All matters listed under "Consent" are considered by the City Council to be routine and will be enacted by one motion. Any Councilor may, however, remove an item from consent by request. Attachment #8 ~, The City of Owasso has been awarded a grant in the amount of $35,000 by the Oklahoma ' Department of Commerce for the purpose of remodeling and repairs to the roof of the Community Center. Consideration and Appropriate Action Relating to the Purchase of a Vehicle to be Assigned to the City Manager, and Authorization for Payment of Such Purchase. Mr McElrath Attachment #9 The staff will recommend Council approval of the expenditure of $22,555 to Mike Quinn Dodge, Tulsa, OK for the purchase of one 1998 Dodge Grand Caravan, as per specifications. i~ 10. Consideration and Appropriate Action Relating to a Request from A/D Group to Rezone 168.692 Acres, More or Less, Located North and West of East 96th St N and the Owasso Expressway; from AG (Agriculture) to CS (Commercial Shopping Center), OL (Office Light), RS-3 (Residential Single-Family High Density), RS-2 (Residential Single-Family Medium Density), and RE (Residential Estates). Mr Rooney Attachment # 10 The Owasso Planning Commission has conducted a hearing on this request and has recommended Council approval of the requested zoning. The staff concurs with that ~ recommendation. 11. Consideration and Appropriate Action Relating to the Award of a Contract for the Construction of a Parking Lot at the Sports Park. t Mr Rooney Attachment # 11 ' The staff has completed the bidding process, reviewed the bids received, and will recommend that the Council award a contract for the construction of a parking lot at the Sports Park to Horizon Construction, Owasso, OK in the amount of $77,777.77. ^ Owasso City Council March 17, 1998 Page 4 12. Adjournment PROCLAMATION CITY OF OWASSO, OKLAHOMA WHEREAS, The Owasso Senior High School Concert Band has been named a recipient of the international "Sudler Flag of Honor" awarded by the John Philip Sousa Foundation; and, WHEREAS, The Sudler Flag of Honor is awarded to high school concert bands that have - - demonstrated particularly high standards of musical excellence over a period of several years; and, WHEREAS, The bands chosen for this award must have been rated "superior" at state, regional, national, or international levels in concert activities; and a number of the students must have participated in district, all-state, or national honor bands; and, WHEREAS, The band program must offer to the students a complete and balanced program of musical activities, including the concert, solo-ensemble, and marching areas; and the band director must have been in the position of director for at least seven years; and, WHEREAS, The City Council would like to congratulate the Owasso Senior High School Concert Band for this outstanding achievement, and recognize the band as one of the first two bands from Oklahoma to receive the Sudler Flag recognition; NOW, THEREFORE, I, Mary Lou Barnhouse, by virtue of the authority vested in me as Mayor of the City of Owasso, do hereby proclaim Tuesday, April 7, 1998 as OWASSO SENIOR HIGH SCHOOL ' CONCERT BAND DAY in the City of Owasso, Oklahoma, and do further encourage all Owasso residents and businesses to express their thanks and congratulations to Band Director David Gorham and the entire band on that day for this achievement. This an International award of great distinction. Only four high school bands from the entire United States and Canada were selected for this international honor for 1997. Only thirty-four high schools have been so honored during the l5 years during which time the Sudler Flag award program has been in operation. I am sure that the faculty and student body of the Owasso High School as well as the entire community is immensely proud of this fine band and its superb director, Mr.David Gorham and would appreciate a letter of commendation from your office. The awards ceremony is scheduled to take place during a gala concert to be performed by the Owasso Concert Band in the school auditorium at 8:OOPM on Tuesday April 7th .. Prof. Gene Thailkill, Director of Bands at the University of Oklahoma will make the presentation. Owasso and Westmore High School Bands will be the first two bands from Oklahoma to receive the Sudler Flag recognition. Owasso City Council March 3, 1998 ITEM 5: REQUEST BY CITIZEN TO ADDRESS THE CITY COUNCIL Mr Eddie Boback addressed the Council with concerns about handicapped parking. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #98-02. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OWASSO. OKLAHOMA. APPROVING THE INCURRENCE OF INDEBTEDNESS BY THE OWASSO PUBLIC WORKS AUTHORITY (THE "AUTHORITY") IN CONNECTION WITH THE ISSUANCE OF ITS PUBLIC IMPROVEMENT REVENUE BONDS. SERIES 1998 (THE "BONDS")• PROVIDING THAT THE DECLARATION OF TRUST CREATING THE AUTHORITY IS SUBJECT TO THE PROVISIONS OF THE GENERAL BOND INDENTURE. Mr Ray and Mr Keith McDonald presented the resolution, approving the incurring of indebtedness by the Owasso Public Works Authority in connection with the issuance of Series 1998 revenue bonds and containing other provisions relating to the issue. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF A FINAL PLAT FOR CAUDLE ESTATES. Mr Rooney presented the item. He said that the Planning Commission has reviewed the request for a final plat for Caudle Estates and recommends Council approval. Caudle Estates is located south and west of the southwest corner of E 96th St N and Garnett Rd, and contains 38 lots of 2 ;~ Owasso City Council March 3, 1998 ~ approximately 11.34 acres. Dr Bode moved, seconded by Dr Standridge to approve the final plat for Caudle Estates. ' AYE: Bode, Standridge, Wilken, Barnhouse NAY: None • Motion carried 4-0. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ~ AWARD OF A CONTRACT FOR AUDITING SERVICES FOR FY 1997-98 AND AUTHORIZATION FOR THE MAYOR TO EXECUTE SUCH AGREEMENT. Ms Bishop said that notices seeking proposal for audit service were sent to interested accounting ~ firms in January. Six firms responded and were reviewed and evaluated. The RFP specified that the sealed fee proposal include a total price for the audit for the 1997-98 fiscal year and each of the four succeeding fiscal years. Staff recommendation was based on evaluation criteria and client references, as well as the quoted fee. Mr Wilken moved, seconded by Dr Standridge, to approve a contract for auditing services for the fiscal year ending June 30, 1998 with the firm of Michael A Crawford Inc of Oklahoma City for a fee of $20,400. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO DECLARE CERTAIN PROPERTY OBSOLETE OR SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZE THE SALE THEREOF. ~ Ms Worley presented the item, saying that the Owasso City Council accepted a grant from the ,.. Tulsa Area Agency on Aging for the purchase of a new commercial refrigerator for the Community Center. The old refrigerator needs to be disposed of, and the Owasso Senior Citizens Foundation has expressed a desire to have the refrigerator donated to their organization to be sold as a fundraiser. Because the City cannot legally donate to any group, it was suggested ~ that the refrigerator be sold to the Foundation for a nominal amount. Mr Wilken moved, seconded by Dr Standridge,to declare a certain commercial refrigerator located at the Community surplus to the needs of the City and to authorize the sale of the refrigerator to the Owasso Senior Citizens Foundation for the sum of one dollar. 3 Owasso City Council March 3, 1998 AYE: Wilken, Standridge, Bode, Barnhouse NAY: None Motion carried 4-0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF REPAIRS TO THE 1993 CHEVY SUBURBAN. Mr Ray presented the item. On January 8, 1998, the 1993 Chevy Suburban was damaged in a vehicle accident, with damage being sustained to the front of the vehicle. Price estimates for repair were obtained from Pruitt's Body Shop and Foster's Body Shop. The lowest estimate was $4477.44 from Pruitt's; however after the estimate was received, the Fire Department was notified that additional repairs would be necessary, bringing the cost for repairs to $5502.65. After the repairs are completed, new decals will have to be applied at a cost of approximately $600.00. Mayor Barnhouse asked if the Suburban would be utilized as a "take-home" vehicle in the future. Mr Ray said that it would not. Dr Bode moved, seconded by Dr Standridge, to authorize repairs to the 1993 Chevy Suburban, in the amount of $5502.65 to Pruitt's Body Shop, and authorization for payment. ITEM 11: REPORT FROM CITY MANAGER Mr Ray reported that several of the Capital Improvement Projects have been initiated, and that the RFP for the computer upgrade is almost ready. He also said that steps have been taken for conflict resolution in the police department. ITEM 12: REPORT FROM CITY ATTORNEY No report. ITEM 13: REPORT FROM CITY COUNCILORS Vice Mayor Standridge thanked everyone for attending the Council meeting in response to his letter in the Owasso Reporter. Because the City of Owasso was already involved in a CDBG project that had not yet been ' closed out, the funding criteria did not allow the awarding of additional CDBG monies. The application process was resumed in July, 1997, on the basis of the July, 1996, resolution that was still in force. With the assistance of Mr. Andy Armstrong of INCOG, the City was successful in obtaining a CDBG grant in the amount of $35,000 for the purpose of remodeling and/or repairs to the Community Center. The purpose of the grant was left rather broad in scope so that any work undertaken could be made to dovetail with work that it was anticipated would be done under the auspices of the October, 1997, bond issue. Staff has since determined that the most likely and suitable use of the funds would be in the area of roof repair or replacement. At this point, it is still to be determined whether the funds would actually go directly toward such or would be utilized in moving of the heating and air conditioning units from the roof to the ground in preparation for a new, pitched roof. The final determination will depend upon architectural remodeling plans for the City Hall/Community Center complex. ~ As indicated on the letter in attachment A, The Oklahoma Department of Commerce has issued the papers necessary for the City of Owasso to receive the grant monies. The grant contract ' allows $34,000 toward the work to be done at the Community Center and $1,000 for cost of INCOG's administrative work on the project. The papers include three documents: 1. First is the certificate that authorizes signatories of the persons who are to have the authority to sign the ODOC contract and contract modifications. These persons will have the authority to sign Requests for Funds and to sign the official reports associated with the Contract. CDBG GRANT MARCH 11, 1998 PAGE 2 2. The second document is the actual contract itself. 3. The third authorizes ODOC automatically to send copies of all contract correspondence to INCOG as our consultant. In any agreement with any subcontractor or any agent for the Contractor, the Contractor will specify that such subcontractors or agents shall hold harmless the State of Oklahoma, its agents, officers and employees for all the hereinbefore-described expenses, claims, actions or amounts recovered. COMPENSATION TO CONTRACTOR a. Funds made available pursuant to this contract shall be used only for expenses incurred during the period funded as specified in Part I for the purposes and activities approved and agreed to by ODOC. No ODOC funds may be used for expenses incurred either prior to or after the time period specified with the exception of expenses incurred in the preparation of preliminary architectur- al/engineering plans and specifications, if required as a part of the application for funding of this contract. b. ODOC shall disburse funds to the Contractor upon receipt and approval by ODOC of timely, properly executed Re- quests for Funds. The Contractor may submit a Request for Funds as often as necessary to meet its financial obligations. All funds received shall be expended within three (3) days of receipt. No funds shall be disbursed by ODOC when any of the following conditions are present: 1. The latest Monthly Expenditure Report due has not been received and accepted by ODOC. The Contractor is required to submit a Monthly Expenditure Report by the tenth (10th) of the month following the receipt and/or expenditure of funds; 2. Any Quarterly Report is past due; 3. Funds are requested for activities not listed on the contract budget or are in excess of the current budget amount for a particular activity. c. All requests for funds should be submitted to ODOC during the period funded. A final claim may be submitted no later than sixty (60) days after the final date of the period funded. Said claim will be allowed only for reim- bursement of actual expenditures. Any claim submitted after the sixty (60) days may be disallowed by ODOC. d. If ODOC determines that payment based on estimated expenditures is resulting in accumulation of excessive balances of cash on hand, ODOC may modify the basis for compensation to the Contractor to effect proper cash management. e. If a question arises as to the validity of any claim made under this contract and the parties are unable to resolve such question by negotiation, then the Contractor may ' request a resolution of the question pursuant to the terms of this contract and the administrative procedures available through ODOC rules promulgated pursuant to the Oklahoma Administrative Procedures Act, 75 O.S. §§251, et sea. 13. RELEASE OF FUNDS a. No costs, with the exception of administration and engin- eering, shall be incurred until after the Contractor has CDBG 97 II - 7 of 10 received written notice from ODOC that the Contractor has ~ satisfied the specific requirements listed herein for ~"~ release of funds. The Contractor shall submit a finding of Exemption (CDBG Sample 3) to the Oklahoma Department ~ of Commerce prior to requesting the release of funds for ~ ~°~~~ administration and engineering. The Contractor may ~"~ submit a request for release of funds for this activity prior to the release of other funded activities. PROCUREMENT .a. Procurement, management and disposition of property ~, ~, acquired with contract funds shall be governed by federal and State law, and as directed by ODOC in the Contractors Implementation Manual. Applicable State laws include the ~'1 Public Competitive Bidding Act of 1974, 61 O.S. §§101, ~„ et sea. ta! ~' b. Materials acquired for construction purposes shall be ~'* deemed real property once they have become part of the ~' construction. t 15. RE CORDS REPORTS, DOCUMENTATION ,: m . ~ a. The Contractor shall maintain records and accounts, ~ ,,, ~'` including property, personnel and financial records, that Wv properly document and account for all project funds. ~_" Specific types and forms of record are required in the '~~ ODOC Contractors Implementation Manual previously received by the Contractor. b. The Contractor shall retain all books, documents, papers, '~,•- records and other materials involving all activities and CDBG 97 II - 8 of 10 transactions related to this contract for at least three (3) years from the date of submission of the Final Expenditure Report or until all audit findings have been resolved, whichever is later. All records and accounts shall be made available on demand to the Oklahoma State Auditor and Inspector, HUD, the Comptroller General and ODOC, its agents and designees for inspection and use in carrying out its responsibilities for administration of funds. c. The Contractor will submit to ODOC documentation of local leverage funds used for the project in such form and at such times as required by ODOC. d. The Contractor shall submit a Quarterly Report (form 4:4) by the fifth (5th) day of January, April, July and October. 16. CLOSING OUT OF PERIOD FUNDED a. The Contractor shall promptly. return to ODOC any funds received under this contract that are not obligated as of the final date of the period funded. Funds shall be considered obligated only if goods and services have been received as of the final date of the period funded. b. ODOC may unilaterally modify this contract to subtract the total amount of funds not obligated by the Contractor as of the final date of the period funded. c. The Contractor cannot close out the contract until the project is completed and all monitoring issues have been resolved and approved by ODOC. d. The Contractor shall submit closeout documents in accordance with the forms and policy in the Contractors Implementation Manual no later than sixty (60) days after the final date of the period funded or upon completion of the project. 17. AUDIT, DISALLOWED COSTS a. The Contractor shall comply with ODOC's Audit Policies and Audit Procedures, which are incorporated herein and made a part hereof. b. The Contractor shall provide ODOC with timely copies of reports on any audits that include funds received from ODOC. c. In the event an audit results in the determination that the Contractor has expended contract funds on unallow- able costs, the Contractor shall reimburse ODOC in full for all such costs. 18. PROGRAM INCOME The Contractor shall account to ODOC for all Program Income resulting from this agreement, as provided in 24 CFR 570.489(e). Disposition of Program Income will be determined by ODOC. 19. INTERPRETATION, REMEDIES a. In the event the terms or rovisions of this contract are ~ P ~ ~~ zx• ~ breached by either party or in the event a dispute shall ~ ~b ~'° ~' CDBG 97 - II - 9 of 10 arise between the parties regarding the meaning, require- ments or interpretation of the terms and provisions of this contract, then such breach or dispute shall be resolved pursuant to the terms of this contract and the administrative procedures available through ODOC rules promulgated pursuant to the Oklahoma Administrative Procedures Act, 75 O.S. §§251, et sea. b. Neither forbearance nor payment by ODOC shall be con- strued to constitute waiver of any remedies for any default or breach by the Contractor that exists then or occurs later. 20. TERMINATION OR SUSPENSION a. This contract may be terminated or suspended in whole or in part at any time by written agreement of the parties. b. This contract may be terminated or suspended by ODOC, in whole or. in part, for cause, after notice and an oppor- tunity for Contractor to present reasons why such action should not be taken. Procedures for such a process shall be in accordance with the General Rules of Practice and Procedure of the Department. Grounds constituting cause include but are not limited to: (1) The Contractor fails to meet the requirements for Release of Funds within one hundred twenty (120) - days after the beginning of the contract period; (2) The Contractor fails to commence actual construc- tion or otherwise begin implementation of the funded project within two hundred seventy (270) days from the start date of the contract; (3) The Contractor fails to comply with provisions of this contract or with any applicable laws, regula- tions, guidelines or procedures, including ODOC policies and issuances, or is unduly dilatory in executing its commitments under this contract; (4) Purposes for the funds have not been or will not be fulfilled or would be illegal to carry out; (5) The Contractor has submitted incorrect or incom- plete documentation pertaining to this contract; (6) The Contractor is unduly dilatory in executing its commitments under a prior contract with ODOC, including, but not limited to submission of any audits due, resolution of audit findings and monitoring results. c. In the event of termination or suspension, the Con- tractor shall be entitled to payment for otherwise valid and allowable obligations incurred in good faith prior to notice of such action and to reimbursement for rea- sonable and necessary expenses. The Contractor shall reduce to the minimum possible obligations, prepaid expenses and other costs. d. The Contractor shall not be relieved of liability to ODOC for damages sustained by ODOC by virtue of any breach of this agreement by the Contractor. ODOC may withhold payments due under this agreement pending resolution of the damages. ~ MEMORANDUM ~ TO: THE HONORABLE MAYOR AND CITY COUNCIL ' McELRATH ~ ~ FROM: JIM SUPPORT SERVICES DIRECTOR SUBJECT: VEHICLE FOR CITY MANAGER DATE: March 12, 1998 ^ BACKGROUND: ' In the FY98 budget $25,000 was budgeted with which to purchase a new vehicle for use by the City Manager. This would replace the vehicle that the City Manager _ currently drives -- a 1979 Chevrolet Caprice with 150,000 in mileage. The duties of the City Manager require the use of a vehicle that is capable of high usage and frequent highway trips out of the Owasso and/or Tulsa area. While the 1989 Caprice is still serviceable, it has reached the point at which, or beyond, that the City of Owasso usually transfers vehicles to a department in which it would be driven less and kept primarily for local or utility use. In light of the above considerations, Staff has researched vehicles available that would provide the City Manager with the kind of dependable transportation suited to the demands of the position. In addition, because from time to time the need also arises to transport groups of Five or six passengers in a City Vehicle, staff targeted a vehicle that would allow such use. At the present time the City does not own a vehicle suitable for comfortably transporting six passengers. The vehicle that appeared best suited for the above purposes appeared to be the mini-van. While a larger vehicle such as a Sports Utility/Surburban would accomplish the above, it would not be as accessible to passengers. Also, the price ranges for such vehicles are generally well in excess of the budgeted amount. The all-around highest-rated minivan for general passenger use is the Chrysler product. The Dodge version of this vehicle is also the one carried on the State bid list; this fact provided Staff with a valuable cross reference in considering the quotes, since the State Bid price is generally considered to be highly competitive. As evidenced from the letter attached, Staff solicited sealed quotes from three area vendors and also considered the price from the State bid list. Vendors that were contacted and that submitted sealed quotes were: East Tulsa Dodge 4627 S. Memorial Dr. Tulsa, OK 74145 Mike Quinn Dodge 2111E 11th Tulsa, OK 74104 Jim Glover Dodge 2920 N Aspen Ave Broken Arrow, OK 74012 The bids received are listed on the attached documents. They were as follows: East Tulsa Dodge: $22,655 Mike Quinn Dodge: $22,555 Jim Glover Dodge: $23,930 State Bid List: $22,750 All vehicles quoted include the features specified in the bid, with the exception of the State Bid List, which does not contain the Security Alarm. The lowest quote was $22,555 from Mike Quinn Dodge. Staff recommends that the City Council accept the bid quote from Mike Quinn Dodge in the amount of $22,555 for the purchase of the 1998 Dodge Caravan as specified above. Staff also recommends that the Council authorize the purchase from line item 51-110-5442, `capital expenditures for vehicles', from the Managerial Department budget, which contains a present balance of $25,000. Staff also recommends that the Council authorize the expenditure of $22,555 for the purchase of the vehicle. Avenue. The subject property, totals approximately 168 acres, more or less, and is currently undeveloped. The current zoning on ~ the subject property is AG (Agriculture) and the applicants are requesting a rezoning to CS (Commercial Shopping Center), OL (Office Light), RS-3 (Residential Single-Family High Density), RS-2 (Residential Single-Family Medium Density), and RE (Residential Estates). At the February 10, 1998 meeting, the Owasso Planning Commission reviewed the rezoning ' request for the Johnson property. The rezoning request at that time included requests for CS, OL, RS-3, RM-2 (Residential Multi-Family High Density), and RD (Residential Duplex). As ~ you are aware, the Planning Commission recommended a tabling of that item until March 10, 1998 in response to objections against the proposal from a large number of protestants (approximately 200 citizens). The Planning Commission advised the citizens that their reason for tabling the item was in order to afford an opportunity for both the applicant and citizens to meet to attempt to work out areas within the application that were of concerns to them, but with the understanding that the meeting should be conducted in a serious, logical manner with the ~, understanding that the property was likely to develop. Staff established a meeting date of February 24, 1998 at 7:00 PM in the Owasso Community Center in order to provide for that opportunity. Representatives who had taken on a "lead" role amongst the citizens were contacted to inform them of the scheduled meeting, and notice was published in the Owasso Reporter. At that meeting, about 25-30 citizens attended the meeting, each representing a different neighborhood adjacent or near the subject property. A "matter of fact" approach was taken by those in attendance, and the meeting produced concessions by both parties which resulted in a resolution. The applicants have withdrawn the portions of the request that included RM-2 (Multi-Family) and RD (Residential Duplex) zoning, resulting in an expansion of the RS-3 (Residential Single- Family High Density) Zoning and CS (Commercial Zoning). OL (Office Light) zoning was expanded along N. 129 E. Avenue, thus replacing some CS zoning that had existed immediately across N. 129 E. Avenue from some residential properties. Both RE and RS-2 buffers were provided by the applicant along their northern and western boundaries as recommended by staff ' at the time of the initial review. The Planning Commission reviewed the amended zoning submittal at their March 10, 1998 regular meeting. About 50 citizens attended that public hearing, two of which asked questions to the Planning Commission regarding street alignment and detention requirements. No one in the audience spoke in opposition to the request and a complete copy of the staff report is attached for your information and review. The Planning Commission unanimously recommended approval of the rezoning request, as amended by the applicant. If approved by the Ciry Council, an Ordinance formally adopting the approval of the rezoning of the property would be placed on the April 7, 1998 City Council agenda. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from AG (Agricultural) to CS (Commercial Shopping Center); OL (Office Light); RS-3 (Residential Single-Family High Density); RS-2 (Residential Single-Family Medium Density); ~ and RE (Residential Estates). LOCATION AND SIZE: The property is generally located west and north of E. 96th Street North and the Owasso Expressway, south of Sherrill Acres and west of the planned Bailey Ranch Estates II. The subject property contains approximately 168.692 acres. EXISTING LAND USE: The subject property is currently undeveloped. t SURROUNDING LAND USE: The subject property is abutted on the south by E. 96th Street north, while farther south lies CS (Commercial Shopping Center), OM (Office Medium), OL (Office Light) and RM-2 (Residential Multi-Family High Density) zoned property, a portion of which is developed with the new ONG Work Center. ~ The subject property is abutted on the east by the Owasso Expressway and N. 129th E. Avenue, while farther east lies the Glenn-Mir Acres Addition (Tulsa County) which is zoned RE (Residential Estates). ~ The subject property is bordered on the north by the Sherrill Acres Addition and additional property owned by the Johnsons, both of which are zoned RE (Residential Estates). .• The subject property is bordered on the west by the planned Bailey Ranch Estates II zoned Planned Unit Development with an underlying zoning of RS-2 (Residential Single-Family Medium Density) and additional property which has developed residentially (Tulsa County) ~ and is zoned AG (Agriculture). Staff Report ~ OZ-98-07 Page 2 of 6 SITE INFORMATION: No unusual development hardships are noted. ANALYSIS The applicant's original submittal, reviewed by the Planning Commission on February 10, 1998, was tabled in order to allow for representatives from surrounding neighborhoods to meet with the applicant to discuss their concerns. Staff secured both parties a meeting place and time for that meeting and it was conducted on Tuesday, February 24, 1998 at 7:00 PM at the Owasso Community Center. The meeting was conducted in an orderly manner and logical concerns from neighboring property owners were brought to the table. As a result of that meeting, slightly over an hour in length, the applicant removed both the multi-family and duplex portions from the ~ application (replaced with RS-3 and CS), removed a portion of the commercial zoning along N. 129 E. Avenue (replaced with OL), and extended the proposed RS-2 buffer along the subject property's west property line. The proposed rezoning as amended, would create multiple zonings on one large, undeveloped tract of land. The tract contains a total of 168.692 acres which is proposed for several different zoning classifications (Residential, Commercial, and Office) of varying intensity. Because the request before you contains multiple zonings, staff will review each individual portion of the zoning request separately, concentrating on that individual request, its w _ relationship to existing and what is proposed, and review of basic planning principle as applied to the individual request in that area. CS -Commercial Shopping Center ~ The applicant's request contains one large area (57.23 acres, approximately 34 % of the entire tract under zoning consideration) in which they are requesting commercial zoning. The area is located along the south and southeast portions of the parcel. This area would abut E. 96th Street North, the Owasso Expressway, and a small portion of N. 129th E. Avenue. The Comprehensive Plan for the City of Owasso does identify this area for commercial development. Specifically, it defines this area as being a "Type Two Activity Center" located at the intersections of primary arterial streets. A "Type Two Activity Center" is ~ forty (40) acres, ten (10) acres distributed to each corner. While the applicants request is slightly larger than what the Comprehensive Plan deems appropriate, it is consistent with that which is found at the intersection of E. 86th Street North and the Owasso Expressway. It is important to note that while the Planning Commission should consider surrounding property zoning and uses, one of the most important factors to be considered is the appropriate zoning of this parcel today. Certainly the location of the property itself, more 1 Staff Report OZ-98-07 ~ Page 3 of 6 ~.. specifically the portion of which that CS zoning is being sought, lends itself to commercial development. Direct access would appear to be limited to E. 96th Street North (primary arterial), with nearby access to the Owasso Expressway, would support large scale commercial development. Access to N. 129th E. Avenue would occur through the proposed i~ OL zoning, and should not adversely impact those neighbors east of N. 129th E. Avenue. Please note that the Comprehensive Plan, while identifying a 10 acre parcel on the corner for commercial development, did not identify the remainder of this area for commercial development but rather for High Intensit~Industrial Development. Staff would strongly suggest that the Comprehensive Plan is outdated in this area and that a commercial use of the property would be more appropriate. OL -Office Light The applicants request contains two areas in which they are requesting office zoning. The first area, located along N. 129th E. Avenue immediately north of the tract in which the applicants aze requesting CS (Commercial Shopping Center) zoning and contains 5.65 acres (3 % of the entire tract). While the Comprehensive Plan does not identify this area for office development (identified in the 1985 Comprehensive Plan as Residential), it should be noted that the Plan may be outdated in this azea as well. The likelihood of Low Density Residential occurring immediately adjacent to CS development is improbable; not to mention that it is also improbable for property within the Ciry Limits of Owasso required to have sanitary sewer to develop as low density at all, whether it abutted Commercial zoning or not. The Office zoning which is proposed would allow for such uses as medical, dental, insurance, and professional offices and could include a hair styling salon by Special Exception. Generally, retail type uses aze excluded in any OL district. OL zoning at this location may be considered to be a preferred buffer from any possible commercial development within the subject property to the south and the existing residentially developed property to the east and the proposed residential development (RE) to the north. The staff and other applications considered by the Planning Commission have established a pattern of utilizing OL zoning as a buffer between Commercial and Residential property, most recently along the Owasso Expressway near the Three Lakes Addition (Castle Point), as well as E. 86th Street North. The second area, located west of the proposed CS zoning, is located neaz the southwest corner of the entire subject property and contains 10 acres (6% of the entire tract). Similar to the other area of the subject property in which OL zoning is being requested, the Comprehensive Plan identifies portions of this azea as being appropriate for both High Intensity Industrial and Residential development. The applicants request for office Staff Report OZ-98-07 Page 4 of 6 development in this area would again act as a buffer between the proposed Commercial development and the residential development proposed to the west. Additionally, the OL zoning being requested includes a finger parcel of proposed OL zoning connecting the area of OL zoning along N. 129th E. Avenue to the OL zoning along E. 96th Street North, directly adjacent to the CS zoning (3% of the entire tract). Once again, this portion would act as a buffer between the proposed commercial zoning and the residential zoning being proposed by the applicant. Staff would expect that this portion would develop as a combined landscape buffer and pedestrian trail area, the concept of which is not only _ strongly endorsed by staff, but by planning professionals throughout our country. RS-3 Residential Single-Famil~gh Density ~ The applicants have requested one large area designated for single-family residential high density which is located along the western and northern portions of the subject property. This portion contains 70.63 acres, representing 42% of the entire subject property. The applicants request for RS-3 zoning is a natural transgression of land uses from the more intense to less intense. When the entire subject property and the proposed zoning changes are reviewed as a whole, the zoning pattern requested makes sense. The most intense land use (Commercial) is followed by Office then Single-Family High Density, which is then abutted by Single-Family Medium Density to the west (Bailey Ranch Estates). While the applicant did not request a planned unit development, this is a rather comprehensive approach to the development potential of the site. The applicant has included two buffers to those abutting properties to the north and west. The first buffer area is along the northern boundary of the subject property. The applicant has reserved the northerly 200' of the RS-3 proposal (abutting Sherrill Acres).. for RE (Residential Estates) zoning in order to protect those property owners and represents 8.99 acres or 5 % of the subject tract. A similar buffer was required by the applicants of the ~ Bailey Ranch Estates zoning case in 1994. The second buffer area is located along the western boundary of the subject property. In this area the applicant has supplied a 125' of RS-2 (Residential Single-Family Medium Density) buffer, representing 10.86 acres or 6% of the subject property. The land east of Bailey ,,,~ Ranch Estates is zoned RS-2, and the buffer proposed would ensure comparable lot sizes abutting that property as well. The RS-2 buffer is continued by the applicant from the southern boundary of the proposed Bailey Ranch Estates II to E. 96th Street North. Staff Report OZ-98-07 Page 5 of 6 COMI~~NTS In reviewing whether or not the streets from Sherrill Acres would be required to connect to ~ streets within the subject property at the time of development, staff met with the City Manager and reviewed the stub streets from Sherrill Acres. This meeting and review has resulted in the city's position that the streets will not be required to be connected to the subject property. The streets within Sherrill Acres have bar ditches for stormwater drainage ~ and no curb and gutter. To tie this type of street into a street with curb and gutter would be difficult at best. Additionally, the applicant has stated that these street connections are not vital to the success of their future development, nor do the property owners in Sherrill Acres desire to have the streets connected. Prior to the initial public hearing on February 10, 1998, staff received numerous calls regarding the zoning voicing opposition to various portions of the request. Numerous letters were also submitted to staff which were forwarded to you at the February 10, 1998 meeting. Since the public hearing, staff has received one letter regarding the proposal and conducted one meeting with two nearby property owners. The letter was from a Bailey Ranch Estates resident that had concerns regarding commercial intrusion, multi-family, and the traffic development would bring to Bailey Ranch Estates. Items discussed at the meeting with nearby property owners were questions regarding minimum property development standards, whether or not commercial zoning was appropriate at that location, and street connections. Please note that the meeting and the letter were conducted prior to the February 24, 1998 meeting between neighborhood representatives and the applicant. At the time of packet preparation for this agenda, staff has received no additional comments opposing the applicants amended application since February 24, 1998. Provide six (6) inches Type "A" aggregate over the entire surface and compact a minimum of three (3) passes with asteel-wheel roller. c. Fine grade existing gravel areas to provide a plain surface. The program was developed to privatize the service and provide support so that city crews can continue to carry out their job ~ assignments. Staff evaluation of the program indicates that it continues to be cost-effective. We have continued to make progress on other projects (i.e. street repair, drainage ditch renovation and small construction projects). The use of these private sector contracts have continued to provide the citizens of Owasso with a more efficient delivery of services. The use of full-time employees to perform seasonal mowing is reduced, allowing for more efficient response to the needs of both the Street and Parks Departments. By continuing the privatization of mowing in specified areas, the city full-time work force is able to attend to the other street right-of--way mowing and seasonal maintenance needs that must be accomplished during the spring, summer and fall. There are four criteria used to evaluate the mowing program: quality, timeliness, cost and citizen reaction. Historically, privatized mowing has met or exceeded our expectations in each of these areas. An annual review of the program is used to make adjustments to the program in order to maintain effectiveness. The Parks mowing season is eighteen (18) mowings. Total cost for the season is $9,054.00. Page 3 Mowing Contracts The 1998 mowing bids for the easements, medians and right-of--way areas had a slight decrease of $55.50 to $2,587.00 per mowing. The mowing season for the easements and right-of--ways calls for six (6) mowings. The medians are mowed more frequently, totaling eighteen (18) seasonal mowings. Total cost for the season will be ' $17,382.00. The total expense for all awarded contract mowing of the parks, medians, easements and right-of--ways is ' $26,436.00, a savings of $1,173.00 for the mowing season (1998) compared to the 1997 season. FUNDING SOURCE: Funding for the FY 97-98 mowing program (July-October 1997 and April-June 1998) was approved as part of the Street Division budget for Physical Property Services (51-410-5320), as well as Parks Department (51-631- ' 5320). Funding to continue the mowing July-October 1998 and the start-up of the 1999 season April-June will be included in the FY 98-99 budget. RECOMMENDATION: Staff believes that the utilization of private sector contractors permits the City to use its personnel in a more efficient manner. The bidding process has attracted very competitive bids. "Brush Hog" type mower ,,,,, shall not be used. All grass should be cut 1 to 1'h inches in height.
