Item F requested approval of Ordinance #576, amending the Owasso Zoning Code relating to design standards for off - street parking areas. Item H requested an extension of a contract with GO! systems to provide gasoline and diesel fuel through June 30, 1999 at a bid margin of .06 per gallon over the Oil Price Index Service, and authorization for the Mayor to execute the contract extension agreement. ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST THAT THE CITY COUNCIL DECLARE TWO VEHICLES SURPLUS TO THE NEEDS OF THE CITY. AND AUTHORIZE STAFF TO DISPOSE OF SUCH. Mr McElrath said that the City has a 1985 Plymouth Grand Fury with high mileage and a non- working air conditioner, and a 1981 International Bus that was once used to transport DOC workers. The bus has not been used for several years and the vehicle is rarely used. Staff believes it would be in the best interest of the City to sell both vehicles. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT FOR FY 1997 -98 STREET REPAIRS AT VARIOUS LOCATIONS BETWEEN THE CITY OF OWASSO AND NEWMAN CONTRACTING COMPANY INC AND :AUTHORIZATION FOR FINAL PAYMENT AND RELEASE OF RETAINAGE TO THE CONTRACTOR. Mr Lutz presented the item, stating that the project has been completed and that all punch list items have been completed. Mr Helm moved, seconded by Dr Bode, to accept the work performed by Newman Contracting Company for street repairs, and to authorize final payment in the amount of $36,421.29 and release of retainage in the amount of $9,630.88. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #577 AN ORDINANCE APPROVING AND ADOPTING AN ACTION BY THE OWASSO PUBLIC WORKS AUTHORITY WHEREIN ' WATER AND WASTEWATER CONNECTION FEES WERE INCREASED. Mr Carr said that the approval of OPWA Resolution #98 -04 by the Trustees requires that the City Council establish an ordinance approving those fees. Ordinance #577 takes that action. Dr Bode moved, seconded by Mr Wilken, to approve Ordinance #577 establishing connection fees charged to City of Owasso water and wastewater customers and approving action taken by the OPWA to establish those fees. I AYE: Bode, Wilken, Helm, Barnhouse NAY: None IMotion carried 4 -0. 1 3 Owasso City Council C April 21, 1998 ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A) ACCEPTANCE OF SANITARY SEWER IMPROVEMENTS OF THE TULSA COUNTY SEWER IMPROVEMENT DISTRICT #6• B) APPROVAL OF ORDINANCE #578. AN ORDINANCE APPROVING THE CONSOLIDATION OF THE TULSA COUNTY SEWER IMPROVEMENT DISTRICT #6 WITH THE WASTEWATER COLLECTION SYSTEM OF THE CITY OF OWASSO DEFINING THE TERMS AND CONDITIONS RELATING THERETO, C) APPROVING AN AGREEMENT WITH TULSA COUNTY SEWER IMPROVEMENT DISTRICT #6 FOR THE CONSOLIDATION OF SUCH SEWER DISTRICT WITH THE CITY OF OWASSO WASTEWATER COLLECTION SYSTEM: AND AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS RELATED THERETO. Mr Carr said that in 1995 the homeowners in Pleasant View Addition approached the staff concerning the possibility of connecting to the City's sanitary sewer system to alleviate septic system problems in their subdivision. The homeowners formed a sewer improvement district and issued bonds to finance construction of sewer lines conforming to City standards. The City Council voted on February 18, 1997 to accept, operate and maintain the system, contingent upon a vote of the sewer improvement district. The District agreed to the consolidation in March of 1997. Work on the sewer system has been completed and inspected by City staff, and is ready for acceptance by the City Council. Steps required are to accept the sanitary sewer system, approve an ordinance consolidating the District with the City of Owasso, and to approve the consolidation agreement. Mr Wilken moved, seconded by Dr Bode, to accept the sanitary sewer system improvements of the Tulsa County Sewer Improvement District #6. Dr Bode moved, seconded by Mr Wilken, to approve Ordinance #578, an ordinance approving the consolidation of the Tulsa County Sewer Improvement District #6 with the wastewater collection system of the City of Owasso. AYE: Bode, Wilken, Helm, Barnhouse NAY: None Motion carried 4 -0. 4 n Owasso City Council April 21, 1998 Mr Wilken moved, seconded by Dr Bode, to approve an agreement with Tulsa County Sewer Improvement District #6 for the consolidation of the District with the City of Owasso wastewater collection system, and to authorize the Mayor to execute all necessary documents. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF AN AGREEMENT FOR THE DEVELOPMENT OF SPECIFICATIONS FOR A POLICE FIRING RANGE. Chief Alexander presented the item. In 1996, $30,000 was allocated for the development of a firearms range. A Request for Proposals was developed by members of the police department outlining the needs of the range. Fifteen architects were sent specifications, with three responding to the request. Only one of the three has experience in developing a firearms range. The project will occur in phases, with Phase I to include design, drainage and berm work. Mr Wilken moved, seconded by Dr Bode, to approve an agreement with Imel & Graber Architects for the development of construction specifications for a Police Firing Range, at a cost not to exceed $10,000, and authorization for the Mayor to execute the document. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF AN AGREEMENT BETWEEN THE CITY OF OWASSO AND OUIKTRIP CORPORATION, ' WHEREIN THE CITY AND OUIKTRIP AGREE TO CONDITIONS GOVERNING THE EXCHANGE AND DEVELOPMENT OF REAL ESTATE: AND AUTHORIZATION FOR THE MAYOR TO EXECUTE THE AGREEMENT. Mr Rooney said that in March of 1997, QuikTrip Corporation initiated discussions with the City ' of Owasso regarding the possibility of obtaining excess right -of -way in order to build a new QuikTrip facility at the northeast corner of E 86th St N and Garnett Rd. In order for this to occur, QuikTrip Corporation, a private landowner, the State of Oklahoma, and the City of f Owasso, will need to be in agreement. State statutes prohibit the sale of excess right -of -way to private persons or corporations, put does permit the release to a municipal government in which ' 5 Owasso City Council April 21, 1998 it is located. The municipal government may then exchange, grant, or deed the land in exchange for accompanying improvements. The proposed agreement allows the City to obtain the right - of -way from the State of Oklahoma and deed the land to QuikTrip Corporation in exchange for street and drainage improvements in the area. In order for QuikTrip to complete the street and drainage improvements, they will exchange portions of the acquired land for land owned by Mr D M Sokolosky. Mr Wilken moved, seconded by Mr Helm, to approve an agreement with QuikTrip Corporation for the exchange and development of real estate, and authorization for the Mayor to execute the document. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM RICK KRAMER TO REZONE PROPERTY LOCATED IMMEDIATELY NORTH OF 704 N CARLSBAD• FROM AG (AGRICULTURE) TO RS -3 (RESIDENTIAL SINGLE - FAMILY HIGH DENSITY). Mr Rooney presented the item. The Owasso Planning Commission approved a rezoning request from Mr Rick Kramer to rezone approximately .58 acres of property located immediately north of 704 N Carlsbad from AG (Agriculture) to RS -3 (Residential Single- Family High Density) to allow for single- family residential development. Staff concurred with the Planning Commission. Dr Bode moved, seconded by Mr Helm, to approve the requested zoning. ' AYE: Bode, Helm, Wilken, Barnhouse NAY: None ' Motion carried 4 -0. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ' APPROVAL OF A FINAL PLAT FOR OWASSO GOLF AND ATHLETIC CLUB. Mr Rooney said that the City has received a request from Lindsey Management for a review of the final plat for their proposed Owasso Golf and Athletic Club development. The property was recently rezoned as a Planned Unit Development. The Technical Advisory Committee and the Planning Commission have reviewed the request and have recommended approval with the condition that an access easement be provided to the private property north of Graceland Acres 0 IOwasso City Council April 21, 1998 to prevent that property from becoming land - locked. This is a requirement of the PUD. Dr Bode moved, seconded by Mr Helm, to approve the final plat for Owasso Golf and Athletic Club, with the condition that the required access easement be provided. AYE: Bode, Helm, Wilken, Barnhouse NAY: None Motion carried 4 -0. e ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ' APPROVAL OF A FINAL PLAT FOR THE FAIRWAYS IV AT BAILEY RANCH. Mr Rooney said that the City has received a request for a review of the final plat for The Fairways IV at Bailey Ranch. The Fairways IV consists of 69 lots on 23.7 acres, more or less, in an area zoned PUD. The Technical Advisory Committee and Planning Commission have reviewed the request and recommend approval. Dr Bode moved, seconded by Mr Helm, to approve the final plat for The Fairways IV at Bailey Ranch. AYE: Bode, Helm, Wilken, Barnhouse NAY: None Motion carried 4 -0. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE SELECTION OF A SITE FOR THE LOCATION OF A CITY HALL FACILITY. AND _AUTHORIZATION FOR THE CITY MANAGER TO ' DEVELOP A PROPERTY ACQUISITION PLAN FOR CONSIDERATION BY THE CITY COUNCIL. Mr Ray presented the findings of the Facilities Review Committee and the City Hall Site Selection Committee. He said that several meetings were held by the committee and that an independent consultant was brought in the assist with the selection. Several sites were ' considered by the committee, with criteria being developed in order for the properties to be ranked. Following the established process, three sites were chosen by the committee for further consideration - the property located south of Texaco & McDonald's, property located in a square ' block at Main & Broadway, and property located in the area of the existing police station. The consultant also evaluated those three properties, as well as the property located in Oak Tree Business Park at 96th & Garnett. The consultant recommended the site to the south of Texaco & McDonald's as the preferred site, while the committee voted to recommend the site located on the block that currently houses the police station. Mr Helm moved, seconded by Mr Wilken, 7 Owasso City Council April 21, 1998 to establish the general area of property located within the block containing the current police station as the preferred site for the location of a city hall facility, and to authorize staff to develop a plan for the acquisition of the property contained within that block, with the acquisition plan to be presented to the City Council for approval. AYE: Helm, Wilken, Bode, Barnhouse NAY: None Motion carried 4 -0. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO MOWING CONTRACTS FOR CITY PROPERTIES. Mr Rooney presented the item. At the March 17, 1998 meeting, the City Council awarded bids submitted for the mowing of various city properties. Mowing of the areas was scheduled to begin on April 13, 1998. Rayola Park, Elm Creek Park, and Three Lakes Drainage Easement were awarded to Bartlesville Turf & Landscape as a result of the submittal of the lowest bid. After numerous contacts by telephone, and failure to return the necessary documentation to the City Clerk's office, staff contact Bartlesville Turf & Landscape on Friday, April 17 to inquire their intent to honor the submitted bid. A deadline of Monday, April 20 at 9:00 a.m. was provided to the bidder for the submission of the required documents. The bidder was informed at that time that failure to submit the necessary documentation by that time would result in the City proceeding to the next lowest bidder. Bartlesville Turf & Landscape did not respond, and staff contacted the second lowest bidder for each of the properties mentioned. All have indicated that they will accept a mowing contract and will honor the bid they originally submitted. Dr Bode moved, seconded by Mr Helm, to approve the following contracts for the 1998 mowing season and authorize payment: 1. Rayola Park - Town & Country Landscape at $233 per mowing 2. H 1 II II Owasso City Council April 21, 1998 ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CHANGE ' ORDER #1 A CHANGE ORDER TO A CONTRACT BETWEEN THE CITY OF OWASSO AND HORIZON CONSTRUCTION COMPANY INC FOR THE CONSTRUCTION OF PARKING LOT IMPROVEMENTS AT OWASSO ' SPORTS PARK. Mr Rooney said that unstable soil conditions were encountered while preparing the subgrade for ' the new parking lot at the Sports Park. The contractor has submitted a proposed cost estimate to repair the subgrade deficiencies at a cost not to exceed $8299.75. Mr Wilken moved, seconded by Dr Bode, to approve Change Order #l, increasing the contract with Horizon ' Construction Co Inc for the construction of parking lot improvements at Owasso Sports Park in an amount not to exceed $8299.75, for the purpose of stabilizing the subsurface soil conditions. ITEM 17: REPORT FROM CITY MANAGER Mr Ray invited everyone to attend the reception that will be held following the May 5th Council meeting, to honor the newly - elected Council member, the outgoing mayor and vice mayor, the incoming mayor and vice mayor, Councilor Helm, and the city manager candidate. Mr Ray said that the contractor who was awarded the bid by the City Council on March 17 to mow the U.S. Highway 169 right -of -way, has notified staff that he will be unable to accept the contract. Staff recommended that the contract be awarded to the next low bidder. Dr Standridge moved, seconded by Mr Wilken, to award a contract for mowing the U.S. Highway 169 right -of -way to Mr Marty Tilson of BrushHog Services, at a cost of $1650 per mowing, and authorize payment of same. ENGINEERING PROJECT MANAGER SUBJECT: ACCEPTANCE OF OFF -SITE WATER AND SANITARY SEWER LAKESHORE GREENS DATE: April 27, 1998 BACKGROUND: The facility is located one -eighth mile north of the 86th Street North and 97th East Avenue intersection (see attached location map). The utilities consist of 917 LF of 8" sanitary sewer line and 1,695 LF of 12" water line. Oklahoma Department of Environmental Quality construction permits No. WL000072970265 for water and No. SL000072970266 for the sanitary sewer have been issued. The off -site water connects to the Southern Links off -site water installed along the south side of 86th Street North. The Southern Links portion was installed under a previous ODEQ permit (see attached) and was tested together with the Lakeshore Greens line. Designs for the Lakeshore Greens off -site utilities were reviewed and construction inspected by Public Works personnel. FINAL INSPECTION: A final inspection was held by Public Works representatives with the contractor on September 5, 1997 and punch lists of items needed to bring the facilities to City standards were provided to the contractor on that date. All items were completed. A one -year maintenance bond for the water and sewer systems has been provided (see attached). The water portion of the bond covers both the Lakeshore Greens and Southern Links off -site portions. The bond will become effective upon acceptance of the utilities by the City. A delay in receipt of the maintenance bond (September 1997 to April 1998) resulted in a delay in recommending acceptance. The delay was due to resolution of a change order on the Southern Links line which affected the final construction contract amount. ' RECOMMENDATION: Staff recommends acceptance of the off -site water and sanitary sewer systems for Lakeshore Greens and that portion which comprises the Southern Links off -site water line. The Thunderbolt siren located at 8400 Owasso Expressway (next to Quik Lube) is no longer functioning and parts are not available for its repair. A bid packet was prepared for the purchase of a new siren, and a notice was placed in the newspaper on April 2, 1998 as required by law. Sealed bids were opened on April 23, 1998, with the following bid being received: COMPANY TOTAL BID FOR SIREN & INSTALLATION Goddard Enterprises $6500.00 FUNDING: Funding for this item is included in the FY 1997 -98 Civil Defense Capital Outlay Budget. RECOMMENDATION: tStaff recommends that the City Council award a bid for one general alarm type warning siren and installation to Goddard Enterprises, Guthrie, OK in the amount of $6500. Specifications shall be construed as minimum. All items required to provide a complete system shall be included. GENERAL REQUIREMENTS: 1. SIREN - The Siren shall be of the general alarm type, omnidirectional, having a rating of 115 DBC at 100 feet. Twelve aluminum re- entrant horns with exponential flare rates arranged around a hexagonally- shaped enclosure control and optimize sound dispersion. Power requirement for the siren unit is 120 vac, single phase, with a maximum current draw of 10 amperes. Dual tone, six signals plus public address. 2. CONTROLS - To be 120 vac single phase and capable of operating the above siren. The top cabinet is a NEMA4 enclosure and should contain the amplifiers and controls necessary for siren operation. The lower enclosure is NEMA 3R vented and contains two (2) heavy duty batteries to provide power to the sire. 3. RECEIVER DECODER - This should operate on dual tone sequential or DTMF radio signals. It shall include an AR or AF timer and a mechanical counter included in a weatherproof cabinet. The timer- decoder shall be radio activated, consisting of a completely solid state VHF 150 -174 MHZ receiver with the following minimum specifications: Sensitivity: .5 microvolts for 20 db quiting or better .35 microvolts for usable signal (lz db sined) or better Selectivity: -60 db plus or minus 30 khz Stability: .0025 % from -30 degrees C to +60 degrees C The receiver shall be equipped with an internal speaker for monitoring of transmitted tone at site. The timer - decoder shall be activated by a series of dual tones sequentially operated in a selected range of 300 to 3000 Hz with a band width of not greater than plus or minus 2 % compatible with existing equipment. The antenna for the receiver shall be supplied and mounted on top of weatherproof cabinet. The timer - decoder radio receiver shall be crystal controlled on 155.865 MHZ with the following tones for remote operation: (T -1) 2769 CPS (T -2) 90 CPS (T -3) 1237 CPS (T -4) 1477 CPS (T -5) 1764 CPS 1 4. POLE MOUNTINGS - All cabinets to be installed with bottom of lower cabinet not less than eight (8) feet nor more than ten (10) feet from the ground. Provide and install all necessary conduit, fuses and other related equipment and wire power from control to siren. ' 5. PERMITS - A local, City of Owasso, electrical permit shall be required (no fee). This shall be for coordination of the required electrical inspections. 6. INSTALLATION - Bid complete installation of all above items. 7. WARRANTY - A standard manufacturer's or dealer's warranty shall be supplied, covering the replacement of all defective parts, including labor. All warranty work shall be accomplished with the device on site. Response to warranty calls shall be within 72 hours of notice. 8. BROCHURES - All bids shall specify the model number of each piece of equipment of the manufacturer that the bidder submits for the bid. Brochures on each piece of equipment ' shall accompany all submitted bids so it may be determined the exact piece of equipment which has been bid. ' 9. DOCUMENTS - A full set of record documents, including operational wiring diagrams and equipment lists shall be furnished to the Civil Defense Department upon completion of the ' system and prior to payment being made. 10. ACCEPTANCE TEST - An acceptance test shall be conducted between the contractor and ' the City of Owasso on all equipment before the system shall be accepted. The test date shall be at the City's convenience, and all discrepancies noted during the acceptance test shall be remedied at the contractor's expense, prior to payment being made. ' 11. PAYMENT - As with all municipalities in Oklahoma, payment must be approved and signed on a claims list by the proper City authority. Payment shall be made only after a ' complete and acceptable unit is provided, in accordance with these specifications, and upon submission of an invoice. Mr. Haley. has continued to pursue workers' compensation claims for both his back injury and multiple myeloma. ' Various settlement offers have been received from Mr. Haley's attorney. However, today Mr. Victor Seagle, the City's worker's compensation attorney, received a settlement offer from Mr. ' Haley which would settle both claims and release the City from future claims, for a total of $ 20,000. The offer includes a settlement for each of his two claims on a Form 100, signed with prejudice, (releasing the City from future medical, rehabilitation, etc.) and a common law release from both Mr. Haley and Mrs. Haley, (for any future claims as a result of the cancer) for a sum of $ 10,000 for each claim, plus a $ 75 per claim filing fee and associated legal costs. RAY CITY MANAGER FROM: REGENA GUTHRIE SUBJECT: GEORGE HALEY WORKER'S COMPENSATION SETTLEMENT OFFER DATE: FEBRUARY 9, 1998 BACKGROUND: George Haley began work with the City in April, 1986. On January 20, 1998, his application for disability retirement was approved by the Council and submitted to the Oklahoma Municipal Retirement Fund. At that time, as well as previous work sessions, it was noted that Mr. Haley continued to pursue a workers' compensation claim. On February 9, 1996, Mr. Haley fell from a ladder while making repairs to the inside of a sludge holding basin. He was treated numerous times for this injury, (therapy, prescriptions, medical treatments, diagnostic procedures, etc.) and was released to full duty on April 15, 1996, by Dr. Armstrong. However, Mr. Haley continued to complain of pain and was treated and diagnosed by several other physicians (Dr. Armstrong, Dr. Smith, Dr. Jay Johnson, Dr. Fletcher, Dr. Eichert, and Dr. Don Hawkins). He was off work from April 2, 1997, until June 23, 1997, at which time he was released to light duty assignment in the Human Resources Department. Due to continued reports of pain, and obvious distress, Mr.Haley was sent to Varsha Sikka, M. D., who specializes in Physical Medicine and Rehabilitation, Electromyography and Pain Management, for additional testing (Sed rate, ANA and RA) to rule out arthritis. On July 10, 1997, Dr. Sikka reported that Mr. Haley's sed rate was 95, (normal is 0 to 20) and that other factors were negative. She contacted his family physician Dr. Smith, discussed his sed rate and Dr. Smith advised steroid, Prednisone, and indicated that he would be referring him to a rheumatologist. Dr. Sikka's report further stated her impression was: GEORGE HALEY SETTLEMENT OFFER FEBRUARY 9, 1998 PAGE TWO 1. Polymalacia rheumatica t 2. Degenerative joint disease 3. Neurofibromatosis, pre- existing, non -work related 4. The patient is referred back to his primary physician, otherwise, ' for steroids, since his sed rate is elevated for possible polymalacia rheumatica and rule out rheumatoid arthritis. This is mostly connective tissue disease. It is not work related. ' At that time, Mr. Haley was removed from workers' compensation benefits and placed on sick leave with all charges forward being paid by his health insurance. While awaiting his rheumatoid doctor appointment, on July 21 1997 George Haley entered Tulsa Regional Medical Center due to a fall at his home. He was given an injection and sent home. On August 2, 1997, Mr. Haley was again admitted to TRMC and on August 3, 1997, Dr. Eichert performed a Lammectomy with resection of pedicles, facets, epidural tumor at L1, ' with a postoperative diagnosis: Tumor of the L1 vertebral body, pedicles, facets, lamina, and ' transverse processes with epidural and superficial extension. On August 7, 1997, Dr. Eichert performed an Instrumentation from T10 to L3 with spondylytic fusion. The postoperative diagnosis: Conus medullaris syndrome and multiple myeloma. The City then received a Workers Compensation Court Form 3, notice of representation by F. Michael McGranaham, signed by Mr. Haley on 10/3/97 as claim for compensation benefits. p 1 1
