All matters listed under "Consent" are considered by the City Council to be routine and will be enacted by one motion. Any Councilor may, however, remove an item from consent by request. D. Action Relating to City Council Approval of a Final Plat for The Willows of Silver Creek, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. Attachment 47 -D The staff recommends Council approval of the final plat for The Willows of Silver Creek, located immediately north of The Bradfords of Silver Creek, Nvest of N 145`h East Ave, containing 84 lots on 31.22 acres. more or less. Attachment #7 -E II II II The staff recommends Council approval of the final plat for Oklahoma Central Credit Union, located southeast of the ONG building, between N 12151 East Ave and U.S. Highway 169. F. Action Relating to a Contract Extension for the Supply and Cleaning of Uniforms. Attachment #7 -F The staff recommends that the contract with UniFirst Corporation for the supply and cleaning of uniforms for the Parks, Support Services, and Public Works departments be extended for the period January 1, 2000 through December 31, 2000 under the same conditions as the current agreement. 8. Consideration and Appropriate Action Relating to a Request for a Supplemental Appropriation and Amendment to the Capital Projects Grant Fund, the General Fund General Government Budget, and the Capital Improvements Fund. Mr Henderson Attachment #10 The staff will recommend an amendment to the A/E agreement with C112M Hill, increasing the amount of the agreement in an amount not to exceed $10,671, for the purpose of providing additional engineering services relating to the 1998 bond issue intersection projects. 11. Consideration and Appropriate Action Relating to Ordinance #617, an Ordinance Amending the Oklahoma Municipal Retirement Fund Thrift Plan Document for the City of Owasso, and Declaring an Emergency. Mr Warlick Attachment # 13 The Owasso Annexation Committee and the Owasso Planning Commission have conducted hearings on this request and recommend Council approval of the requested annexation. The staff concurs with the recommendation. 14. Consideration and Appropriate Action Relating to a Request from The Owasso Public Works Authority for the Annexation of Portions of the Public Right -of -Way in Tulsa County, Oklahoma, Located at the Intersections of East 76`' Street North & 129`h East Ave, East 86`h Street North & North Mingo Road, and East 116`h Street North & North Garnett Road. Mr Warlick Attachment #14 The Owasso Annexation Committee and the Owasso Planning Commission have conducted hearings on this request and recommend Council approval of the requested annexation. Owasso City Council September 7, 1999 The consent agenda included minutes of the August 17, 1999 regular meeting and the August 31, 1999 special meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $48,339.28; (2) Workers Comp Self -Ins Plan $4,821.61; (3) Ambulance Service Fund $2,531.82; (4) City Garage $12,342.07; (5) Capital Improvements $88,479.46; (6) Capital Projects Grant $ 54,410.93; (7) Bond Projects Fund $33.30; (8) Payroll ' #1 $162,986.69; (9) Payroll #2 $166,407.60; (10) City Garage Payroll #1 $3,712.71; (11) $3,712.69. Item C requested City Council acceptance of a grant from the Oklahoma Department of Safety in the amount of $25,000 to be used for police overtime expenditures in traffic ' enforcement, and authorization for the City Manager to execute the contract. Item D requested Council approval of an agreement with the Air National Guard allowing them to continue the use of the City of Owasso Police Firing Range at a cost of S2000 per year, and auathonization for the ' Mayor to execute the document. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF A "CARRY- OVER" BUDGET AND SUPPLEMENTAL APPROPRIATION TO VARIOUS DEPARTMENTS WITHIN THE GENERAL FUND GARAGE FUND, AND CAPITAL IMPROVEMENTS FUND. Ms Bishop said that the City Council has approved a carry-over supplemental appropriation since 1993. This concept allows funds to be carried over from one fiscal year to the next. This promotes a philosophy of "save and invest it" rather than "spend it or lose it ". Department Directors submit carry over requests for specific items. Dr Bode moved, seconded by Mr Williams, to approve the requested carry-over from FY 1998 -99 and to approve a supplemental appropriation to the FY 1999 -2000 General Fund Budget of $348,300, Garage Fund Budget of $3876, and Capital Improvements Fund of $533,598. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CITY COUNCIL APPROVAL FOR THE PURCHASE OF AN INTOXILYZER FOR THE POLICE DEPARTMENT. Lt Motto presented the item. The Owasso Police Department has been using both the Breathalyzer and the Intoxilyzer for testing all individuals who are arrested on drunk driving charges. Due to the age of the Breathalyzer, it is frequently in need of repairs. The State has notified the department that use of the Breathalyzer is being discontinued. The State of -2- Owasso City Council September 7, 1999 Oklahoma Board of Tests for Alcohol and Drug Influence is the only agency in the state that can approve any testing devices. The state approves a specific machine and designates a company as the sole production and purchase source, and has approved the Intoxilyzer 5000 -D manufactured by CMI Inc of Owensboro, KY. Staff requested the purchase of a new Intoxilyzer, including the Oklahoma software package, internal modem, keyboard, HP laser printer, wet bath simulator, surge protector, and stand. Ms Voss moved, seconded by Ms Barnhouse, to approve the purchase of an Intozilyzer 5000 -D from CMI Inc, Owensboro, KY, at a cost of - $6500. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ACCEPTANCE OF A DEED OF DEDICATION AND LETTER OF AGREEMENT FROM RANDALL K MARQUETTE AND DANA M MARQUETTE TO THE CITY OF OWASSO; AUTHORIZATION FOR THE MAYOR TO EXECUTE THE DEED, AUTHORIZATION FOR PAYMENT AS INDICATED IN THE LETTER OF AGREEMENT. Mr McElrath said that one of the projects included in the 1997 bond issue is the widening of the intersection at 76th St N & 129th East Ave. Engineering has been completed on the intersection, indicating additional right -of -way needed. Staff has completed negotiations with Randall K & Dana M Marquette, property owners on the northeast corner of the intersection, and has received an executed Deed of Dedication. Dr Bode moved, seconded by Mr Williams, to accept the Letter of Agreement and Deed of dedication from Randall K & Dana M Marquette for property to be utilized as a part of the 76th St N & 129th East Ave intersection improvements, authorization for the Mayor to execute the deed, and authorization for payment. AYE: Bode, Williams, Voss, Barnhouse, Wilken NAY: None Motion carried 5 -0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A BID TO PURCHASE USED MODULAR FURNITURE. Mayor Wilken & Councilor Williams recused themselves from participating in the discussion and the vote on this item, and Vice -Mayor Barnhouse presided. Mr McElrath presented the item. Bid documents were prepared for the purchase of used modular furniture to be used in the new city hall when staff became aware that a large selection of used furniture was available from Oneok. Two bids were received, one from Tulsa Office Furnishings and the other from Oneok. Although the Oneok bid was the lowest, the furniture would need to be completely refurbished and the panels recovered, making the cost more than that for the refurbished furniture from Tulsa Office Furnishings. Since refurbished furniture is always available, staff believes that it would be best to reject the bids and rebid refurbished furniture when it is determined what NN-ill actually - 3 - Owasso City Council September 7, 1999 be need to furnish the new city hall. Dr Bode moved, seconded by Ms Voss, to reject all bids received for the purchase of used modular furniture. AYE: Bode, Voss, Barnhouse NAY: None Motion carried 3 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO APPROVAL OF A CONTRACT FOR SALE BETWEEN TODAY'S PROPERTIES LLC AND THE CITY OF OWASSO OKLAHOMA AND AUTHORIZATION FOR PAYMENT OF $10,000 PURCHASE PRICE. It is proposed that this piece of property at the location where RCB Bank proposes a new facility, be purchased by the City of Owasso, and in turn sold the RCB Bank at a purchase and sale price of $10,000. Ms Voss moved, seconded by Dr Bode to approve a contract for sale between Today's Properties LLC and the City of Owasso, Oklahoma, and authorize the payment of $10,000. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CITY COUNCIL APPROVAL OF A LETTER OF UNDERSTANDING BETWEEN THE BOARD OF COUNTY COMMISSIONERS OF TULSA COUNTY AND THE TULSA COUNTY CRIMINAL JUSTICE AUTHORITY AND THE CITY OF OWASSO ALLOWING THE HOUSING OF INMATES OF MUNICIPALITIES WITHIN THE TULSA COUNTY JAIL SYSTEM ON A SPACE AVAILABLE BASIS, A FORMULA FOR THE NUMBER OF MUNICIPAL INMATES ALLOWED TO BE HOUSED WITHOUT CHARGE AND A FEE STRUCTURE FOR HOUSING OF MUNICIPAL INMATES IN EXCESS OF SAID FORMULA-, AND PROVIDING FOR TERMINATION OF SAID ARRANGEMENT; AND AUTHORIZATION FOR THE MAUOR TO EXECUTE THE DOCUMENT. Mr Hancock said that the proposed Letter of Understanding with the Tulsa County Board of County Commissioners and the Tulsa County Criminal Justice Authority would allow the housing of City of Owasso municipal prpisoners in the Tulsa County Jail at one -half of our present jail capacity. With a capacity of six prisoners, we would be allowed to house three prisoners at no charge. Other municipalities in Tulsa County are also considering the approval of a similar letter of understanding. ITEM 12: CONSIDERATION AND AFFKUFK1A i t AU i WIN tcGLA l llykJ I v RESOLUTION #99 -07 ADOPTING A POSITION REGARDING THE NEED TO WIDEN 76TH STREET NORTH BETWEEN U.S. HIGHWAY 75 AND U.S. HIGHWAY 169 AND TO DESIGNATE THIS CORRIDOR AS A MAJOR ECONOMIC DEVELOPMENT PRIORITY. Mayor Wilken presented Resolution #99 -07, which states that it is the position of the City Council and the City of Owasso that the widening of 76th Street North between U.S. Highway 75 and U.S. Highway 169 be established as the priority major transportation infrastructure improvement for the City of Owasso, as well as portions of northern Tulsa County, and that the City should actively pursue private and public sector support and the appropriate funding to expedite the construction of such major transportation infrastructure improvement for this major transportation corridor. ITEM 1: CALL TO ORDER Mayor Wilken the meeting to order at 5:40 p.m. PRESENT ABSENT Mark Wilken, Mayor Mary Lou Barnhouse, Vice Mayor Denise Bode, Councilor Melinda Voss, Councilor H C "Will' Williams, Councilor STAFF Jeff Hancock, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ITEM 2: FOLLOW UP RELATING TO STAFF DEVELOPMENT TRAINING. Mr Jim Rhea, CEO, and Ms Jena Rhea, President, of Greenwood Performance Systems Inc gave a report on the staff development training held on September 9" & 10`h ITEM 3: UPDATE AND DISCUSSION RELATING TO RADIO LICENSE AND TOWER. Chief Allen said that the City has been granted a six -month temporary license for the 800 Mhz radio system. This will allow us to proceed with the purchase of the new system. It is believed that there will be no problem in obtaining a permanent license at the end of the six -month period. TCI has approached the City about placing a communication tower at the site of the water tower. In exchange, the City would be able to place antennas on the tower, eliminating any dead spots in the new system. ITEM 4: DISCUSSION RELATING TO PUBLIC WORKS PHONE. At the request of staff, this item was removed from the agenda. Owasso City Council September 14, 1999 ' ITEM 7: REPORT FROM ASSISTANT CITY MANAGER. Mr Rooney reported that Comprehensive Planner Karl Fritschen has resigned effective September 24th and will be moving from the state. Staff plans to contract with Mr Fritschen to complete the work on the Comprehensive Plan. Mr Rooney also reported that the October Work , Session will be hosted by the Parks Department and will be held at the Parks Office at the Sports Park. ITEM 8: REPORT FROM CITY MANAGER. Mr Hancock reported briefly on the Bond Issue intersection projects, and also discussed the r recently -held Block Parties. Mr Hancock and Mr Rooney will be attending the ICMA Conference in Portland, OR September 25th - 29th. During their absence, Chief Allen will be designated as Acting City Manager. Rural Water District #3, Washington County was discussed briefly. Mr Hancock has transmitted a letter to the District withdrawing the offer to purchase. Ms Bishop told the Council that there will be some budget amendments forthcoming covering the remodel project for the new Public Works building, a Community Center grant, purchase of land from Today's Properties, and the staff development training. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING THE ACQUISITION OF REAL PROPERTY RELATED TO 76TH ST N & 129TH EAST AVE INTERSECTION AND THE ACQUISITION OF REAL PROPERTY RELATED TO THE MAIN STREET PROJECT AND THE APPRAISAL AND SALE OF REAL PROPERTY TO PRECISION COMPONENTS, SUCH DISCUSSION ALLOWED PURSUANT TO 25 O.S. SECTION 307 -B(3). Dr Bode moved, seconded by Ms Barnhouse to enter into executive session for the purposes stated. AYE: Bode, Barnhouse, Williams, Voss, Wilken NAY: None Motion carried 5 -0, and the Council entered into executive session at 7:00 p.m. Out of executive session at 7:25 p.m. at which time the Mayor declared a ten - minute recess. The meeting was reconvened at 7:35 p.m. ITEM 5: DISCUSSION RELATING TO POLICE DEPARTMENT ITEMS. A. SCHOOL/K -9 CONTRACT B. GENERATOR ITEMS Acting Chief Motto told the Council that the Owasso Board of Education has agreed to retain the services of the drug dog under a contract similar to the one utilized during the 1998 -99 school year. He also discussed the problems with the generator at the police department caused by a recent storm. The purchase of a new generator was discussed. -2- Owasso City Council September 14, 1999 ITEM 6: JOINT DISCUSSION WITH THE OWASSO CAPITAL IMPROVEMENTS COMMITTEE RELATING TO THE CAPITAL IMPROVEMENTS PROGRAM. The Owasso Capital Improvements Committee joined the City Council at this time for a discussion relating to progress of the capital improvement and bond issue projects. Various types of innovative financing and alternative programs were discussed. MOTTO ACTING CHIEF OF POLICE ' SUBJECT: REQUEST APPROVAL OF CONTRACT FOR CANINE SERVICES BETWEEN THE OWASSO POLICE DEPARTMENT 1 AND THE OWASSO PUBLIC SCHOOL SYSTEM DATE: SEPTEMBER 21,1999 tBACKGROUND: ' The 1998 -1999 school year marked the beginning of a partnership between the Owasso Public School System and the Owasso Police Department for "Canine" services. The school system paid the department $ 10,000.00 for drug dog detection services and ' educational programs throughout its facilities. The department K -9 Officer performed periodic drug searches of grades six through twelve, conducted sweeps of the various school parking lots, and provided canine demonstrations and educational programs upon ' request of each school. Last years contract was successful as not only were arrests made for illegal drugs on school property but also several educational programs were presented to the students of each school. A positive relationship was developed between the Police Department and the students. The Police Department would again like to provide these "Canine" services to the school ' system for the 1999 -2000 school year. The Department submitted a contract to the Owasso Public School System, in the amount of $ 10,000.00, at the September 7, 1999 School Board meeting. The Owasso School Board accepted and approved this contract at ' this meeting. The School Board had high praise for our K -9 Officer and the overall job that was done last year. ' For the 1999 -2000 school year, the department will provide a minimum of 225 hours of K -9 services to the school system. This will again include "drug detection" services, educational programs, and K -9 demonstrations. The contract will run from August 1999 through May 2000. The cost to the school system for this service will again be in the amount of $ 10,000.00. The city attorney has reviewed the contract as presented to the school system. The parties agree that the appropriate venue for any judicial resolution of any dispute arising out of the performance or nonperformance of this Agreement shall be Tulsa County, State of Oklahoma. The proposed plat is consistent with the Smith Farm PUD (OPUD -13, April 1995). The Smith Farm PUD calls for mixed -use development on 126.8 acres. The Outline Development Plan for Smith Farm proposes an extension of N 121" E Avenue as a commercial collector road from N 96" E Avenue to Garnett Road, parallel to the Owasso Expressway. On either side of the collector road, the PUD calls for either Commercial or Office/Research/Light Industrial uses. It was noted in the review that property to the east of the plat would have poor access to N 121st E Avenue due to the unusual tapering extension on the northern end of the subject property. At the request of staff, the applicant has provided a 70 foot wide mutual access easement on the northern portion of the subject property. This easement will allow public access to the property to the east. The proposed plat is consistent with the Smith Farm PUD (OPUD -13, April 1995). The Smith Farm PUD calls for mixed -use development on 126.8 acres. The Outline Development Plan for Smith Farm proposes an extension of N 121" E Avenue as a commercial collector road from N 96" E Avenue to Garnett Road, parallel to the Owasso Expressway. On either side of the collector road, the PUD calls for either Commercial or Office/Research/Light Industrial uses. It was noted in the review that property to the east of the plat would have poor access to N 121st E Avenue due to the unusual tapering extension on the northern end of the subject property. At the request of staff, the applicant has provided a 70 foot wide mutual access easement on the northern portion of the subject property. This easement will allow public access to the property to the east. Water and sewer is available to the site and the applicant's engineer has indicated that no DEQ permits will be required for this plat. The Owasso Planning Commission unanimously approved the final plat and recommended approval to Council at their September 14, 1999 regular meeting. In August, the Council approved a contract for services with the Greenwood Performance Group for $11,615. On September 7, the Council authorized a purchase of land for $10,000. A budget supplement in the General Government Department expenditures for $21,615 is needed. This budget amendment would reduce the fund balance in the General Fund by $21,615. Capital Improvements Fund. Remodeling of the old PSO building for use by the public works department is included in the approved budget for a total of $57,000. The budget is divided among the General Fund, the OPWA Operating and the Capital Improvements Fund. The amount included in the Capital Improvements Fund budget is $36,500. The Capital Improvements Committee has established criteria for projects under their consideration. $50,000 has been set as the minimum project size. In order for this project to meet their criteria for funding, the Capital Improvements Committee has recommended an increase in the budget for this project. The contractor is completed with the unsuitable material removal and only 2700 c.y. were removed, which reduces the cost by $2,275.00. 1 On July 20, 1999 City Council approved Change Order No. 2 for the additional construction of a new soccer field at the Spots Park, which increased the contract amount by $30,000.00. CHANGE ORDER NO.3 ' Throughout the construction of this project, inclement weather plagued the contractor. Even though the contract time was very generous, delays and additional work (soccer field) has put the contractor behind the original schedule. Since then, the A/E has prepared plans and specifications for the Intersection Improvements Projects for E. 76th Str. N./ N. 129th E. Ave., E. 116th Str. N./ N. Garnett Rd., E. 86th Str. N./ N. Mingo ' Rd. and the reconstruction of E. 86`h Str. N. from North Mingo to west of North Main. In July 1999 the project plans were submitted to the utility companies and the SK &O Railroad for their review and comment. The result is that the utility relocation will cost more than expected. The costs are listed ' below: ONG - ONG stated that their lines at the at E. 76th Str. N./ N. 129th E. Ave and E. 86th Str. N./ N. Mingo Rd. Intersections were in private right -of -way and will cost the approximately $325,000 to relocate the gas lines. PSO — PSO said that their power lines at the E. 86th Str. N./ N. Mingo Rd. Intersection are in private easement and that the cost to relocate these lines will be approximately $55,000. LSK &O Railroad — SK &O has reviewed the plans and has estimated that extending the crossing to four lanes and installing new signals at the crossing of E. 86th Str. N./ N. 123` E. Ave. A plan -in -hand held with ODOT has determined that only a portion of the project ' will qualify for Federal Funds. Therefore, the project will cost the City more than expected. Therefore, staff discussed the re- prioritization of the intersection projects at the August 31, 1999 ' Council Work Session and recommended removing the E. 86th Str. N./ N. Mingo Rd. Intersection from the Intersection Improvement Projects and placing it on the Federal Highway Administration (FHWA) funding list. Staff also recommended that the E. 86th Str. N./ N. 123`d E. Intersection Project Preliminary construction costs of these projects, along with the other Bond Projects, were estimated in the Fall of 1998. The findings of the estimate reflected $13 million in projects with only $10 million in funds. Since the 86'h/Main Project was receiving a grant from the FWHA, staff recommended that the other three 866' Street projects be added to the list, since they were on the Long -Range Transportation Plan. In May 1999, these projects were added to the FHWA funding list. After the projects were submitted ODOT, administrator of the FHWA funds, informed us that the 86`h/123`d project could be funded in 1999, but the other two would be placed on a waiting list that has-three (3) years of projects currently waiting for funds. City of Owasso staff discussed the wait and determined that the 86th/Mingo Project was needed much sooner. Therefore, the 86`h/Mingo Project was included in the upcoming City project that included 76a'/129`h and 116`h /Garnett Road. Several events have occurred since this decision was made: • Preliminary Plans for 86tk`/123`d have been submitted to ODOT and a plan-in -hand has been held; • Preliminary Plans for 86`h/145`� are 95% complete and; • Final Plans have been submitted for the 86`h/Mingo, 76`h/129`h and the 116` /Garnett intersections. Page 2 Bond Projects – Intersection Issues ' August 31, 1999 Since the design phases of these projects have commenced, several unexpected obstacles have ' been encountered. These obstacles are listed by project below: East 761h Street North/ North 129th East Avenue 'Rig—ht-of-way – Costs to secure right -of -way for this project is costing more than anticipated. These costs are either by direct purchase of right -of -way (NE and SE corners) or by adding costly improvements to the project (NW corner). Utilities - Costs to relocate utilities will cost more than anticipated. ONG, PSO, and GRDA have utilities in private easements and their locations conflict with the right -of -way needs. ' East 86'h Street North/ North Mingo Intersection Proiects: Utilities - Costs to relocate utilities will cost more than anticipated. ONG, and PSO have utilities in ' private easements and their locations conflict with the right -of -way needs. Railroad Crossing – Costs to cross the railroad with an additional two lanes and to improve the signalization at the crossing will cost over $200,000. This is five times more than anticipated by CH2MHi11. East 86`h Street North/ North 14!'h East Avenue Intersection Proiect Signalization – ODOT has given preliminary indications that this intersection will not warrant traffic signals according to their criteria. Therefore, the cost of signals will be the responsibility of the City. This may not have a significant impact on the project, unless right -of -way costs and utility relocations become an issue. East 86`h Street North/ North 123rd East Avenue Sianalization: Signalization – ODOT has given preliminary indications that only the east leg of this intersection will warrant traffic signals according to their criteria and not the west leg. The negative impact of this is that half the project cost is the west leg. The entire project is estimated at only $120,000. This would require the City to fund $60,000. Timing – This project is very important because of the dangerous intersection. Preliminary discussions with ODOT said that they would be able to fund the project in October. Now they say that it will be after the first of the year. CONCERNS: My concern regarding these projects is that the escalating costs of the intersections will continue to drive us further behind on the overall Bond Project budget. Attachment A is a breakdown of each intersection cost estimate. The estimate reflects the initial estimate by CH2MHill and the updates since then. RECOMMENDATIONS Page 3 Bond Projects — Intersection Issues August 31, 1999 , 0 In the February budget revision, staff allocated only Bond Funds to construct the 86`h/Mingo Project. However, staff anticipated that 86`/145"' would receive $658,726 and 86t'/123 `d would receive $100,800 from FHWA out of a maximum of $750,000 per project. Unfortunately, with the traffic signal study warranting only one leg of the 86 h /123`d Project, the FHWA portion looks to be reduced to $60,000 + / -. ' Therefore, I recommend that 86 h/Mingo Project be removed from the upcoming City construction contract and the 86ffi/123'd Project added, regardless of the FHWA funding. By doing this, we can ' gain up to $750,000 to apply toward the 860'/Mingo Project and only lose $60,000 by removing 86`h/123`d from the project list. We had prepared the plan set as a "City" project on 22" x 34" sheet size for the convenience of reducing the plans to "half- size" drawings and maintaining an even scale for plan reviews, bidding and construction purposes. ODOT's standard sheet size when reduced to half -size will not be an "even" scale. When reduced to an even scale the outside border on at least two sides of the sheet are not covered on a standard 11" x 17" paper size for photocopying. The plans in all other aspects conform to ODOT requirements. In reviewing the Manhour /Fee Breakdown included as Exhibit 3, you will see that reformatting the plan sheets for submission to ODOT is a minimal effort. The normal ODOT review process, however, requires a three -step submittal process: plan -in -hand design, preliminary design, and final design. The bulk of our fee increase is incorporating review comments from ODOT at each plan review stage. ODOT, in reviewing the plans, will provide a new perspective and budget will not necessarily be a concern. However, the only major changes I would anticipate is incorporating details for the upgrade of the railroad grade crossing and railroad signal adjustments into the plans. It is suspected that ODOT will not participate in funding the installation of signals for the west intersection due to ' insufficient traffic volumes to meet the warrant for traffic signals. Converse to the 86th Street & Mingo Road changes, the plan sheets for this project will be reformatted from 24" x 36" sheet size to 22" x 34" sheet size to match the plan sheet size of ' the other intersections. Additionally, the bidding assistance and construction administration phases have been added back into the engineering services. The manhours are the same as included in the original Agreement and subsequently deleted by Amendment No. 1. The net increase for the 86th Street & 123rd East Avenue Signalization is $4,850. Upon approval of this Amendment, incorporation of these plans into the bid documents for the intersection improvements will be complete and ready to advertise within 15 days. If approved the total engineering fees for the street and intersection projects will be $288,999. This is less than 7.5 percent of the estimated construction costs for the accumulative projects. The engineering services provided include a pre- design study and ' report to develop short and long term improvements on which to base the design of each project along with conceptual level costs estimates for construction and right -of -way impacts; preparation of construction plans, including field surveys; legal descriptions for right -of -way acquisition by the City; utility coordination; bidding assistance; and construction phase services. In negotiating the original contract, we agreed to the fees proposed by the City for the t individual projects. However, in accepting that as compensation for the services to be provided, there was no contingency in those prescribed fees to provide for additional services or changes in the scope of work as was included in Amendment No. 1 and proposed ' by this Amendment. The level of effort required to make the requested changes is outlined in Exhibit 3 to the Amendment. In reference to the Projects Schedule for the CIP projects, the updated schedule incorporates ' the above changes. Additionally, we are showing a revised completion date for the Design Development phase and plans submittal to the City of September 15. Although this result in a delay of approximately two weeks from the previous schedule provided for this phase of ' work, we do not anticipate any delay in the completion of the Construction Documents phase by December 15, in accordance with the previous schedule. Because the effective date for the changes is retroactive to 7/1/99, the plan year beginning date, an ordinance with an emergency clause has been provided by OMRF for approval by the City Council and execution by the Mayor. Preliminary discussions with the owners indicate that they may seek residential zoning, and possibly commercial zoning near the intersection of E 106'h Street N. To the west of the subject property, across Mingo Road, there are a few single - family homes and mobile homes fronting Mingo and developed to large- tract, Tulsa County standards. To the east of the subject property is the SKO Railroad line, which currently runs approximately two trains a day. To the north of the subject property is an abandoned strip mine. To the south of the subject property, across N 106'h St., is very small triangular tract zoned CS. Sewer will be available to site approximately 500 feet to the west via the North Owasso Sewer Interceptor, now under construction. This property lies within the 1981 court settlement boundary and, although it is a portion of the Rural Water District, it can also be served by OPWA. At this time however, OPWA lines are located approximately '/2 mile to the north or south of the site and water is already on site from Rural Washington Water District #3 (RWWD 43). For obvious reasons, the developer is considering using RWWD #3, and according to the settlement, that may be an option. Provision of water does not need to be resolved prior to annexation and can be addressed prior to platting of any subsequent development. The tracts are located at three (3) intersections: ' 1) E 76"' Street N and N 129' E Avenue, 2) E 86'h Street N and N Mingo Road, 3) E 116"' Street N and N Garnett Road, ' This request was originally presented to the annexation committee on April 5, 1999, but was tabled due to concerns that portions of some of the annexation, as originally proposed, were on ' private property and were not in the right -of -way. The proposal has been revised to include only those areas located in the right -of -way. The annexation will allow the City of Owasso to expend funds on roadway improvements in upcoming bond projects at the above -named intersections. ' Notification of the annexation and rezoning request was published in the Owasso Reporter on March 25, 1999 and April 1, 1999 to notify the public of the annexation request before the Planning ' Commission meeting on April 13, 1999. That will be followed by notification published two consecutive weeks in the Owasso Reporter on April 8, 1999 and April 15, 1999 to notify the public of possible City Council action regarding the request on April 20, 1999. In addition to the annexation policy, a copy of the procedures for annexation is also attached for your information and review. Staff has completed negotiations with Nelson L Gentry and Janet M Gentry, the property owners on the southeast corner of the intersection. The City has received a signed Letter of Agreement from the Gentrys. RECOMMENDATION: Staff recommends acceptance of the Letter of Agreement, and authorization for payment for the right -of -way property, as indicated in the Letter of Agreement. IATTACHMENTS: ' 1. Please understand that agreements proposed herein are commitments recommended by the City Manager and are subject to City Council ratification. We have reviewed the requests addressed in your conversations with City staff member Jim McElrath and agree to the following: 1. The City will pay to you an amount of $36,433 or $1.85 per square foot for the .4521 acres of right of way needed for the project. 2. The City will pay for the reconstruction of the owner's driveway with reinforced concrete up to the right of way limit. 3. The City will make every effort to save large trees valued by the owner. 4. Topsoil shall be restored to all disturbed areas, and the areas shall be sodded with bermuda to obtain equivalent ground cover as the adjacent property. The construction contractor shall be required to replace or repair any permanent fence, gate or driveway or any other structures damaged due to construction activities. If the above commitments comply fully with your requirements, please sign the acknowledgement at the end of this letter. Upon approval by the City Council, we will make available to you a deed document for you to sign and return to us for final execution by the Mayor and Council. Upon satisfaction of title work by the City of Owasso, we will return to you a copy of the fully executed right of way purchase documents, along with a check for the amount previously stated.
