Consideration and Appropriate Action Relating to the Award of a Contract for Engineering Services Relating to an Upgrade of the 117th East Avenue Lift Station. Mr Lutz Attachment #7 - ~ ' The staff will recommend that a contract for engineering services for the upgrade of the 117th East Avenue Lift Station be awarded to Grafton, Tull & Associates, Rogers, AR, in the amount of $40,000, and authorization for the Mayor to execute the document. .~ 8. Consideration and Appropriate Action Relating to the Purchase of a Color Inkjet Plotter for the Engineering Department. Mr Lutz Attachment #8 The staff will recommend City Council approval of the purchase of a Hewlett Packard HP DesignJet 750C plotter from Ridgway's Inc, Tulsa, OK, in the amount of $6157. 9. Consideration and Appropriate Action Relating to a Request for City Council to Authorize the Notice, Equalization and Levy of Assessments Against Properties in Tulsa County Sewer Improvement District #6. Mr Ernst Attachment #9 ~ The staff will recommend that the Council authorize notice, equalization and levy of assessments against properties within the District (Pleasant View Estates) sufficient to pay the interest and principal amounts due on the outstanding indebtedness represented by the District Bonds. ^i ^~ ~ Owasso City Council September 1, 1998 Page 5 10. Consideration and Appropriate Action Relating to a Request for Council Approval of a ' Supplemental Appropriation to the General Fund, Increasing Expenditures in the General Government Department by $80,000 and Increasing Expenditures for a Transfer to the OPWA by $375,000, and Authorizing Such Transfer to the OPWA. ' Ms Bishop Attachment # 10 ' The staff will recommend a supplemental appropriation to the General Fund increasing expenditures in the amount of $80,000 in the General Government Department for the purpose of purchasing the Tulsa City-County Health Department Building at 315 S Cedar; ' and $375,000 for a transfer to the OPWA for the purchase of a building located at 301 W Second Ave, and authorization of the transfer. 11. Consideration of Approval of Contract for Sale and Receipt of Partial Payment Relating to ' City of Owasso, Oklahoma, Acquisition from the Board of County Commissioners of Tulsa County, Oklahoma, of the Tulsa City-County Health Department Real Property, Authorizing ,~ the Mayor to Execute Such Contract for Sale and Receipt of Partial Payment, Authorizing the City Treasurer to Expend the Sum of $500 as and for Earnest Money, as Well as Authorizing a Final Payment of $79,400 Upon Closing of the Real Estate Transaction. Reports from City Councilors A OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, August 18, 1998 The Owasso City Council met in regular session on Tuesday, August 18, 1998 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, August 14, 1998- -- ITEM 1: CALL TO ORDER Mayor Bode called the meeting to order at 7:00 p.m. ITEM 2: INVOCATION The invocation was offered by Pastor William Diekelman of Faith Lutheran Church. ITEM 3: FLAG SALUTE Councilor Wilken led in the flag salute. ITEM 5: REQUEST BY CITIZEN TO ADDRESS THE CITY COUNCIL. Ms Dawn Barrick, who had provided the City Clerk with a written request to address the Council, withdrew her request prior to the meeting. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of the Minutes of August 4, 1998 Regular Meeting and August 11, 1998 Special Meeting. B. Approval of Claims. Owasso City Council August 18, 1998 C. Action Relating to City Council Approval of a Final Plat for The °' Fairways III, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. _ D. Action Relating to the Acceptance of Improvements to the Water and " Sanitary Sewer Systems Constructed to Serve The Fairways III, an Addition to the City of Owasso, Tulsa County, Oklahoma. ~~ The consent agenda included minutes of the August 4, 1998 regular meeting and the August 11, 1998 special meeting, by reference made a part hereto. Item B on the consent agenda included , the following claims: (1) General Fund $34,665.12; (2) Workers Comp Self-Insurance Fund $329.55; (3) Ambulance Service Fund $1,824.31; (4) E-911 $45.57; (5) City Garage $7,582.52; (6) Payroll $152,735.37; (7) City Garage Payroll $3,410.23. Item C requested approval of a ' final plat for the Fairways III, located on the south side of E 96th St N between Bailey Ranch Golf Club to the west and unplatted land to the east. Item D requested acceptance of the water t and sanitary sewer systems constructed to serve The Fairways III. Mr Wilken moved, seconded by Ms Barnhouse to approve the consent agenda. AYE: Wilken, Barnhouse, Standridge, Bode ' NAY: None Motion carried 4-0. ~ ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO APPROVAL OF A CONTRACT FOR DRUG DETECTION CANINE SERVICES. Chief Alexander said that the Owasso Public School system has utilized the services of a drug dog for several years to detect drugs in and around the school facilities. The Owasso Police Department has a dog that has received training in drug detection and has offered the services of that dog to the school system. At the August 3, 1998 Board of Education meeting, the Board unanimously agreed to enter into a contract with the City of Owasso for the use of the Police Department dog for drug detection services and for educational programs at a fee of $10,000 for the 1998-99 school year. Dr Standridge moved, seconded by Ms Barnhouse, to approve the contract with the Owasso Public School System for the Owasso Police Department to provide drug detection canine services to the school system for the 1998-99 school year at a cost of $10,00, and authorization for the Mayor to execute the document. AYE: Standridge, Barnhouse, Wilken, Bode NAY: None Motion carried 4-0. ^i z J Owasso City Council August 18, 1998 ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE VEST FOR COUNCIL APPROVAL OF A "CARRY-OVER" BUDGET AND SUPPLEMENTAL APPROPRIATION TO VARIOUS DEP_AR~'MENTS WITHIN THE GENERAL FUND GARAGE FUND AND CAPITAL IMPROVEMENT FUND. Ms Bishop presented the item, stating that the City Council has approved a carryover budget since 1993. Under this concept, funds unexpended during the fiscal year may be rebudgeted to the next fiscal year. A carryover budget promotes efficiency by allowing unexpended funds to be carried over and utilized in the next fiscal year. A total of $519,729 remains unexpended from the 1997-98 budget. Of that amount, $346,762 is recommended for carryover. Mr Wilken moved, seconded by Dr Standridge, to approve the requested carry-over from the FY 1997-98 budget and a supplemental appropriation to the FY 1998-99 General Fund budget of $346,762, Garage Fund budget of $5000, and Capital Improvement Fund budget of $14,960. AYE: Wilken, Standridge, Barnhouse, Bode NAY: None Motion carried 4-0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT FOR 76TH AND 86TH STREETS NORTH STRIPING AND CRACK SEAL BETWEEN THE CITY OF OWASSO AND MAGNUM CONSTRUCTION INC AND AUTHORIZATION FOR FINAL PAYMENT. Mr Lutz said that a contract was awarded to Magnum Construction on June 3, 1998 in the "' amount of $75,000.42 for the purpose of restriping and sealing cracks at the 76th St N and Main Street intersection and on 86th St N between Garnett Road and 129th East Ave. The work has been completed and inspected and all punch list items have been corrected. The final contract amount is $68,953.74. This is less than the contract award amount due to variation in ~ quantities. A partial payment in the amount of $25,267.51 has been made, leaving a balance due the contractor of $43,686.23. Dr Standridge moved, seconded by Mr Wilken, to accept the work performed under a contract with Magnum Construction Inc and authorize final payment in the amount of $43,686.23. AYE: Standridge, Wilken, Barnhouse, Bode NAY: None Motion carried 4-0. 3 Owasso City Council August 18, 1998 ' ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM VINES PROPERTIES INC FOR ANNEXATION OF AN APPROXIMATE 23.55-ACRE PARCEL OF LAND LOCATED AT THE SOUTHEAST CORNER OF E 116TH STREET NORTH AND MINGO ROAD Mr Rooney presented the item, stating that Vines Properties Inc has requested annexation of approximately 23.55 acres at the southeast corner of Mingo Road and 116th St N. The request has been reviewed by the Technical Advisory Committee, the Annexation Committee, and the Planning Commission, with all recommending approval. Ms Barnhouse moved, seconded by Dr Standridge, to approve the requested annexation. AYE: Barnhouse, Standridge, Wilken, Bode NAY: None Motion carried 4-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ~ REQUEST FROM KOURTIS PROPERTIES LLC FOR ANNEXATION OF AN APPROXIMATE 408.7-ACRE PARCEL OF LAND LOCATED WITHIN THE SQUARE MILE BOUNDED BYE 96TH STREET NORTH AND E 106TH ST N. AND MINGO ROAD AND GARNETT ROAD. ,~„ Mr Rooney said that Kourtis Properties LLC has submitted a petition for annexation of ' approximately 408.7 acres north and west of the Ator Heights Addition. The property is currently zoned Planned Unit Development. If the annexation is approved, the PUD and underlying zoning will be abandoned and the zoning will become AG. The request has been ' reviewed by the Technical Advisory Committee, Annexation Committee, and Planning Commission, and all recommended approval. Mr Wilken moved, seconded by Dr Standridge, to approve the requested annexation. ' AYE: Wilken, Standridge, Barnhouse, Bode NAY: None ' Motion carried 4-0. 4 Owasso City Council August 18, 1998 ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM DOROTHY HART FOR ANNEXATION OF AN APPROXIMATE 3.60-ACRE PARCEL OF LAND LOCATED- NORTH OF MORTON MARINE ON GARNETT ROAD. Ms Dorothy Hart, along with Mr & Mrs Everett Roach, has submitted a petition requesting annexation of properties which combined total approximately 5.26 acres. The subject properties aze located north of Morton Mazine, east of Garnett Road. Mr Rooney said that the purchaser r of the subject properties has indicated the intent to combine the property with additional property to the north to be utilized as a commercial site. The properties aze currently zoned RE ' (Residential Estates) in Tulsa County, but will become AG (Agriculture) upon annexation. A review of the annexation policy indicates that the properties do not meet established guidelines _ relative to tract size. The guidelines were initiated in order to prevent spot annexation, however these properties aze adjacent to existing city limits and will assist ongoing efforts to eliminate Tulsa County parcels surrounded by property that lies within the City of Owasso. All required entities have reviewed the request and recommended annexation. Dr Standridge moved, seconded by Ms Baznhouse, to approve the request from Ms Dorothy Hart for annexation into the city limits of Owasso. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REOUEST FROM EVERETT ROACH FOR ANNEXATION OF AN APPROXIMATE 1.66-ACRE PARCEL OF LAND LOCATED NORTH OF MORTON MARINE ON GARNETT ROAD. Mr & Mrs Everett Roach, along with Ms Dorothy Hazt, have submitted a petition requesting ^s annexation of properties which combined total approximately 5.26 acres. The subject properties are located north of Morton Marine, east of Garnett Road. Mr Rooney said that the purchaser of the subject properties has indicated the intent to combine the property with additional property to the north to be utilized as a commercial site. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FROM LINDA MEEKER (GERMAN CORNER GYMNASTICS, TO REZONE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF E 116TH ST N AND MINGO RD FURTHER DESCRIBED AS LOT 1 BLOCK 1. HILLSIDE ESTATES ADDITION• FROM AG (AGRICULTURE) TO OL (OFFICE LIGHT). CONTAINING 2 56 ACRES MORE OR LESS The City has received a request from Linda Meeker, dba German Corner Gymnastics, for the rezoning of property from AG to CS (Commercial Shopping Center) to allow for. the ' development of the site as a gymnastics facility. Mr Warlick said that the Planning Commission considered the request on August 11, 1998 and, after hearing concerns from citizens, the Planning Commission voted unanimously to approve a rezoning to OL (Office Light). Section 1530 of the Owasso Zoning Code allows the Planning Commission to consider and act on zoning classifications of lesser intensity than what was requested. The rezoning of the property to OL would still allow the applicant to operate a gymnastics facility at the location. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ' REQUEST FROM PRESTON LAKES LLC TO REZONE PROPERTY LOCATED NORTH OF E 86TH ST N BETWEEN N 145TH EAST AVE AND N 161ST E AVE: FROM AG (AGRICULTUREI TO RS-2 (RESIDENTIAL SINGLE-FAMILY MEDIUM DENSITY) RM-2 (RESIDENTIAL MULTI- FAMILY). CS (COMMERCIAL SHOPPING CENTER) AND CG (COMMERCIAL GENERAL), CONTAINING 254 3 ACRES MORE OR LESS Mr Warlick said that Preston Lakes LLC has requested rezoning of a 254.3-acre tract from AG to RS-2, RM-2, CS, and CG. The subject property is located north of East 86th Street North ' 6 ' Owasso City Council August 18, 1998 between North 145th East Avenue and North 161st East Avenue. The purpose of the rezoning request is to establish underlying zoning for a Planned Unit Development. The Planning Commission reviewed the zoning request on August 11, 1998 and approved the requ~~t by a 4-1 vote. Several nearby property owners attended the Planning Commission meeting and"expressed concerns regarding flooding on 86th St, increased traffic, overcrowding of schools, and the presence of multi-family dwellings. Mr Wilken moved, seconded by Ms Barnhouse, to approve rezoning case OZ-98-11 as recommended by the Planning Commission. AYE: Wilken, Barnhouse, Standridge, Bode NAY: None Motion carried 4-0. ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE UEST FROM PRESTON LAKES LLC FOR COUNCIL APPROVAL OF A PLANNED UNIT DEVELOPMENT. ~ Mr Warlick presented the item, stating that Preston Lakes LLC has requested approval of a Planned Unit Development on 254.3 acres. The underlying zoning as approved in the previous ' item allows for multi-family, single family, and commercial areas. The Planning Commission approved the PUD on August 11, 1998, with the conditions outlined in the background memorandum. Mr Wilken moved, seconded by Ms Barnhouse, to approve OPUD-15, following the recommendations of the Planning Commission. AYE: Wilken, Barnhouse, Standridge, Bode NAY: None Motion carried 4-0. ITEM 17: REPORT FROM CITY MANAGER Other than the provided written report, Mr Hancock informed the Council of the denial of a request for rezoning by the Rogers County Commission. ENGINEERING PROJECT MANAGER SUBJECT: ACCEPTANCE OF WATER AND SANITARY SEWER SYSTEMS LAKESHORE GREENS, PHASE I DATE: August 25, 1998 c BACKGROUND: The development is located on Mingo Road about one-fourth mile north of 86th Street North (see attached location map). The utilities consist of installing 570 LF of 8" sanitary sewer line under ODEQ Permit No. SL000072980256 and 1,465 LF of 8" water line under ODEQ Permit No. 000072980255 (see attached). Designs for the these systems were reviewed and construction inspected by Public Works personnel in accordance with city of Owasso standards. FINAL INSPECTION: Public Works personnel conducted final inspections, accompanied by a contractor representative, on August 5, 1998. Punch lists of items needed to bring the facilities to city standards were provided to the contractor on that date. All items were corrected by August 21, 1998. One-year maintenance bonds for the water and sewer systems have been provided and will become effective upon acceptance (see attached). AVENUE LIFT' STATION UPGRADE DATE: August 24, 1998 BACKGROUND: The City of Owasso Sanitary Sewer Master Plan outlines anticipated sanitary sewer system improvements which will be needed over the next 5-, 10- and 20-year periods. The proposed Elm Creek Interceptor Sewer currently awaiting award will discharge at the existing 117th E. Avenue Lift Station (see attached location map). In order for the lift station to adequately accommodate additional flow from future development in the drainage basin, the station capacity must be increased. Upgrading the existing lift station is a master plan recommendation. PROFESSIONAL SERVICES CONTRACT: The design engineer for the Elm Creek Interceptor Sewer is Grafton, Tull and Associates (CTA), Rogers, Arkansas. This engineer is keenly knowledgeable of the wastewater collection system required in the east service area of the City. CTA has submitted a scope of work and a cost proposal for engineering services in the amount of $30,130 with a $10,000 contingency for unforseen conditions for a total of $40,130 (see attached). Staff has reviewed the proposal and found it to be reasonable. Staff proposes to make a direct award for professional engineering services in accordance with Section 7-107(7) of the City of Owasso Code of Ordinances. The cost for the lift station upgrade will be included in the total cost of the Elm Creek Interceptor Sewer system and, as such, will be reimbursable through payback from future development in the drainage basin. FUNDING SOURCE: Funding will be provided temporarily through the Revenue Anticipation Note and will be reimbursed by fees generated from Elm Creek basin development paybacks. ENGINEERING PROJECT MANAGER SUBJECT: PURCHASE OF A COLOR INKJET PLOTTER ENGINEERING DIVISION, PUBLIC WORKS DEPARTMENT DATE: August 25, 1998 BACKGROUND: Engineering Division currently uses a color pen plotter purchased in the late 1980's to produce maps, drawings and other visual aids up to a size of 44" X 30". Division customers include all city departments, city hall administration and civic organizations when requested. The current plotter utilizes multiple color pens to dot-pattern lines and images. This process is very time consuming, makes timely modifications and reprints difficult and does not produce products which compare to current available technology. One E-size (44" X 30") drawing with cross hatching can take up to four hours to produce. The process is further complicated in that the rapid scrolling action sometimes creases or tears the paper, requiring a restart of the total process. The inkjet plotter has the capability to produce quality photo images with information overlays in a matter of minutes which is not possible with the pen plotter. PLOTTER SPECIFICATIONS: No specific specifications were developed. Requirements were developed with reference to what is available in the industry relating to compatibility with Windows and AutoCad, resolution, available accessories, warranty, speed, and life cycle cost. QUOTE ANALYSIS: After contacting several vendors on plotter availability and cost, three vendors were asked to provide sealed quotes (see attached). Two vendors (Triangle Company and Ridgway's, Inc.) submitted the Hewlett Packard HPDesignJet 750C. One vendor (J.D. Young Company) submitted the Hewlett Packard HP540C. The attached comparison sheet shows capabilities and costs of each unit. Both plotters are capable of 600 dots-per-inch and 300 dots-per-inch in color. The price from Ridgways includes a rebate and is less than that of Triangle but exceeds that from J.D. Young. The Ridgway's unit is $362 more than the J.D. Young unit but includes accessories, software and less expensive operational supplies. Even though the J.D. Young unit includes a scanner (the cost of which is steadily declining), the anticipated savings on supplies over the life of the plotter will more than offset the initial cost of a scanner. Staff believes that the life cycle cost of the Ridgway's unit will be a better investment for the city. CITY OF OWASSO JIM ERNST FINANCE DEPARTMENT ASSESSMENT OF SEWER IlVIPROVEMENT DISTRICT August 27, 1998 Homeowners in the Pleasant View Estates Addition approached staff in 1995 concerning the ability to connect to City sewers in order to alleviate septic system problems in their subdivision. The addition is outside the current City limits, but collection lines were designed in conformance with established city criteria. The homeowners elected to form a Sewer Improvement District (Tulsa County Sewer Improvement District No. 6) and issue bonds to finance construction. On February 18, 1997, Council agreed to accept, operate and maintain the system contingent upon the vote of the District. In March ' 1997, the District held an election to consider the transfer and conveyance of the sewer system to the city. The District agreed to the consolidation. The agreement entitled "Agreement for Consolidation of Sewer Improvement District with City of Owasso and for Connection of Sanitary Sewer Systems to Existing Excess Capacity Sanitary ' Sewer System" is attached and was approved by Council on April 21, 1998. The following provisions that the City agrees to perform include: 1-Accept the sewer system and consolidate the District with the City, and ' 2-Collect a reimbursement from properties subsequently connected to the system that will utilize excess capacity. Reimbursements will be in the amount of $1,338.58 per acre and will be applied solely to amortization and satisfaction of the bonded indebtedness. ~ 3-Give notice, equalization and levy of assessments for satisfaction of bonded indebtedness. TRANSFER OF ASSETS AND ASSESSMENT FOR 1999: ~' On August 6, 1998, Mr. John Dix of the District brought a check to the city for all monies accumulated by the District for the payment of the bonds and the interest accrued. A total of ' $18,641.25 was deposited to the City account for the payment of the bonds, interest and reserve. The amount received from the District will pay for the first payments of bonds and interest which are due November 1, 1998. In order to assure the continued flow of money from the District to pay for the interest and principal of the bonds, it is necessary to assess the homeowners on an annual basis. In 1999, the amount of principal and interest due is $5,000 and $5,670, respectively. In addition, 10% is collected to set aside as a reserve for any nonpayment of assessments. The amount of the reserve for this year is $1,067. Each homeowner assessment will be a total of $1,067, which includes $454.55 for principal, $515.45 for interest and $97.00 for the reserve. This amount must be assessed now to receive payment in early 1999. Upon acceptance, staff will mail not}fications to homeowners in Pleasant View Estates concerning assessment and also to Tulsa County Treasurer for actual assessment. RECOMMENDATION: Staff recommends Council authorize notice, equalization and levy of assessments against properties within the District sufficient to pay the interest, principal and reserve due on the outstanding indebtedness represented by the District Bonds. The capacity of such Sewer System exceeds that which is required to serve the property of the District and the lands within the boundaries of the District, referred to above. The obligation of the City for such assumption as provided in §898.4 shall be "~ limited to assumption of the responsibility and obligation for the management and maintenance of the Sewer System and the assessment of the properties within the District for amortization and satisfaction of the bonded indebtedness, as provided herein. 2. Connection of Additional Sewer Systems. Whenever and as often as the owner(s) ~ of any property (referred to herein as an "Expansion Property") within the Drainage Area shall make application to the City for the connection of a sanitary sewer system serving such Expansion Property (referred to herein as the "Expansion System") to the Sewer System, such connection shall be in accordance with the then existing design and construction criteria applicable to privately- funded public improvements for the City or for the Owasso Public Works Authority. 3. City's Covenants and Agreements. The City will, until the indebtedness represented by the District Bonds is fully amortized and satisfied, obtain from the County Assessor of Tulsa County, Oklahoma, on or before the 15th day of May in each year during the term hereof, the assessment book described in §887 of the Act, containing the information specified in such §887, whereupon the City shall immediately give notice thereof and of the time the Council, acting as a Board of Equalization, will meet to equalize assessments, in compliance with the provisions of §888 of the Act. Thereafter the Council shall, in accordance with the provisions of §§ 889 and 890 of the Act, equalize and levy such assessments against the properties within the District sufficient to pay the interest and the principal amounts due on the outstanding indebtedness represented by the District Bonds, sending notice of the nature and amount of such assessments on or before the 1st day of June of each year as provided in §890 of the Act and duly ' certifying to the County Treasurer of Tulsa County, Oklahoma, no earlier than the 1st day of July and no later than the 10th day of July of each year, the amount of taxes levied upon the lands within _ the District. (2) Application of Funds Collected by Assessments. All such funds ,~,,, collected or received by the County Treasurer and paid to the City pursuant to the provisions of §890 shall be applied wholly to the amortization and satisfaction of the indebtedness represented by the District Bonds, in accordance with the provisions of the Bond Resolution adopted by the District on Apri12, 1996 (a copy of which is appended hereto as "Attachment 4"). B. Acceptance of Expansion System(s). The City may, pursuant to the terms and conditions hereof, accept the Expansion System(s) as part of the sewer system of the City, ^~ permit the connection thereto, and receive and dispose of sewage through such systems, subject to the payment of the City's charges for such services as are imposed by ordinance and by applicable ~ state law. C. Recovery of Costs of Construction of Excess Capacity. (1) Collection of Costs of Construction of Excess Capacity. The City will, during the term hereof, require any owner(s) intending or desiring to connect to or extend the Sewer System by the construction and connection of any Expansion System(s) thereto to pay to the City the recoverable cost of the construction of such excess capacity of the Sewer System at the rate of $1,338.58 per acre for the entire aggregate area served by such Expansion System, and the City will collect such sums prior to permitting such connection of any Expansion System to the Sewer System or to any previously connected Expansion System. Upon the receipt of such funds collected by the City pursuant to the provisions of Subparagraph 3.C.(1) above, the City shall promptly call for payment such of the District Bonds as have the next maturity dates following such receipt of funds and total in the aggregate (together with all then unpaid interest thereon) an amount not exceeding the amount of such funds received by the City, and upon presentation of such Bonds shall promptly pay the principal amounts due thereon, together with such interest as shall be due and ' unpaid as of the date of payment, to the holder(s) thereof. 4. Further Covenants, Agreements and Assurances. The parties further covenant and agree as follows: A. Term of Agreement. Unless sooner terminated by the satisfaction of the indebtedness represented by the District Bonds, the term of this Agreement shall run from the date of acceptance by the City of the Sewer System, until the expiration of twenty-one (21) years. B. Limits of Collection by Expansion System Owner(s). Owner(s) of Expansion Systems within a higher elevation in the Drainage Area shall only be entitled to payment for excess capacity constructed by them, if such payment is in addition to the payments herein provided for, until the indebtedness represented by the District Bonds has been paid in full. C. Additional Connections by City. The City shall have the right to make such connections and cross-connections as it may deem necessary for the proper management and ' utilization of the Sewer System and any Expansion Systems as integrated parts of the City's sewerage system. ~ D. No Obligation by City to Provide Service. Nothing herein shall be construed to obligate the City to give or continue to give sewer service to any person or entity, or ' to any particular tract of land, other than the properties within the District, except in accordance with its ordinances, regulations or sewer service charges as are now in effect or may hereafter be adopted. ~ E. Binding Effect. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors and assigns. Contracts for the purchase of those buildings by the City and the OPWA will be considered at the September 1, 1998 meetings.. Before contracts are approved, budgeted funds must be available. Both ~ purchases will be funded from the General Fund unappropriated fund balance. ~ The Health Department is proposed to be purchased by the City General Fund, General Government Department budget. A budget supplement of $80,000 to that department is requested. ~, The PSO building is proposed to be purchased by the OPWA Fund, Administration Department budget funded by a transfer from the General Fund. A budget supplement and authorization to transfer $375,000 to the OPWA is requested. RECOMMENDATION• Staff recommends Council approval of a supplemental appropriation to the General Fund increasing expenditures in the General Government Department by $80,000 and increasing the transfer to the OPWA Fund by $375,000 and authorization for the transfer. CITY OF OWASSO FROM: JEFF HANCOCK '~ CITY MANAGER SUBJECT: PURCHASE OF THE TULSA CITY-COUNTY HEALTH DEPARTMENT BUILDING AT 315 S CEDAR DATE: August 28, 1998 BACKGROUND: ~ During the transition between city managers I had the privilege of meeting with Mr. Gary Cox and Mr. Glenn Burnett of the Tulsa City-County Health Department. At that time we t communicated that the City of Owasso wished to purchase their building at 315 S Cedar. While a previous appraisal in 1996 had indicated the value of the building to be $77,000, a recent Tulsa City-County Health Department appraisal indicated a value of $105,000. The Board of Health '~" met on June 24, 1998 and authorized the attached letter confirming their staff's communication that the Board could accept no less than the 80% of appraised value ($105,000.00) or a selling price between $84,00 and $91,000. We commissioned our own appraisal and received information that the value of the building was $80,000. I again met with both Mr. Carter and Mr. Burnett on Friday July 17,1998 to discuss our concerns over the original price suggested by the Health Board and the results of our appraisal. On July 22, 1998 I met with the full Tulsa City-County Health Board and communicated our desire to purchase the building at a price 80% of the average of our appraisal and the Tulsa City- County Health Board's appraisal or $74,000. Attached is the response from the Board offering the building to the City of Owasso for $79,900. On August 4, 1998 the Owasso City Council authorized the City Manager to accept the proposal from the Tulsa City-County Health Department. Attached is the Contract for Sale for the purchase of the building and property. Upon approval hereof by both Purchaser and Seller, which shall not be later than thirty (30) days from date, a valid and binding contract of sale between the seller and purchaser shall exist, the terms of which are as follows: The total purchase price is Seventy-nine Thousand Nine Hundred Dollars ($79,900), payable as follows: Five Hundred Dollars ($500) hereinafter receipted for, and Seventy- nine Thousand Four Hundred Dollars ($79,400) in cash payable upon delivery of deed as herein provided. Upon closing, the deed will be placed in escrow for up to fifteen (15) days with an escrow agent mutually acceptable to Purchaser and Seller. Within said fifteen (15) days, Purchaser shall pay in full the balance of the purchase price and receive the General Warranty Deed to the property. THE FOLLOWING CONDITIONS ARE TO APPLY TO THIS SALE: Seller within ten (10) days after approval of this contract shall furnish purchaser an abstract of title certified to date, showing a good and merchantable title in the Seller, subject to easement, building restrictions of record and the above mortgages and liens, if any. Purchaser shall have ten (10) days thereafter in which to have the abstract examined and furnish Seller notice in writing of any objections thereto. In the case of valid objections to the title, Seller shall have thirty (30) days or such additional time as may be agreed to in writing to meet same. In the event the title cannot be perfected, or Seller does not approve this contract, the above part payment on the purchase price shall be returned to the purchaser and this contract shall be of no further force and effect. ~ 2. If no objections are made within the time above specified or, if made, when same have been met, as above provided, Seller shall deliver a properly executed general ' warranty deed conveying the above property to Purchaser upon payment of the balance of the purchase price in the manner herein above provided. - ' 3. If, after the Seller has performed its part of this contract furnishing abstract showing title, as herein provided, the purchaser fails to make any further ~ payments or perform any other condition required of it by this contract within five (5) days thereafter; then all the money heretofore paid on the purchase price, as aforesaid, shall at the option of the Seller be retained as such as liquidated damages for the breach of this contract by Purchaser; and the parties hereto agree ~ that said amount is a reasonable amount for such damages, and that from the nature of the subject matter it would be impractical and extremely difficult to fix ~ that actual damage. 4.
