CALL TO ORDER 2. ROLL CALL 3. Approval of Minutes from the June 26, 2007 Regular Meeting — David Hall moved to approve the minutes of June 26, 2007. Ken Foster seconded. AYE: Foster, Ramey, Hall, Laakso NAY: None The motion carried 4 -0. 4. OBOA -07 -13 — Marion Homes - A request for a variance from Marion Homes, LLC to allow the reduction of the required 25' front yard setback to 20' and the required 20' rear yard setback to 15' to allow for the construction of a single family home on a property zoned RS -3 (Residential Single - Family), located at 9804 East 108 Court North. Joe Ramey presented the item and Eric reviewed the staff report. The lot layout poses a hardship for the owner to construct a home on the property. Staff finds that approval of the variance will not result in any determental impact on the area. Notification letters were mailed to property owners within 300 feet of the property and the request was advertised in the Owasso Reporter. Staff does recommend approval of OBOA 07 -13. Ken Foster moved to approve the variance request; David Hall seconded the motion. A vote on the motion was recorded as follows: AYE: Foster, Ramey, Hall, Laakso NAY: None The motion carried 4 -0. OBOA 07 -14 — Sherwood Builders — A request for a variance from Sherwood Builders, LLC to allow the reduction of the required 30' front yard setback to 25' and the required 25' rear yard setback to 20' to allow for the construction of single family homes on a property zoned RS -2 (Residential Single - Family), for the entire subdivision of The Lakes BOARD OF ADJUSTMENT August 28, 2007 Page 2 of 3 of Bailey Ranch, located at the southwest corner of 96t1' Street North and Mingo Road. Joe Ramey presented the item and Eric reviewed the staff report. A similar development wide Board of Adjustment Variance was approved in May, 2000 for Camden Park Il. The request will allow for larger homes and compliment Owasso's current housing market. If approved the setbacks will be the same as those in existing RS -3 districts, such as Fairways, Southern Links, and Sawgrass Park. The approval of the variance will not result in any detrimental impact on the area. Notification letters were mailed to property owners within 300 feet of the property and the request was advertised in the Owasso Reporter. Staff does recommend approval of OBOA 07 -14. Mr. Lonnie Lamb (8910 E. 96 St. No.) was present to express concerns regarding storm water drainage in the area. Mr. Joe Nurre with Public Works Department stated that Kellogg Engineering, Inc. had emailed him a memo on the hydrologic effects of decreasing the setbacks at the Lakes of Bailey Ranch (attached). Mr. Lamb requested a copy of the hydrologic report. Mr. Nurre also stated that the city engineers are aware of the issues discussed and the contractor is also aware. Joe Ramey moved to approve the variance; Ken Foster seconded the motion. A vote on the motion was recorded as follows: AYE: Foster, Ramey, Hall, Laakso NAY: None The motion carried 4 -0. 6. OBOA -07 -15 — Drury — A request for a variance from Charlotte Drury to allow the reduction of the required 10' side yard setback to 5' to allow for the construction of a swimming pool on a property zoned RS -3 (Residential Single - Family), located at 9304 North 100 East Avenue. Joe Ramey presented the item and Eric reviewed the staff report. Upon inspection staff found that the utility easement in the rear yard causes a hardship in the location of a pool. By locating the pool off the utility easement, it shifts the pool location to the side yard. The approval of the variance will not result in any detrimental impact on the area. Notification letters were mailed to property owners within 300 feet of the property and the request was advertised in the Owasso Reporter. Staff does recommend approval of OBOA 07 -15. Ms. Drury was present to address any concerns. Ken Foster moved to approve the variance; David Hall seconded the motion. (918) 275 -4080 • Fax (918) 275 -7171 August 20, 2007 RE: Hydrologic effects of decreasing setback limits at Bailey Range It is our opinion that decreasing the front and back setback distance by 5' each way would have minimal hydrologic impact on subdivision. 1. New setback does not guarantee larger house — the average size rooftop will not increase substantially, there is almost zero probability that houses in this additions would have 4,200 sq. ft. roof tops (60' x 70' single story house). 2. The design includes allowance for AVERAGE roof area of 2,700 sq. ft. This is a LARGE single story house. 3. The adjustment of the setback would allow for small swimming pool to be constructed behind a typical house that was set all the way to the front of the building line. While a swimming pool has an impervious surface (water) it is generally not hydrologically connected to the rest of the drainage area, e.g. 4 " -6" of precipitation would be required before the pool would discharge into the drainage area. 4. The storm drain hydraulics show that the flow in the street never approaches capacity, so if it were possible that the real world, as built, on the ground flows exceeded design flows of the pipes, there is still adequate capacity in the streets. The hydraulic structures in the detention ponds would remain unaffected owing to the amount of overhead water and the timing of the peak flows.
