6. Consideration and appropriate action relating to a request for Council approval of the Consent
Agenda. All matters listed under "Consent" are considered by the City Council to be routine
and will be enacted by one motion. Any Councilor may, however, remove an item from the
Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable.
A. Approval of Minutes of the February 19, 2008 Regular Meeting.

C. Consideration and appropriate action relating to a request for Council approval of
Ordinance No. 911, an ordinance approving rezoning request OZ 08 -01; consisting of
approximately 1.5 acres located at 10409 North Highway 169 Service Road from AG
(Agriculture) to an OM (Medium Intensity Office) Zoning District.

Staff will recommend Council approval of Ordinance No. 911 and has listed this item in
the consent section of the agenda based on Council actions taken February 19, 2008 to
approve the rezoning request.
D. Consideration and appropriate action relating to a request for Council approval of
Ordinance No. 912, an ordinance approving OPUD 07 -02, a planned unit development
consisting of approximately 4.62 acres, located on the south side of East 76th Street North,
immediately west of the Crown Colony subdivision, t/4 mile west of North 129th East
Avenue.

Staff will recommend Council approval of Ordinance No. 912 and has listed this item in
the consent section of the agenda based on Council actions taken January 15, 2008 to
approve the planned unit development.
E. Consideration and appropriate action relating to a request for Council approval of
Ordinance No. 913, an ordinance approving OPUD 07 -03, a planned unit development
consisting of approximately 17.798 acres located on the north side of East 106th Street
North, between the Owasso Sports Park and the SK &O railroad.

MINUTES OF REGULAR MEETING
Tuesday, February 19, 2008
The Owasso City Council met in regular session on Tuesday, February 19, 2008 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 5:00 p.m. on Friday, February 15, 2008.
ITEM 1. CALL TO ORDER
Vice Mayor Gall called the meeting to order at 6:32 p.m.
ITEM 2. INVOCATION
The invocation was offered by Jack Voss of Crossroads Christian Church.
ITEM 3. FLAG SALUTE
The flag salute was led by Councilor Doug Bonebrake.

ITEM 5. PRESENTATION OF A CHARACTER CERTIFICATE
Vice Mayor Gall and Council recognized Public Service Company of Oklahoma for endurance
displayed by their employees following the December 2007 ice storm. An "Endurance"
Character Certificate was presented to attending representatives of PSO.

ITEM 6. READING OF MAYOR'S PROCLAMATION
Vice Mayor Gall introduced Ricci Wood representing the Humane Society of Tulsa, Dr. Greg
Strathe of Strathe Veterinary Hospital, and Deputy Chief Chambless, and Animal Control
Officers Christine Baker and Brandon Hemsouth, from the Owasso Police Department, and read
a proclamation declaring February 23, 2008 as "Spay Day" in the City of Owasso encouraging
citizens to have their pets spayed or neutered.
ITEM 7. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA
A. Approval of Minutes of the February 5, 2008 Regular Meeting and February 12,
2008 Special Meeting.
B. Approval of Claims.
C. Acknowledgement of receiving the monthly FY 2007 -2008 budget status report.
D. Acceptance of the IHOP water system improvements located at the intersection
of North 121s' East Avenue and North Garnett Road consisting of approximately
300 linear feet of eight (8) inch PVC water line.
Mr. Bonebrake moved, seconded by Ms. Kimball, to approve the Consent Agenda with claims
totaling $483,448.22, healthcare self - insurance claims totaling $27,352.68 and payroll claims
totaling $309,746.38.

ITEM 8. PUBLIC HEARING. THE CITY COUNCIL WILL CONDUCT A PUBLIC HEARING
FOR THE PURPOSE OF RECEIVING CITIZEN COMMENTS AND INPUT ON
PROPOSED AMENDMENTS TO THE OWASSO LAND USE MASTER PLAN
Mr. Wiles presented the item and opened the floor for citizen comments. A number of citizens
spoke in favor of approving the amendment.
Mr. Wiles declared the hearing closed.

ITEM 9. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF AMENDMENTS TO THE
OWASSO LAND USE MASTER PLAN
Mr. Wiles recommended the approval of the update to the Owasso Land Use Master Plan.
Ms. Kimball moved, seconded by Mr. Sinex, for Council approval of the update to the Owasso
Land Use Master Plan.

ITEM 10. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF A CITIZEN'S REQUEST TO
PARTIALLY CLOSE A DRAINAGE EASEMENT LOCATED AT 13105 E. 95TH
COURT NORTH
Ms. Darnaby presented the item and recommended Council approval of a request for an
easement closure, providing the applicant includes documentation with the deed acknowledging
the partial closure of the easement.
Mr. Bonebrake moved, seconded by Mr. Sinex, for approval of the request for easement closure,
as recommended.

TO THE AGREEMENT FOR ENGINEERING SERVICES RELATED TO THE
MAIN STREET STREETSCAPE IMPROVEMENT PROJECT
Mr. Stevens presented the item and recommended approval of Change Order No. 1 in the amount
of $5,405.97 to Cobb Engineering for additional design services related to the Main Street
Streetscape Improvement Project.
Mr. Bonebrake moved, seconded by Mr. Sinex, for approval of Change order No. 1 to Cobb
Engineering, as recommended.

ITEM 13. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL ACCEPTANCE OF THE FIRE STATION NO. 3
SANITARY SEWER EXTENSION PROJECT AND AUTHORIZATION FOR
FINAL PAYMENT TO MSB CONSTRUCTION OF TULSA, OKLAHOMA
Mr. Stevens presented the item and recommended Council acceptance of the Fire Station No. 3
Sanitary Sewer Improvements and authorization for final payment to MSB Construction Co. of
Tulsa, Oklahoma in the amount of $14,713.50 for a final revised contract amount of $50,430.00.
Ms. Kimball moved, seconded by Mr. Bonebrake, for Council acceptance of the Fire Station No.
3 Sanitary Sewer Extension Project and authorization for final payment, as recommended.

REQUEST FOR COUNCIL ACCEPTANCE OF THE FIRE STATION NO. 3
WATERLINE EXTENSION PROJECT AND AUTHORIZATION FOR FINAL
PAYMENT TO MSB CONSTRUCTION OF TULSA, OKLAHOMA
Mr. Stevens presented the item and recommended Council acceptance of the Fire Station No. 3
Waterline Extension and authorization for final payment to MSB Construction Co. of Tulsa,
Oklahoma, in the amount of $38,805.00 for a final revised contract amount of $235,266.00.
Mr. Sinex moved, seconded by Mr. Bonebrake, for acceptance of the Fire Station No. 3
Waterline Extension and authorization for final payment, as recommended.

ITEM 15. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL TO AWARD A BID FOR THE PURCHASE OF A
USED ASPHALT PAVING MACHINE
Mr. Doyle presented the item and recommended Council award the bid for the purchase of a
2003 Leeboy 8500 used asphalt paver to Kirby -Smith Machinery, Incorporation of Tulsa,
Oklahoma in the amount of $47,500.00.
Ms. Kimball moved, seconded by Mr. Sinex, for Council to award the bid for the purchase of a
used asphalt paving machine, as recommended.

BACKGROUND:
At the February 19, 2008 meeting, the Owasso City Council approved a request (OZ 08 -01)
to rezone property located at 10409 North Highway 169 Service Road. The approval
changed the zoning from AG (Agriculture) to an OM (Medium Intensity Office) Zoning
District following the Planning Commission's approval on January 7, 2008.
Attached is a copy of Ordinance No. 911 that formally adopts the City Council's action of
February 19, 2008.
RECOMMENDATION:
The staff recommends Council approval of Ordinance No. 911.

WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for or against the requested rezoning of application OZ -08-

immediately west of the Crown Colony subdivision, t/4 mile west of North 129th East
Avenue. The approval changed the zoning from an AG (Agriculture) Zoning District to a
PUD 07 -02 Zoning District, allowing attached residential dwellings (townhomes). The
Council took action on this Planned Unit Development (PUD) request following the
Planning Commission's approval on January 7, 2008.
Attached is a copy of Ordinance No. 912 that formally adopts the City Council's action of

1_0 INTRODUCTION
2.0
The Planned Unit Development of Villas at Stonebridge consists of 4.62 acres more or less
and is located east of East 76`h Street North and North 129`h East Avenue in south Owasso.
The property is located in the NW /4 of Section 33, Township 21 North, Range 14 East of the
Indian Meridian, Tulsa County, Owasso, Oklahoma.
LEGAL DESCRIPTION
The legal description of the property comprising the Planned Unit Development of Villas at
Stonebridge is described in Exhibit "A ". The boundaries of the site are depicted on the
Outline Development Plan.
3_0 DEVELOPER
4.0
The developer of the property is Sooner Traditions, LLC of Norman, Oklahoma.
SITE AND SURROUNDINGS AREAS
The subject property is currently zoned AG- Agricultural District and is vacant. Property to
the west of the site is zoned AG- Agricultural District and is mostly vacant. Property south of
the site is zoned RE- Residential Estates and is mostly vacant. Property east of the site is
zoned RS- Residential Single Family and is developed with residences.
4.1 PHYSICAL CHARACTERISTICS
The site contains gently sloping terrain, with drainage flowing toward a pond located on the
southern portion of the site. The site is covered with native grasses and contains very little
tree cover. Elevation on the site ranges from approximately 622.00 feet at the northwest
boundary to approximately 609.00 feet at the southeast boundary. The soil is comprised of
the Osage - Wynona Association: Deep, nearly level, poorly drained and somewhat poorly
drained, loamy or clayey soils that have a loamy or clayey subsoil over loamy or clayey
sediments; on flood plains.
5_0 CONCEPT
Villas at Stonebridge PUD is located in an area of Owasso that is experiencing continued
growth. This Planned Unit Development represents a response to the continuing immediate
and long term market demands for an increase in the availability of housing in this rapidly
expanding suburban area.

The PUD will contain one tract and will be developed for residential uses. The developer of
Villas at Stonebridge envisions a subdivision containing quad -plex development aimed at
meeting the needs of first time homebuyers and young families.
SERVICE AVAILABILITY
The following is an analysis of the existing and proposed infrastructure to serve this PUD.
6_1 STREETS
The Planned Unit Development of Villas at Stonebridge is situated south of East 76Th Street
North and east of North 129' East Avenue, both two lane roadways.
6_2 SANITARY SEWER
Sanitary sewer facilities are presently available through connection to an existing line located
just east of the site.
6_3 WATER
Water is presently available from existing water lines located north of the site.
6_4 OTHER UTILITIES
Electric, gas, telephone and other appropriate utilities will be extended to serve this
site.
6_5 FIRE PROTECTION
The nearest fire station is Fire Station Number 2, located at 201 S. Cedar, approximately one
and one half miles from the site.
7_0 USE AND DEVELOPMENT REGULATIONS
The Planned Unit Development of Villas at Stonebridge contains one tract and will be
developed according to the RM Residential Multi Family District.
All uses permitted in the RM Residential Multi Family District shall be allowed including
conditional, special permit, special exception and/or accessory uses subject to their
appropriate conditions and review procedures for public hearings where applicable, unless
otherwise noted herein.

7.1 ADDITIONAL USE AND DEVELOPMENT REGULATIONS
7.1.1 Maximum building height shall be two stories or 35 feet.
7.1.2 Minimum building setbacks are as follows:
Minimum 20 foot front setback from the street right -of -way line.
Minimum 10 foot rear setback.
Minimum 5 foot side setback, unless attached units are constructed. No side setback
is required for attached dwellings.
Minimum building setback from the E. 76th Street right -of -way line is 20 feet.
7.1.3 Fireplaces, bay windows, entry ways, patios, patio covers and other similar
appurtenances may encroach up to five feet into the rear yard setback, and two feet
into the side yard setback provided the side yard encroachment is not located at
ground level. However, said appurtenances shall not extend into a utility easement,
right -of -way or across a property line.
7.1.4 Common areas, greenbelts and flood zone areas may be located in setbacks and apply
toward setback requirements.
7.1.5 Parking and driveways are permitted in building setbacks.
7.1.6 There shall be no minimum front building lot width requirement.
7.1.7 Residential density shall average 15 units per acre over the entire development.
8_0 ACCESS
8.1 Access shall be provided from East 76th Street North, with a maximum of two
entrances permitted.
8.2 This development may contain gated entrances with private streets.
8.3 Attached or detached garages for residential development shall count toward meeting
parking requirements.
9_0 SCREENING AND LANDSCAPING
9.1 The subject parcel shall meet all requirements of the City of Owasso Landscape
Ordinance; except as noted herein.

9.2 All landscaping shall be situated so that it does not create a sight restriction hazard
for vehicles entering and exiting the property.
9.3 A ten foot wide landscaped edge will be provided along the north boundary of the
property adjacent to E. 76`" Street. The landscaped edge may be located within the
right -of -way. The landscaped edge will contain trees planted on average 30 foot
centers.
9.4 A four foot wide sidewalk will be provided along the north boundary of Villas at
Stonebridge. This sidewalk may be located within the right of way along E. 76th
Street and within the landscaped edge.
9.5 A minimum six foot high sight -proof fence shall be provided along the east boundary
adjacent to single family uses.
10.0 PARKING
10.1 Parking for all uses shall conform to the current Planning and Zoning Code, except
as noted herein.
10.2 Parking and maneuvering within private street right -of -way shall be permitted.
11.0 SIGNS
12.0
11.1 Signs within Villas at Stonebridge PUD shall meet RM sign regulations, except as
noted herein.
11.2 Freestanding signs will be limited to ground (monument) signs with a landscaped
base.
11.3 Signs may be located within the median of roadways and within the rights -of -way
provided the signs are not located within the right -of -way of E. 76th Street.
ARCHITECTURE
Exterior building wall finish on all main structures shall consist of a minimum 50% brick
veneer, masonry, drivet, rock, stone, stucco, concrete composite siding, wood or other similar
type finish approved by the Planning Director of the City of Owasso. Exposed metal or
exposed concrete block buildings shall not be permitted.
13.0 OWNERSHIP AND MAINTENANCE OF COMMON AREA/OPEN SPACE
The property owner(s) shall be responsible for maintenance of all common/open space areas.

It shall be the responsibility of the property owner(s) for the installation, maintenance and
replacement of all private drainage, landscaping and sprinkler systems.
14.0 DRAINAGEWAYS
14.1 In an effort to be environmentally conscious and preserve the natural beauty of the
area, drainageways will be left natural where possible.
14.2 Drainage improvements, if required, will be in accordance to applicable sections
of the City of Owasso Code of Ordinances. Private drainage ways may be
permitted and constructed in accordance with said code. Such drainage ways must
be designed to handle adequate flows and cannot be built without specific
approval of the City Engineer. The maintenance will be the responsibility of the
property owners.
15.0 OTHER DEVELOPMENT REGULATIONS
15.1 Villas at Stonebridge PUD may be developed in phases. A development schedule
has not been determined at this time.
15.2 Every structure in this Planned Unit Development shall have Class C roofing or
better.
15.3 Common Areas:
Maintenance of the Common Areas in the development shall be the responsibility of
the property owner or Property Owners Association. No structures, storage of
material, grading, fill, or other obstructions, including fences, either temporary or
permanent, that shall cause a blockage of flow or an adverse effect on the functioning
of the storm water facility, shall be placed within the Common Areas intended for the
use of conveyance of storm water, and/or drainage easements shown. Certain
amenities such as, but not limited to, walks, benches, piers, and docks, shall be
permitted if installed in a manner to meet the requirements specified above.
15.4 Platting of this Planned Unit Development shall be required prior to development.

DEVELOPMENT CONCEPT
OWASSO ONE is a proposed mixed -use Planned Unit Development (PUD) North of
106th Street North and between the City of Owasso Sports Park and the Atchinson
Topeka and Sante Fe Railroad, the site consisting of approximately 18 acres. The north
boundary of the site is formed by the Owasso Sports Park, the east boundary is formed by
the Owasso Sports Park and a neighboring property zoned agricultural, the south
boundary is formed by 106th Street North with the adjacent property zoned for multi-
family and commercial use, the west boundary is formed by the Atchinson Topeka and
Sante Fe Railroad providing separation for the adjacent property, Metro Heights I & II,
zoned single family.
Difficulties arise in the development of the property because of the shape and size of the
property. With well thought out planning the site presents a relatively flat terrain with
utilities close in proximity and has excellent development potential.
The land is currently located in Tulsa County and zoned agricultural. Application for
annexation of the property into the city of Owasso has been submitted. The current
master plan for the city of Owasso, Owasso 2015 Land Use Master Plan, shows the land
zoned for Residential which includes Residential Single Family — RS and Residential
Duplex - RD. OWASSO ONE PUD incorporates both Residential Multi Family —RM
and Commercial General — CG. Because of this difference the underlying zoning in the
Owasso 2015 Land Use Master Plan for the city will have to be changed to accommodate
the OWASSO ONE PUD.
The Multi Family and Commercial mix will create a nice compliment to the development
south of 106th street north and continue the effort for planning the fastest growing
community in Oklahoma. The architectural design of the commercial buildings, the
gated apartment community and the landscaping will create a development with its own
identity and at the same time stay consistent with the overall plans of the community.
The Outline Development Plan shows the different land uses and their relationship to
each other on the 18 acre project site. Neighboring properties shall be buffered with
screen fencing and landscaping in accordance with the city of Owasso landscaping
guidelines. The aesthetic water features shall be incorporated into the natural slopes of
the land and will also be used for storm water detention.

EXISTING CONDITIONS
OWASSO ONE is a proposed mixed -use Planned Unit Development (PUD) North of
106th Street North and between the City of Owasso Sports Park and the Atchinson
Topeka and Sante Fe Railroad, consisting of approximately 18 acres. This development
is situated on relatively flat terrain with utilities close in proximity. This site has excellent
development possibilities.
The land is agricultural with a small farm house, barn and fencing for cattle and horses.
There is a small pond on the north boundary of the property near the baseball fields of the
Owasso Sports Park. The on -site slopes consist mainly of 0 % -10% slopes. Using the
north boundary and a small existing area near the south boundary of the Mult- Family area
for water features and storm water detention the balance of the property is developable.
Vehicular access to the Commercial area and the Multi - Family area will be provided with
the same access point located approximately 200 feet east of the Atchinson Topeka and
Sante Fe Railroad railroad tracks on 106th Street North. Access to Highway 75, 2.5 miles
west, Interchange and U.S. Highway 169, 1.5 miles east, is provided by 106th Street
North.

Slope Analysis
EXISTING UTILITIES ANALYSIS
All major utilities: water, sewer, electric and natural gas have access to the project site.
While electric and natural gas are currently the only utilities with direct access to the
project water, to the south east, and sewer, directly to the north, are accessible through
utility extensions. There appears to be no significant problem in servicing all portions of
the project.
Water is provided by the City of Owasso. The City of Owasso is completing construction
on the eighty acre sports park directly to the east of the project during which a new
twelve (12) inch line is to be added.
Sanitary sewer is provided by the City of Owasso. The city has a sanitary sewer line
along the northern boundary of the site. The pipe was put in place in 1972 and is in the
cities plan to be upgraded.
Public Service Company of Oklahoma (PSO) furnishes electricity to the entire area.
Electric service is available on site.
Oklahoma Natural Gas (ONG) is the supplier of natural gas to the project. The gas line is
located on the southern boarder of the site.

SURROUNDING ZONING
There is a variety of different zoning types and land uses located in close proximity to the
development. There is commercial zoning and multi - family on the south side of 106th
Street North, directly south of the project, commercial zoning on the north and east sides
of the project with the City of Owasso Sports Park and the Atchinson Topeka and Sante
Fe Railroad separates the project from Residential Single family, Metro Heights, and a
future fire station site on the corner of 106th Street North and Mingo.
There is approximately 30 acres between the site and the Sports Park that is in Tulsa
County and zoned agricultural. With the proposed development of multi - family on the
north part of the site and commercial bordering 106th Street North the compatibility with
the surrounding areas is assured.

LANDSCAPING
The landscaping concept is intended to achieve unity throughout the Owasso ONE PUD
as well as provide an attractive view from surrounding streets, neighborhoods, and parks.
The Owasso ONE project developed their landscape and hardscape concept using
specific trees, schrubs and stone to be used consistently throughout the commercial and
multifamily areas of the project.
Prior to the issuance of an occupancy permit for the development, all plant materials and
required screening fences shall be installed conforming to the detailed landscape plan
approved by the Owasso City Council.
ACCESS & CIRCULATION
The primary point of access will be north of 106th Street North on the south side of the
commercial tract. Access to the multi- family tract will be through the commercial tract.
The multi - family tract will have a circular loop to access any dwelling by turning left or
right at the main office. Emergency vehicles will use the primary access off of 106th
Street North and a secondary emergency access point shall be located on the north east
corner of the multi - family tract. This secondary point of entry requires access through
the Owasso Sports Park and further coordination with the city is required prior to
finalizing its location.

SITE PLAN REVIEW
No building permit shall be issued for the construction of buildings within a development
area until a detailed site plan of the development area has been submitted to, and
approved by, the City of Owasso Building Permit Department as being in compliance
with the Development Concept and the Development Standards.

PLATTING REQUIREMENT
No building permit shall be issued until the property has been included within a
subdivision plat submitted to and approved by the City of Owasso Planning Commission
and the Owasso City Council and duly filed of record, provided however, development
areas may be platted separately. Restrictive covenants shall be established implementing
of record the Development Concept and Development Standards and the City of Owasso
shall be made a beneficiary thereof.
