Agenda. All matters listed under "Consent" are considered by the City Council to be '
routine and will be enacted by one motion. Any Councilor may, however, remove an item
from consent by request. A motion to adopt the Consent Agenda is non - debatable.

F. Action Relating to Renewal of an Agreement for Ambulance Billing Administrative

The staff recommends Council approval of an agreement with Mediclaims Inc to
provide ambulance billing administrative services for a monthly fee equal to 10% of
actual cash receipts plus postage costs, and authorization for the Mayor to execute the
document.
7. Consideration and Appropriate Action Relating to the Award of a Contract for Fifth Avenue
Road and Utility Improvements.

The staff has completed the bidding process, reviewed the bids received, and will
recommend the award of a contract to Yocham Enterprises, Sapulpa, OK, based on unit bid
prices, and authorization for the Mayor to execute an interlocal agreement with Tulsa
County for placement of asphalt.
8. Consideration and Appropriate Action Relating to a Request from Kourtis Properties to
Rezone Property Located Immediately Northeast of Bank of the Lakes; from OL (Office
Light) to CS (Commercial Shopping Center), Containing 2.23 Acres, More or Less.

The Owasso City Council met in regular session on Tuesday, June 2, 1998 in the Council
' Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, May 29, 1998
IITEM 1: CALL TO ORDER
Mayor Bode called the meeting to order at 7:04 p.m.

IITEM 5: READING OF MAYOR'S PROCLAMATION.
t The Mayor was to present a proclamation to Coach Larry Turner and the Owasso Rams 1998
6A State Championship Baseball Team; however, they were unable to be present.
ITEM 6: SPECIAL PRESENTATION.
Mayor Bode and Chief Alexander presented a certificate to Rev Michael Asher, honoring him
' for his years of service as a police chaplain. Rev Asher is moving from the community. The
certificate stated that an Ash tree will be planted in his honor.

ITEM 7 CONSIDERA TION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR APPROVAL OF THE CONSENT AGENDA.
A. Approval of the Minutes of May 19, 1998 Regular Meeting and May 26, .�
1998 Special Meeting.
B. Approval of Claims.
C. Action Relating to Acceptance of a Grant from the U.S. Department of
Justice Providing Funds for the Employment of Two Additional Police
Officers and Requiring a Local Match of 25 %.
D. Action Relating to an Oklahoma Lease Addendum for E -911 Equipment
from Southwestern Bell Financial Services
E. Action Relating to Ordinance #564 Amended, an Ordinance Amending a
Legal Description Contained in Ordinance #564.
F. Action Relating to City Council Approval of a Final Plat for ROC
Owasso, an Addition to the City of Owasso, Tulsa County State of
Oklahoma.
The consent agenda included minutes of the May 19, 1998 regular meeting and the May 26,
1998 special meeting, by reference made a part hereto. Item B on the consent agenda included
the following claims: (1) General Fund $16,248.15; (2) Workers Comp Self - Insurance Fund
$1,658.20; (3) Ambulance Service Fund $533.00; (4) City Garage $2,329.50; (5) Capital
Improvements $10,866.57; (6) Payroll $127,756.40; (7) City Garage Payroll $3,424.53. Item
C requested acceptance of a grant from the U.S. Department of Justice for funds to employ two
additional police officers, providing approximately 75 % of the funds required over the next three
years. Item D requested authorization for the Mayor to execute an addendum to the lease
purchase agreement with Southwestern Bell Financial Services. The addendum was not included
with the original documents approved on April 7, 1998. Item E requested approval of
Ordinance #564 Amended, which would correct a scriveners error in Ordinance #564. Item F
requested approval of a final plat for ROC Owasso, located on the southeast corner of E 86th
St N and N 129th East ave. Ms Barnhouse moved, seconded by Ms Voss to approve the consent
agenda.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO BIDS
RECEIVED FOR POLICE UNIFORM CLEANING SERVICES.
Chief Alexander presented the item. She said that only two bids were received. One bid was
submitted by the current vendor, however, there have been frequent complaints about the quality

of service received from this vendor. The bid submitted by the second vendor would make the
' cost of the service nearly double what it is currently. The staff request was to reject all bids and
re -bid the service. Mr Wilken moved, seconded by Ms Barnhouse, to reject all bids received
for police uniform cleaning, based on prices and quality of service, and authorize a re -bid for
the service.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
' AWARD OF A BID FOR 76TH AND 86TH STREETS NORTH STRIPING
AND CRACK SEAL.
' Mr Lutz said that the existing traffic striping on 86th St N from Dogwood to 129th East Ave
and at the intersection of 76th St N and Main St has deteriorated to the point that it is difficult
to see. Cracks in the pavement have also developed at both sites. Bid documents were
' developed for the work, with bids being opened on May 13, 1998. Two bids were received,
with the low bidder being Magnum Construction Inc of Broken Arrow. Ms Voss moved,
seconded by Mr Wilken, to approve a contract with Magnum Construction Inc, Broken Arrow,
■ in the amount of $75,000.42 for the purpose of crack sealing and striping portions of 76th St N
and 86th St N, and authorization for the Mayor to execute the document.

ITEM 10: REPORT FROM CITY MANAGER
Mr Ray deferred to Chief Alexander, who reported that the City is one step closer to receiving
some funds for the jail that will be located in the new police station. Tim Rooney reported on
a meeting held by the Rogers County Planning Commission relating to expansion of the rock
quarry. The Planning Commission deferred action on the matter until July 13.
ITEM 11: REPORT FROM CITY ATTORNEY
Mr Cates thanked the Council and staff for the plant he received while he was hospitalized.

' The Owasso City Council met in special session on Tuesday, June 9, 1998 in the Lower Level
Conference Room at City Hall per the Notice of Public Meeting and Agenda posted on the City
' Hall bulletin Board at 9:00 a.m. on Friday, June 5, 1998.
ITEM 1: CALL TO ORDER AND ROLL CALL.
Mayor Bode called the meeting to order at 6:35 p.m. Councilors present: Denise Bode, Mayor;
Mark Wilken, Vice Mayor; Mary Lou Barnhouse, Councilor; Tracy Standridge, Councilor;
' Melinda Voss, Councilor. Councilors absent: None. Staff present: Rodney J Ray, City
Manager; Jeff Hancock, City Manager Designee; Ronald D Cates, City Attorney; Sherry
Bishop, Director of Finance; Robert Carr, Public Works Director; Fire Chief Bob Allen; Police
' Chief Maria Alexander; Tim Rooney, Assistant City Manager. Also present: Morris Strom.

ITEM 2: DISCUSSION OF ISSUES OF IMPORTANT TO THE CITY OF OWASSO.
t Items discussed included the proposed upgrade of the radio communications system for the police
and fire departments, issues relating to a contract with Walters- Morgan Construction Inc for
improvements to the wastewater treatment plant, issues related to the extension of Fifth Avenue
and improvements to the East Service Road between 66th St N and 76th St N, the North Owasso
Wastewater Collection Improvement Project, the planning process for the construction of a new
city hall facility, low interest mortgage rates for median income families within the city limits
' of Owasso, appointments to boards and commissions, the Elm Creek interceptor sewer, and the
Health Department building. No action was requested or taken on any item.

BACKGROUND:
The City of Owasso has received a request for the closing of a portion of a utility easement
located within Lot 6, Block 2, Fairways II Addition. The portion of the easement to be closed
is described as the southern 3 feet of the northern 11 foot utility easement. A case map is
enclosed for your information and review.
The subject property is currently in the process of being developed with a single - family
residence. The residence, as it is proposed, would encroach 2.5 feet into the northern 11 foot
utility easement.
Area utility companies have reviewed the request and have no objections to the closing request.
The Planning Commission unanimously approved the closing request at their June 9, 1998
regular meeting. Staff also has no objections to the request.
If approved by the City Council, an Ordinance will be presented at the July 7, 1998 meeting to
formally adopt the actions of the Council.
RECOMMENDATION:
Staff recommends Council approval of the easement closing request, closing the southern 3 feet
of the northern 11 foot utility easement on Lot 6, Block 2, Fairways II.

IBACKGROUND:
The City of Owasso has received a lot tieing request from Mr. Nick Breese for two lots located
' within the Central Park Addition. The subject property is located within the 12600 block of East
91st Street North. A copy of the Central Park plat is attached for your information and review.

The applicant is requesting a lot tieing agreement in order to allow for the construction of one
single - family residence on the two lots in question. In order to build the single - family residence
on the center portion of the two lots, it is necessary for the applicant to enter into a lot- tieing
agreement with the City of Owasso. Approval and granting of the lot tieing agreement will
ensure that the following occur:
1. The right to construct the single - family dwelling on the common lot lines of
both Lots 20 and 21, Block 1 of Central Park.
2. The right to use the combined lots as if they were a single -lot of record.
3. That neither lot may be sold in the future as a separate lot.
4. That all other improvements (other than the single - family dwelling) shall
comply with all ordinances of the City of Owasso.
The lot tieing agreement does not effect any platted utility easements as there are no utility
easements along the common lot lines of the two lots. All property development standards of
an RS -3 (Residential Single- Family High Density) district would still need to be met by the
applicant (FY setback of 25', RY setback of 20', Side yard setbacks of 5' and 10').
Again, execution of this agreement is necessary in order to allow for construction of the
dwelling. The Owasso Planning Commission unanimously approved the request at their June
9, 1998 regular meeting and staff has no objections to the request. A copy of the lot tieing
agreement is attached for your information and review.

AGREEMENT
THIS AGREEMENT made and entered into this _ __ day of _ 19 , by
and between Nick Breese hereinafter designated "First Party " and the CITY OF OWASSO,
OKLAHOMA, a municipal corporation, hereinafter designated "Second Party ".
_WITNESSETH:
Whereas, First Party is the proposed record owner of the following described real property situated
in the City of Owasso, Tulsa County, Sate of Oklahoma, to -wit:
Lot 20, Block 1, Central Park I
hereinafter designated "First Property",
Lot 21, Block 1, Central Park I
hereinafter designated "Second Property ".
WHEREAS, the First Party has requested approval to permit the construction of a single
family dwelling on the common lot line of both the First and Second Property and have further requested
permission to develop and use said properties and construct improvements thereon in the same manner and
to the same extent as would be permissible if said properties constituted one platted lot instead of one
platted lot and a second platted lot; and
WHEREAS, the Second Party, is willing to grant the aforesaid requests of the First Party, all upon
the terms and subject to the conditions hereinafter set forth.
NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained,
the parties hereto do hereby agree as follows:
(1) Subject to the conditions hereinafter set forth, the Second Party does hereby grant unto the
First Party, his grantees, lessees, successors and assigns the following:
(a) The right to construct a single family dwelling on the common lot line of both the first
and second property.
(b) The right to use said properties of First Party as though said real property constituted a
single platted lot instead of a platted lot and a second platted lot.
(2) The rights granted by the Second Party under the provisions of numerical paragraph (1)
above are subject to the following conditions:
(a) First Party must purchase from current owner both First Property and Second Property;
and
(b) That the aforesaid First and Second Properties may not be sold, mortgaged or otherwise
encumbered separate and apart from each other; and
(c) That construction of buildings and other improvements on said properties of First Party
shall otherwise comply with all ordinances of the City of Owasso, Oklahoma.
(3) In consideration of the covenants and agreements of the Second Party herein contained, the
First Party does hereby agree that so long as this Agreement is in force and effect he will not
sell, mortgage or otherwise encumber said First and Second Properties, separate and
independent of each other.
(4) This Agreement shall automatically terminate upon the replatting of the above described
properties into a single lot as required by law.

' Upon the occurrence of the event described in subparagraph (a) of this numerical paragraph, the Second
Party shall, immediately upon the request of the then record owner of the above described properties,

successors and assigns.

IBACKGROUND:
In the fall of 1997, the Trustees of the Tulsa Industrial Authority approved a $25,000,000
' Mortgage Revenue Bond for Banc Once Capital Markets, Inc. The 30 year fixed rate
mortgages, GNMA backed, provide for 4% down payment assistance for low to moderate
' income home buyers. Attached, for your information and review, is a memo from Karl
Fritschen that describes the program as well as additional information regarding the program.

In order for this rate to be offered to residents of the Owasso area and other communities, the
program requires the approval of the local government entity prior to June 30, 1998. Attached
is a copy of Resolution 98 -05 which would permit the City of Owasso to enter into Interlocal
Governmental Cooperation Agreements to make this program available.

BACKGROUND
In the fall of 1997, the Trustees if the Tulsa Industrial Authority approved a $25,000,000 Mortgage Revenue
Bond (Fresh Rate) for Banc One Capital Markets Inc. through the GNMA (federal mortgage loan program)
mortgage backed securities. Basically, the purpose of the Fresh Rate program is to provide down payment
assistance for those who have low to moderate income but insufficient savings for a down payment verses
traditional loan origination and underwriting practices. Additionally, there are no income limits or first time
buyer restrictions associated with this program.
The reason it is called Fresh Rate is because the allotment amounts of $2 million dollars are issued under
different mortgage interest rates. When the lenders have received enough loan applications to fill the
commitment lot, a new $2 million lot is generated and started at a fresh interest rate. The rate for each
allotment is set by the GNMA rate. This money is then available on a first come first serve basis to the public
at these fixed rates through the participating lenders. These are 30 year fixed rate mortgages and provide 4%
down payment assistance for low to moderate income homebuyers.
Local area lenders will be invited to participate in the Fresh Rate program to assist prospective homebuyers.
However, in order for this program to be offered to local area banks, the approval of the local government '
body must occur. Lenders will have the obligation to undertake a minimum participation of $500,000 and may
reserve up to half of their allocation to one or more builders and/or realtors.

A Lender will sell the mortgage loans to the Servicer. The Servicer will pool the mortgage leans originated
into GNMA securities and in turn sell the GNMA securities to the Bond Trustee.

Subject to approval by the Authority, any lender which (i) a FHA,VA or RH5 mortgagee, (ii) has an
operating office in the state which will be operative throughout the origination period of the Program, and
(iii) is organized or existing under the laws of the program state, another state or the United States, and is
qualified to do business in the program state.
Lenders will have an obligation to undertake a minimum participation of $1,000,000.
Participating Lenders may reserve up to half of their allocation to one or more Builders or Realtors and
collect a corresponding percentage of the commitment fee for such a reservation. All of the terms and
conditions pertaining to the Lender's allocation follow the Builder and Realtors reservations.
The Servicer, Mortgage Clearing Corporation, will review each mortgage loan for compliance with the
Authority Program Requirements prior to loan closing, and it will also havexesponsibiliry for any and all
proposed assumptions of mortgage loans.
All areas of the State are eligible to participate in the program (Only within these areas of State deemed
to be "areas of critical labor surplus." Please contact Thomas Langdon (888 - 2044141) for a listing of
those areas.

The mortgage loan rate will be set an each Commitmcnt Lot of $2 million. When the lenders have
received enough loan applications to fill the Commitment Lot, then a new Lot is started at a fresh interest
rate for the next $2 million.

From the proceeds of the Bonds, an amount equal to 4.0% of the loan amount will be set aside to cover
homeowner down payment and closing cost assistance.
This Down Payment and Closing Cost Assistance is subject to recapture by the Authority if the Borrower
sells his house and the loan is not assumed by a Qualified Buyer or if the Borrower voluntarily refinances
it. The Down Payment Assistance is evidenced by a second lien note and mortgage which is forgiven over
a ten year period following the closing of the loan. The recapture schedule is as follows:

residence requirement, prohibited mortgages requirement, and any other requirement prescribed by State

Lenders are permitted to accept cosigners and guarantors on behalf of Eligible Borrowers, provided: (i)
such cosigner /guarantor is acting in such capacity solely for the purpose of providing additional security for

RESOLUTION NO 98 -05
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA APPROVING THE EXECUTION OF INTERLOCAL
GOVERNMENTAL COOPERATION AGREEMENTS BY THE CITY OF
OWASSO WITH RESPECT TO CERTAIN TAXABLE SINGLE FAMILY
MORTGAGE REVENUE BONDS (FRESH RATE MORTGAGE REVENUE
BOND PROGRAM), AND ALL MATTERS RELATED THERETO OF ANY
SORT OR DESCRIPTION.
WHEREAS, the City of Owasso, Oklahoma (herein called "City ") exists for the use and
benefit of its citizens; and
WHEREAS, the City has determined that, due to its population, it is not presently
economically feasible for it to develop its own taxable single family mortgage revenue bond
program ( "the program ") and that it needs to participate with a city of sufficient population to
sponsor such a program; and
WHEREAS, the City has determined it has a need for said mortgage loan funds for its
citizens; and,
WHEREAS, certain other cities within the State of Oklahoma desire to make such
mortgage loans available to other cities in which there is a need and demand for such loans; and,
WHEREAS, the City desires to assist other cities within the State of Oklahoma, and to
make any such mortgage loan funds in the City of Owasso available to such other cities in which
there is a need and demand for such loans.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA, that this City is hereby empowered to enter into Interlocal
Governmental Cooperation Agreements ( "Agreements ") with any other governmental entity of
the State of Oklahoma that desires to utilize such mortgage loan funds, and perhaps make
available any such mortgage loan funds for use in accordance with the terms of said Agreements,
as approved by the Attorney General of the State of Oklahoma.
BE IT FURTHER RESOLVED, that signatures of the Officers of the City of Owasso,
Oklahoma appearing on each of the Agreements and any other instruments, agreements,
documents, closing papers and certificates executed and delivered pursuant to this Resolution
shall be conclusive evidence of their approval under the terms of this Resolution, and of the
authority of such Officers to execute and deliver any such agreements and instruments for and
on behalf of the City pursuant to the authority of this Resolution.

' Mediclaims, Inc. of Ponca City has provided billing administrative services for the City's ambulance
service since November 1994. Mediclaims services include filing insurance claims, billing
customers, collecting those accounts, and preparing detailed monthly reports. All payments are made
directly to the City, not to Mediclaims. Advise concerning appropriate rates and procedure coding
' is also provided by Mediclaims.

During the time that Mediclaims has provided billing services for the City, average monthly billings
' have increased from $17,000 to more than $25,000, an increase of 47 %. The first year of
Mediclaims services, payments for ambulance services more than doubled. Since then payments
have increased another 90 %. The ratio of payments to "net billings" (billings after subscriber and
' Medicare adjustments) has exceeded 100% during the current fiscal year.
Staff is very satisfied with the quality of the services and accuracy of reports provided by
Mediclaims. Staff is especially pleased with their ability to work with and collect from insurance
companies. The increased revenues to the City has more than paid the fees for Mediclaims services.
' This agreement with Mediclaims provides a monthly fee equal to 10% of actual cash receipts plus
postage costs. City Attorney, Ron Cates has reviewed the document and approved it for Council
consideration.
RECOMMENDATION:
' Staff recommends approval of an agreement with Mediclaims, Inc. to provide ambulance billing
administrative services.

EMERGENCY MEDICAL SERVICE CLAIMS
THIS PROPOSAL is made this day of 1998, between the City of
Owasso, Oklahoma on behalf of the Owasso Ambulance Service, d/b /a (hereinafter "Service "), and
by Mediclaims, Inc. an Oklahoma Corporation, (hereinafter "Mediclaims ").
MEDICLAIMS AGREES:
1. To offer our professional consultation which will include, but is not limited to, help with
setting your fees, procedures that need to be adopted or changed by the Service in order to properly
comply with Medicare and corporate policies and procedures and community relations.
2. To file insurance claims on behalf of insured patients for ambulance services with any and
all Private Health Insurance Companies, Medicare (electronically), Medicaid, Champus /Champ V.A.,
H.M.O. and P.P.O. organizations, Motor Vehicle Insurance Companies, Personal Injury Claims,
Workers Compensation Claims, and United States Public Health Services. Mediclaims will conduct
extensive follow up regarding the status of those claims, without request from the Service.
3. To perform all diagnosis and procedure coding as may be required for such medical
claims and to make necessary inquires of various health care providers as may be required for such
coding.
4. To file a second insurance claim, without notice from the Service, if payment is not
received within 60 days of the first billing.
5. To prepare and send all statements for amounts due to the Service for ambulance services
provided to its customers. The statements are "aged" and generate special "messages" for second,
third and final notices.
6. To place Mediclaims toll -free number and address on all correspondence to patients and
insurance carriers.
7. To use "positive collection techniques" to work with and assist private pay patients in
satisfying their bill and to refrain from using threats or intimidation as a collection technique, obeying
all laws and regulations regarding debt collection practices.
8. To work with attorneys on personal injury and worker's compensation cases for such time
as Mediclaims believes it is prudent to pursue such sources of payment, recognizing that such claims
are normally dependent upon the settlement of the case for payment.
9. To provide informational on site seminars, on request, or as needed, to the EMT's and
Paramedics to train them in the proper preparation and documentation for all run sheet and reports
used for Mediclaims billing.
' 10. To prepare daily and monthly reports for use by the Ambulance Director and /or
Owner /Operator for the Service detailing collection activities, quantity of runs, breakdown of types of
runs, sources of revenue, etc.
' 11. To provide all paper, stationary, printing and all long distance calls associated with
billing for the Service.

12. All records and documents associated with the billing and collection will remain the sole
property of the Service, and shall be available at any time, to the Service's internal and external
auditors for compliance with all appropriate accounting standards and practices.
13. To mail at no cost to the Service, copies of our bimonthly "Newsletter for Ambulance
Services" to be distributed not only to the EMT's and Paramedics, but also to the Service and those in
management for better "education and communication" between our services and our clients.
14. To work directly with representatives from the Service to make available any additional
reports reasonably received for accounting or management purposes.
Mediclaims will supply any report requested as long as it is available from our software and
programmers.
THE SERVICE AGREES:
1. To pay a monthly fee of 10% of actual cash receipts, only postage costs will be borne by
the Service and billed separately. Payment is due on the first day of each month and as soon
thereafter as claims are approved and paid. A LATE FEE WILL BE CHARGED ON ANY
BALANCE UNPAID 30 DAYS OR OVER FROM STATEMENT DATE.
2. To collect at the time of transport any and all medical information, including: patients'
signatures on all waiver of liability forms, and the assignment of benefits /release of information
forms.
3. To request copies of all motor vehicle accident reports, at the Service's expense, from the
Area Police Department, and /or the Oklahoma Highway Patrol.
4. To collect all monies upon billing by Mediclaims and to provide a daily log sheet showing
all payments received and the source of payments, by patient.
S. To secure such approvals and furnish such forms, purchase orders and procedures as
required for the execution of this agreement and the payments herein contemplated in accordance with
applicable statutes and ordinances.
GENERAL PROVISIONS;
1. The services herein provided are unique and not generally available in the public market.

2. This agreement may be terminated by either party upon ninety days written notice to the
other party.
3. This agreement may be amended or modified upon mutual agreement at any time, but all
modifications must be in writing to be effective. '
4. This agreement will remain in effect for a period of one year and may be renewed from

SUBJECT: NSP ROADWAY AND UTILITY IMPROVEMENTS - PHASE II
CONTRACT AWARD

BACKGROUND:
Extension of 5th Avenue from Cedar Street east to the U.S. Highway 169 West Service Road was
intended to be constructed to provide roadway access and utilities for National Steak and Poultry
NSP). The original engineering design contract was awarded to Sack and Associates, Inc. in
February 1995.
Due to probable effects of elevating the Service Road with the closing of 66th Street North by the
Oklahoma Department of Transportation (ODOT) and some difficulty in obtaining right -of -way, the
project was divided into two phases of construction. The Phase I contract provided roadway
improvements to the east property line ofNSP. Phase II will extend the roadway to the Service Road
and includes widening the existing drainage channel on east of NSP both north and south of the
roadway extension to accommodate 100 -year flood conditions.
PHASE II PROJECT SCOPE/BIDS ANALYSIS:
As advertised, the bid documents for Phase II were compiled to include only that portion of work to
extend 5th Avenue to the Service Road and construct drainage channel improvements. The project
was advertised on March 5, 1998 and bid opening held on April 7, 1998. The bid documents required
submittal of a base bid and included three (3) deductive alternates which incrementally reduced the
scope of drainage channel construction to avoid potential problems with what was anticipated to be
limited funding. Five (5) bids were received ranging from $288,569.00 to $355,080.50 for the entire
project, including all drainage channel improvements.
During analysis of the bids, it was determined that the funding from ODOT had been restricted (see
letter dated February 14, 1995). City staff had been proceeding with an understanding that the
entire project was to be paid using allocated Industrial Access Road funds, which were programmed
in March 1995 in the amount of $454,000. On April 13, 1998, a copy of the letter to the City of
Owasso was obtained that indicated the Industrial Access Road funds were only to be used for a
curbless road section, paving and a multiple box or short span bridge. Based on the contract apparent

low bid, only $175,603 would be eligible for payment by ODOT. An additional $112,966 would be
required by the city to complete the project.
In order to evaluate means by which the project could be constructed within the budgeted amount,
city staff proposed that the 5th Avenue extension be combined with raising the Service Road. An
ODOT memorandum by the Division Eight Engineer indicates that "it would be a beneficial process
to raise this West Service Road at the same time the section of 5th Avenue is constructed." As a
result, evaluation of the bid was conducted jointly by city staff, ODOT and Tulsa County to determine
the ability to include Service Road improvements under the terms of the contract.
Bids received were based on unit prices for estimated quantities of work; therefore, it was determined
that adjustments in quantities could be made under the terms of the contract that would enable
construction to be accomplished on the Service Road. Based on projected work quantities for raising
the Service Road, Tulsa County has been asked to perform the paving with the City of Owasso
paying for paving materials only in order to stay within the budgeted amount for the project. An
interlocal agreement between the City of Owasso and Tulsa County would be required. In addition,
shifting work responsibilities from the apparent low bidder to Tulsa County has been discussed with
the contractor and agreed upon.
At this time, calculated quantities for the entire project indicate that approximately $20- 25,000 may
still be needed to complete the work. As discussed by Rodney Ray, City Manager during a recent
Council work session, it is anticipated that a request to provide supplemental funding from reserves
will be made at the completion of the project. At that time, actual quantities and costs will be known.
PROJECT FUNDING:
Funding for the project is included in the FY97 -98 Capital Projects Grant Fund (Line Item 85 -411-
5430) in the amount of $454,000.
RECOMMENDATION:
Staff recommends Council award a contract based on bid unit prices for the construction of the Phase
H - NSP Roadway and Utility Improvements to Yocham Enterprises, Inc. And authorize the Mayor
to execute an interlocal agreement between the City of Owasso and Tulsa County for placement of
asphalt.

' The Oklahoma Department of Transportation is prepared to participate in the
construction of an industrial access road to provide access to the proposed
National Steak and Poultry, Inc. plant in southwest Owasso.
1. The participation includes the pavement of a curbless road section of a
Is width comparable to the west and north section of the industrial road
which is in place.
' 2. The industrial access road will begin at the east end of the existing road
and go eastward to an intersection with the west side frontage road for
US -169 between 66th Street North and 76th Street North.
' 3. ODOT's participation does not include:
a. Acquisition of the right-of-way
b. Utility relocation
C. Grading or filling of the roadbed
4. ODOT will participate in the construction of a multiple box or short span
' bridge over a small drainageway on the alignment, as it will serve as a
flood period evacuation route for residents and business people in the US-
169 and 66th street North area (in lieu of an at -grade crossing on US -169
which will be cloeed).
'S. Subsequent ownership and maintenance of the new road will be by local
government.

This commitment, which will be before the Transportation Commission on March 6,
1995, is contingent on NSP's proceeding with the plant. Governor Keating's
administration is committed to an aggressive stance on attracting as well as
expanding industry in Oklahoma, and he views industrial access roads as an
effective tool for accommodation.

This project was programed March 6, 1995, for $454,000, consisting of: from West Service .
Road on US -169 west 0.27 miles on 5th Avenue to Cedar Street, serving the above
reference plant. The West Service Road which provides access to this section of 5th ,
Avenue occasionally floods and it would be a beneficial process to raise this West Service
Road at the same time the section of 5th Avenue is constructed. This would also help
resolve the 66th Street grade intersection at US -169 closure. I have visited with Mr.
McCaleb about this project extension and he is favorable.
The project is being done by the City of Owasso. The Department is participating as money
only. To allow the $454,000 to complete the work, the City of Owasso and Tulsa County will
do a significant amount of work so that both 5th Avenue can be constructed and the Service
Road can be raised and stay within the budgeted amount.
We are therefore, requesting permission to extend Project No. SAP - 72(563) to raise the
existing Service Road to, at or above the flood plain level. These two segments are
continuous and with the input from Tulsa County and the City of Owasso, this can be
accomplished within the budgeted amount.
An immediate response would be appreciated because the City of Owasso needs to
proceed with the construction contract.

' BACKGROUND:
The Owasso Planning Commission held a public hearing on June 9, 1998 to review a request
from Kourtis Realty LTD, Co., for the rezoning of property from OL (Office Light) to CS
(Commercial Shopping Center). The subject property is located northeast of the current Bank
of the Lakes site and contains 97,326 square feet, more or less. A legal description of the
subject property is contained within the complete staff report which is attached for your
information and review.
The applicants are requesting the rezoning to CS in order to allow for the development of the
site for office, retail, and restaurant use. Staff review of the request indicates that a rezoning
of the subject property to a CS classification is consistent with the development pattern along
E. 86th Street North over the last five years and an appropriate buffer between any commercial
development and existing residential should be able to be maintained.
' Notices of the rezoning request were mailed to property owners within 300 feet of the subject
property and legal notice was published in the Owasso Reporter. The subject property was also
posted the week of May 25, 1998. Several neighborhood citizens attended the meeting to voice
concerns regarding an appropriate buffer between potential commercial development and the
residential areas. Staff and the Planning Commission agreed to require a detailed landscaping
' plan as a condition of any site plan approval for the subject property.
If the Council approves the rezoning request, an ordinance will be presented to the Council at
the July 7, 1998 meeting to formally adopt the actions of the Council. The Planning
Commission unanimously recommended approval of the rezoning request from OL (Office Light)
to CS (Commercial Shopping Center).
' RECOMMENDATION:
Staff recommends approval of the rezoning request from OL to CS.

REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from

LOCATION AND SIZE: The subject property is located northeast of the Bank of the Lakes
site (12401 E. 86th Street North) and contains 97,326 square feet, more or less. A copy of

EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted to the north by a drainage
channel, while farther north lies developed residential property - Central Park II and
Lakeridge - zoned RS -3 (Residential Single - Family High Density). The subject property is
bordered on the southwest by the Bank of the Lakes property zoned OL (Office Light). The
subject property is bordered on the south by undeveloped property zoned CS (Commercial
Shopping Center), likely to be developed in a restaurant manner. The subject property is
bordered on the east by the Warehouse Market grocery store also zoned CS.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 6 "Commercial Land Uses ".
SITE INFORMATION: No unusual development hardships are noted.

The applicant is requesting a rezoning of a parcel of land 97,326 square feet in area from OL
(Office Light) to CS (Commercial Shopping Center) in order to allow for commercial
retail /restaurant development. The applicants have additionally requested a site plan approval
(see next agenda item) for the subject property which is contingent upon this rezoning
application.

' A portion of the original tract from which the subject property and the Bank of the Lakes
property was created from was involved in a rezoning request in 1990. At that time, the
land that contains Robert Long's Insurance office /Diane's Travel and the property that is now
' Bank of the Lakes was considered for CG zoning for the ultimate use of a car wash. That
request was denied, with the Planning Commission citing that although the established zoning
pattern in the area supported the request, the physical surroundings did not.
Since 1990, the property involved in that zoning request has developed or is preparing to do
so Robert Long's Insurance office and Diane's Travel were constructed in 1992 within OL
(Office Light) zoning requirements and specifications. Bank of the Lakes, after receiving lot
split approval in November or 1996, was also developed within OL zoning requirements and
specifications. The property immediately south of the subject property was rezoned from OL
to CS in January of this year and is anticipated to develop in a restaurant manner
(Schlotzsky's).
Obviously, the physical changes in the area are not limited to these properties. Since the
original zoning application in 1990, Warehouse Foods (originally Food Lion) developed east
of the subject property, as well as much of the Ram Plaza Addition which was platted in
1993. In 1996, Cornerstone Shopping Center located on the south side of E. 86th Street
North, also completed a large expansion to the existing shopping center. In short, E. 86th
Street North has become a commercial retail /service corridor within our community for
exceeding 1990 expectations.
The applicant's request to rezone the subject property to CS is consistent with development
that has occurred within this corridor since 1992, but yet does not go to the extreme of a CG
zoning and the intensity that would accompany it. An approval would allow for retail /service
uses, thus adding to what is already found along this corridor of our community.
Quite simply, the conditions that may have supported a denial of a rezoning request on a
portion of this property in 1990 are no longer existent in 1998 on this property. Office and
commercial development has occurred both east and west of the subject property and is
anticipated to the south, thus creating a more harmonious environment for CS zoning.
This is not to state, however, that concerns for an appropriate buffer between the subject
property and the developing residential property do not exist. Strict and stringent review of
the accompanying site plan (see next agenda item) for utilization of the existing dense
vegetation along the drainage channel, as well as any additional landscape buffering and
required fencing should occur. Any and all steps viewed as being necessary by the Planning
Commission to provide the appropriate buffers should be considered as conditions of
approval during the site plan review.

Notices were sent to surrounding property owners on May 22, 1998 and the legal ad was
published in the Owasso Reporter on May 21, 1998. Staff has received two inquires
regarding the zoning request. Both property owners were concerned with the vegetation
along the drainage channel, one wanted it to remain while the other wanted it to be cleared
RECOMMENDATION
Staff recommends approval of the rezoning request from OL (Office Light) to CS
(Commercial Shopping Center).

Preston Lakes, LLC has submitted to the City of Owasso a petition for the annexation of
property totaling approximately 253.99 acres, more or less. The subject property is located
north and east of the northeast corner of E. 86th Street North and N. 145th E. Avenue and is
currently undeveloped. A subject map is attached for your information and review.
The subject property is currently zoned AG (Agricultural) in Rogers County and would remain
zoned AG upon annexation. All property annexed by the City of Owasso is required to be zoned
the lowest zoning classification (AG) until any rezoning request is received and approved by the
Planning Commission and the City Council. A copy of the City of Owasso's annexation policy
is attached for your information and review. If annexation is approved by the City Council, the
subject property would have to go through all platting requirements of the City of Owasso prior
to any development. It should be noted that upon any development of this property,
acceleration/deceleration lanes would need to be included for all entries along E. 86th St North,
N. 145th E. Avenue and N. 161st E. Avenue, as well as sidewalks.
Two items that are noteworthy when reviewing this annexation are both water and sanitary sewer
availability. The subject property does not lie within the City of Owasso's service area for
water, but rather Rogers County Rural Water District #3. In regards to potential development
of the property, all construction standards of the City of Owasso would need to be met
regardless of the service provider. The subject property is similar in nature to the conditions
found at the time of annexation of the Bailey Ranch Estates property. A water district boundary
map is attached for your information and review.
Sanitary sewer will be provided to the subject property via the proposed Elm Creek Interceptor
Sewer, a joint project between the city and the private sector. At the time the Elm Creek
Interceptor sewer is tapped or extended by the developer of the subject property, a "pay- back"
fee will be required to be paid to the City of Owasso. The "pay- back" charged to this
developer, as well as others within the Elm Creek Interceptor Service Area, will be figured on
a per -acre basis, and should allow the city to recoup approximately 85 % of the construction
costs.

Notification of the annexation request was published in the Owasso Reporter on May 21, 1998
to notify the public of the annexation request before the Planning Commission on June 9, 1998.
That notification was followed by notification published two consecutive weeks in the Owasso
Reporter on June 4 and 11, 1998 to notify the public of possible City Council action regarding
the request on June 16, 1998. A copy of the procedures for annexation is also attached for your
information and review.
The Technical Advisory Committee reviewed this request at their May 27, 1998 regular meeting
and had no comments /concerns regarding the request. The Owasso Annexation Committee
reviewed the request at their May 28, 1998 Special Meeting and also recommended approval of
the annexation. The Owasso Planning Commission also unanimously recommended approved
the annexation request at their June 9, 1998 meeting.
If approved by the City Council, an ordinance formally adopting the actions of the Council will
be presented at the July 7, 1998 meeting.
RECOMMENDATION:
Staff recommends approval of the annexation request.

PETITION FOR ANNEXATION
The undersigned, constituting not less than three- fourths of the registered voters and being
owners of not less than three- fourths (in value) of the hereinafter described real estate situated
in Tulsa County, Oklahoma, to -wit:
The Southwest Quarter of the Southwest Quarter (SW /4 SW /4) and the West Half of the
Southeast Quarter of the Southwest Quarter (W /2 SEA SW /4) of Section Twenty -two (22),
Township Twenty -one (21) North, Range 14 (14) East of the I.B.&M., containing 60 acres more
or less, Rogers County, State of Oklahoma, according to the US Government Survey thereof,
AND
A tract of land containing a part of the E/2 of the SE /4 of the SW /4 of Section 22, Township
21 North, Range 14 East of the I.B. &M., Rogers County, Oklahoma, being more particularly
described as follows: COMMENCING at the Southeast corner of the E/2 of the SE /4 of the
SW /4; thence N 00 °06'35" W along the East line of said E/2 of the SE/4 of the SW /4; a
distance of 632.01 feet to the True Point of Beginning; thence N 00 °6'35" W continuing along
said East line a distance of 690.32 feet to the Northeast corner of the E/2 of the SE 14 of the
SW /4; thence S 89059'16" W a distance of 661.14 feet to the Northwest corner of said E/2 of
the SE /4 of the SW /4; thence S 00 °05'31" E along the West line of said E12 of the SEA of the
SW /4, a distance of 1087.98 feet to a point 234.67 feet North of the Southwest corner of the E/2

Being territory adjacent and contiguous to the incorporated City of Owasso, Oklahoma, and not
presently embraced within the Limits thereof, hereby petition the City Council of the City of
Owasso, Oklahoma, to annex the aforementioned real estate into the City Limits of said City.
