ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A BID TO
PURCHASE SELF - CONTAINED BREATHING APPARATUS.
Deputy Chief Stuckey presented the item. He said that the FY 1999 -2000 capital outlay budget
contains $11,500 for the purchase of self - contained breathing apparatus. Bids were prepared,
opened, and rejected because all bids exceeded the budgeted amount. The specifications were
reviewed and changed and the equipment was rebid. Three bids were received, all meeting the
specifications. Dr Bode moved, seconded by Mr Williams, to award the bid for four SCBA and
three additional cylinders to Orr Safety Corp, Louisville, KY in the amount of $11,443.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE
3625, AN ORDINANCE PERTAINING TO MOTOR VEHICLE ESCORT
' GUIDES, AND DECLARING AN EMERGENCY
Acting Chief Motto presented the item. He said that the police department has provided funeral
escorts for many years. However, the rapid growth of the community has placed increased
demands on the department and they are often not available to provide this service. The City
' Attorney has developed an ordinance that will allow Motor Vehicle Escort Guide agencies to
perform funeral escorts. This ordinance empowers them to direct and control traffic on any city
street while engaged in an escort. The ordinance also outlines the duties and authority of these
' agencies while engaged in any escort function within the City of Owasso, and provides for the
Owasso Police Department to inspect, control and regulate any such agency operating within the
city limits. Dr Bode moved, seconded by Mr Williams, to approve Ordinance #625.

I ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE #625.
' Chief Motto said that due to the absence of any code provisions pertaining to Motor Vehicle
Escort Guides and the immediate necessity for such provisions, an emergency clause has been
attached to Ordinance #625. If approved, the ordinance will become effective immediately upon
publication. Dr Bode moved, seconded by Ms Barnhouse, to approve the attachment of an
emergency clause to Ordinance #625.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #99 -08 A RESOLUTION AUTHORIZING THE POLICE
OFFICERS OF THE CITY OF OWASSO POLICE DEPARTMENT TO PERFORM
POLICE FUNCTIONS OUTSIDE THE OWASSO CITY LIMITS.
Acting Chief Motto presented the item. He said that the City of Owasso has mutual aid
agreements with the Oklahoma Highway Patrol and both the Tulsa and Rogers County Sheriffs'
' Offices. These agreements authorize the police department to either request assistance from or
provide assistance to these law enforcement agencies. Since any law enforcement agency must
have a mutual aid agreement with any other agency where assistance is requested or provided,
the City Attorney has drafted a resolution granting and authorizing the Owasso Police
Department to assist or request assistance from any municipality within the State of Oklahoma.
Dr Bode moved, seconded by Mr Williams, to approve Resolution #99 -08.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
TO AWARD A CONTRACT FOR MANAGEMENT OF THE POLICE CHIEF
SELECTION PROCESS.
Mr Harder presented the item. The assessment center process is one of several selection devices
used to determine a cand'idate's qualifications for a particular supervisory or managerial position.
The persons who perform these services have been trained in group and interpersonal skills,
observation of behavior and the exercises used during the assessment process. Two proposals
were received from firms for the design and management of an assessment center for the
selection of the next police chief. Booth Research Group Inc has multiple clients and will
customize the assessment from a proven tested process. Human Resources Management
Services LLC has limited experience and will have to completely design the process. Booth also
has the lowest cost associated with the process. Forty -five applications have been received for
the position of police chief. That has been reduced to 31 through the elimination of candidates
who do not meet minimum requirements. That number will be further reduced by a management
panel review to 3 -6. Those final applicants will be subjected to the assessment center process.
The final choice rests with the City Manager. Dr Bode moved, seconded by Mr Williams, to
award a contract to Booth Research Group Inc, Parker, CO in the amount of $10,500 plus
expenses for management of the police chief selection process.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR THE PURCHASE OF COMPUTER SOFTWARE.
Mr Rooney said that on November 16, 1999 the City Council authorized the staff to proceed with
purchasing necessary computer components for both the Public Works and Fire Department
facilities. Computer hardware and software is also needed for the Golf Department. Both the
Fire Department and the Golf Department require some specialized software. Equipment lists
have been developed by Mr McMurray of InfiNETe Technology Solutions and quotes have been
taken on the equipment. Dr Bode moved, seconded by Mr Williams, to approve the purchase of
Incident Tracking, Response Time, and Management Report Software from Fire House
Software, Inc. for $7680; Chemical Emergency Response Software from Cameo for $640; Pre -
Plan Mapping Software from Bode Research Group for $1126; Testing Software from Fire
Instructor Testing Software, Inc for $1083; and Hardware for Golf Course Software from Dell
Computer Corporation for $5539; Printers for the Golf Course from Hewlett - Packard for $900;
Two UPS Workstations from CDW for $250, and Hardware and Software from The Golf System
for $16,110. The total purchase of all hardware and software equipment is $33,328.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO FINAL
ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT FOR
OWASSO SPORTS PARK FOUR PLEX / SOCCER FIELD PROJECT, BETWEEN
THE CITY OF OWASSO AND FRIX AND FOSTER CONSTRUCTION CO INC
AND AUTHORIZATION FOR FINAL PAYMENT AND RELEASE OF
RETAINAGE.
Mr Henderson presented the item. On February 17, 1999 the City Council awarded a contract to
Frix & Foster Construction Co Inc of Muskogee, OK for the purpose of constructing the new
four -plex at the Owasso Sports Park. The total contract amount for the improvements was
$267,308.00. On April 20, 1999 Change Order #1 was approved by the City Council to increase
the contract amount by $7000 for the removal and replacement of unsuitable material on the site.
The final net cost for that removal and replacement was $4725. On July 20, 1999 Change Order
#2 was approved by the City Council to add the construction of a new soccer field to the
contract. This increased the contract cost by $30,000. On September 21, 1999 Change Order #3
was approved, which added 45 weather days to the project due to the wet spring. The final
contract amount with all change orders is $302,033.00. Final inspection was held on October 15,
1999 and a punch list of items was prepared. The contractor has completed the items on the
punch list to the satisfaction of City staff. A one -year Maintenance Bond has been provided for
the construction and will begin the day of final acceptance. Dr Bode moved, seconded by Ms
Barnhouse, to approve final acceptance of the Sports Park Four -Plex / Soccer Project and
authorize final payment in the amount of $17,381.65 to Frix and Foster Construction Co Inc,
Muskogee, OK.

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CHANGE
ORDER #4. A CHANGE ORDER TO A CONTRACT BETWEEN THE CITY OF
OWASSO AND HORIZON CONSTRUCTION CO INC FOR THE STREET
REHABILITATION PROJECT.
Mr Henderson said that Change Order #4 to a contract for the street rehabilitation project allows
for some drainage work at 3 d & Carlsbad, allows for the relocation of a 12" water line, and
reconciles final construction quantities. The amount of the change order is $65,630.86. Dr Bode
moved, seconded by Mr Williams, to approve Change Order #4 to a contract with Horizon
Construction Co Inc for the street rehabilitation project.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO FINAL
ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT FOR STREET
REHABILITATION PROJECT BETWEEN THE CITY OF OWASOS AND
HORIZON CONSTRUCTION CO INC AND AUTHORIZATION FOR FINAL
PAYMENT AND RELEASE OF RETAINAGE
Mr Henderson said that on October 20, 1998 the City Council awarded a contract to Horizon
Construction Co Inc, Owasso, Ok for the purpose of reconstruction of several streets. The total
contract amount for the improvements was $836,954.95. Change Order #1 was approved on
December 15, 1998 in the amount of $19,270.94 for the use of quick -set flowable fill to stabilize
the subgrade under 11th St because of subgrade problems. On May 4, 1999 change Order #2 was
approved in the amount of $81,023.78 to reconcile the quantities on 11th St; add fabric
reinforcement, replace deteriorated storm drainage and reduce roadway repairs on Atlanta; and
reroute storm drainage from 3 d St and Carlsbad to the ease side of the golf course. Change
Order #3 was approved on June 15, 1999 in the amount of $27,726.18 to add the walkbridge and
sidewalk to the east side of N 1291h east Ave from the High School to Camden Park. Change
Order #4, approved in the last item, added $65,630.86 to the cost of the project and relocated a
12" water line, provided for some storm drainage work, and reconciled final construction
quantities. The final contract amount is $1,030,203.54. A final inspection was held on October
22, 1999, and a punch list of items was prepared. The contractor has completed the punch list to
the satisfaction of City staff, and has provided a one -year Maintenance Bond. Mr Williams
moved, seconded by Ms Barnhouse, to accept the work performed under a contract with Horizon
Construct Co Inc for street rehabilitation project, and authorize final payment, including
retainage, in the amount of $51,123.

ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
AGREEMENT FOR THE RELOCATION OF A GAS LINE AT 76TH STREET
NORTH AND 129TH EAST AVENUE INTERSECTION
Because of the absence of one Councilor and two Councilors having to recuse themselves from
this item, it was withdrawn from the agenda.

ITEM 17: CONSIDERATION AND APPROPRIATE ACTION RELATING C ON LAT NG T O AN
AGREEMENT FOR THE RELOCATIONS OF A POWER POLE AT 76"' STREET
' NORTH AND 129TH EAST AVENUE INTERSECTION.
Mr Henderson said that as a part of the bond issue for capital improvement projects, the
intersection at 76th St N & N 129th East Ave will be expanded to one through lane and a left turn
lane in each direction. A right turn lane will accommodate southbound traffic turning west, and
' signalization will be included at this intersection. The construction of the right turn lane for
southbound traffic turning west requires the moving of one Grand River Dam Authority pole.
An agreement has been worked out with GRDA for them to relocate the pole at a cost of $4160.
' Dr Bode moved, seconded by Mr Williams, to approve an agreement with Grand River Dam
Authority for the relocation of a power pole at 76th St N and 129th East Ave at a cost not to
exceed $4160, and authorization for the Mayor to execute the agreement.

ITEM 18: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
DETERMINATION OF A SOLE SOURCE FOR REPLACEMENT OF FOLDING
PARTITIONS AT THE OWASSO COMMUNITY CENTER AND AWARD OF A
CONTRACT FOR SAME.
Mr Henderson said that costs to replace the roof and carpet at the Community Center were lower
than budgeted. The staff developed a list of items at the Community Center that need repair or
replacement. One of those items is replacement of the partitions between the dining room and
recreation room. The staff determined that it would be in the best interest of the City to retain
the existing framework and roller system, and replace only the partitions themselves. Murray
Womble is the only company in the area that carries these partitions. Any other company would
have to remove the existing roller system and install their own with the partitions. The City
Attorney reviewed the issue and agreed that, because the City wants to retain the existing
framework and roller system, Murray Womble would be considered a sole source for the
product. Dr Bode moved, seconded by Mr Williams, to award a contract in the amount of
$13,101 to Murray Womble Inc, Owasso, OK, through the utilization of a sole source quotation,
for the replacement of folding partitions at the Community Center.

Mr Cates discussed proposed agreements with Washington County and Rogers County rural
water districts, relating to utility services, fire protection and ambulance service within the areas.
ITEM 4: UPDATE ON PROPOSED CONTRACT WITH SEAYCO.
Mr Cates discussed the proposed real estate agreement with SEAYCO for signalization and
street improvements along the southern perimeter of Owasso Market.
Owasso City Council December 14, 1999
ITEM 5: UPDATE ON PROPOSED GOLF COURSE FEE STRUCTURE.
Mr Carlson discussed a proposed fee increase at the golf course which, if approved by the
Trustees, will take place in late spring. He said that fees for Owasso residents and patron card
holders will remain the same.

SUBJECT: AWARD OF BID FOR COMMUNITY CENTER CARPET
REPLACEMENT PROJECT
DATE: December 14, 1999
BACKGROUND:
In October of 1997, the citizens of Owasso approved a 10- million - dollar bond issue for capital
improvement projects within the City of Owasso. The projects included for funding within that
bond issue are street and intersection improvements, a new city hall, remodeling of the existing
city hall for the police department, improvements to the Owasso Sports Park and improvements
to the existing Community Center. Improvements to the Community Center included a new roof
and the replacement of carpet and ceiling tiles because of water damage.
In February 1999, the City Council awarded the re- roofing of the Community Center to Shelton -
Metro Roofing Company. The new roof has been installed and the punch list items are being
completed.
During the re- roofing project, the project architect /engineer (A/E), CH2M Hill/Urban Design
Group, and staff worked on color schemes and patterns for the carpet replacement. As the
roofing project neared completion, final touches were made to the plans and the project was
advertised.
Bids were opened on September 16, 1999, with Mill Creek Carpet and Tile being the only
bidder. The bid submitted was for $29,760.00 (see attachment A), which will include removal of
the existing carpet and baseboards, laying of carpet squares, installation of new baseboards, and
installation of transition strips where the carpet ends and the existing tile begins.
BID ANALYSIS:
After the bid was opened and the A/E compared the unit prices to previous projects, Urban
Design Group transmitted a letter to staff verifying that the bid is acceptable (see attachment B).
Staff also requested that the contractor supply names of contacts on their last four projects.
' Three contacts responded to our calls, and all three were very positive.

FUNDING:
The roof replacement was accomplished through the use of bond issue funds, and a grant has
been obtained through the Oklahoma Department of Commerce for the carpet replacement.
RECOMMENDATION:
Staff recommends that the City Council award the bid for the Community Center Carpet
Replacement Project to Mill Creek Carpet and Tile in the amount of $29,760.00.

PROJECT BACKGROUND:
Projects included for funding within the $10 million dollar bond issue approved by the citizens of
Owasso included street and intersection improvements, remodeling and expansion of existing
' facilities and improvements to the Owasso Sports Park. Included as a project was the overlay of
Main Street from Second Street to Ninth Street.
' After the Bond Issue was passed, the Transportation Equity Act for the 21' Century (TEA -21)
program was implemented. Included in the program are enhancement funds for improving the
transportation facilities. Staff researched the program and determined that a North Main Street
enhancement project, along with the New City Hall/Police Station Project, would anchor
revitalization to the downtown area.
' Staff worked with our consulting engineers on the conceptual design options. A Public Meeting was
held on November 1, 1999 to gain public input and to recommend a boulevard option. The
consensus of the public from that meeting was to leave the existing roadway a four -lane, repair the
deficient areas and overlay the road.
Staff instructed the consultants to begin the overlay project, but determined that an enhancement
could be included at a later date. Staff presented a two -stage project to the public on December 13,
1999. The first stage is to immediately repair the deficiencies and overlay Main Street. The second
stage is to apply for the TEA -21 funds and add bicycle lanes, lighting and enhancements on the
outside of the existing curb, if the funds become available (See Attachment A for typical section of
proposed improvements). The public was receptive to the this concept and encouraged staff to
proceed.
TEA -21 APPLICATION:
' The formal TEA -21 application is due at the Oklahoma Department of Transportation (ODOT)
offices on January 3, 2000. Council approval of the application is required. A draft version of the

Final Application is included as Attachment B. The Application will submitted after staff has made '
final revisions to the support text.
The cost estimate for the project, as derived by our consultants, is included as Attachment C. The
cost is divided so the maximum amount of TEA -21 Funds does not exceed the recommended amount
by the ODOT Enhancement Program staff. The estimated project cost and the responsibilities are
as follows:

City of Owasso Funded $227,727
Details of the City of Owasso funding portion will be determined after the project has been
approved. A portion of the Main Street Project funds and surplus funds from the initial street
rehabilitation projects are available for use. The available Main Street funds will be determined after
the overlay has been performed. The surplus funds from the street rehabilitation projects are
$58,770.46.
RECOMMENDATION:
Staff recommends approval of the TEA -21 application and authorization for the Mayor to execute
the document (Attachment D).
FUNDING:
Funding of the project will be solidified after TEA -21 announcements are made in July 2000.

PART III. - LOCATION OF PROJECT
DESCRIBE LOCATION OF PROJECT:

The North Main Street Enhancement Project is located in Section 30, T21N, R14E, Tulsa County
Oklahoma. The section of Main Street included in this project is between 76"' Street North and
86`' Street North (See location map on the following page). The extents of this project is from 2nd
Street to 11'h Street, since Main Street from 76"' Street North is wide enough to include a bicycle
lane without major improvements and Main Street from 11th Street to 86"' Street is being widened
as part of a separate project.
The project shall consist of adding a new bicycle lane in each direction, landscaping and
decorative lighting. The City of Owasso will also, elevate.the crown of the existing road to

facilitate drainage for the bicycle lands: The City of Owasso plans to make few repairs to Main
Street before the overlay as part of a separate project. The overlay will occur in the Spring of
2000 because, whether the TEA -21 funds are approved or not, the matching funds will be used
on Main Street enhancements.

PART IV- PROJECT DESCRIPTION
Purpose, type (bike paths, restoration, rehabilitation, landscaping), size, length, other

Project Purpose:
The purpose of this project is to enhance the residential section Main Street in Owasso Oklahoma
between 2 "d Street and l Vh Streets. The project shall consist of constructing new four feet (4')
wide bicycle lanes in each direction, new decorative street lighting and landscaping on the
outside of the curb and gutter. (See Conceptual Section in Appendix A)
The project will be 4300 feet long. The existing four;dnv�g lanes are ten feet (10') wide and
will remain the same width for traffic calming purposes. No additional right -of -way will be
needed for the project. (See Appendix B for the plan view sheets for the project and Appendix C
for the aerial views of the project)
Street lighting will be provided by either Public Service Company of Oklahoma (PSO) or
Oklahoma Natural Gas (ONG). The City of Owasso will work with these two entities on an
arrangement, but for the purpose of this application, we will assume the responsibilities of
providing the lighting.
PART V - TRANSPORTATION RELATIONSHIP
Describe how the project is related to the State's transportation system in terms of

Transportation Relationship

Main Street was originally constructed as a U.S. Hwy. 75 in the 1920's and shared the '
designation with U.S. Hwy 169 later. The road was a dirt two -lane with borrow ditches for
drainage. In the 1960's, the road was widened to a concrete four -lane, with curb and gutter
installed on the south one -third of the project. Borrow ditches were left one the northern two -
thirds because this area was primarily residential and parking was in the front of the residences.
U.S. Hwy. 75 is now located 4.5 miles west of Main Street. Curb and utter was added to the
northern section in the 1970's.

Today, Main Street acts as a collector road for the residents in the older part of Owasso from
their homes to two major arterials in Owasso. East 86`' Street North, the north terminus of Main
Street, is the primary arterial in Owasso. It links U.S. Hwy. 75 to U.S. Hwy. 169. It also
accommodates traffic flow to the Owasso High School Complex on the east side of town.
Enhancement Categories
The Main Street project meets two of the Enhancement categories. They are:
• Facilities for pedestrians and bicycles and
• Landscaping and other scenic beautification.

Facilities for pedestrians and bicycles - Main Street will be reconstructed with a 4 -feet wide
bicycle lane in each direction. Main Street was listed as an alternate route for a proposed trail
system in Owasso. The preferred route for the trail in this area is along the existing SK &O
Railroad right -of -way. The SK &O Railroad runs northwest through Owasso between 76"' Street
North and 86" Street North, but right -of -way negotiation have not been successful with the
railroad. The City of Owasso has updated the Comprehensive Plan and included Main Street on
the route for the trail system through Owasso.
Sidewalks will be reconstructed in the areas where the existing sidewalks are damaged or
missing. Handicap ramps will be installed at each intersection for pedestrians traffic. Crosswalks
perpendicular to Main Street will be constructed with molded concrete to give a brick paving
Iappearance.
Landscaping and other scenic beautification =Main Street will reconstructed with decorative
street lighting along the backside of the new /existing sidewalks. The exact style of lighting has
not been chosen at this time, but a Colonial Style has been recommended by our Planning
Department.
Landscaping will be provided around the lighting mentioned above. Low growth shrubs and trees
are proposed because of the extensive overhead utilities in this area. As part of our Downtown
Redevelopment Plan is to negotiate with the utility companies and have all overhead utilities in
this area relocated to underground.

The number of people that will directly benefit from the project everyday is 2600. This figure is
calculated by counting the number of residences and apartments in the old part of town between
76"' Street North and 86''' Street North, west of the Carlsbad and east of U.S. Highway 169 (935) r'
and multiplying the average number of Owasso residents per household (2.78).
The direct beneficiaries not living in this area is hard to calculate, but each person that drives '
their children to one of the three schools in the area, visit the public library, shop the commercial
district, attend church, visit physicians office, etc could total as much as 13,000.

prod ect;
The Owasso 7"' Grade Center, football and soccer practice facilities are located at the north
end of the project.
• The project will encourage bicycle traffic in the area
• The project, along with the New City Hall/Police Station Project and the Library Expansion
will provide an anchor for the downtown redevelopment effort.
• The project will allow for the two annual parades to be held on Main Street again. They have
been moved because of the condition of the roadway.
Regional Benefits:
• This project will allow the Tulsa Master Trails Project have a link between 76"' Street North
and 86' Street North if the SK &O Railroad easement is not feasible.

Economic Development/Tourism : This project will boost the economic development and
tourism in Owasso because it is one of four investments the City has provided as an anchor for
downtown redevelopment. The others are: Constructing a New City Hall/Police Station on Main
Street, Widening the 86`'' Street North/ North Main Street intersection and the implementation of
an Urban Design Study in the down town area. Once the area has been improved, increases in
sales tax revenue and tourism is expected.

the narrow lane widths will calm them. '

WHAT WILL NEED TO BE MAINTAINED IN THE SHORT AND LONG TERM?
Short Term Maintenance will be to adequately water and fertilizer to the landscaping until all
plantings are established.
Long Term Maintenance will be to keep the plantings watered and fertilized on a regular basis,
mowing the public right -of -way, providing repairs to the roadway, sidewalk and bicycle lanes
when needed, cleaning of storm sewer grates and inlets and providing striping on lanes

Owasso Parks Department to keep the right -of -way mowed and the landscaping watered.
' Park Department has a watering truck that is used to water the plantings from the ISTEA
Iprogram and the U.S. Forestry Department plantings.
• Lighting — City of Owasso Public Works will maintain the street lighting. Two (2)
technicians are currently maintaining all traffic signals, building lighting and other
miscellaneous electrical maintenance.
• City of Owasso Streets Division will maintain the sidewalks, roadway and bicycle lanes after
construction. The full time crews work daily to keep the streets maintained in Owasso.

OKLAHOMA NATURAL GAS COMPANY AND THE CITY OF
OWASSO - 1998 BOND PROJECTS

IBACKGROUND:
In October of 1997, the citizens of Owasso approved a 10 million - dollar bond issue for Capital
Improvement Projects within the City of Owasso. The projects included for funding within that
bond issue included street and intersection improvements, remodeling and expansion of existing
' facilities and improvements to the Owasso Sports Park. Included as a phase of the intersection
improvements was the reconstruction and signalization of several intersections, as well as the
rehabilitation of a major arterial roadway. These projects are listed below:
' 0 Widening and Signalizing of East 76` Street North/ North 1 29 `h
East Avenue,
• Widening and Reconstruction of East 116" Street North/ North Garnett Road,
0 Signalizing of East 86' Street North/ North 123rd East Avenue,
0 Rehabilitation of 860' Street North between Mingo and Main Streets
The intersection at 76" Street North and North 129" East Avenue will be expanded to one through
lane and a left turn lane in each direction. A right -turn lane will accommodate southbound traffic
turning west. Signalization will be included at this intersection.
The widening of the lanes of traffic required additional right-of-way on the northwest, northeast
' and southeast corners of the intersection. It also requires the relocation of several hundred feet of
Oklahoma Natural Gas (ONG) lines, which are in private easement.
' City staff received the original agreement from ONG in October and the City's cost to relocate the
gas lines for this intersection was estimated at $175,105.00. City staff and CH2MH111, the Bond
Project engineers, met with ONG after the preliminary submittal in an attempt to reduce the
' relocation costs. We were successful in reducing the cost to an estimated $116,321.00.
ONG submitted the revised agreement two weeks ago. Mr. Cates reviewed it and the changes
' forwarded to ONG for revisions. The revised agreement is included with this memorandum. Since
the costs above are estimates and contingent bidding by ONG, a maximum cost to the City was
set in the agreement at $175,000.00

Oklahoma Natural Gas Company, a Division of ONEOK, Inc., hereinafter called "Company,"
owns 4 -inch and 2 -inch medium- pressure distribution natural gas pipelines, within the
construction limits of the referenced project in the City of Owasso, Tulsa County,
Oklahoma, which Company utilizes in the discharge of its duties as a public service
corporation.
City of Owasso, Oklahoma, a municipal corporation, hereinafter called "City," has
requested Company to relocate these facilities to accommodate the proposed construction
of the referenced project as shown on plans therefor and received by Company on June 14,
1999. City agrees to reimburse Company in the extent and manner hereinafter stated for
that portion of the cost of relocating said facilities which is for the benefit of City.
Company proposes to perform the necessary relocation of its facilities in substantial
accordance with the four plan sheets and the two -page cost estimate, both dated July
23, 1999, of which four copies each are attached. Company will bear the cost of
relocating the portions of the facilities which do not occupy private rights -of -way.
The City's share of the estimated cost of the necessary relocation will be $116,321 all
of which is to be reimbursed to Company by City.
City by accepting the proposal agrees that City shall reimburse Company for its share
of the total actual relocation costs, said costs being arrived at in the same manner as
used in Company's estimated cost of the project attached hereto.

Such relocation costs will be based upon, but not necessarily limited to, material
suppliers', work contractors', and equipment- rental invoices; and at then - current rates
and prices, company's transfer and stores expense charges for warehoused materials;
payroll time sheets; indirect labor charges; auto, truck, and equipment use records;
expense statements; and standard allocated overhead charges. Company's award of and
payment for contracted work will be based upon competitive bids or continuing contract,
whichever appears to the Company will be most practical and economical.
It is further understood, and City by accepting this proposal agrees, that City will
reimburse the Company in accordance with this agreement within thirty (30) days after
the said relocation work has been completed and Company's statement for City's costs
thereof has been submitted. Company agrees that the total amount chargeable to City
shall not exceed $175,000.
The Company by agreeing to or by abandoning, relocating, or modifying any of its
facilities pursuant to this agreement shall not thereby be deemed to have abandoned,
modified, released, or otherwise destroyed any of its rights existing at the time of the
execution of this agreement under valid and subsisting private right -of -way easements
granted to, obtained by or through condemnation, or otherwise vested in the Company
unless the Company shall have released same by written instrument.
Further, should the Company in the course of relocating the above- described facilities
relocate any of such facilities presently located on private right -of -way onto public
right -of -way, the Company shall be deemed in respect to such facilities to have retained
sufficient easement and other rights such that if said facilities are encompassed within
any future governmental project requiring relocation, adjustment, or abandonment of such
facilities, that the Company shall be entitled to reimbursement for the cost of such
relocation, adjustment, or abandonment from the governmental agency requiring the same;
provided, however, this provision shall not be construed as requiring reimbursement by
the City of Owasso except when such relocation, adjustment, or abandonment is required
for a project of the City of Owasso.
Any changes made by the City in this proposal as submitted by the Company shall be
subject to the written acceptance thereof by the Company before there is any binding
contract between the parties.
City by accepting this proposal warrants that it now has or will have unencumbered funds
available with which to pay the relocation costs to the extent herein above provided.
If this proposal is not accepted by the City within one (1) year from the date of this
letter, this proposal shall automatically terminate and thereafter shall not be subject
to acceptance by the City unless the proposal is reinstated by Company.

' REGULATING THE SALE OF AUTOMOBILES

' BACKGROUND:
In recent months, staff and Council have received numerous citizen complaints regarding the sale
of automobiles on vacant or unused portions of parking lots throughout the City of Owasso.
What has been occurring is when there are large portions of a parking lot that are not being used,
or when a business has closed, people trying to sell automobiles park them in the parking lots.
This is desirable for the seller as they achieve excellent visibility along major arterial streets and
the lots are generally well illuminated and secure. The most noticeable area where this practice
' had been occurring was in the former Warehouse Foods/Food Lion parking lot.
' The problems that have arisen are three -fold. First, city staff has received complaints from
licensed used automobile dealers in Owasso regarding the makeshift "automalls ". Secondly, the
visual impact to surrounding businesses is often times undesirable. And finally, under current
' city regulations, the city cannot prohibit the sale of the automobiles unless the property owner
posts the property. When a business closes and the property is being listed by the commercial
real estate company, getting them to post the property is difficult at best.

Ordinance No. 626 would prohibit the sale of automobiles on open lots unless the necessary state
license is obtained and the zoning for the sale of the automobiles is appropriate. It would allow
for the Police Department and Code Enforcement Officer to tow the vehicles after a sufficient
notice, warning, citation, or warrant has been issued by the City of Owasso for the vehicle
involved. Ordinance No. 626 does not affect an individual's right to sell their automobile at their
own personal residence, involving a vehicle licensed in their own name as owner.
Ordinance No. 626 was derived from a similar ordinance from the City of Broken Arrow and has
been reviewed by Mr. Cates. Due to the current absence of code provisions relating to this
matter, staff has also attached an emergency clause to Ordinance No. 626, which will have to be
acted on separately by the Council.
RECOMMENDATION:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT, TO -WIT:
Section One: Part 9, Licensing and Business Regulations of the Code of Ordinances of
the City of Owasso, Oklahoma, is hereby amended by renumbering Chapter 4 - Penalty, as
Chapter 5 and providing as Chapter 4 of said part the following, to -wit:
Section 9 -401 Used Motor Vehicle Dealers and Automotive Dismantlers and Parts
Recyclers.
a) It shall be unlawful for any person, firm, association, corporation or trust to sell,
offer for sale, or display for sale one (1) or more used motor vehicles within the city without first
obtaining a license therefor from the appropriate state authorities as set forth in 47 O.S., Section
581, et seq., or amendments thereto. It shall be unlawful for any owner of real property, lessee of
real property, or person having an interest in real property to allow the sale, or display for sale, of
one (1) or more used motor vehicles within the city unless said property is zoned for such use.
Provided that this section shall not apply to any person making such use of their own personal
residence, and involving a vehicle licensed in their own name as owner.
(b) It shall be unlawful for any person, firm, association, corporation or trust to fail to
show a valid state license under Title 47, upon the request of any properly identified officer or
employee of the city.
(c) It shall be unlawful for any person. firm, association, corporation or trust to violate any
of the provisions of the Automotive Dismantlers and Parts Recycler Act, also known as 47 O.S.,
Section 591,1 et seq., within the city limits of Owasso. Oklahoma.
(d) Each day during which any of the above business operations are conducted in violation
of this section shall be considered a separate offense; each successfully consummated transaction
during which the provisions of this section are violated shall constitute a separate offense.
(e) Members of the police department or code enforcement officers are hereby
authorized to remove a vehicle from any property to a garage or other place of safety when such
vehicle has been parked on more than one occasion for the principle purpose or displaying such
vehicle for sale in violation of this chapter or the Owasso Code or the Owasso Zoning Code. City
personnel shall be required to show that an official notice, warning, citation, or warrant has been
issued by the City of Owasso for the vehicle involved prior to the incident for which the vehicle is
to be towed.
(f) The prohibition contained in subsection (a) shall not apply to mortgagees or secured
parties who are selling motor vehicles which were collateral on a mortgage or security agreement
if: (1) such mortgages or secured parties do not realize for their own account from such sales any
monies in excess or the outstanding balance secured by such mortgage or security agreement, plus
costs of collection; and (2) the sale is conducted as a lawful secondary use on such mortgagees'
or secured parties' primary business property.

This article shall apply pp y to and govern licenses required by this Code or other ordinances of
the city; provided, however, if any or this

provision article conflicts with a provision of this Code
or other ordinance or the city relating to a license for a specific business, profession, occupation,
trade, privilege or other activity, such latter provision shall govern and control.
Section Two: That due to the absence of code provisions pertaining to Used Motor

emergency is hereby declared to exist whereby the provisions hereof shall become effective

The City of Owasso was notified on November 18, 1999 that TCI Cable Vision of Tulsa, Inc has

cable television permit for the City of Owasso and the subsequent change of ownership of the
new permit holder.
' TCI is an indirect subsidiary of AT &T and initially here will be an internal reorganization

among AT &T's subsidiaries whereby, through one or more internal transactions, Tulsa Cable
' will be merged into Communications Central II, Inc., which will be a direct wholly -owned
subsidiary of AT &T when the AT &T internal reorganization is complete. Second, Cox Telport
Partners, Inc. will acquire 100% of the stock of the new permit holder, Communications Central
' II, Inc, through Cox's acquisition of the stock of the new permit holder.
' While the City of Owasso's consent for the acquisition by Cox of the ownership of
Communications Central II, Inc., is not necessary, Tulsa Cable Television is requesting the
consent of the City of Owasso because the consent is required for the AT &T internal
reorganization. A letter outlining the above transaction from Mr. Rick Comfort of Tulsa Cable
Television is attached for your information and review. A copy of FCC Form 394, which
contains information necessary to establish the technical, legal and financial qualifications of
Cox Teleport partners, Inc., will be available Tuesday evening for your review.
A copy of Resolution 99 -09 is attached for your information and review. Mr. Cates has reviewed
this item for both the City of Owasso and the City of Sand Springs and has no concerns with
Council adoption of Resolution 99 -09. There will be no change in existing cable rates as a result
of the passage of this resolution.

This letter is to officially notify you of certain transactions involving your local cable
television operator, Tulsa Cable Television, Inc. (`Tulsa Cable'), an indirect subsidiary of AT &T
Corp. Cox Teleport Partners, Inc. C'Cox'� and certain affiliates of Tulsa Cable have entered into
an agreement (the "Reorganization Agreement', which will result in the transfer of the permit
for your community and a subsequent change of ownership of the new permit holder. The
Reorganization Agreement provides for two separate transactions. First, there will be an
internal reorganization among AT &T's subsidiaries whereby, through one or more internal
transactions, Tulsa Cable will be merged with and into Communications Central II, Inc., which
will be a direct wholly -owned subsidiary of AT &T when the AT &T internal reorganization is
complete. Second, following the AT &T internal reorganization, Cox will acquire 100% of the

We respectfully request your consent to the AT &T internal reorganization pursuant to
the permit. While your consent is not required to the subsequent acquisition by Cox of the
ownership of Communications Central II, Inc., we are asking for such consent as a matter of
courtesy given that consent is required for the AT &T internal reorganization. Accompanying
this letter are one original and two copies of FCC Form 394 relating to the AT &T internal
reorganization, as well as an original and two copies of FCC Form 394 relating to Cox's parent,
Cox Communications, Inc., which contains the information necessary to establish the technical,
legal and financial qualifications of Cox.
Cox Communications, Inc. is the 4th largest multiple system cable operator with
approximately five million subscribers. Cox Communications, Inc. is a full - service provider of
telecommunications products and offers an array of video and telecommunications services to
its customers. Cox Communications, Inc. already owns multiple systems throughout Oklahoma,
which should enhance its relationship with community leaders, governmental officials, and
franchising authorities. We believe AT &T's system will fit well into Cox Communications, Inc.'s
concentrated cluster in Oklahoma and will provide it with the ability to provide better service to
your community.

RESOLUTION NO. 99-09
A RESOLUTION OF THE CITY OF OWASSO, OKLAHOMA APPROVING
THE MERGER OF THE PERMIT HOLDER AND SUBSEQUENT CHANGE
IN OWNERSHIP OF THE PERMIT HOLDER.
WHEREAS, Tulsa Cable Television, Inc. ( "Permit Holder ") owns, operates, and maintains
a cable television system (the "System ") in City of Owasso, Oklahoma (the "City"), and is the duly
authorized holder of a permit, license or other authorization (as amended to date, the "Permit "); and
WHEREAS, Cox Teleport Partners, Inc. ( "Cox ") and certain affiliates of Permit Holder have
entered into an Agreement and Plan of Reorganization dated as of July 6, 1999 (the "Reorganization
Agreement "), pursuant to which the following transactions will occur (collectively, the
"Transactions "): (1) There will be an internal reorganization among AT &T Corp.'s ( "AT &T ")
subsidiaries whereby, through one or more internal transactions, the Permit Holder will be merged
with and into Communications Central II, Inc. ( "New Permit Holder "), which will be a direct
wholly -owned subsidiary of AT &T Corp. when the AT &T internal reorganization is complete and
(2) following the AT &T internal reorganization, Cox will acquire 100% of the stock of the New
Permit Holder; and
WHEREAS, Permit Holder and Cox have requested consent by the City to the Transactions
in accordance with the requirements of the Permit and have filed an FCC Form 394 with the City.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA AS FOLLOWS:
SECTION 1. The City hereby consents to the Transactions, all in accordance with the terms
of the Permit.
SECTION 2. The City confirms that (a) the Permit was properly granted or transferred to
Permit Holder, (b) the Permit represents the entire understanding of the parties and Permit Holder
has no obligations to the City other than those specifically stated in the Permit, and (c) Permit Holder
is materially in compliance with the provisions of the Permit and there exists no fact or circumstance
known to the City which constitutes or which, with the passage of time or the giving of notice or
both, would constitute a material default or breach under the.Permit or would allow the City to
cancel or terminate the rights thereunder, except upon the expiration of the full term of the Permit.
SECTION 3. Following the Transactions, the pen-nit holder may transfer the System and /or
the Permit, or control related thereto, to any entity controlling, controlled by, or under common
control with Cox.
SECTION 4. The City hereby consents to and approves the assignment, mortgage, pledge,
or other encumbrance, if any, of the Permit, the System, or assets relating thereto, as collateral for
a loan.
SECTION 5. This Resolution shall be deemed effective for purposes of the Transactions
upon the consummation of the transactions contemplated by the Reorganization Agreement (the
"Closing "). Effective as of the Closing, the City releases Permit Holder and its affiliates from all
obligations and liabilities with respect to the Permit that relate to the period from and after the
Closing; provided, that New Permit Holder shall be responsible for all such obligations and liabilities
that relate to the period from and after the Closing.
SECTION 6. This Resolution shall have the force of a continuing agreement with Permit
Holder and Cox, and the City shall not amend or otherwise alter this Resolution without the consent
of Permit Holder and Cox.

BACKGROUND
On Wednesday, November 3, 1999, the City of Owasso received an offer to dedicate a
substantial amount of right -of -way for use by the public. The subject property is located on the
south side of E 106'h Street N between Mingo Road (N 97`h E Avenue) and Garnett Road, the
' west side of Garnett road from the intersection with E 106" Street N extending approximately
one half mile to the south, and the east side of Mingo Road from the intersection with E 106`h
Street N extending approximately on quarter mile to the south.
' The right -of -way dedication is generally located on the north, northeast, and northwest sides of
the Lakes PUD. The dedication would generally result in 50 feet of right -of -way (from the
centerline of the abutting streets) along existing roadways, which would be consistent with our
thoroughfare plan requirements. Additional portions to be dedicated include: 1) a small
triangular strip located on the southeast corner of E 106'h Street N and Mingo Road that is
comprised mainly of SKO Railroad right -of -way, and 2) an additional 8 feet of right -of -way on
the southwest side and near the intersection of N 106`h E Avenue and Garnett Road. The Owasso
Planning Commission unanimously recommended approval of the right -of -way dedication at
their November 9, 1999 regular meeting.
RECOMMENDATION
' Staff recommends acceptance of the right -of -way dedication.

The Oklahoma Baptist Retirement Center is requesting a zoning change for 15.84 acres, more or
less from RS -1 (Residential Single - Family Low - Density) to RD (Residential Duplex). The
proposed rezoning will serve as a portion of the underlying zoning for OPUD -17, also contained
within this agenda. The subject property is generally located on the west side of N 1290'E Avenue,
south of E 76h Street N. The subject tract is currently undeveloped.
' The proposed rezoning would allow a substantial expansion of the Oklahoma Baptist Retirement
Center. The 1985 Comprehensive Plan Update calls for Public Facilities on this site. The proposal
for RD (Residential Duplex) zoning will allow an expansion of the retirement facility and is
' consistent with the plan. The complete staff report for this rezoning is attached for your
information and review.
' Notices were sent to surrounding property owners within 300 feet of the subject property and legal
advertisements were published. Additionally, a public notice of the proposed rezoning was posted
on the subject property. The Owasso Planning Commission unanimously approved the rezoning at
their December 14, 1999 regular meeting. There was extensive discussion of storm drainage on the
site. The Planning Commission attached a condition to the accompanying PUD to address these
concerns.
RECOMMENDATION
Staff recommends approval of the proposed rezoning.

SURROUNDING LAND USE: Other facilities in the Oklahoma Baptist Retirement Center are
located to the north of the subject property. To the south of the subject property is,additional
undeveloped land, some of which is located within the 100 -year floodplain. To the east of the
subject property across N 129" E Avenue are approximately four single - family homes. To the
west are approximately two single - family homes on large tracts.

' ANALYSIS
Because this case is related to OPUD -17, staff will request that both zoning items be discussed at
the same time. Each item is a separate zoning issue, however, and each will require a separate vote.
Because of the potential to abandon all or a portion of a PUD, the Planning Commission should be
' comfortable with the underlying zoning that is proposed for this site as well as the PUD.
The proposed rezoning would allow a substantial expansion of the Oklahoma Baptist Retirement
Center. The 1985 Comprehensive Plan Update calls for Public Facilities on this site. The proposal
for RD (Residential Duplex) zoning will allow an expansion of the retirement facility and is
consistent with the plan.
Notices were sent to su rrounding property owners within 300 feet of the subject property and legal
advertisements were published. Additionally, a public notice of the proposed rezoning was posted
on the subject property. As of this date, staff has received no calls or letters regarding the rezoning
or PUD.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: D.M. Sokolosky is the owner and applicant for
Tract A of the rezoning request, David Vines is the owner and applicant for Tract B of the rezoning
request.
REQUESTED ACTION AND PURPOSE: A request for review of a zoning change on two
adjacent tracts: 1) Tract A proposes a change from AG (Agriculture) District to RS -3 (Residential
Single - Family High - Density) District, and 2) Tract B proposes a change from AG (Agriculture)
District to CG (General Commercial) District.
LOCATION AND SIZE: The subject properties are described as part of the SW /4 of Section 7, T-
21-N, R -14 -E. There are two tracts, each containing approximately 15.4 acres. Tract A is located
on the east side of N 97"' E Avenue (Mingo Road) approximately 1/3 mile north of E 106''' Street N,
and Tract B is located on the northeast corner of N 97" E Avenue (Mingo Road) and E 106'h Street
N.
EXISTING LAND USE: The subject properties are currently undeveloped.
SURROUNDING LAND USE: N 97"' E Avenue (Mingo Road) borders the subject property on
the west. Across the street there are approximately six residences on large lots. To the east is the
SKO Railroad and beyond that is additional undeveloped land. To the south is undeveloped land
located in the Lakes PUD and planned for commercial use. To the north is additional undeveloped
land that had formerly been used for open pit mining.
APPLICABLE REGULATIONS: The Zoning Code of the City of Owasso, Chapter 15
"Amendments ", Chapter 4 "Residential District Provisions" and Chapter 6 "Commercial District
Provisions."

Because these tracts are adjacent and similar, staff recommended review of the rezoning as a
single case. Though the two tracts are being presented in the same case, the recommendations for

each tract can be different. Approval or denial of one tract does not have to result in the same
ruling for the second tract. If need be, the Planning Commission can offer separate motions.
' The a pp licants have requested the rezoning of recently annexed land. These two tracts are both
approximately 15.4 acres in size and are located on the east side of N 97"' East Avenue, north of E
' 106'h Street N.
' On the northernmost tract (Tract A), D.M. Sokolosky proposes a rezoning from AG (Agriculture)
District to RS -3 (Residential Single - Family High - Density). The 1985 Comprehensive Plan Update
indicates agriculture for this area, however, there are several changes in this area that would render
' this recommendation obsolete. First, the availability of sewer to the west of the site has made
higher density development of the area feasible. Second, the gravel mining operation to the north
of the subject property has ceased which has substantially changed the environment for other forms
' of development. Hillside estates and other higher density housing developments have been located
nearby, further changing the potential of the area. Finally, the location of the Owasso Sports Park
to the northeast of the site, represents an amenity that would enhance the duality of life for persons
' living in the vicinity. Because of these factors, the 1985 comprehensive plan recommendation for
agriculture in this area may no longer be appropriate, and the Planning Commission may find that
higher density forms of development are more appropriate at this site.

On the southernmost tract (Tract B), David Vines proposes a rezoning of 15.4 acres from AG
District to CG (General Commercial) District. The 1985 Comprehensive Plan Update indicates a
desire for commercial land use at the intersection of N 97"' E Avenue and E 1060' Street N. This is
the typical recommendation for intersections throughout our planning area. Vines proposal for
commercial zoning is larger than is recommended in the 1985 Comprehensive Plan Update. As
with Tract A, there are factors that strongly support a larger area. First, the unusual narrow
configuration of the property, especially the narrow frontage on E 106" Street N, makes a small
rezoning on the corner somewhat impractical. In order for the stated goal of commercial property
here to be fulfilled, the tract would need to be larger in order to allow for a reasonable commercial
configuration and good access from Mingo Road, avoiding access from E 106" Street N. Second,
for the same reasons as Tract A, the availability of sewer in the area has increased the development

potential and therefore increased development intensity is warranted at this location. To the
southeast of the site, the Lakes PUD contemplates some commercial and multi - family development
near the intersection. To the southwest, plans are being drawn up for a new subdivision that will
feature a commercial tract at the intersection. Further to the west on E 106 " Street N, there are
plans for even more single- family housing at higher densities.
There are five houses across Mingo Road to the west of this location, and a sixth home under
construction. Surrounding development will have a significant impact regardless of the activity
across the street. The introduction of the North Owasso Sewer Interceptor has increased the value
of the surrounding properties as well as the land that these homes occupy. The 1985
Comprehensive Plan Update calls for commercial and multifamily residential near the intersection
with residential housing to the north. Even though some of these homes are not consistent with the
long range plan, they were there first and certainly deserve some consideration. Mr. Vines has
voluntarily submitted a sketch plan showing his development intentions for the site, which is
included within this packet. Note that Mr. Vines does not intend to have commercial frontage on
Mingo Road. Further, there are only two points of access and he proposes a decorative fence that
would be consistent with Mr. Sokolosky's residential fence to the north, if approved. The proposed
development offers a sensitive screening for the existing housing to the west.
Notices were sent to surrounding property owners within 300 feet of the subject property and legal
advertisements were published. Additionally, a public notice of the proposed rezoning was posted
on the subject property. As of this date, staff has received one call from a concerned neighbor. She
has indicated that she does not want industrial uses on the tract, and that ideally she would prefer to
see housing at on Tract B. Staff explained that only commercial uses would be permitted by right
and that Warehousing and Light Manufacturing at this location could only be permitted by Special
Exception of the Board of Adjustment, which would require notification in the newspaper as well
as by mail. Therefore, neighboring property owners would receive advance notice and an
opportunity to review and comment on any such proposal.
RECOMMENDATION
Staff recommends approval of the proposed rezoning.

OKLAHOMA BAPTIST RETIREMENT CENTER

BACKGROUND
The applicant, Oklahoma Baptist Retirement Center, proposes a Planned Unit Development (PUD)
on ± 32.33 acres, more or less on property generally located south of E 76" St. N on the west side
of N 1290' E Avenue. The applicant proposes up to 209 family units (154 Quadruplexes, 55
Duplexes) along with accessory commercial buildings, parks, and a community building. The
complete staff report for this rezoning is attached for your information and review.
Notices were sent to surrounding property owners within 300 feet of the subject property and legal
advertisements were published. Additionally, a public notice of the proposed rezoning was posted
on the subject property. The Owasso Planning Commission unanimously approved the rezoning at
their December 14, 1999 regular meeting. There was extensive discussion of storm drainage on the
site. The Planning Commission attached a condition to the PUD to address these concerns.
RECOMMENDATION
Staff recommends approval of the PUD subject to the following 12 conditions:
A. That the applicant's Development Text, and Outline Development be considered to be the
Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code;
B. That single - family attached dwelling shall be constructed to the standards specifically set out in
the test of this PUD,
C. That the proposed accessory commercial development conform to the PUD accessory
commercial requirements of the Owasso Zoning Code,
D. That within the PUD, the maximum number of dwellings shall not exceed 209,
E. That as this proposal already meets the maximum allowable development densities, only
decreases in development will be allowed as minor transfers (10% decrease in a development

area's density), and then only so long as there is no significant change in the character of the
development,
F. That a detailed drainage report be submitted at the time of platting, and certification of such

PUD standards and conditions of approval and make the City of Owasso beneficiary,
H. That no building permits be issued within any portion of the PUD until all criteria outlined
within Chapter 8 of the Owasso Subdivision Regulations are met by the developer,
I. That Acceleration/Deceleration lanes are required at the access point to the subject property
along the arterial street (N 129' E Ave.),
J. That the development will include sidewalks along the abutting arterial streets and the interior
drives within the proposed development,
K. The Planning Commission reserves the right to prescribe additional buffering and screening as
it deems necessary during the platting process. To the extent that the developer chooses to vary
from the outline PUD, the developer can and should expect additional buffering requirements as
is necessary to ensure compatibility with surrounding land uses.
L. That the applicant will meet with surrounding property owners to the south, west, and east of

BACKGROUND

Tulsa County, Oklahoma, generally located south of E 76"` St. N on the west side of N 129" E
' Avenue. The applicant proposes up to 209 family units (154 Quadruplexes, 55 Duplexes) along
with accessory commercial buildings, parks, and a community building.
The proposal for Bradford Park PUD is substantial, nearly doubling the size of the Retirement
Center and creating a new neighborhood that will be unique in our City. A goal of the development
is to fulfill a need for a independent senior housing, reflective of the needs of a growing number of
today's and tomorrow's Owasso resident.
At first glance, the rectangular geometry of the streets in the outline development plan stands out.
Typically, we would prefer curvilinear streets. In this case, the more efficient rectilinear geometry
will ensure that residents throughout the development will have easy walking access to the
accessory commercial buildings, park, and community center. The higher density (a maximum of
60% land coverage on lots) is reflective of the community it will serve. There will less demand for
private open space, which can often produce maintenance problems with older families.
Incidentally, the Owasso Fire Department has noted that the rectangular street layout should speed
emergency response time.
Chapter 8, Planned Unit Development, describes the purpose of the PUD. Generally, a PUD
permits flexibility within the development, while preserving open space, maintaining appropriate
limits on the character and intensity of land use, and assuring compatibility with the adjoining and
proximate properties.
The developer is given the flexibility to arrange land use freely within the PUD, irrespective of the
location of the underlying zoning districts. However, the aggregate land use must conform to the
underlying zoning. In this case, the underlying zoning on the subject property consists of 16.49
acres of RS -1 (Residential Single - Family Low - Density) and 15.84 acres of RD (Residential

Duplex). The maximum number of dwelling units allowed with the underlying zoning is 209,
which is exactly the same as the number of dwelling units proposed in the Bradford Park PUD.
Staff calculated that in order to meet livability space requirements, the developer will need to
provide a total of 45% open space. The developer proposes a minimum open space of 40% per lot,
and an additional 5% open space with parks, thus meeting the livability space requirement of 45 %.
Although no incompatibility problems have been noted with the surrounding properties, the
Planning Commission can act to prevent problems through the prescription of buffering, screening,
and setbacks during the platting process. At this time, staff sees no need for additional buffering or
screening.
Within the PUD, the developer has provided a set of Development Standards for each type
development proposed in the PUD. Minimum standards for Single - Family Attached Dwellings,
(whether in duplexes or quadroplexes) is given within the text of the PUD. The yards and setbacks
of buildings are fairly consistent with other development in Owasso and should not create any
particular problems. During the platting process, a review of the proposed Development Standards
will ensure that the developer adheres to these standards and is consistent with the Outline
Development Plan. Any deviation should be in conformance with the proposed development
standards, or the underlying zoning code.

The applicant will need to provide additional detail prior to platting this development. There were
no concerns voiced that would prevent approval of the PUD.
PUBLIC HEARING AND PLANNING COMMISSION ACTION
The Owasso Zoning Code, Section 880.5, requires the Planning Commission to determine the
following:
a) Whether the PUD is consistent with the Comprehensive Plan. The 1985 '
Comprehensive Plan calls for Public and Quasi - public land uses on this site. The
proposed retirement community fulfills this requirement.
Unfortunately, the Comprehensive Plan does not provide any direct guidance in the use
of the PUD. At that time our current comprehensive plan was drafted, the PUD was not
widely used and there is no specific mention of PUDs in our Comprehensive Plan.
The Planning Commission may look at overall the density recommended in the plan

c) Whether the PUD is consistent with the stated purposes and standards of the
Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned
Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes
PUD. The PUD would:

with the understanding that geographical constraints may prevent an exact duplication
of the recommendation of the comprehensive plan. With this in mind, the proposed

use and configuration are very consistent with the Comprehensive Plan.
b) Whether the PUD is in harmony with the existing and expected development of
'
surrounding areas. Surrounding land uses can be broken down into three effected
areas:
'
1) Areas near undeveloped land. Areas to the south of the subject property are
undeveloped. The nature of the proposed development will not create any
barriers to the future development of this land. Drainage is indicated on the
outline plan and the residential character of the proposed development should
allow a wide variety of compatible development on adjacent tracts.
2) Areas near existing single- family development. To the east across N 1290, E
Avenue, there are several existing single - family homes. The plan proposes only
one point of access onto N 129' E Avenue, which should limit the turning
conflicts with these homes. Many of these homes can expect an increase in
traffic, but the traffic volumes generated by this development alone should not
substantially affect the character of this road. Additionally, accel/decel lanes
'
will be required, which should improve access to the site. The single - family
homes to west are set back on very large tracts should be effected minimally, if
'
at all.
3) Areas within the Retirement Center. The existing retirement center features
'
a great deal of open space, as well as many other complementary facilities.
Were it not for the existing amenities available to potential residents, this
proposal would certainly not be as strong.
The strategic location of each land use should result in very few incompatibilities with
the surrounding land uses. Under the rules of the PUD, the developer has the ability to
'
reallocate each of these land uses within the development. If the developer chooses
this option, the Planning Commission may require additional buffering to ensure
compatibility in and around the development.
'
Whether the PUD is a unified treatment of the development possibilities of this
site. The proposed development is consistent throughout. It is a high - density
'
development designed to cater to families 55 or older. The facility features a
community center, accessory commercial, and parks that will be within easy walking
distance of all of the residents of the community.
c) Whether the PUD is consistent with the stated purposes and standards of the
Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned
Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes
PUD. The PUD would:

1) Permit innovative land development while maintaining appropriate limits on
the character and intensity of use and assure compatibility with adjoining and
proximate properties;
2) Permit flexibility within the development to best utilize the unique physical
features of the particular site;
3) Provide and preserve meaningful open space;
4) Achieve a continuity of function and design within the development.
The PUD also conforms to the standards set forth in Chapter 8. The developer has
submitted the appropriate application materials and has established a plan that should
conform to the requirements of the Owasso Zoning Code. Staff does not anticipate any
difficulties in the administration of the Bradford Park PUD as proposed.
RECOMMENDATION
Staff recommends approval of the PUD subject to the following conditions:
A. That the applicant's Development Text, and Outline Development be considered to be the
Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code;
B. That single - family attached dwelling shall be constructed to the standards specifically set out in
the test of this PUD,
C. That the proposed accessory commercial development conform to the PUD accessory
commercial requirements of the Owasso Zoning Code,
D. That within the PUD, the maximum number of dwellings shall not exceed 209,
E. That as this proposal already meets the maximum allowable development densities, only
decreases in development will be allowed as minor transfers (10% decrease in a development
area's density), and then only so long as their is no significant change in the character of the
development,
F. That a detailed drainage report be submitted at the time of platting, and certification of such
document by an engineer,
G. All covenants of any subdivision plat containing property within the PUD shall incorporate all
PUD standards and conditions of approval and make the City of Owasso beneficiary,
H. That no building permits be issued within any portion of the PUD until all criteria outlined
within Chapter 8 of the Owasso Subdivision Regulations are met by the developer,
I. That Acceleration/Deceleration lanes are required at the access point to the subject property
along the arterial street (N 129' E Ave.),

J. That the development will include sidewalks along the abutting arterial streets and the interior
drives within the proposed development,
K. The Planning Commission reserves the right to prescribe additional buffering and screening as
it deems necessary during the platting process. To the extent that the developer chooses to vary
from the outline PUD, the developer can and should expect additional buffering requirements as
is necessary to ensure compatibility with surrounding land uses.

In this year's budget, $1090 per month was included to cover the costs of cleaning services for
City Hall and for Public Works administration building. These services have been performed on
a month -by -month basis up to this time. Now that the move has been made to the new Public
Works facility, the City has solicited bids for these services.
Specifications were advertised in the Owasso Reporter and Tulsa World. The following four
companies responded:
Upky Janitorial Collinsville
Associated Maintenance Tulsa
Crossroads Cleaning Services Owasso
ABM Janitorial Services Tulsa (nationally headquartered)
As can be seen from the attached Bid Documentation sheet, ABM Janitorial Services submitted
the low bid of $1078 per month for cleaning both buildings. Staff has examined the ABM
submittal and believes that their scopes of service appears adequate to perform to the desired
specifications.
City Clerk Marcia Boutwell has prepared a contract, approved by City Attorney Ron Cates, as to
form and content. This contract will allow the option for renewal at the end of the fiscal year, if
approved by both parties.

including stairs.
d. Vacuum carpeted traffic areas, including entry mats, inside and outside.
Spot clean as necessary.
e. Clean glass in doors at all entryways.
f. Sanitize door handles.
2. Rest Rooms
a. Empty trash & damp wipe cans as needed.
b. Stock paper & hand soap as needed (supplies furnished by City of
Owasso).
C. Sanitize toilets & urinals, to include wiping of the toilet seats.
d. Sanitize basins, countertops, and stall handles. Polish bright work.
e. Clean & polish mirrors, towel dispensers, & partitions.
f. Wet mop floors with disinfecting solution.
B. Weekly Duties
1. All Named Areas
a. Dust vertical surfaces.
b. Vacuum all carpeting, getting into corners & under furnishings.
C. Damp mop all hard surface floors.
d. Buff hard surface floors to enable them to present best possible
appearance.
2. Rest Rooms
a. Use acid -based "clinging" cleaner on inside of urinals and toilet bowls.
C. Monthly Duties
1. All Named Areas
a. Dust high surfaces not previously mentioned, including HVAC vents and
ceiling fans.
b. Damp wipe fingerprints from doorframes & around light switches.
C. Vacuum or whisk upholstered furniture.
d. Dust mini blinds.
e. Re -coat high traffic areas of hard surface floors as needed.
D. City Hall Only
1. Check lower level conference room daily & clean if needed. Rinse dirty coffee
pot and wash any dirty cups.

1. Remain in contact with named contact person to insure all City of Owasso's needs
are addressed.
2. Defective or inoperable building features will be noted to the contact person.
3. Janitor closets and storage areas will be clean and organized with all stored

THIS CONTRACT made this 21St day of December, 1999, between the City of Owasso/ Owasso
Public Works Authority, Owasso, Oklahoma (CITY /AUTHORITY) and ABM Janitorial
Services (CONTRACTOR).
WITNESSETH:
That for and in consideration of the payments and agreements that are contained herein and
incorporated herein by reference, it is agreed by and between CITY /AUTHORITY and
CONTRACTOR as follows, to -wit:
SECTION ONE
RELATIONSHIP OF PARTIES
The parties intend that an independent contractor relationship be established by the Contract.
CONTRACTOR is not to be considered as an agent or employee of CITY /AUTHORITY for any
i purpose, nor is CONTRACTOR entitled to any of the benefits of CITY /AUTHORITY.
' SECTION TWO
DESCRIPTION OF WORK
' The CITY /AUTHORITY hereby contracts with CONTRACTOR to furnish janitorial services to
CITY /AUTHORITY as set forth in the attached Specifications.
' The CONTRACTOR covenants unto CITY /AUTHORITY that CONTRACTOR possesses
sufficient equipment and personnel capable to perform the services called for in the
Specifications. It is understood and agreed that CITY /AUTHORITY may spot -check all work
being performed by CONTRACTOR under the terms of this CONTRACT to assure the
completeness thereof for the benefit of CITY /AUTHORITY. It is further understood that
CITY /AUTHORITY may notify CONTRACTOR of any duties not being performed and require
that CONTRACTOR comply with the terms of this CONTRACT.
SECTION THREE
COMPENSATION
For the work performed under this CONTRACT, CITY /AUTHORITY shall pay
CONTRACTOR the sum of One Thousand Seventy -Eight and no /100 Dollars ($1078.00) per
month for services performed at Owasso City Hall, 207 S Cedar, and Owasso Public Works
' Building, 301 W Second Ave. It is specifically understood that such constitutes total
compensation hereunder and that no further compensation shall be provided unto
CONTRACTOR.

The effective date of this Contract shall be on the 3`d day of January, 2000, and continue until the
30`h day of June, 2000. This Contract may be extended for successive one -year terms for a
period of up to three years if agreed to by both parties in writing not less than sixty days prior to
the expiration of the initial term or of any successive one -year term. CITY /AUTHORITY may
for its convenience at any time terminate this Contract by serving written notice of such
termination upon CONTRACTOR, as well as providing compensation due for services rendered
through the date of termination.
SECTION FIVE
ENTIRE CONTRACT
This instrument, supplemented by the Contract Documents, contains the entire CONTRACT
between the parties, and no statement, promise or inducement made by either party, or the agent
of either party, that is not contained in this written CONTRACT shall be valid or binding. No
modification, variation, change, addition, deletion or alteration of the relationship of the parties
shall be effective unless reduced to writing and executed by both parties hereto.
SECTION SIX
CHOICE OF LAW
This CONTRACT shall be construed in accordance with the laws of the State of Oklahoma.

December 15, 1999
The City of Owasso and the Fraternal Order of Police Lodge #149 (FOP) began negotiations for an
agreement for FY 1999 -2000 in March. Negotiations continued through a declared impasse and
Federal Mediation and Conciliation Services (FMCS) mediation (on June 7). Negotiations continued
even though FMCS Binding Interest Arbitration was scheduled for December 10. As Arbitration
was scheduled to begin, the parties reached a tentative agreement on the three remaining articles not
already tentatively agreed upon.
As is required, the Lodge's membership ratified the agreement on December 14.
SIGNIFICANT AGREEMENT CHANGES FROM THE PREVIOUS AGREEMENT:
1. Time limits for grievances to be presented to the City Manager by the FOP have been
established where no time limits were established before.
2. 100% of sick leave accruals will be paid on the death of an officer.
3. The promotion process has been better defined.
4. The City will assume a 2% increase in retirement contributions with a corresponding 2%
decrease paid by the employee.
5. Uniform allowance for non - detectives has been increased from $350 to $400 per year.
6. Education incentives have been increased from $50 to $75 per month for employees with an
associate's degree and monthly incentives for employees with a Masters or higher degree are
established at $125 per month.
7. Continues the range and step pay -plan with an across - the -board increase of 5.05 %.

FINANCIAL DISCUSSION:
By continuing the range and step pay -plan with the across - the -board increase, the City paying an
additional 2% of employee retirement, increasing education incentives, and increasing uniform
allowances, the cost of the agreement is $92,856.82 greater than the cost of the agreement for the
previous fiscal year.
RECOMMENDATION:
Staff recommends the Council approve the collective bargaining agreement between the City of
Owasso, Oklahoma and Fraternal Order of Police Lodge 149 for FY 1999 -2000 and that the Mayor
be authorized to execute the same.

agreement addresses those concerns. This same agreement was approved by the OPWA. Dr
Bode moved, seconded by Ms Voss, to approve the agreement with Rural Water District No. 3,
Washington County, and authorize the Mayor to execute the agreement.

This memorandum addresses four requested actions. The first two are items 6 and 7 under the
Owasso Public Works Authority Agenda and requests OPWA approval of agreements with Rural
Water District No. 3, Rogers County and Rural Water District No. 3, Washington County. The
next two actions are items 18 and 19 under the City Council Agenda to approve the same
agreements.
' BACKGROUND:
' For the last few months, both the City Attorney and staff have had discussions with the attorney
and staff of both Rural Water District No. 3, Rogers County and Rural Water District No. 3,
Washington County. The purpose of these negotiations was to work out methods of business for
' both rural water districts and the City when, within the city limits, an area is serviced by a rural
water district. This is currently prevalent at the subdivisions of Bailey Ranch Estates II, Preston
Lakes, and the Owasso Market Center.
As was discussed at the last City Council Work Session by Mr. Cates, we have arrived at
agreements between the OPWA, City and both rural water districts. The proposed, attached
agreements note our cooperative purpose, the duration of the agreements, the method of holding
title and ownership of assets, and the income, liabilities, accounting, billing and collection of
charges procedures. It also notes development standards, termination of service, and area of
service.
City Attorney Ron Cates plans to be present at the meeting to present to you these agreements.

proposed agreements at paragraphs five and six of each. Insofar as inter - connection service is
concerned, I inserted the language "at District's expense" as it is my understanding that has been
the understanding among the parties.
I have discussed your client's request concerning the City establishing a flat rate that
q would cover all charges to be billed and collected by your client on the City's behalf with Ms.
Sherry Bishop, Finance Director of the City of Owasso, Oklahoma. Ms. Bishop advised me that
' establishing a fixed rate is a workable solution to your client's concerns and therefore would be
recommended to the City provided, however, the City would have the opportunity to periodically
review District's water service charges to its customers within the corporate limits of City, more
' importantly, the volumes of water being sold to determine whether or not an adjustment would
need to be made in the fixed rate. Understandably, such review of the water charges would occur
at reasonable times being agreed upon by the parties during the course of this relationship.
' I trust the foregoing meets with your needs at this time. After you have had an
opportunity to review such, please contact me to let me know if the proposed modifications are
' acceptable. As you are aware, I am taking the proposed agreements before the City Council of

AGREEMENT
BY AND BETWEEN
RURAL WATER DISTRICT NO. 3, ROGERS COUNTY
AND THE CITY OF OWASSO OKLAHOMA
AND OWASSO PUBLIC WORKS AUTHORITY
THIS AGREEMENT is made and entered into this day f

and between Rural Water District No. 3, Rogers County, Oklahoma, hereinafter referred to as
' "District" and the City of Owasso, Oklahoma, and the Owasso Public Works Authority,
hereinafter collectively referred to as "City".
WITNESSETH:
' Historical Recital
The District and the City are each engaged in the business of supplying utility services to
' patrons within each entity's respective territorial area. In an effort to provide the best service to
its patrons and without duplication of facilities, incurring unnecessary expense and overhead
costs, etc. the parties have agreed to share responsibility for the provision of certain utility service
' to areas within each of the respective territories.
The District is engaged in the business of supplying potable water to its patrons. The City
is engaged in the business of supplying sanitary sewer service, sanitation service as well as
ambulance and fire protection service to its patrons. The parties have determined it to be in their
mutual interest to each provide their respective service to their respective patrons and to mutually
' agree on issues relevant to the services to be performed.
The Agreement
The District and the City, in consideration of their mutual promises and other valuable
consideration, hereby agree as follows:
1. Cooperative Purpose: It is the intent of the parties to conduct their respective
operatives in a cooperative manner. The purpose of this agreement shall be to mutually cooperate
in the furnishing of utility services, fire protection and ambulance service to developing areas that
are within or contemplated to come within the respective territory of both parties with District to
provide exclusive water service and with City to provide sanitary sewer, sanitation, ambulance
and fire protection service.
2. Duration: This agreement shall become effective when it is approved by both District
and City governing bodies and shall remain in effect for a period of ten (10) years thereafter and
shall be automatically renewed for additional ten (10) year periods unless canceled by the majority
vote of one of the governing bodies of the parties hereto at least one hundred twenty (120) days 1
prior to any anniversary date.
I Method of Holding Title and Ownership of Assets: It is understood and agreed that '
District shall remain the owner of all easements, water transmission lines, pumps, fire hydrants,
appurtenances and equipment located within the District's water service territory and used in
providing water service to the area. City shall remain the owner of all easements, sewer lines,
pump and lift stations, appurtenances and equipment located within the District's water service
territory and used in providing sanitary sewer service to the area. City shall further inspect and
service all fire hydrants. Each party shall have authority to pledge or otherwise designate their
respective assets as security for any loan or encumbrance.
4. Income, Liabilities and Accountin : The revenue derived from the sale of water,
benefit units or other income of any nature from the operation of the water distribution system
within District's water service territory shall remain the sole property of District. District will
incur no debt or liability that will obligate the City and further will hold City harmless from any
claim or liability resulting from the operation of the water distribution system.
The revenue derived from the operation of the sanitary sewer system, sanitary sewer
assessments, sanitation service charges and ambulance subscription fees shall remain the sole
property of City. City will incur no debt or liability that will obligate the District and further will
hold District harmless from any claim or liability resulting from the operation of the sanitary sewer
system, sanitation service and ambulance service.
5. Billing and Collection of charges: District shall be responsible for the billing and
collection of its charges for water service to its patrons. District will be responsible for the billing
and collection of City's then applicable sanitary sewer charges, sanitary sewer assessments,
sanitation charges, ambulance subscription fees and any other future fees which City may lawfully
adopt. Such amounts collected shall be remitted to City by District on or before the day of
each month. The City shall pay unto District as and for its billing and collection charges an
amount equal to ( percent) of amounts collected and remitted by District to City.
The foregoing percentage payment may be renegotiated and adjusted by the parties -no more than
on an annual basis, such adjustment to be memorialized by written memorandum executed by the
parties and attached hereto.
Either party hereto may, upon ninety (90) days written notice to the other, with or without
cause, terminate the billing, collection and remittance arrangement as established by this
paragraph. If, and in the event, termination of such billing, collection and remittance arrangement
is effectuated by either party, then, in such event, both parties shall, in good faith, cooperate in
making the billing, collection and remittance arrangement transition giving full consideration to
the issues associated with administrative implementation as well as customer convenience
occasioned by such transition.

The District shall furnish water necessary for fire suppression purposes within District's
water service territory at no cost to the City. District's water used by City for the flushing and
testing of fire hydrants shall be paid for to District by City at the Districts then applicable rate
being charged other municipal fire services or rural fire protection districts located within
District's water service territory. City shall give twenty-four (24) hour prior notification to
District of the times and hydrants to be tested and will provide District City's best estimate of
water used by City in such flushing and testing.
6. Development Standards: District will agree to require all Developers to meet the
Oklahoma Department of Environmental Quality (DEQ) standards for installation of all water
distribution lines and systems including adequate fire flow protection. Should District be unable
to furnish adequate water flow for fire protection, City agrees to provide at District's expense,
inner - connection service sufficient for fire protection purposes if City's water distribution system
is adequate to provide water flow for fire- protection and the inner - connection service will not
detrimentally affect service to other parts of the City as determined by the City.
7. Termination of Service: As in accommodation to City, District agrees to disconnect
water service to any of its patrons that fail to pay City's applicable sanitary sewer charges, sanitary
sewer assessments, sanitation charges, ambulance subscription fees and any other future fees
which City may lawfully adopt, provided, however, that City will require its patrons to sign an
agreement for service that will include a provision whereby applicant will agree that District may
terminate his water service in the event of a default on payment to the City of any sanitary sewer
charges, sanitary sewer assessments, sanitation charges, ambulance subscription fees and any
other future fees which City may lawfully adopt, and further provided that City will notify District
in writing of any such default and request termination of water service and further provided that
City will hold District free and harmless from suits, claims and liabilities that may result to District
as a result of termination of water service and further City will reimburse District for any costs
and expenses that it may incur as a result of termination of water service.
8. Area of Service. This contract shall govern, control and include all lands that are
within the boundary of District and that are annexed by the City.
9. Indemnification: Each of the parties hereto shall indemnify and hold harmless the
other from any and all claims, suits and liabilities that either may incur as a result of the negligence
or breach of this agreement by the other party. Further, neither party may obligate the other party
to any debt or liability and neither shall be liable for the conduct of the other.

AGREEMENT ,
BY AND BETWEEN
RURAL WATER DISTRICT NO. 3, WASHINGTON COUNTY
AND THE CITY OF OWASSO OKLAHOMA '
AND OWASSO PUBLIC WORKS AUTHORITY
THIS AGREEMENT is made and entered into this day of December, 1999,by and
between Rural Water District No. 3, Washington County, Oklahoma, hereinafter referred to as
"District" and the City of Owasso, Oklahoma, and the Owasso Public Works Authority,
hereinafter collectively referred to as "City".
WITNESSETH:
Historical Recital
The District and the City are each engaged in the business of supplying utility services to
patrons within each entity's respective territorial area. In an effort to provide the best service to
its patrons and without duplication of facilities, incurring unnecessary expense and overhead
costs, etc. the parties have agreed to share responsibility for the provision of certain utility service
to areas within each of the respective territories.
The District is engaged in the business of supplying potable water to its patrons. The City
is engaged in the business of supplying sanitary sewer service, sanitation service as well as
ambulance and fire protection service to its patrons. The parties have determined it to be in their
mutual interest to each provide their respective service to their respective patrons and to mutually
agree on issues relevant to the services to be performed.
The Agreement
The District and the City, in consideration of their mutual promises and other valuable
consideration, hereby agree as follows:
1. Cooperative Purpose: It is the intent of the parties to conduct their respective
operatives in a cooperative manner. The purpose of this agreement shall be to mutually cooperate
in the furnishing of utility services, fire protection and ambulance service to developing areas that
are within or contemplated to come within the respective territory of both parties with District to
provide exclusive water service and with City to provide sanitary sewer, sanitation, ambulance
and fire protection service.
2. Duration: This agreement shall become effective when it is approved by both District
and City governing bodies and shall remain in effect for a period of ten (10) years thereafter and
shall be automatically renewed for additional ten (10) year periods unless canceled by the majority
ivote of one of the governing bodies of the parties hereto at least one hundred twenty (120) days
prior to any anniversary date.
3. Method of Holding Title and Ownership of Assets: It is understood and agreed that
District shall remain the owner of all easements, water transmission lines, pumps, fire hydrants,
appurtenances and equipment located within the District's water service territory and used in
providing water service to the area. City shall remain the owner of all easements, sewer lines,
pump and lift stations, appurtenances and equipment located within the District's water service
' territory and used in providing sanitary sewer service to the area. City shall further inspect and
service all fire hydrants. Each party shall have authority to pledge or otherwise designate their
respective assets as security for any loan or encumbrance.
4. Income Liabilities
and Accountin The revenue derived from the sale of water,
' benefit units or other income of any nature from the operation of the water distribution system
within District's water service territory shall remain the sole property of District. District will
incur no debt or liability that will obligate the City and further will hold City harmless from any
' claim or liability resulting from the operation of the water distribution system.
The revenue derived from the operation of the sanitary sewer system, sanitary sewer
' assessments, sanitation service charges and ambulance subscription fees shall remain the sole
property of City. City will incur no debt or liability that will obligate the District and further will
hold District harmless from any claim or liability resulting from the operation of the sanitary sewer
' system, sanitation service and ambulance service.
4 5. Billiniz and Collection of charges: District shall be responsible for the billing and
collection of its charges for water service to its patrons. District will be responsible for the billing
and collection of City's then applicable sanitary sewer charges, sanitary sewer assessments,
sanitation charges, ambulance subscription fees and any other future fees which City may lawfully
adopt. Such amounts collected shall be remitted to City by District on or before the day of
each month. The City shall pay unto District as and for its billing and collection charges an
amount equal to ( percent) of amounts collected and remitted by District to City.
' The foregoing percentage payment may be renegotiated and adjusted by the parties no more than
on an annual basis, such adjustment to be memorialized by written memorandum executed by the
parties and attached hereto. .
Either party hereto may, upon ninety (90) days written notice to the other, with or without
' cause, terminate the billing, collection and remittance arrangement as established by this
paragraph. If, and in the event, termination of such billing, collection and remittance arrangement
is effectuated by either party, then, in such event, both parties shall, in good faith, cooperate in
making the billing, collection and remittance arrangement transition giving full consideration to
' the issues associated with administrative implementation as well as customer convenience
occasioned by such transition.

The District shall furnish water necessary for fire suppression purposes within District's
water service territory at no cost to the City. District's water used by City for the flushing and
testing of fire hydrants shall be paid for to District by City at the Districts then applicable rate
being charged other municipal fire services or rural fire protection districts located within
District's water service territory. City shall give twenty -four (24) hour prior notification to
District of the times and hydrants to be tested and will provide District City's best estimate of
water used by City in such flushing and testing.
6. Development Standards: District will agree to require all Developers to meet the
Oklahoma Department of Environmental Quality (DEQ) standards for installation of all water
distribution lines and systems including adequate fire flow protection. Should District be unable
to furnish adequate water flow for fire protection, City agrees to provide at District's expense,
inner - connection service sufficient for fire protection purposes if City's water distribution system
is adequate to provide water flow for fire- protection and the inner - connection service will not
detrimentally affect service to other parts of the City as determined by the City.
7. Termination of Service: As in accommodation to City, District agrees to disconnect
water service to any of its patrons that fail to pay City's applicable sanitary sewer charges, sanitary
sewer assessments, sanitation charges, ambulance subscription fees and any other future fees
which City may lawfully adopt, provided, however, that City will require its patrons to sign an
agreement for service that will include a provision whereby applicant will agree that District may
terminate his water service in the event of a default on payment to the City of any sanitary sewer
charges, sanitary sewer assessments, sanitation charges, ambulance subscription fees and any
other future fees which City may lawfully adopt, and further provided that City will notify District
in writing of any such default and request termination of water service and further provided that
City will hold District free and harmless from suits, claims and liabilities that may result to District
as a result of termination of water service and further City will reimburse District for any costs
and expenses that it may incur as a result of termination of water service.
8. Area of Service. This contract shall govern, control and include all lands that are
within the boundary of District and that are annexed by the City.
.9. Indemnification: Each of the parties hereto shall indemnify and hold harmless the
other from any and all claims, suits and liabilities that either may incur as a result of the negligence
or breach of this agreement by the other party. Further, neither party may obligate the other party
to any debt or liability and neither shall be liable for the conduct of the other.
10. Amendment: This agreement may he amended from time by the mutual consent and
written agreement of both parties.
