/user- friendly graphical screen displays, and a more advanced focus on future enhancements to their system. Of the two remaining vendors, Creative Computer Solutions returned a more complete response to the specifications as outlined in the Request for Proposal. Interviews with Pentamation clients also revealed a need for code modifications just to get standard reporting formats (i.e. checks, purchase orders). Based on the evaluation by the Computer Management Team and what will fit the needs of the City of Owasso today and in the future, the staff would like to ask for authorization to negotiate a contract for the purchase of computer software from Creative Computer Solutions. The process was begun by considering how long this unit will need to be utilized before it will have to be replaced. In 1993, the department was averaging about 12,000 miles per year, and in 1997 about 17,000 miles per year. With the yearly increase in the number of miles being ' placed on the units, and the increase in the number of calls, it was determined that the vehicle we purchase will need to be in service for 100,000 miles, or approximately five years, before it is replaced. For this reason, a Freightliner chassis was chosen. The staff then looked at the unit ' from a patient's point of view. The number one concern is the patient's comfort during the trip to the hospital, since we are an average of 20 -30 minutes away. Also considered was the ease of loading and unloading a patient, the ability and ease of getting to the patient and treating them once inside the unit, the safety of the crew and patient while transporting, (how well the unit is made structurally), the ability to clean and decontaminate the unit, the size of the compartments, access to the equipment whether from the inside or the outside of the unit and from either side of the unit. Being able to access from either side of the unit is a safety item, especially while on scene of a motor vehicle accident. This enables the rescuers to stay out of the traffic. ' The bid specifications were sent out February 23, 1998 and bids were received and opened on March 18, 1998. REVIEW OF BIDS: ' All bids submitted were reviewed. The review committee looked at compliance and non- compliance of the specification. Non - compliance did not automatically rule the bidder out. The committee also looked at the time frame listed for delivery, the references of agencies purchasing ambulances from each vendor submitting a bid, and the warranty procedures for fixing a unit. Further, a list of what was considered to be some of the more important items was developed and each vendor's submittal was checked to determine whether or not they met the requirements. REVUEW OF AMBULANCE BIDS APRIL 13, 1999 PAGE 2 WHEELED COACH $133.605.00 When Wheeled Coach submitted their bid, they took a total exception to the entire bid specifications. Joseph Zillmer, the contact person for Wheeled Coach, was contacted and HE stated that it was easier for him to take a total exception and send us a copy of their own specifications than to submit the variances to our specifications. After searching through the bid packet submitted, we discovered that they met most of the specifications. However, the total length of their vehicle is longer than our specifications call for and, as such, will not fit in our bay and allow us to pass by the vehicle safely. Concerning the warranty work, he was willing to send a person of our choice to their own warranty school in Florida at the company's expense so that all work could be done locally. All expenses would be paid by Wheeled Coach. We were told he would put that in writing, however nothing has been received yet. MEDIC MASTER $126,500.00 Medic Master was unable to comply with the requirement of having built at least 100 ambulances in the last five years. Also, they went over the required length of the vehicle and it will not fit safely in our bay. All warranty work is done in Clinton Ok., and the vehicle must be taken there by the department. Collinsville EMS recently purchased a Boardman (now called Medic Master) ambulance. They were contacted and stated they had problems with the unit from the very beginning. During the delivery of the unit, it had stalled several times. Even though Boardman knew about the problem, it still took two weeks to be able to get an appointment to have the vehicle looked at in Clinton. Boardman refused to send a person to Collinsville to try and solve the problem in house. Boardman ambulance did admit that they had a problem with the unit that Collinsville purchased, and they admitted it up front without any prompting. Collinsville also states that they will never purchase another Boardman ambulance again due to the difficulties they have had with the unit and with getting it serviced. EXCELLENCE $150,175.15 Excellence did very well on the bid, however the modular length of the unit is shorter than requested in the specifications. The overall length of the unit is as requested and will fit in the bay without a problem. Excellence is able to do the cross -lay for the backboards, and warranty work can be done locally. They can deliver a unit within 120 -150 days from receiving the Notice of Award or from receiving a chassis, whichever is later. AA EMERGENCY AMBULANCE $150,481.00 AA Emergency bid a 250 horse power engine, not a 300 hp engine as requested. AA did well in the bidding process, meeting all of the dimensional requirements for the unit, but were not able to do the cross -lays for the backboards, and did not meet the electrical warranty requirements. All warranty work at this time needs to be done in Midwest City, however they are working on setting up an authorized service center in the Tulsa area. We were unable to find a specified delivery time for the unit in the company's bid package. At the April 13, 1999 Planning Commission meeting, several citizens pointed out some compatibility issues including trash blowing into the neighborhood, the use of Eleventh Street for commercial activities, and an unattractive appearance on the rear of the facility next door. Chairman Haynes stated that he believed a screening wall or fence, which would be required with any commercial expansion, would address many of these issues and be an improvement over existing conditions. Although the existing tire facility to west is "grandfathered" as an existing non - conforming use, any expansion of the operation will require the erection of a screening wall or fence along the C:\OwassoTlanning Commission \04- 13- 99 \OZ -99 -03 Bob Ary\MEMORaNDUM OZ -99 -03 Ary.doc 6 property line between the business and surrounding residential districts in order to comply with the zoning code. This wall or fence will need to cross the existing driveways on the south side of the tire facility and may result in loss of access to the facility from Eleventh Street on the south side of the subject property, where vehicles are currently stored along a very wide driveway. The wall or fence would also cross the driveway of the subject property. The erection of a screening wall or fence may serve as an improvement for neighboring residents by screening the view of the tire operation and eliminating the Eleventh Street access to the facility. Traffic volumes have increased dramatically on E 86`h Street N over the last several years and will continue to increase as the growth in the Fairways and other areas to the west continues. Certainly development pressure has increased along with the traffic counts. But changing conditions should not automatically result in a modification of the comprehensive plan. Accommodating growth and protecting the existing neighborhood are both objectives. Fortunately, there are often practical ways to fulfill both objectives. The expansion of the zoning district will not result not create an extremely large property. The resulting tract on the southeast corner will only be approximately 1/z acre. As long as commercial activity is oriented towards E 86' Street N, the impact on the abutting neighborhood to the south is manageable. In -this case, staff is comfortable with the degree of protection that the screening wall or fence will provide. Notice of this zoning change was published in the Owasso Reporter and letters were sent to property owners within 300 feet of the proposed zone change. The primary - result of the proposed zoning change will be a rezoning of approximately 12 acres of property from OL to CS. Other portions of the request are designed to reconfigure an OL buffer strip between the CS and surrounding RS -3 zoning. The subject property is located north of E 96"' Street N, west of the Owasso Expressway. This rezoning is similar to case (OZ- 99 -01), though somewhat larger. The proposed rezoning will create additional room for commercial development to front on the north side of E 96"' Street N. An important feature of the proposed rezoning is that although it increases land use intensity for approximately 12 acres (from OL to CS), it is reasonably insulated from existing land uses. A 50 foot OL office zoning strip would buffer the potential CS zoning. Surrounding that would be an extensive amount of RS -3 single - family zoning. Thus a change in intensity will likely not adversely affect surrounding uses. This change in zoning is consistent with the previous zoning actions and will result in only a minor change in the previous development plan. The proposed rezoning, which includes a 50 foot OL (landscape) buffer, makes adequate provisions for the separation of land uses. No obvious barriers to development were noted in the staff review. ANALYSIS The 1985 comprehensive plan update indicates high intensity industrial uses to be appropriate for the subject property as well as for property to the east to the Owasso Expressway. The Johnson rezoning has rendered this portion of the comprehensive plan obsolete. Instead, the Johnson rezoning (April 1998) provides for a combination of commercial shopping center and single - family high- density residential. Light office district serves as a buffer between the contrasting uses. The OL zoning is too narrow for development and serves to provide room for a4andscape easement. A conceptual master development plan was submitted with the April 1998 rezoning. The original plan indicates that the major commercial shopping facility would front on the Owasso Expressway. The proposed rezoning, like the previous rezoning (OZ- 99 -01), represents a minor change that would allow the major tenant to front on E 96"' Street N. This change in zoning is consistent with the previous zoning actions and will result in only a minor change in the previous development plan. The continued development of this property will require careful planning. The inclusion of landscape easements, access points, and acceleration/deceleration lanes during the platting process will be critical for the successful development of the property. The proposed zoning change is consistent with previously approved changes, and there are no obvious barriers to development noted at this time. RECOMMENDATION Staff recommends approval of OZ- 99 -04. Unforeseen conditions such as the growth of the 86`' St. corridor and construction of the sewer interceptor have changed the outlook for this area. These changing conditions should be accounted for in the Comprehensive Plan update currently being developed. The Comprehensive Plan also calls for low- density residential development on the remainder of the tract. The developer proposes an appropriate RS -2 (Residential Single - Family Medium Density) District for the same area. Large floodplain areas near Elk Creek would make a full build out of this site very costly and difficult. In the accompanying PUD plan, the developer ' shows large tracts of open space conserved in these floodplain areas. The plan is virtually the same as the original submission, but includes an additional 60 acres to the original 254 acres. The additional 60 acres includes a church site and single-family residential housing and is located generally in the northwest portion of the tract. The proposal for Preston Lakes PUD is quite large, and made possible only by the new Elm Creek Sewer Interceptor, which should be completed this spring. The developer proposes a combination of single - family housing ( ±159.6 acres), villa townhouses ( ±8.0 acres), multi - family apartments ( ±18.5 acres), a church site ( ±15.0 acres), and commercial ( ±42.7 acres). The developer also proposes a ±70.2 acre park, in areas which do not lend themselves to development, primarily because of the floodplain. A goal of the development is to fulfill a need for a diverse range of housing and living types, reflective of the needs of today's and tomorrow's Owasso resident. Staff finds the proposed development to be appropriate and consistent with plans for the community, and consistent with the purposes and intents of the Planned Unit Development chapter of the Owasso Zoning Code. Notice of this zoning change was published in the Owasso Reporter and letters were sent to property owners within 300 feet of the proposed zone change. A sign with information relevant to the proposed zoning change was also posted on the subject property. At the April 13, 1999 Planning Commission meeting, several citizens appeared to ask questions ' about the proposed development. In the course of the discussion, many questions appeared to be satisfactorily addressed. Staff noted one citizen opposing the PUD, or any other type of development on the 314 acre tract. The Owasso Planning Commission recommended approval ' of the proposed rezoning at the April 13, 1999 regular meeting by a vote of 4 -0, with one member asking to recuse himself from the vote. The applicant, Preston Lakes LLC, proposes a Planned Unit Development (PUD) on ± 314 acres, located in the south half of Section 22, T -21 -N, R -14 -E, City of Owasso, Rogers County, Oklahoma, generally located north of E 86`h St. N between N 145t" E Ave. and N 16151 E Ave. The applicant proposes up to 500 single- family detached dwelling units, 80 villas /townhouses, and up to 450 multi - family units, and ± 11 acres of commercial development with a maximum floor area of 217,800 square feet. The proposal for Preston Lakes PUD is quite large, and made possible only by the new Elm Creek Sewer Interceptor, which should be completed this spring. The developer proposes a combination of single- family housing ( ±159.6 acres), villa townhouses ( ±8.0 acres), multi - family apartments ( ±18.5 acres), a church site ( ±15.0 acres), and commercial ( ±42.7 acres). The developer also proposes a ±70.2 acre park, in areas which do not lend themselves to development, primarily because of the floodplain. A goal of the development is to fulfill a need for a diverse range of housing and living types, reflective of the needs of today's and tomorrow's Owasso resident. The proposal offers a wide variety of land uses on a single site, and the developer proposes to use the topography, as well as other natural and man -made features to separate the more intense from the less intense land uses. The highest intensity land uses are shown at the southwest corner of the property, near the intersection of E 86"' St. N and N 145''' E Ave. The plan proposes commercial and multifamily development. Commercial activity is concentrated on N 145' E Avenue and increases in intensity as one draws near the intersection with E 86"' Street N. The proposed commercial /office and multi - family areas are somewhat larger than what was originally called for in the 1985 Comprehensive Plan. The Elm Creek Sewer Interceptor will allow residential development at a higher intensity than the 1985 plan anticipated. A balance that allows some multi - family represents an efficient use of this new infrastructure. Additionally, more commercial and office to serve these areas is also appropriate, ' 2. More specifically, the development of the Greens at Owasso apartments to the southwest of the subject property, and the higher intensity residential proposed within the proposed PUD highlight a particular need for commercial services within the ' immediate area, 3. Approximately 20% of the commercial /office area is proposed for a church site. ' Churches certainly have periods of peak land use intensity, but overall the intensity is low and they are generally compatible with residential and other low intensity uses, ' 4. An additional 25 % of the commercial area will be needed for drainage ponds that will alleviate an existing condition, the intermittent flooding of E 86' Street near 145' E Avenue (Note: the development will not be able to completely prevent --the more ' frequent flooding that occurs midway between N 145`'' and N 161` E Avenues). The drainage areas will also provide capacity for neighboring proposed residential sites. ' 5. As with many PUDs, the proposed maximum intensities represent development limits that are often difficult, impractical, or unmarketable due to the natural constraints of the site, even with the added flexibility that the PUD allows. Because of the increased development intensity nearby (proposed and existing), as well as the natural features and drainage conditions that occur in this area, staff supports increasing the land area for commercial and office purposes and recommends that the comprehensive plan be amended during the normal course of the update process that is now underway. ' With such a large site, the developer is seeking flexibility in the form of a PUD. The developer anticipates that it will take at least five years to develop this site and believes that the PUD will grant him the flexibility he needs to adapt to changing market conditions. As we review the proposal, it is important to also review the PUD, in terms of: ' 1) Its flexibility as a supplemental zoning district, 2) Adherence to the underlying zoning districts, ' 3) And variance from the outline development plan presented with this agenda. Chapter 8, Planned Unit Development, describes the purpose of the PUD. Generally, a PUD permits flexibility within the development, while preserving open space, maintaining appropriate limits on the character and intensity of land use, and assuring compatibility with the adjoining and proximate properties. The developer is given the flexibility to arrange land use freely within the PUD, irrespective of ' C: \Owasso\Planning Commission \04- 13- 99\PUD -15 Preston Lakes\MEMORANDUM - Preston Lakes PUD.doc 1 the location of the underlying zoning districts. However, the aggregate land use must conform to the underlying zoning. For instance, the developer proposes 5 acres of CG commercial uses. He can place those land uses anywhere on the tract so long as, in the end, he does not exceed the proposed 5 acres. The Planning Commission can act to prevent through the prescription of buffering, screening, and setbacks during the platting process. At this time, the proposed outline PUD appears to have adequate buffering to ensure compatibility of land uses. Within the PUD, the developer has provided a set of Development Standards for each type development proposed in the PUD. Minimum standards for Single - Family Detached Residential (Executive and Premier Homesites), Single - family Attached (Villas), Multifamily, and Commercial, are given in the text of the PUD. During the platting process, a review of the proposed Development Standards will ensure that the developer adheres to these standards and is consistent with the Outline Plan. Any deviation should be in conformance with the proposed development standards, or the underlying zoning code. TAC COMMENTS The original 254 acre plan was reviewed by the Owasso Technical Advisory Committee July 29, 1998. They offered the following comments: Communi Development Department 1. 1985 comprehensive plan recommends medium intensity commercial, surrounded by medium intensity residential. The commercial area is larger than plan suggests. Since the new sewer interceptor has helped to increase the significance of this node, the Comprehensive Plan should be revised to reflect new conditions, ' 2. Need more detail on commercial area: parcels and traffic flow, including curb cuts, 3. 1985 Comprehensive Plan calls for medium intensity housing surrounding commercial. Multifamily is slightly larger than plan recommends and of higher intensity. Recommend a strong integration with and clear access to open space in neighboring park. Also recommend clear pedestrian access through commercial areas for access to schools. Additional screening and vegetative buffering to the north, 4. Plan shows 372 single - family lots, reconcile with Data Summary. Rogers County Rural Water _District III, Chuck Burns 5. Capacity is available, 6. Developer must make formal application, 7. Off -site improvements required: t a. 12" water main at 76' and N 151" E Ave., or, b. 12" @ 86`h and 177h E Ave., or, C. 6" lines available at Whispering Pines and Cambridge Park, ' PSO - No comments offered. The developer addressed those issues satisfactorily. An additional review of the new submittal was conducted on March 23, 1999. No additional recommendations were made. PUBLIC HEARING AND PLANNING CONINUSSION ACTION The Owasso Zoning Code, Section 880.5, requires the Planning Commission to determine the following: a) Whether the PUD is consistent with the Comprehensive Plan. The underlying zoning for the PUD very closely resembles the land use called for in the 1985 Comprehensive Plan. A copy of the land use map is attached herein. The overall densities for residential and commercial would be very consistent with the Comprehensive Plan. Although the commercial and higher density housing areas are slightly larger (about 25%) than the plan calls for, the importance of this node has also increased. Unfortunately, the Comprehensive Plan does not provide any direct guidance in the use of the PUD. The Comprehensive Plan Map of 1985 includes text that was drafted in 1978. At that time, the PUD was not widely used. As a result, there is no information regarding the PUD in the Comprehensive Plan. The flexibility in land use that is allowed within a PUD may reallocate densities recommended in the comprehensive plan. As a result, the Planning Commission may look at overall the density recommended in the plan with the understanding that geographical constraints may prevent an exact duplication of the recommendation of the comprehensive plan. For additional guidance in the use of PUDs, we can turn to the Zoning Code, Chapter 8, regarding Planned Unit Development. The PUD was created to address certain conditions and situations where conventional zoning would be ineffective, or even detrimental. Such conditions might include unique topographical considerations. Elm Creek may qualify as a unique situation. b) Whether the PUD is in harmony with the existing and expected development of surrounding areas. Surrounding land uses can be broken down into three affected areas: 1) Areas near the proposed commercial. Around the proposed commercial area lies: an undeveloped 80 acre tract to the north, Hodson Elementary and additional undeveloped land to the south, and Silver Creek Addition that will likely expand to abut some of the commercial areas of the PUD along 145''' E Ave. Near the intersection of 86' St. N and 145th E Ave., 7 acres of commercial development is anticipated. The commercial areas appear to be compatible with the surrounding land use, both existing and anticipated. A buffer to the north is recommended (and shown in the text addendum to the C: \Owasso\Planning Commission \04- 13- 99\PUD -15 Preston Lakes\MEMORANDUM - Preston Lakes PUD.doc PUD included in this packet), simply because the commercial area is relatively large, and the anticipated development in the 80 acre tract will likely of a lower density. The developer will need to pay special attention to pedestrian movement to ensure complete compatibility with the elementary school (this is also reflected in the text addendum). 2) Areas near the proposed multi - family. Again, the multi - family area is fairly insulated. The 80 acre tract lies to the north, proposed commercial to the west across a buffer zone, proposed single- family to the east across a buffer zone, and vacant land to the south across 86`h St. N, also buffered. The proximity to Hodson Elementary is desirable for families with children who may live in the multi - family area. Nearby convenience commercial is also a plus for higher density residential as it may help to reduce the overall number of vehicle trips. The developer has tried to ensure that the multi- family will be compatible with surrounding land use. 3) Areas near the park and single -family development. Single- family housing is proposed to abut the rear lots of existing estate lots to the north. Although the proposed housing will probably be of a higher density, the abutting properties are reasonably compatible with one another. In addition, ' the proposed park could serve as an amenity for all of the neighboring properties. The Premier Homesites in the SE corner of the PUD will be located opposite existing estates lots to the south across E 86' St. N. Again, ' this should be compatible with existing land use. The proposed Villa townhouses will be located to the north of the Premier Homesites and south of the park. Although this is a higher density development, the proximity of the park should provide openness and feeling of space. A large undeveloped 40 acre strip along N 1615` E Ave. abuts the proposed PUD to the east. This may be developed as residential, or a combination of residential and , commercial near the intersection of 86' St. and 161" E Ave. Both of these possibilities will be reasonably compatible with the surrounding park and . residential areas. In summary, the developer has located each of the proposed land uses appropriately within the development. The strategic location of each land use should result in very ' few incompatibilities with the surrounding land uses. The possibility of a well - maintained park nearby may even enhance the quality of life of the neighbors. Under the rules of the PUD, the developer has the ability to reallocate each of these , land uses within the development. If the developer chooses this option, the Planning Commission may require additional buffering to ensure compatibility in and around the development. ' c) Whether the PUD is a unified treatment of the development possibilities of this site. The unified treatment of the site begins with an understanding that construction in the floodplain should be avoided; a sound decision. Rather than concentrate on increasing the amount of developable land, the creators have tried to made the open space a key feature which ties the development together, enhancing the value of the C: \Owasso\Planning Commission \04- 13- 99\PUD -15 Preston Lakes\MEMORANDUM - Preston Lakes PUD.doc II 1 remaining properties. In return for preserving the open space, the developer is requesting that the Planning Commission allow him to develop at higher densities in ' the areas that are more suited to development. The additional 60 acres that has been added is somewhat less integrated with the ' original 254 acres, but street there is a street connection that physically ties the PUD together. Staff also recommends a pedestrian access connection in the southeast corner of the additional 60 acres. This will facilitate access to the proposed park. ' d) Whether the PUD is consistent with the stated purposes and standards of the Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned ' Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes PUD. The PUD would: 1) Permit innovative land development while maintaining appropriate limits on the character and intensity of use and assure compatibility with adjoining and proximate properties; ' 2) Permit flexibility within the development to best utilize the unique physical features of the particular site; 3) Provide and preserve meaningful open space; ' 4) Achieve a continuity of function and design within the development. The PUD also conforms to the standards set forth in Chapter 8. The developer has submitted the appropriate application materials and has established a plan that should conform to the requirements of the Owasso Zoning Code. Staff does not anticipate any difficulties in the administration of the Preston Lakes PUD as proposed. Certain ' details regarding ownership of the park and maintenance of drainage facilities are unresolved but it is not necessary to resolve these issues for approval of the PUD ' concept. Maintenance agreements as well as dedication of land for public purposes can and should be resolved during the platting process. ' RECOMMENDATION Staff recommends approval of the PUD subject to the following conditions: 1 A. That the applicant's Development Text, Text Addendum, and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the ' Owasso Zoning Code; B. That unless specifically set out in the standards and conditions of this PUD, single- family ' development shall meet the requirements of a typical RS -2 district, C. That minor transfers (10% increase in a development area's density) of dwelling units from one residential development area to another can occur if a significant change in the character of either development area is not created. H. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. I. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. J. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. K. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. L. Acceleration/Deceleration lanes at each access point to the subject property along the arterial streets (two locations on E 86h St. N, one location on N 145' E Ave.). M. The inclusion of sidewalks along the abutting arterial streets and the interior drives within the proposed development. N. That the applicant provides easements for pedestrian accessways between lots as required by the Planning Commission to facilitate access to the proposed park. The location of these accessways shall be determined as the development evolves to the platting stages, O. The submittal of detailed landscaping plans to be submitted at the time- of site plan review, said plans to be reviewed by staff and the Planning Commission for approval. P. "Attachment 2" MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: THERON WARLICK CITY PLANNER ' SUBJECT: ANNEXATION REQUEST LOWE DATE: April 14, 1999 ' BACKGROUND Lewis Dean Lowe and Donald Allen Lowe, the owners, have submitted a petition to the -City of ' Owasso requesting annexation of property totaling approximately 10.00 acres, more or less. The subject property is described as a tract of land in Section 7, Township 21 North, Range 14 East, Tulsa County, Oklahoma. The subject property is located on the south side of E 116' Street N, east of the Owasso Sports -Plex. ' The subject property lies in unincorporated Tulsa County but is completely surrounded by the City of Owasso. The City of Owasso Annexation Policy indicates that normally tracts of 20 acres or more are desired, the fact that this tract is surrounded the City of Owasso makes it a likely candidate for annexation, regardless of its size. To the north of the subject property across E 116" Street N lies entrance to Country Estates III, to t the south is Hale Acres Addition, to the west is the Owasso Sports Complex, and to the east is a church on approximately 5 acres zoned AG (Agriculture). ' The subject property is zoned CS (Commercial Shopping Center) in Tulsa County. An atypical aspect of the proposed annexation is that the applicants have requested in their petition that the property be assigned the same CS (Shopping Center) designation in the City of Owasso. Section 110.3 (b) of the Owasso Zoning Code specifically allows Council to annex property and retain Tulsa County zoning. Owasso annexation policy specifically states that all annexed property given zoning designation of AG (Agriculture). However, the "downzoning" of property may serve as a disincentive to many property owners because of real or perceived losses in property value or limitations on land use. The combined annexation and rezoning procedure removes this deterrent and may be favorably considered when the proposed zoning is consistent with the comprehensive ' plan for our community. Notification of the annexation and rezoning request was published in the Owasso Reporter on April ' 1, 1999 to notify the public of the annexation request before the Planning Commission meeting on April 13, 1999. Bailey Ranch Estates II is part of a Planned Unit Development (Bailey Ranch Estates PUD, OPUD -12) located 1/a mile north of E 96'' St. N and Garnett Rd., east of the existing Bailey Ranch Estates I. Phase II of Bailey Ranch Estates consists of 135 lots on ±40.68 acres of property. The Planning Commission reviewed the proposed final plat at their June 9, 1998 regular meeting. The applicant presented the proposal to the members of the Planning Commission. The Planning Commission also invited comments regarding the plat from the public. A lengthy debate ensued. Mr. Tom Vogt, attorney for Owasso Investments, L.L.C. was present to express concerns with the storm drainage within the planned Bailey Ranch Estates IV Addition. He stated that in order to use the detention facility to the north of the subject property the applicant must acquire an easement from his client. Mr. Noble Sokolosky of Trail's End Development appeared to disagree with Mr. Vogt's assertion and stated that an easement was not necessary, mainly because Bailey Ranch Estates II was built according to previously approved Bailey Ranch Estates PUD (OPUD -12). Mr. Vogt requested that the Commission postpone a ruling on the final plat for Bailey Ranch Estates II in order to provide time for research into the water retention problems. After a discussion, the Planning Commission found that the plat conformed to planning and zoning regulations, as well as with the Bailey Ranch Estates PUD. The Planning Commission voted unanimously to approve the final plat for Bailey Ranch Estates II with the condition that the applicant must make changes in the plat to include the recommendations of the Technical Advisory Committee.
