Mr Rooney ' Attachment #11 The staff has acquired information relating to the zoning request, met with representatives ' of the company, and will attend the zoning hearing on Tuesday, March 4 in Claremore. At the Council meeting a report will be given to update the Council relative to the Rogers County Planning Commission action and options available to the City Council. 1 1 12. Consideration and Appropriate Action Relating to the Repair of a 1996 Patrol Vehicle. Mr Harder Attachment #12 ' The staff will recommend City Council approval of repairs to a 1996 patrol vehicle damaged in an accident; such bid for repairs to be awarded to Pruitt's Body Shop in the ' amount of $8355.83, and authorization for payment. The staff will further recommend that the City Manager be authorized to approve additional expenditure for parts and labor which may be identified during the repair process. 1 1 in Owasso City Council March 4, 1997 Page 4 13. Consideration and Appropriate Action Relating to a Seat Belt Policy. Mr Harder Attachment #13 The staff will recommend Council approval of a seat belt policy, whereby anyone who is driver or passenger in a city -owned vehicle, and anyone who is utilizing a privately -owned vehicle while on city - related business, is required to wear a seat belt. 14. Report Relating to the Status of the Construction of Improvements by the YMCA to the Owasso Recreation Center. Mr Ray ' Attachment #14 The staff will report to the City Council the status of the project to construct improvements to the City -owned Recreation Center, now leased to the YMCA. 15. Adjournment 7 OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, February 18, 1997 The Owasso City Council met in regular session on Tuesday, February 18, 1997 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, February 14, 1997. ITEM 1: CALL TO ORDER Mayor Ewing called the meeting to order at 7:10 p.m. ITEM 2: INVOCATION The invocation was given by Pastor Jim Rawls of the Owasso New Hope Baptist Church. ITEM : FLAG SALUTE Vice Mayor Ramey led in the flag salute. 1 ITEM 4: ROLL CALL PRESENT Danny Ewing, Mayor Joe Ramey, Vice Mayor Michael Helm, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ABSENT Mary Lou Barnhouse, Councilor Tracy Standridge, Councilor ITEM 5: REQUEST APPROVAL OF THE MINUTES OF FEBRUARY 4. 1997 REGULAR MEETING AND FEBRUARY 10, 1997 SPECIAL MEETING. I Mayor Ewing moved, seconded by Mr Helm, to approve the minutes as submitted, by reference made a part hereto. AYE: Ewing, Helm, Ramey NAY: None Motion carried 3 -0. ho 11 1 Owasso City Council February 18, 1997 ' ITEM 6: REQUEST APPROVAL OF THE CLAIMS. Councilor Helm referred to an item under Police Services for the lease of a copier. The lease is held by a bank in Claremore. Mr Helm requested that staff check to see if the legse could go through a local bank. Mr Ramey moved, seconded by Mr Helm, that the followiflg claims be approved as submitted: (1) General Fund $40,443.31; (2) Ambulance Service Fund $445.44; (3) City Garage $1,140.91; (4) Capital Improvements $1,022.37; (5) Payroll $118,190.46; (6) City Garage Payroll $2,278.91. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CONSOLIDATING TULSA COUNTY RURAL SEWER IMPROVEMENT DISTRICT #6 (PLEASANT VIEW ADDITION) INTO THE CITY OF OWASSO SANITARY SEWER FACILITY. Homeowners in the Pleasant View Addition, which is not in the city limits, approached the staff in 1995 with regard to connecting to the city sewer system in order to alleviate septic system problems in their subdivision. The homeowners formed a sewer improvement district and issued bonds to finance construction of collection lines. Those lines were constructed in conformance with city standards, and were inspected by Public Works personnel. The sewer district would now like for the city to accept, operate and maintain the system. A one -year maintenance bond has been provided by the contractor, who has agreed to extend the original bond to become effective upon acceptance of the system by the City Council. That acceptance will become effective after the sewer district ballots the members for their approval. Mr Ramey moved, seconded by Mr Helm, to accept, operate and maintain the sanitary sewer system constructed by Tulsa County Rural Sewer Improvement District #6, contingent upon vote of the district. Pa 1 t II Owasso City Council February 18, 1997 ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A PROJECT AGREEMENT BY AND BETWEEN THE CITY OF OWASSO AND THE OKLAHOMA DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF AN INDUSTRIAL ACCESS PROJECT ROADWAY TO THE ONG WORKCENTER, AND AUTHORIZATION FOR THE MAYOR TO EXECUTE THE DOCUMENT. The City of Owasso has been notified that the Oklahoma Highway Commission has authorized the Department of Transportation to participate in the construction of an industrial access road to provide access to the ONG Workcenter. ODOT has requested that the City of Owasso execute a Project Agreement in order that funds can be set aside for construction of the road. The Agreement requires that the City develop engineering and construction plans, which have already been completed), and acquire the right -of -way. In return, ODOT agrees to reimburse the City for the cost of the industrial access road in an amount not to exceed $60,000. These funds can be used only to construct the surface of the roadway and cannot be utilized for base or subgrade preparation. Tulsa County has agreed to perform about $117,000 worth of construction work on this project. Mr Ramey moved, seconded by Mayor Ewing, to approve the Project Agreement between the City of Owasso and the Oklahoma Department of Transportation, and to authorize the Mayor to execute the document. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #535, AN ORDINANCE AMENDING WARDS 1 AND 2 OF THE CITY OF OWASSO, OKLAHOMA COUNCIL WARD BOUNDARIES MAP. On May 16, 1995, the City annexed a small tract of land located immediately east of Bailey Ranch Estates and contiguous to the existing corporate limits of the city. The property was placed in "Ward 2" upon annexation. At that time, assurances were made to the Council that the tract would be "reapportioned" prior to the 1997 elections and placed in Ward 1. The property is actually contiguous to Ward 1 rather than Ward 2. On January 2, 1997, the City Council met in special session and adopted Resolution #97 -01, a resolution providing notice of a proposed change in the City of Owasso Ward Boundary Map. That notice was published on January 3 and included a map showing the proposed change. A special meeting of the City Council was scheduled for February 3 to consider the ordinance, but was not conducted due to a lack of quorum. If approved, Ordinance #535 will remove the property from Ward 2 and place it in Ward 1 effective March 27. The ordinance simply alters the Ward Boundary Map —' 3 Owasso City Council February 18 1997 ' and attaches the new map as Exhibit "A" as the "official" Owasso Ward Boundary Map of the City of Owasso. Ordinance #535 does not affect any person's voting status in the electorial process in either the upcoming or future elections. Mr Ramey moved, seconded by Mayor Ewing, to approve Ordinance #535. AYE: Ramey, Ewing, Helm ' � g, NAY: None ' Motion carved 3 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ' ORDINANCE #538, AN ORDINANCE REDUCING THE SPEED LIMIT IN SCHOOL ZONES. This item was removed from the agenda at the request of staff to allow for language clarification. It will be placed on the March 4th agenda. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE #538. This item was also removed from the agenda until such time as Ordinance #538 is considered by the Council. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING ORDINANCE #539, AN ORDINANCE RELATING TO TOBACCO DISTRIBUTION TO PERSONS UNDER THE AGE OF 18 YEARS. As a result of the state legislature passing the "Prevention of Youth Access to Tobacco Act ", the city staff has developed an ordinance that, if adopted, prohibits the sale, possession and use of all tobacco products by any person under the age of 18. It also prohibits the distribution of any tobacco product samples within 300 feet of any school, playground or other facility primarily used by any person under 18 years of age. The ordinance defines penalties and fines. Mr Ramey moved, seconded by Mr Helm, to approve Ordinance #539. AYE: Ramey, Helm, Ewing NAY: None Motion carried 3 -0. 4 P ' Owasso City Council February 18, 1997 1 ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ACCEPTANCE OF AN EQUIPMENT GRANT TO THE OWASSO POLICE DEPARTMENT FROM THE OKLAHOMA HIGHWAY SAFETY COUNCIL. The Owasso Police Department has received a grant from the Oklahoma Highway Safety Council through the "Start Taking Oklahoma Roads More Seriously" project, consisting of three video camcorders and two radar units. The estimated value of the grant is over $10,000, and no ' match is required. Mr Ramey moved, seconded by Mr Helm, to accept the grant of equipment from the Oklahoma Highway Safety Office. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE FINAL PLAT FOR COUNTRY ESTATES II, LOCATED NORTH OF COUNTRY ESTATES ADDITION AND -- CONTAINING 193 RESIDENTIAL LOTS OF 49 ACRES, MORE OR LESS. The City received a request from A &W Development to review a final plat for Country Estates II. Country Estates II is located north of Country Estates and is north and west of the northwest corner of East 116th St N and Garnett Rd. The final plat was reviewed by the Technical Advisory Committee at their January 29th meeting and several concerns were expressed by the utility companies. Those concerns have been addressed and the corrections made. The Planning f. Commission reviewed the final plat on February 13th and unanimously recommended approval. Questions were raised on whether or not the streets in Country Estates have been accepted by the city. Mr Carr said that the streets have not been accepted, but the sanitary sewer and water lines have been accepted. Vice Mayor Ramey suggested postponing approval of the final plat until the developers could be present to answer questions. Mr Ray explained that delaying ' approval of the plat because the streets have not yet been accepted in Country Estates would not be a legitimate reason for denial. Following further discussion, Mr Ramey moved, seconded by Mr Helm, to approve the final plat for Country Estates II. 6.. AYE: Ramey, Helm, Ewing on NAY: None Motion carried 3 -0. Ib 0 5 Owasso City Council February 18 1997 ' ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO REZONE 8.9 ACRES ON LOT 1, BLOCK 1. OWASSO FIRST ASSEMBLY OF GOD FROM AG (AGRICULTURE) TO OM (OFFICE MEDIUM). The city has received a request to rezone approximately 8.9 acres of land south of the southeast corner of East 96th St N and North 129th E Ave from AG to OM. The tract contains the Owasso Assembly of God Church. The Planning Commission unanimously approved the request, and the only comment received by staff was favorable. Mr Ramey moved, seconded by Mayor Ewing, to approve the requested zoning. AYE: Ramey, Ewing, Helm NAY: None Motion carried 3 -0. ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF THE PURCHASE OF A 1997 FORD F150 FOR USE BY THE FIRE DEPARTMENT AS A STATION VEHICLE. Fire Department personnel requested the purchase of a vehicle to be used for non - emergency tasks so that emergency vehicles will not have to be taken out of service to be utilized for those non - emergency tasks. Funds for the purchase of the vehicle are available from carry -over budget. Three local vendors were contacted for bids, as well as several vendors in Tulsa. All bids were higher than the State Bid price. The staff recommended the purchase of a station vehicle utilizing State Bid. Mr Ramey moved, seconded by Mayor Ewing, to approve an expenditure in the amount of $15,278 to Fred Jones Ford, Oklahoma City, OK for the purchase of a 1997 Ford F150, through a price established by State Bid #BP12941, and authorization for payment. AYE: Ramey, Ewing, Helm NAY: None Motion carried 3 -0. ITEM 17: REPORT RELATING TO THE STATUS OF THE CONSTRUCTION OF IMPROVEMENTS BY THE YMCA TO THE OWASSO RECREATION CENTER. Mr Ray gave a status report on the Owasso Recreation Center improvements. Most of the interior demolition has been done. Footings have been dug for the new Block interior walls and those walls were poured on Friday, February 14. C IOwasso City Council February 18, 1997 ITEM 18: REPORT FROM CITY MANAGER ' Mr Ray introduced Mr Buz Walker, who is a temporary employee in the Managerial Department; and Ms Angela Henderson, who recently left the employment of the city. Part 15, Chapter 4, section 15 -402 of the Code of Ordinances of the City of Owasso currently regulates school speed zones at a maximum of 25 mph. The signs posted within the school zones display that the maximum speed in the school zone to be 20 mph. Police officers cite violators when the speed is in excess of 20 mph, as posted. The majority of violators pay the citation without appearing in court. The ordinance discrepancy was noted several weeks ago when a violator appeared in court on an appeal and the judge noted the difference between the ordinance and the posted speed signs. The normal speed through a residential area is 25 mph. The school speed zones were reduced to 20 mph several years ago and the ordinance should have been modified at that time. The City Attorney Ron Cates has coordinated with the city prosecuting attorney and the city judge with regard to this ordinance modification. The request ' asks for expansion of an "M" zoning classification to an additional 80 acres north of the existing mining area (see attached map). An "M" designation denotes mining and, if approved, would allow the company to begin mining the property now zoned AG (agriculture). A public hearing ' on the request is scheduled for Tuesday, March 4, at 4:00 p.m. before the Rogers County Planning Commission. Mr Rooney plans to attend the meeting as an observer and on behalf of the City of Owasso as an interested party. Additionally, the staff and Mayor met with Anchor representatives on Thursday, February 27 in an effort to become fully acquainted with the request. The meeting was informative and allowed Anchor to present their plans to the group in attendance. Evidently the plan envisions a rather immediate move of active mining operations ' into the 80 -acre tract if zoning is approved. The Company owns the property and is proposing a 300' buffer around the area to be zoned in what they term as an effort to minimize the impact on surrounding property. It also appears that Anchor's position is that they would rather begin ' mining operations on the tract now, before additional homes are constructed in the area. Their rational for that position seems to be that the quicker the area is mined, the quicker the area can be developed without homeowners experiencing problems with that type of operation. The ' Company representatives also briefed the City delegation on the methods used to monitor blasting and the complaint response system used by the Company. It should be noted that there have been several legal confrontations between area citizens and Anchor during the past years. Generally those confrontations have focused on the problems caused by blasting, dust pollution, and truck traffic. In most cases, those "fights" have resulted in operational changes by the company to reduce the nuisance problems, but the company has continued to receive authority to operate at that location. ROCK QUARRY EXPANSION FEBRUARY 28, 1997 PAGE 2 This request to expand the mining operation to bring it closer to residential areas will, most certainly, be viewed by area citizens as increasing the problems they have experienced and also create some fear that property values will decline. Without the benefit of an in -depth review, the expanded site appears to bring the possibility of having actual mining within 900 feet of a residential subdivision (existing mining is within 600' of a residential subdivision), and within 1500 feet of 76th St N. The staff (Mr Rooney) will attend the Rogers County Planning Commission on March 4 and will present a report to the Council during the City Council meeting. At that time, the staff will also outline options available to the Council. RECOMMENDATION: No recommendation is offered at this time. MEMORANDUM ' TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: POLICE CHIEF MARIA ALEXANDER ALLAN E HARDER REGENA GUTHRIE SUBJECT: REPAIR OF DAMAGED PATROL VEHICLE tDATE: February 26, 1997 BACKGROUND: In December 1996, an Owasso Police officer was involved in a traffic accident on Garnett Road at approximately 116th Street North. Fortunately, the officer was not injured, but the police vehicle was damaged extensively. The accident was investigated by the Oklahoma Highway Patrol and the operator of the other vehicle received a citation; however, that citation was subsequently dismissed in District Court. The insurance company will not settle the accident claim until the liability is completely assessed by all parties. The damaged patrol vehicle needs to be repaired regardless of the assignment of liability. ANALYSIS: ' The vehicle is a 1996 Ford Crown Victoria which is still under warranty. In order to maintain the warranty of the vehicle, the repair must be to factory standards. "Bids" were received from two experienced local vendors. The bids considered were from Pruitt's Body Shop and Foster's ' Body Shop. 1 1 When comparing the bids received, Pruitt's bid appears to be more "parts replacement" comprehensive as well as detailing the requirements from Ford Motor Company regarding maintaining the integrity of the new car warranty. When you compare the parts from each bid against the other, the bids are extremely close in dollar value. Because there may be repairs needed which are not visible when vehicles are heavily damaged, neither company will state that the bid amount would "fix" the vehicle. Therefore, there is a possibility that charges to repair this vehicle will exceed these bids. REPAIR OF DAMAGED PATROL VEHICLE FEBRUARY 26, 1997 PAGE 2 FUNDING: The Collision Self- insurance Fund budget is reserved for payment of expenses resulting from collision repairs to City vehicles. Funds are available and appropriated in an amount sufficient to meet the cost of this repair project. RECONEMENDATION: Staff recommends that Pruitt's Body Shop be awarded the bid to repair this vehicle in the amount of $8,355.83. This recommendation is made even though Pruitt's bid was slightly higher; the bid submitted was more comprehensive. Pruitt's also pointed out the warranty validation requirement from Ford Motor Company. Staff further recommends that the City Manager be authorized to approve additional expenditure for parts and labor which may be identified during the repair process. Prior to increasing the amount of this bid by Pruitt's Body Shop, any additional repairs must be cleared through Regena Guthrie and receive approval from the City Manager prior to additional work being performed. Foster's Body Shop bid Ll I� 1 F1 Am December 30, 1996 COLLISION REPAIRS TO 1996 FORD POLICE CRUISER To Whom It May Concern: Attached please find my Visual Damage Report for the damaged police cruiser. Several years ago, the term" estimate" was dropped by professional collision repairers' in favor of better and clearer terminology. The general public sometimes confused "estimate" with the term "quote ". With the complexity of late model vehicles, and the use of plastic and composite parts, hidden or unseen damage is quite common on repair jobs today. Normally, vehicles have the outer damaged parts removed by one of our technicians before we, or an insurance adjuster will attempt to write a damage report. Then, as repairs progress, if additional damage is found, we contact the owner and or adjuster to keep them informed. After repairs are completed, we then prepare a "supplement" bill. Even the best and most experienced of us are unable to do business under a firm "quote" basis. Because of this, most insurance companies today simply tell their customers to select a repair shop they trust and that has the ability to do good quality repairs and the price will be worked out during the process. All shops use the same manuals (or data bases) for labor times. And original equipment manufacturer (O.E.M.) parts have only one price. We seldom recommend after market or imitation parts. All of us realizes this particular vehicle must at times travel at a very high rate of speed and be expected to stop as fast or faster than the average vehicle. Safety and liability considerations must be a priority. The utmost precaution must be used to return this vehicle to its "pre- accident" condition. Being a taxpayer and a member of the community I do understand the City's responsibility to spend the least and get the most. You must be prudent and spend money wisely. You must be very cautious however of anyone who submits a low up front price and then ends up with a large supplement. Therefor, we have tried very hard to determine all the damage without being able to lift the car or take the front bumper off. We have inspected it twice and believe we have a complete damage report. The new parts will be O.E.M. only, which I believe is a must. This is the only way to retain the balance of the manufacturer's warranty intact. However, there is a possibility of additional damage that must be recognized. (D They are listed on the damage report, designated with an "0" for open items, and highlighted on lines 28, 30, and 34. If they are needed the price will not be known until they are delivered (due to the new model). The * indicates the price is not listed in our database supplied by the manufacturer. We can not get a price on the "Owasso Police" decal stripe. Therefor we do not have that included. page 2 I have checked the feasibility of the vehicle being sold for salvage. The best bid I could obtain was $4,000.00 for the vehicle as is, after the emergency equipment was removed. I do not believe this to be a viable solution as that would be too much of a financial loss to sustain. The damage is not severe enough to cause any future problems if repairs are done correctly. Please be advised we have the best Garage Owners Liability and Garage Keepers Liability Insurance on the market. This means the vehicle will be covered by our company should there be a fire or theft in our shop. It also covers our workmanship in case of a future liability . We have all the necessary equipment to return the vehicle to it's pre- accident condition. My technicians are ASE and I -Car certified and our shop is a designated I -Car Gold Class Facility. Our work is warranted for as long as Owasso owns the car. No one is perfect, and we don't intend to make mistakes, but if we do, we do our best to correct them. We will do our best to return the vehicle to a pre - accident condition and to factory specifications. This is important because a lot of factory warranty remains. Turn around time on this repair should be 12 to 15 working days for us. We could have repairs started within 24 hours of your approval. I regret not being able to attend this council meeting in person. But I will be out of town on vacation. I hope I have answered any and all questions you may have. The policy revision is believed necessary in order to address the increased exposure to liabilities by the City when employees ' are or have been involved in automobile accidents. The policy has been reviewed by and commented on by Department Directors. City Attorney Ronald D Cates also has reviewed it for content. 1 PREVIOUS POLICY STATEMENT: t 1 The previous policy found in the CITY OF OWASSO, OK, PERSONNEL MANUAL, Chapter 9, MISCELLANEOUS, Section 9 -2 USE OF CITY VEHICLES, Item C. states, "All city employees are required to wear seat belts in vehicles so equipped. " EFFECT OF POLICY MODIFICATION: The revised policy will replace the previous policy, and defines more clearly the intent of the City to protect its workers by mandating compliance through expanded policy language. The new policy requires seat belt use in any seat, in any vehicle, while on city business. It further requires employees not to drive or ride in vehicles without seat belts or with inoperable seat belts. Being involved in an accident while in noncompliance with the policy subjects employees to discipline and could jeopardize an employee's Worker's Compensation claims. RECOMMENDATION: The staff recommends approval of the revised policy. ATTACHMENT: 1. Revised Policy Statement City of Owasso Seat Belt Use Policy NOTE: This policy is more restrictive than state law. All employees, while engaged in business for or on behalf of the City, when acting in the course of employment and subject to coverage by the City's Workers' Compensation Program, while either a driver or passenger, regardless of seat location, either in a City owned, non- , owned or privately owned vehicle, shall at all times wear the seat/shoulder belt(s) furnished in the vehicle. If a vehicle does not have i a seat/shoulder belt(s), or the seat/shoulder belt(s) is inoperative, the employee shall not ride or drive such vehicle while engaged in business for, or on behalf of the City. ' All employees involved (either as a passenger or driver) in a collision, ' while engaged in business for, or on behalf of the City, when acting in the course of employment and subject to coverage by the City's Workers' Compensation Program, while either a driver or passenger, regardless of the seat location, either in a City owned, non -owned or privately owned vehicle, and not wearing the furnished seat/shoulder belt(s), shall be subject to departmental discipline, and should a Workers' Compensation claim arise, in accordance with 85 0. S., § 11, the claim may be disqualified from coverage. February 27, 1997 and observed that the majority of the internal block work for the walls is completed. Prior to further sessions, it is important that the Council establish general parameters and direction for those negotiations. State statutes (25 O.S., Section 307 -B(2)) allow the use of an executive session for the purpose of privately discussing negotiations between the municipality and representatives of employee to bargaining units. This request is for the Council to approve entering into executive session for that purpose. RECOMMENDATION: The staff recommends Council action to enter into executive session for the above - described purpose. The staff further recommends that Councilor -elect Dr Bode and, if known, the Councilor -elect from Ward 1 be invited to attend the executive session in order that they may be well informed relative to these negotiations.
