Amendment to the Charter of the City of Owasso; and Authorizing the Placement of Such
Proposal on the General Election Ballot for April 1, 1997; and Notifying the Tulsa County
Election Board of the Calling of Such Election; and Establishing the Ballot Title of the
Proposal.

The City Manager has been requested to prepare a Charter Amendment relating to Council
compensation for submission to the City Council. Resolution #97 -05, if adopted by the
Council, would place an item on the April 1 General Election Ballot for consideration by
' the voters. The proposed amendment of Article 2, Section 2 -3 of the city charter
establishes compensation rate for Councilors at one hundred dollars per meeting attended.

Tuesday, January 21, 1997
The Owasso City Council met in regular session on Tuesday, January 21, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 17, 1997.

Mayor Ewing called the meeting to order at 7:05 p.m.

January 21, 1997
Mr Standridge moved, seconded by Ms Barnhouse, that the following claims be approved as ,
submitted: (1) General Fund $27,680.63; (2) Workers Comp Self -Ins $2,553.69; (3) Ambulance
Service Fund $1,378.15; (4) E -911 $1,846.96; (5) City Garage $2,423.97; (6) Capital
Improvements $3,466.17; (6) Capital Projects Grant $20.94; (7) Payroll $117,790.38; (8) City
Garage Payroll $2,315.59.

ITEM 7: PRESENTATION BY OWASSO GIRL SCOUT TROOP 161.
Misty Gilmartin, Elisa Norman, Kim Hansen, and Randi Wilson gave a brief history of Girl
Scouts and presented an overview of scouting activities. This was done as a part of their badge
requirements.
ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF THE DONATION OF A TV /VCR AN OVERHEAD
PROJECTOR AND A CAMCORDER.
Chief Alexander said that the Owasso Public School System has received funds from a DARE
grant, and they have requested authorization to donate audio - visual equipment to the Owasso
Police Department. The donation consists of a new Emerson 19" color TV /VCR combination
valued at $330, one Apollo Cobra overhead projector valued at $380, and one Magnavox VHS
Camcorder valued at $290. The total value of the donation is $1000. The equipment will be
used primarily in the DARE program, but may be used by the Police Department in public
relations programs and internal training when not being used in the DARE curriculum.
Mr Ramey moved, seconded by Mr Standridge, to accept the donation of equipment by the ,
Owasso Public School System.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST AUTHORIZING THE ESTABLISHMENT OF A "HOME PAGE"
FOR OWASSO CITY GOVERNMENT ON THE "INTERNET "• AND A
REQUEST FOR COUNCIL APPROVAL OF AN AGREEMENT BETWEEN
THE CITY OF OWASSO AND A HOME PAGE PROVIDING FOR THE
DEVELOPMENT OF THE INTERNET WEB SITE• AND AUTHORIZING
THE MAYOR TO EXECUTE THE AGREEMENT.
Over the past several months talks have been ongoing relating to the creation of a city internet
site. Mr Lee Thompson, Internet Creative Services; Mr Jim Rardin, A Home Page; and
Mr Dwight Lewton, Business Product Services have been working with Mr Knebel and
Ms Henderson to set up an internet web site to allow public access to current City information,
such as City Council Agendas, Who to Call, etc. Mr Rardin and Mr Thompson have proposed
a public /private partnership with the City and have offered to develop an internet web site for
City government purposes at no cost to the City. Initial cost should not exceed approximately
$350, and the ongoing cost will be approximately $20 per month for the telephone access to the
internet provider. Mr Ramey moved, seconded by Mr Standridge, to approve the establishment
of an internet site, and approve an agreement between the City of Owasso and A Home Page,
and authorize the Mayor to execute the agreement.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
RE UEST FOR COUNCIL APPROVAL OF ANNEXATION OF AN 8.90
ACRE TRACT OF LAND LOCATED SOUTH OF THE SOUTHEAST
CORNER OF EAST 96TH STREET NORTH AND 129TH EAST AVENUE
( OWASSO FIRST ASSEMBLY OF GOD PETITIONER).
Owasso Assembly of God Inc has submitted a petition to the City of Owasso for annexation of
property located south of the southeast corner of East 96th Street North and North 129th East
Avenue. The Owasso Assembly of God Church is located on the site. The request has been
reviewed by the Technical Advisory Committee, with no opposition being voiced. The Owasso
Annexation Committee reviewed the annexation request at their January 9, 1997 special meeting
and unanimously approved the request. Mr Ramey moved, seconded by Ms Barnhouse, to
approve the requested annexation of the tract containing the Owasso Assembly of God Church.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
RUEST TO CLOSE A DEDICATED RIGHT-OF-WAY LOCATED NORTH
AND WEST OF THE NORTHWEST CORNER OF EAST 116TH STREET
NORTH AND GARNETT ROAD.
A & W Development has requested the closing of a public right -of -way located north and west
of the northwest corner of East 116th Street North and Garnett Road, within the proposed
Country Estates R property. The right -of -way does not physically exist and is currently on
paper only. The Technical Advisory Committee and the Planning Commission both have
recommended approval of the request, and the staff has no objections to the closing of the right -
of -way. Mr Ramey moved, seconded by Mr Standridge, to approve closing the public right -of-
way as requested.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF A SANITARY SEWER EASEMENT.
The ONG workstation site project has required the obtaining of sanitary sewer line easements
for construction of infrastructure. An agreement has been successfully negotiated with Hayward
and Betty Smith for a 20 -foot permanent easement and an additional 20 -foot temporary
construction easement. City acceptance of this easement will allow construction to begin on the
roadway and utility portion of the project. Mr Standridge moved, seconded by Mr Ramey, to
approve and accept the sanitary sewer easement from Hayward and Betty Smith, and authorize
the Mayor to execute the document on behalf of the City of Owasso.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION 7 -04 A RESOLUTION APPROVING THE INCURRING OF
INDEBTEDNESS BY THE TULSA COUNTY CRIMINAL JUSTICE
AUTHORITY IN AN AMOUNT NOT TO EXCEED $70,000,000.
The Tulsa County Criminal Justice Authority has requested that the governing body of each
member of the Trust adopt a resolution approving the incurring of debt. Before the Trust can
issue bonds, eight of the eleven beneficiaries must vote to approve the incurring of debt by the
Authority. In order to approve the indebtedness, a beneficiary's governing body must record
a 2/3 vote of all members for a resolution stating their approval of such debt. Resolution #97 -04
gives approval of the City of Owasso of the incurring of indebtedness by the Tulsa County
Criminal Justice Authority in an amount not to exceed $70,000.00. Mr Standridge moved,
seconded by Mayor Ewing to adopt Resolution #97 -04, approving the incurring of debt by the
Tulsa County Criminal Justice Authority in an amount not to exceed $70,000,000.00.

SUBJECT: YMCA STATUS REPORT ON RECREATION CENTER
IMPROVEMENTS
DATE: January 31, 1997
BACKGROUND:
On July 2, 1996, the City of Owasso entered into an agreement with the YMCA of Greater
Tulsa. That agreement allowed the YMCA the use of the City's recreation center building in
return for an investment of $250,000 (minimum) in improvements to the facility and an
enhancement of recreational services to the community. The agreement also stipulated that the
$250,000 investment be made within twelve months of the date of the agreement.
On January 29th, a building permit for rennovation of the recreation center was issued and
' construction began on January 30. The plans for that rennovation were approved by the City
Council on October 15, 1996.
' Mr John Swift, Executive Director for the YMCA of Greater tulsa, has been requested to brief
Councilors on the status of the project and present an update relating to YMCA plans for the
facility. Mr Swift has agreed to that request and will be present to make such a presentation.

EXHIBIT A
RECREATION FACILITY LEASE AGREEMENT
THIS LEASE, made at Owasso, Oklahoma, on the ,2nd day of
_-r I- , 1996, by and between the CITY OF OWASSO, OKLAHOMA, an
Oklahoma municipal corporation, its successors and assigns,
hereinafter called "LESSOR ", and THE YOUNG MEN'S CHRISTIAN
ASSOCIATION OF GREATER TULSA, hereinafter called "LESSEE ".
W I T N E S S E T H:
That LESSOR does hereby let and lease unto LESSEE the premises
situated in the City of Owasso, County of Tulsa and State of
Oklahoma, and further described as follows:
Rayola Recreation Center and Appurtenant Facilities
consisting of the Western Four (4) Ballfields
hereinafter referred to as "recreational facility." Said
premises are to be used and occupied for recreational
purposes only. LESSEE, for no additional consideration,
shall be allowed to utilize the two (2) eastern (front)
softball fields when same are not otherwise scheduled for
use by or through LESSOR. Such fields shall become part
of the herein demised premises when used by LESSEE. It
is the intent of the parties hereto that the two (2)
eastern (front) softball fields are to become a permanent
part of the demised premises when the parties find it to
be appropriate and the parties will review this status
annually. The swimming pool operated by LESSEE under a
prior agreement will become a part of demised premises on
the effective date hereof. The demised premises shall
also include that one -half (1/2) of the parking lot
adjacent to this facility.
To have and to hold unto LESSEE for the term of ten (10)
years, commencing on the 1st day of July, 1996, and ending on the
30th day of June, 2006, upon the covenants and agreements herein
set forth.
1. The LESSEE hereby covenants and agrees to pay to the
LESSOR as rent for said premises during the said term, the sum of
One Hundred Dollars and no /100's ($100.00) at ten Dollars and
no /loo's ($10.00) per year payable on the 1st day of July, 1996,
and a like sum on the 1st day of July each year thereafter during
the term hereof. As additional rental payable hereunder LESSEE
covenants with LESSOR that within one (1) year from the inception
of this lease LESSEE will expend an amount of money, not less than
Two Hundred Fifty Thousand Dollars ($250,000.00), for capital
improvements to, on or upon the recreational facility hereby
demised. Such capital improvements must, in accordance with
Oklahoma Law, be designed by and certified to by a duly Registered
Architect in the State of Oklahoma. Further, prior to performance
of the capital improvements herein contemplated, LESSEE shall
present the design and specifications to the City Council of the
City of Owasso, Oklahoma, for its approval, such approval not to be
unreasonably withheld. Contracts for the construction of the
recreational facility capital improvements shall meet all
requirements of the Public Competitive Bidding Act of 1974, 61 O.S.
101 ct seq.
Construction of the recreational facility capital improvements
shall be the sole obligation and responsibility of the LESSEE.
Such recreational facility capital improvements shall be
accomplished in a workmanlike manner and shall comply with all
local, state and federal laws pertaining thereto. LESSEE shall
hold harmless LESSOR, LESSEE agreeing to indemnify LESSOR, from and
against any and all claims, cost, damage, expense, including any
LESSOR incurred Attorneys fees, cost of Alternative Dispute
Resolution Attorneys fees and costs, or loss incurred or suffered

by LESSOR arising out of LESSEE's recreational facility capital
improvements.
If, upon the expiration of the term hereof, and for a period
of Five (5) years thereafter, LESSOR sells such recreational
facility herein demised, then, in such event LESSOR shall pay
LESSEE, solely from the proceeds of such sale, an amount of money
for the recreational facility value enhancement resulting from the
recreational facility capital improvement performance by LESSEE;
provided, however, such value enhancement repayment from proceeds
shall equal the value of enhancement from the date of capital
improvement completion as depreciated on a straight line basis over
the term of years from date of completion until the date of sale.
For the purposes of this Lease depreciable life of said capital
improvement shall be fifteen (15) years.
2. Not withstanding any other provision hereof to the
contrary, either party hereto may terminate this Lease Agreement at
any time upon one hundred twenty (120) day written notice to the
other party.
If LESSEE so terminates, it shall forfeit all its right, title
and interest to said capital improvements to LESSOR.
If LESSOR so terminates, the parties hereto shall seek to
negotiate a mutually satisfactory settlement. In the event the
parties cannot agree, determination of LESSEE's damages shall be
settled by arbitration. Such arbitration shall be before three
disinterested arbitrators, one named by LESSOR, one by LESSEE and
one by the two thus chosen. The arbitrators shall determine the

controversy and their determination shall be final and binding on
both LESSOR and LESSEE. Any mandatory award issued by the
arbitrators against Lessor shall be payable by Lessor to Lessee
solely from revenue derived by Lessor from Lessor's operation of
the Recreational facility.
3. LESSOR shall not allow said premises to be used in any
manner which shall unreasonable interfere with LESSEE'S occupancy
and /or programs, nor which shall, in any way, cause any damage to
the facility or to LESSEE'S equipment located thereon.
4. LESSEE has examined and knows the condition of said
premises and has received the same in their present condition.
LESSEE shall keep said premises in a clean, safe and healthy
condition, in accordance with the ordinances of the City of Owasso,
Oklahoma, and acceptable safety and recreational standards.
5. LESSEE will use and occupy said premises and
appurtenances in a careful, safe and proper manner, in accordance
with the ordinances of the City of Owasso, Oklahoma; and LESSEE
will not allow said premises to be used for any purpose in any way
that will increase the rate of insurance thereof, nor for any
purpose other than that hereinbefore specified, nor to be occupied
in whole or in part by any other persons; and will not bring nor
suffer to be brought into or upon said premises any substance or
force that will increase the hazard of fire in or on said premises,
and will not permit liquor to be sold at wholesale or retail, or
consumed on the premises; will not sublet said premises or any part
thereof, nor assign this Lease, without in each case, the written

consent of LESSOR first obtained; and will not permit any transfer
by operation of law of LESSEE'S interest in said premises. LESSEE
shall not use the premises for any unlawful purpose or in any way
that will injure the reputation of the same, or disturb the
neighborhood; and will not permit any substantial alteration of or
upon any part of said demised premises, nor allow any sign or
placard posted or placed thereon, except by written consent of
LESSOR unless otherwise provided in said written consent. The
lights of the Western Four (4) Ballfields will not be utilized.
6. LESSEE will pay all utility expenses, together with all
' water and sewer, levied or charged against said premises (except
water for the swimming pool until LESSOR repairs the leak to
'LESSEE'S satisfaction) for and during the term for which this Lease
' is granted. Any amounts so paid by LESSOR and any amounts paid by
LESSOR to keep said premises in a clean, safe and healthy condition
' as hereinbefore specified, or to make up any default on LESSEE'S
part to fulfill LESSEE'S covenants herein written, are hereby
agreed and declared to be so much additional rent and shall be due
and payable with the next installment of rent due thereafter upon
this Lease.
7. LESSEE shall have the following duties with reference to
said premises:
•'' a) to keep said premises clean, as stated herein;
b) to dispose from the leased premises all rubbish,
garbage and other waste, in a clean and sanitary
manner;
C) to properly use, operate, maintain and replace, if
reasonably necessary, the facilities hereby demised

including, but not limited to, all exterior and
interior portions of the recreation facilities, all
electrical, gas, plumbing, heating and cooling
equipment therein as well as that portion of the
parking lot which is part of the demised premises;
d) to maintain the grounds of the leased premises in a
clean, safe and sanitary condition, including all
mowing of the grass and maintenance of the demised
athletic fields thereof;
e) to assume and be solely responsible for the
planning, development, safety, supervision, and
other program aspects of their recreational
programs.
8. LESSEE will deliver up and surrender to the LESSOR
Possession of the premises hereby leased upon the expiration of
this Lease or its termination in any way, in as good condition and
repair as the same shall be at the commencement of said term (loss
by fire and ordinary wear and decay only excepted) and deliver the
keys at the office of the LESSOR or LESSOR'S agent.
9. LESSOR may have free access to the premises at all
reasonable times for the purpose of examining the same
10. LESSEE shall provide LESSOR with a written notice of its
proposed uses of the premises at least thirty (30) days in advance
thereof. LESSEE may authorize the City of Owasso, Oklahoma, to use
said premises at times which do not conflict with the LESSEE'S use.
The City of Owasso, Oklahoma, shall give the LESSEE reasonable
notice of its intended use. LESSOR'S use shall be subject to the
same restrictions and limitations as any other party's use of the
premises. LESSEE shall post program schedules of the premises in
a prominent place in the building.

LESSEE'S use of the premises, as well as its programs
instituted and administered thereon, shall at all times be done
with the objective of enlarging and expanding upon recreational
opportunities for all citizens of Owasso, Oklahoma. Further,
LESSEE'S use of the premises, as well as its programs instituted
and administered thereon, shall not discriminate against any person
or persons on the basis of race, creed, sex, national origin,
disability status or religious belief.
If any person or organization wishes to institute a new
program to take place on said premises, it shall first request the
LESSEE to offer and conduct said program. It is the intent of
LESSEE to offer and conduct said programs, however, LESSEE has
final right to determine whether a program will be offered and
conducted by LESSEE and LESSEE'S decision on these matters is
f inal .
11. LESSOR shall not be liable for any damage occasioned by
or from plumbing, gas, water, steam, or other pipes, or sewage or
the bursting, leaking or running of any cistern, tank, washstand,
or waste pipe in, above, upon or about said building or premises,
nor for damage occasioned by water, snow or ice, nor for any damage
arising from acts or negligence of LESSEE its agents, licensees,
employees, invitees, or guests.
12. If default be made in payment of said rent or any part
thereof or in fulfillment of any of the covenants or agreements
herein specified to be fulfilled by the LESSEE, or if any waste be
committed or unnecessary damage done upon or to said premises, the

LESSOR may, at LESSOR'S election, at any time while such default
continues or before the replacement or repair of such waste or
damage, and without notice, declare the said term ended and enter
into possession of said premises and sue for and recover all rents
and damages accrued or accruing under this Lease or arising out of
any violation thereof, or LESSOR may sue and recover without
declaring this Lease void or entering into possession of said
premises.
13. Every demand for rent due wherever and whenever made
shall have the same effect as if made at the time it falls due and
at the place of payment or on the premises. LESSOR may receive and
collect any rent due, and such collection or receipt shall not
operate as a waiver of, nor affect such notice, suit or judgment.
Any notice or summons to be served by or on behalf of LESSOR upon
LESSEE under this Lease or in connection with any proceeding or
action growing out of this Lease or the tenancy arising therefrom,
may be sufficiently served by leaving such notice or summons
addressed to LESSEE upon the said demised premises.
14. The LESSEE shall insure the subject premises against loss
by personal injury or property damage due to negligent supervision
and endorse the City of Owasso, Oklahoma, as an additional insured
thereon. Such insurance shall be at LESSEE'S cost and in an amount
not less than One Million and no /100ths Dollars ($1,000,000.00).
A copy of the evidence of insurance shall be supplied to the City
Manager of LESSOR.

15. The LESSEE shall assume any and all property tax
obligations imposed upon the property of LESSEE during the term of
this Lease, including any increases thereon.
16. And the LESSOR hereby covenants and agrees that if the
LESSEE shall perform all the covenants and agreements herein
stipulated to be performed on LESSEE'S part, the LESSEE shall at
' all times during said term have the peaceable and quiet enjoyment
and possession of said premises without any manner of let or
' hindrance from LESSOR or any person or persons lawfully claiming
said premises.
17. LESSOR and LESSEE mutually agree that either of them may
terminate this Lease at the end of the above - stated initial term by
giving the other party written notice thereof at least sixty (60)
' days prior thereto. In the absence of such notice, this Lease
shall continue on the terms and conditions contained herein and in
force prior to the expiration of the above - stated initial term on
a month -to -month basis unless terminated by either party upon sixty
(60) days written notice.
18. LESSEE shall hold the City of Owasso, Oklahoma, its
officers, agents, employees and independent contractors, harmless
and fully indemnify said City of and from any and all claims of
neglect, negligence, liability for personal injury or property
damage occurring during the term of this Lease, except as the same
may arise from the negligence of LESSOR, LESSOR'S agents or
employees. This indemnification and hold harmless agreement shall
Iextend to reasonable attorneys fees and costs incurred in defending

itself from any claims made during the term of the Lease, including
therewith Alternative Dispute Resolution Attorneys fees and costs.
19. LESSOR or LESSEE may request that the terms and
provisions of this Lease be reopened upon thirty (30) days notice
in writing to the other party. Each party shall attempt, at this
point, to address any such issues raised by the other, but the
process of reopening or renegotiating shall not obligate either
party to accept the proposal of the other party or to vary the
terms of this agreement.
IN WITNESS WHEREOF, the parties have hereunto set their hands

The staff requests that item #8 relating to the purchase of a vehicle for the fire department be
removed from the agenda at this time. Chief Allen requests time to research additional prices
and information relating to this purchase. A Council work session is scheduled for February
11th, at which time this item will be discussed.

BACKGROUND:
In 1973, the Fire Department purchased vehicles from the Oklahoma Highway Patrol surplus. These
vehicles typically had over 100,000 miles and would have a life span of a few years. In 1978, the
department purchased a station wagon as a station vehicle and utilized it into the 1990's. Due to the
allocation of Capital Outlay funds, we have not been able to replace this vehicle until now.
The money for this vehicle has been saved in the form of Carry-Over funds. This has been
accomplished by applying cost efficient, money management to previous purchases from the Capital
tOutlay Budget.
For the past five years, the department's Capital Outlay Committee has prioritized Capital Outlay
' expenditures based on the needs of the department so that the best and most cost efficient service
could be given to the citizens of Owasso.
The committee based it's prioritization on the facts that emergency vehicles are taken out of service
for non - emergency tasks. The intended use of this vehicle would be for retrieving medical
equipment which had to be left at the Tulsa hospitals, transporting personnel and equipment to
training classes, providing a means of transporting manpower and extra supplies to emergency scenes,
and performing routine tasks locally like picking up food and /or station supplies.
r The committee has developed specification based on the intended use of the vehicle, and Oklahoma
Department of Central Services "State Bid" meets those specifications. All additional equipment
' needed to meet department's requirements for emergency accessories (light bars, sirens, radios, etc.)
will be supplied from surplus at the department.
' RECOMMENDATIONS:
Three bids from local vendors are included for your review. Other vendors in Tulsa were contacted
also, but all bids were higher than those obtained locally. After researching the cost of new vehicles,
used vehicles, and comparing them with the "State Bid" price the Capital Outlay Committee would
recommend purchasing this vehicle through the "State Bid" process.

The staff will recommend Council approval of an expenditure in the amount of $15,278 to Fred Jones
Ford, Oklahoma City, Oklahoma for the purchase of one 1997 Ford F150, and authorization for
payment. Such purchase price established by state bid #BP 12941 through the Oklahoma Department
of Central Services.
Funding for this vehicle was approved in FY 96 -97 Budget.

totals 8.90 acres and is currently developed as the site of the Owasso Assembly of God church.
An area map is attached for your information and review.
Attached is a copy of Ordinance No. 536 which would formally adopt the City Council's action
of February 21, 1997, thus formally approving the annexation request.
RECOMMENDATION:

petition in writing, signed by not less than three - fourths of the legal voters and owners of not
less than three - fourths (in value) of the property hereinafter described, the same being contiguous
to the corporate limits of the City of Owasso, requesting that said property be annexed and
added to the City of Owasso is submitted; and
WHEREAS, notice of the presentation of said Petition was given by the Petitioner by
publication in the Owasso Reporter, a newspaper of general circulation published in the City of
Owasso, Oklahoma, and notice was given that said Petition would be considered by the City
Council of the City of Owasso, at a meeting to be held on January 21, 1997 at 7:00 PM at the
Community Center, Owasso, Oklahoma; and
WHEREAS, on the 21st day of January, 1997, said Petition was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and further, that proper legal notice of presentation of
said petition had been given; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA.
Section 1. That the following described territory lying in Tulsa County, Oklahoma which
is contiguous to the present corporate limits of the City of Owasso and described in the petition

IBACKGROUND:
The attached resolution, if adopted would place a question before the voters of Owasso relating
to a proposed amendment of the Owasso City Charter. The proposal is to amend the Charter's
provision prohibiting compensation for councilors (Article 2, Section 2 -3) by adding language
that would pay councilors for each meeting they attend.
The methods for amending the Charter are limited by Article 9, Section 9 -1. The Charter may
only be amended by a vote of the people. Proposals to amend the Charter can only be brought
to a vote by an initiative petition requiring the Council to call an election, or by a vote of the
City Council calling an election on its own initiative.
The attached resolution contains language that would, if adopted by the City Council and ratified
by the voters, repeal Section 2 -3 of the Charter and substitute new language providing payment
for City Councilors for their services as Councilors. The proposal sets compensation at one
hundred dollars per meeting for regular and special meetings. The resolution proposes an
election for this amendment on April 1, 1997, the same date as the city's general election for
council members (if a general election is needed) and calls a special election for the amendment
on April 1, 1997 if no general election is required for council elections.

HISTORY:
There have been several Charter reviews since its adoption in 1972. The most recent review
was completed on February 2, 1996 (report attached for your review). Previously, reviews were
conducted in 1995, 1993, and 1990. Actual Charter elections were conducted in 1985 and 1986.
While no elections were conducted in 1990, 1993, or 1995, the issue of councilor pay was
discussed (if only briefly) during each of the reviews. However, actual elections regarding
Charter amendments were held in 1985 and 1986. In the 1986 election, the voters rejected a

proposition relating to such compensation by a vote of 415 to 83. The 1985 Charter election
included seven proposals, but did not include compensation for councilors.
RECOMMENDATION:
This item relates to Council Policy, therefore no staff recommendation is offered.
NOTE: Adoption of the resolution will call an election for the voters of Owasso to determine
the outcome of the proposal. The Council cannot, by vote of the Council, amend the
Charter. Also, please note that only a majority vote of the Council is required to place
a Charter amendment before the voters.

SUBJECT: RESULTS AND RECOMMENDATIONS REGARDING THE CHARTER OF
THE CITY OF OWASSO, OKLAHOMA
DATE: FEBRUARY 2, 1996
Pursuant to your directive issued August 1, 1995, we have completed our review of The Charter
of the City of Owasso, Oklahoma. Our review began on September 12, 1995, the first of
several special meetings which were conducted during the fall of 1995. The Charter Review
' Committee enlisted the assistance of Mr. Ron Cates and several other City of Owasso staff
members to expedite the review process.
During the course of our efforts we considered the language contained in the city charters and
forms of government of six other Oklahoma cities. We compared and contrasted the documents
to determine the validity and applicability of Owasso's Charter. With the assistance of Sherry
Bishop, we were able to summarize the documents and consider their content and relative merits.
As with the constitution, Owasso's city charter sets the framework within which the government
of Owasso functions. Accordingly, it was the committee's opinion, that only with great care and
careful consideration of the potential issues that may arise, that changes should be considered
appropriate in the document. We were continually aware of the need for future generations of
Owasso citizens to be able to rely on this charter for direction in guiding our city forward as we
completed our work.
Throughout the review process we solicited input from various parties regarding their thoughts
and ideas related to potential changes in the existing charter. We were concerned that the
document remain vital and relevant in light of the many complex issues confronting our
community. In addition to the valuable input from several of the city staff, several area citizens
also provided key input by adding their thoughts to ours.
Now complete, our review lasted five months. We read, discussed, evaluated, debated and
occasionally disagreed. Ultimately, we reviewed and approved as written, with one exception,
each section of the entire document. We have attached hereto, as Exhibit A, our proposed
revised language for Article 4, Section 1 of the Charter. We have also attached, as Exhibit B,
draft language to update an ordinance related to Article 4, Section 2(a) regarding minimum
competitive bids and City Manager purchasing authority.
Proposed Change to Article 4. Section 1
According to the existing Charter, the City Treasurer is hired, managed and subject to
disciplinary action solely by the City Manager. The City Manager, in turn, is appointed by the
City Council. At no time does the City Council have any oversight over the activities of the
City Treasurer, nor does it have the authority to hire or discipline such individual. While we
believe the Charter is fully correct in its delegation of authority to the City Manager to hire and 16
have authority over the City Treasurer without the direct intervention of the City Council, we
are also concerned about the lack of the City Council's involvement in the hiring and discipline ,
process.
We developed revised language with the assistance of Mr. Ron Cates to address our concerns. '
It is important to note, we do not recommend as a committee for the City Council to in any way
have administrative authority over the City Treasurer. Rather, we recommend adding a level
of review to the hiring and discipline process related to the City Treasurer due to the important '
responsibilities of the position. Our recommendation would involve the City Council in
affirming the hiring or firing of the City Treasurer if, and, or when the City Manager ,
recommends such action. We believe this addition to the city charter will strengthen the checks
and balances already built into the existing document.
Proposed Ordinance Change
Our review of the city charter uncovered an administrative difficulty which we believe should
be addressed by the City Council at its earliest convenience. Article 4, Section 4 -2(1) empowers
the City Council to set purchase limits for materials and equipment required for the ordinary '
daily operation of the city government. It is our understanding the current ordinance requires
prior City Council approval for all purchases in excess of $1,000 and competitive bidding for
all purchases in excess of $2,000.
We believe such amounts to be overly burdensome by current standards and would recommend
increasing the limits set by the ordinance to $5,000 for both purchasing and bidding. The larger
limit would allow the City Manger the discretion to address routine purchases without undue
administrative delay, while still maintaining the approvals process for all expenditures that now
exists. We have assembled, again with the assistance of Mr. Ron Cates, the necessary language
to facilitate updating this ordinance for your consideration and approval.
Conclusion
The Owasso City Charter is an effective relevant framework for managing our community
affairs. With the exception of the minor change we recommended, we found the document to
be reasonable and fair.

In accordance with direction given by the Committee I am proposing the following language
to implement the desired change in the Charter of the City of Owasso, Oklahoma, as relates to the

City Manager, subject to approval of the City Council, shall appoint the City Treasurer for

and shall perform the duties as prescribed by this Charter, applicable law, and such ordinances
and other policies as the Council may adopt. The City Treasurer or personnel under his or
her supervision and control shall collect or receive revenue and other money for the City, shall
be responsible for its custody, safe keeping, deposit and disbursement, shall maintain a general
accounting system for the City Government and shall have such other powers and duties
consistent with this Charter as may be prescribed by ordinance or applicable law. The City
Manager shall be the only authorized individual to direct the day to day activities of the City
Treasurer. The City Manager shall be the only authorized officer to recommend a layoff,
suspension, demotion or removal of the City Treasurer; provided, however, such layoff,

BACKGROUND:
On Monday, August 30, Councilor Burris requested that an item be added to the September 7th
agenda regarding the creation of a Charter Review Committee. Councilor Burris indicated that
the Charter is now twenty years old and has not been changed for several years. Thus, the staff
placed an item on the agenda to provide for a Council discussion of the issue.
Councilor Burris indicated that he thought the most effective method for reviewing the Charter
would be through a review committee comprised of five persons. He suggested that it would
be helpful if two of the five were members of the City Council.
CHARTER AMENDMENT PROCESS:
Article 9, Section 9 -1 of the Owasso City Charter provides for the methods of changing the
Charter. Essentially, there are only two methods of initiating a Charter change. The first
method is for the City Council to submit proposed changes. In order for the City Council to
submit changes, a majority vote of the Council must be cast during a meeting of that body. The
second method of initiating Charter changes is through the initiative petition process as
established by the state constitution. If an initiative petition is submitted and certified as meeting
the constitutional requirements, then the changes must be presented to the voters for approval
or denial.
Regardless of the method used to initiate requested changes in the Charter, any such change
must be approved by a vote of the qualified electors of the city. If a Charter election is
conducted, only a majority vote of those voting is required for passage. In the event a Charter
change is approved by the voters, the final step in the process is for the Governor to "approve"
the action (requirement of state constitution).

COMMENTS:
1. The decision as to whether or not to create a Charter Review Committee is a policy
question, therefore, there is no staff recommendation accompanying this memorandum.
2. The staff, including Mr Cates, will be prepared to address questions regarding a Charter
change prior to, during, or after the meeting. If you have questions, please call Mr
Cates or me.
3. Should the Council wish to initiate Charter changes, the creation of a Charter Review
Committee is a viable vehicle for initiating a comprehensive review of that document.
However, it should be noted that from a historical perspective, the use of a broad based
committee to initiate Charter changes has not been successful. Generally, these groups
tend to want to rewrite the entire document rather than focus on the charge they have
been given. Additionally, such committees are often placed under strong pressure from
special interest groups to react to current problems and use the Charter to achieve success '
in an area that may be more of an emotional reaction to a current event than a truly
needed Charter change. A more successful method of achieving a Charter review has
been for the City Council to sit as a "Committee of the Whole" to review and initiate
Charter changes. Generally, when such an approach is utilized, the Council / committee
conducts study sessions, public hearings, and informational meetings to gain expertise
and input. In this case, the method used may depend on the ultimate goal the Council
wants to achieve.
4. It should be noted that the Owasso City Charter was reviewed and changed in a vote on '
April 2, 1985. At that time, five changes to the Charter were proposed to the voters (see
attached). The voters approved Proposition #1, 2, 3, & 4, but turned down Proposition
#5 (see attached vote certification). Additionally, the Council conducted a Charter '
review during October and November of 1990 (see attached), however, no changes were
submitted to a vote of the people. ,

ARTICLE 2, ARTICLE 3, ARTICLE 6, AND ARTICLE 7 THEREOF,
AND CALLING FOR AN ELECTION IN THE CITY OF OWASSO,
OKLAHOMA, FOR THE PURPOSES OF SUBMITTING TO THE
REGISTERED, QUALIFIED VOTERS OF SAID CITY OF OWASSO,
OKLAHOMA, THE QUESTIONS OF AMENDING AND REPEALING
VARIOUS SECTIONS IN THE AFOREMENTIONED ARTICLES OF
THE CHARTER OF THE CITY OF OWASSO, OKLAHOMA, SETTING
BALLOT REQUIREMENTS, PUBLICATION OF PROPOSED CHANGES,
ELECTION DATE, AND DECLARING AN EMERGENCY.
WHEREAS, under the provisions of Article 9, Section 9 -1,
the Charter of the City of Owasso, Oklahoma, may be amended
by proposals therefor submitted by the Council, and at a
general or special election therefor, ratified by a majority
of the qualified electors voting thereon and approved by the
Governor as provided by the State Constitution; and,
WHEREAS, it is deemed advisable by the City Council of
the City of Owasso, Oklahoma, that the present Charter of
said City of Owasso, Oklahoma, be amended in certain
particulars and that certain portions therein be repealed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA:
Section 1: That the City Council of the City of Owasso,
Oklahoma, hereby proposes that the Charter of the City of
Owasso, Oklahoma, be amended in part and that part of the
City Charter of the City of Owasso, Oklahoma, be repealed,
both proposed amendments and proposed repealer being those as
set forth in Exhibit "A" attached hereto.
Section 2: That the City Council of the City of Owasso,
Oklahoma, consistent with Article 9 of the Charter of the
City of Owasso, Oklahoma, as well as state law relating
thereto, calls for an election to be held in the City of
Owasso, Oklahoma, on the 2nd day of April, 1985, same being a
date for general election, or if such general election not be
held, such being hereby called as a date for a special
election to be held hereon, for the purpose of submitting to
the qualified electors of the City of Owasso, Oklahoma, for
their ratification or rejection amendments to and repeal of
' those portions of the Charter of said City of Owasso,
Oklahoma, referred to in Exhibit "A ".
Section 3: The amendments and repealers contained in said
Exhibit "A" shall be placed on the ballot for ratification or
rejection in a manner so that each Section of the Articles
containing the proposed changes may be voted upon separately,
except that where passage of a proposal contained in one
Article is interrelated with that proposed in another, the
two may be combined for voting purposes; further, that in
addition to provision for voting separately on each Article,
u , the ballot shall be prepared in such a manner as to allow the
^II voters to vote for approval or rejection of the proposals in
their entirety by a single mark, provision for same to be
placed at the top of said ballot.
Section 4: The ballot shall set forth propositions set out
' in Exhibit "A" attached hereto, in a concise manner,
containing the gist of the propositions couched in language
' that may be readily understood by persons not engaged in the
practice of law. The ballot title shall contain language
which clearly states that a "yes" vote is a vote in favor of
the proposition and meaning to ratify such proposition, and a
"no" vote is a vote against the proposition and meaning to
reject such proposition.
r Section 5: This Resolution, in addition to the proposal for
amendments to and repealers of portions of the Charter of the
City of Owasso, Oklahoma, shall constitute a call for an
election ratifying the proposals or rejecting same, in whole
or in part. Additionally, consistent with the provisions of
Section 6 -10 of Article 6 of the Charter of the City of
Owasso, Oklahoma, said election shall be conducted in

accordance with the provisions of the State Constitution and
laws applicable to city elections.

an announcement of the date for the election on same shall be
published as required by law.
Section 7: The present Articles of the Charter of the City
of Owasso, Oklahoma, as well as the proposed Articles as they
would appear if the amendments and repealers were ratified
and approved, is attached hereto as Exhibit "B" and
incorporated by reference herein to be used for purposes of
comparison and understanding of the changes proposed herein.
Section 8: That by reason of the fact that the effective
date of this Resolution must occur prior to thirty days from
the date hereof in order that submission of the proposed
amendments and repealers to the qualified electors may occur
on April 2, 1985, and by virtue thereof result in a
substantial savings of monies to the City of Owasso,
Oklahoma, and as a result thereof, the inhabitants of the
City of Owasso, Oklahoma, it is necessary that this
Resolution take effect immediately upon its passage and
publication. As a result of such action being necessary for
the purposes of effectuating a substantial savings to the
inhabitants of the City of Owasso, Oklahoma, an emergency is
hereby declared to exist whereby, this Resolution shall take
effective immediately upon passage and publication thereof.
PASSED AND APPROVED this 5th day of February, 1985, with
the emergency clause voted upon separately.

PROPOSITIONS FOR AMENDMENT
' TO THE CHARTER OF THE CITY OF OWASSO, OKLAHOMA
PROPOSITION I
' Shall Article 2, Section 2 -1(b) of the Charter of the
City of Owasso, Oklahoma, be amended to provide as follows:
'
Only qualified electors of the City who reside in
the respective wards from which they are elected or
appointed to fill a vacancy, shall be qualified for
the offices of Councilmen. Upon election, or
appointment, as the case may be, such Councilman
shall continue to reside within the ward from which
elected or appointed during the entire term of said
Councilman's office, or upon removal of residence
therefrom, forfeit such office. No Councilman
may hold any office in the City government by
appointment by the City Manager or by any subordinate
of the City Manager. If the Mayor or any other
A Councilman is convicted of a crime involving moral
turpitude, his office shall become vacant immediately
when the case is finally determined."
PROPOSITION II
Shall Article 2, Section 2 -8 of the Charter of the City
of Owasso, Oklahoma, be amended to provide as follows:
"If the Mayor or any other Councilman is absent from
more than one -half of all the regular and special
meetings of the Council held within any period of
four consecutive calendar months, such perso n
shall thereupon cease to hold office."
PROPOSITION III
Shall Article 3, Section 3 -1(a) of the Charter of the
City of Owasso, Oklahoma, be amended to provide as follows:
"There shall be a City Manager. The Council shall
appoint him for an indefinite term by a vote of
majority of all its members. It shall choose him
solely on the basis of his executive and adminis-
trative qualifications. At the time of his
appointment, he need not be a resident of the City
or State; but, during his tenure of office, he
shall reside within the limits of said City or
the designated fence line thereof. Neither the
■ Mayor nor any other Councilman may be appointed
City Manager or Acting City Manager during his
term nor within two years after the expiration
of his term."
PROPOSITION IV
Shall Article 6, Section 6 -3, and Section 6 -4 of the
Charter of the City of Owasso, Oklahoma, be amended to
provide as follows:

"Section 6 -3: Any person qualified for the office for
which he is filing may have his name placed on the ballot
for the primary election as a candidate for councilman
from his ward by filing, on the first Monday, Tuesday,
or Wednesday of February, unless any such day or days
be a legal holiday or a day wherein the office of the
secretary of the county election board is lawfully
closed, whereupon such time shall be extended commensur-
ate with the legal holiday or lawful closing, with the
secretary of the county election board, a sworn statement
of his candidacy.
Section 6 -4: A primary election shall be held on
the first Tuesday in March of every year to nominate
candidates for Councilmen to succeed those whose terms
are expiring in the respective year. If only one person
is a candidate for an office to be filled, he shall be
not only nominated, but also elected ipso facto, and
his name shall not appear on the primary or general
election ballot. Every qualified elector of the City
shall be entitled to vote for one candidate for each
office to be filled."

CHARTER REVIEW REPORT
NOVEMBER 29, 1990
A Charter Review Committee was established by the Council on
October 3, 1990, for the purpose of reviewing the existing Charter
and to propose necessary changes. Each member of the Council has
received a report from the Committee as prepared by the City
Attorney.
The Committee requests that, before any further action is taken or
` expense incurred, the items in the report be acted upon separately
by the Council. This will determine if there is sufficient support
to continue consideration of each individual item.
The Committee has developed a list of items for Council
consideration. Those items that receive the support of the Council
will be rewritten into final form by the City Attorney for
publication and public hearing. After a public hearing the Council
' would then vote on the final items to be presented to the voters on
the March primary election ballot.
Based on my understanding of the process and previous discussions
(see memorandum dated September 27), I propose the following
schedule of activities for implementing this process. Please note
that the only specific deadline is the date for calling an
election. We are required to give the election board 45 -days
notice prior to any election. If we are to have a March 5th
election we must pass a resolution calling for that event no later
® January 15th. March 5th is the normal election date for the City's
primary election and it would be less costly to include the Charter
election on that same date if the Council so desires.
Dec. 18, 1990 - Council conducts public hearing on the
recommended amendments as a part of the
regular Council meeting.

requested amendments by adopting

MEMORANDUM

FROM: Charter Review Committee
DATE: November 12, 1990
RE: Charter Review
In accordance with direction given by the City Council, the
Charter Review Committee consisting of Mayor Mark Thompson, Vice
Mayor John Phillips and City Attorney Ronald D. Cates have reviewed
the Charter of the City of Owasso, Oklahoma, as well as met for
purposes of discussion of anv areas of recommended change to such
Charter. After review of the Charter, as well as discussions con-
cerning same, it is the collective decision of the Charter Review
Committee to submit to the City Council a listing of provisions of
the City Charter wherein change is potentially desirable by the
Council for recommendation to the qualified electors of such City.
For the sake of economy, the Committee has refrained from drafting
language to implement such changes pending the City Council's col-
lective decision as to such proposed changes as being desirable to
submit to the voters of the City. Consequently, what is submitted
at present should be considered as concepts for consideration by
the Council. It is anticipated if the City Council deems desirable
proceeding with any or all of the proposed changes then subsequent
to such decision drafting of proposed language to incorporate such
concepts for presentment to the voters would be undertaken. Addi-
tionally, it should be observed that the following listing is a
listing of areas that the Charter Review Committee felt a Charter
change should be considered; however, such is not intended to be
exhaustive thereof and any comments or ideas regarding other areas
of change which the Administration or Council deem desirable are
welcomed.
AREAS OF PROPOSED CHANGE:
1. Article I - Incorporation; Form of Government; Powers,
Section 1-3--Powers of City--The Charter Review Committee deemed
desirable to recommend for Council consideration, amendment to said
Charter, in particular Section 1-3--Powers of City to provide for
incorporation therein of zoning powers. Presently, the powers of
the City of Owasso, Oklahoma, in regards to zoning originate by
virtue of enabling legislation from the State. Consequently, based
upon decision of the Supreme Court of the State of Oklahoma, all
provisions, both substantive as well as procedural, of the laws of
the State of Oklahoma relating to zoning are exclusive in terms of
powers of the municipality. Accordingly, the effect of such deci-
sion has been to place limitations upon the municipality's handling
of zoning matters. The implication of such opinion has been to the
extent that if and in the event zoning powers originated by virtue

of grant from the people as contained in a charter of a home rule
city, such statutory limitations would not exist. Accordingly, it
is submitted that consideration should be given to inclusion of
such powers as a power granted directly from the qualified electors
of the City and incorporated within the Charter;
2. Article II - The Council,
A. Election of Members of the City Council from Wards
in Lieu of At Large Elections. Amending the manner in which mem-
bers of the City Council are elected to such Council was proposed.
Essentially, modification of Section 2-1 as well as 6.1 and 6.6 of
the City Charter was discussed wherein the present system, such
being City Council members being elected at large by the citizens
of the City, was recommended for deletion and in lieu thereof there
be provided that the members of the Council be elected by qualified
electors of the Ward such Council member represents. The philoso-
phy behind such recommended change is that such would result in the
members of the Council truly representing Wards from which they are
elected.
B. An additional recommendation for Council considera-
tion as relates to the City Council is for abolishment of the
office of Mayor and Vice Mayor and in lieu thereof the Council
govern in a commission format. Essentially, such concept results
in little change insofar as powers are concerned due to the fact
that under the existing City Charter, the office of Mayor, or in
the Mayor's absence the Vice Mayor, possesses only ceremonial
powers, marshal law powers and acts as the presiding official for
the City Council during its meetings. In lieu thereof, the City
Council, or commission as the case may be, would essentially per-
form the same function, however, a presiding official would be
determined on a rotational basis. Further, any ceremonial repre-
sentation of the City would be accomplished via City Council, or
commission; en banc direction. Further, it is contemplated in such
format that insofar as there exists a need for a contact person for
the City of Owasso, Oklahoma, which historically is the Mayor of
said City, that such matter would be delegated unto the City
Manager of the City of Owasso, Oklahoma.
C. It is recommended that Section 2-7--Council Meetings
' be modified to allow for executive sessions to be held as may be
authorized by state law. The change is recommended to allow lati-
tude to the Council to retire into executive sessions to deal with
matters recognized by state law as being properly within the scope
of executive sessions without any unintended limitation arising
from the Charter. Considering the Oklahoma Open Meeting Law is a
matter of statewide concern,_and consequently, obligatory upon the
t City, it is felt that modification of the Charter, which contains

language predating the Oklahoma Open Meeting Law to the extent
Oklahoma law allows, would be advisable.
D. It is recommended that Section 2-11--Council Quorum,
Rules, Yeas and Nays be modified by deletion of the following
phrase, to-wit: "but a smaller number may adjourn from day to day
or from time to time", by reason of such being confusing, as well
as inconsistent with the Oklahoma Open Meeting Law.
3. Article III - City Manager and Administrative Departments
and Article IV Department of Finance; Fiscal Affairs
The Charter Review Committee submits for consideration signi-
ficant reorganization of the administrative departments within the
City. Essentially, the specific submittals are as follows, to-wit:
A. Provide that the office of City Treasurer be an
office of appointment by the Council;
B. Expand upon the existing duties of the position of
City Clerk to encompass the receipt of revenue and remittance of
same to the City Treasurer, the custodian and financial officer of
the City;
C. Provide that City shall, at all times, provide for
the provision of police, fire and ambulance service within said
City; and,
D. Provide for modification of Section 4-4 of the
Charter to require competitive bidding on public improvements in
an amount equal to that as required by the Public Competitive
Bidding Law of the State of Oklahoma.

4. The Charter Review Committee recommends to the City
Council consideration of modification of Article VI relating to '
elections within the City of Owasso, providing the legislative body
with the power to adopt by ordinance provisions for the City
running City elections in alternative to such being run by the ~
Tulsa County Election Board. It appears that a significant savings
could result from the election being conducted by the City as well
as more centralized voting being achieved.
5. The Charter Review Committee recommends to the extent ~
such does not require substantial modification of the Charter, that
all reference to gender be removed. '

SUBJECT: REQUEST TO ESTABLISH A "CHARTER REVIEW
COMMITTEE"
DATE: SEPTEMBER 27, 1990
BACKGROUND:

Pursuant to previous discussions, the purpose of this request is to
establish a Charter Review Committee. The Mayor has indicated that
a good approach to the entire charter review process would be to
form a committee comprised of two Council Members and the City
Attorney. Such a committee would then have the responsibility of
reviewing the existing charter and drafting any changes to that
document considered to be in the best interest of the City.
Based on a research of the Charter, State Statutes, and the Code of
Ordinances it appears that the following sequence of events would
meet the schedule requirements for this endeavor:
Oct. 2, 1990 - Establish committee & appoint members

NOTE: Should the amendments be approved by the voters, the
following steps would be then required:
1. The election must be certified by the County Election
Board. ~
2. The Mayor must authenticate the amended charter and
transmit the document to the Governor.
3. The Governor must review the amended charter and ~
determine if the amendments are in conflict with the
Constitution of Oklahoma.
4. Upon the Governor's approval of the amended charter, ,
it shall become the "organic law" of the City.
RECOMMENDATION
The staff of the City will refrain from active participation in
this process unless specifically requested to research or present
information. There will, therefore, be no recommendation on these
memorandums relating to this issue. We consider this process basic
to the policy makers responsibilities and desire only to be of
service if we are so requested.
It is my understanding, however, that Mayor Thompson will have a
recommendation on this issue.
