8. Consideration and Appropriate Action Relating to the Award of a Contract for Engineering
Design Services at the Highway 169 and 76th St N Interchange.

The staff has completed the request for proposal process, reviewed the proposals received,
and will recommend that the Council award a contract for engineering design services
related to the Highway 169 and 76th St N interchange improvements to CH2M Hill Inc,
Tulsa, OK in the amount of $99,729.
9. Consideration and Appropriate Action Relating to a Request for Council Approval of
Amendments to the FY 1997-98 Capital Improvements Fund and General Fund Budgets.

The staff will recommend approval of an amendment to the Capital Improvements Fund
budget wherein the appropriation for the Computerization Project is decreased by $30,000
and a transfer to the General Fund is increased by $30,000; and an amendment to the
General Fund budget wherein the appropriation to the Managerial Department Personal
Services is increased by $30,000 and the transfer from the Capital Improvements Fund is
increased by $30,000.
10. Consideration and Appropriate Action Relating to Council Authorization of a Bond Projects
Fund and Approval of aProject-Length Budget and a 1997-98 Fiscal Year Budget for That
Fund.

The staff will recommend approval of an amendment to the Capital Improvements Fund
budget where in the appropriation for the City Hall Renovation and 86th St N & Main
Intersection Projects are decreased by $269,000 and a transfer to the Bond Projects Fund
is increased by $269,000; and an amendment to the General Fund Budget wherein the
appropriation to the Engineering Department Personal Services is increased by $30,100 and
a transfer from the Bond Projects Fund is increased by $30,100.

Tuesday, January 20, 1998
The Owasso City Council met in regular session on Tuesday, January 20, 1998 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 16, 1998.

ITEM 5: READING OF MAYOR'S PROCLAMATION.
Mayor Barnhouse read a proclamation naming the Baptist Retirement Center as Business of the
Quarter for the First Quarter of 1998. The Mayor presented the proclamation to Mr Steve
Thomas, Administrator.
ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR APPROVAL OF THE CONSENT AGENDA.
A. Approval of the Minutes of January 6, 1998 Regular Meeting and

The consent agenda included minutes of the January 6, 1998 regular meeting and January 15,
1998 special meeting, by reference made a part hereto. Item B on the consent agenda included
the following claims: (1) General Fund $44,304.15; (2) Cemetery Care $2,000.00; (3) Workers'
Comp Self-Insurance Fund $1,016.25; (4) Ambulance Service Fund $1,628.07; (5) E-911
$1,873.44; (6) City Garage $7,945.23; (7) Capital Improvements $14,223.10; (8) Capital
Projects Grant $7,250.00; (9) Interfund Transfers $3,515.96; (10) Payroll $136,139.45;
(11) City Garage Payroll $3,263.08; (12) Capital Improvement Fund Payroll $2,003.52. Item C
requested approval of an agreement with Public Service Company of Oklahoma to furnish,
install, maintain and operate electric street, highway and other area lighting requested by the
City for the period July 1, 1997 thru June 30, 1998. Item D requested acceptance of a grant
from the Tulsa Area Agency on Aging in the amount of $3880 to be used for the purchase of
a Hobard Commercial Refrigerator for the Community Center, and authorization for the Mayor
to execute the document. Item E was a request for a supplemental appropriation to the General
Fund Budget increasing estimated revenues by $3880 and increasing expenditures in the
Community Center Department Machinery & Equipment line item by $3880. Dr Bode moved,
seconded by Dr Standridge, to approve the consent agenda.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE EXPENDITURE OF FUNDS TO PURCHASE A
VEHICLE FOR THE ENGINEERING DIVISION AND A VEHICLE FOR THE
STREETS DIVISION. SUCH PURCHASES UTILIZING THE STATE OF
OKLAHOMA BID LIST CONTRACT NUMBER SW80035• AND
AUTHORIZATION FOR PAYMENT.
Mr Carr said that funds are included in the FY 1997-98 budget for the purchase of vehicles for
the engineering and street divisions. Bids were solicited and opened in October 1997. Four
vendors submitted bids, with all bids exceeding the budgeted amount. The City Council rejected
the bids on November 18, 1997. The staff then obtained a copy of the FY 1998 State of
Oklahoma bid list and evaluated the bids for the required vehicles. Larry Spencer Chevrolet in
Norman, OK is the apparent low bidder in all but one category, and was just under $14 above
the low bidder in that category. Staff recommendation is to purchase the requested vehicles

' from Larry Spencer Chevrolet. Dr Standridge moved, seconded by Mr Wilken, to approve the
purchase and authorize payment fora 1998 Chevrolet 5-10 extended cab vehicle for the
engineering division in the amount of $14,494.97 and a 1998 Chevrolet 3/4 automatic vehicle
for the street division in the amount of $17,036.13, from Larry Spencer Chevrolet in Norman,
OK.

Items 8, 9, 10 & 11 were reviewed concurrently by Mr Rooney because of the connection of
each zoning case to the Planned United Development, however, separate action was taken on
each item. Lindsey Management of Fayetteville, AR has requested approval of three rezoning
requests and a Planned Unit Development application. The subject property contained within
the PUD, of which the rezoning requests are a portion, contains 288 acres of undeveloped
property located with the square mile section bounded by E 76th St N, E 86th St N, N 129th
E Ave, and N 145th E Ave. If approved, the requests will allow for the development of multi-
family housing, an 18-hole golf course, and single-family housing. The three zoning cases
would establish needed underlying zoning within the subject area to permit the implementation
of the proposed PUD. OZ-98-03, OZ-98-04, and OZ-98-OS will establish 80.53 acres of RM-1
zoning, 165.29 acres of OM zoning, and 39.68 acres of RS-1 zoning. The Owasso Planning
Commission has conducted a hearing on all four requests and has recommended Council
approval of the requested zoning and PUD. The staff concurs with those recommendations.
Relative to OZ-98-O5, Mr Gary Baxter expressed concern about rezoning the area from RE to
RS-1. He suggested leaving the zoning as is until such time as that area is developed.
Councilor Helm suggested that the Director of Golf for the City of Owasso be included in
reviewing the plans for the golf course adjacent to 129th E Ave, to ensure that all efforts are
made to ensure the protection of traffic on 129th E Ave.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FROM LINDSEY MANAGEMENT FOR COUNCIL APPROVAL
OF A PLANNED UNIT DEVELOPMENT.
Mr Wilken moved, seconded by Dr Standridge, to approve OPUD-98-O1, conditional upon the
developer accepting the following conditions as recommended by staff:
A. That the applicant's Development Text and Conceptual Development Plan be
considered to be the Outline Development Plan as required by the PUD Chapter
of the Owasso Zoning Code.
B. That unless specifically set out in the standards and conditions of this PUD,
single-family development shall meet the requirements of a typical RS-1 district.

C. That the square footage of any single-family dwelling be a minimum of 2250

THE BANK OF THE LAKES PROPERTY: FROM OL (OFFICE LIGHTI TO
CS (COMMERCIAL SHOPPING CENTER).
Mr Rooney said that KMO Development Group Inc has requested a rezoning from OL to CS
for property containing approximately 1.04 acres located between the Bank of the Lakes site and
Warehouse Market along E 86th St N. The Planning Commission held a public hearing on the
request and gave its unanimous approval. Dr Standridge moved, seconded by Mr Wilken, to
approve the rezoning request contained in OZ-98-O1.

' ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FROM OMNI ENTERTAINMENT TO REZONE LOTS 3, 4 & 5,
AND RESERVE AREA "A" OF FORREST DRIVE INDUSTRIAL PARK,
' LOCATED WEST OF THE OWASSO EXPRESSWAY; FROM IL L(LIGHT
INDUSTRIAL) TO CG (COMMERCIAL GENERAL .
Omni Entertainment Inc has requested a rezoning from IL to CG for property containing
approximately 6.4 acres located immediately northwest of Keller Williams Realty, on the west
' side of the Owasso Expressway. The applicants are requesting the rezoning in order to allow
for the development of the site for a family entertainment facility. The Owasso Planning
Commission unanimously approved the request at their January 13, 1998 meeting. Dr Bode
' moved, seconded by Dr Standridge, to approve the rezoning request contained in OZ-98-02.

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
WORKERS' COMPENSATION CLAIM FOR HEARING LOSS, AND
AUTHORIZATION FOR PAYMENT.

Mr Harder presented the case for Firefighter Mike Sole, who has filed a claim for hearing loss
' as a result of loud noises associated with firefighting and response to emergencies. Hearing tests
have been conducted on Mr Sole and a rating assigned to the hearing loss. On December 16,
1997, the matter was tried in Tulsa Workers' Compensation Court. As a result of that trial, the
' City has received Workers' Compensation Court Order No 97-14136F, ordering a 4.4 % binaural
hearing loss, for which Mr Sole is entitled to compensation for 10.8 weeks at $185 per week,
plus associated taxes, fees, and costs, for a total cost of the award of $2227.85. Dr Standridge
t moved, second by Mr Wilken, to approve and authorize payment of the court-ordered Workers'
Compensation claim of Mike Sole for hearing loss.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
WORKERS COMPENSATION CLAIM FOR A NECK INJURY, AND
AUTHORIZATION FOR PAYMENT.
Mr Harder presented the case for Firefighter Mike Sole, who has filed a claim for a neck injury
sustained while unloading a patient from an ambulance. Mr Sole has been evaluated and rated

by three physicians. On December 18, 1997, the matter was tried in Tulsa Workers'
Compensation Court. As a result of that trial, the City has received Workers' Compensation
Court Order No 97-4526X, awarding a 20 % permanent partial disability to the body as a whole,
due to Mr Sole's injury. Mr Sole is entitled to compensation for 91 weeks at $213 per week,
plus associated taxes, fees, and costs. The total cost of this award is $20,960.18. Dr Standridge
moved, seconded by Dr Bode, to approve and authorize payment of the Court-ordered Workers'
Compensation claim of Mike Sole for a neck injury.

ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL TO EMPLOY THE FIRM OF
LIONESS REALTY GROUP INC FOR PROFESSIONAL AND TECHNICAL
SERVICES ASSOCIATED WITH THE LOCATION AND CONSTRUCTION
OF A CITY HALL FACILITY.
Mr Ray requested that the City Council approve an agreement with Lioness Realty Group to
provide professional services relating to the construction of a city hall facility. He said that the
firm will provide professional assistance to the citizens committee involved in site selection, and
provide expertise that isn't currently available to the committee. John Groth questioned why it
is necessary to hire a consulting firm. He said he believes the citizens group can make the
proper decisions, and that he sees the hiring of an the firm as an unnecessary expense. Mr Ray
said that there are issues to be addressed other than the simple selection of a site. Mr Helm
moved, seconded by Dr Bode, to authorize the Mayor to execute a letter of agreement between
the City of Owasso and Lioness Realty Group for professional services relating to the
construction of a city hall facility, such agreement providing for a scope of work and further
providing for compensation not to exceed $13,200, plus expenses not to exceed $2600.

ITEM 17: CONSIDERATION AND APPROPRIATE RELATING TO A CONTRACT
RENEWAL AGREEMENT WITH THE LOCAL GOVERNMENT TESTING

' Mr Harder presented the item. On March 5, 1996, a contract between the City of Owasso and
the Local Government Testing Consortium was approved by the City Council, to assist the City
in complying with federally mandated drug and alcohol testing. The contract expired after one
' year, however, the Consortium has continued to provide testing services without a contract. The
contract renewal has now been received and reviewed and approved by the City Attorney. The
' renewal contract does not differ from the previous contract except in redefining the expiration
clause to be indefinite, with 90 days written notice from either party. The fee for the services
is $32.50 per year per employee in the testing pools. Mr Wilken moved, seconded by
Dr Standridge, to approve the renewal agreement with the Local Government Testing
Consortium to serve as athird-party administrator for federally mandated random alcohol and
drug testing of employees, and authorize the Mayor to execute the agreement.

PUBLIC HEARING
ITEM 18: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR APPROVAL BY THE CITY COUNCIL, SITTING AS THE
RETIREMENT COMMITTEE, FOR DISABILITY RETIREMENT.
' Mr Harder said that George Haley began employment with the City as a water meter reader on
April 8, 1986, with his current position being wastewater treatment plant operator. Mr Haley
~ was injured in an on-the job-accident on February 9, 1996 when he fell from a ladder. He was
on worker's compensation leave from April 2, 1997 until June 23, 1997, when he returned to
a light duty assignment. Mr Haley worked until July 2, 1997, and has not worked since that
date. While he was on light duty, Mr Haley was diagnosed with multiple myeloma and surgery
was performed. At that time, he was removed from workers' compensation status. Mr Haley
~ is covered by a mandatory defined benefit retirement plan and has elected to participate in a
defined contribution (thrift) retirement plan, both through the Oklahoma Municipal Retirement
Fund. He has applied for disability benefits from both plans. As a requirement for disability
benefits, the local retirement committee must decide the applicant's qualifications for the
benefits. The City Council also serves as the local retirement committee. All forms are in
order and have been submitted to the Council/Retirement Committee for review. Dr Bode
moved, seconded by Dr Standridge, that the City Council in their capacity as the Retirement
' Committee, approve the request from George Haley for disability retirement from both the Thrift
Plan and the Defined Benefit Retirement Plan.

BACKGROUND:
At the January 20, 1998 meeting, the Owasso Ciry Council approved a request to rezone
property located within the South Half (S/2) of the South Half (S/2) of the Southeast Quarter
(SE/4) of Section 20, Township 21 North, Range 14 East. The subject property is located north
of E. 86th Street North, immediately east of the Bank of the Lakes site.
Attached is a copy of Ordinance No. 565 which formally adopts the City Council's action of
January 20, 1998, thus rezoning the subject property from OL (Office Light) to CS (Commercial
Shopping Center).
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 565.

FY 1997-98 STREET REPAIRS

BACKGROUND:
Council action on September 16, 1997 approved construction of recommended street repair sites
throughout the City in conjunction with the FY97-98 Street Division Capital Outlay Program.
A total of 39 projects were identified for construction by contract (see Attachment 1).
SOLICITATION OF BIDS:
The Public Works Engineering Division developed specifications and drawings commensurate
with the approved projects. The bid solicitation was structured for each individual site using unit
priced bid items. The low bidder would be selected based on the total of all sites. Contract
payments will be based on the actual amount of work done at each site based on the bid unit
prices for work items.
Bids were received on January 8, 1998. A total of four bids were received ranging from
$127,617.70 to $192,953.80 (see Attachment 2). The Engineer's Estimate is $102,396.50. The
apparent low bid was submitted by Newman Contracting of Glenpool, Oklahoma.
Following bid opening, Engineering Division staff analyzed the apparent low bid with respect
to the Engineer's Estimate. The analysis indicated that this bid included prices for traffic control
during construction (signs, barricades, drums and lights) which far exceeded what is normally
charged for such devices. Upon advice from the City Attorney, negotiations were initiated with
the apparent low bidder to rectify the difference. As a result, Newman agreed to lower his unit
prices for traffic control devices. The resultant change will reduce his bid to $107,029.70.
Newman has since confirmed his agreement to the Change Order and the reduced contract
amount (see Attachment 3). Therefore, procedurally, the award should be made at Newman's
original bid and an immediate change order be issued reducing the contract amount.
FUNDING SOURCE
The total budget for FY97-98 is $114,000 (Line Item 51-410-5461) with $8,000 reserved for
minor street repairs by City forces. Only $6,100 of the reserved funds have been expended,
leaving a total of $107,900 for contract work.

INTERCHANGE IMPROVEMENTS

BACKGROUND:
' In June 1997, re resentatives of the City of Owasso and the Oklahoma Department of Transportation
p
~ (ODOT) met to discuss improvements at the subject intersection. A project was proposed by both
parties to achieve realignment of the entrance/exit ramps and service roads at the interchange. In
addition, signalization would be relocated to be consistent with the ramp/service road alignment.
It was discussed at that time that design, right-of--way acquisition and utility relocation would be the
responsibility of the City of Owasso. Funds for engineering were included in the FY97-98 Capital
Improvement Fund budget in the amount of $100,000 (line item 81-410-5468).
A formal request for funding of the project was sent to ODOT in July 1997 and City of Owasso
Resolution No. 97-09 committing to the project was approved by Council on August 19, 1997 and
~ forwarded to ODOT. Staff received official notification in October 1997 that the Transportation
Commission approved this project.
ENGINEERING PROPOSALS:
~ Staff requested qualification statements on November 14, 1997 from engineering firms capable of
providing construction administration and resident inspection services for the wastewater treatment
plant improvements. A packet of information was advertised and sent to twenty-five (25) area
engineering firms. Responses were received from ten (10) firms. Statements were ranked according
'~ to the total number of evaluation points assigned by the Review Committee (consisting of Mayor
Barnhouse, Rodney Ray (City Manager), Robert Carr (Public Works Director), Dwayne Henderson
(Capital Projects Manager) and Mark Brown (Owasso Citizen and former ODOT Traffic Engineer)).
Based upon the initial evaluation, the Review Committee identified The Benham Group, CH2MHi11,
Dewberry Design Group and HNTB Corporation as "Qualified and IIighly Responsive Firms". These

four (4) firms were requested to submit a detailed Scope of Services and their proposed fee for final
evaluation by the Review Committee.
Each firm submitted their detailed scope of services on December 23, 1997. Each submittal was
evaluated and ranked by the Review Committee. CH2MHill was selected as the top ranked firm for
fee negotiations. For comparison, the fee proposals submitted by each firm are summarized as
follows:

Since each proposal fee exceeded our $100,000 budget, the Committee authorized the Public Works
Director to negotiate with CH2MHill to reduce the fee. The objective of the negotiation was to
reduce the fee toward our budgeted amount without impacting the overall scope of work.
ENGINEERING SERVICES AGREEMENT:
Staff met with representatives from CH2MIIill on January 26, 1998 to discuss the scope of work and
the fee proposal. As a result of the meeting, the fee proposed was reduced to $99,729. An
Agreement was drafted and reviewed by the City Attorney. The attached Agreement for Engineering
Design Services has been prepared as a result of the review comments.

The project design is scheduled to enable ODOT bid letting in July 1999. Milestones in the project
are consistent with dates provided by ODOT for FY99-00 funding of construction.
FUNDING:
As previously stated, funds for engineering were included in the FY97-98 Capital Improvement Fund
budget in the amount of $100,000 (link item 81-410-5468).

THIS AGREEMENT, made and entered into this day of ,
199 between the City of Owasso,.Oklahoma, aMunicipal Corporation, of the State of
Oklahoma, hereinafter referred to as CITY, and CH2M HILL, INC., hereinafter referred to
as ENGIlVEER;
WTTNESSETH:
WHEREAS, CITY intends to construct improvements to the intersection of U.S.
Highway 169 and 76th Street North, hereinafter referred to as the PROJECT; and,
WHEREAS, CITY requires certain professional services in connection with the PROJECT,
hereinafter referred to as the SERVICES; and,
WHEREAS, ENGINEER is prepared to provide such SERVICES;
WHEREAS, funding is available for the PROJECT.
NOW THEREFORE, inconsideration of the promises contained herein, the parties hereto
agree as follows:
1. SCOPE OF PROTECT. The scope of this PROJECT is described in Attachment A,
SCOPE OF PROTECT, which is attached hereto and incorporated by reference as part
of this AGREEMENT.
2. SERVICES TO BE PERFORMED BY ENGINEER. ENGINEER shall perform the
SERVICES described in Attachment B, SCOPE OF SERVICES, which is attached
hereto and incorporated by reference as part of this AGREEMENT.
3. CITY'S RESPONSIBILITIES. CITY shall be responsible for all matters described in
Attachment C, RESPONSIBILITIES OF THE CITY, which is attached hereto and
incorporated by reference as part of this AGREEMENT.
4. COMPENSATION. CITY shall pay ENGINEER in accordance with Attachment D,
COMPENSATION, and further described in Attachment E, FEE/MANHOUR
BREAKDOWN, which are attached hereto and incorporated by reference as part of
this AGREEMENT.
5. SCHEDULE. ENGINEER shall perform the SERVICES described in Attachment B,
SCOPE OF SERVICES, in accordance with the schedule set forth in Attachment F,
which is attached hereto and incorporated by reference as part of this
AGREEMENT.
6. STANDARD OF PERFORMANCE. ENGINEER shall perform the SERVICES
undertaken in a manner consistent with the prevailing accepted standard for similar
services with respect to projects of comparable function and complexity and with
the applicable laws and regulations published and in effect at the time of

performance of the SERVICES. The PROJECT shall be designed and engineered in a
good and workmanlike manner and in strict accordance with this AGREEMENT. All
engineering work shall be performed by or under the supervision of Professional

,~ 7. LIMITATION OF RESPONSIBILITY.
7.1. ENGINEER shall not be responsible for construction means, methods,
techniques, sequences, procedures, or safety precautions and programs in
connection with the PROJECT.
~' 8. OPIlVIONS OF COST AND SCHEDULE.
8.1. Since ENGINEER has no control over the cost of labor, materials, equipment,
or services furnished by others, or over contractors', subcontractors', or
vendors' methods of determining prices, or over competitive bidding or
market conditions, ENGINEER'S cost estimates shall be made on the basis of
qualification and experience as a Professional Engineer.
8.2. Since ENGINEER has no control over the resources provided by others to
meet construction contract schedules, ENGINEER'S forecast schedules shall
be made on the basis of qualification and experience as a Professional

9.1. ENGINEER shall defend and indemn
for damages arising out of the performance of the SERVICES for CITY

expenses of whatever nature where such liability is caused by the negligent
or omission of ENGINEER or any person or organization for

9.2. ENGINEER shall not be liable to CITY for any special, indirect or
consequential damages, such as, but not limited to, loss of revenue, or loss of
anticipated profits.
10. COMPLIANCE WITH LAWS.
10.1. In performance of the SERVICES, ENGINEER shall comply with applicable
regulatory requirements including federal, state, and local laws, rules,
regulations, orders, codes, criteria and standards. ENGINEER shall procure
the permits, certificates, and licenses necessary to allow ENGINEER to
perform the SERVICES. ENGINEER shall not be responsible for procuring
permits, certificates, and licenses required for any construction unless such

responsibilities are specifically assigned to ENGINEER in Attachment B,
SCOPE OF SERVICES.
10.2. The ENGINEER shall take the necessary actions to ensure its facilities are in
compliance with the requirements of the Americans With Disabilities Act. It
is understood that the program of the ENGINEER is not a program or
activity of the CITY OF OWASSO. The ENGINEER agrees that its program or
activity will comply with the requirements of the Americans With
Disabilities Act. Any costs of such compliance will be the responsibility of
the ENGINEER. Under no circumstances will ENGINEER conduct any
activity which it deems to not be in compliance with the Americans With
Disabilities Act.
11. INSURANCE.
11.1. During the performance of the SERVICES under this AGREEMENT,
ENGINEER shall maintain the following insurance:
11.1.1. General Liability Insurance with bodily injury limits of not less than
$1,000,000 for each occurrence and not less than $1,000,000 in the
aggregate, and with property damage limits of not less than $100,000
for each occurrence and not less than $100,000 in the aggregate.
11.1.2. Automobile Liability Insurance with bodily injury limits of not less
than $1,000,000 for each person and not less than $1,000,000 for each
accident and with property damage limits of not less than $100,000
for each accident.
11.1.3. Worker's Compensation Insurance in accordance with statutory
requirements and Employers' Liability Insurance with limits of not
less than $100,000 for each occurrence.
11.1.4. Errors and Omissions Insurance to remain in effect during the
PROJECT and the term of any legal liability. Errors and Omissions
coverage to be for a minimum of $500,000, deductibles subject to
approval.
11.2. ENGINEER shall furnish CITY certificates of insurance which shall include a
provision that such insurance shall not be canceled without at least 30 days
written notice to the CITY.
12. .OWNERSHIP AND REUSE OF DOCUMENTS.
12.1. All documents, including original drawings, estimates, specifications, field
notes and data shall become and remain the property of the CITY.
12.2. CTTY'S reuse of such documents without written verification or adaptation
by ENGINEER for the specific purpose intended shall be at CITY'S risk.
13. TERMINATION OF AGREEMENT.
13.1. The obligation to continue SERVICES under this AGREEMENT may be
terminated by either party upon fifteen days written notice in the event of

substantial failure by the other party to perform in accordance with the terms
hereof through no fault of the terminating party.
13.2. CITY shall have the right to terminate this AGREEMENT, or suspend
performance thereof, for CTTY'S convenience upon written notice to
ENGINEER; and ENGINEER shall terminate or suspend performance of
SERVICES on a schedule acceptable to CITY. In the event of termination or
suspension for CTTY'S convenience, CITY shall pay ENGINEER for all
SERVICES performed in accordance with provisions of Attachment D,
COMPENSATION. Upon restart of a suspended project, payment shall be
made to ENGINEER in accordance with Attachment D, COMPENSATION.
14. NOTICE.
14.1. Any notice, demand, or request required by or made pursuant to this
AGREEMENT shall be deemed properly made if personally delivered in
writing or deposited in the United States mail, postage prepaid, to the
address specified below.

14.2. Nothing contained in this Article shall be construed to restrict the
transmission of routine communications between representatives of
ENGINEER and CITY.
15. UNCONTROLLABLE FORCES. Neither CITY nor ENGINEER shall be considered to
be in default of this AGREEMENT if delays in or failure of performance shall be due
to forces which are beyond the control of the parties; including, but not limited to:
~, fire, flood, earthquakes, storms, lightning, epidemic, war, riot, civil disturbance,
sabotage; inability to procure permits, licenses, or authorizations from any state,
local, or federal agency or person for any of the supplies, materials, accesses, or
services required to be provided by either CITY or ENGINEER under this
AGREEMENT; strikes, work slowdowns or other labor disturbances, and judicial
^ restraint.
~ 16. SEVERABILTTY. If any portion of this AGREEMENT shall be construed by a court
of competent jurisdiction as unenforceable, such portion shall be severed herefrom,
and the balance of this AGREEMENT shall remain in full force and effect.
17. INTEGRATION AND MODIFICATION. This AGREEMENT includes Attachments
' A, B, C, D, E, and represents the entire and integrated AGREEMENT between the
Parties; and supersedes all prior negotiations, representations, or agreements
pertaining to the SCOPE OF SERVICES herein, either written or oral. This

AGREEMENT may be amended only by a written instrument signed by each of the
Parties.
18. DISPUTE RESOLUTION PROCEDURE. In the event of a dispute between the
Architect/Engineer and the CITY over the interpretation or application of the terms
of this AGREEMENT, the matter shall be referred to the City's Director of Public
Works for resolution. If the Director of Public Works is unable to resolve the dispute,
the matter may, in the Director's discretion, be referred to the City Manager for
resolution. Regardless of these procedures, neither party shall be precluded from
exercising any rights, privileges or opportunities permitted by law to resolve any
dispute.
19. ASSIGNMENT. ENGINEER shall not assign its obligations undertaken pursuant to
this AGREEMENT, provided that nothing contained in this paragraph shall prevent
ENGINEER from employing such independent consultants, associates, and
subcontractors as ENGINEER may deem appropriate to assist ENGINEER in the
performance of the SERVICES hereunder.
20. APPROVAL. It is understood and agreed that all work performed under this
AGREEMENT shall be subject to inspection and approval by the Public Works
Department of the City of Owasso, and any plans or specifications not meeting the
terms set forth in this AGREEMENT will be replaced or corrected at the sole expense
of the ENGINEER. The ENGINEER will meet with the City staff initially and
monthly thereafter and will be available for public meetings and/or City of Owasso
presentations.
21. KEY PERSONNEL. ENGINEER has designated Kenneth Hill, P.E., as Project
Manager in the performance of the SERVICES hereunder. ENGINEER agrees that no
change will be made in the assignment of this position without prior approval of
CITY.

SCOPE OF PROTECT. The PROJECT shall consist of improvements to the entrance/exit
ramps and service roads at U.S. Highway 169 & 76th Street North and improvements along
76th Street North between the intersections of the ramps and frontage roads, and the
necessary rehabilitation of the existing pavement. These improvements to include
realignment of the entrance/exit ramps and service roads, including traffic signal
relocations and modifications of the intersections of 76th Street North with these ramps/
service roads. It is expected that there shall be one construction contract which must be
entered into in order to bring this PROJECT into being. Included maybe services and/or
construction contracts for engineering, right-of-way acquisition, utility relocations, etc.

The services to be performed by the ENGINEER under this AGREEMENT will consist of
' three phases, as stated below. Further, it is understood and agreed that the date of
beginning, rate of progress, and the time of completion of the work to be done hereunder
~ are essential provisions of this AGREEMENT; and it is further understood and agreed that
the work embraced in this AGREEMENT shall commence upon execution of this
AGREEMENT and after receipt of a Notice to Proceed. It is further understood that the
PROJECT will be designed and constructed in accordance with Oklahoma Department of
Transportation (ODOT) criteria and specifications for construction.
The Basic Services of ENGINEER include, but are not necessarily limited to, the following
~ tasks:
• Designate a representative to coordinate all information between ENGINEER and CITY.
• Perform necessary surveys and investigations for the PROJECT.
• Prepare all drawings in conformance with CITY and ODOT requirements. Construction
plans shall be prepared in metric dimensions.
• Provide assistance to the CITY as liaison with ODOT in matters related to the PROJECT.
1.0 Investigation
1.1 Attend initial design workshop with CITY and ODOT to review general project
requirements, establish critical design parameters, and discuss scheduling of the
project.
1.2 Collect and review available documents pertaining to the project and site, including
but not limited to record drawings, utility plans, accident records, and other
pertinent documents provided by the CITY and/or ODOT.
1.3 Existing right-of-way and abutting ownerships will be researched and information
provided on the drawings.
1.4 Design and topographic surveys will be performed to establish design/construction
' horizontal and vertical control points. Surveys will also include ground and aerial
surveys to reflect planimetrics, utilities, drainage structures, and right-of-way. The
horizontal and vertical control will be set in a manner to allow the contractor to use
' these same points during construction.

1.5 Conduct traffic counts, including 16-hour traffic volumes on 76th Street North,
entrance/exit ramps and service roads, and turning movement counts at four
intersections-76th Street North at the ramps and service roads.
1.6 An inventory of equipment will be conducted of the existing traffic signal system
and controls for both intersections.
1.7 Existing utilities will be located by field surveying, including "potholing' when
required, to determine the horizontal and vertical location of affected utilities.
Potholing will be coordinated with the CITY and/or ODOT. ENGINEER will
coordinate with other utility owners in obtaining utility locations, including
"potholing."
1.8 Review accident history. Accident records will be furnished by ODOT and CITY.
2.0 Predesign
2.1 Develop Conceptual Layout of possible intersection improvements. The Conceptual
Layout will be a single-line drawing overlaying the existing intersection. The
approximate limits of the project will be: 76th Street North, from the frontage road
on the west side of U.S. Highway 169 intersecting with 76th Street North to the
frontage road on the east side of U.S. Highway 169 intersecting with the 76th Street
North and U.S. Highway 169 -all of the area within the existing highway right-of-
way from 500 feet beyond the gore nose of the four entrance/exit ramps, including
the acceleration or deceleration lane, to 76th Street North (not including the mainline
U.S. 169). Reconstruction of the existing pavement on 76th Street North will be
evaluated. Current ODOT criteria and standards will be used for design.
2.2 Projected traffic volumes for the selected design year will be developed from
existing traffic count information obtained during the Investigation Phase.
2.3 Develop conceptual level construction cost estimate of improvements.
2.4 Prepare a Predesign Report, including conceptual layout and construction cost
estimate.
2.5 ENGINEER will conduct a meeting with the CITY and ODOT to present the
Conceptual Layout and discuss work completed in the Investigation Phase.
ENGINEER will present a report including the recommended layout and a
conceptual cost estimate of the improvements. Boring locations for°geotechnical
investigation will be determined at this meeting.
3.0 Plan-In-Hand Design
3.1 Modifications to the recommended layout resulting from the Predesign Meeting will
be incorporated into the base plan for the plan-in-hand design and development of
construction drawings.

3.2 The plan-in-hand design will include:
• Typical Pavement Sections
• Intersection Geometry
• Horizontal and Vertical Alignments
• Grading Plan
• Drainage Plan
• Traffic Signal Plan
• Wiring Diagrams
• Phasing Diagrams
• Preliminary Signing and Pavement Marking Plan
• Utility Plan
• Preliminary Pay Quantities
Prepare construction drawings in accordance with ODOT criteria and format.
3.3 Coordinate geotechnical investigation, including soil and pavement borings. The
results will be presented in a report consisting of subsurface exploration, laboratory
testing data, and pavement design recommendations from a qualified geotechnical
testing company.
3.4 Evaluate the condition of the existing pavement to verify existing pavement
structure or base stability. ENGINEER will perform a visual inspection of the
existing pavement and review the pavement borings to determine the extent of
pavement replacement and/or rehabilitation.
3.5 Evaluate the condition of the existing traffic signal equipment in consideration of
relocating or replacing the equipment in the design of the new signal system.
3.6 Coordinate or sequence the two signalized intersections by programming the
controller in the design of the signal system. The OPTICOM priority control system,
which provides right-of-way pre-emption for emergency vehicles, will be included
in the design.
3.7 Evaluate storm sewer/drainage system within the project limits. The adequacy of
existing drainage channels upstream and downstream of this project will not be
evaluated.
3.8 Temporary construction easements, and permanent rights-of-way needed for the
construction of this project will be shown on the Plan-in-Hand plans.
3.9 ENGINEER will prepare a detailed estimate of construction cost.
3.10 Conduct an internal Quality Assessment/Quality Control (QA/QC) review.
Following this review and any resulting modifications, the Plan-In-Hand plans will
be submitted to the CITY and ODOT for review along with aPlan-In-Hand estimate
of construction cost.
3.11 Plan-In-Hand. Representatives of the project team including the project manager
will be present during the Plan-In-Hand review meeting and field inspections with

the CITY and ODOT. ENGINEER will prepare minutes of the meeting and
disseminate to all attendees.
4.0 Public Meeting
4.1 At the CTTY's request, CH2M HILL will conduct a public meeting to present an
overview of the project and answer questions. Displays of the project will be
prepared for the presentation that show the major aspects of the project. A summary
of the meeting will be transcribed and provided to the CITY and ODOT.
5.0 Preliminary Design
5.1 Following the Plan-In-Hand review, Preliminary Design will be prepared.
Modifications and comments from the Plan-In-Hand review will be incorporated
into the design and construction plans, and the Preliminary Design completed.
5.2 Conduct additional field investigations, including field surveys, as .required to
complete Preliminary Design.
5.3 The following drawings will be developed, as a minimum.

• Right-of-Way Map

5.4 Prepare detailed traffic control plans for each phase of construction. Access to
businesses will be maintained at all times.
5.5 Legal descriptions of any right-of-way needs for the project will be prepared and
submitted to the CITY and ODOT. Proposed permanent and temporary rights-of-
way will be shown on the plans. Legal descriptions and parcel maps of proposed
rights-of-way will be prepared and provided to the CITY and ODOT for acquisition.
Copies of the deeds for such properties and other supporting documentation will
also be provided.

5.6 Prepare a utility plan identifying utilities that have a potential for conflict with
construction of the proposed improvements.
5.7 ENGINEER will assist the CITY in coordinating the relocation of those utilities in
conflict with the proposed construction. ENGINEER will conduct a meeting of
affected utility providers to receive input in regard to the relocation of facilities and
projected schedule.
5.8 ENGINEER will coordinate with the CITY and ODOT and prepare necessary
environmental documentation for FHWA clearances and approval.
5.9 ENGINEER will prepare an updated estimate of construction cost.
5.10 An internal QA/QC review will be conducted by a senior engineer of ENGINEER.
Following this review and any resulting modifications, the Construction Documents
will be submitted to the CITY and ODOT for review.
5.11 ENGINEER will furnish the requested number of copies of Preliminary Plans to the
CITY and ODOT for review.
6.0 Final Design
6.1 Following the Preliminary Design review, the Final Design documents will be

Design review will be incorporated into the design and construction plans.
6.2 Conduct final field investigations, including additional field survey, as required to
complete the Final Design.
6.3 ENGINEER will prepare an updated estimate of construction costs.
6.4 ENGINEER will furnish the requested number of copies of Final Plans to the CITY
and ODOT for review.
7.0 Final Revision
7.1 Following receipt of final review comments, final revisions to the Contract
Documents will be made as appropriate.
7.2 ENGINEER will prepare an updated estimate of construction cost.
7.3 An internal QA/QC review will be conducted by a senior engineer of ENGINEER.
Following this review and any resulting modifications, the Construction Documents
will be submitted to the CITY and ODOT for review.
7.4 Original tracings will be submitted to ODOT along with special provisions, special
conditions and special technical specifications, as required, for bidding.
7.5 ENGINEER will furnish the CITY one set of final drawings on mylar reproducible
media and electronic files on disk in AutoCAD Release 13 format.

The conceptual layouts and Predesign Report will be presented within 30-calendar days
following the Notice to Proceed. Plan-In-Hand Plans will be submitted within 90-calendar

within 75-calendar days following receipt of Plan-In-Hand comments. Final Plans will be
submitted for review within 45-calendar days following receipt of Preliminary review

1.0 Reports, Records, etc. To furnish, as required by the work, and not at expense to the

CITY which maybe useful in the work involved under this AGREEMENT.
1.2 Standard construction drawings and standard specifications.
2.0 Access. To provide access to public and private property when required in

3.0 Staff Assistance. Designate in writing a person to act as its representative in respect
to the work to be performed under this AGREEMENT, and such person shall have
complete authority to transmit instructions, receive information, interpret and
define CrrY'S policies and decisions with respect to materials, equipment, elements
and systems pertinent to the services covered by this AGREEMENT.
3.1 Furnish staff assistance in locating, both horizontally and vertically, existing CITY
owned utilities and in expediting their relocation as described in Attachment B.
Further, CITY will furnish assistance as required in obtaining locations of other
utilities, including "potholing".
3.2 Furnish legal assistance as required in the preparation of construction and other
supporting documents.
4.0 Review. Examine all studies, reports, sketches, estimates, specifications, drawings,
proposals and other documents presented by ENGINEER and render in writing
decisions pertaining thereto with a reasonable time so as not to delay the services of
ENGINEER.

BACKGROUND•
The FY 1997-98 Capital Improvements Fund Budget contains $625,000 for a computerization
project. The Management Information Systems Director has been hired with the responsibility
for the acquisition, implementation and maintenance of a computer system network. During the
initial acquisition and implementation stages of the project, funding for this position is proposed
to come from the project budget. The MIS position would be phased in to the General Fund
operating budget during the next fiscal year.
Salaries and benefits for the MIS position would be paid directly from the General Fund
Managerial Department with a transfer from the Computerization Project budget to reimburse
actual expenses. Projected cost of funding this position for the remainder of this fiscal year is
$30,000. Both the General Fund Budget and the Capital Improvements Fund Budget would be
amended.
RECOMMENDATION:
Staff recommends approval of an amendment to the Capital Improvements Fund Budget
decreasing the expenditure for the computerization project by $30,000 and increasing a transfer
to the General Fund by $30,000; and an amendment to the General Fund budget increasing the
expenditure for the Managerial Department Personal Services by $30,000 and increasing a
transfer from the Capital Improvements Fund by $30,000.

BACKGR
On October 14, 1997, the citizens of Owasso approved Ordinance #553 amending the sales tax
ordinance and approving projects. Projects and funding sources were listed on "Exhibit A" of
the ordinance. In order to create a record that best demonstrates compliance with the sources
and uses of funds specified in Ordinance #553 and Exhibit A (see attachment), staff proposes
to establish a new accounting fund of the City, the Bond Projects Fund.
Funding for these projects comes from three different sources: Revenue Bonds (to be issued this
year), the OPWA Sales Tax Capital Future Fund account, and the Capital Improvements Fund.
Accounting for all of the projects in the "Bond Projects Fund," will necessitate transferring all
of the funding sources to the new Bond Projects Fund.
Aggregating the various monies into one Fund will require several actions:
• Establish the Bond Projects Fund,
• Approve a Bond Projects Fund budget,
• Transfer the Capital Future Fund account,
• Transfer the 86th Street reserves (Capital Improvements Fund),
• Transfer the existing allocation for City Hall (Capital Improvements Fund),
• Amend all affected budgets.
BOND PROJECTS FUND BUDGET:
Staff is proposing the use of aProject-Length Budget as well as a Fiscal Year budget for this
fund. The project-length budget allows Council to authorize all of the projects as approved by
the voters. The Fiscal Year Budget allows Council to approve a budget limited to the revenues
available during the current fiscal year. Use of aProject-Length Budget will enable reporting
on these projects on a "from inception" basis in addition to the traditional fiscal year basis.
Proposed "Total Revenue" for the Bond Projects Fund, Project-Length Budget is $9,999,000.
(See Attachment.) This is $16,000 more than estimated in Ordinance #553, Exhibit A. That
difference represents "existing monies already allocated to City Hall" (now the Police Station
Project) exceeding the $100,000 estimate. Other differences between the proposed revenue
budget and Exhibit A are due to modifications made in December to refund the 1988 Revenue
Bonds. (Proceeds of the Revenue Bonds increased by $500,000 and reserves on hand decreased
by $500,000.)
Proposed "Total Expenditures" for the Bond Projects Fund, Project-Length Budget is
$9,999,000. This total includes the $9,721,000 Exhibit A projects plus the above mentioned
$16,000 and another $262,000 which was unspecified in Exhibit A. Proposed budgets for the
streets and facilities projects have been reduced by $142,000 to bud eg_t separately for en ig_neering
services through the end of fiscal year 2000. (Engineering budget is allocated 80% to streets
and 20% to facilities projects.) Salaries for engineering services actually will be paid from the
General Fund Engineering Department. The General Fund will be reimbursed by a monthly
transfer from the Bond Projects Fund.
Staff is recommending authorization to establish the Bond Project Fund and approval of the
attached budget.
OPWA SALE5 TAX CAPITAL FUTURE FUND ACCOUNT:
Ordinance #553 amended the purpose of the City's one percent sales tax.. Section 4 of the
ordinance states, "...the amounts in the OPWA Capital Future Fund accumulated to date, plus
those amounts to be accumulated through June 30, 2001, shall be immediately available to fund
those projects listed on Exhibit "A" hereto...."
Staff is recommending approval of an amendment to the budget and authorization to transfer the
existing balance of $1,150,161.56 from the OPWA Sales Tax Capital Future Fund account to
the Bond Projects Fund. Staff is also recommending authorization to make monthly transfers
of fifteen percent (15 %) of one percent sales tax to the Bond Projects Fund.

CAPITAL IMPROVEMENTS FUND:
The current Capital Improvements Fund budget includes unencumbered funds of $153,000 for
' the 86th Street & Main Intersection project and $116,000 for City Hall renovation. These items
are listed in the estimated funding sources on Exhibit A of Ordinance #553. Staff is
recommending amendments to the Capital Improvements Fund budget and authorization to
transfer $269,000 to the Bond Projects Fund.
RECOMMENDATION:
Staff recommends Council approval of the following:
Establish the Bond Projects Fund.
Approve the Bond Projects Fund Project-Length and Fiscal Year Budgets (attached).
Approve an amendment to the Capital Improvements Fund budget decreasing the
appropriation for project expenditures by $269,000 and increasing a transfer to the Bond
Projects Fund by $269,000.
Approve an amendment to the General Fund budget increasing the appropriation to the
Engineering Department, Personal Services expenditures by $30,100 and increasing a
transfer from the Bond Projects Fund by $30,100.
Staff recommends OPWA Trustee approval of the following:
Approve an amendment to the OPWA Sales Tax Capital Future Fund account budget
increasing the appropriation to transfer $1,150,162 to the Bond Projects Fund.
Approve a transfer of $1,150,161.56 from the OPWA Sales Tax Capital Future Fund
account to the Bond Projects Fund.
Approve monthly transfers of those amounts (15% of one percent of the sales tax) to be
accumulated through June 30, 2001 to the Bond Projects Fund.

used (i) to pay the principal and interest requirements
on The Owasso Public Works Authority's Public Improvement
Revenue Bonds, Series 1988 issued in the original
principal amount of $6,100,000 and/or the Authority's
Public Improvement Revenue Bonds to be issued in the
original principal amount of not to exceed $8,500,000, or
any indebtedness issued to refund said bond issues, (ii)
after paying debt service on the referenced bond issues,
for making deposits in an amount equal to fifteen percent

to the Capital Future Fund of the City for the purposes
of funding future capital improvement projects of Che

to the acquisition of at least 50 acres of property suitable for
industrial development. Cost of acquiring such property would be
between $200,000 and $350,000, depending upon location and access

the land acquisition as a project, without the resources necessary
to develop the property, might not be in the best interest of the
