Attachment #6-C The staff recommends approval of an agreement with Public Service Company of Oklahoma to furnish, install, maintain and operate electric street, highway, and other area lighting requested by the city. D. Action Relating to a Request for Council Acceptance of a Grant to Fund the Purchase of a Commercial .Refrigerator for the Community Center. Attachment #6-D The staff recommends Council acceptance of a grant from the Tulsa Area Agency of Aging in the amount of $3880 to be used for the purchase of a Hobard Commercial Refrigerator for the Community Center, and authorization for the Mayor to execute the document. i i E. Action Relating to a Request for a Supplemental Appropriation and Amendment to the General Fund Community Center Department Capital Outlay Budget. Consideration and Appropriate Action Relating to a Request for the Expenditure of Funds ' to Purchase a Vehicle for the Engineering Division and a Vehicle for the Streets Division, Such Purchases Utilizing the State of Oklahoma Bid List Contract Number SW80035; and Authorization for Payment. ' Mr Carr Attachment #7 ' The staff will recommend contracts, as provided by State of Oklahoma Department of Central Services Contract Number SW80035, be awarded to Larry Spencer Chevrolet, Norman, OK in the amount of $14,494.97 for the purchase of a 1998 Chevrolet 5-10 ' extended cab pickup truck for the Engineering Division; and in the amount of $17,036.13 for the purchase of a 1998 Chevrolet 3/4 ton pickup for the Streets Division; and authorization for payment. The staff concurs with that recommendation. 14. Consideration and Appropriate Action Relating to a Workers Compensation Claim for ' Hearing Loss, and Authorization for Payment. Ms Guthrie Attachment #14 The staff will recommend Council approval of a payment in the amount of $1998 plus associated taxes, fees and costs, for a hearing loss claim by David M Sole, Owasso Fire Department paramedic/firefighter, per workers compensation court order #97-14136F, representing a 4.4 % binaural hearing loss. ~ Owasso City Council January 20, 1998 Page 6 i 15. Consideration and Appropriate Action Relating to a Workers Compensation Claim fora ~ Neck Injury, and Authorization for Payment. Ms Guthrie See Attachment #14 The staff will recommend Council approval of a payment in the amount of $19,383 plus ~~ associated taxes, fees and costs, to be paid over a period of 91 weeks, for a neck injury claim by David M Sole, Owasso Fire Department paramedic/firefighter, per workers compensation court order #97-4526X, representing a 20% permanent partial disability to '„ the body as a whole. 16. Consideration and Appropriate Action Relating to a Request for Council Approval to Employ the Firm of Lioness Realty Group Inc for Professional and Technical Services Associated With the Location and Construction of a City Hall Facility. Mr Ray Attachment #16 The staff will recommend Council authorization for the Mayor to execute a letter of agreement between the City of Owasso and Lioness Realty Group for professional services relating to the construction of a city hall facility, such agreement providing for a scope of work and further providing for compensation not to exceed $13,200, plus expenses not to exceed $2600. 17. Consideration and Appropriate Action Relating to a Contract Renewal Agreement with the Local Government Testing Consortium for the Purpose of Serving as aThird-Party Administrator to Assist in Compliance With Federally Mandated Random Alcohol and Drug Testing. ~ Mr Harder Attachment # 17 The staff will recommend Council approval of a contract renewal agreement with the Local Government Testing Consortium to serve as athird-party administrator for federally rr mandated random alcohol and drug testing of all employees who are Commercial Drivers License (CDL) status and "safety sensitive" employees. is ~~ i Owasso City Council January 20, 1998 Page 7 PUBLIC HEARING 18. Consideration and Appropriate Action Relating to a Request for Approval by the City Council, Sitting as the Retirement Committee, for Disability Retirement. Mr Harder Attachment # 18 The staff will recommend that the City Council, in their capacity as the Retirement Committee, approve a request from George Haley for disability retirement for both the Thrift Plan and the Defined Benefit Retirement Plan. 19. ITEM 1: CALL TO ORDER Mayor Barnhouse called the meeting to order at 7:02 p.m. ITEM 2: INVOCATION The invocation was offered by Councilor Mark Wilken ITEM 3: FLAG SALUTE ' Councilor Mike Helm led in the flag salute. ABSENT Tracy Standridge, Vice Mayor ITEM 5: REQUEST BY CITIZEN TO ADDRESS THE CITY COUNCIL. Ms Libby Stators addressed the Council regarding alleged parking violations on the street in front of her home. She has a concern that the ordinances are vague and are not being enforced. Ms Staton's complaint regarded a specific incident, but she also said that it is an ongoing problem. Mr Ray proposed that a committee be formed to review the city's parking ordinances. That committee will be chaired by Community Development Director Tim Rooney, and will include police officers, the city attorney, code enforcement officers, council members, and two citizens. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of the Minutes of December 16, 1997 Regular Meeting and December 22, 1997 Special Meeting. A Owasso City Council January 6, 1998 ~ B. Approval of Claims. C. Action Relating to Ordinance #564, an Ordinance Providing for the Closing of a Portion of a Utility Easement Located on Lot 1, Block 7, Bailey Ranch Estates. D. Action Relating to Resolution #98-01, a Resolution Calling aNon-Partisan Primary and General Election Pursuant to Provisions of the Owasso City Charter for the Purpose of Electing Council Member for Ward 5. The consent agenda included minutes of the December 16, 1997 regular meeting and December 22, 1997 special meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $33,554.03; (2) Workers' Comp Self- Insurance Fund $3,302.06; (3) Ambulance Service Fund $1,302.72; (4) E-911 $1,871.79; (5) City Garage $4,365.68; (6) Capital Improvements $39.79; (7) Interfund Transfers $33,995.08; (8) Payroll $137,729.59; (9) City Garage Payroll $3,311.73; (10) Capital Improvement Fund Payroll $2,003.52. Item C requested approval of Ordinance #564, relating to an easement closing and formally adopting the City Council's action of December 16, 1997. Item D requested approval of Resolution #98-01 calling for an election to be conducted for a Ward 5 Councilor for athree-year term, and notifying the Tulsa County Election Board. Dr Bode moved, seconded by Mr Wilken, to approve the consent agenda. AYE: Bode, Wilken, Helm, Barnhouse NAY: None Motion carried 4-0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF A CONTRACT BETWEEN THE CITY OF OWASSO AND EIS COMMUNICATIONS, TULSA, OK; SUCH CONTRACT FOR THE PURPOSE OF PROVIDING EMERGENCY COMMUNICATIONS CONSULTING SERVICES TO THE CITY'S POLICE AND FIRE DEPARTMENTS. Chief Alexander presented the item relating to the selection of a consultant to review the police and fire communication systems and make recommendations for improvements. A Request for Proposal was developed and sent to independent consultants and major radio manufacturers. The RFP detailed that a consultant would interview all police and fire personnel and then make appropriate recommendations as to the type of radio features that would benefit each agency. Proposals were received from Ganner Associates, Pacific Consulting Services, and EIS Communications. Ganner Associates and Pacific Consulting Services both quoted aper-hour cost, while EIS Communications proposed a flat fee. A minimum of 100 hours has been estimated as needed to complete the work. Using 100 hours as a guideline, EIS Communication's flat fee is the lowest cost of the three. Mr Wilken moved, seconded by Dr Bode, to approve a contract in the amount of $5000 with EIS Communications for the 2 Owasso City Council January 6, 1998 purpose of reviewing the Police and Fire Department communications needs as outlined in a Request for Proposals issued on November 4, 1997. ITEM 1: CALL TO ORDER AND ROLL CALL. Mayor Barnhouse called the meeting to order at 6:44 p.m. Councilors present: Mary Lou Bariiliouse, Mayor; Tracy Standridge, Vice Mayor; Mike Helm, Councilor; Denise Bode, Councilor. Councilors absent: Mark Wilken, Councilor. ITEM 3: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PERSONNEL MATTERS RELATING TO THE OFFICE OF THE CITY MANAGER SUCH EXECUTIVE SESSION PROVIDED FOR IN O.S. 25 SECTION 307(B)(1). Cam' ~~ PUBLIC WORKS DIRECTOR~.!~ SUBJECT: AGREEMENT FOR MUNICIPAL STREET LIGHTING SERVICE (PUBLIC SERVICE COMPANY OF OKLAHOMA) DATE: January 13, 1998 BACKGROUND: Initially, on July 1, 1987, the Owasso City Council approved a contract with the Public Service Company of Oklahoma (PSO) for the purpose of providing street lighting services to the city of Owasso. A resolution was approved in September 1991. authorizing additional street lighting to be added to the contract. and an Agreement was drafted to cover the period of July 1, 1996 to June 30, 1997 that was approved by Council on February 20, 199b. In order that both the City and PSO can accurately account for billing and placement/relocation of street lights, the Agreement has been modified to cover the period of July 1, 1997 to June 30, 1998. In October 1997, an initial Agreement was prepared. for presentation to Council. At that time an amendment was proposed to enable extension of the Agreement at the end of the fiscal year. The amendment included the following wording: If an in the event Company and Customer have not entered into a successor agreement prior to June 15, 1.998, then, in such event, Customer, at the next regular meeting of the governing body of the Customer, or as soon as practical thereafter, shall take affirmative action to extend this agreement into the succeeding fiscal year of Customer. Company hereby agrees to be bound by any necessary extension of this agreement until such time as a successor agreement is entered into. PSO has agreed. to the amendment and has revised the Agreement. The contents of the Agreement have been reviewed and approved by the City Attorney. PRESENT LIGHTING INVENTORY• A total of 809 lights are presently in use within the city limits (a total of 7241ights were included in the FY96-97 Agreement). All of the present inventory are sodium vapor lights. These lights are less costly to operate than the old-style mercury vapor lights. Page 2 PSO Lighting Agreement NOTE: Public Works Department staff is charged with the responsibility to verify the need for street lighting when requests are made. The basic purpose of street lighting is for traffic safety, with a secondary purpose of neighborhood safety and security. Requests for lighting in these areas are made through the Public works Department. Installation of additional lighting are authorized in writing by the Public Works director and PSO will not install lights without the authorization. OPERATION COSTS: The rates for municipal street lighting are set by the Oklahoma Corporation Commission. MAINTENANCE Company shall exercise reasonable care in maintaining all said street, highway and other area lighting facilities. Company shall perform necessary repairs and maintain and operate all street, highway and other area lighting at the expense of the Company except in the case of unavoidable occurrences beyond the Company's conVol. Customer shall diligently report to the Company all lighting facilities that aze not operating. Company shall use diligence in repairing these non-operating lighting facilities during normal business hours. RELOCATIONS Customer may submit a written request authorized by the appropriate officials for the Company to relocate lighting facilities. Company will be reimbursed by the Customer for all costs associated with the requested relocation except to the extent such costs would otherwise have been paid by Company pursuant to the franchise between Customer and Company. TITLE Company retains full title to all lighting facilities heretofore or hereafter installed for the Customer under this contract.. The vendor making repairs to the refrigerator has advised that repairs will continue to be needed because of the age of the equipment. During the summer of 1997, staff began looking at the possibility of purchasing a new commercial refrigerator and, as a part of the process, requested quotes from three vendors. '~ In August, staff learned of grant funds available through the Tulsa Area Agency on Aging. Part of the consideration for the grant is that the equipment be used by the Senior Citizens Nutrition Program. On August 25, 1997, a grant.application was submitted for funding to purchase a new refrigerator. Confirmation of a grant award in the amount of $3880 to be used to purchase a ~ new Hobard Commercial Refrigerator was received on December 10, 1997. REQUEST: The staff is requesting that the City Council accept a grant from the Tulsa Area Agency on Aging in the amount of $3880, for the purpose of acquiring a Commercial Refrigerator for the Community Center. Staff further requests Council action to approve a supplemental appropriation and amendment to the General Fund Budget, wherein estimated revenues are increased by $3880, and expenditures in the Community Center Department Budget (Machinery & Equipment line item) are increased by $3880. In the near future, the staff will present a request asking for Council action to declare the old refrigerator surplus to the needs of the City, and authorize that it be donated to the Owasso Senior Citizens Foundation, to be sold as a fund raiser; and a request to purchase a new refrigerator based on a bidding process to be conducted subsequent to acceptance of this grant. The Tulsa Area Agency will fulfill it's responsibilities of monitoring and evaluation of Oklahoma Senate Bill 109-Community Enhancement of Nutrition Assistance (CENA) by requiring s and completing the following: On-site visit(s) will be made quarterly by Tulsa Area Agency on Aging Planning Staff to visually assure that all Alterations/Renovations, equipment and furniture purchases and other center specifics were completed in a timely fashion regarding quality, etc. and that specifics continually being used to meet purpose of grant. Copies of receipts are due, when requested, to Tulsa Area Agency on Aging, as verification, for purchases or work completed Review of expenditures to assure complete distribution of funding for specific. purposes as stated in "Purpose of the Contract". The Tulsa Area Agency on Aging will submit all programmatic and financial reports required by the Special Unit on Aging no later than September 30, 1998. ^ The contractor will maintain adequate and separate accounting and fiscal records and account for all funds provided by any source to pay the cost of the project and to permit audit and/or examination of all such records, procedures and accounts at any reasonable time by authorized personnel of the U. Vehicle specifications for each division were based on the following criteria: ' En 'ngn eerin~ Personnel in the division normally require transportation within the city. Work typically is performed using sensitive light-weight equipment that should be transported and stored inside the vehicle. At times, other large equipment and materials may need to be transported. Amid-size extended cab pickup truck is appropriate for this division. re is Most work performed by personnel in this division consists of hauling equipment, tools and personnel to work. sites within the city. Periodically, towing a small trailer may be required. Vehicles in the division are used by a variety of persons on a daily basis. Hauling capabilities are consistent with a 3!4-ton pickup. An automatic transmission will provide the power needed for daily applications and enable use by a variety of persons. Wastewater Collection Work performed by personnel in this division consists of hauling heavy equipment, repair supplies, tools and personnel to work sites. Sites maybe in remote areas. Regularly, atrailer-mounted water pressurized jet rodding machine is used to clear sewer blockages. Power to adequately tow the rodding machine can be provided using a 5-speed manual transmission. Hauling capabilities are consistent with a 3/4-ton pickup. Page 2 Public Works Department Vehicle Bids Refuse Collection Work performed by personnel in this division consists of hauling polycarts for residential and commercial refuse collection. Delivery of new or replacement carts are performed daily in all areas of the city. Hauling capabilities are consistent. with a 3/4-ton pickup. An automatic transmission will provide the power needed for daily applications and enable use by a variety of persons. BIDS: In order to provide potential bidders an attractive bid package, staff initially prepared a bid specification that included all four vehicles. The specifications indicated the vehicles were to be the "current model year". Bid packages were sent to fourteen (l4) potential vendors on October 1, 1997. Bids were received on October 27, 1997 from four (4) vendors. In addition, staff called vendors on the State of Oklahoma bid tilt to determine availability of vehicles. Two (2) Oklahoma City vendors provided quotes. All bids exceed budgeted amounts. At the November 18, 1997 CounciilOPWA meeting all bids were rejected. As a result of the above, staff contacted the State of Oklaharna and obtained a copy of the FY98 state vehicle bids. The available bids were evaluated for mid-size and 3/4-ton pickup trucks. The bid for the 3/4-ton manual transmission pickup is recommended to be awarded to Larry Spencer also. Award to one vendor will facilitate coordination of delivery and warranty repair. Delivery is expected within 120 days of receipt of the order. FUNDING SOURCE: Funds for the purchase of these vehicles are included in the FY97-98 Capital Outlay Budget for each division. CITY OF OWASSO FROM: TIMOTHY ROONEY COMMLThiITY DEVELOPMENT DIRECTOR SUBJECT: REZONING AND PLANNED UNIT DEVELOPMENT REQUESTS OZ-98-03, OZ-98-04, OZ-98-05, OPUD-98-O1 DATE: January 14, 1998 BACKGROUND: Lindsey Management of Fayetteville, Arkansas has requested approval of three rezoning requests and a Planned Unit Development application. The subject property contained within the PUD, of which the rezoning requests are a portion, contains 288 acres of undeveloped property located within the square mile section bounded by E. 76th Street North, E. 86th Street North, N. 129th E. Avenue, and N. 145th E. Avenue. The applicant's requests, if approved, would allow for the development of multi-family housing, an 18 hole golf course, and single-family housing. The three zoning cases would establish needed underlying zoning within the subject area to permit the implementation of the proposed PUD. OZ-98-03, OZ-98-04, and OZ-98-O5, if approved, would establish 80.53 acres of RM-1 (Residential Multi-Family Low Density), 165.29 acres of OM (Office Medium), and 39.68 acres of RS-1 (Residential Single-Family Low Density) underlying zonings. The Owasso Planning Commission reviewed the requests at their January 13, 1998 regular meeting. At that meeting, the applicant presented the proposal to the members of the Planning Commission and also received comments and questions from approximately 60 interested citizens. After hearing all concerns and answering all questions, the Planning Commission received the staff presentation and recommendation regazding the four requests and acted on each item separately. The Planning Commission unanimously recommended approval of OZ-98-03 and OZ-98-04 as recommended by staff. The Planning Commission recommended approval of OZ-98-OS by a 4-1 margin. OPUD-98-O1 was also unanimously recommended for approval by the Planning Commission with an additional condition that the "squaze footage of all homes within the single- family azea be a minimum of 2,250 square feet." That condition has been added to the staff report which is attached for your information and review. In review, the request by the applicant consists of three rezoning requests to establish the needed underlying zoning patterns, followed by the Planned Unit Development request. Separate action will be required on each zoning, followed by the Planned Unit Development. Staff will present separate recommendations for each request. Staff Report CITY OF OWASSO Community Development Department OPUD-98-O1 OZ-98-03, OZ-98-04, OZ-98-OS Staff Report GENERAL INFORMATION The applicant, Lindsey Management of Fayetteville, Arkansas has submitted to the City of Owasso a Planned Unit Development for review. The Planned Unit Development subject property consists largely of a majority of the undeveloped land bounded by E. 76th Street North, N. 129th E. Avenue, E. 86th Street North, and N. 145th E. Avenue. The approximate size of the entire property is 288 acres, more or less. The PUD proposes a mixed use development, consisting of apartments, a golf course, single-family housing, and office development. Accompanying the PUD application are three separate zoning cases that would establish the underlying zoning that is necessary for the implementation of the PUD. These cases involve rezonings to RS-1 (Residential Single-Family Low Density) for the single-family housing area, OM (Office Medium) for the Golf Course development, and RM-2 (Residential Multi- Family High Density) for the multi-family development. Because all four requests (OPUD-98-O1, OZ-98-03, OZ-98-04, OZ-98-OS) are interrelated, staff has prepared one memorandum to review all requests. Please note however, that action on each request will need to occur separately, with the zoning requests proceeding the PUD requests. CONCEPT OF A PUD The concept behind a Planned Unit Development is to provide a creative alternative to a ' conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity ' and flexibility than could be achieved by traditional zoning in planning and development of large parcels of land. "" The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete coordinated plan of development for a large parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND OPUD 98-O1 is 288 acres in size, all of which is undeveloped. The current zoning of the subject tract consists of RE (Residential Estates), RS-2 (Residential Single-Family Medium Density), RS-3 (Residential Single-Family High Density), RD (Residential Duplex), CS STAFF REPORT OPUD-98-O1 PAGE20F10 (Commercial Shopping Center), and OL (Office Light). The largest portions are zoned RS-2 and RE. "~1 Portions of the subject tract are abutted on the west by the Owasso Sixth Grade Center and N. 129th E. Avenue, while farther west lies the Elm Creek Estates and Double Oaks Additions. Northern portions of the subject tract are bordered by large commercial tracts of land zoned CS (future site of Albertsons and a strip shopping center), OL zoned property, the property formerly utilized as the dairy, and an additional site for a future church development. Farther north lies E. 86th Street North, and the Owasso High School, the Owasso Eighth Grade Center, Brentwood Estates and Brentwood Park (RS-2) and the Silver Creek Development (PUD). The subject tract is bordered on the east by the planned location of N. 145th East Avenue, while farther east lies Pamela Hodson Elementary School and several large lot residential additions in Rogers County. The subject property is bordered on the south by E. 76th Street North, Graceland Acres (Tulsa County), and the Copper Meadows Addition (zoned RS-3). Case maps indicating both the proposed and existing zoning are included within the applicants text submittal within your packet. The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and Text. The plan and text call for the development of 80.53 acres for multi-family housing with an underlying zoning of RM-2, 165.29 acres for golf course development with an underlying zoning of OM (Office Medium), and 42.70 acres for single-family housing with an underlying zoning of RS-1 (Residential Single-Family Low Density). STAFF ANALYSIS Because PUD's are not a normal agenda item at every Planning Commission and Ciry Council meeting, I feel it is important to establish a quick review of the PUD requirements and process. The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: (1) Whether the PUD is consistent with the Comprehensive Plan. (2) Whether the PUD is in harmony with the existing and expected development of surrounding areas. (3) Whether the PUD is a unified treatment of the development possibilities of the project site. (4) Whether the PUD is consistent with the stated purpose and standards of the PUD Ordinance. !I .i i ~ ~A STAFF REPORT OPUD-98-O1 PAGE30F10 (a) Permit innovative land development while maintaining appropriate limitation on the chazacter and intensity of use assuring compatibility with adjoining and proximate properties; (b) Permit flexibility within the development to best utilize the unique physical features of the particular site; (c) Provide and preserve meaningful open space; (d) Achieve a continuity of function and design within the development. CONSISTENCY WITH COMPREHENSIVE PLAN The Comprehensive Plan is implemented through the use of the zoning process. This means that when zoning or PUD requests are presented to the Planning Commission and City Council, they should be consistent with the Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the majority of the subject tract to be developed as Low Density Residential. In addition, portions of the subject tract located in the southeast and northeast corners aze designated to be utilized as Medium Density Residential and Commercial-Office. The applicants submittal, if applied directly to the comprehensive plan as it was developed in ~ 1978 and updated in 1985, would have difficulty being consistent with the comprehensive plan in large portions of the proposed development. However, when one reviews the ~'' submittal more closely, as well as the existing growth patterns in Owasso and the subject ,~ azea specifically, the proposal by the applicant makes sense. ~ While a lazge portion of the tract would be developed at no density with a low intensity use ,~ (165.29 acres for golf course development) which easily can be determined to be consistent ~ with the comprehensive plan, another large portion of the tract (80.53 acres) is being proposed for multi-family development at a high density. While not conforming to the P comprehensive plan adopted in 1978 and updated in 1985, this type of use in this location makes sense. The utilization of multi-family housing azound golf course development has become quite common in the development arena, and makes even more sense when one r considers that the apartments would be located between the eventual commercial development ~ that is likely along the E. 86th Street corridor and the proposed golf course. '~"' Additionally, multi-family housing proposals typically create a lazge number of protestants from neighboring single-family housing additions. In this proposal, existing single-family housing located within the square mile section (Copper Meadows) is buffered from any ^ STAFF REPORT OPUD-98-O1 PAGE 4 OF 10 multi-family housing by the proposed golf course. This plan of development helps to ensure a more harmonious interaction between those two very different but yet needed housing alternatives within our community. Staff would recommend, however, that the golf course be required to be substantially completed prior to the occupancy of any multi-family unit. In short, while not identified in the 1978 or 1985 comprehensive plan as an area that would be conducive to higher densities of residential development, the improvements to the transportation infrastructure of E. 86th Street North since 1985, and the residential development that has occurred (Copper Meadows, Double Oaks, Elm Creek Estates, Brentwood Park, Brentwood Estates, Barrington Estates, and Silver Creek), and the commercial development that has and is planned to occur makes this area an attractive and logical location for multi-family housing and a golf course. The growth pattern that has occurred in Owasso could not have been anticipated in 1985 and to apply the outdated plan in this area would not be productive. With the above facts in mind, it would be staff's opinion that the applicants submittal, while ,~, not necessarily adhering to the Comprehensive Plan, is consistent with the goals of any comprehensive plan and its guidelines to ensure quality development. Harmony With Existing and Expected Development Any large development such as the proposed PUD is going to create changes within a ~ community and new demands will be placed upon our existing infrastructure. It is important to note, however, that in a community like Owasso, this growth would be likely to occur regardless of this development. The PUD simply has the potential to increase the demand for services more quickly and therefore shortens the schedule for determining solutions. _ While it is the opinion of staff that the harmony of land uses for both existing and expected development has been creatively addressed by the applicant with the utilization of the golf course between the existing and planned single-family housing and the proposed multi-family housing within the square mile section, the amount of vehicular and pedestrian traffic that a large multi-family complex is likely to generate could create problems. The applicant is proposing four separate access points from the multi-family and golf course area to section line roads. One access point is proposed along N. 129th E. Avenue near the E. 84th Street North area. Two access points are proposed along E. 86th Street North (one near the Eighth Grade Center Access Drive and the other about 550 feet west of the N. 145th E. Avenue intersection). The final access point is planned about 1,500 feet south of E. 86th Street North along N. 145th E. Avenue. A review of the amount of the proposed ~ ingress/egress points for the multi-family and golf course area indicates those points to be well planned and a good manner in which to distribute the vehicle traffic loads. ' STAFF REPORT OPUD-98-O1 ' PAGE 5 OF 10 ~ The planned access from E. 86th Street North near the Owasso Eighth Grade Center, however, does create some concern for staff. While the idea of providing access to the multi-family/golf course area at this point along E. 86th Street North is a good one, the relationship with this proposed access and the Eight Grade Center's access is not. Staff rr/ would prefer that these two access points (the Eighth Grade Center's and the access proposed by the developer) not be offset any distance at all. While the Eighth Grade Center's access ' - is currently problematic, improvements could be realized to this access point through the acceleration/deceleration lanes that would be required of the applicant and a widening of the turning radius on the school's site. Additionally, the creation of left turn lanes for east and ~"1q westbound traffic, as well as signalization, would be of benefit to the school and the applicant in addressing those traffic problems. The planned signalization improvements at N. 145th E. Avenue and E. 86th Street North will greatly enhance the movement of traffic at the other access point proposed along E. 86th Street North and the access point planned along N. 145th E. Avenue. Staff feels that by requiring the following, a majority of vehicular and pedestrian traffic concerns can be addressed: 1. Acceleration/deceleration lanes at each access point along the arterial streets. 2. The inclusion of sidewalks along the abutting arterial streets and the interior drives within the proposed development 3. The realignment of the E. 86th Street access near the Eighth Grade Center, eliminating the offset. 4. Left turn lanes for both east and westbound traffic along E. 86th Street North at the Eight Grade Center access location 5. signalization at the Eighth Grade Center access location. In addition, Mr. Karl Fritschen (City's Comprehensive Planner) also conducted a trip generation study for the PUD proposal. The study, utilizing existing vehicle counts and trip generation rates obtained from the Bureau of Transportation Statistics through the US Department of Transportation, is attached for your information and review. The results indicate that at build-out, the total project (golf course, multi-family, and single-family) would generate 6,509 vehicle trips per day at the proposed densities (RM-2 and RS-1). If the density of the multi-family area is lowered to RM-1 rather than RM-2, the total project would generate 5,815 vehicle trips per day. It is staff's opinion that it may be in the best interest of the city to reduce the proposed density and underlying zoning from RM-2 to RM- STAFF REPORT OPUD-98-O1 PAGE 6 OF 10 1. This would reduce the number of multi-family dwelling units from 936 to as low as 800, reduce the number of estimated vehicle trips from 6,509 to 5,815, and place less of a strain on the existing infrastructure in the area. While it can be argued that the total amount of dwelling units (multi-family and single- ~'_ family) proposed by the applicant is less than if it developed under the property development -~ standards of the existing zoning pattern, the concentration of vehicles that will result from 80.5 acres of multi-family development is greater than if the entire parcel were to develop at the various densities of single-family zoning currently existing. Leal, Planning and Site Engineering While the applicant has stated within the application that three detention areas will be incorporated into the site in order to address their drainage needs, staff would recommend the requirement of a detailed drainage report and certification of such document by an engineer at time of platting. If the report indicates that a larger drainage detention area is needed, a result of fewer single-family residential lots is likely to occur. Typically, these items are addressed during the platting stages of the subject property. Internal street patterns and the connections appear to be of a logical and sensible pattern, with access being provided to an out parcel located northeast of Graceland Acres. An additional parcel of land, immediately north of that parcel, remains to be addressed. It is staff's understanding that the applicant is currently in the negotiation process in order to obtain that property. Please note if that property is not purchased by the applicant, access to that parcel will need to be provided during the platting stage in order to prevent the creation of a land locked parcel. The lot layout proposed within the PUD conceptual development plan is relatively simplistic in nature and would appear to meet the requirements of the Owasso Subdivision Regulations. Please be advised, however, that lot layouts can change and that this submittal is conceptual in nature. Further review of the lot layout would occur at the time of preliminary plat stage. ^ Unified Treatment of the PUD Subject Area A review of the applicant's Illustrative Site Plan for "The Greens at Owasso" fmds an excellent utilization of the project site. As stated within the applicant's submittal, drainage within the undeveloped project site is split, with a large area draining from the northwest to the east and from the southeast to the north in the area identified for single-family development. The utilization of the existing drainage channel bed by developing it into a ~ ~ STAFF REPORT OPUD-98-O1 PAGE70F10 detention pond is appropriate. In addition, much of the needed detention, as is typical with golf course development, is likely to be provided within the low points of the golf course itself. Although it may not be necessary at the time a large majority of the residential development occurs, staff will recommend the applicant be required to provide detention for the proposed office development area located in the northeast corner of the subject property. This could be realized through a detention basin contained within the proposed park or on-site detention at the time of any office development. 4, As staff has indicated in the past, as well as earlier within this report, the importance of some form of buffer between land uses of varying intensities cannot be stressed enough. The applicant has provided a substantial buffer between existing single-family housing within the square mile section and the proposed multi-family via the development and placement of the golf course. Residential areas on the north side of E. 86th Street North have also been f provided a buffer by the applicant through a landscape buffer shown on the conceptual 1~, layout. However, staff remains concerned that the multi-family residential areas located south of the planned commercial development not contained within this proposal, as well as the single-family residential areas immediately west of N. 129th E. Avenue, have not been afforded that same opportunity. ' Often times, conflicts between the two different land uses occur, usually resulting in an unhappy resident more often than an unhappy commercial business. A large part of a Planner's responsibility is not only the "technical" review of a proposed development but also to anticipate any potential conflicts which could arise. While there is no specific buffer requirement, staff has recommended the utilization of more dense landscaping as buffer's in ~ the past. While the area surrounding the proposed commercial development is certainly not single-family development, staff still feels some form of buffer in addition to the Zoning Code's requirement of a 6 foot "privacy" fence should be included for those future multi- family residents, as well as those single-family residents west of N. 129th E. Avenue. Staff recommends that detailed landscaping plans (type, species, size, location, irrigation) be required to be submitted for those areas identified (the north boundary and the west boundary along N. 129th E. Avenue) with the final plat. Said landscaping plans would then be reviewed by staff to ensure that compatible relationships between the differing uses are maintained and protected. Staff would also recommend that the Planning Commission review and approve these plans. While PUD submittals are often times complex in nature and not easily understood, the use of the concept can be extremely beneficial in two significant matters. The first, is it allows for staff, Planning Commission, Council and most importantly -citizens - to see a complete STAFF REPORT OPUD-98-O1 PAGE 8 OF 10 picture of how an entire subject area will develop. This prevents a "piece-mealed" community and eliminates potential surprises. It assists in knowing the entire infrastructure needs of the development and assists the city in planning and scheduling other improvements The second is that it essentially allows for conditional zoning. While many of the '"'R requirements recommended by staff to be conditions of approval are currently contained within other development documents of the city, some are not. If this were a standard rezoning, not only would the flexibility of the applicant to shift densities be restricted, but it would also result in limited ability for staff, the Planning Commission, and Council to address areas that are unique to the subject property but not found within development documents. Attached for your information and review are letters of notification sent to property owners within 300' of the subject property, the legal advertisements that appeared in the Owasso Reporter, a copy of the application, and Trip Generation Information. Enclosed within your packet of information is a large case map as well as the applicants submitted materials. The major streets that will service the development are 86th St. N., 129th E. Ave., 76th St. N., and 145th E. Ave. Using daily trip generation rates obtained from the Bureau of Transportation Statistics through the U.S. Department of Transportation, I have calculated the approximate number of trips generated from the proposed development under RM-2 and RS-1 zoning scenarios. The trips generated by this proposal will undoubtedly impact traffic volumes on the above streets servicing the development. Assuming the development is built out, Tables 1 and 2 illustrate the number of daily trips generated by proposal under each zoning scenario. A legal description of the subject property is contained within the complete staff report which is attached for your information and review. The applicants are requesting the rezoning to CS in order to allow for the development of the site in a retail or restaurant manner. It is important to note that E. 86th Street North has become a commercial retail/service corridor within our community, and if approved, a buffer consisting of slightly more than 2 acres of OL zoning would be maintained between this property and the residential additions to the north (Lakeridge and Central Park II). SITE INFORMATION: No unusual development hardships are noted. ANALYSIS The applicants are requesting a rezoning of a parcel of land 1.04 acres in area from OL (Office Light) to CS (Commercial Shopping Center) in order to allow for commercial retail or restaurant development. The applicants have additionally requested a lot split approval for the subject property that is involved in the rezoning request (See Agenda Item # 9). ~' Staff Report OZ-98-O1 Page 2 of 3 A portion of the original tract from which the subject property and the Bank of the Lakes property was created from was involved in a rezoning request in 1990. At that time, the land that contains Robert Long's Insurance Office/Diane's Travel and the property that is now Bank of the Lakes was considered by the Planning Commission for CG zoning for the ultimate use of a car wash. That request was denied, with the Planning Commission citing that although the established zoning pattern in the area supported the request, the physical surroundings did not. Since 1990, the property involved in that zoning request has developed. Robert Long's Insurance Office and Diane's Travel were constructed in 1992 within OL (Office Light) zoning requirements and specifications. Bank of the Lakes, after receiving lot split approval in November of 1996, was also developed within OL (Office Light) zoning requirements and specifications and is nearly completed. Obviously the physical changes in the area are not limited to these two properties. Since 1990, Warehouse Foods (originally Food Lion) has developed to the east of the subject property, as well as much of the Ram Plaza Addition. In 1996, the Cornerstone Shopping Center located southwest of the subject property, also completed a large expansion to the existing shopping center. In short, East 86th Street North has become a commercial retail/service corridor within our community far exceeding 1990 expectations. The applicant's request to rezone the 200'x 227' tract to CS is consistent with development that has occurred within this corridor since 1992, but yet does not go to the extreme of a CG (Commercial General) zoning and the intensity that would accompany it. It would allow for ~,„ retail and service uses, thus adding to what is already found along this corridor of our community. In addition, providing the lot split is approved, would still provide slightly more than 2 acres of OL (Office Light) zoning to act as a buffer between the subject property and the residential areas to the north (Lakeridge and Central Park II). The conditions that supported a denial of a rezoning request on the neighboring property in 1990 are quite simply no longer existent in 1998 on this property. Also, a rezoning of the property from IL to CG may be more appropriate, regardless of the potential use being proposed, due to its proximity to a main entrance into our community. Beautification efforts have been made in this area, with additional projects to come, and the myriad of industrial uses that would be permitted if IL zoning was maintained is less than desirable. Notices of the rezoning request were mailed to property owners within 300 feet of the subject property and legal notice was published in the Owasso Reporter. The subject property was also posted the week of December 15, 1997. Several area citizens attended the meeting noting concerns regarding drainage in the area. Staff informed the citizens that the applicants would be required to submit detailed drainage plans at the time of site plan review. If the Council approves the rezoning request, an ordinance will be presented at the February 3, 1998 meeting to formally adopt the actions of the Council. EXISTING LAND USE: A majority of the subject property is undeveloped, with the exception of asingle-family dwelling. SURROUNDING LAND USE: The subject property is abutted on the southeast by Keller Williams Realty, while the Anthony's Shopping Center abuts the property on the south. To the west of the subject property is property owned by the Owasso Public Schools while north is an undeveloped strip of land which is abutted by single-family dwellings. APPLICABLE REGULATIONS: The Zoning Code for the Ciry of Owasso, Chapter 15 "Amendments" and Chapter 6 "Commercial Land Uses". SITE INFORMATION: No unusual development hardships are noted, however a large drainage channel does run through a portion of the property which would require some regrading prior to any comprehensive development. ANALYSIS The applicants are requesting a rezoning on a parcel of land approximately 6.47 acres in area from IL (Light Industrial) to CG (Commercial General) in order to allow for a family entertainment center. The applicants have additionally requested a lot split approval for the subject property that is involved in the rezoning request (See Agenda Item # 11). Staff Report OZ-98-02 Page 2 of 2 In reviewing the proposed rezoning request to insure its appropriateness, staff has reviewed the current zoning patterns along both sides of the Owasso Expressway between E. 76th Street North and E. 96th Street North. It was determined that over 180 acres of land adjacent to the expressway are currently being utilized or have been zoned for Commercial Shopping or Commercial General. Please note that this is likely to increase with the relocation of Woods Precision to the German Corner area and a likely commercial use utilizing that facility. These existing zoning patterns and uses certainly support any CS or CG zoning request. An-area map with all CS or CG zoning shaded in black is also attached for your information and review. - In addition, with the current zoning of the subject property being IL, it could be argued that a commercial use of the property would be more appropriate than an industrial use as this is a gateway entrance to our community. If it were to develop in an industrial manner, a myriad of undesirable, less aesthetically pleasing uses could result. The Ciry of Owasso is currently in the process of taking steps to beautify this corridor of our community through a landscaping and fencing project between E. 76th Street North and E. 86th Street North. Also, another landscaping grant has been applied for in order to provide beautification to those areas between E. 86th Street North and E. 96th Street North. Rooney Community Development Director ' MEMORAND1J11'1 TO: HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: REGENA GUTHRIE SUBJECT: MIKE SOLE HEARING LOSS COURT ORDER # 97-14136F MIKE SOLE NECK INJURY COURT ORDER # 97-4526X DATE: JANUARY 13, 1998 HEARING LOSS COURT ORDER # 97-14136F: Firefighter Mike Sole on August 23, 1997, filed a claim (Form 3 -copy attached - #H-1) with the Workers' Compensation Court for hearing loss as a result of "loud noises associated with firefighting and response to emergencies". Until that date, there was no medical treatment received, nor requested. During the City's investigation of this claim, we directed Mr. Sole to the Tulsa Otolaryngology, Inc., A. Munson Fuller, MD, (report attached - #H-3) whose examination and hearing tests show a bilateral sensorineural hearing loss throughout all frequencies. Dr. Fuller, using the Fourth Edition AMA Guidelines as designated by Rule 32 of the Oklahoma Worker's Compensation Court, rated Mr. Sole with a four frequency total hearing loss of 120 decibels in the left ear, which is a monaural impairment of 7.5 percent. Mr. Sole was also rated with a four frequency total hearing loss in the right ear of 110 decibels, which is a monaural impairment of 3.8 percent. This resulted in a binaural impairment of 4.4 percent. When the City received claim for hearing loss from Mr. Sole, a copy of a rating report from his doctor, Russell F. Allen, MD, Inc., (copy attached - #H-2) was also included. Dr. Allen's report assigned a monaural hearing loss on the right of 31 percent and a monaural hearing loss on the left of 50 percent. Again, using the AMA Guidelines, a 34 percent binaural hearing loss was assigned. On December 16, 1997, this matter was tried before the Honorable Ellen C. Edwards in Tulsa Workers' Compensation Court. As a result of that trial, the City has received Workers' Compensation Court Order Number 97-14136F, (copy attached - #H-4, filed January 5, 1998) MIKE SOLE HEARING AND NECK WORKERS' COMPENSATION CLAIMS JANUARY 13, 1998 PAGE TWO which orders that as a result of said injury, Mr. Sole sustained a 3.8 percent Loss of Hearing to the Right Ear and 7.5 percent Loss of Hearing to the Left Ear, for a Binaural Hearing Loss of 4.4 percent,, for which Mr. Sole is entitled to compensation for 10.8 weeks at $ 185 per week, or the total amount of $ 1,998 of which 10.8 weeks have accrued and shall be paid in a lump sum of $ 1,998. In addition to the award, court costs ($ 75); Special Occupational Health and Safety Fund Tax (.75 %); Special Indemnity Fund Tax (5 %); and Workers' Compensation Administration Fund (2 %) are payable within 20 days from the date of filing of the order. The total cost of this award is $ 2,227.85, and if approved, will be paid from the Workers' Compensation Self-Insurance Fund. NECK INJURY COURT ORDER # 97-4526X: On January 19, 1997, firefighter Mike Sole was injured while unloading a patient from the ambulance at St. John's Hospital in Tulsa. He was diagnosed by Dr. Galles with cervical strain and radiculopathy. On February 27, 1997, he saw Dr. David Benner of Neurological Surgery, Inc. who performed a cervical laminectomy on March 3, 1997. On February 28, 1997, Mr. Sole filed claim with the Workers' Compensation Court (Form 3 -copy attached - #N-1). Mr. Sole returned to light duty on May 12, 1997 and was released to full duty on July 24, 1997. He has successfully performed the duties of a paramedic/firefighter since that time. Prior to the Workers' Compensation Court date of December 18, 1997, Mr. Sole was evaluated by his doctor, John A. Karr, D.C. (copy attached - #N-2) who rated him on July 23, 1997, with: 31 percent whole person permanent impairment to the neck, 14 percent permanent impairment to the right shoulder, and 15 percent permanent impairment to the right arm all due to his January 19, 1997 injuries. On October 20, 1997, the City directed Mr. Sole to Dr. Michael Farrar, Gilcrease Medical Center, Inc. , who gave Mr. Sole an impairment rating of 16 percent (copy attached- #N-3) to the body as a whole as contributed by the cervical spine with right arm radicular features, with zero percent impairment to the right shoulder or any other anatomical region. Dr. Benner, who performed the surgery on Mr. Sole performed an impairment evaluation on October 21, 1997 and assessed a final impairment rating of 21 percent (copy attached - #N-4) to the person as a whole. Under conditions and terms of that contract, the Local Government Testing Consortium provided the City with all random drug and ^ alcohol testing services. Those services included not only testing but also the random selection _ process. The contract allowed the City to comply with testing mandated by the U.S. Department of Transportation (DOT). Services provided under the contract have been satisfactory. The contract approved in 1996, by contract clause, expired one year after the date of the contract. Since March 5, 1997, the Consortium has continued to provide testing services without a contract. CONTRACT RENEWAL: A contract renewal from the Consortium has been received by the City. The contract has been reviewed and approved by City Attorney Ron Cates. The renewal contract does not differ from the previous contract except in redefining the expiration clause to be indefinite, with 90 days written notice from either party to the contract. The fee for the services is $32.50 per year per employee in the testing pools. This fee has not increased since testing was begun through the Consortium. The City currently has 17 employees in the DOT testing pool. RECOMMENDATION: Staff recommends approval and execution of the contract renewal. HARDER HUMAN RESOURCES DIRECTOR SUBJECT: APPLICATION FOR DISABILITY BENEFITS BY GEORGE HALEY t DATE: January 13, 1998 BACKGROUND: George Haley began employment with the City as a Water Meter Reader on April 8, 1986. His current position with the City is Waste Water Treatment Plant Operator. On February 9, 1996, he was injured in an on-the-job accident, falling from a ladder. Since that time, he has received medical treatment on numerous occasions. He was on Worker's Compensation leave from April 2, 1997, until June 23, 1997, when he returned to a light duty assignment. He worked until July 8, 1997, and has not returned to work since that date. Mr. Haley continues to pursue Worker's Compensation benefits. ^ While on light duty assignment and while away from work, he was examined for the source of pain that kept him from working. During that time, he fell at his residence and was taken to ' the hospital. While there he was diagnosed with multiple myeloma and surgery was performed. Subsequent to that diagnosis, Mr. Haley was removed from Worker's Compensation status and has exhausted all accumulated leave; thus, since December of 1997, he has not received ' compensation from the City. DISABILITY APPLICATION: As a City of Owasso employee, Mr. Haley is covered by a defined benefit retirement plan (mandatory) and elected to participate in a defined contribution retirement plan (Thrift). Both plans are administered by the Oklahoma Municipal Retirement Fund (OMRF). Because of his medical condition, he has applied for disability benefits from both plans and submitted the required application forms. The OMRF procedures for application for disability benefits (both plans) require, in addition to all forms being complete, that the local "retirement committee" decide the applicant's qualifications for the benefits.
