15. Consideration and Appropriate Action Relating to the Establishment of a Public Policy
Regarding the Permitting of Companies Other than the Holder of a Franchise, to Provide
Electrical Service to the Citizens of Owasso, and Giving Direction to the Staff for the
Further Development of Such a Permit or the Cessation of Such Effort.

For the past several months discussions have taken place relating to the issue of allowing
companies other than PSO to provide electrical service to the city. Research has been
completed and addressed to the Council. The staff requires direction from the City Council
and requests that action be taken to move the effort toward producing a final ordinance, or
that action be taken that directs the staff to cease work on the ordinance. Such direction
is considered to be in the best interest of the city in that the legal expense and staff cost to
further develop this issue will be substantial.
16. Consideration and Appropriate Action Relating to a Mayor's Appointment to the Sales Tax
Watchdog Committee.

112 South Main, to the Watchdog Committee to fill a vacant position reserved specifically
for a representative of retail business; and request City Council confirmation of that

_ The Owasso City Council met in regular session on Tuesday, March 4, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, February 28, 1997.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
ORDINANCE #538. AN ORDINANCE REDUCING THE SPEED LIMIT IN
SCHOOL ZONES.
Ordinance #538 would reduce the speed limit in school zones from 25 mph to 20 mph. The
school speed zones were reduced to 20 mph several years ago and that is the posted speed. The
ordinance was not modified at that time. Mr Ramey moved, seconded by Dr Standridge, to
approve Ordinance #538, reducing the speed limit in school zones from 25 mph to 20 mph.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE ATTACHMENT OF AN EMERGENCY CLAUSE TO
ORDINANCE #538.
In order for Ordinance #538 to become effective immediately upon passage, the staff requested
the attachment of an emergency clause. Mr Ramey moved, seconded by Dr Standridge, to
approve the attachment of an emergency clause to Ordinance #538.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
ORDINANCE #540, AN ORDINANCE REZONING 8.9 ACRES ON LOT 1,
BLOCK 1, OWASSO FIRST ASSEMBLY OF GOD FROM AG
(AGRICULTURE) TO OM (OFFICE MEDIUM).
On February 18, 1997, the City Council approved the rezoning of an 8.90 acre tract of land
from AG to OM. The tract is located south of the southeast corner of East 96th Street North
and North 129th East Avenue. Ordinance #540 would formalize that action. Dr Standridge
moved, seconded by Ms Bamhouse, to approve Ordinance #540.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
UESTION OF WHETHER THE OWASSO CITY COUNCIL SHOULD TAKE
A POSITION AND, IF SO, WHAT POSITION SHOULD BE TAKEN
RELATIVE TO A REQUEST MADE TO THE ROGERS COUNTY
PLANNING COMMISSION BY ANCHOR STONE COMPANY FOR
EXPANSION OF AN "M" ZONING CLASSIFICATION TO ALLOW MINING
OPERATIONS ON ADDITIONAL PROPERTY OWNED BY THE COMPANY.
Mr Rooney has received information that Anchor Stone Company, operators of the rock quarry
mining operation located north of 66th St N and east of 145th E Ave, has made application with
the Rogers County Planning Commission for expansion of their mining operation to an additional
80 acres north of the existing mining area. A public hearing on the request was held on
Tuesday, March 4, at 4:00 p.m. before the Rogers County Planning Commission. Mr Rooney
attended that meeting as an observer and on behalf of the City of Owasso as an interested party.
He updated the Council on the meeting and said that the Rogers County Planning Commission
denied the request for mining expansion, but that it is anticipated than Anchor Stone will appeal
the denial to the County Commission. Several citizens living near the mining operation were
in attendance at the City Council meeting and expressed their concerns about an expanded
operation. Mr Ramey moved that the Owasso City Council take a position of opposing the

request by Anchor Stone Company to expand their mining operation, and that the city staff be
authorized to represent the Council and citizens in dealing with Anchor Stone. Motion seconded
by Mayor Ewing.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
REPAIR OF A 1996 PATROL VEHICLE.. I
In December 1996, an Owasso Police Officer was involved in a traffic accident that caused
extensive damage to the police vehicle. The 1996 Ford Crown Victoria is still under warranty
and repairs must be made to factory standards in order to maintain the warranty. Because of
the significant amount of damage to the vehicle, Councilors questioned whether the vehicle
should be repaired or totaled. There is also a possibility that further damage will be found once
repairs are begun. A question was raised as to whether the vehicle would be stable enough to
be used as a police vehicle once repairs are made. It was suggested that the vehicle could be
utilized by another department that does not require high speed if it is discovered that it will not
perform to public safety standards. Mr Ramey moved to approve the repairs to the 1996 patrol
vehicle damaged in an accident, and that the bid for repairs be awarded to Pruitt's Body Shop
in the amount of $8355.83, and authorization for payment. He further moved that the City
Manager be authorized to approve additional expenditure for parts and labor which may be
identified during the repair process. Motion seconded by Ms Barnhouse.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A SEAT
BELT POLICY.
The city's current seat belt policy simply states, "All city employees are required to wear seat
belts in vehicles so equipped." It is believed by staff that the policy needs to more clearly define
the intent of the City to protect its workers by mandating compliance through expanded policy
language. The proposed policy requires seat belt use in any seat, in any vehicle, while on city
business. Questions were raised about the feasibility of requiring the use of seat belts in all city
vehicles, such as refuse trucks and golf carts. Mayor Ewing moved, seconded by Mr Ramey,

that this item be tabled until such time as the City Attorney and Mr Harder clarify the language
tand intent of the policy.

ITEM 14: REPORT RELATING TO THE STATUS OF THE CONSTRUCTION OF
IMPROVEMENTS BY THE YMCA TO THE OWASSO RECREATION
CENTER.
Mr John Swift, CEO of the YMCA of Greater Tulsa, provided a written construction update.
The City's building inspector is monitoring the construction.

REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF

and Board of Education on Tuesday, March 11, 1997 in the Training Room at First Bank of
Owasso per the Notice of Public Meeting and Agenda posted on the City Hall bulletin Board at
2:00 p.m. on Friday, March 7, 1997.
ITEM 1: CALL TO ORDER.

ITEM 2. WELCOME AND INTRODUCTIONS.
IN Superintendent Johnson welcomed everyone and introduced the Board of Education and staff.
ITEM 3: INTRODUCTORY REMARKS.
City Manager Rodney Ray introduced the City Council, Councilor - elect, and City staff.
' ITEM 4: DEVELOPMENTAL REQUIREMENTS OF THE TECHNICAL ADVISORY
COMMITTEE, PLANNING COMMISSION, AND BOARD OF ADJUSTMENT.
In the absence of Mr Rooney, Mr Ray explained the process and requirements of the Technical
Advisory Committee, Planning Commission, and Board of Adjustment; and how these
requirements relate to development.

ITEM 5: UPDATE ON PAST, PRESENT AND FUTURE SCHOOL GROWTH:
BUILDING AND SITES: AND A LOOK INTO FUTURE NEEDS.
Mr Krafft discussed school population and sites, as well as upcoming needs as a result of the
projected growth of Owasso.
ITEM 6: CITY OF OWASSO EXPECTATIONS FOR SITES. BUILDING AND
INFRASTRUCTURE.
Mr Carr explained what the City expects and requires for new construction. He said that
drainage is a major concern because much of the construction is surrounded by already
developed areas.
The meeting was recessed at 7:45 p.m. and reconvened at 8:00 p.m.
ITEM 7: PROJECTED FUTURE INFRASTRUCTURE NEEDS AND GROWTH
PROJECTIONS.
Mr Ray discussed the projected growth of population within the city limits and what effect that
growth will have on future infrastructure needs. The current population within the city limits
is 14,500. Projects are for that number to be 30,000 by 2004 and 33,000 by 2007.
ITEM 8: WRAP -UP REMARKS FROM SCHOOL BOARD AND CITY COUNCIL.
Owasso Mayor Danny Ewing made closing remarks on behalf of the City of Owasso and City '
Council. School Board President Bill Bush wrapped up the meeting on behalf of the Board of
Education. Both expressed their belief that the joint meeting was worthwhile, and suggested that
the Board of Education and City Council hold a joint meeting at a minimum of twice a year.
ITEM 9: QUESTIONS AND ANSWERS AND GENERAL DISCUSSION.
There was discussion concerning issues faced by the City of Owasso and the Board of Education
when a new school site is selected and a school building constructed. Mr Ray suggested that
an advisory committee of school and city officials be formed and hold regular meetings so that
problems can be addressed before a bond issue is passed for new school construction. It was
also suggested that a city official be appointed as a member of the school bond committee.

' For the past seven (7) years, the City of Owasso has utilized private sector contractors for the
purpose of providing mowing services during the summer growing months. The program was
developed to privatize the service and provide support so that city crews can continue to carry
' out their job assignments.
Staff evaluation of the program indicates that it continues to be cost- effective. We have
continued to make progress on other projects (i.e. street repair, drainage ditch renovation and
small construction projects). The use of these private sector contracts have continued to provide
the citizens of Owasso with a more efficient delivery of services. The use of full -time
' employees to perform seasonal mowing is reduced, allowing for more efficient response to the
needs of both the Street and Parks Departments.
' By continuing the privatization of mowing in specified areas, the city full-time work force is able
to attend to the other street right -of -way mowing and seasonal maintenance needs that must be
accomplished during the spring, summer and fall.
' There are four criteria used to evaluate the mowing program: quality, timeliness, cost and
citizen reaction. Historically, privatized mowing has met or exceeded our expectations in each
' of these areas. An annual review of the program is used to make adjustments to the program
in order to maintain effectiveness.
BID ANALYSIS:
The 1997 mowing bid was advertised and bid packages were sent to twenty nine ( 29 ) perspective
mowing contractors. Thirteen (13) mowing contractors placed bids which staff believe are
competitive.

The 1997 mowing bids for the parks had an increase of $6.00 per mowing from the 1996 season
costs. The Parks mowing season is eighteen (18) mowings. Total cost for the season is
$9,558.00.
The 1997 mowing bids for the easements, medians and right -of -way areas had a slight decrease
of $64.50 to $2,502.50 per mowing. The mowing season calls for six (6) mowings. Total cost
for the season will be $15,015.00.
The actual 1996 mowing contracts did not include the U.S. Highway 169 right -of -way because
the bid amount exceeded the cost of city personnel by $1,130.00 per mowing. In the bid
analysis provided, a differential of approximately $280 per mowing is shown for 1997.
Although an additional $1,680.00 would be paid under the contract, most of the added expense

is off -set by reductions in cost of mowing other areas. The savings in wear on equipment and
mowing time is a significant benefit due to the age of the city equipment and availability of
personnel. Staff is recommending adding the Highway 169 mowing for this contract period.
The total expense for all awarded contract mowing of the parks, medians, easements and right -
of -ways is $24,573.00, a savings of $279.00 for the mowing season (1997) compared to the
r 1996 season.
' ELMING SOURCE:
Funding for the FY 96 -97 mowing program (July - October 1996 and April -June 1997) was
approved as part of the Street Division budget for Physical Property Services (51- 410 - 5320).
Funding to continue the mowing July - October 1997 and the start-up of the 1998 season April -
June will be included in the FY 97 -98 budget.

*PARKS: Rayola, Elm Creek, 86th Street and Ator Heights
Mow the entire park area with a riding lawn mower or hand mower. "Brush Hog" type mower
shall not be used. All grass should be cut 1 to llh inches in height.
Mow within four inches (4 ") of any obstruction; fences, trees, poles, etc. Creeks and
embankments should be mowed per agreeable distance from the water.
The city crews will be responsible for "weed - eating" all ditches; around all trees, light poles,
picnic tables, and fences; and steep hills and slopes. It is the intent of the City to have the
"mowing contractor" mow as close to all structures, fences, trees, and drainage ditches as is
possible.
The City is requiring the parks be mowed once every ten days.
No mowing is to be done on the weekends (from 6:00 p.m. on Friday until 8:00 a.m. on
Monday.
The walking /jogging trail(s) shall be kept free of grass clippings or other yardwaste.

March 11, 1997
Work consists of repair and modification of City streets at 15 locations throughout the city
(attached map) as part of the FY96/97 Street Repair Program. The contract was awarded to
AM -Rail, Tulsa, OK, in the amount of $36,201.50. The City Council approved the award on
November 5, 1996. Notice to Proceed was issued on November 26, 1996. Completion date
was set at March 8. 1997.
The contract amount included bid items for additional work such as deeper excavation or
additional patch area at each site which could be anticipated during the course of the work. The
contract was awarded with the understanding that should additional work not be needed, no
payment would be made. Therefore, payment for the total contract work could be expected to
be less than the original contract award amount.
Work was inspected by Public Works personnel.
A one -year maintenance bond has been provided to become effective upon acceptance of the
contract work (see attached).
FINAL INSPECTION
Public Works personnel held a final inspection with the contractor on March 3, 1997. There
were no deficiencies noted.
' CONTRACT COST AND FUNDING
Minor quantity adjustments using the contract unit prices were reflected in the final contract
amount. The total contract amount remains at $36,201.50. Total earnings to date are
$26,886.40 of which $24,179.46 has been paid. The difference is $2,686.64 which is contract
retainage. The difference between the contract award amount and earnings is due to bid items
' for additional work which was not needed. Total payments to date include all work

accomplished. Therefore, the final payment request is the return of contact retainage in the
amount of $2,686.64.
RECOMMENDATION:
Staff recommends acceptance of the Street Repairs and Modifications at Various Locations
contract and authorization for final payment to AM -Rail in the amount of $2,686:.

The project is located between 86th and 96th Streets North, east and adjacent to Nottingham I
addition (see attached location map).
The Nottingham II water system was accepted by Council on December 3, 1996. Sanitary sewer
service is provided by the system constructed for the Nottingham I addition.
Designs for the streets and storm drains were reviewed and construction inspected by Public
Works personnel.
FINAL INSPECTION•
The final inspection was attended by the developer and Public Works personnel on March 7,
1997. There were no deficiencies noted.
A one -year storm drainage maintenance bond has been provided (see attached). Staff
recommendation for acceptance is contingent upon receipt of a two-year street maintenance bond
prior to the next scheduled Council meeting. The bonds will become effective upon acceptance.
RECOMMENDATION:
Staff recommends acceptance of the Nottingham II streets and storm drain system, contingent

The subdivision is located between 86th and 96th Streets North, west of the Ator subdivision.
(see attached location map).
The Fairways I water and sanitary sewer systems were accepted by Council on August 15, 1995.
Designs for streets and storm drainage systems were reviewed and construction inspected by
Public Works personnel.
A final inspection was held by Public Works representatives on June 17, 1996. The developer
attended the inspection. A punch list of work items needed to bring the facilities to City
standards was provided to the developer on June 24, 1997. (see attached). The streets punch
list and a portion of the storm drainage list were completed in September 1996. Heavy rainfall
during September 1996 revealed a problem pertaining to the ability of the Fairways I system to
accommodate runoff from the Fairways II and golf course areas upstream. The correction for
the storm drainage problem was completed on March 4, 1997.
Staff recommendation for acceptance is contingent upon receipt of a one -year maintenance bond
' for storm drainage and a two-year maintenance bond for streets prior to the next scheduled
Council meeting. The bonds will become effective upon Council acceptance of the facilities.
RECOMMENDATION:
' Staff recommends acceptance of the streets and storm drainage systems for Fairways I,
contingent upon receipt of required maintenance bonds.

The City of Owasso has received consent for the annexation of an approximate 20 acre parcel
of land located south of the southwest corner of E. 96th Street North & Garnett Road. The
subject property is owned by the Edison family and a subject map and legal description are
attached for your information and review.
The subject property is currently zoned RMT (Residential Multi- Family Townhouse) within
Tulsa County. Residential Multi- Family Townhouse allows for the development of attached
multi - family townhouse dwellings on separate lots, which are designed expressly for separate
ownership, in a higher density than conventional detached single - family dwellings. The Owasso
Zoning Code (reference material attached) allows for the City Council to annex and zone
property under one ordinance if the property retains the existing zoning classification once
annexed. To summarize what this means, if an applicant already had zoning established in Tulsa
County and wants to maintain that same zoning in the city limits, no zoning process is necessary.
While annexation of property and the maintaining of its established zoning from Tulsa County
has not been accomplished recently in Owasso (most property annexed by the city is already
zoned AG), it is an option that the Council can consider in addition to rezoning the property to
AG (Agriculture).
The Technical Advisory Committee reviewed the annexation request at their January 2, 1997
meeting. At that meeting, staff and area utility companies were present to offer comments on
the annexation request. No comments opposing the annexation request were voiced at that
meeting.
Copies of the City of Owasso's annexation policies and procedures are attached for your
information and review. The subject property would meet all of the noted policy guidelines with
the exception of being rezoned to AG (Agriculture). Please note, however, that the annexation
policies were developed as guidelines and the request to continue the established zoning of the
property is within the purview of the annexation process.

The notice for annexation was published in the January 23 and 30, 1997 additions of the Owasso
Reporter to notify the public of any possible Planning Commission action related to the
annexation request on February 13, 1997. The notice for annexation was also published in the
February 2, 1997 Owasso Reporter to notify the public of any possible Council action.
The Annexation Committee conducted its review of the annexation request at their February 3,
1996 meeting and unanimously approved the request. The minutes from this meeting are
attached for your information and review. The Planning Commission reviewed the annexation
request at their February 13, 1997 meeting and also approved the request. .
RECOMMENDATION:
Staff recommends approval of the annexation request, maintaining established RMT zoning.

SECTION 100 TITLE
' Title 100, this ordinance shall be known and may be cited as the Zoning
Code of the City of Owasso, Oklahoma.

' 110.1 Purposes
This code is enacted for the purposes of promoting the health, safety,
peace, morals, comfort, convenience, prosperity, order and general
welfare; to reduce the danger and congestion of public transportation, to
provide adequate light and air, public utilities, facilities and service,
' and other public requirements; to promote productive and enjoyable harmony
between man and his environment; to achieve a balance between population
and resource use which will permit high standards of living and a wide
sharing of amenities; to prevent overcrowding of land and undue encroach-
ment thereon; to promote efforts which will prevent or eliminate danger to
the environment; to stimulate and assure for all citizens safe, healthful,
productive, and aesthetically and culturally pleasing surroundings; to
encourage the residential, commercial, and industrial growth of the com-
munity as well as the most appropriate use of land; and to encourage the
development of the community in accordance with a Comprehensive Plan.

c. Tense and Definition
For the purpose of this code certain terms and words are to be
used and interpreted as defined in Chapter 16 of this code:
words used in the present tense shall include the future tense;
words in the singular number include the plural and words in the
plural number include the singular, except where the natural con-
struction of the writing indicates otherwise. The words "shall"
and "will" are mandatory.
110.3 Jurisdiction
a. Territorial Jurisdiction
This code shall be in full force and effect and shall apply to
all lands within the incorporated limits of the City of Owasso,
Oklahoma.
b. Annexed Territory
When any territory shall be brought into the zoning jurisdiction
of the City of Owasso by annexation or otherwise, such territory
shall be deemed to be in the AG Agriculture district, provided,
however, that the City Council may annex and rezone in one
ordinance properties given previous zoning in Tulsa County. This
provision shall not operate to preclude subsequent rezoning of
such property by amendment in the manner set forth in Chapter 15.
c. Property owned, leased or operated by the City of Owasso, Okla-
homa, or any other public or governmental body or agency shall be
subject to the terms of this code.
SECTION 120 ENACTMENT
120.1 Planning Commission Approval and Recommendation
The Owasso Planning Commission after Public Hearing does hereby approve
and recommend to the City Council that this new Zoning Code and Zoning Map
be adopted.

120.2 City Council Adoption I
The City Council after the Planning Commission recommendation for approval
does hereby adopt this Zoning Code and Zoning Map. Due to the immediate op
necessity for the preservation of the public peace, health and safety, an
emergency is hereby declared to exist by reason whereof this Ordinance �'
shall be in full force and effect from and after its passage and approval.
Passed and adopted by the unanimous vote of all of the members of the City
Council of the City of Owasso, Oklahoma, the emergency clause having been
proposed and acted upon separately, and the said emergency clause having
been passed by more than three - fourths vote of the members of said Council
this 5th day of June , 1984.

ANNEXATION POLICY
1• While '

5. Where a "city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation - for a six month period after
rejection by the City Council.

Mr. Rooney presented the annexation item. (Rodney Ray enters at 5:10) Ray Haynes
asked for clarification regarding the statement in staff's memorandum regarding the
incoming zoning of the property if it was annexed. Mr. Rooney responded that when an
applicant requests annexation, the city has the option of maintaining the established
zoning of the property (in this case RMT) or annexing the property into the city with AG
(Agriculture) zoning.
Upon completion of the discussion, Ray Haynes motioned to approve the annexation,
seconded by Robert Carr. Motion carried 4 -0.

SUBJECT: ORDINANCE NO. 541 - ESTABLISHING A SIXTY (60) DAY
MORATORIUM ON THE CONSTRUCTION OR MODIFICATION OF
COMMUNICATION TOWERS
DATE: March 13, 1997
BACKGROUND:
Approximately two years ago, and again in August 1996, the FCC auctioned off to the
highest bidder the right to exclusively occupy and use defined portions of the radio airways
spectrum. As a result of these actions and the subsequent enactment of the 1996
Telecommunications Act by Congress, numerous telecommunications companies have been
created. A significant portion of these "new" companies are establishing wireless
communication networks all across the United States, in an attempt to provide the next
generation of cellular phone technology or Personal Communication Services (PCS).
PCS is similar to existing cellular telephone service with the exception that it is operated at a
higher frequency - thus resulting in a technical requirement of double the communications
facilities which have supported cellular technology. As a result, an onslaught of
communication tower applications is anticipated throughout much of the United States.
OWASSO ZONING REGULATIONS:
In staff's opinion, the City of Owasso's Zoning Code is inadequate to address land issues
created by the 1996 Federal Communications Act and PCS technical needs. Currently,
communication towers are permitted by right in any commercial or industrial district in
Owasso, subject to setback requirements. In all other areas (residential, office, and
agriculture), towers are permitted only if a Special Exception is received through the Board
of Adjustment.
The staff concerns are as follows:
1. Various types of towers exist (monopole, lattice, guy- wired) today and
consideration should be given to restricting those that are aesthetically
challenged.

2. As a majority of the land abutting the Owasso Expressway is zoned for
commercial and /or industrial uses, consideration should be given to preserve
this corridor from the intrusion of towers.
3. The Zoning Code does not contain criteria for the Board of Adjustment to
consider regarding communication towers. Consideration should be given to
establish minimum standards for appropriate colors, types, setbacks, screening,
lighting, signage, and height.
4. The Zoning Code contains no requirement to design towers to accommodate
multiple users. This may be singularly the best way to minimize the number
of communication towers.
5. The Zoning Code does not require the removal of abandoned towers.
6. The Zoning Code contains no up to date definitions relating to issues
associated with cellular and PCS antenna towers and antennas.
WHAT OWASSO CAN AND CANNOT DO:
The 1996 Telecommunications Act states: "Except as provided (herein), nothing in this act
shall limit or affect the authority of a State or local government or instrumentality thereof
over decisions regarding the placement, construction, and modification of personal wireless
service facilities. " The Act does, however, place three important limitations on local
governments 1) cities may not "unreasonably discriminate among providers of functionally
equivalent services," 2) cities may not "prohibit or have the effect of prohibiting the
provision of personal wireless services," and 3) cities may not regulate personal wireless
services "on the basis of the environmental effects of radio frequency emissions to the extent
that such facilities comply with the (FCC's) regulations concerning such emissions. "
CONCLUSION:
In light of the concerns contained within this memorandum and recent action by the City of
Tulsa establishing a moratorium in order to update and redefine their zoning code, staff feels
it is in the best interest of the Council to establish a sixty (60) day moratorium concerning
the construction and /or modification of communication towers. Because the City of Tulsa
has established a moratorium prohibiting towers, it is quite likely that communication
providers may look to Owasso and other communities in which to locate their towers.

If the moratorium is established, staff will be conducting a thorough review of the Owasso
Zoning Code as it relates to communication towers, monitoring similar efforts in the Tulsa
metropolitan area, and attending a conference in Dallas, Texas regarding tower placement.
Proposed changes would then be presented to the Planning Commission and Council for
adoption.
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 541, establishing a moratorium on the
construction and /or modification of communication towers. Furthermore, staff recommends
the inclusion of an emergency clause, thus allowing the ordinance to take effect immediately
after its passage.

AN ORDINANCE DECLARING A SIXTY (60) DAY MORATORIUM,
PROHIBITING THE CONSTRUCTION OF, OR ISSUANCE OF PERMITS
FOR, NEW STRUCTURES OR THE MODIFICATION OF EXISTING
STRUCTURES USED TO SUPPORT ANTENNAS; PROVIDING FOR
PENALTIES FOR VIOLATION THEREOF; AND DECLARING AN
EMERGENCY.
WHEREAS, the City Council has been advised that an increase in the amount of
applications for permission to construct communication towers in the City of Owasso and
throughout the Tulsa metropolitan area, including in residential, office, industrial,
commercial, and agricultural zoned districts, is likely in the next few months; and
WHEREAS, the federal government has enacted the Telecommunications Act of 1996
which places certain restrictions and obligations on local governments in connection with the
regulation of the telecommunications industry; and
WHEREAS, the provisions of the Zoning Code of the City of Owasso, Chapter 10,
Section 1004, pertaining to the regulation of antennas and their supporting structures, have
not been reviewed since the adoption of the Telecommunications Act of 1996 and did not
contemplate the proliferation of communication towers that is now anticipated to occur in the
City; and
WHEREAS, on February 13, 1997, the Tulsa Metropolitan Area Planning
Commission ( "TMAPC ") and the Indian Nations Council of Governments ( "INCOG "), of
which, membership in both organizations is held by the City of Owasso, commenced a study
and review of all applicable zoning regulations respecting installation, operation, and removal
of communication tower facilities; and
WHEREAS, the TMAPC and INCOG anticipate issuing their recommendations as to
changes to existing zoning ordinances and additional zoning regulations within the next sixty
(60) calendar days; and
WHEREAS, it is the desire of the City Council to review recommendations and
proposed changes to the zoning ordinances as soon as possible so the City Council can
review and implement changes to the ordinances and lift the moratorium prior to the
expiration of the next sixty (60) calendar days; and
WHEREAS, a moratorium prohibiting the construction of, or issuance of permits for,
new structures or the modification of existing structures which are used primarily to support
antennas, whether as a principal or accessory use, and which are in excess of thirty feet (30')
in height, is necessary while the City conducts the study of its present regulations; and
WHEREAS, the City Council finds that the moratorium imposed by this ordinance is
necessary for the protection of the public, peace, health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT
Section 1. That a moratorium prohibiting the construction of, or issuance
of permits for, new structures or the modification of existing
structures which are used primarily to support antennas, whether
as a principal or accessory use, and which are in excess of thirty
feet (30') in height, is hereby declared and established for a
period of sixty (60) days from and after the effective date of this
ordinance in all residential, office, commercial, industrial, and
agricultural zoned districts within the City of Owasso.

Section 2. Any property owner or other party who violates the moratorium
established by this ordinance shall be guilty of a misdemeanor
and, upon conviction thereof, shall be punished by a fine of not
less than one hundred dollars ($100.00) nor more than two
hundred dollars ($200.00), excluding court costs, and /or thirty
(30) days imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense.
Section 3. This moratorium shall not apply to any zoning application which
was filed and also deemed to be complete prior to the effective
date of this moratorium.
Section 4. The establishment of fine /imprisonment under authority of this
ordinance shall not be construed as the exclusive penalty and
shall not prevent the City of Owasso from seeking appropriate
legal remedies in the District Courts of Tulsa County.
Section 5. Nothing herein shall preclude or prohibit the filing of an
application with the Board of Adjustment for a special exception
for the use of property in residential, office, and agricultural
zoned districts or areas for a tower, provided notice shall not be
given and a public hearing on such application shall not be
scheduled during the moratorium.
Section 6. That an emergency is hereby declared to exist for the
preservation of the public peace, health, and safety, by reason
whereof this ordinance shall take effect immediately from and
after its passage, approval, and publication.

BACKGROUND:
During the past several months there has been a continuing discussion, in several forums,
relating to the issue of whether or not the City of Owasso should, through a permitting process,
allow companies other than the electrical franchise holder (PSO) to provide electrical service to
the citizens and businesses of Owasso. First discussed in an Owasso Economic Development
Authority meeting as a potential vehicle to enhance the community's ability to "package"
financing plans for economic development prospects, the discussion relating to this question then
broadened to include City Council work sessions and staff research.
As a result of those discussions, it is apparent that there are differing positions both within the
community and within the City Council. The staff believes it is the appropriate time to seek
direction before proceeding further in the process of developing public policy relating to this
issue. Considerable time has already been allocated to researching this issue and developing a
' draft ordinance. Additional staff time, legal work and public hearings are necessary if the
Council desires to proceed with the permitting process. The staff position is that resources
should be allocated for projects and purposes that implement Council policy. In those cases
' where that policy direction is not clear, the staff seeks direction prior to expending funds. This
issue is one of those instances when the staff is not sure of what the City Council believes the
public policy should be or the direction that staff should be following. Therefore, this question
' is placed on the agenda so that direction relating to how the staff should proceed from this point
can be given.
THE QUESTION AT ISSUE:
The question at issue is whether the City should adopt a public policy that would allow electrical
utility companies, other than the franchise holder, to provide electrical service inside the City's
' corporate boundaries through the use of a permit and regardless of franchise status.

OPTIONS:
It appears that there are three viable options available to the City Council. They are as follows:
OPTION #1 - Direct the staff to proceed with the development of an ordinance that allows the
issuance of a permit to any company meeting the permit requirements to serve any area within
the corporate limits. Such authorization in the form of allowing the use of easements and rights -
of -way in return for certain fees and charges generally associated with a "gross receipts tax".
This option allows any company to serve any Owasso location so long as they meet the permit
requirements and are wiling to make the required investment in capital cost.
OPTION #2 - Direct the staff to proceed with the development of an ordinance that allows the
issuance of a permit to any company meeting permit requirements to serve only industrially and
heavy commercially zoned areas in the city's corporate limits. Once again, such authorization
is in the form of allowing the use of easements and rights -of -way in return for certain fees and
charges as prescribed by the ordinance. This option would allow electrical distribution
companies to serve only areas where economic development activities occur, and could provide
the OEDA with assistance in their activities by taking advantage of private sector competition.
Companies would still be required to meet the permit criteria and invest in capital costs in order
to serve these areas.
OPTION #3 - Direct the staff to cease any activities toward the development of an ordinance that
would allow companies other than the franchise holder to serve the City of Owasso.
REOUEST:
This request is for policy direction and is a Council policy issue. The staff needs that direction
in order to appropriately allocate resources (staff time and funds) to the various priorities under
consideration. Since this is a policy issue, no recommendation is offered.
NOTES:
1. In the event the Council directs continued development of the permit ordinance, it is
anticipated that an ordinance would be ready for consideration at the April 15 Council
meeting.
2. Please be reminded that the staff presented a preliminary financial impact study on
February 4, 1997 and determined that the impact of adopting a policy to allow additional
providers varied with the extent of the policy and the type of company that would seek a
permit. The worst case scenario indicated a potential loss of revenue in the amount of
$174,000 per year to the City, and the best case scenario indicated an impact of no loss to
the City. The staff analysis of that study predicts that the real impact is between those two
extremes and anticipated an annual loss of revenue not to exceed $5000.

BACKGROUND:
The Sales Tax Watchdog Committee was created by the voters as a requirement of the 1988
sales tax election. The language in the propositions placed before the voters ensured that, if the
measures passed, language would be included in the "bond indenture" that required formation
' of the committee as a condition of incurring debt.
Specifically, the committee was created for the purpose of providing citizen review of the
collection and disbursement of monies made available through the one -cent capital improvements
sales tax approved by the voters. The committee was designed to provide representation from
a broad and diverse cross section of the community. Membership on the committee was
established for the following categories:

' The committee, therefore, is composed of a total of thirteen members. Those members
appointed serve for the life of the sales tax (scheduled to expire in 2007). Members cannot be
removed except by resignation.
In 1991, due to review of membership guidelines by the committee, recommendations relating
' to appointments to the committee were made to the City Council (see attached memorandum
dated April 8, 1991). The result of those recommendations was a formalized City Council

Policy Statement that adopted a criteria for appointments to the Sales Tax Watchdog Committee
(see attached Policy Statement dated May 21, 1991) .
RESIGNATION:
The City Clerk has received a letter of resignation from the Sales Tax Watchdog Committee
from Mr Bill Williams. Mr Williams was appointed in 1991 to the committee to fill a vacant
"Retail" slot.
APPOINTMENT PROCESS:
Historically, the Mayor has appointed /nominated replacements to the committee as vacancies
occur. The authority for that appointment is based on statutory and Charter language providing
that certain appointments are reserved for the Mayor. Traditionally, when specific language
providing for Mayoral appointment is not included in statutes or ordinances, the Mayor has
initiated the appointment in order to provide an orderly process. In the case of the Sales Tax
Watchdog Committee, while there is no specific language requiring Mayoral appointment, the
eight -year practice has been for the Mayor to initiate the appointment and request City Council
confirmation.
RECOMMEND APPOINTMENT:
I submit for your consideration, the appointment of Mr Steve Baggett, owner of "My House
Gifts and Accessories ", 112 South Main, to the Sales Tax Watchdog Committee, and recommend
confirmation of that appointment. I have discussed the appointment with Mr Baggett and
confirmed his willingness to serve on this committee. I have further determined that Mr Baggett
fully meets the committee membership criteria outlined in the City Council Policy Statement
relating to such. Mr Baggett resides within the Owasso corporate limits and may be telephoned

sales tax. Individual representatives were then appointed to this
committee by the Mayor and charged with meeting on a regular basis
to review the status of capital improvements projects funded by the
1988 sales tax extension bond issue.
In order to ensure the integrity of the makeup of the Watchdog
Committee as established by a vote of the citizens of Owasso, the
membership criteria subcommittee respectfully submits the following
suggestions for the establishment of minimum criteria for future
appointments to the committee.
These suggestions are subject to full committee review and action
before presentation to the City Council for their consideration.

Generally, the City of Owasso has a history of
addressing its Capital needs on a one project
at a time basis. The prevailing philosophy has
been one of crisis management wherein a par-
ticular problem is recognized and subsequent-
ly addressed as an immediate need. In all
cases, the funding for such needs has been
"short term" and usually designed to address
one need at a time.
In early 1988 it became apparent to the City
Council that the issue of major improvements
to 86th Street was one that would require im-
mediate attention and a major funding source.
However, the approach taken by the Council
set the stage for a change in the city's basic
philosophy toward Capital Improvements. The
Council chose to appoint a Capital Im-
provements Committee to study the overall
capital needs of the city rather than address
only the short term need.
The committee has submitted a final report to
the Council that outlines the basic infrastruc-
ture needs of the city over the next several
years and a comprehensive funding source for
these needs. Copies of this report are available
upon request at City Hall.

Any real Capital Plan should be accompanied
by a comprehensive funding program that will
provide a real source of adequate financing.
On Tuesday, October 4th the citizens of
Owasso will be given an opportunity to approve
just such a funding source in the form of an
extension of our current one -cent sales tax for
a period of fifteen years. No property taxes are
involved in this issue, all bonds will be paid
from revenue generated by the sales tax level
we now have.
If passed, "PROPOSITION 7'' will not only ex-
tend the current sales tax but will also require
certain guarantees to the citizens that no
Council or City Administration can change
without a vote of the people. There are four
basic guarantees that are included in the
ballot. They are:
1) All funds from the sales tax extension
must be used only for capital im-
provements projects.
2) A requirement that at least 15% of all
revenues be set aside in a special
restricted fund for use only after the ex-
tension is over or by authority of a vote
of the citizens of Owasso.
3) All projects must be approved and
authorized by a vote of the people, or
from funds accumulated and then only,
after a review process that includes the
Capital Improvements Committee and
the City Council.
4) Establishment of a citizens ''WAT-
CHDOG COMMITTEE" comprised of
fourteen people appointed by the Coun-
cil and given the proper reports to allow
them access to information needed to
stay informed and aware of the progress
of all projects and status of revenue.
On October 4th, the citizens of Owasso will
have a chance to approve and fund the follow-
ing projects:
1) Five Lane 86th St. from Highway 169
East to the High School - Improve the In-
tersection & Place Signals at the High
School - Improve the Intersection at Main
& 86th and Widen 86th West from
Highway 169 to Main St. ($2,700,000)
2) Drainage Study for North Owasso - Ger-
man Corner & Hale Acres Area ($15,000)
3) Replace Fire Department Radios With a
Reliable System to Improve Communica-
