6. Consideration and Appropriate Action Relating to a Request for Approval of the Consent
Agenda. All matters listed under "Consent" are considered by the City Council to be

BACKGROUND:
On Wednesday, 12- 24 -97, at approximately 9:00 pm, the Owasso Police department received
a call for service from a resident regarding a vehicle parked in front of her home. The
complainant was identified as Libbie Stayton who resides at 410 East 21st Court in Owasso.
Ms. Stayton relayed that a one ton commercial vehicle had been parked in front of her home
since approximately 1:30 pm on 12- 24 -97. Ms. Stayton further stated that this was a
reoccurring problem with her neighbor and she has sought assistance from code enforcement in
the past. Officer Shaun Jones was dispatched to investigate the complaint and found no
violation. Officer Jones made contact with the complainant and attempted to inform her that the
vehicle was not in violation of any city ordinance. Officer Jones advised Ms. Stayton that the
code enforcement officer would be notified of her complaint as well.
CURRENT ISSUE:
On Friday, 12- 26 -97, Ms. Stayton made contact with City Hall and spoke with Mr. Marlar
(acting code enforcement officer). Mr. Marlar proceeded to the location where the commercial
vehicle was still parked and met with Ms. Stayton. At this time, it was determined that the
vehicle was in violation of the city ordinance #15 -704, which prohibits any vehicle to be parked
on a pubic roadway for longer than 48 hours. Mr. Marlar was directed by the code enforcement
officer to tag the vehicle, however he brought tow stickers to the police department and
requested police officers mark the vehicle since he had no authority to do so. The officers on
the shift were apparently unaware of the previous parking problem and made a note to pass it
on to the code enforcement officer upon his return.

REAL ISSUE: I
Contact was made with Ms. Stayton on Monday, 12 -29 -97 and it was ascertained that this type ,
of parking complaint is not uncommon with her neighbors. She was assured that the neighbors
would be contacted and copies of the current ordinances regarding parking were delivered to '
them. Additionally, contact was made with the business (Water Products) and they were advised
of the complaint which involved one of their vehicles (employees) .
LACK OF RESPONSE:
The situation described could have been handled differently at several levels. First, although '
the officer responded correctly to a lack of violation on the 24th, he could have marked the tires
of the vehicle for the 48 hour time period to begin. This information could have then been �I
passed onto the next shift and a citation could have been issued at 9:00 pm on Friday.
Secondly, the acting code enforcement officer could be given the authority to tag (or mark)
vehicles upon seeing a violation. Thirdly, the officers on the 26th should have investigated the
incident more thoroughly when advised of the complaint by Mr. Marlar.
CURRENT ACTION:
The neighbors next to Ms. Slayton will be contacted and a copy of the parking ordinances
delivered. A review of the current city ordinance should occur to see if any modification should
take place. And, more detailed training in code enforcement violations will be included in the
police department field training process. Ms. Slayton was advised to call the department directly
in the event of future parking problems.

36. "Stand" or "standing" means any stopping or halting of a vehicle whether occupied or not,
otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging
passengers;
37. "Stop," when required, shall mean the complete cessation from movement;
38. "Stop or stopping," when prohibited, means any halting even momentarily of a vehicle
whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the
direction of a police officer or traffic signal;
39. "Street" or "highway" means the entire width between the boundary lines of every way when
any part thereof is open to the use of the public for purposes of vehicular travel;
40. "Through street or highway" means a street, or boulevard or highway or portion thereof at

a. Vehicular traffic from intersecting streets or highways is required by law to come to
a full stop before entering or crossing; and
b. Stop signs are erected as provided in this part;
' 41. "Traffic" means pedestrians, ridden or herded animals, vehicles and other conveyances, either,

singularly or together, while using any highway or street for purpose of travel;
' 42. "Traffic control devices or signals" mean any device legally authorized and used for the
purpose of regulating, warning or guiding traffic;
43. "U -turn" means a turn by which a vehicle reverses its course of travel on
the same street; and
' 44. "Vehicle" means every device in, upon, or by which any person or property is, or may be
transported, or drawn, upon a highway or street, except devices moved by human power or used exclusively
upon stationary rails or tracks.

There is hereby adopted by reference and made a part of this code all of the provisions of the Oklahoma
Highway Safety Code, all as found in Title 47 of the Oklahoma Statutes. All of these provisions are hereby
made a part of the traffic ordinances of the city. All of the provisions found in this title are hereby vitalized
as provided in the laws by this section, specific reference to which is hereby made, as well as all subsequent
amendments to the laws, and all of the laws as well as amendments thereto shall be in full force and effect
within the city insofar as the same are not modified by other provisions in this part or amendments thereto.

STOPPING, STANDING AND PARKING GENERALLY

Any vehicle in violation of any regulation contained in this chapter governing, limiting or prohibiting
the parking or standing of a vehicle on any street or public thoroughfare is hereby declared to constitute a
public nuisance, and each separate traffic citation issued as authorized herein for such violation shall constitute
a separate notice thereof to the owner or operator of such vehicle. (Prior Code, Chapter 20)
The provisions of this chapter shall not be applicable when it is necessary for a vehicle to stop to avoid
conflict with other traffic or in compliance with the directions of a police officer or official traffic control
device. (Prior Code, Chapter 20)
The city manager, subject to any directions which the council may give by motion or resolution, may
establish parking time limits or prohibit parking on designated streets or parts of streets and have appropriate
signs placed on the streets. When the signs are in place, it is unlawful for any person to park a vehicle in
violation of the sign. No such time limits shall be effective unless a sign is erected and in place at the time of
the alleged violation. All parking limit regulations unless otherwise provided shall be in force and effect
between the hours of 8:00 A.M. and 6:00 P.M. except Sundays and legal holidays. (Prior Code, Chapter 20)

the curb for the purpose of loading or unloading merchandise or materials subject to the terms and conditions
of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of
the vehicle and shall grant to such person the privilege as therein stated and authorized herein. The city
' manager may revoke such permits at any time.
B. It is unlawful for any permittee or other person to violate any of the special terms or
' conditions of any such permit. (Prior Code, Chapter 20)
SECTION 15 -710 HAZARDOUS OR CONGESTED PLACES; STOPPING, STANDING
PARKING.

' standing, or parking of vehicles when such stopping, standing or parking would create an especially hazardous
condition or would cause unusual delay to traffic.

SECTION 15 -704 PARKING MORE THAN FORTY -EIGHT (48) HOURS.

No person shall park a vehicle on any street for a period of time longer than forty -eight (48) hours.
This section shall not affect parking limits established for shorter periods.

SECTION 15 -705 BR.AKES ; MOTOR NOT TO BE LEFT RUNNING, UNATTENDED VEHICLES

The person driving or in charge of a motor vehicle shall not permit it to stand unattended without first
stopping the engine and effectively setting the brake thereon and, when standing upon any grade, turning the
front wheels to the curb or side of the street. (Prior Code, Chapter 20)

SECTION 15 -706 SIGNS OR MARKINGS INDICATING ANGLE PARKING.
The city manager, subject to any directions which the council may give by motion or resolution, shall
'
determine upon what streets and parts of streets angle parking shall be permitted and shall have such streets
marked or signed; provided, however, that angle parking shall not be permitted on any federal -aid or state
highway, unless the state department of highways has determined that the roadway is of sufficient width to
'
permit angle parking without interfering with the free movement of traffic. (Prior Code, Chapter 20)

SECTION 15 -707 OBEDIENCE TO ANGLE- PARKING SIGNS OR MAREINGS.
On those streets which have been so signed or marked for angle parking, no'person shall park or stand
a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings
(Prior Code, Chapter 20) _
SECTION 15 -708 PARKING IN SPACES MARKED OFF.
In an area where parking spaces have been marked off on the surface. of the street, a driver parking a

vehicle shall park it within a parking space as thus marked off, and not on or over a line delimiting a space.

SECTION 15 -709 PERMITS FOR LOADING OR UNLOADING AT AN ANGLE TO THE CURB.

of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of
the vehicle and shall grant to such person the privilege as therein stated and authorized herein. The city

B. It is unlawful for any permittee or other person to violate any of the special terms or

A. No person shall stop, stand, or park a vehicle, except in emergencies or when necessary to
avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic control
device in any of the following places:
1. On or over a sidewalk, sidewalk area, or between the sidewalk and the street;
2. In front of or across a public or private driveway;
3. Within an intersection;
4. Within fifteen (15) feet of a fire hydrant except in a parking space officially marked;
5. On or over a crosswalk;
6. Within twenty (20) feet of a crosswalk at an intersection;
7. Within thirty (30) feet upon the approach to any flashing beacon, stop sign, or traffic control ,

signal located at the side of a roadway;
8. Between a safety zone and the adjacent curb or within thirty . (30) feet of points on the curb ,
immediately opposite the ends of a safety zone, unless a different length has been indicated by signs or
markings;
9. _ - Within fifty (50) feet of the nearest rail of a railroad crossing;
10.- twenty (20) feet of the driveway entrance to any fire station, and on the side of street

opposite the entrance to any fire station within seventy -five (75) feet oJ: f the entrance whenproperly signposted;
11. Alongside or opposite any street excavation or construction when stopping, standing, or
parking would obstruct traffic;
12. On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
13. Upon any bridge or overpass or other elevated structure upon a highway or within a highway
tunnel, or on any underpass;
14. At any place where official signs prohibit stopping;
15. In front of or at the exit of any theater or public building while people are congregating inside,
or in front of any public building of three (3) or more stories in height; or
16. On the grounds of any public park except where permitted by official signs.
B. No person shall move a vehicle not lawfully under his control into any prohibited area or an
unlawful distance away from a curb. (Prior Code, Chapter 20)

No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other
side of the intersection or crosswalk to accommodate the vehicles or pedestrians, notwithstanding any traffic

' SECTION 15 -713 STANDING OR PARKING ON ONE -WAY ROADWAY,
A. If a highway includes two (2) or more separate roadways and traffic is restricted to one
direction upon any such roadway, no person shall stand or park a vehicle upon the left -hand side of the
one -way roadway unless signs are erected to permit such standing or parking.
B. The city manager, subject to any directions which the council may give by motion or
resolution, may determine when standing or parking may be permitted upon the left -hand side of any such
one -way roadway and to erect signs giving notice thereof. (Prior Code, Chapter 20)
SECTION 15 -714 STANDING OR PARKING ON LEFT SIDE OF ONE -WAY STREETS.
The city manager may have signs erected upon the left -hand side of any one -way street to prohibit the
standing or parking of vehicles. When the signs are in place, no person shall stand or park a vehicle in
violation of any such signs. (Prior Code, Chapter 20)
' The parking of vehicles at the curb where streets intersect shall be prohibited fifteen (15) feet in advance
of the crosswalk on the near side of such intersection. (Prior Code, Chapter 20)

SECTION 15 -716 PARKING IN ALLEYS- BLOCKING DRIVEWAYS.
No person, other than the operator of a U.S. Postal Service Vehicle engaged in collecting or delivering
U.S. Mail, shall park a vehicle within a street or alley in such a manner or under such conditions as to leave
' available less than ten (10) feet of the width of the roadway for the free movement of vehicular traffic. No
person shall stop, stand or park a vehicle within a street or alley in such position as to block a driveway
entrance to any abutting property. No person shall park or stand a vehicle in any alley except while actually
' engaged in loading or unloading passengers or freight. (Prior Code, Chapter 20)

' PROOF.
A. No person shall make an entry with any vehicle upon real property owned or legally.occupied
' by another without-the owner's or occupant's consent except where such private property is provided as public
parking and the general use of the property is not restricted by signs or proper markings.
' B. Where entry is made upon real property owned or legally occupied by another without the
owner's or occupant's consent, except on unrestricted public parking, and is complained of by the owner or
legal occupant of the premises, the burden is put upon the person making the entry to show that permission
' for such entry was given. (Prior Code, Chapter 20)
SECTION 15 -718 p RTUNG OF CERTAIN COMMERCIAL VEIRCLES ON PUBLIC STREETS IN
' RESIDE Ai AND COMMERCIAL AREAS_
A. No person shall park any commercial vehicle, other than pickup trucks of three - quarter (3/4)
' ton classification or lighter, on any through street nor on any street of thirty (30) feet or less in width at night
unless the person is in any residential area.
B. No person shall park any commercial vehicle, other than trucks of one and one -half ('fi) ton
classification or lighter, or wider than an ordinary passenger car, on any public street.

C. Notwithstanding the provisions of Subsection A and B above, a commercial vehicle may be
parked so as not to create a traffic hazard during active loading or unloading.
D. No person shall park a commercial vehicle at any time opposite another vehicle on a street
thirty -six (36) feet or less in width. The term "street" as used herein, shall mean the entire width between the
curbs of every way publicly maintained when any part thereof is open to the use of the public for purposes of
vehicular travel. (Prior Code, Chapter 20)
A. It is unlawful for any person to place or park a motor vehicle in any parking space on private
property accesstble to the public and where the public is invited or public property that is designated and posted
as a reserved area for parking of motor vehicles of a physically disabled person unless such is eligible for a
detachable insignia or reflective insignia as a physically disabled person under the provisions of Sections
15 -112 or 149.3 of Title 47 of the Oklahoma Statutes, and such insignias are displayed as provided in Sections
15 -112 or 149.4 of Title 47 of the Oklahoma Statutes or regulations adopted pursuant thereto.
B. In addition to penalty, any person violating this section shall pay any and all- reasonable and
necessary charges incurred by the landowner or other person in having any motor vehicle removed from the

SECTION 15 -720 PARKING FOR CERTAIN PURPOSES PROHIBITED.
No person shall park a vehicle upon any roadway for the purpose of: .,1!

A. Except as otherwise provided in this chapter, every vehicle stopped or parked upon a roadway
where there are adjacent curbs, shall be so stopped or parked with the right -hand wheels of the vehicle parallel
to and within eighteen (18) inches of the right -hand curb. Any vehicle stopped or parked upon the left -hand
side of a one- way street where there are adjacent curbs shall be parked or stopped with the left -hand wheels
parallel to and within eighteen (18) inches of the left -hand curb.
B. Commercial vehicles shall be parked parallel in all areas unless otherwise authorized by the
chief of police.
C. Drivers or passengers of vehicles parked on the street shall enter and exit from the side of the
vehicle nearest the edge or roadside of the curb.
D. Drivers or passengers of vehicles parked on a public street shall not open doors of the vehicles
on the traffic side.
E. No vehicle shall be parked nearer than three (3) feet to the rear or front of another parked
vehicle, except where parking lines or other measurements are marked in parking zones.

F. Every driver desiring to enter a parking space being vacated shall stop his vehicle and wait
to the rear of the other vehicle in the actual process of vacating the parking space and having so waited shall
have prior right to the parking space over all other drivers.
G. It is unlawful for any driver to wait in his vehicle ahead of a parking space being vacated, or
to attempt to interfere with one who has waited properly at the rear of a parking space being vacated.
H. No driver shall stop and wait for a parking space unless the vehicle vacating the space is in
motion in the process of vacating.
I. Every driver desiring to enter a vacant parking space shall stop his vehicle immediately in
' back of and parallel to the space then drive into it. It is unlawful for any other driver to drive his vehicle into
the space, block, or interfere in any way with the driver while he is preparing to drive into the space. (Prior

SECTION 15 -725 PARIUNG TIME LIMITED.
A. No person shall park a vehicle longer than the period designated upon the official signs at any
designated time or place or any day except Sundays and legal holidays.
B. No person shall park a vehicle in the street in front of a business establishment while such
establishment is open for business in excess of one hour unless official signs designate otherwise.
C. No person shall move his vehicle in any manner or leave a parking space and then re -enter
it to avoid the intent of this chapter.
D. No person shall park a vehicle on the private property of another without the consent of the
owner of the property, his agent or tenant. Any unoccupied vehicle parked in violation of this chapter may
upon complaint of the property owner, his agent, or tenant, be removed and impounded by the police.
E. No vehicle driver shall exchange parking spaces with another vehicle driver within the same

The impoundment of vehicles under authority of the provisions of this chapter shall be construed as an
enforcement procedure for protection of the public peace, safety and welfare, and the safeguarding of
property,. and shall be used generally for the prevention and removal of traffic hazards, prevention and
abatement of public nuisances arising from traffic law violations, protection of the public rights in the use of
streets and thoroughfares from obstructions placed and left in derogation of those rights, and for safeguarding
and protecting recovered stolen vehicles. (Prior Code, Chapter 20)

Every vehicle that is impounded under the provisions of this chapter shall be removed to the nearest
garage or place of safekeeping designated by the city council, and to no other place. (Prior Code, Chapter

A. Exce pt as otherwise provided, any vehicle impounded under the authority of this chapter shall
be stored and held safely until an order for its release is received from an officer of the traffic violations
bureau or other proper police officer.
B. The order of release of an impounded vehicle shall be conditioned upon the payment by the
person to whom the release is issued of all impoundment costs and accrued storage charges assessed against
the vehicle.
C. No order of release of an impounded vehicle shall be issued until all fines and costs due the
city because of traffic law or other law violations involving the vehicle have been paid. (Prior Code, Chapter

Members of the police department are hereby authorized within the limits set forth in this chapter to

made under order of an authorized police officer and in strict adherence with the procedures required in this

A disabled vehicle upon a street or highway may be impounded under the following circumstances:
1. If left unattended and improperly parked on street or highway and constitutes a definite hazard
or obstruction to the normal movement of traffic; or
2. If the person in charge of the vehicle is physically incapacitated to such extent as to be unable
to provide for its custody or removal and the vehicle is so disabled as to constitute an obstruction to traffic or
a hazard.

and detained by police under circumstances which leaves or will leave a vehicle unattended on any street or

A vehicle left unattended upon any street, alley or thoroughfare and so parked illegally as to constitute
a definite hazard or obstruction to the normal movement of traffic shall be impounded. (Prior Code, Chapter

A. An unattended vehicle found to be in violation of this code may be impounded when the
required complaint has been properly made and filed as provided in this section.
B. If a violation of the provisions of this code occurs, the owner or legal occupant who complains
shall sign a complaint against the person parking the vehicle on the owner's or legal occupant's property, or
if the identity of the person parking the vehicle is unknown, then the complaint may be Filed against the
registered owner of the vehicle. The complaint shall be verified and shall allege that the complaining party
is the owner or legal occupant of the property upon which the vehicle is parked or standing.
C. Upon filing of the complaint by the property owner or legal occupant, and
if there appears to be proper cause to believe the provisions of this code have been violated, the police
department shall cause the vehicle to be impounded from the property and placed in storage.
SECTION 15 -1410 VEHICLES PARKED OVERTIME.
Any unattended vehicle which has been parked for more than one hour in excess of the time allowed
for parking in any place shall be impounded. (Prior Code, Chapter 20)

' Any vehicle illegally parked in such a manner that it blocks a fire escape ladder, device or exit or blocks
ready access to a fire hydrant shall be impounded.
' SECTION 15 -1412 VEHICLES PARKED IN INTERSECTION.
Any unattended vehicle illegally parked in any street intersection shall be impounded. A disabled
vehicle in an intersection with the person in charge of the vehicle being present, shall be moved out of the
intersection and to the nearest available legal parking space at the street curbing.
A. Whenever a stolen vehicle is located by police and the registered owner cannot be found
' within a reasonable time not exceeding one hour, or cannot be determined from the registration papers or other
identifying media in the vehicle or from records or information available from reports of stolen cars, the
vehicle maybe removed to the nearest authorized place to impoundment and the registered owner of the
vehicle shall be notified of the location of the place of impoundment as soon as possible by the police
department.
' B. . If the registered owner is identified, located and notified of the recovery of the stolen vehicle,
the owner shall be given the right to make his own arrangement for the removal of the vehicle within the
period of one hour from the time he is actually notified of its recovery, and if the owner is unable or unwilling
' to effect the removal within the time specified the vehicle may be impounded.
SECTION 15 -1414 VEHICLES WITH OUTSTANDING TRAFFIC CITATIONS.
Any vehicle for which two (2) or more citations have been issued, pursuant to this code for violation

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR A SUPPLEMENTAL APPROPRIATION TO THE CAPITAL
IMPROVEMENT FUND BUDGET.
Ms Bishop said that the City of Owasso and Tulsa County jointly funded improvements to the
96th St & Garnett Rd intersection. The project, with the exception of fencing, was completed
in December 1996. The fencing portion of the project was completed in November 1997, and
payment for the work and materials made from the Capital Improvements Fund. A supplemental
appropriation from reserves from the FY 1996 -97 Capital Improvements Fund budget (96th St
intersection project) is requested to pay for the fencing portion of the project. Dr Bode moved,
seconded by Dr Standridge, to approve 'an amendment to the FY 1997 -98 Capital Improvements
Fund Budget, providing for a supplemental appropriation in the amount of $7567 to the 96th St
& Garnett Rd intersection project.

Mr Tobias presented the item, stating that the Enterprise Zone program was adopted by the City
Council in October 1994 by resolution. An expansion of that original zone is requested to
facilitate the attraction of a commercial development to the expanded area. The Owasso
Economic Development Authority adopted a resolution in November endorsing the expansion
of the Enterprise Zone. Mr Wilken moved, seconded by Dr Standridge, to approve Resolution
#97 -13, endorsing expansion of the Enterprise Zone.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #97 -14 A RESOLUTION STATING THE CITY COUNCIL'S
REVIEW OF WARD BOUNDARIES AND THE POPULATION CONTAINED
WITHIN EACH INDICATES A POPULATION VARIANCE THAT IS NOT
SUFFICIENT TO WARRANT A CHANGE IN THE EXISTING WARD
BOUNDARIES.
The Owasso City Charter requires that the Council review the wards and their boundaries at
intervals of not more that five years, and revise them to maintain equality in population among
the wards. Mr Ray said that a review of the existing ward boundaries and estimated population
of each has been conducted. It is the opinion of staff that there is insufficient disparity in
population among the wards to warrant a change in the boundaries at this time. Resolution
#97 -14 states that the City Council has reviewed the ward boundaries and the population
distribution within the wards, and finds that there is not sufficient reason to charge boundary
lines at this review. Mr Wilken moved, seconded by Dr Bode, to approve Resolution #97 -14.

to fill a vacancy on the Planning Commission. The unexpired term will expire on June 30,
1998. The mayor requested that Mr Murray Adams be appointed to the Sales Tax Watchdog
Committee, representing Recreation Groups; and that Mr Willard Mills be appointed to fill the
Citizen -at -Large slot on the Watchdog Committee. Mr Helm moved, seconded by Dr Bode, to

REQUEST FOR AN AMENDMENT TO THE CAPITAL IMPROVEMENTS
FUND BUDGET.
Ms Bishop presented the item to amend the Capital Improvements Fund budget by reducing the
appropriation for 86th St - Cedar to Main by $500,000 and increase a transfer to the OPWA
Sales Tax Fund by $500,000, such amendment resulting from the issuance of OPWA Revenue
Refunding Bonds, Series 1997. The 86th St project has been funded by other means.

At the December 16, 1997 meeting, the Owasso City Council approved a request to close a
utility easement located on Lot 1, Block 7, Bailey Ranch Estates.
Attached is a copy of Ordinance No. 564 which formally adopts the City Council's action of
December 16, 1997.
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 564.

AN ORDINANCE CLOSING TO THE PUBLIC USE A PORTION OF A
UTILITY EASEMENT LOCATED WITHIN LOT ONE (1), BLOCK SEVEN
(7), BAILEY RANCH ESTATES ADDITION, AN ADDITION TO THE
CITY OF OWASSO, TULSA COUNTY, STATE OF OKLAHOMA, AND
RETAINING UNTO SAID CITY OF OWASSO, OKLAHOMA, THE
ABSOLUTE RIGHT TO REOPEN SAME WITHOUT EXPENSE TO THE
MUNICIPALITY, AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and expedient
to close to public use a portion of a certain utility easement;
WHEREAS, said utility easement is described as follows:
The northerly 10' utility easement, less and except the westerly 11' of said easement,
of Lot 1, Block 7, Bailey Ranch Estates.
WHEREAS, pursuant to Title II, Oklahoma Statutes, Section 42 -110, the only holders
of a franchise or purported holders of a franchise that may purport to have a special
right or privilege to use said utility easement are Public Service Company of
Oklahoma, and /or Oklahoma Natural Gas Company, and /or Southwestern Bell
Telephone Company, and /or TCI Cable Television Company; and,
WHEREAS, the above holders of franchise or purported holders of a franchise that
may purport to have a special right or privilege to use said utility easement have
waived their objections to the closure of said easement, if any.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT,
Section 1. The following described utility easement, be, and the same is hereby closed to
the public use, to -wit:
The northerly 10' utility easement, less and except the westerly 11' of said
easement, of Lot 1, Block 7, Bailey Ranch Estates.
Section 2. The municipality shall retain the absolute right to reopen the public way or
easement without expense to the municipality. Closing of the public way or ,
easement shall not affect the right to maintain, repair, reconstruct, operate or
remove utility, public service corporation, or transmission company facilities
of service therein, nor shall a closing affect private ways existing by operation
of law unless released in writing by the owners thereof.
Section 3. All ordinances or parts of ordinances in conflict herewith be, and the same are
hereby expressly repealed.

BACKGROUND:
The City of Owasso has received a request from Mr. Larry Pennington for the closing of the
northern 10' utility easement, less and except the westerly 11' of said easement, located within
Lot 1, Block 7, Bailey Ranch Estates Addition (9819 North 115th East Avenue). Unlike
previous requests, this is not a request to close a portion of a utility easement, but rather the
' entire easement itself. A location map and case map are enclosed for your information and
review.
Currently, the subject property is not developed and their are no encroachments into this utility
easement of any kind. The Technical Advisory Committee reviewed the request at the
November 24, 1997 regular meeting and had no objections to the closing request. The Owasso
Planning Commission reviewed the request at their December 9, 1997 regular meeting and
unanimously recommended approval.
Staff has no concerns regarding this request.
RECOMMENDATION:
Staff recommends Council approval of the easement closing request, closing the northern 10'
utility easement, less and except the westerly 11' of said easement, located within Lot 1, Block
7, of Bailey Ranch Estates.

RESOLUTION TO CALL ELECTIONS - COUNCIL WARD 5
December 30, 1997
Pursuant to the provisions of the Owasso City Charter governing the election of City Council
members, the Council shall take action by Resolution to call any necessary Ward Elections.
Such election is needed for the following Ward:
Ward #5 Three Year Term (Michael Helm)
Staff has prepared Resolution #98 -01 which, if approved by Council, calls for an election to be
conducted for this Ward and allows for proper notification to the Tulsa County Election Board.
It also identifies the process that must be followed to meet all legal requirements.
The filing period is February 2, 3, & 4, 1998. All candidates must file a Declaration of
Candidacy with the Tulsa County Election Board between 8:00 a.m. and 5:00 p.m. on one of
those days.
The primary election is set by Charter and will be March 3, 1998. If a general election is
necessary, it will be held on April 7, 1998. A general election will be held if one candidate in
the primary election does not receive a majority of all the votes cast for that Ward. The elected
councilor will be sworn in at the first meeting in May (May 5, 1998).
RECOMMENDATION:
The staff recommends approval of Resolution #98 -01.

WHEREAS, a Primary Election shall be held on the 3rd day of March, 1998 for the

REQUEST FOR APPROVAL OF A CONTRACT FOR
COMMUNICATION CONSULTING SERVICES

In July of this year, selected members of the police and fire departments established a project
work team to review the current communication system and make appropriate recommendations
for improvement. As the research and evaluation phase progressed, it became apparent that the
team was receiving conflicting information from vendors and radio manufacturers. Different
routes of inquiry were pursued yet the project team was not satisfied with the lack of technical
expertise needed for such a large investment. The project team unanimously agreed that an
independent consultant would be able to provide a detailed needs assessment of the
communications system. The goal of this assessment would be to identify the communication
needs of both the police and fire agencies. Upon completion of a detailed needs assessment, the
project team would have additional information to make a radio system recommendation.
REQUEST FOR PROPOSAL:
A request for proposal was completed and sent to independent consultants and major radio
manufacturers. The RFP detailed that a consultant would interview all police and fire personnel
and then make appropriate recommendations as to the type of radio features which would benefit
each agency. Upon completion, a final copy of the features necessary will be submitted to the
project team for approval. The next phase would include a recommendation from the project
team as to the radio system needed to meet the needs of both agencies. On 12 -1 -97, three
proposals were opened by the City Clerk. Estimates were received from:
Ganner Associates $ 125 per hour
Pacific Consulting Services $ 65 per hour
EIS Communications $ 5,000 flat fee

ANALYSIS OF COST:
It is estimated that a minimum of one hundred (100) hours would be needed to complete the '
assessment since approximately ninety (90) people would be interviewed. This number includes
full time paid police officers and fire fighters, dispatch personnel, reserve police officers and
fire volunteers. Based on the minimum number of hours, the comparison costs were as follows: '
1. Ganner Associates $125.00 X 100 hours = $12,500
2. Pacific Consulting $ 65.00 X 100 hours = $ 6,500
3. EIS Communication Flat Fee = $ 5,000
It is expected that the needs assessment will take at least thirty (30) days. After the interviews
are conducted, a needs analysis will occur and a list of the desired features will be prioritized
so that a selection of the best communications system can be made. The radio improvement
team has met with the representative from EIS and was satisfied with his technical knowledge
and ability.
FUNDING:
In July of 1996, the City of Owasso received a one time unanticipated sales tax payment from
a company that had failed to pay appropriate sales taxes during 1994 and 1995. An employee
team was established to suggest uses for this unexpected receipt of funds. The team
recommended that the money be set aside for improvement to the radio communication system.
Approximately $93,000 remains in the budget of General Government, specifically 51- 210 -5441.
If approved, the consultant would be paid with funds from this account.
RECOMMENDATION:
The communications team and staff recommend Council approval of acceptance of Morris Strom '
(EIS Communication) as a radio consultant to provide a needs assessment for both fire and
police personnel, for a cost of $5,000.00. '

The project proposal is to review and evaluate Owasso's radio communication system.
BACKGROUND:

Approximately ten ( 10 ) years ago, the city of Owasso upgraded the fire and police radio system.
The upgrade allowed us change from 150 MHz to 450 MHz UHF frequencies. The upgrade was
necessary due to the fact that the VHF frequencies were over crowded, and our emergency radio
communications were being compromised.
' The upgrade also included purchasing a new radio system complete with both mobile and hand
held radios. However, because the current radio system has surpassed it's life expectancy, we are
1 continually experiencing problems. At the present time our radios are not reliable for emergency
service communications.
I Before submitting a recommendation to your office, a project team has been created to identify
the future needs of the city's radio communication system.
i The project team will review, evaluate, and research the following objectives:
a. Is our present radio system adequate for our future needs? i_e. data transmission,
' reliability, communication with surrounding agencies.
b. What benefits, if any, would an 800 MHz system provide?

initiated at various milestones throughout the project. The Operations Commander will advise the
Mayor, City Manager, Chief of Police, and Fire Chief when the project termination checklist is
completed.

ACTION PLAN.
ObJective:
The Project Team will recommend a radio communication system sufficient to meet the future
needs of the City of Owasso Police and Fire Departments.
Measures of Performance:
Performance will be measured through periodic monitoring, completion of certain key bench
marks, and meeting of the schedule and budget items.

OF THE CITY OF OWASSO'S
RADIO COMMUNICATIONS SYSTEMS
The City of Owasso will accept proposals from qualified telecommunications engineering firms
pursuant to entering into a contractual agreement to provide services as detailed in the attached
request.
All proposals must be submitted in a sealed envelope and clearly marked in the lower left
corner: "Sealed Proposal - Telecommunications Engineering Services ". Proposals must be
submitted to the Owasso City Clerk, 207 S Cedar, Owasso, OK 74055, and must be received
by 3.00 p.m. on Wednesday, November 26, 1997. Proposals may be mailed or hand
delivered.
No proposal will be opened and reviewed until the time specified. It is the responsibility of the
offerer to ensure that the proposal is received by the date and time specified above. Late
submittals will not be considered.
All costs associated with the preparation of a proposal in response to this RFP will be the
responsibility of the offerer and will not be reimbursed by the City of Owasso. All proposals
will be considered without regard to age, race, creed, color, sex, handicap or national origin.
The offerer must include the affidavit on the following page as a part of the submittal.

THE CITY OF OWASSO
' INTRODUCTION
The City of Owasso is currently requesting proposals from qualified telecommunications engineering
' firms to provide services related to engineering and project management of the City of Owasso's
present radio communications to improve upon or replace existing systems. The goal is to study the
needs of the City of Owasso and to develop a comprehensive communications plan that will support
' growth into the 21 st century.
The Engineer will consider all technologies available. Any designs prepared will incorporate proven
' technologies that will improve the efficiency and response time for the Police and Fire Departments.
SCOPE
The engineering firm will analyze independently the current radio systems in use in the Police and Fire
' Departments and provide formal recommendations with regard to improvements or changes. The
engineer will review existing systems, develop and understanding of the Police and Fire departments
overall needs, and prepare a written report to the City of Owasso which will detail all needs and
provide recommendations as to how the City of Owasso should proceed with improvements. The
engineer will coordinate with Police and Fore Departments designated personnel to develop detailed
written recommendations.
The first step in the evaluation process shall be the development of a System Requirements Document
(SRD). This document will define the functional and operational needs of both departments and the
consolidated system needs. The SRD will cover requirements for coverage, control, reliability,
interdepartmental communications, and inter- agency communications for both department are also
to be defined.
In addition to the SRD, the Consultant shall prepare a system design and trade -off analysis (SDTA)
for the City of Owasso. This document will define technical solutions to functional requirements and
will provide budgetary cost estimates for the various solutions proposed.
Following the approval of the SRD and the SDTA by the City of Owasso, the engineer may be
requested to develop a detailed design and prepare the system technical specification to allow the City
of Owasso to procure the system or systems which meet the functional and operational requirements
' of the Police and Fire departments as outlined in the SRD and SDTA.
The purpose of this document is to define the functional and operational needs of both departments
and the consolidated system needs. After review and approval by the City of Owasso of the SRD it
will serve as the definitive document from which the engineer will prepare the System Design Trade
Off Analysis.
The engineer will provide the City of Owasso with drafts of the SRD as it is being developed.
Written comments of the drafts will be provided. The engineer shall incorporate comments that are
germane. As with all projects this size some of the comments that will be provided will be more
relevant to the technical specification, procurement documents or other facets of the project.
Comments of this nature will be noted, but will not be addressed in the SRD. All relevant comments
will be addressed in the appropriate documents.
To prepare the SRD, the engineer will be required to perform the following tasks as a minimum: '
1. Study the structure of various mobile radio systems.

2. Study channel loading for all radio systems.

3. Determine equipment age and projected life. I
4. Review control equipment medium costs.
5. Study dispatcher's equipment and methods of handling traffic.
6. Determine coverage and coverage requirements for Police and Fire department
7. Study maintenance methods and costs.
8. Project radio needs for at least the next 10 years.
9. Make recommendations as to whether existing radio's can be improved.
10. Evaluate possibilities of consolidating mobile radio systems to improve overall operations
and/or to reduce cost.
11. Evaluate technologies such as mobile data terminals, 450, 800, and 900 MI-IZ systems that
may be available to improve overall operations and/or to reduce cost.
12. Interview each of the police and fire personnel to assist in the defining of the needs of the
various departments within the city.
13. Inventory the present system and determine the value of that system in relation to the present
and future needs of the city. Does the old system have a trade -in value and how much ?.

' 14. Present a plan for the dispatch center for the City of Owasso. This would includethecross-
patching, if necessary, to the various groups that need to interact with the City of Owasso,
including 911 service.
15. Examine the issue of redundancy. How will the communications system be exposed during
a system failure. How will the city functions during this outage?
The engineer will compile the data gathered and prepare a detailed report to be used as back up data
for the SRD. It is the intention of the City of Owasso to incorporate all functional and operational
requirements of police and fire departments participating in this project in the SRD.
After approval by the City of Owasso of the SRD, the engineer will prepare the system design trade
off analysis. This document will, as a minimum:
1. Provide the City of Owasso with a written evaluation of current system operation and its
effectiveness.
2. Make recommendations for changes and/or improvements to current systems, prioritized as
to value and need.
3. Provide budgetary cost estimates, including equipment cost, installation cost, engineering and
' project management cost for any recommended changes or additions to radio systems.
4. Provide a plan for proposed implementation of any recommended changes.
5. Provide a costibenefit analysis for any recommended changes.
' 6. Provide an evaluation of the impact on current radio system if a "do nothing" option is
selected.
The engineer will review the SDTA with police and fire personnel, incorporate changes or additions
to the SDTA and prepare a final SDTA for approval by the City of Owasso. The engineer will review
the final SDTA and recommendations with appropriate members of police and fire staff as required.
This RFP covers only the preparation of the SRD and SDTA as outlined above. However, The City
of Owasso may elect to award additional work to the engineer to assist with the detailed system
design and project implementation of any recommended systems. In order for the City of Owasso
to evaluate the engineer's interest in and capability to perform such services, the engineer shall submit
an optional proposal for the services outlined below.
Upon authorization of the City of Owasso, the engineer will develop fully the project work plan and
prepare a detailed system design including a final cost analysis for the proposed changes or
improvements. The engineer will develop the comprehensive specifications for the acquisition,
installation, acceptance tests, and maintenance of the recommended system. The engineer will be
required to analyze any building/office modifications necessary as a result of the recommended system
design, as well as the required interfaces with the existing systems. As part of the engineer will be
required to develop specifications for the training of operations personnel in the use and maintenance
of the communications system. The engineer will provide engineering services throughout the bid
process, to include the conducting of a pre - proposal meeting for interested vendors. The engineer
will develop criteria for evaluation prior to proposals being received by the City of Owasso and
prepare written evaluations of all proposals received based upon these criterion.
An oral presentation may be required by the City of Owasso.
The engineer will review site plans and specifications and will prepare a detailed, time phased
implementation and installation schedule. The engineer will prepare and execute the system cut -over
plan. The engineer will provide all aspects of project management and submit written status reports
to police and fire chiefs on each phase of the project. Additionally, the engineer will keep all
interested parties appraised fully of progress to date, future milestones and target dates, anticipated
problems, and recommended solutions and alternatives.

The following elements shall be included within prospective engineer's proposals:

2. Qualifications and experience in the telecommunications engineering field.
Detailed description of services to be provided.
4. References. Proposer shall include a list of clients indication ability to accomplish a project
of this magnitude successfully and on schedule, in the communications field.
5. Schedule. Proposer shall include a schedule for the preparation of the SRD and SDTA. The
proposer shall also provide a preliminary schedule for the detailed design and project
management of the proposed systems. It is recognized that these schedules will, of necessity,
be very generalized and subject to change depending on final configuration.
6. Alternative Proposals. Proposers are free to propose any alternative strategies to these
specifications. In doing so, they should point out the proposals benefit to the City of Owasso.
This does not relieve the proposer from responding to the requirements of this solicitation.

The City of Owasso is faced with a decision to select a communications system that will
most likely be used for the next 10 -15 years. The task for the project engineer will be to
develop options that will enhance the selection process for the City of Owasso. To
accomplish this task the engineer will have to know the exact requirements and needs of
each of the departments within the structure of the city. The results of this process will be
a report called the SRD (Systems Requirements Document) as defined in the RFP issued
by the City of Owasso. As a result of the SRD the next step will be the development of
SDTA (System Design and Trade -off Analysis) which will outline the system options that
are available to the City of Owasso. All of these reports will be developed with the
coordination and input from the Fire and Police Departments. The development of the
SDTA will be the creative process that will provide system options that will carry the City
of Owasso's communication system beyond the year 2000. Upon development of the
SDTA Owasso will retain the engineer as a project designer and project manager.
Morris D. Strom and EIS Communications have been involved in the communications
industry for more than 20 years. Mr. Strom has a degree from OSU obtained in 1976 and
has installed equipment from just about every manufacturer of equipment that is available.
Today, we represent Motorola, Ericsson/GE, Kenwood, Midland, Maxon, Standard, and
Tait. In addition to these equipment choices we have shipped systems and equipment all
over the world. EIS was involved in developing communication equipment for the fueling
system for the U.S. Army used in Desert Storm. Morris Strom and EIS have the
experience to bring a real "smorgasbord" of choices and experience to the table. We will
help the City of Owasso process and refine these choices to develop a system that best
suits Owasso beyond the year 2000. The vast experience that Morris Strom and EIS bring
to the table qualify them to be your "radio advocate ". We are not representing one system
or one design but the commitment to wrap the design of the system around the needs of
Owasso. This advocacy approach truly represents the needs of the city because we are
not proposing that the city fit a mold that has been established by other organizations,
unless this is in the best interest of Owasso. Morris Strom and EIS are very qualified to
design System 2000 for the City of Owasso.

' Description of Services
In addition to the development of SRD and SDTA that comply with the specifications
listed in the attached RFP the use of demo equipment will be a part of the process. Many
of the systems that will be evaluated have the option of using demo equipment to
determine how the equipment will work in a true work application. The exception would
be large items such as dispatch consoles and items that are not mobile. Also, EIS has
successfully used video in our presentations which illustrates the message more effectively.
You can expect video to be used by EIS to illustrate situations that require visual
illustration.

Concerning the work beyond the development of the SRD and SDTA, which would be the
actual specification development, site selection, equipment selection, building
requirements, and installation, the engineer would serve as the "advocate" that would
simply represent the needs of the City of Owasso. This would include the monitoring of
the bid process and more importantly the monitoring the installation of equipment. There
are so many short cuts that can be made that "meet specs" but are not in the interest of the
City of Owasso. Mr. Strom will only accept work that is first rate and will enhance the
quality of the Owasso Communication System. In addition to the quality control issues
we have found since Mr. Strom and EIS are in the business of developing radio system
around the world we are able to "smart buy ". We have often saved the cost of our fees by
the methods and sources we use to purchase equipment. The challenge we have is to
design and supervise the construction of a state of the art system while paving for our
services with the savings we brina to the table with our purchasing knowledge. In other
words we like for our services to be "self funding ". The City of Owasso can only win in
this environment.

The above listed references are clients that we have developed systems for and have
several years of experience with our organization. A conversation with these people will
define the commitment that Mr. Strom and EIS make to their clients. If more names are
needed, please advise.
Upon acceptance of this proposal the SRD should be developed in 60 days with the SDTA
developed in an additional 30 days. The detailed design should take another 30 days with
the total project being ready for the bid process in 120 days. The issue of channel
availability and licensing can cause some problems. If this process determines that
Owasso needs to get more channels we will have to enter the application process to have
channels assigned to the City of Owasso. This is the area that we lose control of the
project. Many times we have had frequency selection take months, and other times it has
moved rather smoothly. Getting equipment and labor to do the installation is not the
problem, it is getting the frequencies that can slow the process. A good estimate for the
installation of the equipment after we have frequencies would be 90 days. Most
equipment can be built in a 30 -45 day period if it is specialized and add another 30 -45
days for the installation and testing. Most of the equipment with the exception of consoles
and some specialty items are stocking items that would only take 2 -3 weeks to have on
site. Again, this is only speculative since we are not sure what the studies will reveal what
Owasso needs.
' The City of Owasso has chosen the correct path in developing a study for the selection of
a communications system. From a service vendor we are finding that our business is
' changing in that we are being asked to set on the clients side of the table more and more
often. We are being retained by many companies to be an advocate for their radio needs
and represent them in making the correct choices for the radio system. We are enjoying
' this process as we are able bring many years of experience while still providing our clients
with quality communication systems.
Pricing/Bid
IOur fees for developing the SRD and SDTA would be $5,000. The cost of a detailed
design and the project management would be 7% of the total project.
