Tuesday, February 4, 1997
The Owasso City Council met in regular session on Tuesday, February 4, 1997 in the Council
' Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, January 31, 1997.
ITEM 1: CALL TO ORDER
Mayor Ewing called the meeting to order at 7:05 p.m.

Mayor Ewing presented a proclamation to the presidents of FHA, FFA, and VICA, naming the
week of February 9 -15 as Vocational Education Week in the City of Owasso.
ITEM 5: REQUEST APPROVAL OF THE MINUTES OF JANUARY 21, 1997
REGULAR MEETING.
Ms Barnhouse moved, seconded by Dr Standridge, to approve the minutes as submitted, by
reference made a part hereto.

ITEM 6: REQUEST APPROVAL OF THE CLAIMS
Dr Standridge moved, seconded by Ms Barnhouse, that the following claims be approved as
submitted: (1) General Fund $35,318.51; (2) Workers Comp Self -Ins $3,113.47; (3) Ambulance
Service Fund $253.74; (4) E -911 $1,847.30; (5) City Garage $2,352.95; (6) Capital
Improvements $18,258.55; (7) Payroll $117,642.59; (8) City Garage Payroll $2,278.91.

ITEM 7: REPORT RELATING TO THE STATUS OF THE YMCA RENNOVATION
PROJECT, SUCH PROJECT PURSUANT TO REQUIREMENTS CONTAINED
IN A CONTRACT FOR SERVICES BETWEEN THE CITY OF OWASSO AND
THE YMCA OF GREATER TULSA.
Mr John Swift, Executive Director of the YMCA of Greater Tulsa, and Mr Jim Neal, a member
of the Board of Directors, gave an update on the status of the project. Demolition has begun,
and plans are for the work to be completed and the building open around May 24th, to coincide
with the opening of the swimming pool. Council Helm requested that there be an update at
every Council meeting on the status of construction, until the building is open.
ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF THE PURCHASE OF A 1997
FORD F150 FOR USE BY THE FIRE DEPARTMENT AS A STATION
VEHICLE.
This item was removed from the agenda at the request of staff to allowed additional time for the
department to further research prices and information.
ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
ORDINANCE #536. AN ORDINANCE PROVIDING FOR THE
ANNEXATION OF APPROXIMATELY 8.9 ACRES LOCATED SOUTH OF
THE SOUTHEAST CORNER OF EAST 96TH STREET NORTH AND 129TH
EAST AVENUE ( OWASSO FIRST ASSEMBLY OF GOD).
Ordinance #536 formally adopts the City Council's action of February 21, 1997, approving the
annexation request. Dr Standridge moved, seconded by Ms Barnhouse, to approve
Ordinance #536.

NORTHWEST CORNER OF EAST 116TH STREET NORTH AND GARNETT
ROAD.
Ordinance #537 formally adopts the City Council's action of February 21, 1997, approving the
request to close a public right -of -way. Dr Standridge moved, seconded by Ms Barnhouse, to
approve Ordinance #537.

be ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #97 -05. A RESOLUTION PROPOSING AN AMENDMENT TO
' THE CHARTER OF THE CITY OF OWASSO: AND AUTHORIZING THE
PLACEMENT OF SUCH PROPOSAL ON THE GENERAL ELECTION
BALLOT FOR APRIL 1, 1997; AND NOTIFYING THE TULSA COUNTY
ELECTION BOARD OF THE CALLING OS SUCH ELECTION: AND
ESTABLISHING THE BALLOT TITLE OF THE PROPOSAL.
Resolution #97 -05 was placed on the agenda at the request of Mayor Ewing and relates to
compensation for Councilors for meetings attended. If adopted, the resolution would place an
item on the April 1 General Election Ballot for consideration by the voters. The proposed
amendment of Article 2, Section 2 -3 of the City Charter establishes a compensation rate for
Councilors at one hundred dollars per meeting attended. The Mayor said that he would not be
seeking another term on the Council and would not benefit from such a Charter change, but that
he feels Councilors should receive some compensation for their time and effort. Councilors
Barnhouse and Standridge both stated that they could not support the proposal. Ms Barnhouse
' said that she ran for Council because she wanted to try to help the people in her Ward.
Dr Standridge said that he is proud to serve on a volunteer basis. John Groth, Bob Randolph,
and Jerry Duke, all former mayors, expressed their opposition to Councilors receiving pay. Ms

Melinda Voss, a citizen, also spoke against the proposal, stressing the spirit of volunteerism.
Mayor Ewing moved to approve Resolution #97 -05, proposing an amendment to the City Charter
that would call for an election on the question of Councilor pay. There was no second and the
motion died. No other motions were made.
ITEM 12: REPORT FROM CITY MANAGER
Mr Ray reported that the joint meeting with the Owasso School Board would be held on
March 11th. He said there would be a work session of the Council on February 11th at
6:30 p.m. He also reported on the feasibility study on the impact of permitting electric utility
companies.

ITEM 15: UNFINISHED BUSINESS
Councilor Helm requested an explanation on overtime expenses. Mr Ray explained that the
overtime incurred in the Finance Department was a result of a computer crash that occurred
during a payroll week and required some employees to work extra hours. The overtime shown
in Support Services results from an employee transporting Department of Corrections workers
to their jobs with the City of Owasso. Public Works Department overtime is attributable to
snow removal. The ongoing overtime in the Police Department is because of a resignation and
injuries, where shifts must be covered by other employees. Two firefighters have been out with
injuries, which has caused some overtime in the Fire Department. Councilor Helm also asked
if utility lines at the housing additions around the golf course could be underground instead of
overhead.

The Owasso City Council met in special session on Monday, February 10, 1997 in the
Conference Room at the Owasso City Hall per the Notice of Public Meeting and Agenda posted
on the City Hall bulletin Board at 3:00 p.m. on Thursday, February 6, 1997.

DISTRICT NO. 6 (PLEASANT VIEW) WITH CITY OF OWASSO

BACKGROUND:
February 12, 1997
Homeowners in the Pleasant View Addition (east of Windsor Lake and north of Nottingham)
approached staff in 1995 concerning the ability to connect to City sewers in order to alleviate
septic system problems in their subdivision. The addition is outside the current City limits, but
collection lines were designed in conformance with established city criteria.
The project consisted of installing 1,535 LF of 8 -inch sanitary sewer line. Oklahoma
Department of Environmental Quality construction permit No. SL000072950907 was issued on
February 16, 1996 (see attached permit).
The homeowners elected to form a Sewer Improvement District (Tulsa County Sewer
Improvement District No. 6) and issue bonds to finance construction. The District would like
the City of Owasso to accept the system for operation and maintenance. A work session was
held with some of the Directors of the District on January 14, 1997 to discuss consolidation of
the District with the City of Owasso sanitary sewer system. They are already connected to
sewer lines in Nottingham and receiving service from the City.
CONSOLIDATION PROCEDURE:
Procedurally, a three -step process is required for consolidation to occur as follows:
1 - The District asks the City to accept, operate and maintain the system contingent upon
vote of the District;
2 - The District will then ballot the members, and
3 - Following concurrence with the District members, Council will need to act to
formally accept the system for operation and maintenance.

Step 1 in the process has occurred.
FUNDING FOR THE PROTECT CONSTRUCTION:
As indicated in the attached December 16, 1996 letter, in order to pay for the construction and
installation of the facilities, the District issued bonds in the amount of $103,000.00 payable over
20 -years at an interest rate of 6% per annum. These bonds are funded by ad valorem
assessments against the properties in Pleasant View Addition. The City of Owasso will be
assuming the indebtedness. THIS INDEBTEDNESS DOES NOT REPRESENT A MONETARY
OBLIGATION AGAINST THE FULL FAITH AND CREDIT OF THE CITY OF OWASSO,
BUT IS PAYABLE SOLELY FROM THE PROPERTY ASSESSMENTS.
ACCEPTANCE OF THE SYSTEM:
Design for this system was reviewed and construction inspected by Public Works personnel in
accordance with City of Owasso standards. Construction was inspected by Engineering Division
staff and was completed in June 1996.
Public Works Department Engineering Division personnel conducted a final inspection on July
12, 1996 and were accompanied by a representative of the contractor. A punch list was
forwarded to the contractor and all deficiencies were corrected by July 25, 1996.
Recommendation for accepting the project has been delayed pending consolidation.
One -year maintenance bond has been provided by the contractor (see attached). The contractor
has agreed to extend the original bond to become effective upon Council acceptance of the
sanitary sewer system. Formal acceptance of the system (Step 3 in the above process) will
occur after the District ballots the members for consolidation (Step 2 in the process).
RECOMMENDATION;
Staff recommends Council approval of consolidation of the Tulsa County Sewer improvement
District No. 6 with the City of Owasso system.

This letter will serve to conftmi the meeting or "work session" scheduled for "T'uesdav
evening, January 14, 1997, at 6:30 p.m. in the basement or lower level of the Owasso City Hall,,
at 2017 South Cedar, in Owasso, at which one or more of the Directors of the Tulsa County Sewer
Improvement District No. 6 will meet with the members of the City Council, as well as the City
Manager and, presumably, the City's Public: Works Director, regarding the consolidation of the
District with the City of Owasso, pursuant to the provisions of 19 O.S. 1991 § §898.1 el seq.
As I mentioned to you in my letter of August 15, 1996, the District was organized by the
Board of County Commissioners of Tulsa County on February 26, 1996, in accordance with the
provisions of 19 O.S. 1991 § §871 el .seq_ The sanitary sewer facilities within the .District are in
place and completed, and they have been connected to the City's sanitary sewer systern and are
presently in operation. On behalf of the District 1 have previously made a formal request by the
Board of Directors of the District, for the consolidation of the District with the City of Owasso,
' pursuant to which the sanitary sewer facilities constructed within the District, and any easements
and rights of way therefor, and all hereditaments appertaining thereto, would be transferred to
and become part of the City of Owasso's sanitary sewer system. Under §898.2, the City would
also assume the bonded indebtedness of the District (as described above), and the properties
- %6thin the District would. assume any legal bonded indebtedness of the City of Owasso.
' In order to pay for the construction and installation of the sewer facilities, the District
issued 103 Sewer Improvement Bonds, each in the amount of $1,000.00 (for a total of
' $103,000.00), dated May t, 1996, bearing interest at the statutory rate of 6% per annum,
maturing at various dates over the next twenty years, according to the provisions of 19 0.S. 1991
§884_ As you know, assessments have been levied through the Office of the Tulsa. County
Treasurer, under the provisions of 19 0.5.1991 §890, for the 1996 ad valorem tax year.

February 13, 1997
On February 5, 1996, the City of Owasso was notified that the Oklahoma Highway Commission
had authorized the Department of Transportation to participate in the construction of an
industrial access road to provide access to the ONG Workcenter. The ODOT Director has now
formalized that project with a proposed contract and requested that the City of Owasso execute
the attached Project Agreement in order that funds can be set aside for construction of the road.
The staff has reviewed the contract and finds it to be consistent with terms previously negotiated.
The contract requires the City to develop engineering and construction plans (already completed)
and acquire the right -of -way. In return, the ODOT agrees to reimburse the City for the cost of
the industrial access road in an amount not to exceed $60,000. The grant funds can be used
only to construct the surface of the roadway and cannot be utilized for base or subgrade
preparation. Tulsa County has agreed to perform about $117,000 worth of construction work
on this project. Without that assistance, the roadway could not have been accomplished.
RECOMMENDATION:
The staff recommends that the Council approve the "Project Agreement" between the City of
Owasso and the Oklahoma Department of Transportation, and authorize the mayor to execute
the document.

This Agreement, made the day and year last written below, by and between
the City of Owasso, hereinafter referred to as the CITY, and the Department
of Transportation of the State of Oklahoma, hereinafter referred to as the
DEPARTMENT, is for the following intents and purposes and subject to the
following terms and conditions, to -wit:

WHEREAS, the DEPARTMENT is in receipt of a request by the CITY that the
CITY be permitted to engineer and let a contract to construct an Industrial ,.
Access Project and to be reimbursed by the DEPARTMENT for the cost of
surfacing materials upon satisfactory completion of the work from the funds
allocated by the Transportation Commission for the project; and
WHEREAS, the Transportation Commission did at its regular meeting of
February 5, 1996 an Agenda Item allocating $60,000 (sixty thousand dollars)
for the purpose of participating with the CITY in constructing an '
Industrial Access Project serving the ONG Service Center. The project will
begin on 96th Street just west of US 169 and extending south approximately
1,140 feet.
NOW, THEREFORE, it is mutually agreed by the CITY and the DEPARTMENT that:
1. The CITY agrees to provide all plans, specifications and
construction cost estimates for this project.
2. The CITY agrees to adjust or relocate or cause the adjustment or
relocation, at the CITY's sole expense, of all utility facilities
as may be reasonably necessary or convenient to accommodate
construction of the project.
3. The CITY warrants that all rights -of -way needed for the
construction of said project shall be free and clear of all
obstructions and encumbrances of whatsoever nature, which would w
interfere with construction of the project, including but not
limited to utility poles, pipelines, buildings, signs and other
facilities above or below the surface of the ground.
4. The CITY shall, by resolution, duly authorize the execution of
this AGREEMENT by proper officials, and attach copies of such
resolution to this AGREEMENT.
5. Upon approval of this AGREEMENT by the DEPARTMENT, the CITY shall
advertise and let the contract for this project in the usual and
customary manner. The CITY shall assume total responsibility for
the construction, inspection and completion of this project.
6. The CITY shall appoint competent supervision of the construction

7. It is further understood and agreed that upon completion of said

The City of owasso and its Economic Development Authority have recently completed
negotiations with Oklahoma Natural Gas Company that will bring approximately thirty new jobs
to our community.
The project consists of the construction of a 1.2 million dollar facility that will house one of
ib ONG's new decentralized customer service centers. The Owasso Economic Development
Authority will finance the center and property and provide the site with water, wastewater and
an access road into the site. Our approach has resulted in agreements with the company and the
to landowner that will also make additional land available for future industrial development
opportunities.

We have funds to complete the improvements for water, wastewater, drainage and zoning
requirements. However, funding for approximately 1100 feet of roadway is not available
through local sources. Therefore, please consider this correspondence as an official request for
assistance from the Department of Transportation for an Industrial Access Road Grant in the
amount of $110,000. A 1.2 million dollar private investment and an additional $200,000 local
investment (from the sale of the land to ONG) is directly dependent upon our success in
acquiring this funding.
The City of Owasso has demonstrated success in two previous projects wherein industrial access
road funds were granted by your agency. Those two projects have created 320 new jobs for
Oklahoma and Owasso. This third project, while not as large, will be another positive step for
our community, one of Oklahoma's best corporate citizens, and the State of Oklahoma.

LOCATION: Commission Districts II and VIII
B. Commission District VIII - Tulsa County
The City of Owasso has requested the Department to construct an
Industrial Access road to serve a new Oklahoma Natural Gas customer
service center located west of US 169 on 96th Street North in Tulsa
County. This new center is estimated to cost $1,200,000 and it
will initially employ 30 people with an annual payroll of $760,000.
The proposed access road will begin on 96th Street just west of US
169 and extend south approximately 1140 feet to the parking area of
service center. The City of Owasso will provide all rights -of -way,
utility relocations, engineering, grading, drainage, and surfacing
work on this -project. Upon completion of the access road and
submission of appropriate expenditure documentation, the Department
will reimburse the City an amount not to exceed $60,000 for the
surfacing work only on this project. _ --
In accordance with Oklahoma Transportation Commission Rules,
Regulations, Policies and Procedures, Article IV -A, Section 13,
work on these two Industrial Access roads in Madill and Owasso will
not proceed until the cities have entered into agreements with the
Department to complete the projects as stated and have agreed to
adequately maintain the roads upon completion-
The Department recommends Commission approval to add these projects
to the Industrial Access Road program for State Fiscal Year 1996.

On January 2, 1997, the City Council met in special session and adopted Resolution #97 -01, a
r resolution providing notice of a proposed change in the City of Owasso Ward Boundary Map.
That notice was published on January 3 and included a map showing the proposed change. A
special meeting of the City Council was scheduled for February 3 to consider the ordinance, but
was not conducted due to a lack of quorum.
' Ordinance #535 is proposed as the appropriate method of removing the above described property
from Ward 2 and placing it in Ward 1. The ordinance simply alters the Ward Boundary Map
and attaches the new map as Exhibit "A" as the "official" Owasso Ward Boundary Map of the

Resolution #97 -01 provides for the calling of a Special Meeting of the Owasso City Council to
consider the adoption of an ordinance, with an emergency clause, that would change the
boundaries of Wards 1 & 2 of the City of Owasso Ward Boundary Map. A small tract of land
to the east of Bailey Ranch Estates would be removed from Ward 2 and placed in Ward 1 if the
ordinance is adopted. Resolution #97 -01 calls for the Special Meeting to be held at 7:30 a.m.

BACKGROUND:
The purpose of this memorandum is to request Council action to change the current school speed
zone regulation by adoption of Ordinance #538. Part 15, Chapter 4, section 15 -402 of the Code
of Ordinances of the City of Owasso currently regulates school speed zones at a maximum of
25 mph. The signs posted within the school zones display that the maximum speed in the school
zone to be 20 mph. Police officers cite violators when the speed is in excess of 20 mph, as
posted. The majority of violators pay the citation without appearing in court. The ordinance
discrepancy was noted several weeks ago when a violator appeared in court on an appeal and
the judge noted the difference between the ordinance and the posted speed signs.
The normal speed through a residential area is 25 mph. The school speed zones were reduced
to 20 mph several years ago and the ordinance should have been modified at that time.
The City Attorney Ron Cates has coordinated with the city prosecuting attorney and the city
judge with regard to this ordinance modification.
RECOMMENDATION•
The staff recommends City Council approval of Ordinance #538.

BACKGROUND:
The State Legislature recently passed the "Prevention of Youth Access to Tobacco Act ". In
response to that legislation, the staff has developed a City Ordinance that, if adopted, prohibits
the sale, possession and use of all tobacco products by any person under the age of 18.
Additionally, the ordinance prohibits the distribution of any tobacco product samples within 300
feet of any school, playground or other facility primarily used by any person under 18.
The proposed ordinance allows violators to be cited and receive a fine if convicted. The
convicted violator could, under this ordinance, receive a first offense fine of $25.00. With the
second conviction comes a $50.00 fine, and the third and subsequent convictions are $75.00 if
they occur within a one year period. These are the maximum penalties as allowed by state
statute. The citation does not automatically require a mandatory court appearance, though the
judge may mandate an appearance.
RECOMMENDATION•
The staff recommends City Council approval of Ordinance #539.

adopting the following provisions, to be codified as Section 10 -419 - Tobacco to Minors, to -wit:

A. As used in this Ordinance
(1) "Person" means any individual, firm, fiduciary, partnership, corporation, trust, or
association, however formed, '
(2) "Proof of age" means a driver license, license for identification only_ or other generally
accepted means of identification that dCSCI ilhes the individual as eighteen (IS) vlars oI aux 01 uldrr '
and contains a photograph or other likeness of the individual and appears on its face to be valid.
(3) "Sample" means a tobacco product distributed to members of the public at no cost for
the purpose of promoting the product.
(4) "Sampling" means the distribution of samples to members of the public in a public
place. and,
( >) "Tobacco product" means any product that contains tobacco and is intended for '
human consumption.
B (1) It is unlawful for any person to sell or furnish in any manner any tobacco product to ,
another person who is under eighteen ( i 8) years of age, or to purchase in any manner a tobacco
product on behalf of any such person Pravided, however. that it shall not be unlawful for an
employee under eighteen (18) years of age to handle such products when required in the performance '
of the employee's duties
(2) A person engaged in the sale or distribution of tobacco products shall demand proof '
of age from a prospective purchaser or recipient if an ordinary person Would conclude on the basis
of appearance that the prospective purchaser may be under eighteen (18) years of age.
(3) When a person violates subsection B(1) of this section, the ,Municipal Court shall '
assess such person a fine of Twenty -five Dollars ($25.00) for the first offense within a one -year
period, Fifty Dollars ($50.00) for the second offense within one -year period, and Seventy -five Dollars
($75.00) for a third offense or subsequent offense within a one -year period. Proof that the defendant
demanded, was shown, and reasonably relied upon proof of age, shall be a defense to any action
brought pursuant to this subsection
' (4) If the sale is made by an employee of the owner of a store at which tobacco products
are sold at retail, the employee shall be guilty of the violation and shall be subject to the fine.
' (5) Upon failure of the employee to pay the fine within ninety (90) days of the day of the
assessment of such fine, the Municipal Court Clerk shall notify the Department of Public Safety and
the Department shall suspend or not issue a driver license to said employee until proof of payment
has been furnished to the Department of Public Safety.
' (6) . For purposes of determining the liability of a person controlling franchises or business
operation; in multiple locations ror am, v iolar loa of subsection A or B of this section, rash indiyidual
franchise or business location shall be deemed a separate entity
' C (1) It is unlawful for a person who is under eighteen (18) years of age to purchase, or
accept receipt of, or have in their possession a tobacco product, or to present or offer to any person
' any purported proof of age which is false, fraudulent. or not actually his or her own, for the purpose
of purchasing or receiving any tobacco product. Provided, however, that it shall not be unlawful for
such it person to handle such tobacco product \\ hen required in the performance of such person's
duties.

(2) When a person violates subsection C(1) of this section, the Municipal Court shall
assess such person a fine of Twenty -five Dollars ($25 00) for a first offense within a one -year period,

IBACKGROUND:
The Oklahoma Highway Safety Office has awarded a grant to the Owasso Police Department.
t The grant consists of providing the Department with three video camcorders and two radar units
through the STORMS project. STORMS (Start Taking Oklahoma Roads More Seriously) is a
Highway Safety sponsored project designed to reduce traffic accidents and injuries. The Owasso
' Police Department has been an active member and supporter of the many programs which are
initiated from the Highway Safety Office.
The donation includes two new single antenna K -band radars valued at $1,000 each and three
low new dash mounted video camcorders valued at approximately $2,700 each. The total value of
the equipment to be received is estimated at over $10,000.
It is through the department's involvement with the traffic coalition that has qualified the
department to receive this equipment. The equipment listed will be installed in marked police
' vehicles for use in the patrol division.
There is no match required by the City to receive this equipment. All equipment will become
' the property of the City of Owasso and will be shown on the fixed asset record for the Owasso
Police Department.
Is RECOMMENDATION:
' Staff recommends Council approval on the acceptance of the grant and the donation of radars
and camcorders valued at over $10,000.00.

COUNTRY ESTATES II

BACKGROUND
The City of Owasso has received a request from A &W Development to review a final plat for
Country Estates II. Country Estates II is located north of Country Estates and is north and west
of the northwest corner of E. 116th Street North and Garnett Road. A location map, as well
as a copy of the Country Estates plat have been attached for your information and review. The
proposed final plat would contain approximately 193 single - family residential high density lots
on 48.14 acres, more or less. The subject property was rezoned from AG (Agriculture) to RS -3
(Residential Single - Family High Density) in May of 1995.
The Technical Advisory Committee reviewed the preliminary plat for Country Estates II at their
May 1, 1996 regular meeting. At that meeting, area utility companies had the opportunity to
request additional service easements, as well as utility easements for street lighting. All of these
requested easements were included on the final plat reviewed and approved by the Planning
Commission on May 14, 1996.
The final plat was reviewed by the Technical Advisory Committee at their January 29, 1997
regular meeting. Staff had identified several missing lot lines as well as errors within the
covenants of the plat prior to the TAC meeting and met with the applicant's engineer. All of
those concerns were addressed and the corrections are included within the plat enclosed.
At the TAC meeting, however, utility companies requested two minor corrections /additions to
the plat:
1. The 5' utility easements located on the property lines of Lots 5 and 6, Block
1 need to be changed to the property lines between Lots 6 & 7, Block 1.
2. South of Lots 5 thru 9, Block 12 a separate 11' utility easement needs to be
filed by separate instrument.
All other concerns by staff and the utility companies have been addressed at this time.
Construction plans have been reviewed and approved by the Engineering Division of Public
Works and permits from DEQ have been issued for the construction of water and sanitary sewer.
Additional requirements of this plat are that sidewalks will be required along Garnett Road, as
well as acceleration /deceleration lanes.
The Planning Commission reviewed the final plat at their February 13, 1997 meeting and
unanimously recommended approval of the final plat.
RECOMMENDATION
Staff recommends Council approval of the final plat for Country Estates II, subject to the
inclusion of the easement corrections /additions requested from the Technical Advisory
Committee.

Pursuant to O.S. 27A 2 -6 -401, the City of Owasso is hereby granted this permit to construct
10,847 L.F. of eight (8) inch PVC sewer lines and appurtenances to serve the Country Estates
II Addition, located in SE-1/4, Section 6, T -21 -N, R -14 -E, I.M., Owasso, Tulsa County,
Oklahoma, in accordance with the plans and specifications approved on November 14, 1996.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in
accordance with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the state
certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted
thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date
of approval or the phases not under construction will be resubmitted for approval as a
new project.
3) That no significant information necessary for a proper evaluation of the project has
been omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with OAC 252:655- 9 -1(h) of the
Standards for Water Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer
lines will prevent excessive infiltration and that the leakage will not exceed 200 gallons
per inch of pipe diameter per mile per day.

6) That the State Department of Environmental Quality shall be kept informed of
occurrences which may affect the eventual performance of the works or that will
unduly delay the progress of the project.
7) That the permittee will take steps to assure that the connection of house services to
the sewers is done in such a manner that the functioning of the sewers will not be
impaired and that earth and ground water will be excluded from the sewers when the
' connection is completed.
8) That any deviations from approved plans or specifications affecting capacity, flow or
operation of units must be approved by the Chief Engineer before any such deviations
' are made in the construction of this project.
9) That the recipient of the permit is responsible for the continued operation and
maintenance of these facilities in accordance with rules and regulations adopted by the
Environmental Quality Board, and that this department will be notified in writing of any
sale or transfer of ownership of these facilities.

liabilities which the permittee may be under pursuant to prior enforcement action taken by

Board, and that this department will be notified in writing of any sale or transfer of ownership
of these facilities.
9) The issuance of this permit does not relieve the responsible parties of any obligations
or liabilities which the permittee may be under pursuant to prior enforcement action
taken by the Department.
10) That whenever plastic pipe is approved and used for potable water, it shall bear the seal of the
National Sanitation Foundation and meet the appropriate commercial standards.
11) That water lines shall be located at least fifteen (15) feet from all parts of septic tanks and
absorption fields, or other sewage treatment and disposal systems.
12) That there shall be no cross - connection made between this public water system and any
private water system or other source of possible contamination. In addition, any existing
individual sewage disposal systems shall be approved by the County or State Department of
Environmental Quality prior to completing the service connection to the public water system.
All individual sewage disposal systems constructed after the permitted water lines have been
placed into service shall be constructed in accordance with the Residential Sanitation rules
(OAC 252:640) and be approved by the local Department of Environmental Quality prior to
completing the service connection to the public water system. It shall be the responsibility of
the permittee to provide inspection of the plumbing installations.
13) That any notations or changes recorded on the official set of plans and specifications in the
State Department of Environmental Quality files shall be part of the plans as approved.
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will constitute
acceptance of the permit and all conditions and provisions.

BACKGROUND:
The Owasso Planning Commission held a public hearing on February 13, 1997 to review a
rezoning request of property from AG (Agriculture) to OM (Office Medium) for property
containing approximately 8.9 acres located south of the southeast corner of E. 96th Street North
and N. 129th E. Avenue. The subject property is described as Lot 1, Block 1, Owasso First
Assembly of God, and is developed as a church site. A copy of the complete staff report is
attached for your information and review.
The applicants are requesting the rezoning to OM in order to allow for the continued operation
of the church at that location by right. It is important to note that if the OM zoning is approved,
no further review processes would be required for the church to continue operations unless an
expansion of 2,000 square feet or larger is sought by the church. OM zoning is also present to
the west of the subject property.
Notices of the rezoning request were mailed to property owners within 300 feet of the subject
' property and legal notice was published in the Owasso Reporter. The subject property was also
posted the last week of January. The only comment regarding the rezoning received by staff
was in support of the request and it is attached for your information and review.
If the Council approves the rezoning request, an ordinance will be presented at the March 4,
1997 meeting to formally adopt the actions of the Council. The Planning Commission
unanimously approved the rezoning request from AG (Agriculture) to OM (Office Medium).
RECOMMENDATION:
Staff recommends approval of the rezoning request from AG to OM.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Owasso First Assembly of God, Inc.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
AG (Agriculture) to OM (Office Medium) to allow recently annexed property that contains a
church to be permitted outright.
LOCATION AND SIZE: The property is located south of the southeast corner of E. 96th
Street North and N. 129th E. Avenue and is described as Lot 1, Block 1, Owasso Assembly
of God. The subject property contains approximately 8.90 acres, more or less.
EXISTING LAND USE: The subject property is developed as a church.
SURROUNDING LAND USE: The subject property is abutted on the north by a residence
and undeveloped property, both located in Tulsa County, zoned CS (Commercial Shopping
Center) while further north lies E. 96th Street North. The subject site is bordered on the
west by N. 129th E. Avenue, while further west lies additional OM (Office Medium) zoning
which is not developed. The subject property is bordered on the south by AG zoned
property, also in Tulsa County, developed as a church. East of the subject property lies the
Windsor Lake Addition zoned RS -2 (Residential Single - Family Medium Density).
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 5 "Office Land Uses ".
SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The proposed rezoning, if approved, would allow the Owasso First Assembly of God church
to operate as a permitted use at that location. The applicants, upon annexation, had 4
options:
1. To exist as a non - conforming use until anytime they planned future
enlargement of their facility.
2. To obtain a Special Exception through the Owasso Board of Adjustment in
order to operate under the AG (Agriculture) zoning.
3. To rezone the property to any Commercial designation in order to be permitted
by right.
4. To rezone the property to an OM designation in order to be permitted by
' right.
Staff was clear at the time of annexation that commercial zoning would not be supported and
the applicants were clear that they had intended to pursue OM zoning if annexed. OM
zoning is established immediately west of the subject property and appears to be a logical
buffer to the RS -2 zoning found to the east... commercial zoning at this location would not be
logical in the event the property ever changed hands.
With the subject property being developed as a church, OM zoning allows for the applicants
to build extensions to the existing facility without the Board of Adjustment approval process.
Please understand, however, that any expansion larger than 2,000 square feet would still
require Planning Commission site plan review.
Letters were sent to surrounding property owners within 300' of the subject property and
1 notification was published in the Owasso Reporter. Staff has received one comment in favor
of the rezoning request and a copy of it, as well as copies of the legal advertisement and
letter to property owners, are attached for your information and review.
RECOMMENDATION
' Staff recommends approval of the rezoning request to OM.

MEMORANDUM

BACKGROUND:
In 1973, the Fire Department purchased vehicles from the Oklahoma Highway Patrol surplus. These
vehicles typically had over 100,000 miles and would have a life span of a few years. In 1978, the
department purchased a station wagon as a station vehicle and utilized it into the 1990's. Due to the
allocation of Capital Outlay funds, we have not been able to replace this vehicle until now.
The money for this vehicle has been saved in the form of Carry-Over funds. This has been
accomplished by applying cost efficient, money management to previous purchases from the Capital
Outlay Budget.
For the past five years, the department's Capital Outlay Committee has prioritized Capital Outlay
expenditures based on the needs of the department so that the best and most cost efficient service
could be given to the citizens of Owasso.
The committee based it's prioritization on the facts that emergency vehicles are taken out of service
for non - emergency tasks. The intended use of this vehicle would be for retrieving medical
equipment which had to be left at the Tulsa hospitals, transporting personnel and equipment to
training classes, providing a means of transporting manpower and extra supplies to emergency scenes,
and performing routine tasks locally like picking up food and/or station supplies.
' The committee has developed specification based on the intended use of the vehicle, and Oklahoma
Department of Central Services "State Bid" meets those specifications. All additional equipment
needed to meet department's requirements for emergency accessories (light bars, sirens, radios, etc.)
will be supplied from surplus at the department.
■ RECOMMENDATIONS:
Three bids from local vendors are included for your review. Other vendors in Tulsa were contacted
also, but all bids were higher than those obtained locally. After researching the cost of new vehicles,
used vehicles, and comparing them with the "State Bid" price the Capital Outlay Committee would
recommend purchasing this vehicle through the "State Bid" process.

The staff will recommend Council approval of an expenditure in the amount of $15,278 to Fred Jones
Ford, Oklahoma City, Oklahoma for the purchase of one 1997 Ford F150, and authorization for
payment. Such purchase price established by state bid #BP 12941 through the Oklahoma Department
of Central Services.
Funding for this vehicle was approved in FY 96 -97 Budget.

OWASSO RECREATION CENTER BY YMCA

BACKGROUND:
Prior commitments prevent Mr Swift from attending Tuesday's Council meeting. However, he
has submitted a brief update regarding the rennovation of the Recreation Center for the YMCA.
That report is attached for your review.
As requested by Councilor Helm, I have scheduled a status report on the YMCA project as an
agenda item for each Council meeting. The staff will visit the project site prior to the meetings
and will be prepared to answer questions from the Councilors. Additionally, I have requested
that Mr Swift provide a regular written status report that can be transmitted to the Council for
your review.

Update on YMCA Building Renovations.
As of today, February 12, 1997, most of the interior demolition work is complete.
The old office needs to be removed, as well as a second floor front walk.
Footings have been dug for the new Block interior walls and the contractor
cstimates those walls are to be poured on Friday, February 14, 1997.
Construction is on schedule.
