Mr. Ray will introduce the Employee of the Month for April 2006.
7. Consideration and appropriate action relating to a request for Council approval of the
Consent Agenda. All matters listed under "Consent" are considered by the City Council to
be routine and will be enacted by one motion. Any Councilor may, however, remove an
item from the Consent Agenda by request. A motion to adopt the Consent Agenda is non -
debatable.

D. Approval of Ordinance No. 847, an ordinance approving rezoning request OZ 06-02, a
request to rezone approximately 3 acres, more or less, from AG Agricultural zoning to
CS Commercial zoning, located south of E. 96"' Street North, on the cast side of N.
1221'd East Avenue, immediately northeast of the Smith Farm Marketplace.

E. Acceptance of the Lake Valley I Sanitary Sewer System, a residential development
located northeast of the intersection of E. 106th Street North and N. 145th East Avenue
consisting of 562 L.F. of 12-inch PVC and 5,584 L.F. of 8-inch PVC sanitary sewer
line.
Attachment # 7-E
Staff will recommend Council acceptance of the Lake Valley I Sanitary Sewer System.
F. Acceptance of the Ojala Property Sanitary Sewer System, located southeast of the
intersection of E. 96th Street North and N. 136"' East Avenue consisting of 180 L.F. of
8-inch PVC sanitary sewer line.

Staff will recommend Council acceptance of the Ojala Property Sanitary Sewer System.
8. Consideration and appropriate action relating to a request for Council approval of a
contract between the City of Owasso and James and Bonnie Williams for an interest in real
property for the purpose of acquiring easements for the 106th Street Water Transmission
Line Project from Sheridan to Mingo, authorization for the Mayor to execute all necessary
documents relating to the purchase, and authorization for payment.

Tuesday, March 21, 2006
The Owasso City Council met in regular session on Tuesday, March 21, 2006 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 5:00 p.m. on Friday, March 17, 2006.
ITEM 1. CALL TO ORDER
The meeting was called to order at 6:32 p.m.

The invocation was offered by John David Meisner, Youth Minister, New Heights Church.

A. Approval of Minutes of the March 6, 2006 Special Meeting and the March 7,
2006 Regular Meeting.
B. Approval of Claims.
C. Acknowledgement of receiving the monthly FY 2005-2006 budget status
report.

D. Acceptance of the US Highway 169 Service Road (Owasso
Expressway/Tyann Development) Improvements consisting of 3,950 feet of
concrete including curb, storm drainage, signage, and stripping located south
of East 96th Street North and east of US Highway 169.
E. Acceptance of a donation from the Wal-Mart Foundation; approval of a
budget amendment to the FY 2005-2006 General Fund increasing revenues in
the amount of $3,000.00; and, a supplemental appropriation increasing
expenditures in the amount of $1,500.00 within the Police Department Budget
and in the amount of $1,500.00 within the Fire Department Budget.
Mr. Cataudella moved, seconded by Mr. Colgan, to approve the Consent Agenda with claims
totaling $251,764.04, self-insurance medical claims chi fees totaling $84,004.02, and payroll
claims totaling $338,218.93.

ITEM 6. PUBLIC HEARING A Public Hearing conducted for the purpose of receiving
citizen comments and input on the completed Community Development Block
Grant (CDBG) FY 2003 Sidewalk Improvement Project which involved the repair
and/or replacement of sidewalks in the original town target area; and, to receive
recommendations on future community development needs within the City to be
considered by the Owasso City Council in developing and approving a community
development project to be submitted to the Oklahoma Department of Commerce for
funding consideration under the FY 2006 Community Development Block Grant
Program.
Mr. Wiles presented the item. Mayor Thoendel then opened the Public Hearing, inviting any
citizen comments or input regarding the work that was performed under the grant or any
recommendations on future community development needs. No citizens chose to speak and the
meeting was closed.
ITEM 7. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL AUTHORIZATION OF THE COMMUNITY
DEVELOPMENT DEPARTMENT TO COMPLETE ALL CLOSEOUT
DOCUMENTS RELATED TO THE SIDEWALK IMPROVEMENT PROJECT
UNDER THE CDBG 03, SMALL CITIES GRANT; AND, AUTHORIZATION
OF THE MAYOR TO EXECUTE ALL NECESSARY CLOSEOUT
DOCUMENTS FOR TRANSMITTAL TO THE OKLAHOMA DEPARTMENT
OF COMMERCE

acceptance of the completed CDBG 2003 Sidewalk Improvement Project, authorization of the
Mayor to execute all necessary documents, and authorization for the Community Development
Department to transmit closeout documents to the Oklahoma Department of Commerce.

ITEM 8. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL AUTHORIZATION FOR THE MAYOR TO

approval of the Tyann Plaza IV Final Plat.

ITEM 12. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF ORDINANCE NO. 837, AN
ORDINANCE ESTABLISHING MINIMUM REQUIREMENTS FOR ACCESS
GATES FOR GATED COMMUNITIES AND PLANNED UNIT
DEVELOPMENTS AND PROVIDING FOR THE REGISTRATION AND
INSPECTION OF SAID ACCESS GATES
Mr. Wiles presented the item. Councilor Kimball stated that she could not support this
ordinance. She further stated that she felt developers were moving away from Owasso because
of over -regulating ordinances, naming the recently established Landscape Ordinance, Lighting
Ordinance and Signage Ordinance. Mr. Colgan's position was that he felt the ordinances were
good. Mr. Cataudella's position was that he agreed with Mr. Colgan and said the ordinances
mentioned had been discussed with many of the developers in the Owasso area. Mr.

Thoendel's position was he felt the ordinances mentioned gave developers information up -front
as to what Owasso expected. After much discussion, Mr. Cataudella moved, seconded by Mr.
Guevara, for Council approval of Ordinance No. 837.

ITEM 13. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL TO AWARD A CONSTRUCTION
CONTRACT FOR THE FY 2005-2006 STREET REPAIR PROJECT
Ms. Stagg presented the item. Ms. Kimball moved, seconded by Mr. Colgan, for Council
approval to award a contract for the construction of the FY 2005-2006 Street Repair Project to
Magnum Construction, Incorporated of Broken Arrow, Oklahoma in the amount of $98,536.00.

ITEM 14. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL AUTHORIZATION FOR THE CITY MANAGER TO
EXECUTE AN AGREEMENT BETWEEN THE CITY OF OWASSO AND
OKLAHOMA NATURAL GAS COMPANY FOR THE PURPOSE OF GAS
FACILITIES RELOCATION WITHIN THE SILVER CREEK DRAINAGE
IMPROVEMENT PROJECT; AND, AUTHORIZATION OF THE CITY
MANAGER TO TERMINATE SUCH AGREEMENT IN THE EVENT THE
TOTAL ESTIMATED COSTS SHOULD EXCEED $17,757.00
Councilor Kimball recused herself from this agenda item.
Ms. Stagg presented the item. Mr. Cataudella moved, seconded by Mr. Colgan, for Council
approval of authority for the City Manager to execute the Agreement for Gas Facilities
Relocation between the City of Owasso and Oklahoma Natural Gas Company for Silver Creek
Drainage Improvements in the amount of $17,757.00; and, authorization of the City Manager to
terminate such agreement in the event the total estimated costs should exceed $17,757.00.

The Owasso City Council met in a special meeting on Tuesday, March 28, 2006 in the Lower
Level Conference Room at City Hall, 111 N. Main Street, per the Notice of Public Meeting and
Agenda posted on the City Hall bulletin board at 8:00 AM on Wednesday, March 22, 2006.

Mr. Ray reviewed the upcoming budget process and reviewed operational and capital outlay
requests from departments. Budget initiatives of the ISO Rating, GIS System, Technology
Applications for Integrated Software, Major Street Repair, and US 169 Widening from I-244 to
SH 20 were also reviewed. No action was taken regarding these items and additional meetings
will be scheduled in the future.
ITEM 3: DISCUSSION RELATING TO CURRENT VACANCIES IN VARIOUS BOARDS
AND COMMISSIONS

The subject residential development is located northeast of the intersection of East 106"' Street
North and North 145t" East Avenue (see attached map). The sanitary sewer system consists of
approximately 562 L.F. of 12-inch PVC and 5,584 L.F. of 8-inch PVC sanitary sewer line.
Washington County RWD #3 supplies the water. Design of the sanitary sewer system was
reviewed and approved in April 2005.

Final inspection for the sanitary sewer system was conducted on February 15, 2006. All items
identified at the final inspection requiring correction to meet city standards have been completed.
The construction contractor has provided the required one-year maintenance bond for the system.
Staff recommends Council acceptance of the Lake Valley I sanitary sewer system.

The subject residential development is located southeast of the intersection of East 96"' Street
North and North 136t" East Avenue (see attached map). The sanitary sewer system consists of
approximately 180 L.F. of 8-inch PVC sanitary sewer line. Design of the sanitary sewer system
was reviewed and approved in July 2004.

Final inspection for the sanitary sewer system was conducted on December 6, 2005. All items
identified at the final inspection requiring correction to meet city standards have been completed.
The construction contractor has provided the required one-year maintenance bond for the system.

Enclosed is Permit No. SL000072040709 for the construction of 180 feet of eight (8) inch PVC sanitary
sewer line to serve the Ojala Property sanitary sewer line extension, City of Owasso, Tulsa County,
Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans approved by this
Department on July 23, 2004. Any deviations from the approved plans and specifications affecting
capacity, flow or operation of units must be approved, in writing, by the Department before changes are
made.
Receipt of this permit should be noted in the minutes of the next regular meeting of the City of Owasso,
after which it should be made a matter of permanent record.
We are returning one (1) set of the approved plans to you, two (2) sets to your engineer and retaining one
(1) set for our files.

The City staff is completing acquisition of right-of-way for easements on a two mile
portion of E. 106th Street N. from Sheridan to Mingo for installation of a water
transmission line. The transmission line will connect the City's water system with the
City of Tulsa's new connection point to be located at 106th Street and Sheridan. As a part
of those acquisitions, negotiations for the purchase of 3,350 square feet of permanent and
4,150 square feet of temporary easement from James F. and Bonnie L. Williams have
resulted in a contract. The total purchase price for this property is reflective of the
number of square feet needed for both the permanent and temporary easements and the
price per square foot as determined in the Appraisal Report submitted by Story &
Associates.
This contract completes the right-of-way acquisition process for the 106"' Street waterline
construction project. Two parcels are currently in condemnation proceedings, and it is
anticipated that the City will pay the Commissioners' award, when rendered, to the court
thereby gaining lawful entry onto the land.

This request is for City Council approval of the attached contract for the purchase of an
interest in real property, authorization for the Mayor to execute such contract, and
authorization for payment to be made. The proposed contract is attached for your review.

permanent and temporary easements, 2) City Council authorization for the Mayor to
execute the Contract, and 3) authorization for payment of the purchase price.
