12. Consideration and Appropriate Action Relating the Acceptance of a Sanitary Sewer
Easement.

The staff will recommend that the City Council accept and approve the sanitary sewer
easement from Hayward and Betty Smith, and authorize the Mayor to execute the document
on behalf of the City of Owasso.
13. Consideration and Appropriate Action Relating to Resolution #97 -04, a Resolution
Approving the Incurring of Indebtedness by the Tulsa County Criminal Justice Authority
in an Amount Not to Exceed $70,000,000.

The staff has reviewed the requested resolution and notes that Oklahoma Statutes require
the approval of the beneficiary before a public trust may incur debt. In this case, there are
eleven beneficiaries, therefore eight must approve the incurring of this debt prior to the
Trustees taking action to issue bonds. The staff will recommend City Council adoption of
Resolution #97 -04. 1

MINUTES OF REGULAR MEETING
Tuesday, January 7, 1997
The Owasso City Council met in regular session on Tuesday, January 7, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 3, 1997.

ITEM 5: READING OF MAYOR'S PROCLAMATION.
Mayor Ewing read and presentation a proclamation to Lorrie Dozier, owner of Dozier Printing,
naming them as Business of the Quarter for the first quarter of 1997. Ms Dozier introduced
members of her family and staff who were present.
ITEM 6: REQUEST APPROVAL OF THE MINUTES OF DECEMBER 17 1996
REGULAR MEETING.
Mr Ramey moved, seconded by Ms Bamhouse, to approve the minutes as submitted, by
reference made a part hereto.

ITEM 7: REQUEST APPROVAL OF THE CLAIMS.
Mr Helm questioned the police department overtime. Mr Ray said there are some officers still
on light duty because of injuries and two new officers who just started working and are still
training. Mr Ramey moved, seconded by Ms Barnhouse, that the following claims be approved
as submitted: (1) General Fund $30,789.38; (2) Workers Comp Self -Ins $515.20; (3) Ambulance
Service Fund $1,079.74; (4) E -911 $1,844.21; (5) City Garage $4,740.63; (6) Capital
Improvements $33.77; (6) Payroll $114,763.54; (7) City Garage Payroll $2,313.66.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
AGREEMENT BETWEEN THE HAAS - EDISON FAMILY AND THE CITY
OF OWASSO. THE ACCEPTANCE OF A SANITARY SEWER EASEMENT.
AND AUTHORIZATION FOR THE MAYOR TO EXECUTE SUCH
DOCUMENTS.
Mr Cates said that there have been ongoing negotiations over the last several weeks with
representatives of the Haas - Edison family for purposes of securing a twenty -foot permanent
sanitary sewer easement, with temporary working space adjacent to that easement. The
easement is needed for the construction, location, operation and maintenance of a sanitary sewer
for the ONG Workstation being constructed at 96th St N and Garnett Rd. An agreement was
presented which spoke to annexation/zoning, development, and easement stipulations for the
property. Mr Ramey moved, seconded by Ms Barnhouse, to approve the proposed agreement
between the Haas - Edison family and the City of Owasso, to accept and approve the sanitary
sewer easement, and to authorize the Mayor to execute the necessary documents on behalf of
the City of Owasso.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
' REQUEST FOR COUNCIL APPROVAL OF A FINAL PLAT FOR
BRENTWOOD PARK, AN ADDITION TO THE CITY OF OWASSO, TULSA
COUNTY, OKLAHOMA.
The City of Owasso has received a request to review the final plat for Brentwood Park. The
subject property is located east of the existing Brentwood Estates subdivision and contains 20
single family lots on 8.41 acres, more or less. The plat has been reviewed by the Technical
Advisory Committee and the Planning Commission, with both bodies recommending approval.
Mr Ramey moved, seconded by Ms Barnhouse, to approve the final plat for Brentwood Park.

' ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND SANITARY
' SEWER SYSTEMS CONSTRUCTED TO SERVE BRENTWOOD PARK, AN
ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, OKLAHOMA.
Public Works personnel have conducted a final inspection of the water and sanitary sewer
r systems serving Brentwood Park, with no deficiencies being noted. A confirmation letter
approving the construction permits has been received. One -year maintenance bonds have been
provided and will become effective upon acceptance of the infrastructure. Mr Ramey moved,
seconded by Mayor Ewing, to accept the improvements to the water and sanitary sewer systems
constructed to serve Brentwood Park.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF BID FOR ONE UHF BASE STATION /REPEATER AND
INSTALLATION, AND A SUPPLEMENTAL APPROPRIATION TO THE
GENERAL FUND'S STREET DEPARTMENT TO FUND THE PURCHASE.
On December 3, 1996, the City Council authorized the solicitation of bids for a 100 watt
continuous duty programmable repeater capable of handling the volume and type of radio traffic
for Public Works, Community Development and Parks Departments. Bid documents were

prepared and mailed to three vendors and an advertisement placed in The Owasso Reporter.
Two bids were received and opened on December 20, 1996. One bidder, Total Radio, did not
supply sufficient information on the transfer /charger portion of the bid to determine if the
charger met the specifications. Because of questions relating to the charger, that item was
removed from the bid proposal. Total Radio's bid was $8520 (including the charger, which they
did not bid separately as requested), and Ericsson Inc submitted a bid of $8316 (with the
removal of the charger). Staff also was not convinced that the model bid by Total was the latest
state -of -the -art equipment as required by the specifications. Mr Ramey moved, seconded by Ms
Barnhouse, to award the bid for the purchase and installation of one UHF Base Station /Repeater
to Ericsson Inc, Oklahoma City, OK in the amount of $8316, and authorization for payment
upon successful completion of the installation.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR A CONTRACT EXTENSION FOR MAINTENANCE TO THE
CITY'S STORM SIRENS.
The City Council awarded a contract to Goddard Enterprises for preventative maintenance to the
city's storm sirens for fiscal year 1995 -96. The contract expired on June 30, 1996 and, due to
an oversight, has not been extended. Goddard Enterprises performed to the contract standards
during FY95 -96, and the staff believes the maintenance program should be continued with an
extension of the contract. The vendor has agreed to continue the maintenance program during
FY96 -97 for the same terms and conditions as were contained in the original contract. Mr
Ramey moved, seconded by Mr Helm, that the contract with Goddard Enterprises for
preventative maintenance to the City's storm sirens be extended for the 1996 -97 fiscal year, and
that the Mayor be authorized to execute the document.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
APPLICATION FOR THE METROPOLITAN TULSA HOME CONSORTIUM
FY96 OWNER- OCCUPIED HOUSING REHABILITATION PROGRAM.
' Mr McElrath has prepared a Request for Proposal to submit to Tulsa County for funds that are
available for no- interest or low- interest loans to qualifying low- income homeowners for
rehabilitation projects. The proposed target area is the older part of the city that is bounded on
the north by 86th St N, on the south by Fifth Ave, on the east by Highway 169, and on the west
by Carlsbad Ave. First Bank of Owasso and RCB Bank have agreed to provide "lender
participation ", which indicates that they will be willing to give serious consideration to the
provision of second mortgages to rehabilitation applicants who require more than the maximum
amount of a rehabilitation loan. Mr Ramey moved, seconded by Mr Helm, that application be
made to the Metropolitan Tulsa HOME consortium for the Owner - Occupied Housing
Rehabilitation Program and that the Mayor be authorized to execute the necessary documents.

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
' RESOLUTION #97 -02, A RESOLUTION AMENDING RESOLUTION #86 -16
WAIVING BUILDING PERMIT AND INSPECTION FEES FOR BUILDING
PERMITS INVOLVING THE USE OF FEDERAL /STATE GRANT FUNDS.

Under Item 13, the City Council approved application to the Tulsa Metropolitan HOME
Consortium for funds to be used for low- interest or no- interest loans to low income citizens of
Owasso for owner - occupied housing rehabilitation. One of the ways that the City of Owasso
can assist potential participants in the program is to waive building permit and inspection fees
associated with remodeling and /or home improvement. The current fee schedule was adopted
by resolution in 1986 and needs to be amended to contain language that would permit the waiver
of permit and inspection fees when associated with a local, state or federal rehabilitation grant.
Resolution #97 -02 would add the necessary language to allow that waiver. Mr Ramey moved,
seconded by Mr Helm, to adopt Resolution #97 -02.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #97 -03 A RESOLUTION CALLING A NON - PARTISAN
PRIMARY AND GENERAL ELECTION PURSUANT TO PROVISIONS OF
THE OWASSO CITY CHARTER FOR THE PURPOSE OF ELECTING
COUNCIL MEMBERS FOR WARDS 1 & 2.
The Owasso City Charter provides for the Council to take action by Resolution to call any
necessary Ward elections. Such elections are needed for Ward 1 & 2 (three year terms).
Resolution #97 -03 calls for an election to be conducted for these Wards and allows for
notification to the Tulsa County Election Board. The filing period will be February 3, 4, & 5,
1997, with a primary election held on March 4, 1997. If a general election is necessary, it will
be held on April 1, 1997. Mayor Ewing moved, seconded by Ms Barnhouse, to approve
Resolution #97 -03.

ITEM 16: REPORT FROM CITY MANAGER
Mr Ray introduced Eric Mikel, who has recently been employed as Engineering Technician.
He also briefly discussed a letter that was being prepared to be sent to the Owasso School Board
suggesting a time for a joint meeting. The City's computers have been down for several days
and it may take some extra work to get payroll out. Mr Ray recognized three former mayors
of Owasso who were in the audience, Mr Groth, Mr Randolph, and Mr Duke.
ITEM 17: REPORT FROM CITY ATTORNEY
No report.
ITEM 18: REPORT FROM CITY COUNCILORS
Mr Helm requested asked about the status of a financial impact study on an electrical ordinance.
Mr Ray said that it was in progress and that he would try to get an update in the next City
Manager's Report. Mr Helm also asked about the time frame relating to the YMCA expending '
$250,000 on upgrading the Recreation Center. Mr Cates will look at the agreement with the
YMCA and determine what that time frame is.

RESOLUTION #97 -01, A RESOLUTION PROVIDING NOTICE OF A
PROPOSED CHANGE TO THE CITY OF OWASSO WARD BOUNDARY
MAP.
Resolution #97 -01 provides for the calling of a Special Meeting of the Owasso City Council to
consider the adoption of an ordinance, with an emergency clause, that would change the
boundaries of Wards 1 & 2 of the City of Owasso Ward Boundary Map. A small tract of land
to the east of Bailey Ranch Estates would be removed from Ward 2 and placed in Ward 1 if the
ordinance is adopted. Resolution #97 -01 calls for the Special Meeting to be held at 7:30 a.m.
Monday, February 3, 1997 in the Owasso City Hall Lower Level Conference Room.

SUBJECT: REQUEST FOR AUTHORIZATION OF A CITY INTERNET SITE
DATE: January 16, 1997
BACKGROUND:
Several months ago, the city manager was contacted by Mr Lee Thompson of "Internet Creative
Services ". Mr Thompson expressed his interest in assisting the city with setting up its own Internet
site. Mr Ray forwarded him to my office for further discussion of the possibilities.
This request is the culmination of several months of research and discussion between myself, Mr
Lee Thompson, Ms Angela Henderson (Director of Owasso Economic Development), Mr Jim
Rardin (proprietor of A HOME PAGE), and Mr Dwight Lewton (proprietor of Business Product
Services).
GENERAL INTERNET INFORMATION:
Basically, the Internet is an extremely large network of connected computer systems. Just like its
smaller cousins, local area networks (used in many small offices to connect individual employee's
computers), it can be used for electronic mail between individuals, sharing work, scheduling work,
and dissemination of information of nearly any kind. The Internet had humble beginnings as a
simple network used to connect military computer systems within the United States. It was then
called DARPANET and was not open for use by anyone but military personnel. Within a few
years, several universities and scientific organizations involved in military related research were
added to the list of computer users with access to specific portions of this growing computer
network. The value of the new data connections between research institution's computer systems
soon became apparent and the Internet was born.
The newly opened Internet communications standards made access available to nearly every
researcher with a computer system and the proper programs. In the following years, major
universities, other government organizations, and the scientific research community established
computer connections through the telephone company's lines to access and share information with
those organizations already connected to the Internet. Although the Internet was soon burgeoning
with available information, it was all in the form of computer files that had to be transferred
between systems through the use of complicated computer commands. This complexity kept its use
limited to sophisticated "technical types" and their associates.
Approximately four years ago, several college students majoring in computer science recognized the
"complexity issue" and began writing custom computer programs to allow easy access to computer
files. Their solution was to create standards for displaying computer files as pages in a book that
could easily be accessed at will. Somebody decided to call this new method of access "browsing the
WEB ". (The WEB is intended as a metaphor depicting each strand of a spider's web as a
communication wire and each intersection of the spiders web as a connected computer). The new
WEB tools that were subsequently developed made access to the Internet relatively easy for nearly
anyone with a computer system and a telephone connection.
The current and most commonly used computer programs for utilizing the WEB, electronic mail,
and group discussions /conferences are very simple to learn and operate. Although the Internet and
Internet access methods are still evolving, access is now readily available to nearly anyone at a
reasonable price (it is free at most public libraries). The amount of information available through
this network is currently growing at a fantastic rate as is the number of individuals utilizing the new
Internet tools to find information they want.
Government organizations, large and small, have found the Internet a very inexpensive tool for
making up -to -date information available to businesses and the general public at large. Businesses
are beginning to recognize that they can efficiently accomplish research for relocations, business
law, tax information, demographics, etc. with this new tool. Individuals are also recognizing
functions involving a myriad of uses from communicating with friends all over the world to
researching treatment for a disease to making airline reservations and checking the weather forecast
for their destination.
PROPOSED OWASSO INTERNET SITE:
Over the past ten or more years, the City of Owasso's staff has taken pride in its openness and
willingness to share information with its citizen /customers. A major obstacle to this open policy is
the city's associated cost for assembling, publishing, and continuous distribution of information on
events, meeting agendas, policy changes, who to call lists, etc. The local newspaper has been very
helpful and dependable in its coverage of city business, but much of the information people
frequently need does not change very often and therefore is not worthy of weekly news space (such
as "Who do I call about a pothole ?" or "Who is my council representative ? "). An Internet WEB
site and its associated informational pages would allow public access to such material on an as
needed basis. Additionally, economic development contacts could readily be attracted to the City
through information supplied on the site.
Several components are necessary to implement a WEB page or site. First it is necessary to either
(1) purchase the proper computer equipment, computer programs, and Internet data connections or
(2) rent data storage space on a computer system already configured and connected to the Internet.
Mr Dwight Lewton, owner of Business Product Services in Tulsa and an Owasso community
resident, has offered the City sufficient data storage space and e-mail addresses on one of their
"Internet connected" systems free of charge. The second necessary component is an Internet
address so others can access any stored information through their own Internet connection. This
address is supplied through InterNIC (Internet Network Information Center) and is analogous to a
computerized Zip +4 code. If this proposal is approved, registration of the City Internet site
owasso.ok.us (and its assigned Internet Protocol address) will be requested through InterNIC.

After the electronic distribution site is established, the WEB "pages" must be properly designed,
a -,
built, and installed on the site. A well designed WEB home page should be useful and attractive
because many times, it is the viewers first contact with the site's proprietors. It requires talent in
several disciplines to properly assemble and maintain a distinguished WEB site. Rates for
professional site developers generally range from one hundred to several thousand dollars per hour.
Mr Jim Rardin of "A HOME PAGE" in Tulsa has proposed a private /public partnership with the
city. He and his associate, Mr Lee Thompson, have offered to develop an Internet WEB site for
City government purposes at no cost to the City. If Mr Rardin's agreement is accepted, they
propose to develop a subsequent community/commercial site linked to the City's WEB pages. It is
assumed, the community /commercial site will generate some of the revenue "A HOME PAGE"
requires to maintain operations.

Agreement are attached for your review.
COST:
By utilizing a private /public sector partnership concept with "A HOME PAGE" for the site's
development and maintenance and accepting the donation of computer time and space from Mr
Lewton, it appears that the cost to the City will be minimal. The staff research indicates initial cost
will include approximately $100 to register two names with InterNIC (owasso.ok.us and
owasso.com), approximately $150 in legal fees to ensure one of the Internet names (owasso.com)
will be available, and an initial Internet address for City Hall at approximately $75. Ongoing cost
should not exceed approximately $20 per month for the telephone access to the Internet provider.
In summary, the initial cost should not exceed $350 and monthly expenses should be approximately
$20. Funding for this and other unanticipated small expenses is available in the adopted 1996 -97
budget through existing appropriations.
RECOMENDATION:
There are several distinct advantages to the City attaining an Internet WEB presence. Assuring the
availability of timely information for the citizen/customer and the possibility of economic
development opportunities that may not otherwise exist are first and foremost. Through the use of
donated Internet server space and a public /private partnership, the City has the opportunity to
acquire such a presence at minimal cost. Therefore, it is recommended the City Council approve
the request to establish an Internet site, and approve the request for an agreement between the City
and a company that has offered to develop the web site without expense.

The following document constitutes an agreement between A HOME PAGE (hereinafter,
_ AHP) J C Rardin, proprietor, and the City of Owasso, Oklahoma (hereinafter, City). This
agreement involves the development of an Internet web site for the City and subsequent
development of a community/commercial web site.
City Web Site Development
AHP agrees to develop an Internet web site for City government purposes at no cost to the
City. The content of each page will be determined by agreement of the City and AHP. The
' City shall retain final authority over the specific contents of the pages of the City web site.
AHP agrees to provide for the development of the original 25 page City web site. (Each
web site page shall consist of one (1) hypertext mark -up language (HTML) document
which may be more or less than one 8 1/2 x 11 inch typed page). AHP further agrees to
' develop links from the City web site to a community/commercial web site. AHP shall
provide links from the community/commercial web site to the City web site.
AHP agrees to maintain both the City web site and the community/commercial web site at
no cost to the City. Said maintenance agreement shall remain in effect for no less than 12
months unless agreed upon in writing or in accordance with any other clauses of this
agreement.
Minor changes and corrections to pages will be made by AHP at no charge to the City.
Major changes, revisions, and additions to City pages will be made by authorized City staff
and specific Owasso Public School teachers (and students under their supervision).
Control over the content of such City pages shall remain with the City. AHP shall update
on a weekly basis the publicly viewed Internet web site with the changes made by the
authorized City staff and the School(s).
1 AHP reserves the right to limit the number of additional pages added to the City web site
dependent upon usage and traffic. Links to web sites maintained by the Owasso Public
Schools shall be provided from the City web site at no additional charge.

Commercial Web Site Development I
AHP shall develop a community/commercial web site for the publication of non -
government related information and advertising for Owasso, Oklahoma area businesses, '
associations, non - profit organizations, and other non - government entities. Fees shall be
charged for various levels of participation. The right to all such fees shall remain with
AHP. Community/commercial web site shall include, but not be limited to, a directory of '
area businesses and organizations. AHP shall retain the rights to all such directory data.
AHP will maintain the community/commercial web site and may charge fees for these
services accordingly.
Community/commercial web site shall be linked directly to the City web site. All
community/commercial web site data shall be housed on a site other than the City web site.
AHP shall provide for all the setup, maintenance, advertising, marketing, billing, and office
related expenses of developing and maintaining the community/commercial web site. AHP
shall be responsible for the contracting or employment of staff as it deems necessary.
The City recognizes AHP as the "authorized ", Internet "web site developer ", "presence
provider ", or "consultant" for the City of Owasso.
This agreement shall continue in effect for twelve (12) months following the date below and
is renewable upon agreement of both AHP and the City. AHP or the City may terminate
this agreement, with cause, on thirty (30) days written notice.

A Rich History... A Promising Future
At the turn of the century, the Atchison, Topeka, and Santa Fe Railroad line ended in a
field several miles northeast of Tulsa. As the land around the end of this railroad
developed, the Osage Indian Word — Owasso, meaning "the end" or "turnaround" — was
adopted to identify the area. Owasso formally became a town under laws of the Indian
Territory in 1906 and was chartered as a city September 28, 1972.
The population of Owasso remained at just a few hundred people until the end of World

The Owasso Economic Development Authority
The Owasso Economic Development Authority (OEDA) is a dynamic team of local
professionals with a broad range of expertise in economic development. Founded by a
Declaration of Trust in September, 1987, the OEDA is a public trust formed under and
pursuant to Title 60 Oklahoma Statutes 1971 Sec. 176 et. Seq., with the City of Owasso as

January 16, 1997
Owasso First Assembly of God, Inc., has submitted to the City of Owasso a petition for
annexation of property located south of the southeast corner of E. 96th Street North & N. 129th
E. Avenue containing 8.90 acres, more or less. The subject property is described as Lot One
(1), Block One (1) of Owasso Assembly of God, and contains the Owasso First Assembly of
God church. A subject map is attached for your information and review.
The subject property is currently zoned AG (Agriculture) and would remain zoned AG upon
annexation pending any rezoning application. The Zoning Code allows for the City Council to
annex and rezone property under one ordinance if the property has been given previous zoning
in Tulsa County, however in this case, AG is also the established zoning in the county.
Churches, described as being a Use Unit 5 in the Owasso Zoning Code, are required to operate
via Special Exception in zoning districts other than OM (Office Medium) and any commercial
zoning. The subject property did go through this process with Tulsa County and obtained a
Special Exception several years ago. If annexed, the Owasso First Assembly of God church
would be a "pre- existing non - conforming" use, thus allowing the church to continue to operate
at that location, provided that there is no expansion or increase in size /area. If the applicants
desire to expand their facility, they would first need to rezone to either OM (Office Medium)
or a form of commercial (Note that any form of commercial zoning would not be supported
by staff), or process a Special Exception request through the Board of Adjustment. It is staff's
understanding that the applicants want to pursue OM zoning upon annexation.
' The Technical Advisory Committee reviewed the annexation request at their January 2, t997
meeting. At that meeting, staff and area utility companies were present to offer comments on
the annexation request. No comments opposing the annexation request were voiced at that
meeting.

Copies of the City of Owasso's annexation policies and procedures are attached for your
information and review. The subject property would appear to meet all requirements with the
exception of tract size as properties of larger than 20 acres are preferred. Staff feels that this
requirement was directed more at undeveloped property however, and annexation of this
property would not be detrimental.
The Owasso Annexation Committee reviewed the annexation request at their January 9, 1997
special meeting and unanimously approved the annexation request. A copy of the minutes from
that meeting are also attached for your information and review. Please note that Chief Allen
made the Annexation Committee aware that the Owasso Fire Department does not possess the
manpower or equipment to fight a fully engulfed fire at this facility. However it was also noted
that the ability to fight fires at similar facilities currently within the city is limited and because
this facility is within our responding area, regardless of annexation, the Owasso Fire Department
would be the responding agency.
The notice for annexation was published in the January 2 and January 9, 1997 additions of the
Owasso Reporter for Planning Commission action and January 16, 1997 Owasso Reporter for
Council action.
RECOMMENDATION:
Staff recommends approval of the annexation request.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the r
lowest zoning classification, that is,_ AG, agricultural.
Landowners may then petition for rezoning if they desire
further development of their .property. All legal uses annexed �
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5- Where a city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation for a six month period after
rejection by the City Council.

3. Owasso First Assembly of God, Inc. - An approximate 8.90 acre tract located south and
' west of the southwest corner of E. 96th Street North and N. 129th E. Avenue described
as Lot One (1), Block One (1), Owasso Assembly of God. The subject property contains
the Owasso First Assembly of God church.

Mr. Rooney presented the annexation item. Chief Allen commented on current fire
fighting abilities in the area of the Owasso First Assembly of God, as well as water
pressure. Currently, the ability of the fire department to fight a fire at that facility is
limited, however it is currently the fire department's responsibility to fight a fire at that
area.
Mr. Ray reviewed that the city would have no increased liability if this property was
annexed. Furthermore, ISO ratings could go up or down in the city whether or not the
church was annexed, due to the random selection process that exists when they perform
ISO visits and the fact that are abilities to fight fires at other structures currently within
the city limits are limited too.
With no further comments, Bob Allen motioned, seconded b Charles Willey, '

recommend approval of the annexation request to the Owasso Planning Commission.
The motion carried 8 -0.

BACKGROUND:
The City of Owasso has received a request from A & W Development for the closing of public
right -of -way located within Section 6, Township 21 North, Range 14 East of Tulsa County. The
general location of the proposed closing is north and west of the northwest corner of E. 116th
Street North and Garnett Road and would be contained within the proposed Country Estates II
property.
The request involves right -of -way that is defined as a "paper street" because the proposed right -
of -way to be closed exists in paper form only and does not exist physically at the site. A copy
of an area map, with the right -of -way to be closed highlighted, is attached for your information
and review. As you can see, this right -of -way is located throughout much of what is proposed
as Country Estates II (North and west of Country Estates). A physical review of the area
indicates that no street exists in this area.
The Technical Advisory Committee reviewed the request at their January 2, 1997 meeting. No
comments and /or concerns regarding the right -of -way closing were expressed at that meeting.
The Owasso Planning Commission unanimously recommended approval of the request at their
January 14, 1997 regular meeting. Staff has no objections to the closing of the right -of -way.
If the closing of the right -of -way is approved by the Council, an Ordinance formally adopting
the closing actions will be presented to the Council at your February 4, 1997 regular meeting.
RECOMMENDATION:
Staff recommends Council approval of the right -of -way closing request.

BACKGROUND:
' The Owasso Public School system has received money from a DARE grant again this year.
Marvena Johnson (with the public school) has requested authorization to donate audio - visual
equipment to the Owasso Police Department.
1 The donation includes a new Emerson 19" color TV /VCR combination valued at $330, one
Apollo Cobra overhead projector valued at $380, and one Magnavox VHS Camcorder valued
' at $290. The total value of the donation is $1000.
Last year, the Owasso Police Department received a new computer system through this grant
program. It is through our involvement in the DARE program that the department is qualified
to receive this equipment. The equipment listed is used primarily for conducting the DARE
curriculum, however, when not is use for DARE, it can be used by the Owasso Police
' Department in public relations programs and internal training.
There is no cost to the City to receive the equipment and no reporting requirements of the
' department through the grant application. All equipment will become the property of the City
of Owasso and will be shown on the fixed asset record for the Owasso Police Department.

RECOMMENDATION:
' The staff recommends Council acceptance of the equipment to be donated by the Owasso School
System, valued at $1000.

BACKGROUND:
January 16, 1997
As you are aware, Mr. Ron Cates and I have been involved in acquiring sanitary sewer line
easements necessary for construction of infrastructure for the Oklahoma Natural Gas Work
Station. Mr. Cates presented an easement agreement between the Haas- Edison family and the
City of Owasso at the January 7 City Council meeting, and approval was given for the mayor's
signature of the agreement and easement.
An easement has been successfully negotiated with Hayward and Betty Smith, owners of the
above - described property, just to the east of Garnett Road and the Haas - Edison tract. The
Smith's have agreed to grant the easement, which includes a 20 foot permanent easement and
an additional 20 foot temporary construction easement.
Granting of this easement would allow the Owasso Economic Development Authority and
Yocham Enterprises, contractor for the ONG Roadway and Utility Improvements Project, to
begin construction of the project.
RECOMMENDATION:
Staff recommends acceptance by the City Council of the sanitary sewer easement on the Smith
property and that authorization be given to the Mayor of the City of Owasso to execute such on
behalf of the City.

INCURRING OF DEBT BY THE TULSA COUNTY CRIMINAL
JUSTICE AUTHORITY (JAIL AUTHORITY)

BACKGROUND:
' In 1995, the Tulsa County jail system came under fire from federal officials in the Department
of Justice. The focus of the Department of Justice was centered on facilities and operations,
' with an emphasis placed on crowded and inadequate facilities. As a result of a federal
inspection, the U.S. Department of Justice issued an order requiring Tulsa County to comply
with specific goals and deadlines agreed to by both parties. In order to comply with the order,
' County officials believed that a new jail facility would be needed. Additionally, it was the
County's position that a new, properly designed facility could be operated more efficiently at
less cost per prisoner.
'
Subsequently, the Coun asked for input from the cities and towns within the county. After

much debate and discussion, the framework for an eleven - member public trust was developed.
r The Trust as proposed would be comprised of eleven members and include Tulsa County, City
of Tulsa, City of Broken Arrow, City of Sand Springs, City of Owasso, City of Jenks, City of
' Bixby, City of Collinsville, City of Glenpool, Town of Skiatook, and Town of Sperry.
Upon consensus agreement among the eleven governmental entities concerning the proposed
' Authority's make up and duties, the focus of their effort was directed toward financing the new
jail facility. A county-wide sales tax was proposed and, on September 12, 1995, the voters of
Tulsa County approved an additional sales tax for the construction and operation of a new jail
facility.
In October 1995, the Tulsa County Criminal Justice Authority was officially created. On
October 17, 1995, the Owasso City Council adopted Resolution #95 -12, a resolution notifying
the County that the City of Owasso would accept beneficial interest in the Authority immediately
upon the City being named as a beneficiary of the TCCJA. In November, appointments to the
Authority were made and Owasso's Mayor was named to one of the three "seats" reserved for
mayors of the nine cities and towns (other than the City of Tulsa) in Tulsa County.

In November 1995, the Authority began meeting and initiated the process of providing Tulsa
County with a new jail facility. Mayor Ewing currently serves as a member of the TCCJA.
On Friday, January 10, 1997, the Authority voted to authorize its staff and consultants to begin
the process of issuing revenue bonds in an amount not to exceed $70,000,000. The bonds are
to be "Revenue Bonds" of the Authority, backed by the revenue of the dedicated sales tax passed
in September 1995. The actual size of the bond issue will be finalized on or about February 11
when bids for the jail construction are opened. It is anticipated that the actual amount will be
approximately $66,000,000. The $70,000,000 cap was established to allow for flexibility should
the bids be higher than expected.
Before the bonds can be issued, eight of the eleven beneficiaries must vote to approve the
incurring of debt by the Authority. In order to approve the indebtedness, a beneficiary's
governing body must record a 2/3 vote of all members for a resolution stating their approval of
such debt.
Two beneficiaries have already approved resolutions similar to the one prepared for
consideration by the Owasso City Council. The Board of Tulsa County Commissioners and the
Town of Sperry have adopted those resolutions.
REQUEST:
The request is for City Council adoption of Resolution #97 -04, thus approving the incurring of
indebtedness in an amount not to exceed $70,000,000.
LIABILITY•
Because the jail bond will pledge revenues from the sales tax, it is a revenue bond and is backed
only by the revenues of the sales tax and certain other jail revenues. THERE IS NO
LIABILITY TO THE CITY OF OWASSO or any other beneficiary in terms of debt service or
operational responsibility. Should the Authority default on the debt, the City of Owasso has no
legal or moral obligation to assume any responsibility for the payment of debt.
IMPACT ON CITY'S DEBT OR ABILITY TO ISSUE DEBT:
Research by the staff and Mr Cates indicates that the ability of the City to issue debt after
approving this request is not a concern. The only impact this bond issue could have on our
ability to issue debt would be in a case wherein the City desired to issue a General Obligation
Property Tax debt. Because of IRS regulations, a city is limited to an annual issue of up to ten

million dollars if they desire to maintain what is known as "small issue status" and retain a
' federal tax exemption for its bondholders.
The City of Owasso has not issued any G.O. bonds in the last fourteen years, and the staff does
' not know of any plans to utilize G.O. bonds in calendar year 1997. Therefore, it appears that
the issue of the jail bonds will not have any impact on our bonding ability. Please note that the
IRS limitation is a per -year restriction, thus in January of 1998 the jail bond debt could not have
any impact if the City decided to issue G.O. bonds. Additionally, the concept of an allocation
of proportional debt between the eleven beneficiaries would also reduce the impact should the
City decide to issue G.O. debt during 1997.
RECONEMWNDATION:
The staff recommends Council adoption of Resolution #97 -04 approving the incurring of debt
by the Tulsa County Criminal Justice Authority in an amount not to exceed $70,000,000.

WHEREAS, the Tulsa County Criminal Justice Authority (the "Authority "), was created
by an Amended and Restated Declaration of Trust, dated as of October 20, 1995 (the "Trust
Indenture "), for the use and benefit of Tulsa County, Oklahoma, the City of Bixby, Oklahoma,
the City of Broken Arrow, Oklahoma, the City of Collinsville, Oklahoma, the City of Glenpool,

WHEREAS, the Authority has determined that it would be most advantageous at this

and erecting, furnishing, equipping, remodeling and repairing a County jail and other detention
facilities as directed by the Board of County Commissioners of Tulsa County, including the
David L. Moss Criminal Justice Facility (the "Project "); and,
WHEREAS, in order to provide funds to finance the Project, the Authority intends to
issue its First Mortgage Sales Tax Revenue Bonds, Series 1997, in the aggregate principal
amount of not to exceed $70,000,000 (the "Bonds "; and,
WHEREAS, the Authority has determined in connection with the issuance of the Bonds
that the Bonds be sold by open, competitive bidding pursuant to the provisions of the Official
Notice of Sale and Instructions to Bidders approved by the Authority (the "Notice of Sale "); and,
' WHEREAS, as a beneficiary Y of the Authority, the City of Owasso, Oklahoma ( the
' "City) is required to approve the incurring of indebtedness of the Authority prior to the issuance,
sale and delivery of the Bonds;
' NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA THAT:
Section 1. The incurring of indebtedness by the Trustees of the Tulsa County
Criminal Justice Authority in the aggregate principal amount of not to exceed $70,000,000 to
be evidenced by the Bonds of the Authority is hereby approved by the City Council of the City
of Owasso, Oklahoma, the governing body of said City.
Section 2. The Bonds shall be sold by open, competitive bid pursuant to the Notice
of Sale, which is hereby specifically approved.
Section 3. The Mayor and City Clerk of the City be, and they hereby are, authorized
and empowered for and on behalf of the City, to execute and deliver such agreements and
documents and take such action as such officer or officers may deem necessary or desirable in
order to accomplish the issuance and sale of the Bonds.
PASSED, APPROVED AND ADOPTED this 21st day of January, 1997 by the City
Council of the City of Owasso, Oklahoma.
