SUBJECT: OZ-08-02, A REQUEST FOR REZONING OF 2.417 ACRES LOCATED
AT 11102 EAST 126TH STREET NORTH.

BACKGROUND:
In order to further facilitate the development of their property for potential office use, Mr. and Mrs.
Lee have requested for their property to be rezoned from an AG (Agriculture) Zoning District to a CS
(Commercial Shopping) Zoning District. A general area map is attached for review.
PROPERTY CHARACTERISTICS:
The property is currently undeveloped and is zoned AG (Agriculture). Land to the east is zoned
AG (Agriculture), land to the south is developing as Crescent Ridge under an RS-3 (Single Family
Residential) Zoning District, land to the west is zoned AG (Agriculture), land to the North is zoned
IM (Industrial Medium).
The subject site is 2.417 acres in size. The property will be served municipal water, municipal
wastewater, municipal police, municipal fire, and municipal EMS service.
DESCRIPTION OF OM ZONING DISTRICT:
The CS zoning district is designed to accommodate a wide range of commercial uses (including
offices) that are protected from other general commercial activities.
DEVELOPMENT PROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the city limits is made a part of the city. Property owners
and land developers sometimes choose to have their property annexed into Owasso in order to
receive Owasso municipal services, such as police protection, refuse collection, and sanitary
sewer.
The second step in the development of a piece of property in Owasso is rezoning. When a
property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In
order to develop the property, the land must be zoned for particular kinds of uses, such as
residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the
growth policy displayed in the Owasso Master Plan.
One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD.
When a development proposes to exhibit a mixture of uses with specific regulations and standards
unique to a particular tract of land, a PUD is often the preferred land use control mechanism.
The third step in the development of a piece of property in Owasso is platting. A preliminary plat
is required for any development that proposes to divide land into two or more lots. Preliminary
plats illustrate the development concept for the property, and are often modified significantly after
being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning
Commission. Sometimes, difficult development issues such as existing utility lines, wells, or
easements are brought to light at the preliminary plat stage and must be remedied prior to
development.
After the preliminary plat has been reviewed by the City and various utility companies,
construction plans for the development's infrastructure are typically submitted. These plans
include specifications and drawings for stormwater drainage, streets and grading and erosion
control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of
other agencies, such as the Department of Environmental Quality for wastewater collection and the
US Army Corps of Engineers for properties that maybe development sensitive.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the
layout and dimension of lots included on the final plat, right-of--way widths, easements, and other
physical characteristics that must be provided for review by the City. After obtaining approval
from the TAC and Planning Commission, the final plat is considered by the City Council. If
approved, the final plat is filed with the office of the County Clerk and governs all future
development on that property.
The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are
reviewed by the TAC and approved by city staff. Issues such as building setbacks, parking,
access, landscaping, and building footprint are presented in the site plan. Once a site plan is
approved, the development is clear to apply for a building permit and to submit construction plans
for the building's foundation, plumbing, electrical system, and HVAC.
LEGAL CONSIDERATIONS OF ZONING REQUESTS:
Section 1500 of the Owasso Zoning Code outlines the city's policy on zoning amendments. The code
states that amendments will be adopted to recognize changes in the Comprehensive Plan, or to
recognize changing conditions in a particular area or in the jurisdictional area. Zoning changes must
be based on two fundamental questions: 1) Does the requested zoning allow a land use that is
appropriate for the subject property, and 2) Is the requested zoning in conformance with the Owasso
Land Use Master Plan?
Development considerations such as traffic, roads, grading, drainage, stormwater detention, utilities,
rights-of--way, etc, are not to be considered until the platting stage of development. At the platting
(and site planning) stage, the Planning Commission, municipal staff, and the Technical Advisory
Committee work with the applicant to solve these types of specific development concerns.
The proposed development for this property is an office building.
CONFORMANCE TO MASTER PLAN DESIGNATION:
The Owasso Land Use Master Plan designates the property for commercial use. The requested
zoning designation, CS (Commercial Shopping), is allowed within the master plan's designation for
the property.
ANALYSIS:
The subject property is currently designated by the Owasso Comprehensive Plan as future
Commercial. If the application is approved, the subject property would be zoned CS (Commercial
Shopping). Such a rezoning would allow for the property to develop as an office facility, per the
applicants request.
Letters were mailed to surrounding property owners and the legal advertisement was published in
the Owasso Reporter. Staff has received no phone calls or correspondence from the public in
regards to the request. Copies of both the letter to property owners and the legal advertisement are
attached for your information and review.
PLANNING COMMISSION HEARING:
The Owasso Planning Commission will consider the rezoning request at a public hearing on March
10, 2008.
RECOMMENDATION:
The staff intends to recommend approval of OZ-08-02.

The City of Owasso has received an application to review the Final Plat of Prestige Pond
proposing 43 residential lots, on approximately 25 acres, located on the northwest corner of East
106`h Street North and North 161 S` East Avenue. A general area map is attached.

ANALYSIS:
The Prestige Pond Final Plat is in anticipation of a single family residential development proposing
42 lots on approximately 25 acres zoned RS-2 located on the northwest corner of East 106th Street
North and North 161St East Avenue. The proposed development would house average lot sizes of
10,500 square feet. According to the Owasso Zoning Code, single family uses are included
allowed by right on property zoned RS-2.
There are two points of access into Prestige pond. The first is off of East 106th Street North and
shows 78.54 feet to be designated for ingress and egress. The second point of access is off of North
161St East Avenue and shows 78.54 feet to be designated for ingress and egress. The two points of
access designated for ingress and egress includes a total of 157.08 feet.
The proposed plat illustrates a 20' utility easement in the front of the lot and a 17.5' utility
easement in the rear. Some of the lots also include utility easements on the sides varying between
5' and 10'.
The development will be served by City of Owasso sewer and Rogers County Rural Water District
No. 3 for water. The applicant has also set aside three reserve areas throughout the development
for additional green space and storm water detention, totaling approximately 6.5 acres. The largest
of these reserve areas will be located where the existing pond is at the northwest corner of East
106t" Street North and North 161St East Avenue. The existing pond will be engineered and
modified to act as a wet storm water detention facility for the development.
Any development that occurs on the subject property must adhere to all subdivision, zoning and
engineering requirements including but not limited to paved drives and storm water detention. The
property will be subject to all payback fees including Storm Siren fees of $16 per acre, and a
sanitary sewer payback fee of $2,580 per acre.
TECHNICAL ADVISORY COMMITTEE:
The Owasso Technical Advisory Committee reviewed the final plat at the February 27, 2008
regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to
comment on the plat and request any additions and/or concerns. The Technical Advisory
Committee recommended that the Planning Commission approve the Final Plat of Prestige Pond.
PLANNING COMMISSION HEARING:
The Owasso Planning Commission will consider the rezoning request at a public hearing on February
11, 2008.
RECOMMENDATION:
Staff intends to recommend approval of Prestige Pond Final Plat.

ASSISTANCE TO FIREFIGHTERS GRANT

BACKGROUND:
The Fire Department seeks to apply for the Department of Homeland Security Assistance
to Firefighters Grant Program (AFG). The proposed application falls under the
equipment category in two areas, physical fitness equipment and safety equipment. In
the physical fitness equipment section, the grant application includes wellness and fitness
equipment for the fire stations. In the safety equipment section of the application,
firefighting gear and equipment and a myriad of additional safety equipment will be
requested. The grant application is for $172,727, 90% of which would be federally
funded. The remaining 10% would be funded from the fire department's operating
budget.
ASSISTANCE TO FIRE FIGHTERS GRANT PROCESS:
One of the central goals of AFG is to better prepare fire departments in responding to
emergencies. Fire departments are able to request grant monies under two broad
categories in the Assistance to Firefighters Grant (AFG) program: apparatus or
operations/safety equipment. In the equipment category, various operational,
educational, and support equipment is grant eligible in the application. Following a need
analysis, the Owasso Fire Department has chosen to request physical fitness equipment
and safety equipment.
COMMENTS:
This item is informational only, if the City of Owasso is a recipient of the grant, an action
item will be placed on the City Council Agenda at that time. Please note, that no
supplemental appropriation will be needed if the grant is awarded.

The Capital Improvements Committee was formed to ensure citizen input in the Capital
Improvements planning process. The Capital Improvements Plan is a critical planning tool that
outlines a path of expenditures for major projects of high priority to the City of Owasso. The
committee is comprised of 19 members, nine municipal staff members and ten citizen members.
The committee meets annually with the goal of recommending updates of the capital improvements
plan to the City Council before the end of each fiscal year.

PROCESS FOR CREATING ANNUAL LIST OF PRIORITIES:
Adopted September 2, 2003, Resolution 2003-14 sets the guidelines whereby the City Council
establishes capital priorities each year.
First, the Capital Improvements Committee conducts a meeting and transmits a recommendation of
capital priorities to the City Council. Then, the City Council conducts a public hearing in order to
receive and consider information provided by citizens that may be relevant to the proposed
amendment to the priorities. Finally, at least two weeks after the public hearing, the City Council
adopts by resolution the prioritized list of capital projects for the upcoming fiscal year.
PRIORITIES:
Adopted last year for Fiscal Year 2007-2008, the capital improvement projects currently prioritized
by Resolution 2007-OS are as follows:
1. North 129th East Avenue Road Widening Project
2. Street Improvement/Repair Project - FY `08
3. Main Street Redevelopment Project
4. Sportspark - FY `08
5. East 86th Street North Road Widening Project
6. Joint Training Facility
PROPOSED PRIORITY CAPITAL IMPROVEMENT PROJECTS:
The City has identified five capital improvement projects that the staff recommends as priorities for
the upcoming fiscal year.
STREET IMPROVEMENT/REPAIR PROJECT -For many years, the City of Owasso has
partnered with Tulsa County to improve local streets throughout Owasso. Beginning in FY'06, the
City adopted a philosophy about street repair that led to the City committing $1 million annually
through the Capital Improvements Program. So far, the project has received $1 million annually to
fund overlay and minor reconstruction projects for Owasso's streets. The staff proposes to continue
the Street Improvement/Repair Project in Fiscal Year 2008-2009.
SPORTSPARK -This project proposes to continue the development of the 80 acres that lie
between the developed portion of the Sportspark and East 106th Street North. Planned
improvements include a road, parking lot, ten baseball fields, seven football fields and two new
restrooms. The specific improvements planned for next year include a new baseball fourplex, a
new restroom, and waterline and wastewater line extensions.
EAST 86TH STREET NORTH WIDENING RIGHT-OF-WAY ACQUISITION -This project
proposes to acquire right-of--way for the widening of East 86th Street North from Main Street to
Mingo Road. The City of Owasso, Tulsa County and ODOT are partnering to widen 86th Street
from Main Street to Highway 75. Also, as a priority capital project during this current fiscal year,
the City has funded the engineering design so that the widening can be constructed.
INTERSECTION IMPROVEMENTS AT EAST 106TH STREET NORTH AND GARNETT
ROAD -This project proposes to acquire right of way and provide for engineering design for the
improvements of the intersection at East 106th Street North and North Garnett Road. The City of
Owasso is working with ODOT to secure additional funding to construct this project.
TTC/TCC ROAD AND LAND ACQUISITION PROJECT -This project proposes to acquire 25
acres on which the Tulsa Community College (TCC) educational facility would be located.
Further, the project would provide for the construction of a frontage road to serve both the TCC and
the Tulsa Technology Center (TTC), on the east side of Highway 169 between East 106th Street
North and East 116th Street North.
FINANCIAL ANALYSIS:
The staff projects that $1.5 million will be available to budget for capital projects in Fiscal Year
2008-2009. The estimated cost breakdown of the proposed capital projects is as follows:
1. Street Improvement/Repair Project - $1 million
2. Sportspark - $500,000
3. East 86th Street North Widening Right-of--Way Acquisition - $450,000
4. Intersection Improvements at East 106th Street North and N. Garnett Road - $450,000
5. TTC/TCC Road and Land Acquisition Project - $4.7 million
The total estimated cost of all proposed projects is $7,100,000. In order for these projects to be
funded in Fiscal Year 2008-2009, the staff will recommend that the City borrow $5,600,000.
RECOMMENDATION TO CAPITAL IMPROVEMENTS COMMITTEE:
The Capital Improvements Committee is conducting a meeting on March 13, 2008 in order to
formulate a recommendation to the City Council about what the capital priorities should be for
FY'08-09. During that meeting, the staff will present the current financial condition of the Capital
Improvements Program and also present a recommended list of priority capital projects.
The staff will recommend the following projects be the priority capital improvements for FY `08-
09:
1. Street Improvement/Repair Project - FY `09
2. Sportspark - FY `09
3. East 86th Street North Widening Right-of--Way Acquisition
4. Intersection Improvements at East 106th Street North and Garnett Road
5. TTC/TCC Road and Land Acquisition Project

WHEREAS, on the 14a' day of October, 2003, the citizens of the City of Owasso,
Oklahoma, approved Ordinance Number 763, an ordinance providing for the extension of the
third penny sales tax and fiuther, restricting the use of said sales tax generated by such third
penny extension to capital projects reviewed by the Capital Improvements Committee and
approved by the City Council by resolution; and,
WHEREAS, the City Council, by Resolution No. 2006-10, designated as priorities,
specifically: the Additional Fire Stations; the Sports Park Expansion; East 96~' Street North road
project; North Garnett road project; YMCA pool; Silver Creek watershed drainage improvement
project; conceptual design of four intersections - 96`~ Street North/145a' East Avenue, Garnett
Road1106~` Street North, Mingo Road/96`~ Street North, and 145a' East Avenue/106` Street
North; and the Street Improvement/Repair Project; and,
WHEREAS, the City Council, after having received a recommendation from the Capital
Improvements Committee that the following six projects: North 129` East Avenue road
widening, Street Improvement/Repair Project, Main Street Redevelopment Project, Sportspark
Build-out, East 86`~ Street North road widening, and Joint Training Facility be included in the
priority projects list; and, after properly notifying the Public, all in accordance with Resolution
No. 2003-14, has held a Public Hearing as required by the aforesaid resolution.
