Consideration and Appropriate Action Relating to City Council Authorization to Engage ' the Services of Mr Rusty McMurray of Infinete Technology Solutions for the Purpose of Identifying and Assessing Current and Future Computer Needs. ' Mr Rooney The staff will request Council authorization to engage the services of Mr Rusty ' McMurray of Infinete Technology Solutions for the purpose stated. MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER RE: ACCEPTANCE OF AGREEMENT WITH MR RUSTY MCMURRAY OF INFINETE TECHNOLOGY SOLUTIONS DATE: October 5, 1999 BACKGROUND: Effective 5:00 PM on Friday, October 1, 1999, Mr. Frank Knight resigned his position as Information Systems Director. _ Prior to Mr. Knight's resignation, CCS (Creative Computer Solutions — the City's financial software provider) was on -site last week to provide training for various segments of their system to members of the Finance Department. During CCS's training session with the Finance Department, several critical functions of the city's computer network system were not installed or did not function properly. In addition to the CCS and network problems, the City Hall facility encountered a power surge/lightening strike the week of September 27,1999:' While all computers were on surge protectors, several that were networked with the city's current financial system, CPS, have encountered operational difficulties. Typically, a total of 9 computers within Finance and Utility Billing have access to the CPS system. Currently, as a result of the power surge /lightening strike this number has been limited to 5. Also, in recent weeks, the Finance Department has been encountering difficulties when running various reports on the CPS system, a possible indication of a complete failure. In order to address all of the above issues in the most timely and cost effective manner as possible, staff would like to enter into an agreementwith Mr. Rusty McMurray of InfiNETe Technology Solutions. InfiNETe Technology Solutions is a full service provider of technology, support, design and programming in Business System Planning, Networking, and web /eCommerce programming. A complete proposal which would include placing two engineers onsite for the rest of this week to evaluate problem areas, the current network, and identify and address power surge /lightening strike damage is attached for your information and review. Please note that this would also allow for training with CCS, scheduled next week, to continue. • �i FUNDING: Funding for the costs associated with the contract for services with InfiNETe Technology Solutions would be available within the General Fund Information Systems Department Budget —Salary Line Item No. 51- 180 -5101. While Mr. McMurray anticipates the cost for the services described to range from $4,320 to $5,400, staff would request that Council enter into this agreement for an amount not to exceed $10,000. This would allow InfiNETe Technology Solutions to address any other problems that are perhaps unknown at this time. ADDITIONAL COMMENTS: This is a proposed solution to the immediate problems that have been identified. A long- term solution to Information System staffing needs will be developed with the advice of Mr. McMurray, and a continuation of this engagement may need to be extended until such time that staff has been hired. If the proposal by InfiNETe Technology Solutions is approved by the Council, and update will be provided at the Council Work Session on October 12, 1999. RECOMMENDATION: Staff recommends Council authorization to engage the services of Rusty McMurray of InfiNete Technology Solutions for the purpose of performing Computer, Network, and Software Assessment for an amount not to exceed $10,000. It is our immediate objective to identify current hot spots, supervise other current contractors repairs, provide temporary staffing, to assist in the transition to a new IT Director, and to insure the success of the City's new CCS financial package rollout. InfiNETe Technology Solutions will place 2 Engineers onsite through Friday to evaluate the current Microsoft NT Network, and identify additional "hot spots" other than and- including: • Power Surge Damage — 2 - 3Com Network Hubs • Test existing wiring and cabling for damage (InfiNETe) • Network Printer Configuration • CCS Financial Software setup for Training Classes • Conductivity and Stability for Current Unix based Financial Software InfiNETe Technology Solutions will supervise and report to City Management, all known current independent contractors repair work onsite (identified): • Current Financial Software Stabilization, Conductivity and Backup plan (UNIX System) (Current Consultant — K. OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, September 21, 1999 The Owasso City Council met in regular session on Tuesday, September 21, 1999 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, September 17, 1999. ITEM 1: CALL TO ORDER Mayor Wilken called the meeting to order at 6:30 p.m. ITEM 2: INVOCATION The invocation was offered by Support Services Director Jim McElrath. ITEM 3: FLAG SALUTE City Planner Theron Warlick led in the flag salute. ITEM 4: ROLL CALL PRESENT Mark Wilken, Mayor Mary Lou Barnhouse, Vice Mayor Denise Bode, Councilor H C "Will" Williams, Councilor STAFF Jeff Hancock, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ABSENT Melinda Voss, Councilor ITEM 5: READING OF MAYOR'S PROCLAMATION. Mayor Wilken read and presented a proclamation to Dr Gene Drake, recognizing him Business of the Quarter for the Third Quarter of 1999. ITEM 6: REQUEST BY CITIZEN TO ADDRESS THE CITY COUNCIL. Ms Gail Fickle addressed the Council relative to a marching band competition that will be held on October 2nd at the Owasso High School. She said that 12 bands from across the state will be present, and 3000 -4000 people are expected to attend. NIs Fickle invited the Council and citizens to attend the competition. Owasso City Council September 21, 1999 ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of the Minutes of September 7, 1999 Regular Meeting and September 14, 1999 Special Meeting. B. Approval of Claims. C. Action Relating to Council Approval of a Contract for Drug Detection Canine Services. D. Action Relating to City Council Approval of a Final Plat for The Willows of Silver Creek, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. E. Action Relating to City Council Approval of a Final Plat for Oklahoma Central Credit Union, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. F. The consent agenda included minutes of the September 7, 1999 regular meeting and the September 14, 1999 special meeting, by reference made a part hereto. Item C requested City Council approval of a contract with the Owasso Public School System for the Owasso Police Department to provide drug detection services to the school system for the 1998 -99 school year, at a cost of $10,000. Item D requested Council approval of the final plat for The Willows of Silver creek, located immediately north of The Bradfords of Silver Creek, west of N 145`" East Ave, containing 84 lots on 31.22 acres, more or less. Item E requested Council approval of the final plat for Oklahoma Central Credit Union, located southeast of the ONG building, between N 121St East Ave and U.S. Highway 169. Item F requested extension of a contract with UniFirst Corporation for the supply and cleaning of uniforms for the Parks, Support Services, and Public Works Departments for the Period January 1, 2000 through December 31, 2000, under the same conditions as the current agreement. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR A SUPPLEMENTAL APPROPRIATION AND AMENDMENT TO THE ' CAPITAL PROJECTS GRANT FUND THE GENERAL FUND GENERAL GOVERNMENT BUDGET AND THE CAPITAL IMPROVEMENTS FUND. ' Ms Bishop said that in order for the budget to operate as the current police statement of the City Council, the budget must be amended to incorporate current activity. Several contracts, projects t Owasso City Council September 21, 1999 and grants are not included in the budget. The Capital Projects Grant Fund needs to be amended to reflect a $35,000 grant received for the renovation of the Community Center. A contract for services with the Greenwood Performance Group for $11,615 and a purchase of land for $10,000 requires an amendment of $21,615 in the General Fund of the General Fund. A budget amendment of $14,000 in requested in the Capital Improvements Fund to assist in the remodeling of the old PSO building for use by the public works department. Mr Williams moved, seconded by Dr Bode, to approve a supplemental appropriation to the Capital Projects Grant Fund, wherein revenues and expenditures are increased by $35,000; to the General Government Department of the General Fund, increasing expenditures by $21,615; and to the Public Works building project in the Capital Improvements Fund, increasing expenditures by $14,000. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CHANGE ORDER #3 A CHANGE ORDER TO A CONTRACT BETWEEN THE CITY OF ' OWASSO AND FRIX AND FOSTER CONSTRUCTION CO INC FOR CONSTRUCTION OF A FOUR -PLEX AT THE OWASSO SPORTS PARK. ' Mr Henderson said that on July 20, 1999, the City Council approved Change Order #2 to a contract with Frix & Foster for the additional construction of a new soccer field at the Sports Park. At that time, no additional time was requested. Because of inclement weather, the contractor has requested additional days for the completion of the project. ' ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AMEND THE ARCHITECT /ENGINEERING AGREEMENT BETWEEN THE CITY OFF OWASSO AND CH2M HILL. Mr Henderson presented the item. In May 1998, the City of Owaso entered into an agreement with CH2M Hill for architectural /engineering services related to the bond issue projects. The agreement was amended in February 1999 to expand the scope of the project. Since that time, intersection project plans have been completed and submitted to the utility companies for review and comment. The result is that utility relocation will cost more than originally expected and changes will need to be made to the plans. Amendment #2 to the A/E agreement with CH2M Hill provides for additional engineering services. Mr Williams moved, seconded by Ms Barnhouse, to approve the amendment to the A/E agreement with CH2M Hill, increasing the -3- Owasso City Council September 21, 1999 amount of the agreement in an amount not to exceed $10,671, for the purpose of providing additional engineering services relating to the 1998 bond issue intersection project. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #617, AN ORDINANCE AMENDING THE OKLAHOMA MUNICIPAL RETIREMENT FUND THRIFT PLAN DOCUMENT FOR THE CITIY OF OWASSO, AND DECLARING AN EMERGENCY. Mr Harder said that recent changes within the banking industry resulted in a change in the management of the Oklahoma Municipal Retirement Fund retirement funds for City employees Allocations will be made on a cash basis rather than an accrual basis. The changes necessitate an amendment to the City's plan document retroactive to July 1, 1999, the beginning of the plan year. OMRF requires that the City approve the changes by ordinance, and Ordinance #617 authorizes those changes. Dr Bode moved, seconded by Ms Barnhouse to approved Ordinance #617. AYE: Bode, Barnhouse, Williams, Wilken NAY: None Motion carried 4 -0. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THA ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE #617. Because the change in the retirement fund is retroactive to July 1, 1999, an emergency clause has been attached to the ordinance and must be acted upon separately. Dr Bode moved, seconded by Mr Williams, to approve the attachment of an emergency clause to Ordinance #617. AYE: Bode, Williams, Barnhouse, Wilken NAY: None Motion carried 4 -0. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM SOKOLOSKY & VINES FOR ANNEXATION OF TWO ADJACENT 15.4 ACRE TRACTS OF LAND GENERALLY LOCATED ON THE NORTHEAST CORNER OF NORTH 97" EAST AVE AND EAST 106T" STREET NORTH, BETWEEN MINGO ROAD AND THE SKO RAILROAD RIGHTL -OF -WAY. Mr Warlick Hancock said that DM Sokolosky and David Fines have requested the annexation of two individually owned 15.4 acre tracts totaling approximately 30.8 acres. These properties are -4- Owasso City Council September 21, 1999 generally located on the northeast corner of Mingo Road and E 106"' St N, between Mingo Rd and the SKO Railroad right -of -way. The land is undeveloped and presently zoned AG in Tulsa County. Upon annexation, the property will also be designated AG within the City of Owasos. A citizen in the audience asked what the land would be used for. Mr Warlick said that preliminary discussions with the owners indicate that they may request residential zoning, with possible commercial zoning near the intersection. However, all zoning requests, as well as plats & site plans will have to follow established approval guidelines. The Annexation Committee and the Planning Commission have both reviewed the request and both recommended approval Dr Bode moved, seconded by Mr Williams, to approve the requested annexation. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM THE OWASSO PUBLIC WORKS AUTHORITY FOR THE ANNEXATION OF PORTIONS OF THE PUBLIC RIGHT -OF -WAY IN TULSA COUNTY OKLAHOMA LOCATED AT THE INTERSECTIONS OF EAST 76TH STREET ' NORTH & 129TH EAST AVE EAST 86TH STREET NORTH & NORTH MINGO ROAD AND EAST 116TH STREET NORTH & NORTH GARNETT ROAD. Mr Warlick said that OPWA has requested the annexation of portions of the public right -of -way in Tulsa County, located at three intersections. The annexations will allow the City of Owasso to expend funds on roadway improvements in upcoming bond projects at the above -named intersections. The Annexation Committee and the Planning Commission have both recommended approval. Ms Bamhouse moved, seconded by Mr Williams, to approve the requested annexation. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ACCEPTANCE OF A LETTER OF AGREEMENT FROM NELSON L GENTRY AND JANET M GENTRY TO THE CITY OF OWASSO AND AUTHORIZATION FOR PAYMENT AS INDICATED IN THE LETTER OF AGREEMENT. Mr McElrath presented the item. He said that one of the projects included in the October 1997 bond issue is the widening of the intersection at -6`h St N & 1291h East Ave. Engineering has been completed on the intersection, indicating additional right -of -way needed. Staff has completed negotiations with Nelson L Gentry & Janet M Gentry, the property owners on the southeast corner of the intersection, and the city has received a signed Letter of Agreement. A citizen in the audience asked how much was paid of the land. Mr McElrath requested that the City Clerk read the amount. The City Clerk responded with an amount of $36,433 for the .4521 -5- Owasso City Council September 21, 1999 acres of right -of -way needed for the project. Dr Bode moved, seconded by Mr Williams, to accept the Letter of Agreement from Nelson L & Janet M Gentry to the City of Owasso for property to be utilized as a part of the 76th St N & 129" East Ave intersection improvement, and authorization for payment. Mr Cates said that this is the same piece of property that the City purchased two weeks ago at a purchase price of $10,000, and it is being sold to RCB Bank at the same price. RCB is requesting to purchase the property to be utilized as a part of their new bank site. The subject property consists of two tracts of land located on east side of Mingo Road, north of N 106,` E Avenue. Each tract is 15 acre in size, with a total annexation request of 30 acres, more or less. A case map is attached for your information and review. As reported to you previously, the subject property's zoning will become AG (Agriculture) upon annexation. After design and construction considerations, City staff determined the best use for the grant funds to be carpet replacement. In order to meet the final requirement of the grant award, council needs to approve the release of funds. RECOMMENDATION: The staff recommends Council approval of the release of funds for the ODOC grant, and that the Mayor be authorized to execute the document. MEMORANDUM TO: THE HONORABLE MAYOR & CITY COUNCIL CITY OF OWASSO FROM: DEPUTY CHIEF STUCKEY SUBJECT: SELF - CONTAINED BREATHING APPARATUS (SCBA) DATE: September 29, 1999 BACKGROUND: The Self- Contained Breathing Apparatus (SCBA) allows the fire fighter to operate in areas that are low in oxygen and contain dangerous gases. The fiscal year 1999 -2000 capital outlay budget contained $11,500.00 for the purchase of SCBA's. BID REVIEW Specifications were developed and mailed to dealers in August of this year. Two bids were received, both above the budgeted amount. In order to stay within the budgeted amount, staff will reduce the number of specified SCBA, and request a re -bid of the equipment. RECOMMENDATION Staff recommends that all bids received be rejected, and that the Council authorize the re- bidding of the SCBA with new specifications. ' MEMORANDUM t TO: THE HONORABLE MAYOR CITY COUNCIL CITY OF OWASSO FROM: LIEUTENANT CLIFFORD R. MOTTO ACTING CHIEF OF POLICE kill SUBJECT: REQUEST TO PURCHASE EMERGENCY GENERATOR FOR THE ' POLICE DEPARTMENT DATE: September 29, 1999 BACKGROUND: On August 27, 1999, the Police Department's emergency generator was struck by lightening during a thunderstorm. The generator was damaged beyond repair and has been declared a "total 1 loss" by the city's insurance carrier. The generator was an 8KW Natural Gas unit and was approximately twenty years old. The Police Department Communications Division, as well as all police telephones, 911 emergency lines, police radios, computer systems, and the city jail facility are powered by this generator. The Department has been forced to rent an emergency generator since August 27, 1999, as it cannot afford to lose its communications abilities in the r event of another power failure. In researching this issue, it was learned that an 8KW unit is no longer sufficient to handle the ' equipment the Department must operate during a power outage. The power companies that were contacted do not even stock any generator rated lower than IOKW. Additionally, a "natural gas" supply source is not recommended as it is very likely that the gas company would turn off the line in the event of "tornado damage" to the area. Therefore, a "diesel" unit, which has its own fuel source, was recommended. It was further recommended that, at a minimum, a generator with a rating of no less than 20KW be used at the Police Department to ensure adequate power ' for all equipment that is expected to be operational during times of power outages. Staff contacted three power system companies from the Tulsa -Metro area, and requested price ' quotes for a "turn -key" operation for an emergency generator, appropriate transfer switch, and all wiring installations. Staff further requested prices for generators that would power additional areas of the Police Department instead of just the Communications area and jail. The companies recommended that, since the Department has two separate electric services coming into the building and is basically wired in "thirds', a 20KW unit be purchased for Communications and P the jail, a 35KW unit to additionally power the squad room area, and a 60KW unit to power the entire building. r EMERGENCY GENERATOR SEPTEMBER 29, 1999 PAGE 2 The following companies were contacted to supply quotes: 1. Clifford Power Systems 2. Southern Plains Power 3. Waukesha- Pearce Industries It should be noted that only Clifford Power Systems was able to provide a "turn-key" operation as they have electrical contractors on staff. The other two companies can provide the equipment; however, the Police Department would be responsible for all installations. Any and all costs that are not offset by the insurance company will come from the Department's operating budget. If the Department cannot make this unexpected deficit up over the course of the fiscal year, a supplemental appropriation will be requested at that time. Staff has been advised by Regina Guthrie that the insurance company will pay from $9,500 to $10,000.00 for the repair /replacement costs of the generator. The 20KW generator unit and all installation costs from Clifford Power systems will be $15,842.00. Once the insurance company issues payment to the City for the loss, actual costs to the Police Department will be either $6342 or $5842. ' EMERGENCY GENERATOR SEPTEMBER 29, 1999 ' PAGE 3 RECOMMENDATION: ' Staff recommends City Council authorization for the Police Department to purchase a generator from Clifford Power Systems. Although the price quote from this company is $838 higher than ' the lowest quote, Clifford Power Systems is familiar with the Police Department and has provided service to us in the past. This company has also worked with various city departments in the past and their work and equipment has been recommended by other city Department Directors. Additionally, this company is the only one that can provide a "turn—key" operation, and is providing the rental generator the department is presently utilizing. ' Staff, therefore, recommends that a 20KW Diesel Generator be purchased from Clifford Power Systems at a total cost of $15,842. This price includes installation and a one -year warranty. JEFF HANCOCK ' SUBJECT: RIGHT OF WAY ACQUISITION PROCEDURES 86TH AND MAIN INTERSECTION AND IMPROVEMENT IDATE: September 24, 1999 BACKGROUND: 1 Negotiations on 86`h and Main: At the March 2, 1999, City Council Meeting the City Council approved a "Real Estate and Right- of- Way/Easement Acquisition Procedure." This was the City's first written procedure, covering all the various types of acquisition projects. The procedure specifies that "negotiations will be performed by City of Owasso staff." This procedure has been followed on the acquisition of property at the intersection of 76`h and 129`h, which is a locally funded project. However, in the case of 86`h and Main which is to include Federal monies, it appears that an adjustment may be necessary in order to ensure that the City is in full compliance with the complicated and lengthy rules that regulate federally funded projects. Owasso City Attorney Ron Cates has recommended to staff that they not attempt to handle the negotiation/acquisition phase of the 86`h and Main project. The stringent regulations and record - keeping requirements are such that the possibility of making an error on any phase of the acquisition procedure exposes the City to the possibility of having to repay the Federal monies ($750,000). Such would be the case if any discrepancy in the federally prescribed procedures were discovered, even years after the project is completed. Based on Mr. Cates' opinion, as well as staff's study of the federal rules covering such projects, staff concurs that in the case of the 86`' and Main project, it is in the best interests of the City to retain the services of Cinnabar Services Company (which is providing the professional services ' on this project) to handle the negotiation/acquisition phase of the project. This would be in addition to the preliminary data collection/appraisal phase that they have already performed �I 86TH AND MAIN RIGHT OF WAY ACQUISITION SEPTEMBER 24, 1999 PAGE 2 2. Title Work on 80 and Main project:_ The procedures approved by the City Council on March 2, 1999 specify that the data collection performed by the professional service company; "Include determination of the existing property owner, mortgage information and obtaining a copy of the warranty deed for each property" and that, "All mortgage holders identified during data collection will be contacted by the City Attorney and asked to subordinate their mortgage interest to the City of Owasso for the purpose of obtaining the requested acquisition." In conversations with the City Attorney during the course of this project, he has indicated to staff that he recommends a more conservative and protective approach in the area of title work. This approach recommends obtaining a full updating of the abstract and rendering of a title opinion, as well as coverage by title insurance on each piece of real estate taken prior to any mortgage subordination. This would be in place of obtaining a simple certificate of title and an instrument of mortgage subordination. Cost estimates from Cinnabar Company for Mortgage Subordination on seven (7) parcels were $180 apiece or $1260 total. Cost estimates from local Owasso attorneys for full abstract/title /title insurance work range from $800 to $1800 per parcel. The cost would vary based on two factors: (1) whether or not a given abstract has to be created from sovereignty or only brought up to date and (2) the cost of title insurance as determined by the size of the parcel taken and the actual value of the project improvement on that parcel. The breakdown per parcel would range as follows: 1. Abstract work: $200 to $1000 2. Title opinion $400 3. Title insurance $200 to $400. As of the writing of this memo, staff has not yet determined estimates as to which parcels will cost which amount; so we only know that the total cost will range from approximately $5600 to $12,600, and will most probably fall somewhere between these two amounts. Staff has discussed this situation with Cinnabar. Cinnabar has advised the City that different governmental entities with which they are familiar handle this particular phase of acquisition in different ways. For example, the State of Oklahoma never requires anything beyond a title certificate and mortgage subordination, while the City of Tulsa always requires abstract updating and a full title opinion on any purchase of real property. The approach recommended by Mr. Cates, while more expensive, would certainly provide a very high, if not the highest degree of protection for the citizens of the City of Owasso. ' 86 T11 AND MAIN RIGHT OF WAY ACQUISITION SEPTEMBER 24, 1999 PAGE 3 ' ANTICIPATED RECOMMENDATION: Unless directed by the Council to explore other options than those listed above, Staff plans to t recommend at the October 5,1999 Council meeting that the City Council approve the following: ' 1. The retaining of Cinnabar Service Company to perform the negotiation/acquisition phase of the bond issue 86`h and Main intersection and roadway improvement project at a cost not to exceed $9000 (the amount previously specified by them in their proposal of services for this ' proj ect.) 2. Therefore, a Request for Qualifications for real estate and right -of way acquisition services for this and other projects was prepared. 61 REAL ESTATE AND RIGHTS -OF -WAY AC UISI'TION PROCEDURE: To proceed with bidding and have construction initiated in accordance with the ODOT schedule, temporary and permanent rights -of -way for construction are required. Four (4) firms were sent Requests for Qualifications and responses were received from three (3) of these firms. Staff reviewed the qualifications statements and selected Cinnabar Service Company as the most "Qualified and Highly Responsive" firm. Specific future t projects would be identified and price proposals submitted as professional services, thereby not requiring competitive bids. A meeting was held with representatives from Cinnabar to discuss 'potential projects. At that ■ time a request for a letter proposals were requested. LETTER PROPOSALS: -8e Street North and Main Street Prior to formalization of the acquisition procedure, a letter proposal was submitted on December 14, 1998 for consideration (see Attachment 2). Periodically, these improvements involve construction on or adjacent to privately -owned lands that requires a subsurface easement for the construction, operation and maintenance and temporary or permanent surface right -of -way to enable adequate area for construction and the improvement. The City of Owasso will take all reasonable effort to keep from having to request right -of -way ' and/or easement in order to construct improvements. Designs will incorporate practical alternatives to minimize property acquisition. There will be times, however, that property ' acquisition will be unavoidable.. Acquisition of real estate can become formal and insensitive to the property owner. The City of Owasso desires to maintain a personalized approach to the process as much as possible. The ' policy has been developed to blend the use of contracted professional services for data collection and city staff involvement for property owner contact and project - specific discussion. ' The purpose of this policy is to establish the framework for the methodology in obtaining the use of the subject property for proposed infrastructure improvements. The following steps have been identified: Preliminary Data Collection 1. Final project design drawings will be utilized to determine pipeline route alignment and/or the limits of construction. The intent is to use detailed drawings and legal descriptions that should minimize the probability of adding to or subtracting from the ' required real estate acquisition in the future. 2. Negotiation ' 6. Those properties not obtained as a donation will require negotiation of value. Analysis of area comparative sales will be performed by the real estate service ' company and will serve as the basis of property value for negotiation 7. Prior to initiating the negotiation phase, a status meeting will be held with City ' Council to present findings and establish criteria for the negotiation phase. Each property will be presented and negotiation criteria developed on a case- by-case basis. 8. Negotiations will be performed by City of Owasso staff. 9. In the event that there is failure to negotiate mutually acceptable provisions for the real estate acquisition, staff may recommend modification to the design to change alignment or limits of construction. Another option may be to initiate condemnation proceedings. Condemnation 10. At the recommendation of the City Attorney, condemnation proceedings may be ' initiated for properties that could not be acquired through negotiation. Condemnation will be approved by the City Council in advance. 11. Concurrent with the first steps in the condemnation process, the real estate service company will be directed to prepare comprehensive narrative appraisals for each -remaining property. These appraisals will be performed at the direction and to the ' level of detail required by the City Attorney. A professional review of the narrative appraisals will be required for projects using Federal funds to assure procedural compliance to determine value. in 12. Initial steps in the condemnation process prior to having the ability to utilize the subject property could take from 90 -120 days. 13. Cover letter ' B. Qualifications of the FIRM This section shall discuss prior relevant experience of the firm. Particular mention should be made regarding previous experience on similar projects. The section shall also include a ' discussion of projects performed within the past twelve (12) months. The discussion of each project shall include information concerning a description of any similar work, project schedules and special circumstances encountered. All current or pending litigation against the firm shall be provided C. References References shall be provided, with current names, addresses and telephone numbers included for all appropriate points of contact. D. Present Projects This portion of the submittal shall also include a listing of all projects currently in progress by the firm and their anticipated completion date. E. Firm Organization and Staffing This section shall discuss staffing showing key personnel. Resames of key personnel shall be included as an appendix- I F. Detail of Billing Rates The firm shall provide detailed information concerning billing rates for each person. Included shall be a description of other direct fees, charges and expenses anticipated (i.e., mileage, telephone, and reproduction). An explanation of the conversion of direct labor rates to billing rates to determine the multiplier used by the firm is to be provided G. Description of Additional or Supporting Services The firm shall submit a description of other capabilities to provide the City with additional information which may be used as a reference should they desire the firm to perform additional ' or supporting services. REVIEW CRITERIA FOR THE PROPOSALS RECEIVED Qualifications statements will be reviewed in terms of content and completeness. Any or all references may be contacted. Each required item will be reviewed and the following factors will be assessed: I, Experience and competence of the firm and staff in the required areas of expertise. 2. Capacity to perform all required services. ' 3. Ability to expedite the completion of the project in a timely manner. 4. Evaluation of record on similar projects which shall include quality of work and cost ' control. All submittals that have been received by the deadline and in the manner required in this RFQ will be ' opened and evaluated by a Review Comrniitee. Based upon this evaluation, the Review Committee will identify a firm as the most "Qualified and Highly Responsive Firm ". As project locations are identified, the selected "Qualified and Highly Responsive Firm" will be 1 requested to submit a letter proposal of services and fee for specific services. If warranted, the terms of the agreement for services will be negotiated ' IV. NUMBER OF COPIES TO BE SUBMITTED ' Firm shall submit one (1) original and three (3) copies of proposal to the City in response to the RFQ. The ' memorandum attached to the previous item ( #11) and provided to you on Monday, September 27th, explains the reasons that staff believes this approach to be beneficial to the City of Owasso. ' RECOMMENDATION: ' Staff recommends authorization for the City Manager to retain competent local attorneys to perform and/or oversee services necessary to prove and insure title to the real estate acquired for right of way on the 86th and Main improvement project, at a total cost not to exceed $15,000.
