Attachment #5 -C The staff recommends Council approval of Ordinance #580, and has listed this item in the consent section of the agenda based on Council action on June 16, 1998 to approve the easement closing and authorize an ordinance. D. Action Relating to Ordinance #581, an Ordinance Providing for the Rezoning of Property Located Immediately Northeast of Bank of the Lakes; from OL (Office Light) to CS (Commercial Shopping Center). Attachment #5 -D The staff recommends Council approval of Ordinance #581, and has listed this item in the consent section of the agenda based on Council action on June 16, 1998 to approve the rezoning and authorize an ordinance. E. Action Relating to Ordinance #582, an Ordinance Providing for the Annexation of an Approximate 253.50 Acre Parcel of Land Located North and East of the Northeast Corner of East 86th St N and N 145th East Ave, in Rogers County. Attachment #5 -E The staff recommends Council approval of Ordinance #582, and has listed this item in the consent section of the agenda based on Council action on June 16, 1998 to approve the annexation in concept and authorize an ordinance. F. Action Relating to the Granting of a Utility Right -of -Way Easement to Public Service Company of Oklahoma for the Location of an Electrical System on the Bailey Ranch Golf Club Property, Generally Located South of the Southeast Corner of 96th Street North and Mingo Road. Attachment #5 -G ' The staff recommends Council acceptance of the infrastructure improvements. 6. Consideration and Appropriate Action Relating to a Contract Between the City of Owasso 1 and the Fraternal Order of Police Lodge #149. FOP Lodge #149 Attachment #6 The City Clerk has received a written request from the FOP Lodge #149 to address the Council relative to their contract, and that appropriate action be taken. 7. Consideration and Appropriate Action Relating to the Appointment and Confirmation of Members to the Owasso Planning Commission and the Owasso Economic Development Authority. Adjournment I A OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING ' Tuesday, June 16, 1998 The Owasso City Council met in regular session on Tuesday, June 16, 1998 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, June 12, 1998 ITEM 1: CALL TO ORDER Mayor Bode called the meeting to order at 7:00 p.m. ITEM 2: INVOCATION Mr Jim McElrath offered the invocation. Mayor Bode presented a ' framed copy of the article to Mr Heath. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of the Minutes of June 2, 1998 Regular Meeting and June 9, ' 1998 Special Meeting. B. Approval of Claims. Owasso City Council June 16, 1998 C. Request Approval to Close a Portion of a Utility Easement Located on Lot 6, Block 2, Fairways II Addition. D. Request Approval of a Lot Tieing Agreement for Lots 20 & 21, Block 1, Central Park Addition. E. Action Relating to Resolution #98 -05, a Resolution Approving Interlocal Governmental Agreements With Respect to Certain Taxable Single Family Mortgage Revenue Bonds. F. Action Relating to Renewal of an Agreement for Ambulance Billing Administrative Services. The consent agenda included minutes of the June 2, 1998 regular meeting and the June 9, 1998 special meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General. Item C requested approval to close a portion of a utility easement located on Lot 6, Block 2, Fairways II Addition. Item D requested approval of a lot tieing agreement for Lots 20 & 21, Block 1, Central Park Addition. Item E requested approval of Resolution #98 -05, approving interlocal governmental agreements with respect to certain taxable single family mortgage revenue bonds. Item F requested approval to renew an agreement with Mediclaims Inc for ambulance billing administrative services. Mr Wilken moved, seconded by Dr Standridge to approve the consent agenda. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE AWARD OF A CONTRACT FOR FIFTH AVENUE ROAD AND UTILITY IMPROVEMENTS. Mr Carr presented the item. The extension of Fifth Avenue from Cedar St east to the Highway 169 west service road was intended to be constructed to provide roadway access and utilities for National Steak and Poultry. The original engineering design was awarded to Sack & Associates in February 1995. The project was divided into two phases, with Phase I taking the road improvements to the east property line of NSP. Phase II will extend the road to the service road, and includes widening the existing drainage channel north and south of the roadway extension to accommodate 100 -year flood conditions. Bids for Phase II of the project were opened on April- 7, 1998, with five bids being received. Bids received were based on unit prices 2 Owasso City Council June 16, 1998 for estimated quantities of work and it has been determined that adjustments in quantities may be made under terms of the contract that would enable the west service road to be raised. Based on projected work quantities for raising the service road, Tulsa County has been asked to perform the paving, with the City of Owasso paying for paving materials. An interlocal agreement between the City of Owasso and Tulsa County would be required. Dr Standridge ' moved, seconded by Mr Wilken, to award a contract for Fifth Avenue Road and Utility Improvements to Yocham Enterprises, Sapulpa, OK, based on unit bid prices, and authorize the ' Mayor to execute an interlocal agreement with Tulsa County for placement of asphalt. AYE: Standridge, Wilken, Barnhouse, Voss, Bode NAY: None Motion carried 5 -0. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM KOURTIS PROPERTIES TO REZONE PROPERTY LOCATED IMMEDIATELY NORTHEAST OF BANK OF THE LAKES: FROM OL (OFFICE LIGHT) TO CS (COMMERCIAL SHOPPING CENTER), CONTAINING 2.23 ACRES, MORE OR LESS. Mr Rooney said that the Planning Commission held a public hearing on June 9, 1998 to review a request from Kourtis Realty LTD for the rezoning of property from Office Light to Commercial Shopping Center. The property is located northeast of Bank of the Lakes and contains approximately 97,326 sq ft. The applicants are requesting the rezoning to allow for the development of the site for office, retail and restaurant use. Several neighborhood citizens attended the Planning Commission meeting to voice concerns regarding an appropriate buffer between potential commercial development and the residential areas. Staff and the Planning Commission agreed to require a detailed landscaping plan as a condition of any site plan approval for the property. The Planning Commission unanimously recommended approval of the rezoning request. Dr Standridge moved, seconded by Ms Barnhouse, to approve the requested rezoning. AYE: Standridge, Barnhouse, Voss, Wilken, Bode NAY: None Motion carried 5 -0. 1 it 1 Owasso City Council June 16, 1998 ' ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM DAVID CHARNEY FOR ANNEXATION OF AN APPROXIMATE 253.50 -ACRE PARCEL OF LAND LOCATED NORTH AND EAST OF EAST 86TH STREET NORTH AND NORTH 145TH EAST AVENUE. Mr Rooney presented the request. Preston Lakes LLC has submitted a petition for the annexation of approximately 253.99 acres located north and east of the northeast corner of East 86th St N and N 145th East Ave. The property is currently undeveloped and is zoned AG. The Technical Advisory Committee, Annexation Committee, and Planning Commission have all reviewed the request and have all unanimously recommended approval. Ms Barnhouse moved, seconded by Dr Standridge, to approve the requested annexation. AYE: Barnhouse, Standridge, Voss, Wilken, Bode NAY: None Motion carried 5 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPOINTMENT AND CONFIRMATION OF MEMBERS TO VARIOUS BOARDS, TRUSTS, COMMISSIONS AND COMMITTEES. Mayor Bode presented her appointments to various boards, trusts, commissions and committees and requested City Council confirmation. Each appointment was acted upon separately, with the following results: Indian Nations Council of Governments - Mayor Bode moved, seconded by Ms Voss, that the representative to that body be Mayor Denise Bode, with City Manager Jeff Hancock as alternate. The term expires April 30, 1999. In order for this area to be provided sanitary sewer and electrical services, it was necessary for the developers ' of The Fairways to cross the Hole #7 Fairway of Bailey Golf Ranch and a portion of land owned by Larkin Bailey Trust. ENGINEERING PROJECT MANAGER ACCEPTANCE OF STREETS AND DRAINAGE SYSTEMS SILVER CREEK, PHASE I June 29, 1998 BACKGROUND: The project is located three- fourths mile east of the 86th Street North and 129th E. Avenue intersection, immediately east of the existing Brentwood Park addition (see attached location map). The Silver Creek I water and sanitary sewers were accepted by Council on September 16, 1997. Designs for these facilities were reviewed and construction inspected by Public Works personnel. FINAL INSPECTION Public Works personnel held final inspections with the contractors on May 11, 1998 and punch lists of items required to meet City standards were delivered to the contractor on that date. All punch list items relating to the streets and drainage have been completed. The contractors have provided a one -year maintenance bond for the storm drainage system and a two year bond for streets. (see attached). JEFF HANCOCK CITY MANAGER SUBJECT: FOP OWASSO LODGE #149 - COLLECTIVE BARGAINING DATE: July 2, 1998 BACKGROUND: The City of Owasso and FOP Owasso Lodge #149 have been in collective bargaining with weekly meetings since March 12, 1998. In negotiation sessions, the City and the FOP reached tentative agreements on all Collective Bargaining Agreement Articles except Article 23 which is the compensation article. In efforts to reach an agreement, the parties have used the services of a Mediator assigned by the Federal Mediation and Conciliation Service (FMCS), requested a panel for arbitration from FMCS, and continued to meet formally and informally in negotiation sessions. The most recent session was June 24, during which discussions were productive but still failed to result in an agreement. During the collective bargaining agreement process, the FOP submitted a request to the City Clerk, for the FOP to be on the City Council agenda in a regular meeting for "discussion and appropriate action concerning Contract between the City of Owasso and the Fraternal Order of Police Lodge 149. " The initial FOP request was made June 11 and was amended June 12, specifying the FOP be on the July 7, agenda. The FOP's desire to be on the Agenda was verbally confirmed by Cpl. Kenneth Yount in a discussion with Allan E. Harder on Monday, June 29. LEGAL DISCUSSIONS: The FOP's request to be on the Agenda has been discussed with Ronald D. Cates, City Attorney. It is his opinion that any request made by the FOP of the Council constitutes an "unfair labor practice." Specifically, TITLE 11, OKLAHOMA STATUTES, §51 -102, 6. states: "Unfair labor practices" for the purpose of this article shall be deemed to include but not be limited to the following acts and conduct:.. . b. Action by bargaining agent: (3) refusing to bargain collectively or discuss grievances in good faith with the proper corporate authorities with respect to any issue coming within the purview of this article. In the ground rules for negotiations, the City and the FOP designated the individuals who would represent each party in the collective bargaining process. Neither the FOP lodge membership nor the City Council were so designated. Thus any attempts to negotiate other than through the duly designated representatives may be considered a refusal to bargain collectively as mandated in the statutes. We have discussed the FOP's request to be on the Council agenda with Mr. Charles Plumb, the attorney who is representing the City in interest arbitration. He concurs that appearance of the FOP to address the Council would be an Unfair Labor Practice. He terms the action as a "bypass," bypassing the collective bargaining process and the City's designated bargaining representative. Mr. Plumb advises us that we should advise the FOP in writing, in advance of the meeting, of our opinion relating to the Unfair Labor Practice. Attached is a draft letter to the FOP informing them of Administration's position. Unless otherwise directed by the Council, it is my intention to hand deliver the letter to the FOP on Monday, July 6. tRonald D. Cates, has also been consulted throughout the discussions. He is in agreement with the recommendations from Mr. Plumb, and the actions anticipated by Administration. RECOMMENDATIONS: Staff would recommend no action be taken on any request or information presented by the FOP until such time as the collective bargaining process is completed. Mr. Plumb also ' advises us that we recommend to the Council that if the FOP addresses the Council at the Council meeting about a Collective Bargaining Agreement (Contract), the Council not make comments regarding the agreement.
