Consideration and Appropriate Action Relating to a Request for Reconsideration of a Motion to Table Consideration of Action Relating to the Development and Adoption of an Ordinance Providing for the Issuance of Permits to Companies Wishing to Provide Electrical Service Within the Corporate Limits of the City of Owasso. Mr Ray Attachment #8 The City Manager has received a request to place this item on the Council agenda from a member of the Council who voted in the affirmative on a motion to table an agenda item `'' that related to the electrical permit issue. That action to table was taken in a regular M meeting of the Owasso City Council on March 18th and, pursuant to discussions with the City Attorney, a motion to reconsider the issue is proper. Consideration and Appropriate Action Relating to Ordinance #543, an ordinance relating to the issuance of permits to companies who desire to provide electrical service to customers within the corporate limits of the City of Owasso, providing for an effective date, ' establishing criteria for the issuance of such permit, and requiring the payment of certain fees and charges for use of the municipality's rights-of--way and easements. Mr Ray ^ Attachment #9 The staff will present an ordinance that, if adopted, will allow the issuance of "permits" to companies desiring to serve utility customers within the corporate city limits in areas zones ,r with industrial classifications. The proposed ordinance includes requirements for payment of a gross receipts tax in leu of a franchise tax in payment for the use of city rights-of-way and easements. If adopted, the ordinance will become effective thirty days from publication. 10. Consideration and Appropriate Action Relating to a Request for Approval of the Final Plat for Lakeshore Greens, Located North of the Northeast Corner of East 86th Street North and ~ Mingo Road, Containing 14.18 Acres. Mr Rooney ^ Attachment #10 The staff will recommend approval of the final plat for Lakeshore Greens, such plat contemplating the development of amulti-family apartment complex. ~ 11. Consideration and Appropriate Action Relating to the Acceptance of Improvements to the Streets and Stormwater Drainage Systems Constructed to Serve Brentwood Park, an Addition to the City of Owasso, Tulsa County, Oklahoma. Consideration and Appropriate Action Relating to the Award of a Contract for Street Repairs on 129th East Avenue at the Sixth Grade Center. Mr Lutz Attachment #12 The staff has completed the bidding process, reviewed the bids received, and will ~ recommend a contract be awarded to Horizon Construction, Owasso, OK in the amount of $20,972.19, for the repair of 129th E Ave at the Sixth Grade Center, consistent with bid specifications. ri 13. Consideration and Appropriate Action Relating to a Request for the Purchase of a Flexwing Cutter and for a Supplemental Appropriation in the Amount of $7434 to the General Fund's Street Department Budget for the Purpose of Funding the Purchase, and Authorization for Payment to the Vendor Upon Delivery of the Equipment. Mr Roberts Attachment #13 ~ The staff has solicited quotes and will recommend City Council authorization for the r. purchase of a 15' heavy duty Farmhand flexwing cutter from Bolt Equipment Co, Broken ,,, Arrow, OK in the amount of $7434. Additionally, the staff will recommend a supplemental appropriation in the amount of $7434 to the General Fund's Street Department Budget for the purpose of funding the purchase, and authorization for payment. 14. Consideration and Appropriate Action Relating to a Report from the Ambulance Ordinance Review Team. Chief Allen Attachment #14 The staff will recommend City Council acceptance of the report, and that the Council direct ,.~, the City Attorney to prepare an ordinance containing the recommended changes to Ordinance #369. 1 Owasso City Council April 15, 1997 Page 5 15. Consideration and Appropriate Action Relating to an Amendment and Renewal to the Enhanced 911 Interlocal Agreement. Chief Alexander Attachment #15 The staff will recommend City Council approval of an amendment to the E911 Interlocal Agreement allowing Skiatook and Collinsville exchanges to join those exchanges already in the system, and renewing the existing amended interlocal agreement as required by the Attorney General of the State of Oklahoma. 16. Report Relating to the Status of the Construction of Improvements by the YMCA to the Owasso Recreation Center. Mr Ray Attachment #16 The staff will report to the City Council the status of the project to construct improvements to the City-owned Recreation Center, now leased to the YMCA. 17. Adjournment ~r r OWASSO CITY COUNCIL ' MINUTES OF REGULAR MEETING Tuesday, April 1, 1997 The Owasso City Council met in regular session on Tuesday, April 1, 1997 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p. m. on Friday, March 28, 1997. ITEM 1: CALL TO ORDER Mayor Ewing called the meeting to order at 7:04 p. m. ITEM 2: INVOCATION The invocation was offered by Pastor Charles Curran of Owasso First Christian Church. ITEM 3: FLAG SALUTE Councilor Helm led in the flag salute. ITEM 4: ROLL CALL PRESENT ABSENT Danny Ewing, Mayor Joe Ramey, Vice Mayor Mary Lou Barnhouse, Councilor Michael Helm, Councilor Tracy Standridge, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ITEM 5: RECOGNITION OF STUDENTS Mayor Ewing introduced Dottie Dorsel, President of Owasso Sertoma Club. Ms Dorsel introduced the top three essayists in the Sertoma Club's Heritage Month Essay Contest. All of the students were sixth graders and each read their essay entitled "If I Were President" . Mayor Ewing and Councilor Barnhouse presented certificates of recognition to Laura King, first place; Amiee Durham, second place; and Matthew Trout, third place. Owasso City Council April 1, 1997 ITEM 6: READING OF MAYOR'S PROCLAMATION Mayor Ewing presented a proclamation to John, Dolly, and Steve Mowery in recognition of Mowery Funeral Service, Business of the Quarter for the Second Quarter of 1997. ITEM 7: READING OF MAYOR'S PROCLAMATION Mayor Ewing read a proclamation naming April 6-12, 1997 as National Building Code Safety Week in Owasso. He presented the proclamation to Gary Orr, Mike Knebel, and Ted McCord, City of Owasso Building Inspectors. ITEM 8: REQUEST APPROVAL OF THE MINUTES OF MARCH 18 1997 REGULAR MEETING. Mr Ramey moved, seconded by Dr Standridge, to approve the minutes as submitted, by reference made a part hereto. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. ITEM 9: REQUEST APPROVAL OF THE CLAIMS Councilor Barnhouse asked for clarification on a Workers Compensation payment. Mr Ray said that it was an old claim that had just recently been presented for payment. Dr Standridge moved, seconded by Ms Barnhouse, that the following claims be approved as submitted: (1) General Fund $17,866.08; (2) Workers Comp Self Ins Plan $3,931.29; (3) Ambulance Service Fund $688.57; (4) City Garage $8,846.41; (5) Capital Improvements $604.42; (6) Payroll $117, 847.01; (7) City Garage Payroll $ l , 592.42. AYE: Standridge, Barnhouse, Helm, Ramey, Ewing NAY: None Motion carried 5-0. 2 Owasso City Council April 1, 1997 ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #542, AN ORDINANCE PROVIDING FOR THE ANNEXATION OF AN APPROXIMATE 20-ACRE PARCEL OF LAND LOCATED SOUTH OF THE SOUTHWEST CORNER OF EAST 96TH STREET NORTH AND GARNETT ROAD. FURTHER DESCRIBED AS THE S/2 OF THE NE/4 OF THE NE/4 OF SECTION 19 TOWNSHIP 21 NORTH RANGE 14 EAST; AND THE CONTINUANCE OF ZONING ESTABLISHED IN TULSA COUNTY (RESIDENTIAL MULTI-FAMILY TOWNHOUSE At the March 18th meeting, the City Council approved the above-mentioned annexation request and continuation of Tulsa County zoning. Ordinance No 542 formally adopts that action. Dr Standridge moved, seconded by Mr Ramey, to approve Ordinance No 542. AYE: Standridge, Ramey, Helm, Barnhouse, Ewing NAY: None ~ Motion carried 5-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ACCEPTANCE OF IMPROVEMENTS TO THE STREETS AND STORMWATER DRAINAGE SYSTEMS CONSTRUCTED TO SERVE THE FAIRWAYS I. AN ADDITION TO THE CITY OF OWASSO TULSA COUNTY. OKLAHOMA. The Fairways is located between 86th and 96th Streets North, west of Ator Heights. Water and sanitary sewer systems were accepted by the City Council on August 15, 1995. The Public Works Department personnel reviewed the designs for streets and storrn drainage systems and inspected construction. A final inspection was held on June 17, 1996 and a punch list provided to the developer on June 24, 1996. All items were completed in September 1996, however, there was a problem relating to storm water runoff. The corrections for that problem were completed on March 4, 1997 and the developer provided aone-year maintenance bond for storm drainage and atwo-year maintenance bond for streets. Both bonds become effective upon Council acceptance of the infrastructure improvements. Mr Ramey moved, seconded by Dr Standridge, to accept the streets and stormwater drainage system constructed to serve The Fairways I. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. 3 Owasso City Council April 1, 1997 ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A PROJECT AGREEMENT BETWEEN THE OKLAHOMA DEPARTMENT OF TRANSPORTATION AND THE CITY OF OWASSO FOR THE PURPOSE OF CONSTRUCTING FENCING IMPROVEMENTS TO AND LANDSCAPING ENHANCEMENT OF. THE RIGHT-OF-WAY OF U S 169 HIGHWAY BETWEEN 76TH ST N AND 86TH STN SUCH AGREEMENT PROVIDING ~ FOR A $100.000 CONTRIBUTION TO THE PROJECT FROM THE DEPARTMENT OF TRANSPORTATION AND A $25 000 CONTRIBUTION FROM THE CITY OF OWASSO. Mr Carr said that the Oklahoma Department of Transportation maintains the Highway 169 roadway, including the fencing along the right-of-way. Fencing between 76th and 86th Streets ' North is a combination of chain link and wood post with hog wire. Federal highway enhancement funds are available for replacement of the fencing if landscaping is added to the project. Such funding is 80% federal and 20% local. The Public Works Department staff prepared a plan for the project, which would cost approximately $100,000, with the City's share estimated at $20,000. Funds for the project were included in the FY96-97 budget. ODOT has developed the fencing plans, and expects to award a contract in April or May. Public Works Engineering is preparing a landscaping plan for submission and approval by ODOT. On February 17, 1997 a public hearing was held to discuss the proposed project. All business and property owners along the highway were invited to attend and provide input. ODOT has provided copies of a Transportation Enhancement Project Agreement to be executed, which formalizes all aspects of the project and recognizes the project as a cooperative effort between ODOT and the City of Owasso. Mr Ramey moved, seconded by Ms Barnhouse, to approve the , project agreement with ODOT and authorize the Mayor to execute the appropriate documents. AYE: Ramey, Barnhouse, Standridge, Helm NAY: Ewing Motion carried 4-1. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A SEAT BELT POLICY. This item was first brought to the Council on March 4, 1997. At that time action was tabled to allow the staff some time to clarify some questions, such as exempting such vehicles as refuse collection trucks. A paragraph was added to the policy to empower the City Manager to exclude "adherence to this policy because of equipment design or operational efficiencies" . The policy requires seat belt use in any seat, in any vehicle, while on city business, except when excluded by the City Manager. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPOINTMENT OF AN AUDITOR FOR THE PURPOSE OF CONDUCTING AN INDEPENDENT AUDIT OF FINANCIAL OPERATIONS AND ACTIVITIES FOR FISCAL YEAR 1996-97. By City Charter, the Council must designate an accountant to make an independent audit of all accounts and financial transactions of the City. Proposals for audit services were solicited two years ago, and the firm of Carlson & Cottrell of Shawnee was selected. It has been City policy to retain the same auditors for up to three years if they have been performing satisfactorily. This will be the third year for Carlson & Cottrell to serve as auditors for the City. The staff recommended that the contract with Carlson & Cottrell be renewed for fiscal year ended June 30, 1997 for a total fee of $16,700 to conduct an independent audit of the City and its trust authorities. Mr Ramey moved, seconded by Mayor Ewing, to renew the contract with Carlson & Cottrell for a total fee of $16,700. AYE: Ramey, Ewing, Standridge, Barnhouse, Helm NAY: None Motion carried 5-0. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL ACCEPTANCE OF A DONATION OF $5014.36 FROM THE U.S. JUSTICE DEPARTMENT TO THE OWASSO POLICE DEPARTMENT; AND FOR CITY COUNCIL APPROVAL OF A SUPPLEMENTAL APPROPRIATION TO THE GENERAL FUND'S POLICE DEPARTMENT BUDGET. The Owasso Police Department has participated in the efforts of the Tulsa County Drug Task Force, and has received a check in the amount of $5014.36 as the department's share of the net proceeds from a successful seizure and forfeiture. Mr Ramey moved, seconded by Dr Standridge, to accept a donation of $5014.36 from the City's involvement in the Regional Drug Task Force, and to approve a supplemental appropriation to the Police Department budget in the same amount. Owasso City Council April 1, 1997 ITEM 16: REPORT RELATING TO THE STATUS OF THE CONSTRUCTION OF IMPROVEMENTS BY THE YMCA TO THE OWASSO RECREATION CENTER. Mr John Swift, CEO of the YMCA of Greater Tulsa, provided a written construction update; and Gary Orr, City Building Inspector, also provided a written construction update. Upon consideration of that agenda item, a motion was made and seconded to table further consideration pending the outcome of legislation currently being considered by the Oklahoma Legislature. That "motion to table" passed by a margin of four to one. The staff accepted that action as a policy decision and considered it as direction. A member of the Council, who votes in the affirmative on a motion to table consideration of an item, may request reconsideration of that item under generally accepted rules of order for meetings. The City Attorney agrees that a motion to reconsider an action to table, when made by a Councilor who voted "for" the motion, is appropriate. Such a request (for reconsideration) has been made in relation to the March 18, 1997 motion to table further consideration of an ordinance providing for the issuance of permits to electrical utility providers who do not "hold" a franchise with the City. Therefore, pursuant to that request, an item providing for reconsideration of the motion to table the further consideration of an ordinance relating to the provision of electrical service, has been listed for consideration and action by the City Council. Please note that the item is listed in anticipation that a member of the Council who actually voted "for" the March 18, 1997 motion to table, will move for reconsideration. Also note that consideration of Ordinance #543 (see item #9 on the April 15th agenda) is dependent upon successful passage of a motion to reconsider the March 18th action to table. ATTACHMENTS: 1. Ms Barnhouse said that during the past several months there has been a continuing discussion relating to the issue of whether or not the City of Owasso should allow companies other than the electrical franchise holder to provide electrical service to the citizens of Owasso. This would be done through a permitting process. She requested that the matter be tabled until results of Senate Bill 500, which would create an Electric Restructuring Act, are known. She said that the staff has already spent considerable time in researching the issue and needed direction before proceeding further toward the development of an ordinance. Councilor Helm asked how the ^~! issue was first introduced. Mr Ray said that the question of permitting electrical providers came from an OEDA meeting and that OEDA Trustees, as well as Councilors and citizens, are divided on the issue. Following discussion and comments, Ms Barnhouse moved, seconded by Mr Ramey, to table the issue of an electrical ordinance until such time as the result of Senate Bill 500 is known. CITY OF OWASSO FROM: RODNEY J RAY CITY MANAGER SUBJECT: DEVELOPMENT OF ORDINANCE TO ALLOW ELECTRICAL SERVICE BY COMPANIES OTHER THAN FRANCHISE HOLDER DATE: March 14, 1997 BACKGROUND: During the past several months there has been a continuing discussion, in several forums, relating to the issue of whether or not the City of Owasso should, through a permitting process, allow companies other than the electrical franchise holder (PSO) to provide electrical service to the citizens and businesses of Owasso. First discussed in an Owasso Economic Development Authority meeting as a potential vehicle to enhance the community's ability to "package" financing plans for economic development prospects, the discussion relating to this question then broadened to include City Council work sessions and staff research. As a result of those discussions, it is apparent that there are differing positions both within the community and within the City Council. The staff believes it is the appropriate time to seek direction before proceeding further in the process of developing public policy relating to this issue. Considerable time has already been allocated to researching this issue and developing a draft ordinance. Additional staff time, legal work and public hearings are necessary if the Council desires to proceed with the permitting process. The staff position is that resources should be allocated for projects and purposes that implement Council policy. In those cases where that policy direction is not clear, the staff seeks direction prior to expending funds. This issue is one of those instances when the staff is not sure of what the City Council believes the public policy should be or the direction that staff should be following. Therefore, this question is placed on the agenda so that direction relating to how the staff should proceed from this point can be given. THE QUESTION AT ISSUE: The question at issue is whether the City should adopt a public policy that would allow electrical utility companies, other than the franchise holder, to provide electrical service inside the City's corporate boundaries through the use of a permit and regardless of franchise status. rr DEVELOPMENT OF ELECTRICAL ORDINANCE MARCH 14, 1997 PAGE 2 OPTIONS: It appears that there are three viable options available to the City Council. They are as follows: OPTION #1 -Direct the staff to proceed with the development of an ordinance that allows the ~ issuance of a permit to any company meeting the permit requirements to serve any area within the corporate limits. Such authorization in the form of allowing the use of easements and rights- ' of-way in return for certain fees and charges generally associated with a "gross receipts tax" . This option allows any company to serve any Owasso location so long as they meet the permit , requirements and are wiling to make the required investment in capital cost. OPTION #2 -Direct the staff to proceed with the development of an ordinance that allows the issuance of a permit to any company meeting permit requirements to serve only industrially and ' heavy commercially zoned areas in the city's corporate limits. Once again, such authorization is in the form of allowing the use of easements and rights-of--way in return for certain fees and ~ charges as prescribed by the ordinance. This option would allow electrical distribution companies to serve only areas where economic development activities occur, and could provide the OEDA with assistance in their activities by taking advantage of private sector competition. Companies would still be required to meet the permit criteria and invest in capital costs in order ~ to serve these areas. OPTION #3 -Direct the staff to cease any activities toward the development of an ordinance that would allow companies other than the franchise holder to serve the City of Owasso. REQUEST: This request is for policy direction and is a Council policy issue. The staff needs that direction in order to appropriately allocate resources (staff time and funds) to the various priorities under consideration. Since this is a policy issue, no recommendation is offered. ' NOTES: 1. In the event the Council directs continued development of the permit ordinance, it is anticipated that an ordinance would be ready for consideration at the April 15 Council meeting. 2. Please be reminded that the staff presented a preliminary financial impact study on ' February 4, 1997 and determined that the impact of adopting a policy to allow additional providers varied with the extent of the policy and the type of company that would seek a permit. The worst case scenario indicated a potential loss of revenue in the amount of $174,000 per year to the City, and the best case scenario indicated an impact of no loss to the City. The staff analysis of that study predicts that the real impact is between those two extremes and anticipated an annual loss of revenue not to exceed $5000. MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: RODNEY J RAY CITY MANAGER SUBJECT: DEVELOPMENT OF ORDINANCE TO ALLOW ELECTRICAL SERVICE BY COMPANIES OTHER THAN FRANCHISE HOLDER DATE: April 11, 1997 BACKGROUND: During the past several months there has been a continuing discussion, in several forums, relating to the issue of whether or not the City of Owasso should, through a permitting process, allow companies other than the electrical franchise holder (PSO) to provide electrical service to the citizens and businesses of Owasso. First discussed in an Owasso Economic Development Authority meeting as a potential vehicle to enhance the community's ability to "package" financing plans for economic development prospects, the discussion relating to this question then broadened to include City Council work sessions and staff research. On March 18, 1997, the staff requested direction relating to this issue and outlined several options available to the Council. At that meeting, the Council voted to table further consideration of the matter until the Oklahoma Legislature completed work on legislation that could establish law relating to "deregulation" of the electrical utility industry. Subsequently, the staff was requested by a member of the Council to place an item on the Council agenda for reconsideration of that "motion to table" (see agenda item #8). Additionally, the staff was requested to present for Council consideration at the April 15th meeting an ordinance that, if adopted, would provide for the issuance of a permit to electrical utility companies (who meet the established criteria) to serve customers in industrially zoned areas of the city. ORDINANCE #543: Pursuant to that request, Ordinance #543 has been prepared by the City Attorney for consideration at the April 15th City Council meeting. The ordinance amends Part 17 of the "Code of Ordinances of the City of Owasso", and provides for the issuance of "permits" for companies to serve customers only in industrial zoned property. The proposed ordinance sets the term of the permit for ten years, and requires permitees to "AGREE" to pay a fee equal to 2% of its gross receipts from the sale of electric energy within the city, as a fee for the use of city rights-of-way and easements. The term "agree to" is important in that should a permit DEVELOPMENT OF ELECTRICAL ORDINANCE APRIL 11, 1997 PAGE 2 holder be a rural electric cooperative, the city cannot "force" payment of such fee unless the cooperative agrees prior to, and as a condition of, the issuance of a permit. The ordinance also requires insurance coverage at minimum levels and establishes a method for the revocation of the permit. Generally, the permit mirrors the electric franchise currently held by PSO (attached for your comparison). "Electrical Distribution Systern" means the building, equipping, maintaining; extending, owning and operating of a plant andbr system for the manufacture and/or distribution and sale of electricity for lighting, heating, and po~~~er purposes as electric energy maybe put, in and to the City and to the public in industrial zoned properties only, and to transmit electric energy over high-lines to connections and systems in other localities with poles, wires, conduits, substations and apparatus necessary and convenient for such system upon, across over and/or under each or any of the streets, alle}~s, avenues, v.ays and other public places and grounds. H. "Person" means any person, firm, partnership, association, corporation, company or organization of any kind. I. "Applicant" means any person submitting an application to the City of Owasso for a permit to operate electrical distrb~tion system u:rder the terms and conditions set forth by the Council. J. "Permittee" means the person to v: hom or to u-hich a permit as detined above is granted by the Council under this ordiranc? or am•one who succeeds she person in accordance with the provisions of this ordinance K. "Gross receipts" means all revenue derived directly or indirectly by a Permittee, its affiliates, subsidiaries, parents, and anv person in which a Perminee has a financial interest from or in connection with the operation of the electrical distribution system in Owasso, Oklahoma, with no deductions. L. "Street" means t'ne surface of and the space above and below any public street., road, highway, freeway, lane, path, public way, or place, alley, coon, bouievare, parkway, drive or other easement held by tl~e City fer *.he purpose of public travel and will include other easements or rights of way as will be held by the City which ~.vill, within their proper use and meaning, entitle the City and the Permittee to the use of them for the purposes of installing or operating an electrical distribution system over poles, wires, cables, conductors, ducts, conduits, vaults, manholes, amplifiers, appliances, attachments, and the property as may be ordinarily necessary and pertinent to an electrical distribution system. M. "Subscriber'' means a purchaser of any service delivered over the system to an industrial zoned property where the service is to be utiiized in connection with an industrial zonins permitted business or trade. Section I7-302. C;rant of Authority; Permit Fee The Council of the City of Owasso creates the ri~f~t, priviiege, and permit to construct, operate, and maintain an electrical distribution system in the streets of the City, subject to the conditions and restrictions as provided below; and that right, privile~>e, and permit will be offered to potential applicants and granted, by the Director of Public Works after all applications have ~ been examined by the Council, to the applicant presenting the best legal, character, financial, technical, and other qualifications, and whose construction plans and arrangements can be shown to be both feasible and adeq,uat~ to meet the minimum requirements established in this ordinance. The term of the permit v.~ill be tin i .0! years from the da*.~ the permit is issued by the Director of Public Works. From and after the aoprova.l and acceptance of the permit, the Permittee shall pay, and in consideration of the granting of the permit agrees to pay, to the City as a permit fee, and as a compensation for the right and privilege enjoyed hereunder, a sum equal to two percent (2%) of its gross receipts from the sale of electric energy within the City, payable monthly on or before the 20th day of each month, on such receipts for the preceding calendar month, which fee shall be in lieu of all concessions, charges, franchise, licenses, occupation, privilege and other permit fees, or taxes, except sales taxes as may be applicable, assessments for special in-~provements and ad valorem taxes. Section I7-303. Insurance A. Prior to the granting of the permit and at all times during the term of the permit, i Permittee must obtain and maintain, pay all premiums for as well as file with the Director of Finance, executed duplicate copies and receipts evidencing the payment of premiums for the following: 1. A seneral comprehensive public liabitity insurance policy indemnifying, defending and saving harmless the City, its officers; boards, commissions; agents, or etployees, from any and all claims by any person on account of injury to or death of a person or persons occasioned by the operations of a Permittee under the permit granted in this ordinance or alleged to have been so caused to occur with a minimum liability of Two Hundred Thousand Dollars ($200,000.00) per personal injury or death of any one person and Five Hundred Thousand Dollars ($500,000.00) for personal injury or death of any two or more persons in any one occurrence. 2 Property damage insurance indemnifying, defending, and saving harmless the City, its officials, officers, boards, commissions, agents, and employees from and against all claims by any person for property damage occasioned by the operation of Permittee under the permit granted in this ordinance or alleged to have beer. so caused to occu- with a minimum liability of Fifry Thousand Dollars ($SO,000.CO) for property damage for any one person and Two Hundred Thousand Dollars ($200,000.00) for property damage to two or more persons ir. any one occurrence B. Such insurance as prodded for in this section will be kept in foil force and effect by a Permittee during the existence cr' and until after the removal of all poles, wires, cables, underground conduits, manholes, ar,d other conductors and fixtures incidental to the maintenance and operation of the electrical distribution system as defined in the permit. C. Kates During the life of the permit and for and in consideration of the acceptance hereof by the Permittee, it is agreed that [he Permittee may charge and collect from the City, its inhabitants and the consumers therein, a rate or rates, which shall at all times be compensatory and reasonable, subject to such rules and regulation; as are nov; in effect, or that may hereafter be lawfully made by the Corporation. Commission of t::e State of Okiahorra, or by other regular)}~ constituted regulatory authority. Section 17-305. Conditions of Street Occupancy A. All transmission and distribution structures, lines, and equipment erected by a Permittee within the Cit}' must be so located as to cause minimum interference with the proper use of the streets, and to cause minimum itttetference with the rights and reasonable convenience of property owners who adjoin any streets. The electrical distribution system must be constructed and operated in compliance with a!i adopted City, State and rationally recognized construction and electrical codes and must he kept current with new codes as required. B. Except when absolutely necessary to service a subscriber and not simply because it will be more convenient, economical, or profitable for a Permittee to so operate, and then only when expressly permitted in writing by the Director of Public Works, under such conditions as he/she will prescribe for the public ~: e!fare, a Permittee must not erect, authorize, or permit others to erect any poles or facilities within the streets of the City for the conduct of its electrical distribution system but will use the existing poles and other equipment of the appropriate electrical power and telephone and other utility companies under such terms and agreements as a Permittee negotiates with these companies. The City must cooperate with a Permittee in negotiating and obtaining permission to use facilities. C. iVo poles, cables; equipment, or wires for the construction, maintenance and operation of the electrical distribu*.ion system must be installed or the installation of them commenced on any existing pole wi*.hin the City of Owasso until the equipment and wires must have been set forth on a plot or map showing the existing poles, streets, alleys, or highways within the City of Owasso where such installations are proposed and submitted in writing by a Permittee to the Director of Public Works and approved by the department in writing. Such approval or disapproval with the reasons for it ~~iil be given in writing to a Permittee within a reasonable period of time. D. Should a Permittee be reouited in the conduct of its business to Locate property within the streets of the City other than property which may be attached to utility poles, then, before a Permittee installs such p;operr,~ or permit, any other person. to install such property for Permittee, Permittee must disclose to the Director of Public Works of the City for approve! as to the need for such property and as to the location within the street and such property may be only installed under such conditions as the Director will prescribe concerning such property location installation. E. Whenever the City or State requires the relocation or reinstallation of any property of a Permittee in any of the streets of the City, it is the obligation of the Permittee on notice of such requirement to immediately remove and relcezte or reinstall such property as may be reasonably necessary to meet the requiremen*.<., of the City or State. Such relocation; removal or reinstallation by a Permittee will be at the sole cost of a Permittee. F. Whenever in any place :vithin the City all the electrical and telephone utilities must be located underground, it is the obligation of a Permittee to locate or to cause its property to be located underground within such places; however, it is the policy of the City to have the maximum amount, if not all, of the electrical distribution system as possible located underground. If other electric utilities or telephone utilities must be located underground in any place within the City after a Permittee has previously installed its property, nevenheiess, a Permittee must at the same time or immediately thereafter ren-:ove and relocate its property also underground. The Permittee may locate ce: rain cauipn-:e^,t above br ourtd on a showing of necessity to approval by the Director of Public Works. Facilities of a Permittee placed underground at the property owner's request in an area where outer electric utiLties or telephone utilities are aerial must be installed with the additional expense paid by the property owner. G. Permittee has the authority to trim trees overhanging the streets of the City so as to prevent the branches of such trees from coming into contact with a Permittee's wires and cable. All trimming must be done tinder the supervision and direction of the City and at the expense of Permittee. H In case of disturbance of any street caused by a Permittee, such Permittee must at its own cost and expense and in a ~~z.nner approved by the Director of Public Works of the City., replace and restore such street in as goon a condition. as before the work involving such disturbance was performed; provided, that where a cut or disturbance is tnde in a section of sidewalk paving, rather than replacing only the area to be cut Permittee must replace the full width of the existing walk and length of the section or sections cut. The section shall be determined as that area marked by expansion joints or scoring. I. The Permittee must maintain, repair, and keep in good condition for a period of one year following such disturbance al! portions of a sidewalk or street disturbed by it or its agents provided such maintenance and repairs are made necessary because of defective workmanship or materials supplied by rite Permittee. J The Permittee must at the request of any person. holding a building moving permit issued by the City temporarily rzise or lower its wires to permit the moving of such building. The expense of such temporary removal or raising or lowering of the wires must be paid by the person requesting the same and a Permittee shall have the authority to require such payment in advance. The Permittee mutt be given not less than 48 hours advance notice to arrange for such temporary wire changes. In the event of such a disagreement between a Permittee and a holder of a permit, such disagreement will be resolved by the Director of Public Works. K. If at any time in case of fire or disaster in the City; ii becomes necessary in the judgment of the A4ayor or the Chief of the Fire Department to cut or move any of the wire cables, amplifiers, appliances or other fixtures of a Permittee, the repairs rendered necessary by this must be made by a Permittee, at its own cost and expense and t~7thout charge against the City. L. The Permittee's work, while in progress, must be properly executed at all times with suitable barricades, flags, lights, flares, or other devices as are reasonably required to protect ' all members of the public having occzsion ±o use the portion of the streets involved, or adjacent property. Section 17-306. Initial System Installation Schedule Within thirty (30) days after *.he acceptance of the permit; a Permittee must proceed with due diligence to obtain all necessan~ Dermits and authorizations -r~hich are required in the conduct of its business, including but not limited to any utility joint-use agreements as well as any other permits, and authorizations to be granted by duly constituted regulatory agencies having jurisdiction over the operation of electrical distribution systems Section 17-307. Operational Stand:ands A. The Permittee co'denanU and agrees in consideration hereoY that it will maintain electric service in and to the City under :he rules and regulations imposed upon it by the Corporation Commission of the State of Oklahoma or by any other regularly constituted regulatory authority. But in accepting the permit, the Permittee does not guarantee continuous service at all times and shall be relie.•ed temporarily frorn its obligations to fi:rnish such services continuously in case of any injury cawed by an act of God or by the elements, strikes, lock-outs, or any temporary breakdown or failure of machinery, transmission lines; appliances and apparatus, or by other causes beyond the control of the Permittee; but it does agree in such cases to exercise proper diligence ir. repair of sucl: machinery, transmission lines, appliances and apparatus and to resume operation of same without unnecessary delay. B. The Perrittee covenants and agrees that it will indemnify and held the City of Owasso free and clear of any claims for damages or other,vise caused by the negligence of the Permittee in the construction or operation carried on hereunder. It is understood and agreed that in the event of claims being presented or prosecuted against the City the Permittee shall have the right to defend against the same and to settle and discharge same in such manner as it may see fit. To this end the City agrees to notif}~ :he Permittee of such claims and to furnish to it such information and assistance as may be necessary in the defense hereof Section 17-308. Removal of Facilities on Rt=quest On termination of service .o aey subscricer, a ''e:.natee must promptly remove all of its facilities and equipment from the premises, of suci; subscriber on written reques_. Such removal must be at no cost to the subscribe: Section 17-309. Compliance with State and Federal i(_aws The Permittee must at all times cotnply with all laws and regulations of the City of Owasso, State of Oklahoma, the Oklahoma Corporation Commission and the federal government or any administrative agency of it. Section 17-310. Revocation of Permit A. In addition to all the rights and powers reserved or pertaining to the City, the City reserves as an additional and separate and distinct power, the right to terminate the permit and all rights and privileges of a Permittee under this ordinance in any of the following events or for any of the following reasons: 1. The Permittee must b}• act or omission violate any term or condition of this ordinance and will fail to do so within. thirty (30) days following written demand by the City to effect such compliance Z. .A:,y provision of this ordinance mwt be finally adjudged by a court of law invalid or unenforceable and further finds that such provision constitutes at that time a consideration material to the continuance of the permit .;ranted in this ordinance. 3. 1'he Permittee becomes insolvent, unable, or unwilling to pay its debts or is adjudged bankrupt, or all or part of Permittee's facilities should be sold under an instrument to secure a debt and are not redeetnable by Permittee within thirty (30) days from the sale. 4. The Permittee attempts to or does practice any fraud or deceit i:, its conduct or relations under the permit with the City or subscribers or potential subscribers. B. No revocation will be effective unless or until the Council has adopted an ordinance setting forth the cause and masons for the revocation and the effective date of it. Such ordinance will not be adopted w~theut ten (10) days prior written notice to a Permittee and an opportunity for a Permittee to be heard on the proposed action oYthe proposed ordinance. In the event such an ordinance is adopted and the ordinance depends on a r?nding of fact, such finding of fact as made by the Council after the hearing provided for will be conclusive. C. A Permittee will net be declared in fault or be subject to any sanction under any provision of this ordinance in any case in which performznce of any such provision is prevented for reasons beyond its control. That there is hereby granted by the City of Owasso, a municipal corporation of the State of Oklahoma, (hereinafter referred to as "Grantor"j, unto Public Service Company of Oklahoma, an Oklahoma corporation, its successors and assigns, (hereinafter referred to as "Grantee"), the right, power and authority to use the streets, alleys, avenues, ways and other public places of Grantor as now constituted and as it may be hereafter extended, for the purpose of building, equipping, maintaining, extending, owning and operating a plant and system for the manufacture, transmissions, distribution and sale of electricity for lighting, heating and power purposes as well as for such other purposes as electric energy may be put, in and to said Grantor and to the public generally, and to transmit electric energy over transmission lines to connections and systems in other localities, with poles, wires, conduits, sub- stations and apparatus necessary and convenient for such plant and system upon, across, over and under each and any of said streets, alleys, avenues, ways and other public places and grounds. aooK5264eaeE 15Q7 ~EcTION ~. SECTION 3. All provisions of this Ordinance and franchise which are obligatory upon or which inure to the benefit of the Grantee shall also be obligatory upon and shall inure tc the benefit of its successors and assigns, and the word "Grantee" as used in this Ordinance shall include and be taken to mean not only Public Service Company of Oklahoma, but also its successors and assigns for which assignment consent is hereby given. SECTION 4. Grantee shall have the right to make and enforce reasonable rules and regulations for the sale, delivery and metering of its electric energy and the conduct of its business, and may reserve in such rules and regulations the rtglrt to disconnect service to customer where Grantee's meters, wires switches, or appliances are found to have been tampered witl~~, or- who have failed to pay for electricity, and to enter upon ti~~e premises of its customers at ail reasonable tunes for the purp~,~e of inspecting, repairing or reading meters or for removing wires, meters, switches or appliances. Provided that such rules and regulations shall not be ~n conflict with law or the rules and regulations from time to time made by the Corporation Commission of the State of Oklahoma cr by other regularly constituted regulatory authority. SECTION 5. Grantee covenants and agrees in consideration hereof, that it will maintain electric service in and to Grantor under the rules and regulations imposed upon it bv_ the Corporation Commission of the State of Oklahoma or by other regularly constituted regulatory authority. But in accepting this franchise and contract, Grantee does not guarantee continuous service at all times and shall be relieved temporarily from its obligation to furnish such services continuously in case of any disability caused by act of God or by the elements, or strikes. or lock-outs, or by any temporary breakdown or failure of machinery, transmission or distribution lines, appliances or apparatus, or by other causes beyond the control of Grantee: but it does agree in such cases to exercise due diligence in repair of such machinery, transmission or distribution lines, appliances and apparatus, and to resume operation of same without unnecessary delay. The Grantee covenants and agrees that it will indemnify and hold the City of Gwasso free and clear of any claims for damages or otherwise caused by the negligence of the Grantee in the construction or operation carried on here-under. But it is understood and agreed that ~n the event of claims being presented or prosecuted against said City the Grantee shall have the right to defend against the same and to settle and discharge same in such manner as it may see fit. And to this end said City agrees to notify the Grantee of such claims and to furnish to it such information and assistance as may be necessary in the defense hereof. SECTION 6. In performing the terms and provisions or" this Ordinance, franchise and contract. Grantee is hereby given the continuing right, privilege and option to manufacture said electric energy within the corporate limits of Grantor, or to transmit said current over transmission lines from other plants and to distribute same from some central location at proper voltage; together with the right to transmit electric energy from and through said City to other localities. Grantee is hereby ' e~oK5264P~~E 1508 authorized to allow others, having a permitted right granted by said City, to attach facilities to its poles and structures on such conditions as it deems just and reasonable; provided, should the parties be unable to agree, the City Council of said City shall determine such conditions as are just and reasonable, which shall be binding upon all parties. SECTION 7. During the life of this franchise and for and in consideration of the acceptance hereof by Grantee, it is agreed that Grantee may charge and collect from Grantor, its inhabitants and the consumers therein, a rate or rates, which shall at all times be compensatory and reasonable, subject to such rules and regulations as are now in effect or that may hereafter be lawfully made by the Corporation Commission of the State of Oklahoma, or by other regularly constituted regulatory authority. SECTION 8. During the life of this franchise, Grantee will sell and deliver to Grantor all electric energy requested by it for the lighting of its streets and in pumping necessary for its municipal water and sewer plants and systems. SECTION 9. From and after the approval and acceptance of this Ordinance, the Grantee shall pay, and in consideration of the granting of this franchise agrees to pay to the Grantor as a franchise tax, and as a compensation for the right and privilege enjoyed hereunder, a sum equal to two percent (2%) of its gross receipts from the sale of electrical energy within said City, payable monthly on or before the 20th day of each month, on such receipts for the preceding calendar month, which tax shall be in lieu of all concessions, charges, excise, franchise, licenses, occupation, privilege and permit fees, or taxes, except assessments for special improvements and ad valorem taxes. SECTION 10. This Ordinance and franchise shall be in full force and effect from and after its acceptance as hereinafter provided, upon its passage and approval by a vote of the majority of the qualified electors residing within said City, who shall vote thereon at a special election called under or pursuant to the provisions hereof; and if this Ordinance fails to be so approved at said election, it shall be wholly void and of no effect. The Mayor of said City is hereby authorized and instructed to call by resolution such election in the manner and form provided by the laws of the State of Oklahoma for the calling of special elections, giving such notice and preparing such resolution, ballot title and call therefore as provided by law for the purpose of submission to the qualified electors residing within said City the proposition of approval or refusal of this Ordinance and the franchise hereby granted; and the proper offices of said City are hereby directed to do all things that may be necessary for holding of said election and for the submission of said question and shall, in all things, comply with laws of the State of Oklahoma,. in the designation of the day, month and year of said election, the hours of opening and closing polls, the voting places within said City in which said election shall be held and the proper persons within the respective precincts of said City for the purpose of holding said election. It is understood and agreed that in the event said franchise be approved at such election the Grantee shall within thirty (30) days after the result of such election is declared as provided by law, file with-the Clerk of said City an acceptance in writing duly executed according to law, accepting this Ordinance and franchise. eaoK5264 PacE 1509 SECTION 11. Upon the filing by the Grantee of the acceptance of this Ordinance as hereinabove provided, all rights, privileges and obligations of any other ordinance and franchises, or portions thereof, under which said Grantee may now be exercising its privileges of use of the streets, alleys, avenues, ways and public places and grounds in said City and particularly ~ Ordinance #72 of said City and all other ordinances and parts of ordinances in conflict herewith, shall be and thereafter remain cancelled, annulled and repealed. This ordinance shall be published within fifteen (15) days after its passage, in a legal newspaper of the county, which newspaper has been continuously and uninterruptedly published in Tulsa County, Oklahoma, during a period of more than one hundred and four (104) consecutive weeks immediately prior to this date and to the first publication of such notice; and which newspaper has had during all of said period and does have, a paid general subscription circulation in said Tulsa County, Oklahoma, and which said newspaper has entrance into the United States mail as paid second-class mail matter. Q E,. ~~ , 4 MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: LAKESHORE GREENS FINAL PLAT DATE: April 8, 1997 BACKGROUND The City of Owasso has received a request from the Larkin Bailey Foundation, current owners, for the review of a final plat for Lakeshore Greens. Lakeshore Greens is located north of the northeast corner of E. 86th Street North and Mingo Road along the northern portion of the Bailey Golf Course. An area map has been enclosed for your information and review. The subject property is zoned PUD (Planned Unit Development), with the underlying designation t of Residential Multi-Family Low Density. RM-1 zoning allows for the development of multi- family housing (apartments) outright at that location. Please note, however, that no tax credit. low-income, or rent subsidized housing is being_proposed b t~pplicants. The preliminary ' plat for Lakeshore Greens was approved by the Planning Commission at their February 13, 1997 regular meeting. The final plat which contains 2 lots with an acreage total of approximately 14.18 acres, was reviewed by the Technical Advisory Committee at their regular meeting on February 26, 1997. ~ At that meeting, the only comment from utility companies was the need for an additional easement along the shared property lines of Lots 1 and 2. This correction has been added to the final plat enclosed within your packet. Staff provided comments in the following areas: * Acceleration/Deceleration lanes will be required at the entrance off of Mingo Road. * Sidewalk along Mingo Road will be required. * There are different/conflicting easements shown on the east side of Mingo Road on the plat and the site plan. PSO requested an additional 17.5' utility easement outside of the right-of-way at the preliminary plat meeting. This item has been corrected on both the plat and the site plan (next agenda item). The City of Owasso's policy regarding a final plat that receives Planning Commission approval ' is to not forward the plat to the Owasso City Council until DEQ has issued permits for the construction of water and sanitary sewer lines. Construction plans have been submitted to both the Engineering Division of Public Works and DEQ. DEQ has issued permits to construct both ' the water and sanitary sewer lines necessary to serve the Lakeshore Greens property and these are attached for your information and review. _ As stated earlier in the memo, the final plat is for property that contains an RM-1 underlying zoning classification and allows for multi-family housing. No tax credit, low-income or rent ~ subsidized housing is being proposed b t~applicants. Both the final plat and the site plan for Lakeshore Greens were unanimously approved by the Planning Commission at the March 11, 1997. The Brentwood Park water and sanitary sewer systems were accepted by Council on January 7, 1997. Designs for the streets and storm drains were reviewed and construction inspected by Public Works personnel. FINAL INSPECTION: The final inspection was attended by the contractors and Public Works personnel on March 27, 1997. Punch lists were forwarded to the developer on March 31st. All punch list items have been corrected. A one-year storm drainage maintenance bond and atwo-year street maintenance bond have been provided (see attached). Avenue between 76th and 86th Streets North. Quarry trucks have since been limited to use of 66th Street North for access to US Hwy 169. This project consists of repairing two areas of pavement in the north bound lane of 129th East Avenue at the new 6th Grade Center being constructed by the Owasso Board of Education. The work will be scheduled to be performed immediately prior to placement of the school acceleration and deceleration lanes which will abut the repair areas. BID DOCUMENTS The Engineer's estimate indicated that the project needed to be advertised and sealed bids received. Specifications and drawings were prepared by the Public Works Department Engineering Division. The solicitation is for repair of two strips of pavement totaling 253 square yards (see attached drawing). Bids were received on April 9, 1997. Three bidders responded with bids ranging from $20,972.19 to $32,219.10. BID ANALYSIS Horizon Construction, Tulsa, Oklahoma, submitted apparent the low bid at $20,972.19. The engineer's estimate was $15,580.00 (see attached bid tabulation). Horizon has complied with all solicitation requirements and has provided evidence of previous street repair experience. FUNDING SOURCE ' Funds for this project are avaiable in the FY 96-97 Street Division Capital Outlay budget (Line Item 51-410-5461) currently containing a total of $37,214.52. At the end of the last mowing season, it was anticipated that repairs would need to be performed on the 15-foot flex-wing rotary cutter (batwing). The cutter attaches to a tractor and is the largest piece of equipment used by the mowing crew. This cutter is heavily used and is a vital component of the equipment due to the versatility. The exact age of the cutter is unknown, but is believed to be in excess of 11-years old. It was determined that repair will require replacement of the drive lines and rebuilding or replacement of the gear boxes. Costs of these repairs have been estimated in the range of $3,300 to $6,500. As an alternative to repair of this aged equipment, preliminary price quotes were obtained from three vendors for a new unit. New prices were received in the range of $9,250. to $11,000 for a heavy-duty cutter. As a result, staff did not consider repair to be cost-effective due to the age of the cutter. BID PROPOSALS: ,~, In accordance with city purchasing procedures, sealed price proposals were solicited from five (5) potential vendors. Proposals were received from four (4) bidders on April 4, 1997 as shown on the next page. All potential vendors submitted quotes on equipment that met or exceeded the specifications. Chief Stuckey Mike Knebel John Mowery MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: AMBULANCE ORDINANCE REVIEW COMMITTEE SUBJECT: REVIEW FINDINGS DATE: March 19, 1997 PROJECT PROPOSAL The project proposal was to review and evaluate the ambulance service. In Juice 1987, the City Council approved the Advanced Life Support Ambulance Ordinance. This set forth minimum service requirements and certification levels of personnel. The Fire Department was assigned the duties and responsibilities of providing and managing the ambulance service. PROJECT OBJECTIVES On January 24, 1997, the team held it's first meeting to determine facts relating to the ambulance ordinance. The project team researched, reviewed, and evaluated the following objectives: A. Determine the number of ALS (Advanced Life Support) and BLS (Basic Life Support) emergency responses: In calendar year 1996, there was 994 emergency responses of which 72.9% required Basic Life Support and 27.7% required Advanced Life Support. This research shows the majority of emergency responses required a lower level of care than ALS. Refer to Attachment (A). B. Would our allowable ambulance charges decrease if the ambulance license was lowered to BLS? Yes, the State Department of Health allows a higher rate to be charged for ALS response. A dramatic reduction in revenue would have been realized for 1996 in the amount of $38,835.00 if the license had been reduced to BLS. Refer to Attachment (B). C. Would changing our ambulance license to BLS result in a decreased level of service to our citizens? This would decrease the level of service for 27% of the patients treated, which required Advanced Life Support in 1996. The following is a summary of the skill levels in each category: BLS -Basic Life Support Basic EMT -CPR, basic shock management, wound management, emergency vehicle operations, minor medical emergencies, child birth, splinting, psychiatric, and Automatic External Defibrillator (AED). ALS -Advanced Life Support Intermediate EMT -All of the skills listed as basic with the addition of adult intubation, IV therapy, advanced patient assessment, advanced shock management, advanced trauma skills, and Automatic External Defibrillator (AED). ~ Paramedic -All of the skills listed as basic and advanced with the addition of pediatric intubation, nasal intubation, needle thoracotomy, digital intubation, nasal ' gastric intubation, advanced cardiac life support, advanced medical emergencies, advanced emergency childbirth, advanced pre-hospital trauma life support, pediatric ~ advanced life support and pre-hospital legal studies. D. Research other options as identified by the team. Under our present licensure, the State Department of Health will allow AED's to be used by all fire department personnel without lowering to a BLS license. BUDGET A project of $1,500.00 was projected to cover the cost of materials, phone calls, and printing. To date, $225.00 has been expended on the above mentioned items. PROJECT MANAGER The Mayor of the City of Owasso served as the Project Manager and has provided outstanding leadership throughout all phases of this project. TEAM MEMBERS The project team members included: City Counselor Mike Helm, the Fire Chief Bob Allen, Assistant Fire Chief Mark Stuckey, Mike Knebel and John Mowery. These members provided support, guidance and many hours of fact-finding to provide the citizens of Owasso with the best emergency medical care possible. MAJOR MILESTONES ^ The team held four meetings starting on January 24, 1997 and ending on March 20, 1997. During ~ these meetings, many facts and alternative methods of funding, licensure levels, and service levels ,,~ were discussed. The projected time schedule has been adhered to. The Ambulance Ordinance Proposal is scheduled to be presented at the May 20, 1997 Council Meeting. PROJECT TERMINATION CHECKLIST The Assistant Fire Chief will manage the Project Termination. ALEXANDER CHIEF OF POLICE ~ SUBJECT: Addition to Enhanced 911 Board DATE: April 7, 1997 BACKGROUND: During a recent Regional Enhanced 911 Board meeting on March 12, 1997, the executive board members voted to recommend Washington County (Skiatook and Collinsville exchanges) be allowed to participate in the Tulsa regional 911 system. Southwestern Bell advised the Board that joining the regional 911 system represented the most cost effective method for Washington County to provide Enhanced 911 service to its citizens on the southern portion of the County. Each jurisdiction must sign an Amendment to the Interlocal Agreement in order for Washington County to become a part of the regional system. This Amendment also renews each local governments' participation in the regional system for another year. IMPACT: The Washington Counties exchanges will be answered by the Skiatook communications center and forwarded to the appropriate agency. None of the Owasso citizens who currently receive 911 assistance through the Owasso Communications Center will be impacted. Only those exchanges within the unincorporated areas will be included in this proposal. RECOMMENDATION: Staff recommends Council approval of the Amendment and authorizes the Mayor to execute said document. Ms. Domin explained the request includes the Skiatook and Collinsville exchanges in southern Washington County and use of the Tulsa facilities is the most cost-effective method of providing 911 service to residents in that area. She pointed out the request is similar to the Rogers County request of a few years ago. Ms. Domin distributed a sheet entitled Regional Enhanced 911-Washington County Impact. Margie Settlemyre explained there are 559 access lines in the Collinsville and Skiatook exchanges of Washington County and that the monthly cost to the Regional 911 system increases $70.40. However, according to the interlocal agreement, Washington County's share of the Regional 911 system's cost is $123.85 resulting in a monthly savings to the region of $53.45. Ms. Settle also explained that the distributed sheet shows a reimbursement schedule for Washington County's share of the initial installation costs. Those PSAPs wishing to collect the reimbursement shown on this schedule would need to bill Washington County individually. Upon motion duly made by Mickey Perry, seconded by JaElla Vanatta, the Board voted to allow Washington County access to the Tulsa Regional 911 system facilities as presented and to allow the County to appoint a representative to the Regional Enhanced 911 Board. Report and Possible Action from Equipment Upgrade Committee: John Jarrett explained that the Equipment Upgrade Committee had viewed demonstrations from several vendors that provide PSAP equipment. The most functional equipment is manufactured by Tel Control, Inc. (TCI) and, at that time, Mr. Jarrett distributed a brochure on Tel Control, Inc. 911 equipment. Mr. Jarrett stated that the City of Tulsa has agreed to test this equipment, on a limited basis, and that the equipment will be installed in late March. As soon as the installation is complete and the test equipment is operational, the Regional 911 Board will be invited to view a demonstration of that equipment. TCI equipment represents the new "Telephony" which is a cross between a computer and a telephone. Mr. Helm announced that he needed to leave the meeting, but advised that he has talked to Senator Lewis Long regarding whether a 911 fee can be charged to cellular phone customers. Senator Long has submitted the question to the Attorney General and, hopefully, he can provide the 911 Board with some direction as to how to proceed on the issue. Chair Helm left the meeting at this point and Mr. Jarrett assumed the position of Chair for the remainder of the meeting. Larry Short then provided and explained an overhead picture of the TCI Telephony system work station configuration and features. Torrie Whisman of Southwestern Bell advised that Southwestern Bell believes they have created a way in which the TCI system could be provided to the region at a lower cost than the present system. A lower cost is not definite, and Southwestern Bell will continue to explore potential funding mechanisms for the new system. 3.12.97(2) JaElla Ella Vanatta voiced concerns about the effect of cut lines if the new system is installed, as one controller would serve four PSAPs. Ms. Whisman replied that Southwestern Bell has considered this problem and they would build in redundancy to the system. VI. Discussion and Possible Action on Proposed 911 Legislation: Ms. Domin stated three bills relating to 911 have been introduced in the Oklahoma Legislature. At this point, two are still alive, one of which involves language relating to removing a 911 advisory committee that has already completed its work. The other prohibits programming of speed dials to automatically dial 911. Mr. Jarrett agreed that telephones that automatically dial 911 without a caller on the phone, for example when an alarm goes off, are a problem for the Tulsa PSAP. VII. Announcements and Updates: A. Discussion and Distribution of New ESNs for Cellular Calls Ms. Domin distributed a list of new Tulsa area ESN assignments for cellular 911 calls. Dale Frizzell advised that as of March 17`h the Tulsa PSAP will no longer be receiving all Sprint PCS 911 calls; they will be directed to the closest PSAP. B. Discussion of Use of 311 John Jarrett advised that 311 is a new number for non-emergency calls that is being tried in Baltimore, Maryland. Ms. Domin distributed an article explaining the 311 system. Dale Frizzell provided National Emergency Number Association (NENA) and APCO ~ positions on 311. She stated NENA is opposed to any non-emergency three-digit number. Their concern is that 311 will open up a new realm of confusion for citizens and would become the number that citizens call for every type of governmental complaint. In addition, it would bring additional costs to public safety communication systems. C.
