ITEM 3: FLAG SALUTE Councilor Wilken led in the flag salute. ' ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. ' A. Approval of the Minutes of July 21, 1998 Regular Meeting and July 28, 1998 Special Meeting. B. Approval of Claims. ~ C. Action Relating to Ordinance #584, an Ordinance Providing for the Closing of a Utility Easement Located on Lot 14F, Block 3, Three Lakes Addition. D. Action Relating to Ordinance #585, an Ordinance Amending the Defined Benefit Portion of the Municipal Retirement Plan, Changing the Employee Contributions Rate to a Fixed 4.26%. Owasso City Council August 4, 1998 The consent agenda included minutes of the July 21, 1998 regular meeting and the July 28, 1998 special meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $22,632.02; (2) Collision Self-Insurance $1,801.55; (3) Workers Comp Self-Insurance Fund $3,603.40; (4) Ambulance Service Fund $2,844.17; (5) E-911 $1,949/64; (6) City Garage $6,655.49; (7) Capital Improvements $10,483.00; (8) Bond Projects Fund $800.00; (9) Payroll $150,964.81; (10) City Garage Payroll $3,430.92. Item C requested approval of Ordinance #584, formally adopting City Council action of July 21, 1998 closing an easement located on Lot 14F, Block 3, Three Lakes Addition. Item D requested approval of Ordinance #585, amending the employee retirement system defined benefit plan. Mr Wilken moved, seconded by Ms Barnhouse to approve the consent agenda. AYE: Wilken, Barnhouse, Voss, Bode NAY: None Motion carried 4-0. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #98-06. A RESOLUTION AUTHORIZING THE APPROVAL AND EXECUTION OF THE INVESTMENT IN A REVENUE ANTICIPATION NOTE OF THE OWASSO PUBLIC WORKS AUTHORITY AND THE APPROVAL OF THE LOAN AGREEMENT AND REVENUE ANTICIPATION NOTE OF THE OPWA. Ms Bishop said that the OPWA Trustees approved a concept plan for the construction and funding of the Elm Creek Sewer Interceptor project in March. The concept allows the interceptor to be constructed with city-backed financing, supported by a private sector payback as the property develops. In June staff was authorized to develop documents and conduct negotiations for a bank loan and revenue anticipation note of the OPWA. Staff is recommending temporary financing with aone-year revenue anticipation note, structured similar to a construction loan. The OPWA will be able to draw funds as needed and interest will accrue on the balance. When the interceptor project and all costs have been finalized, the revenue anticipation note will be paid off and a revenue anticipation note with a debt service schedule will be presented for approval. City Resolution #96-08 authorizes the City Treasurer to invest in a revenue anticipation note of the OPWA in an amount not to exceed $1, 800, 000. The resolution also approves the OPWA revenue anticipation note and loan agreement between the City and the OPWA. The revenue anticipation note bears an interest rate of 5.2%, with a maturity date of August 4, 1999, and may be prepaid at any time. Ms Voss moved, seconded by Ms Barnhouse, to approve Resolution #98-06 authorizing the City Treasurer to invest in a Revenue Anticipation Note of the OPWA, to approve the proposed Loan Agreement and Revenue Anticipation Note, and authorize the Mayor to execute all documents related thereto. 2 ' Owasso City Council August 4, 1998 AYE: Voss Baznhouse, Wilken, Bode ~ NAY: None Motion carried 4-0. ~ ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AWARD A CONTRACT FOR THE PURCHASE OF THREE VEHICLES BY THE OWASSO POLICE DEPARTMENT• AND EMERGENCY ' EQUIPMENT FOR THOSE VEHICLES. ~ The item was presented by Chief Alexander, who said that the 1998-99 operating budget for the Police Depaztment contains funding for the purchase of three new police vehicles for the patrol division and necessazy emergency equipment. Each year the State of Oklahoma awazds one contract to the vehicle dealership that provides the lowest and best bid for full-size police ~ vehicles, and municipalities may purchase from that state bid. Fred Jones Ford, Oklahoma City, was awarded the 1998-99 bid at a base cost of $19,789 for each vehicle. Some modifications ' were added to the base bid which changed the total vehicle cost to $19,261 each. Additionally, quotes were received for emergency equipment, with the best bid being received from Fox. Staff recommended that the vehicle striping be awarded to Trim-Rite as a sole source vendor. "'" Mr Wilken moved, seconded by Ms Voss, to award a contract to Fred Jones Ford, Oklahoma City, for the purchase of three 1999 Ford Crown Victoria full size police vehicles at a purchase price of $19,261 each ($57,783 total); to Fox for the purchase of emergency police equipment at a cost of $7,930.95; and to Trim-Rite for the striping of police vehicles at a cost of $1378.20. AYE: Wilken, Voss, Baznhouse, Bode ' NAY: None Motion carried 4-0. ' ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A CONTRACT BETWEEN THE CITY OF OWASSO AND FOP LODGE #149 POLICE). Mr Harder said that the staff has completed negotiations with the police (FOP Lodge #149) for ' FY 1998-99 and an agreement has been reached. Staff has been notified that the FOP has ratified the agreement. The cost of the recommended contract is $891,654.14. The increase over FY 1997-98 results from modifications deleting language added last year that created Relief Shift Officers, Professional Pay Increases and Incentive Pay Increases, and inserting language providing for an across the board salary increase of 4.75 %. Officers who are scheduled for a ' S % step increase on their anniversary date will continue to receive that increase. At this time Mr Wilken moved, seconded by Ms Voss, to recess the City Council meeting, to be reconvened at the conclusion of the Owasso Public Works Authority and Owasso Public Golf Authority meetings. AYE: Wilken, Voss, Barnhouse, Bode NAY: None Motion carried 4-0, and the meeting was recessed at 7:15 p.m. The meeting was reconvened at 7:17 p.m., following the OPWA & OPGA meetings. 4 Owasso City Council August 4, 1998 ' 1 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ITEM 3. REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF ' DISCUSSING THE ACOUISITION OF REAL PROPERTY LOCATED AT 301 W SECOND AVE 315 S CEDAR OWASSO OK AND ADDITIONAL WATER SYSTEM PROPERTIES SUCH EXECUTIVE SESSION PROVIDED ' FOR IN O 5 25 SECTION 307(Bl(3). ' Mr Wilken moved, seconded by Ms Voss, to move into executive session to discuss the purchase of the PSO building located at 301 W Second Ave, the Health Department building located at 315 S Cedar, and additional water system properties. AYE: Wilken, Voss, Barnhouse, Bode NAY: None Motion carried 4-0. The Council went into executive session and 7:18 p.m. and returned at 7:55 p.m. ~ ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ACQUISITION OF REAL PROPERTY LOCATED AT 301 W SECOND AVE, ' OWASSO. OK. Mr Hancock said that the PSO building located at 301 W Second Ave has been placed on the market for sale. The City Council discussed in executive session the purchase of that property to be used as a temporary city hall during the construction of the proposed new city hall and then to be used as a public works department field office. Mr Wilken moved, seconded by Ms Voss, to authorize the City Manager or his designee to make an offer of $375,000 on the PSO building on behalf of the City of Owasso, subject to the appropriate environmental audit. AYE: Wilken, Voss, Barnhouse, Bode NAY: None Motion carried 4-0. If the offer is accepted, approval of the contract will be placed on a City Council agenda. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ~UISITION OF PROPERTY LOCATED AT 315 S CEDAR. OWASSO.OK. Mr Hancock said that City staff has been talking to representatives from the Tulsa City-County Health Department about the possibility of purchasing the building currently occupied by the Owasso Chamber of Commerce. The building has been appraised and proposals and counter- r proposals made, with the final proposal from the Health Department being $79,900. Mr Groth 5 Owasso City Council August 4, 1998 said that it was his understanding that the property would be returned to the City at no cost if the Health Department had no further use for it. The land was originally given to the Health Department by the City of Owasso. Mr Cates said that the deed to the property was given without reservation. Mr Wilken moved, seconded by Ms Barnhouse, to authorize the City Manager to accept the proposal from the Tulsa City-County Health Department for the purchase of the building located at 315 S Cedar and currently occupied by the Owasso Chamber of Commerce. AYE: Wilken, Barnhouse, Voss, Bode NAY: None Motion carried 4-0. When the contract for sale has been prepared, it will be placed on a City Council agenda for approval. At that meeting, area utiiiry companies have the opportunity to request ' additional service easements, as well as utility easements for street lighting. ENGINEERING PROJECT MANAGER SUBJECT: ACCEPTANCE OF WATER AND SANITARY SEWER SYSTEMS FAIRWAYS III DATE: August 11, 1998 BACKGROUND: The subdivision is located on East 96th Street North about one-fourth mile east of Mingo Road (see attached map). The systems consist of installing 9,700 LF of 8-inch sanitary sewer line under ODEQ Permit No. SL000072980619 (see attached) and 3,000 LF of 8", 4,750 LF of 6" and 2,825 LF of 4" water lines under ODEQ Permit No. WL000072980618 (see attached notification of permit). Design for these systems were reviewed and construction inspected by Public Works personnel in accordance with City of Owasso standards. FINAL INSPECTION Public Works personnel conducted a final inspection, accompanied by a contractor representative on August 5, 1998. Punch lists were provided to the contractor on that date. All deficiencies were corrected by August 11th. The Owasso Police Department has a canine which has received extensive training to detect an assortment of drugs. In June of this year, the police department submitted a proposal to the Owasso Public School Administration to provide this drug search service. The proposal included searches of all secondary schools, and the high school at random, unannounced times.. Additionally, the canine team will be available to perform educational programs for all schools (to include elementary schools), at their request. ~ This service will be provided to the Owasso Public Schools for a cost of $10,000.00. Not only is this cost less than what was previously being paid, the school system is receiving more search hours. Additionally, educational programs and canine demonstrations are also provided. ~ At the August 3`~, 1998 School Board meeting, the Owasso School Board unanimously agreed to award the drug detection contract to the City of Owasso-Police Department for the 1998-1999 school year. RECOMMENDATION: Staff recommends Council's approval of the Drug Detection Contract between the City of Owasso and the Owasso Public Schools and authorize the Mayor of Owasso to execute the necessary documents. The compazison cost of the proposal offered by the Owasso Police Department is 567 hours of service for $10,000 which at $17.64 is less than half of what is currently being paid. •~ The reason the police department can offer increased service to the public schools at a highly reduced rate is that the Canine Officer is already on duty and being paid by the city. If awazded this contract, the Owasso Police Department pledges to dedicate one Canine Officer to this effort as his primary mission. The officer's hours will be modified as to coincide with the school hours so that he may "~ serve at the schools request if needed. Unless under an extreme emergency circumstance, will other police duties interfere with the primary assignment of service to the schools. This affords a flexibility to the school while utilizing a local resource. Notwithstanding that additional services are being offered for elementary school and public relation programs. The Owasso Police Department is hopeful to continuing to serve the community of °~ Owasso through the continuing of a partnership with the Owasso Public Schools. RELATIONSHIP OF PARTIES The provisions of this Agreement should not be considered or construed as creating any ' relationship by and between the City of Owasso, Oklahoma and the Owasso Public School System in the nature of a partnership, joint venture, etc. On the contrary, the City of Owasso, Oklahoma, acting by and through the Owasso Police Departmen±, in the provision of services herein contemplated shall at all times be considered an independent contractor of the Owasso Public School System. ~I. A "carryover" budget is a concept wherein budgeted, but unexpended, funds from one fiscal ' year may be re-budgeted (appropriated) to the next fiscal year. The goal of a carryover budget is to encourage economy and efficiency in the use of public funds. ' Traditional public sector budgets "reward" the expenditure of all of the funds under a manager's control and "justify" an increasing level of appropriations in subsequent fiscal years. Efforts to be efficient and save money often are "rewarded" by a reduction in future budgets. The "carryover" budget promotes a philosophy of "save it and invest it" rather than "spend it or lose it." Managers who save money from last year's budget are rewarded by the possibility ~ of a carryover appropriation to the new fiscal year budget. This is the sixth year for the City's managers to operate under a "carryover" budget concept. COMl~~NT: The General Fund departments had a total of $519,729 in budgeted but unexpended funds remaining from the 1997-98 budget. Of that amount, $387,937 was eligible for carryover requests (funds from salaries and other personal services line items normally are not eligible for ~ carryover). As indicated in the list below, the General Fund carryover recommendation is for $346,762. ' Two projects budgeted in the Capital Improvements Fund for FY 1997-98 are currently in progress and have unexpended funds that should be carried over to supplement the FY 1998-99 budget. Those projects are the Highway 169 and 76th Street engineering and Hale Acres drainage. MEMORANDUM TO: JEFF HANCOCK CITY MANAGER FROM: JIM McELRATH SUPPORT SERVICES DIRECTOR SUBJECT: CARRYOVER BUDGET FY97-98 SUPPORT SERVICES DEPARTMENT MAINTENANCE DIVISION VEHICLE MAINTENANCE DIVISION DATE: August 7, 1998 SUPPORT SERVICES DEPARTMENT: This department has a total of $1968.59 in unspent funds from the 5200-5400 series in the FY97-98 budget. $1386.00 of this carryover was budgeted for line item 5443 as accrual carryover to eventually be placed toward the purchase of a new van for the department to use in transport of the DOC work crew. The 1988 Dodge van that has been in use by the Department for DOC transport for the past few years lost its engine approximately one week ago. The cost estimated for replacement of the engine by our technicians is approximately $1500.00 for the parts. In addition the van is in need of a thorough front end overhaul, estimated to cost in the neighborhood of $500 for parts and labor. Vehicle Maintenance Chief Technician Jeff Moody believes that this vehicle is worth the cost of repair and should provide the City with at least a couple more years of service. Based upon his opinion, Support Services staff recommends the repair of the vehicle utilizing funds from the FY97-98 budget in the amount of $1968.00, this amount to be carried over to the current year budget. VEHICLE MAINTENANCE DEPARTMENT: Vehicle Maintenance has a total of $5044 in unspent funds from the 5200-5400 series in the FY87-98 budget. $3192 of these funds are unspent from the 5400 series for capital expenditures, some as a result of savings on capital expenditures, some from accrual carryover from FY96-97; the remainder are from operating savings. ' MEMORANDUM CARRYOVER SUPPORT SERVICES 97-98 ' August 7, 1998 PAGE 2 Three years ago it became illegal for service technicians to work on vehicle air conditioning unless their shop had the use of a freon recycling machine. The garage does not have such a machine. As a result, all AC work must be sent out to outside vendors. At the time that the Garage had to stop performing AC repairs, this farming out was not that much of a problem because it happened to coincide with the replacement of a large percentage of the City passenger vehicle fleet with new vehicles. As these vehicles have gone out of warranty, the cost of performing AC ' repairs on them has risen to the point that it would be to our advantage to purchase a freon recyling machine and perform in-house AC repairs. In a few years the machine would not only pay for itself but would also save time in transporting of and waiting on the repair of downed vehicles. The cost of a recycling machine is in the $5,000 range. Vehicle Maintenance staff ' recommends that $5,000 of the surplus funds from the Garage budget for FY97-98 be carried over to the current year budget for purchase of an Air Conditioner Freon Recycling machine. The requests are as follows: A. In the Police budget, the 100 series will return a little over $10,694.41, (even though $7,290 was used from the 100 series to supplement vehicle maintenance). The 200/300/400 series will report $10,813.32, unspent. I am requesting special permission to use these funds for the Police Department as a carry-over budget. If approved, these funds will be used to purchase new utility uniforms for all commissioned officers. The department has been exploring the implementation of a utility uniform and the cost of outfitting all officers with this uniform (absent nylon gear) will be approximately $8,700. In the Dispatch budget, a total of $14,865.70 was not used in FY 1997-1998. The 200/300/400 series returned $1,616.05. I am requesting consideration of $1,600 to be applied in the communications training line item (51-311-5380). Specifically, emergency medical dispatch training to be provided to all communications officers (to include emergency medical Spanish). This training is expensive at $250 per dispatcher (lodging not included). As the 911 calls increase to our communications center, the dispatchers have to be able to provide emergency medical guidance to 911 callers. Since January of 1998, four (4) calls to the 911 center have demanded extensive medical guidance by telephone until the arrival of the ambulance. This is a critical area of concern. These cracks can eventually lead to pavement deterioration resulting in the need for expensive street repairs. Proper attention to cracks will prevent the problems from spreading and can double the life span of the pavement. A crack treatment maintenance program has been developed The program will require the purchase of equipment that will be used to prepare the cracks for sealant material application. Crack prepazation procedures are the techniques used to open up, clean and/or dry crack channels to attain the best conditions possible for the material to be placed. It is perhaps the most important aspect of sealing operations because a high percentage of treatment failures aze adhesion related. The equipment needed includes: A vertical spindle routing machine to open up the narrow crack channels and create a uniform, rectangulaz reservoir for the sealant material to be applied. Following the routing process, the crack channel needs to be cleaned out with a mechanical wirebrush which will loosen all oxidized AC fragments, vegetation and debris. Awalk-behind blower will then be used to blow compressed air at a rate of 200 mph into the channel cleaning out all remaining debris and moisture. Once the prepazation process has taken place, then and only then can the sealant material can be effectively applied. The equipment needed to apply the sealant includes a 3 gallon crackpot applicator and a V-shaped squeegee. The subject property is bordered on the north by ~ E. 116th Street North, while farther north lies AG-R lots located in Tulsa County. AT&SF Railroad borders the subject property on the east, while farther east lies the Owasso Sports Park zoned AG (Agriculture). The subject property is bordered on the south by additional undeveloped property zoned AG and located in Tulsa County. The subject property is bordered on the west by Mingo Road, while farther west lies the Hillside Estates Addition, zoned AG and ~• located within the city limits of Owasso. (Please note the Council will review a rezoning request from AG to CS (Commercial Shopping Center) on a portion of property in the Hillside Estates Addition on this agenda). A subject map of the annexation request has been attached for your information and review. The subject property is currently zoned AG (Agricultural) in Tulsa County and would remain zoned AG upon annexation. The applicant has indicated the intent to develop the subject ^ property in a commercial and/or high tech industrial manner. If annexation is approved, the subject property would then need to obtain commercial zoning and proceed through the platting ' and site plan review process prior to any development. It should be noted that upon any development of this property, acceleration deceleration lanes would need to be included for all _ entries along Mingo Road and E. 116th Street North, as well as sidewalks. ~ Items of note regarding the subject property are limited to the acknowledgement that the subject property lies in the water service area that was a portion of the District Court settlement between Washington County Rural Water District #3 and the City of Owasso. As a part of that settlement, the City of Owasso was granted an opportunity to provide water service in an area ~ that is within Washington County Rural Water District #3 service area (generally the area is bounded by 96th Street North, Mingo Road, 126th Street North, and Garnett Road). At the time that water service to the subject property is desired, the owner would need to pay Washington County Rural Water District a fee of $50.00 for each tap desired. That notification was followed by notification published two consecutive weeks in the Owasso Reporter on July ' 3d, 1998 and August 6, 199$ to notify the public of City Council action regarding the request. Copies of the Procedures for Annexation and the City of Owasso Annexation Policy are attached , far your information and review. The Technical Advisory Committee reviewed this request at their Juiy 29, 1998 meeting. At ' that meeting, area utility companies and staff are afforded the opportunity to address any problems or concerns they have with the annexation request. No comments opposing the request for annexation were received at that meeting. The Owasso Annexation Committee reviewed the subject property at their August 3, 1998 meeting and unanimously recommended approval of the request. The Owasso Planning Commission reviewed the request at their August I1, 1~8 regulaz meeting and also unanimously recommended approval. ~ If annexed, the subject property would be located in Ward One, Staff recommends approval of the annexation request as the subject property meets the policy requirements. 1. The parties have further agreed that any persons now served by nWp #3 may (continue to purchase water from RwD #3 until such time as OPwA !takes title to said lines by paying RwD #3 therefor. 5. The subject property is bordered on the north ^ by E. IObth Street North, while farther north lies AG-R lots located in Tulsa County. The subject property is bordered on the West by Mingo Road, while the subject property's south and east boundaries vary depending upon the exact location. Generally, the subject property is all ' of the remaining undeveloped land in the square mile area bounded by E. 96th Street North, Mingo Road, E. 106th Street North, and Garnett Road (It does not include the Kelly Ann ^ Addition). A subject map is enclosed within your packet for your information and review. The subject property is currently zoned PUD (Planned Unit Development) with underlying ~ zoning of CS (Commercial Shopping), OL (Office Light), RS (Residential Single-Family) and AG (Agriculture). If annexation is approved, the PUD and the underlying zoning of the property would be abandoned and the zoning would become AG. The subject properties are located north of Morton Marine, east of Garnett Road. The subject properties are bordered on the east by the Owasso Expressway and on the north by the Hayward Smith property, zoned PUD (planned Unit Development). The subject properties are bordered ,., on the west by excess right-of--way from Old Highway I69 which is located in the city limits of Owasso but is owned by Tulsa County, while farther west lies Garnett Road itself. The subject properties are bordered to the south by Morton Marine which is zoned CG and located in Tulsa County. A subject map is enclosed within your packet for your information and review. • The subject properties are currently zoned RE (Residential Estates) Yf annexation is approved, the zoning of the property would become AG (agriculture) the lowest zoning classification in the City of Owasso. The purchaser of the subject properties has indicated the intent to combine the lots with additional property to the north as a commercial site. ' Notification of the annexation requests were published in the Owasso Reporter on July 23, 1998 to notify the public of the annexation requests before the Planning Commission. Those notifications were followed by notifications published two consecutive weeks in the Owasso Reporter on 3uly 30, 1998 and August 6, 1998 to notify the public of City Council action regarding the requests. Copies of the Procedures for Annexation and the City of Owasso Annexation Policy are attached for your information and review. Staff Report Hart and Roach Annexation Requests Page 2 of 2 The Technical Advisory Committee reviewed these request at their July 29, 1998 meeting. At that meeting, area utility companies and staff are afforded the opportunity to address any problems or concerns they have with the annexation requests. No comments opposing the requests for annexation were received at that meeting. The Owasso Annexation Committee reviewed the subject properties at their August 3, 1998 meeting and unanimously recommended approval of the annexation requests. The Owasso Planning Commission also unanimously recommended approval of each request at their August l I, 1998 regular meeting. A review of the annexation policy indicates that the subject properties meet the policy guidelines with the exception of tract size. Please note that requirement was intended as a guideline in order to prevent the spot annexation of properties into the city limits of Owasso. German Corner ' Gymnastics for the rezoning of property from AG (Agriculture) to CS (Commercial Shopping Center). The subject property is located at the southwest corner of E 116' St. N and Mingo Road (N 97~' E Ave.), further described as Lot 1, Block 1, Hillside Estates addition to the City ' of Owasso. The subject property contains 2.56 acres, more or less. A subject map, as well as the complete staff report is contained within your packet for your information and review. ' The applicant is requesting the rezoning to CS in order to allow for the development of the site as a gymnastics facility. Staff review of the request indicates that a rezoning of the subject property to a CS classification is consistent with the recommended land use densities of the 1985 ' Comprehensive Plan for the City of Owasso. For this property, the Comprehensive Plan calls for medium intensity commercial on the comer, wrapped by a buffer of medium intensity residential. It is difficult to envision a medium density residential buffer that would function on ~ this small, 2.56 acre site. With respect to surrounding land uses, both existing and proposed, Bulk and Area Requirements of the CS district should offer an adequate degree of protection for the surrounding residential areas. Therefore, staff considered rezoning to CS appropriate for this property. Notices of the rezoning request were mailed to property owners within 300 feet of the subject property and legal notice was published in the Owasso Reporter. The subject property was also posted the week of July 20, 1998. Several citizens attended the public hearing and voiced concerns about the proposed zoning change. The concerns expressed by citizens included the ' availability of other commercial property in the area and their concerns regarding the compatibility of a commercial district within the context what they feel is an existing neighborhood. Section 1530 of the Owasso Zoning Code allows the Planning Commission to consider and act on zoning classifications of lesser intensity. In this case, the Planning Commission could also consider Medium and Low Intensity Office zoning. After consideration of the testimony, the ri Planning Commission voted unanimously to approve a rezoning to OL (Office Light) for the subject property. Staff concurs with this decision as an appropriate zoning classification and a rezoning of the subject property to OL would still allow the applicant to operate a gymnastics ' facility at this location. If the Council approves the rezoning request, an ordinance will be presented to the Council at the September 1, 1998 meeting to formally adopt the actions of the Council. The Planning Commission unanimously recommended approval of the amended rezoning request from AG (Agriculture) to OL (Office Light). The 1985 Comprehensive Plan for Owasso recommends medium intensity commercial on the southwest corner, surrounded by medium intensity residential that should serve as a buffer to neighboring single family residential areas. The owner proposes rezoning the entire area to CS (Shopping Center District). The subject property is relatively small at 2.56 acres, and it is difficult to envision a medium density residential buffer that would function on this site. Surrounding single-family areas would still have a degree of protection. Bulk and Area Requirements for the CS District would limit the building setbacks to a minimum- of 10 feet to abutting residential property. It is also anticipated that proposed commercial facilities, such as the gymnastics center (Use Unit 11 -Offices and Studios), would be required to submit site plans to the Planning Conunission through a separate process. Section 1530 of the Owasso Zoning Code regarding zoning map amendments confers jurisdiction to the Planning Commission to act on the proposed CS zoning, or a zoning district of lesser intensity. In this case the Planning Commission could also act on OM (Office Medium Intensity) District or OL (Office Low Intensity) District, or any combination thereof. A recommendation of a lower intensity land use would not change parking or setback requirements, and would only serve to limit the types of facilities that can locate at this site. The applicant is also requesting a PUD supplemental zoning district described in the Preston Lakes PUD application elsewhere in this agenda. The subject property is located in the south half of Section 22, T-21-N, R-14-E, City of Owasso, Rogers County, Oklahoma, generally located north of E 86'~ St. N between N 145' E Ave. and N 1615` E Ave. The proposed zoning is as follows: from AG to RS-2 (Residential Single-Family Medium Density District) ± 231.7 acres, RM-2 (Residential Multi-Family District) ± 12.6 acres, CS (Shopping Center District) ± 5.0 acres, and CG (General Commercial District) ± 5.0 acres. The subject property was annexed in June 1998 and is the first parcel of land in Rogers County to become part of the City of Owasso. The planned Elm Creek Sewer Interceptor will, for the first time, make development to City of Owasso standards in Rogers County feasible. The interceptor will have the capacity to serve this area as well as other tracts of undeveloped land nearby. The 1985 Owasso Comprehensive Plan recommends medium intensity commercial, surrounded by medium intensity residential for the northeast corner of E 86"' St. N and N 145`'' E Ave. Although the proposed CS (Shopping Center Commercial), CG (General Commercial), and RM- 2 (Residential Multi-Family) Districts are slightly larger than the 1985 plan suggests, the importance of this node has also increased. When the comprehensive plan was drafted 12 years ago, few predicted that this area would have so much potential for development. Unforeseen conditions such as the growth of the 86~' St. corridor and construction of the sewer interceptor have changed the outlook for this area. These changing conditions should be accounted for in the Comprehensive Plan update currently being developed. The Comprehensive Plan also calls for low-density residential development on the remainder of the tract. The developer proposes an appropriate RS-2 (Residential Single-Family Medium Density) District for the same area. OPUD-15 consists of 244.3 acres of single-family and multi-family development proposed in delineated areas. Multi-family would be located in 19.3 acres near the northeast corner of E 86 ~' Street N and N 145' E Avenue, and villas would be located on 8 acres near the southeast corner ' of the development. Single-family housing would occupy 131.3 acres in the center of the tract. Park and open space are proposed for 79.2 acres, most of which is floodplain. The overall residential density being proposed by the applicant is 4.22 dwelling units per acre, which is less ' than the aggregate density of 4.63 units per acre allowed by the proposed underlying zoning districts. In addition, an 11 acre area intended for commercial development is also being sought by the applicants. The location of this property is at the northeast corner of E 86~' Street N and N 145`'' E Avenue. A copy of the complete staff report is attached for your information and review. Once again, because both OZ-98-11 and OPUD-15 are interrelated, both require separate action by the City Council. Because of the common relationship between the two agenda items, staff will likely review both items simultaneously. Please note, an affirmative vote on the underlying zoning is necessary in order for consideration of this item. The Owasso Planning Commission reviewed the Planned Unit Development request at their August 11, 1998 regular meeting. At that meeting, staff recommended approval of OPUD-15 with 15 conditions that are included in the attached report. The Planning Commission approved the Planned Unit Development by a vote of 4-1. MEMORANDUM TO: FROM: SUBJECT: DATE: BACKGROUND The applicant, Preston Lakes LLC, proposes a Planned Unit Development (PUD) on ± 254.3 acres, located in the south half of Section 22, T-21-N, R-14-E, City of Owasso, Rogers County, Oklahoma, generally located north of E 86~' St. N between N 145' E Ave. and N 1615` E Ave. The applicant proposes up to 500 single-family detached dwelling units, 80 villas/townhouses, 450 multi-family units, and ± 11 acres of commercial development with a maximum floor area of 217,800 square feet. The proposal for Preston Lakes PUD is quite large, and made possible only by the new Elm Creek Sewer Interceptor. The developer proposes a combination of single-family housing (131.3 acres), villa townhouses (8.0 acres), multi-family apartments (18.5 acres), and commercial (11.0 acres). The developer also proposes a 70.2 acre park, in areas which do not lend themselves to development, primarily because of the floodplain. A stated goal of the development is to fulfill a need for a diverse range of housing types, reflective of the needs of today's and tomorrow's home buyer. The proposal offers a wide variety of land uses on a single site, and the developer proposes to use the topography, as well as other vegetative and man-made buffers to separate the more intense from the less intense land uses. The highest intensity land uses are shown at the southwest corner of the property, near the intersection of E 86`'' St. N and N 145` E Ave. This generally conforms to the recommendations of the 1985 Comprehensive Plan for the City of Owasso. With such a large site, the developer is seeking flexibility in the form of a PUD. The developer anticipates that it will take at least five years to develop this site and believes that the PUD will grant him the flexibility he needs to adapt to changing market conditions. Generally, a PUD ' permits flexibility within the development, while preserving open space, maintaining appropriate limits on the character and intensity of land use, and assuring compatibility with the adjoining and proximate properties. The developer is given the flexibility to arrange land use freely within the PUD, u~respective of the location of the underlying zoning districts. However, the aggregate land use must conform to the underlying zoning. For instance, the developer proposes 5 acres of CG commercial uses. He can place those land uses anywhere on the tract so long as, in the end, he does not exceed the • proposed 5 acres. The Planning Commission can act to prevent through the prescription of buffering, screening, and setbacks during the platting process. At this time, the proposed outline PUD appears to have adequate buffering to ensure compatibility of land uses. ~ Within the PUD, the developer has provided a set of Development Standards for each type development proposed in the PUD. Minimum standards for Single-Family Detached Residential (Executive and Premier Homesites), Single-family Attached (Villas), Multifamily, and Commercial, are given in the text of the PUD. During the platting process, a review of the •r proposed Development Standards will ensure that the developer adheres to these standards and is consistent with the Outline Plan. Any deviation should be in conformance with the proposed development standards, or the underlying zoning code. PUBLIC HEARING AND PLANNING COMIVIISSION ACTION The Owasso Zoning Code, Section 880.5, requires the Planning Commission. to determine the following: a) Whether the PUD is consistent with the Comprehensive Plan. The underlying zoning for the PUD very closely resembles the land use called for in the 1985 Comprehensive Plan. A copy of the land use map is attached herein. The overall densities for residential and commercial, would be very consistent with the Comprehensive Plan. Although the commercial and higher density housing azeas are slightly lazger (about 25 %) than the plan calls for, the importance of this node has also increased. Unfortunately, the Comprehensive Plan does not provide any direct guidance in the use of the PUD. The Comprehensive Plan Map of 1985 includes text that was _ drafted in 1978. At that time, the PUD was not widely used. As a result, there is no information regazding the PUD in the Comprehensive Plan. This should be remedied in the Comprehensive Plan update currently being developed. "" For guidance we can turn to the Zoning Code, Chapter 8, regarding Planned Unit Development. The PUD was created to address certain conditions -and situations where conventional zoning would be ineffective, or even detrimental. Such ~ conditions might include unique topographical considerations. Elm Creek may qualify as a unique situation. '~ b) Whether the PUD is in harmony with the existing and expected development of surrounding areas. Surrounding land uses can be broken down into three affected , areas: 1) Areas near the proposed commercial. Around the proposed commercial azea lies: an undeveloped 80 acre tract to the north, Hodson Elementary and additional undeveloped land to the south, and Silver Creek Addition that will likely expand to abut some of the commercial areas of the PUD along 145 `~ E ~. A ' buffer to the north is recommended (and shown in the text addendum to the PUD included in this packet), simply because the commercial area is relatively large, and the anticipated development in the 80 acre tract will ~ likely of a lower density. The developer will need to pay special attention to pedestrian movement to ensure complete compatibility with the elementary school (this is also reflected in the text addendum). i il y area s 2) Areas near the proposed multi-family. Again, the multi-fam ~, fairly insulated. The 80 acre tract lies to the north, proposed commercial to the west across a buffer zone, proposed single-family to the east across a ~` ' St. N, also buffered. buffer zone, and vacant land to the south across 86 The proximity to Hodson Elementary is desirable for families with children ^ who may live in the multi-family area. Nearby convenience commercial is also a plus for higher density residential as it may help to reduce the overall number of vehicle trips. The developer has tried to ensure that the multi- family will be compatible with surrounding land use. .. 3) Areas near the park and single-family development. Single-family housing is proposed to abut the rear lots of existing estate lots to the north. Although the proposed housing will probably be of a higher density, the abutting properties are reasonably compatible with one another. The proposed park could serve as an amenity for all of the neighboring ' properties. The Premier Homesites in the SE corner of the PUD will be located opposite existing estates lots to the south across E 86~' St. N. Again, this should be compatible with existing land use. The proposed Villa townhouses will be located to the north of the Premier Homesites and south of the park. Although this is a higher density development, the proximity of the park should provide openness and feeling of space. A large undeveloped ~ 40 acre strip along N 1615` E Ave. abuts the proposed PUD to the east. This may be developed as residential, or a combination of residential and commercial near the intersection of 86~` St. and 161St E Ave. Both of these possibilities will be reasonably compatible with the surrounding park and residential areas. In summary, the developer has located each of the proposed land uses appropriately within the development. The strategic location of each land use should result in very few incompatibilities with the surrounding land uses. The possibility of a well- maintained park nearby may even enhance the quality of life of the neighbors. Under the rules of the PUD, the developer has the ability to reallocate each of these land uses within the development. If the developer chooses this option, the Planning Commission may require additional buffering to ensure compatibility in and around the development. c) Whether the PUD is a unified treatment of the development possibilities of this C:\Owasso\Planning Commission\8-11-98\08. The unified treatment of the site begins with an understanding that construction "1 in the floodplain should be avoided; a sound decision. In return for preserving the open space, the developer is requesting that the Planning Commission allow him to develop at higher densities in ,,, the areas that are more suited to development. d) Whether the PUD is consistent with the stated purposes and standards of the Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes PUD. The PUD would: 1) Permit innovative land development while maintaining appropriate limits on ,r the character and intensity of use and assure compatibility with adjoining and proximate properties; 2) Permit flexibility within the development to best utilize the unique physical features of the particular site; 3) Provide and preserve meaningful open space; 4) Achieve a continuity of function and design within the development. The PUD also conforms to the standards set forth in Chapter 8. The developer has ;~ submitted the appropriate application materials and has established a plan that should conform to the requirements of the Owasso Zoning Code. Staff does not anticipate any difficulties in the administration of the Freston Lakes PUD as proposed. Certain ;~=k details regarding ownership of the park and maintenance of drainage facilities are unresolved but it is not necessary to resolve these issues for approval of the PUD ~ concept. Maintenance agreements as well as dedication of land for public purposes can and should be resolved during the platting process. RECOMMENDATION Staff recommends approval of the PUD subject to the following conditions: A. That the applicant's Development Text, Text Addendum, and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the "~ Owasso Zoning Code; +~I B. ' H. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. ' I. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. t K. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. L. Acceleration/Deceleration lanes at each access point to the subject property along the arterial streets (two locations on E 86~` St. N, one location on N 145' E Ave.). ^ M. The inclusion of sidewalks along the abutting arterial streets and the interior drives within the proposed development. ~ N. The submittal of detailed landscaping plans to be submitted at the time of site plan review, said plans to be reviewed by staff and the Planning Commission for approval. ' O. The Planning Commission reserves the right to prescribe additional buffering, screening, and ~ setbacks during the platting process. To the extent that the developer chooses to vary from the outline PUD, the developer can and should expect additional buffering requirements as is " necessary to ensure compatibility with surrounding land uses. NO. 1 PRESTON LAKES PUD TEXT Owasso, Oklahoma August 4, 1998 This Addendum tb the Preston Lakes PUD Text is submitted to the City of Owasso, Oklahoma to help clarify certain issues. These issues are as follows: Nonhern comnercial tract will have a vegetative buft'er and/or screening fence alonl; its northern boundary line. 2. Alt free standing commercial tracts will be allowed only one curb cut each. The use of mutual access easements will be emphasised to aid in the free movement of traffic within the con,n~ercial tracts. ~n addition, the use of the east/west roadway off 1.45th East Avenue will be encouraged in order to provide interior access to these commercial parcels. 3. The river trail system will provide a connection to the commercial tracts with sidewalks or similar pedestrian access through the commercial area, ultimately allowing for safe access to ~'lodson Elementary School. 4. In an effort to clarify the discrepancy between the 372 single-family lots shown on the conceptual development plan and the request for a tnaxitnun~ of 500 single-family dwelling units, we would like to emphasize that the submitted plan is for illustration purposes only and not to be rtusconstrued as a final lotting plan. We would be allowed, with the approved PUD, to have lots with a minimum of 6S feet in width. The conceptual development plan shows lots that vary from 65 feet to over 100 feet wide. As the various residential. phases are developed, it will be determined by the market demand as to the specific lot sizes that will be butlt. As a result of a preliminary, private meeting between the surrounding homeowners and the developers of Preston lakes, the developers have tigreed to the following screening requirement: "Any residential lots along the northern boundary of Preston Lakes which have a rear lot line adjacent to any lot within the `'4'hispering Pines or Paradise Valley subdivisions shall be required to have a six foot tall privacy fence along such. rear lot line that is adjacent to said subdivisions. Furthermore, and in addition to this fencing requirement, the owner of any such lot tiitltin Preston Lakes shall be required to plant. two trees in the backyard of such. lot within six months after the completion of the construction of a home or such lot.."
