Such purchase price established by state bid #0070-48-10-100 through the Oklahoma Department of Central Services. 11. Consideration and Appropriate Action Relating to a Request for Approval of the Final Plat for Central Park II, Located Southwest of Central Park and East of Lakeridge, Containing 41.56 Acres. Mr Rooney Attachment #11 The staff will recommend approval of the final plat for Central Park II. 12. Consideration and Appropriate Action Relating to a Request to Close a Portion of a Utility Easement Located Within Lot 9, Block 1, Barrington Point, an Addition to the City of Owasso. Mr Rooney Attachment #12 The staff will recommend closing the southeast 7'/z feet of the northwest 171/z foot utility easement as approved by the Owasso Planning Commission. Consideration and Appropriate Action Relating to a Request for City Council Approval of a Supplemental Appropriation to the General Fund's Street Department Budget. '* Ms Bishop Attachment #21 The staff will recommend Council approval of a supplemental appropriation to the General Fund's Street Department budget in the amount of $20,972.19, to fund a contract awarded on April 15, 1997 for the 129th E Ave repair project. Ms Bishop Attachment #22 The staff will recommend Council approval of a supplemental appropriation to the Garage Fund budget in the amount of $26,000, for the purchase of parts for resale. 23. Consideration and Appropriate Action Relating to a Request for City Council Approval of a Supplemental Appropriation to the Self-Insurance Fund's Budget. Ms Bishop Attachment #23 The staff will recommend Council approval of a supplemental appropriation to the Self- Insurance Fund budget in the amount of $5000, for the purpose of funding repairs to city vehicles insured by the fund. 24. Consideration and Appropriate Action Relating to Acceptance of a COPS Fast Grant, and Authorization for the Mayor to Execute the Appropriate Documents. Chief Alexander Attachment #24 The Owasso Police Department has been awarded a grant in the amount of $225,000 by the U.S. Department of Justice for the employment of three additional police officers. Report Relating to the Status of the Construction of Improvements by the YMCA to the Owasso Recreation Center. Adjournment OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING ' Tuesday, May 6, 1997 The Owasso City Council met in regular session, jointly with the Owasso Public Works Authority and the Owasso Public Golf Authority, on Tuesday, May 6, 1997 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p. m, on Friday, May 2, 1997. ~ ITEM 1: CALL TO ORDER ' Mayor Ewing called the meeting to order at 7:05 p. m. ~ ITEM 2: INVOCATION The invocation was offered by Alyson Ramey, daughter of outgoing Vice Mayor Joe Ramey. ITEM 11: OATH OF OFFICE ADMINISTERED TO CITY COUNCILORS The Honorable Michael Hilsabeck, Owasso Municipal Court Judge, administered the oath of office to Councilor-Elect Bode and Councilor-Elect Wilken, and to those remaining in office, Councilors Barnhouse, Helm, and Standridge. Councilors Bode and Wilken were then seated at the Council bench along with the remaining Councilors. ' ITEM 12: ELECTION OF MAYOR/OPWA CHAIR/OPGA CHAIR II Councilor Barnhouse, the ranking member of the Council, presided, and called for nominations for Mayor. Mr Helm nominated Ms Barnhouse for Mayor and Chair of the OPWA and OPGA, seconded by Dr Standridge. ITEM 14: RECESS TO COMMUNITY CENTER ACTIVITIES ROOM FOR RECEPTION Mayor Barnhouse recessed the meeting at 7:15 p.m. A reception honoring outgoing Mayor Danny Ewing, outgoing Vice Mayor Joe Ramey, new Councilors Bode and Wilken, Mayor Barnhouse, Vice Mayor Standridge, and Councilor Helm was held in the activities room. Director of Golf Warren Lehr acted as Master of Ceremonies, and each of those being honored made brief remarks to the gathering. ITEM 15: ADJOURNMENT Mayor Barnhouse adjourned the meeting at 8:05 p.m. due to lack of a quorum. Staff developed a bid packet for the construction of the gravel parking lot, which included a 110' x 336' gravel parking lot, compacted to 95 ' standard proctor density. The top six inches of the soil were to be removed and relocated to different areas within the Sportspark as well. A diagram of the parking lot is attached for your information and review. ^ A total of eight contractors supplied sealed bids for the project, with the contract for the improvements being awarded on December 3, 1996 to AM-RAIL Construction of Tulsa for the amount of $19,089.00. Funding for the improvements was contained within the FY 1996-97 Capital Improvements Fund. The award of bid memorandum for the parking lot improvements is attached for your information and review. ~ In February of 1997, payment in the amount of $18,134.55 was made to AM-RAIL Construction ~ for completion of the parking lot improvements. A retainage equalling 5 % of the completed work ($954.45) was maintained by the City of Owasso in order to ensure that the project was completed and installed successfully. A copy of the application and certificate of payment is attached for your information and review. At this time, the contractor is requesting final payment (release of retainage) for the parking lot ~ improvements. The parking lot has been inspected by Mr. Warren of the Parks Department and Ms. Duggan of the Engineering Division of Public Works. The parking lot conforms with all of the specifications stated in the original bid document and has provided much needed additional parking during the Soccer season. Staff developed a bid packet for the construction of the gravel parking lot in the fall of 1996, and bid packets were available to prospective bidders in early November. A copy of the October 11, 1996 City Manager's Report is attached. The bid packets included specifications for the construction of a 110' x 366' gravel parking lot, compacted to 95 % standard proctor density. The top six inches of the existing soil will be removed and replaced with six inches of Type "A" aggregate. Arrangements were also included to relocate the removed soil to other areas within the Sportspark. A total of eight contractors supplied bids for the paving improvements and they were opened on November 20, 1996. FUNDING: Funding for the Sportspark parking lot construction was included in the FY 1996-97 Capital Improvements Fund in the amount of $25,000.00. Please note, however, that a portion of that money is also earmarked for the construction of a water line to the soccer playing areas. The "' bid received for the parking lot construction is lower than anticipated by staff ($20,000.00), and we are confident that the waterline can be constructed with the remaining funds. AGREEMENT 1096 00300 - 12 of 15 0 I ~h MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR DAVID WARREN PARK SUPERINTENDENT SUBJECT: REQUEST FOR THE EXPENDITURE OF FUNDS AND AUTHORIZATION FOR PURCHASE OF A 1997 FORD F-150 TRUCK FOR THE PARKS DEPARTMENT DATE: May 1, 1997 BACKGROUND OF CURRENT VEHICLES AND USES The Owasso Parks Department currently utilizes two vehicles in order to perform necessary park maintenance operations, a Chevrolet 1-Ton Service Truck and a Chevrolet S-10 Pick-Up Truck. The Chevrolet 1-Ton Service Truck was purchased in 1992 and is the larger of the two vehicles. It is utilized for the towing of mowing and maintenance equipment, hauling dirt and screenings used in park projects, as well as the removal of trash, limbs, and debris from city parks. Due to the tasks performed by park personnel and the equipment needed to perform many of these tasks, this vehicle is the primary vehicle within the Parks Department. The second vehicle, the Chevy 5-10, is a 1986 model with 100,000+ miles to its credit, and was obtained from the Utility Billing Division of Public Works three years ago. Prior to its use within the Parks Department, this vehicle was utilized for water meter sets, removals, and meter reading purposes. Within the Parks Department, the Chevy S-10 has been utilized to perform minor projects and tasks, as well as the back-up vehicle for the Chevy 1-Ton. CURRENT NEEDS As the community has grown, as well as Parks Department staffing (an additional full-time employee was allocated in FY 1996-97), the demand to complete and address more than one task or project at a time within the city parks has also increased. The ability to utilize two vehicles to tow or transport major equipment utilized by the department, as well as personnel, is currently limited as the Chevy S-10 is not sized to perform these functions. In fact, when the Chevy 1-Ton is being serviced or repaired, the Parks Department often is required to call upon Public Works vehicles for towing purposes or must delay project completion. In short, the purchase of a larger pick-up truck, with the necessary equipment and features for towing, would be of great assistance to park operations and productivity within the department. Staff Report Parks Department Vehicle Purchase Page 2 of 4 AVAILABLE FUN-DING In August of 1996, the Owasso Parks Department requested and received acarry-over budget request in the amount of $7,500.00 in order to begin saving for the future purchase of the above described vehicle. A copy of the memorandum requesting this carry-over is attached for your information and review. In April of 1997 during the budget hearing process, staff indicated a request to carry over available monies from the FY 1996-97 to FY 1997-98 in order to purchase the vehicle during the FY 1997-98 budget year. The Parks Department had saved additional monies this year through savings on several identified projects; as well as the utilization of a part-time employee rather than replacing afull-time employee who left the city in February of 1997. As a result of these savings, and the knowledge that the busiest season and its accompanying projects are upon staff now, it would appear to be in our best interest to pursue the vehicle purchase now as well. As a result, the vehicle could then be utilized this summer, during the peak demand on park operations, rather than waiting until the fall of 1997. AVAILABLE VEHICLES FOR PURCHASE Staff then reviewed the State Bid List for vehicles meeting the type described below with the preferred options: Full Size Pick-up Truck (8' bed) 2 Wheel Drive Engine Size and Accompanying Equipment for Towing Purposes Vinyl Interior Fred Jones Ford, Oklahoma City, was the recipient of the 1997 bid list for vehicles meeting the above description. Total Cost and Quote $ 17,420.00 A copy of all of the quotes received is attached for your information and review. REVIEW OF BIDS A review of the bids indicates that the vehicle quoted from Fred Jones Ford of Oklahoma City, also contained on the state bid list, would be the best option available for the Parks Department as it meets the preferred options and contains the largest engine of the three bids received. In addition, the quote received from Fred Jones Ford of Oklahoma City was also the lowest received at $16,080.00. As explained earlier within the memorandum, funding to purchase the vehicle is available within the FY 1996-97 Park Maintenance Budget. ADDITIONAL COMMENTS If the vehicle purchase is approved, the new vehicle will be picked up on Saturday, May 24th. The Chevy 5-10 vehicle currently within the Parks Department will then be transferred to Cemetery Operations in order to address needs within that division, allowing for the replacement of the 1964 vehicle currently being used. Utilization of the S-10 within this division will be ideal considering the relative short distances driven and types of tasks performed. Central Park II is located southwest of the Central Parl: addition, and east of the Lakeridge addition. The subject property is zoned RS-3 (Residential Single-Family High Density). The filial plat for Central Park II and its covenants are enclosed, as well as a copy of Central Park I plat. As reviewed with the Planning Commission through both the preliminary plat review in January of 1997 and the final plat review in March, the subject property contained within the Central Park II plat has been under several different development scenarios since 1994. In 1994, a preliminary plat for Central Park II was approved by the Planning Commission and contained a portion of the property contained within the plat currently before you. In 1995, after a change of ownership, a preliminary plat for Cardinal View was approved by the Planning Commission. This property contained a portion of the property contained within the plat before you, as well as the property where the regional detention pond is located and the Owasso Ninth Grade Center. Since that time, the property has once again changed ownership and the plat enclosed within your packet is the latest application. The final plat was reviewed by the Technical Advisory Committee at their February 26, 1997 meeting. At that meeting, several comments/requests for additional utility easements were made by utility companies and these are included within the current plat. Addresses and street names were also provided and are included within the current plat. Additionally, one exception of the Owasso Subdivision Regulations will be necessary in order for this plat to become reality. The "intersection" that occurs in the northwest portion of the plat (E. 89th Street North and N. 127th E. Avenue) does not meet the minimum distance required for streets to be offset. Staff is not oppossed to this exception request, as only four (4) residential homesites are located around the proposed "eyebrow" and should not create a substantial traffic flow challenge. Staff Report Central Parlc II Final Plat Page 2 of 2 Covenants for Central Park II resemble those of Central Park I. Construction plans for Central Park II have been submitted and approved by Mr. Lutz of the Engineering Division of Public Works. Staff/Council policy regarding final plats is not to present them for approval to the City Council until permits to construct the water and sanitary sewer lines are issued by DEQ. These permits have been issued and are attached for your information and review. The Owasso Planning Commission unanimously approved the final plat for Central Park II at their March 1997 regular meeting. The portion of the easement to be closed is described as the southeasterly 7.5' of the northwesterly 17.5' utility easement. An area map, as well as a case map, are enclosed for your information and review. As the applicants explain in their letter requesting the closure of the easement, the partial closing of the utility easement is being requested in order to allow them to construct an in-ground swimming pool. The subject property is currently developed with asingle-family residence. In order for Community development staff to be able to issue a building permit for the pool, it is necessary for the applicant's to obtain closure of that portion of the utility easement proposed to be occupied by the pool. Area utility companies reviewed the request at the April 30, 1997 Technical Advisory Committee meeting and had no objections to the request. Staff also reviewed the request at that time and is also not opposed as no water or sanitary sewer lines are located within the easement. The Planning Commission unanimously approved the closing request at their May 13, 1997 meeting. If the request is approved by the Council, an ordinance formally closing that portion of the easement would be presented to you at the June 3, 1997 meeting. Staff has no objections to the easement closing request. RECOMMENDATION: Staff recommends approval of the easement closing request, closing the southeasterly 7.5' of the northwesterly 17.5' utility easement on Lot 9, Block 1, Barrington Point Addition. La«~rence Carder Terresa Carden ~ MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FRONT: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: EASEMENT CLOSING REQUEST LOT 13, BLOCK 2, COPPER MEADOWS DATE: May 14, 1997 QACKGROUND: The City of Owasso has received a request for the closingof a portion of a utility easement located within Lot 13, Block 2, Copper Meadows Addition (7828 North 132nd East Avenue). The portion of the easement to be closed is described as the southernmost 1.4' of the northern 11' utility easement. An area map, as well as a case map, are enclosed for your information and review. The subject property is currently developed with asingle-family residence with an above ground pool. A recent survey performed for the subject property, usually indicating a planned sale of the property, indicates an encroachment of 1.4' into an 11' utility easement located on the subject property. In order for the dwelling to be "legally" permitted to exist at that location, the portion of the easement to be occupied must be closed. This can be accomplished, provided that the portion of the utility easement requested for closure is not occupied by airy utility services. Area utility companies reviewed the request at the April 30, 1997 Technical Advisory Committee meeting and had no objections to the request. Staff also reviewed the request at that time and is also not opposed as no water or sanitary sewer lines are located within the easement. Staff has no objections to the easement closing request, and has advised the applicant's attorney to pursue a Variance of the RS-3 property development standards from the Owasso Board of Adjustment. Providing the easement is closed, the dwelling is still located only 9.6' from the north property line and a minimum of 10' is required. Providing the Variance request is approved by the Board of Adjustment, all survey "flaws" with the property would be addressed. The Planning Commission unanimously approved the easement closing request at their May 13, 1997 regular meeting. If the closing request is approved by the Council, an ordinance formally closing that portion of the easement will be presented at the June 3, 1997 Council meeting. Staff has no objections to the request. Rooney '~ Community Development Director MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: TIlVIOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: PROPOSED AMENDMENT TO CHAPTER 10 OF THE OWASSO ZONING CODE REGARDING TELECOMMUNICATION TOWERS DATE: May 14, 1997 BACKGROUND: At the March 18, 1997 regular meeting of the Owasso City Council, Ordinance No. 541 was approved and adopted establishing a sixty (60) day moratorium on the construction or modification of all types of communication towers in the City of Owasso. The moratorium was established as a result of staff's review of the Owasso Zoning Code regarding telecommunication towers and the opinion that the Owasso Zoning Code was incapable of sufficiently addressing concerns regarding telecommunication towers. A copy of the memorandum recommending Council approval of Ordinance No. 541, the ordinance that established the moratorium, is attached for your information and review. WIRELESS BUILDOUT CONFERENCE: On March 24 and 25, 1997, staff attended the Wireless Buildout Conference in Dallas, Texas. The conference, sponsored in part by the American Planning Association, was designed to bring those involved with telecommunications towers (wireless communication providers, tower companies, and planning officials) together in order to clear up any misconceptions regarding the telecommunications industry, as well as to discuss the challenges communication towers present to communities and alternative means of regulation. Over 135 people attended the conference (the second of its kind nationwide), one third of which were municipal planning officials. In addition to a large amount of the information and guidelines that are contained within the proposed amendment, the following is a brief synopsis of information received at that conference: Currently there are over 40 million wireless customers in the United States. It is anticipated that by the turn of the century there will be 100 million wireless customers. There are currently 25,000 tower sites in the United States. By the year 2,000, it is estimated that the total number of towers will be 60,000 to 65,000. Competition within the industry has increased (see original memo). Staff Report ' Proposed Amendment to Chapter 10, Section 1004 Page 2 of 3 ~ Offering a streamlined permit process for telecommunication towers if desired items are included appears to work best for both the communities and providers. PCS will require additional towers and more locations than existing conventional cellular services. ~ Lower rates for this type of service should be anticipated. Due to the increased competition, providers are wanting a quick turnaround. Because of Owasso's relatively flat topography, less towers should be anticipated here than in other areas. Owasso's proximity to the Tulsa areas population will help reduce the amount of towers , in our city limits, although additional towers should be expected in Owasso. PROPOSED AMENDMENT: After reviewing the Owasso Zoning Code and attending the Wireless Buildout Conference, staff has developed a proposed text amendment. Ordinance No. 543, enclosed for your information , and review, would amend Chapter 10, Section 1004 of the Zoning Code by adding "wireless telecommunication and utility facilities" to the included uses spelled out within Section 1004. Additionally, it adds definitions utilized within the industry and sets specific criteria to be met ' by communication providers in order to be permitted by right in CG, CH, IL, IM, or IH zoning districts, and additional requirements to be met if requesting a Special Exception of the Owasso Board of Adjustment. A copy of the existing Section 1004 of Chapter 10 is attached for your information and review. Some basic factors that are required as a portion of this proposed amendment are as follows: It encourages the placement of towers in CG, CH, IL, IM, and IH districts through not requiring Special Exception approval, provided specific requirements are met by the applicant. Towers of a monopole design, or one of equal or lesser impact, are required in order to be permitted by right. Must be monopole if within 200 feet of residential property if requesting a Special Exception. Towers with the co-location abilities for a minimum of three providers. Security fencing Staff Report Proposed Amendment to Chapter 10, Section 1004 Page 3 of 3 Minimum setbacks for towers depending upon height, as well as minimum setbacks from residential districts. Allows for the placement of telecommunication equipment on existing sign structures, utility structures, and buildings and establishes minimum standards to be met for each. This is a brief overview of several items contained within the proposed amendment, and is not all inclusive. Again, Ordinance 543 is enclosed for your information and review and it contains all language and requirements that would be included. INDUSTRY INPUT: Copies of the proposed ordinance amending the Owasso Zoning code were sent to Southwestern Bell Wireless Services and Mr. Keven Coutant, an attorney who represents numerous telecommunication providers in the Tulsa Metropolitan Area. Mr. Coutant worked with the City of Sand Springs in the development and review of their telecommunication tower ordinance. No comments regarding the proposed ordinance were received prior to the Planning Commission meeting on May 13, 1997. Staff did receive comments from Ms. Lee Ann Fager of Southwestern Bell Wireless on Wednesday, May 14, 1997. Staff reviewed these comments with Ms. Fager via telephone, addressed several of her concerns and comments specifically, and explained the staff's position regarding the proposed amendment. One comment Ms. Fager submitted regarding the inclusion of a definition of "historically significant landscapes" and "architecturally significant structures" has subsequently been addressed in the proposed amendment. The Planning Commission unanimously recommended approval of the proposed amendment at their May 13, 1997 regular meeting. Due to the lack of regulation regarding this type of use, staff has also included an emergency clause with this ordinance. X41 - ESTABLISHING A SIXTY (60) DAY ~ MORATORIUM ON THE CONSTRUCTION OR MODIFICATION OF COMMUNICATION TOWERS DATE: March 13, 1997 BACKGROUND: Approximately two years ago, and again in August 1996, the FCC auctioned off to the highest bidder the right to exclusively occupy and use defined portions of the radio airways spectrum. As a result of these actions and the subsequent enactment of the 1996 Telecommunications Act by Congress, numerous telecommunications companies have been created. A significant portion of these "new" companies are establishing wireless communication networks all across the United States, in an attempt to provide the next generation of cellular phone technology or Personal Communication Services (PCS). PCS is similar to existing cellular telephone service with the exception that it is operated at a higher frequency -thus resulting in a technical requirement of double the communications facilities which have supported cellular technology. As a result, an onslaught of communication tower applications is anticipated throughout much of the United States. OWASSO ZONING REGULATIONS: In staff's opinion, the City of Owasso's Zoning Code is inadequate to address land issues created by the 1996 Federal Communications Act and PCS technical needs. Currently, communication towers are permitted by right in any commercial or industrial district in Owasso, subject to setback requirements. In all other areas (residential, office, and agriculture), towers are permitted only if a Special Exception is received through the Board of Adjustment. The staff concerns are as follows: Various types of towers exist (monopole, lattice, guy-wired) today and consideration should be given to restricting those that are aesthetically challenged. As a majority of the land abutting the Owasso Expressway is zoned for commercial and/or industrial uses, consideration should be given to preserve this corridor from the intrusion of to«~ers. 3. The Zoning Code does not contain criteria for the Board of Adjustment to consider regarding communication towers. Consideration should be given to establish minimum standards for appropriate colors, types, setbacks, screening, lighting, signage, and height. 4. The Zoning Code contains no requirement to design towers to accommodate multiple users. This may be singularly the best way to minimize the number of communication towers. 5. The Zoning Code does not require the removal of abandoned towers. 6. The Zoning Code contains no up to date definitions relating to issues associated with cellular and PCS antenna towers and antennas. WHAT OWASSO CAN AND CANNOT DO: ~ The 1996 Telecommunications Act states: "Except as provided (herein), nothing in this act shall limit or affect the authority of a State or local government or instrumentality thereof ' over decisions regarding the placement, construction, and modification of personal wireless service facilities." The Act does, however, place three important limitations on local governments 1) cities may not "unreasonably discriminate among providers of functionally ~" equivalent services," 2) cities may not "prohibit or have the effect of prohibiting the provision of personal wireless services," and 3) cities may not regulate personal wireless services "on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the (FCC's) regulations concerning such emissions." CONCLUSION: In light of the concerns contained within this memorandum and recent action by the City of Tulsa establishing a moratorium in order to update and redefine their zoning code, staff feels it is in the best interest of the Council to establish a sixty (60) day moratorium concerning the construction and/or modification of communication towers. Because the City of Tulsa has established a moratorium prohibiting towers, it is quite likely that communication providers may look to Owasso and other communities in which to locate their towers. (B) The term "telecommunications" means the transmission, between or among points specified by the user, or information of the user's choosing, without change in the form or content or information as sent and received. (C) The term "telecommunications service" means the offering of telecommunications for a fee directly to the public, or to such classes ~ of users as to be effectively available directly to the public, regardless of the facilities used. (D) The term "antenna" means any structure or device used to collect or radiate electromagnetic waves, including both directional antennas, such as panels or dishes, and omni-directional antennas, such as whips, but not including satellite earth stations. (E) The term "telecommunications antenna" means an antenna used to provide a telecommunications service. (F) The term "antenna array" means a structure attached to a telecommunication tower that supports telecommunication antennas. (G) the term "whip antenna" means an omni-directional dipole antenna of cylindrical shape which is no more than six inches in diameter. (H) The term "non whip antenna" means an antenna which is not a whip antenna, such as dish antennas, panel antennas, etc. (I) The term "EIA-222" means Electronic Industries Association Standard 222, "Structural Standards for Steel Antenna Towers and Antenna Support Structures" (J) The term "historically significant landscapes" and "architecturally significant structures" shall apply to those areas identified as such within the National Register of Historic Places. 1004.4 TELECOMMUNICATION TOWERS (A) NO SPECIAL EXCEPTION REQUIRED (1) Pertnitted By Right -Telecommunication towers are a permitted use in all CG, CH, IL, IM, and IH if proposed towers satisfy the following requirements. Telecommunication towers permitted under this subsection may exceed compatibility and base district height restrictions. (a) Aesthetic Protection Telecommunication facilities shall be so located to ensure that historically significant landscapes are protected. The views of vistas from architecturally and/or historically significant structures should not be impaired or diminished by the placement of telecommunication facilities. (b) Setback Tower shall be a minimum of 200' from any RS-3 or more restrictive district. ~ (c) Hei ht ' Tower height, excluding antenna array, does not exceed: (1) 75 feet, if the tower is at least 200 feet but less than 250 feet, from any RS-3 or more restrictive district. (2) 100 feet, if the tower is at least 250 feet but less than 350 feet, from any RS-3 or more restrictive ~ district. ~ (3) 120 feet, if the tower is 350' or greater, from any RS-3 or more restrictive district. (d) Antenna Array Height The antenna array does not exceed the tower height by more than 10 feet. (e) Setback of Gy Wires All guy wires and guy anchors are setback a minimum of 20 feet from any property line. (f) Tower Tvpe The tower is of monopole design, or one of equal or lesser impact, if located within 350' of any RS-3 or more restrictive district. ^ (g) Co-Location ~ A telecommunication tower must be designed and built so as to be capable of use by at least three wireless ,~ communication providers such as cellular or PCS providers using antenna arrays of 9 to 12 antennas each ~ within 15 vertical feet of each other with no more than three degrees twist and sway at the top elevation. The owner of the tower and the property on which the tower is located must certify to the City that the antenna is "~ available for use by at least two other wireless telecommunication providers on a reasonable and non- ~ discriminatory basis and at a cost not exceeding the ~, market value for the use of the facilities. If the property on which the tower is proposed to be located is to be ,~ leased, the portions of the actual or proposed lease that demonstrate compliance with the requirements of this paragraph shall be submitted with the building permit application. (h) Security Fencing The base of tower is enclosed by security fencing. (i) Compliance with Applicable Reeulations w ~, The tower is constructed and operated in compliance with current Federal Communication Commission and other applicable federal and state standards. Q) Neighborhood Impact The proposed tower location will not cause a negative impact on any residential neighborhood. In determining neighborhood impact, the Director shall consider the ~ opinion of record property owners within 300', but the Director shall not be bound by such opinions expressed. (k) Removal of Tower ' Upon the discontinuance of use of any such tower for a period of thirty (30) days, said tower is to be removed by the applicant/owner. (2) Replacement of Existing Poles -Telecommunication Towers erected to replace existing poles are permitted in all zoning districts, provided that: ~ (a) The pole replaced is a functioning utility pole or light standard within an established utility easement or public right-of-way, recreational facility light pole, or telecommunication tower. (b) Replacement tower height, including antenna array, does not exceed: (1) The height of the original utility, light standard, or recreational facility light pole by more than 10 feet; or (2) the height of the original telecommunication tower and antenna array. (c) The pole replaced does not obstruct a public sidewalk, public alley, or other public right-of-way; and (d) Pole appearance and function, except for antenna, are not significantly altered. (3) Placement on Existing Poles -permitted in all zoning districts, provided that: (a) Telecommunication antennas are permitted on existing utility, lighting, telecommunication towers, and sign structures at or exceeding 50 feet in height. (b) Provided that the antenna does not exceed the height of the structure by more than ten (10) feet if a non-whip type or fifteen (15) feet if a whip type. (c) Telecommunication antennas located on existing structures are not subject to the 5,000 foot separation requirement (d) If any additions, changes, or modifications are to be made to the monopole, the Director of Community Development shall have the authority to require proof, through the submission of engineering and structural r data, that the addition, change, or modification conforms to structural wind load and all other requirements of the current Building Code adopted by the City of Owasso. (4) Roof Mounted Telecommunication Antennas -allowed on non- residential buildings in all districts, provided that: (a) Non-whip antennas do not exceed the height of the building by more than ten (10) feet and is screened from view from any adjacent public roadway. (b) Whip antennas do not exceed the height of the building by more than fifteen (15) feet and are located no closer than fifteen (15) feet to the perimeter of the building. (c) Prior to the installation of a roof mounted antenna, the C ^ ommunity Development Department shall be provided with an engineer's certification that the roof will support the proposed antenna and associated roof-mounted antennas and equipment. (d) Roof mounted antennas and associated equipment may ^ either be screened with enclosures or facades having an appearance that blends with the building on which they are located or by locating them so they are not visible , from an adjacent public roadway. (5) Building Mounted Telecommunication Antennas - of the non- whip type are allowed on non-residential buildings in all zoning districts, provided that: (a) The antenna is mounted flush with the exterior of the r~ building so that it projects no more than 30 inches from ~ the surface of the building to which it is attached. (b) The antennas appearance is such as to blend with the ,y surrounding surface of the building. (c) Associated equipment shall be placed either within same ~~ building or in a separate building which matches the ~~ existing building in character and materials or blends with landscaping and other surrounding material adjacent to the separate building housing the equipment. Associated equipment for roof mounted antennas may be ~ located on the roof of the building if it is screened from view from any adjacent public roadway. "'"` (6) When an application for a building permit to locate a telecommunication antenna on an existing building or other structure is made, the Community Development Department ' shall be provided with color photo simulations showing the site of the existing structure with aphoto-realistic representation of the proposed antenna and the existing structure as it would , appear viewed from the closest residential property. The applicant shall also submit photographs of the same views showing current appearance of the site without the proposed antenna. ^ (7) Distance Measurement -distances in this section shall be measured along a single straight line between the center of the tower base and the nearest point on any property line of identified historic property or RS-3 or more restrictive district or use. For the purposes of applying restrictions set forth in this section, "RS-3 or more restrictive zoning district or use" excludes property that is: (a) Used as public or private primary or secondary educational facility; (b) Used as a college or university educational facility; s (c) Owned by the US, State of Oklahoma, Tulsa County, or the City of Owasso, and not used for RS-3 or more restrictive residential uses; (d) Used primarily for religious assembly; (e) Used as a cemetery; (f) Occupied by non-residential, non-conforming uses(s); or (g) Any other site similar to those listed above and determined by the Director of Community Development to be consistent with the purposes of this section. (8) Exceptions and Exemptions (a) A Telecommunication tower that fails to meet the requirements of this section may be authorized by obtaining a Special Exception through the Owasso Board of Adjustment. (b) Towers erected by a public agency for police, tire, EMS, 911 or other similar public emergency communication shall be exempt from the requirements of this section. (B) SPECIAL EXCEPTION REQUIRED (1) This section is designed to encourage placement of telecommunication towers in permitted areas. If a proposed telecommunication tower is not to be located in a permitted by right district, a Special Exception is required. (2) All Special Exception requests for telecommunication towers may be so authorized by the Owasso Board of Adjustment, subject to the following additional requirements: (a) Setback from Historical Property The tower shall not be on, or within 300 feet, of property recognized as a historical property or a property of historical significance. (b) Setbacks General The telecommunication tower must be a minimum of 200 feet, or 3 to 1 distance to height ratio, whichever is greater, from structures used for residential purposes. (c) Hei ht Tower height, excluding antenna array, shall not exceed: (1) 75 feet if the tower is at least 75 feet, but less than 100 feet, from any RS-3 or more restrictive zoning district. (2) 100 feet if the tower is at least 100 feet, but less that 200 feet, from any RS-3 or more restrictive district or use. 1004.5 1004.5 Section 2. (3) 120 feet if the tower is at least 200 feet, but less than 300 feet, from any RS-3 or more restrictive zoning district or use. (g) Security Fencii. lg The base of the tower shall be enclosed by security fencing at a height of 8 feet. (h) Compliance with Applicable Regulations The tower is erected and operated in cotnpliance with the current Federal Communications Commission and other applicable federal and state standards. '~ (i) Distance from Other Towers New telecommunication towers must be a minimum distance of 5,000 feet from any other telecommunication tower, unless in a by right district. (k) Removal of Tower Upon the discontinuance of use of any such tower for a period of thirty (30) days, said tower is to be removed ~ by the applicant/owner. Use Conditions ~- Temporary open air facilities may continue for a period not to exceed sixty (60) days per each application for Special Exception approved by the Board of Adjustment. Off-Street parking and Loading Requirements '~ None, unless otherwise established by the Board of Adjustment. ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: TEXT AMENDMENT TO ALLOW NON-PERMANENT ACCESSORY VENDORS BY SPECIAL EXCEPTION ONLY DATE: May 14, 1997 BACKGROUND The City of Owasso currently permits non-permanent accessory vendors in Commercial and Industrial districts through the Licensing and Business Regulations of the Code of Ordinances for the City of Owasso (see attached). No site plan review, notification of surrounding property owners, or public hearing for input are currently involved in the review process of this type of business. Gradually, over the last two years, non-permanent accessory vendors have created increasing planning challenge for staff. Because the current Code of Ordinances does not specifically require zoning compliance or site plan review of any kind, staff possesses no "legal" authority to intervene and require specific conditions to be met. A review of the current regulations and possibilities regarding future regulation indicates that the best manner in which to regulate this type of use would be to require each use to obtain a Special Exception from the Owasso Board of Adjustment. Currently, Section 1002 of Chapter 10 of the Owasso Zoning Code is designed to permit specific uses "which in some instances may be suitable for location in any use district but, because of their potential adverse influence on adjacent properties, require site plan review and are therefore, permitted in all use districts as a special exception requiring Board of Adjustment approval. " Included uses specifically called out within this section include off-site construction facilities and temporary office structures. By requiring all other accessory vendors to obtain a Special Exception through the Owasso ' Board of Adjustment, all property owners within 300 feet of the subject property would receive notification of the request, a legal ad would be published in the Owasso Reporter, a ~ site plan would be required for review, and a public hearing would be conducted. Additionally, it would allow for each request to be reviewed specifically as it relates to its proposed location and any challenges that may accompany it at that location. The Board of Adjustment then, depending upon those challenges, may require specific conditions be met by ~, the applicant in order for the request to be approved. Staff Report ' Amendment -Vendors Page 2 of 2 ~ It should be noted such a requirement, if adopted by the City Council as an amendment to the Zoning Code, would not be applicable to the current vendors who have already received ~ licenses (licenses expire one year from the date of issuance), but would apply to all future requests of this nature. Uses that would be included for this type of review process through the Board of Adjustment include snow cone vendors, BBQ vendors, and plant and flower "'' vendors. :~ The staff has developed an ordinance amending the Zoning Code that will require accessory ' vendors to obtain a Board of Adjustment Special Exception as described above. A copy of the proposed ordinance is attached for your information and review. The Planning Commission unanimously recommended approval of the proposed amendment at their May ' 13, 1997 regular meeting. "Itinerant vendor" means and includes all persons, firms or corporations, as well as their agents and employees who engage in the temporary or transient business in the city of selling or offering for sale any goods or merchandise, or exhibiting the same for sale or exhibiting the same for the purpose of taking orders for the sale thereof and who for the purpose of carrying on such business or conducting such exhibits thereof either hire, rent, lease or occupy any room or space in any building, structure, other enclosure, vacant lot or any other property whatever in the city in, through, or from which any goods or merchandise may be sold, offered for sale, exhibited for sale or exhibited for the purpose of taking orders for the sale thereof; 2. "Temporary" as used in Paragraph 1 hereof means any such business transacted or conducted in the city for which definite arrangements have not been made for the hire, rental or lease of premises for at least one hundred (100) days, in or upon which such business is to be operated or conducted; and 3. "Transient" as used in Paragraph 1 as used hereof means any such business of any such itinerant vendor as may be operated or conducted by persons, firms or corporations, or by their agents or employees who reside away from the city or who have fixed places of business in places other than the city or who move stocks of goods or merchandise or samples thereof into the city with the purpose or intention of removing them, or the unsold portion thereof, away from the city before the expiration of one hundred (100) days. The term "itinerant vendor" shall not include or be construed to include anyone engaged in interstate commerce nor anyone upon which the provisions of this chapter would impose a direct and unlawful burden on interstate commerce. (Prior Code, Sec. 5-24) SECTION 9-202 LICENSE REQUIRED. It is unlawful for any itinerant vendor to sell, offer for sale, exhibit for sale, or exhibit for the purpose of taking orders for the sale thereof, any goods or merchandise in the city without first obtaining a license as herein provided for. The city clerk shall issue to any itinerant vendor a license authorizing such itinerant vendor to sell, exhibit for sale, offer for sale, or exhibit for the purpose of taking orders for the sale thereof in the city his goods or merchandise only after such itinerant vendor shall have fully complied with all provisions of this chapter and shall have paid the license fees hereinafter provided, which sum shall he compensation to the city for the services herein required of it and to enable the city to partially defray the expenses of enforcing the provisions of this chapter. The itinerant vendor shall make application to the city clerk of the city at least ten (10) days prior to the I' date of his contemplated sale or exhibit to be held in the city which application shall be in the form of an affidavit, stating the full name and address of the itinerant vendor, the location of his or its principal office and place of business, the names and addresses of its officers if it be a corporation, and the partnership name and the names and addresses of all partners if such itinerant vendor be a firm. The application thereof must be accompanied by: 1 • A statement showing the kind and character of goods to be sold, or merchandise to be sold, ' offered for sale or exhibited; 2• A certified copy of the charter if the itinerant vendor be a corporation, incorporated under ' the laws of this state; 3• A certified copy of its permit or authority to do business in the state if the itinerant vendor be ' a corporation, incorporated under the laws of some state other than Oklahoma; and 4• A bond in the sum of not less than Five Hundred Dollars ($500.00), executed by the itinerant ~ vendor as principal, with some surety company authorized to do business in the state as surety, which bond shall be payable to the city for the use and benefit of any person or persons entitled thereto and conditioned that the principal and surety will pay all damages to person, or persons, caused by or arising from, or growing out of the wrongful or illegal conduct of the itinerant vendor while conducting the sale or exhibit in the city. ~ The bond shall remain in full force and effect for the entire duration of the license permit as provided herein, and two (2) years thereafter. ~ (Prior Code, Sec. 5-26) SECTION 9-204 EXEMPTION This chapter is not and shall not be held to be applicable to the: 1. Ordinary commercial traveler who sells or exhibits for sale goods or merchandise to parties engaged in business of buying and selling and dealing in goods or merchandise; 2• Vendors of farm produce, poultry, stock, or agricultural products in their natural state; and 3. Sales of goods or merchandise donated by the owners thereof, the proceeds whereof to be applied to any charitable or philanthropic purpose. (Prior Code, Sec. 5-27) SECTION 9-205 LICENSE FEE Tlie license fee for itinerant vendor shall be Fifty Dollars ($50.00) and shall be for a period of not to ^ exceed six (6) business days, or any fraction thereof. The person duly authorized by the city council, shall inspect once a week, each motor car, vehicle or container used by any licensee, and he shall revoke or suspend the license for any violation of the conditions; 12. SECTION 1001 USE UNIT 1 AREAWIDE USES BY RIGHT 1001.1 Description Certain public uses, agricultural uses, open land uses, and similar uses which are either subject to other public controls or which do not have_ adverse effects on other land uses. 1001.2 Included Uses Passive agricultural uses such as: cultivation, forestry, grazing, planting; open land uses such as: arboretum, flood management project, reservoir, wildlife preserve; public uses such as: fire alarm, historical marker, street sign, thoroughfare, utility line, political campaign signs. 1001.3 Use Conditions - Political Campaign Signs No political campaign sign shall be erected more than forty-five (45) days prior to any election, nor shall any sign be permitted to remain on any property more than seven (7) days following an election; no political , campaign signs shall be permitted on public property and they shall be permitted on private property only with the consent of the property owner; the display surface area of each political campaign sign located in R or 0 zoning districts shall not exceed sixteen (16) square feet in surface area; only one side of a double-faced sign shall be computed in the computation ~ of display surface area. 1001.4 Off-Street Parking None. (see attached location map). The utilities consist of 10,847 LF of 8" sanitary lines, 8,228 LF of 6" water lines and 1,324 LF of 8" water lines. ' Oklahoma Department of Environmental Quality construction permits No. WL000072960820 for water and No. SL000072960821 for sanitary sewers have been issued. Designs for these utilities were reviewed and construction inspected by Public Works personnel. FINAL INSPECTION• A final inspection was held by Public Works representatives with the contractor on March 27 and 31, 1997. A punch list of sanitary sewer work items needed to bring the facilities to City standards was provided to the developer on Apri12, 1997 (see attached punch list). This punch list was completed on April 3rd. There were no comments on the water system. Valve cans may have to be adjusted during the maintenance period after final grades for lots are established. A one-year maintenance bond for sanitary sewers has been received. Staff recommendation for acceptance of the water lines is contingent on receipt of a one-year maintenance bond prior to the May 20th Council meeting. The bonds will become effective upon Council acceptance of the utilities. Their task was to research, review and evaluate various aspects of the city's ambulance service licensure at an ALS (advanced life support) rating. The team studied the numbers and advantages of an ALS (advanced life support) against ~ a BLS (basic life support) rating. If the licensure was lowered from ALS to BLS, the potential impact on revenue needed to be addressed also. At the April 15, 1997 City Council meeting, the Ambulance Ordinance Review Team presented their finding and recommendations. ORDINANCE 369 AMENDMENTS: ' After review, the Team recommended that the City Council direct the City Attorney to draft a new ordinance which contained the following changes to Ordinance #369. 1. A review of the ordinance be conducted a maximum of every five (5) years. 2. Specifications and drawings were prepared by the Public Works Department Engineering Division. The solicitation is for repair of two strips of pavement totaling 253 square yards (see attached drawing). Bids were received on April 9, 1997. Three bidders responded with bids ranging from $20,972.19 to $32,219.10. BID ANALYSIS Horizon Construction, Tulsa, Oklahoma, submitted apparent the low bid at $20,972.19. The engineer's estimate was $15,580.00 (see attached bid tabulation). Horizon has complied with all solicitation requirements and has provided evidence of previous street repair experience. During the last five months, this amount has increased to about $8,000 per month. The increase stems from both a higher than usual number of breakdowns over about atwo-month period and also from repairs made ~ to vehicles that had been offline or inactive. In addition, during the latter period of time, the garage has had two full-time service technicians instead of one technician and a helper, which has facilitated the increase in productivity necessitated by this repair situation, as well as increased productivity in general. At this time, staff projects that the garage will end the year at between $80,000 and $85,000 in expenditures under this line item of "parts for resale." In order to adequately fund the expenditures in this line item, it is necessary to increase the budget appropriation from the current $60,000 to $86,000 for FY 96-97. (It should be noted that the "parts for resale" line item is an "in and out" category. The parts are purchased by the garage and charged to this line item, then the departments are billed for those items or repairs pertaining to their vehicles. ) RECOMMENDATION: Staff recommends that the City Council approve a supplemental appropriation in the amount of $26,000 to the Garage Fund, line item 5270, increasing this line item from $60,000 to $86,000 for FY 96-97. MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL ' CITY OF OWAS50 ~ FROM: RODNEY J RAY CITY MANAGER SUBJECT: REQUEST FOR SUPPLEMENTAL APPROPRIATION TO VEHICLE ~ SELF-INSURANCE FUND ' DATE: May 15, 1997 ' BACKGROUND' ~ On November 1, 1988, the City Council established a Vehicle Self-Insurance Fund for the purpose of creating a more cost effective method of insuring city vehicles against collision damage. The fund was intended to replace the existing traditional collision insurance coverage and is utilized to repair damage to city vehicles involved in accidents, except in those cases ~ wherein fault is determined to be that of a second party. The fund received an initial appropriation of $15,000 and the Council required continued annual appropriations until the fund reached a level of $60,000. Even though the $60,000 cap amount was reached several years a o, the staff has continued to request annual appropriations to the fund to keep pace with the g ~, increased number of vehicles the city operates. The current reserves for the fund are $86,40 . Each year the staff requests an appropriation of $10,000 for anticipated repair costs due to accidents. Since 1988, the appropriated amount has been more than sufficient to cover claims ~ against the fund. In fact, in the nine-year history of the program, there have been fewer than ten incidents that required using the fund for repair costs. However, this year claims for two at-fault accidents have resulted in total expenditures that exceed the $10,000 appropriation ~, authorized by the FY 1996-97 budget. The two claims, totaling $10,979.11, are the result of accidents involving police vehicles (one for $2,123.55 and another for $8,855.56). A supplemental appropriation of $5000 will not reduce that amount unless there are additional accidents. The current year's losses of $10,123.55 have already been encumbered, thus reducing the reserves to its current level. GENERAL INFORMATION• The Vehicle Self-Insurance Fund provides insurance coverage for all of the city's "street legal" vehicles, including police vehicles and fire trucks. Based on the cost of collision coverage at the time the self-insurance fund was created, the city has saved approximately $129,553 by utilizing the self-insurance concept. Those savings are significantly increased when the current cost of collision insurance rates is applied to the analysis. During the seven years previous to the implementation of the program, the city's insurance carrier paid out $27,417.44 in claims (1981-1988). In the nine years since the program began, the city has paid $17,632 in claims (1989-1997). RECOMMENDATION: The staff recommends Council approval of a supplemental appropriation of $5000 to the Vehicle Self-Insurance Fund. Funds for such appropriation derived from the fund's reserves. The request was made for funding of three additional officer positions. In April of 1997, this department was ' notified that federal funds had been awarded to the City of Owasso, which will be used to supplement salary and benefits for three new police officers. The amount awarded to the City and available for use over the next three years is $225,000. This amount is designed to ^~ supplement the salary and benefits of three additional police officers, which equates to approximately 75% of the total salary and benefit package. The cost to the city will be approximately $75,000 over the next three years. ^ The need to increase the number of officers available to the Owasso community is obvious due to our continual growth. The receipt of this grant allows an alternative funding resource to ' occur, thus allowing resources to be made available in other areas of need within the city. Over 130 applications have been received for the position of police officer and 77 candidates took the police examination on May 8th. The top 25 applicants will proceed to review board where the top 5-7 applicants will be recommended for the background phase. The hiring process is on an aggressive track so that all three officers will begin their employment in July. The gymnasium will be closed on May 25 & 26 for the Memorial Day holiday. A formal grand opening is being planned and will be held as soon as all the "clean up" work has been completed.
