6. Consideration and Appropriate Action Relating to a Request for Approval of the Consent
Agenda. All matters listed under "Consent" are considered by the City Council to be
routine and will be enacted by one motion. Any Councilor may, however, remove an item
from consent by request. A motion to adopt the Consent Agenda is non-debatable.
A. Approval of the Minutes of July 1, 1997 Regular Meeting and July 10, 1997 Special
Meeting.

The staff recommends Council approval of a contract extension with Yale Cleaners for
the supply and cleaning of uniforms for certain municipal employees for the period
October 1, 1997 thru September 30, 1998.
D. Action Relating to the Acceptance of a Grant from the District Attorney's Council or
Oklahoma in the amount of $25,000 to assist in funding the DARE program.

The staff recommends Council acceptance of the DARE Grant, and authorization for
the Mayor to execute the necessary documents.

Water, Wastewater, Storm Drainage, and Street Systems Constructed to Serve Central
Park II, an Addition to the City of Owasso, Tulsa County, Oklahoma.

8. Consideration and Appropriate Action Relating to Final Acceptance of Work Performed
Under a Contract for Street Repairs on 129th E Ave at the Sixth Grade Center, Between
the City of Owasso and Horizon Construction Company Inc, and Authorization for Final
Payment and Release of Retainage to the Contractor.

and that final payment in the amount of $20,932.35 be authorized.
9. Consideration and Appropriate Action Relating to a Request from Bob Duenner for
Annexation of an Approximate 50-Acre Parcel of Land Located South of East 96th St N and
North of Ator Heights IV, Bounded on the West by Undeveloped Property Surround the
Golf Course and on the East by the Caudle and Edison Properties.

PROCLAMATION
CITY OF OWASSO, OKLAHOMA
WHEREAS, The Vocational Industrial Clubs of America (VICA) is the national organization
for students in trade, industrial, technical and health occupations education; and,
WHEREAS, VICA sponsors the Skills USA Championships annually to recognize the
achievements of vocational students and to encourage them to strive for
excellence and pride in their chosen occupations; and,
WHEREAS, The contests are designed to test the skills needed for a successful entry-level
performance in given occupational fields, including safety practices and
procedures; and,
WHEREAS, Owasso High School student Logan Randolph recently participated in the thirty-
first annual Skills USA Championships in AVIATION MAINTENANCE
TECHNOLOGY; and,
WHEREAS, The Aviation Maintenance Technology contest requires each contestant to perform
12 tasks, with knowledge and skills designed for an entry-level airframe and
powerpoint (A&P) technician; and,
WHEREAS, The City Council would like to recognize Logan for his participation in the VICA
program and the Skills USA Championships, and more specifically for placing
FIRST in the AVIATION MAINTENANCE TECHNOLOGY contest in the
secondary school division;
NOW, THEREFORE, I, Mary Lou Barnhouse, by virtue of the authority vested in me as Mayor
of the City of Owasso, do hereby recognize Logan Randolph for his success, and offer
congratulations and best wishes from City Council and the citizens of Owasso as he continues
to work toward certification in his chosen profession.
IN WITNESS THEREOF, I have hereunto set my hand and caused the seal of the City of

Tuesday, July 1, 1997
The Owasso City Council met in regular session on Tuesday, July 1, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, June 27, 1997.
ITEM 1: CALL TO ORDER
Mayor Barnhouse called the meeting to order at 7:03 p.m.
ITEM 2: INVOCATION
The invocation was offered by Pastor Clyde Mitchell of the Calvary Missionary Baptist Church.
ITEM 3: FLAG SALUTE
Councilor Wilken led in the flag salute.

ITEM 5: SPECIAL EMPLOYEE RECOGNITION AND PRESENTATION.
Mayor Barnhouse and Mr Ray presented a lapel pin and plaque to Mike Knebel. Mr Knebel was
employed by the City for nine years and resigned to accept employment in the private sector.

B. Approval of Claims.
C. Action Relating to Ordinance #548, an Ordinance Providing for the
Annexation of an Approximate 20-Acre Parcel of Land Located East of
the Northeast Corner of East 96th Street North and 129th East Avenue,
Further Described as a Portion of the West Half of the Southeast Quarter
of the Southwest Quarter of Section 16, Township 21 North, Ranch 14
East, Tulsa County, Oklahoma.
Dr Standridge moved, seconded by Dr Bode, to approve the consent agenda. The consent
agenda included minutes of the June 17, 1997 regular meeting, by reference made a part hereto.
Item B on the consent agenda included the following claims: (1) General Fund $17,238.82;
(2) Workers Comp Self-Insurance Plan $2,773.73; (3) Ambulance Service Fund $30.00; (4) City
Garage $2,811.54; (5) Capital Improvements $5,508.15; (6) Payroll $118,519.18; (7) City
Garage Payroll $2,811.02. Item C approved Ordinance #548.

Motion carried 4-0.
ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR A CONTRACT EXTENSION FOR MAINTENANCE TO THE
CITY'S STORM SIRENS.
Mr Stevens presented the item to extend a contract with Goddard Enterprises to maintain the
city's storm warning sirens. A contract for maintenance was awarded to Goddard Enterprises
for FY 1995-96 and extended for FY 1996-97. Mr Goddard has been contacted and agreed to
a contract extension for FY 1997-98 in the amount of their original bid, $3750, plus a 25 %
allowable mark-up for repair parts. Dr Standridge moved, seconded by Dr Bode, to approve
a contract extension with Goddard Enterprises for preventative maintenance to the city's storm
sirens for the 1997-98 fiscal year.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF IMPROVEMENTS TO THE WATER WASTEWATER
STORM DRAINAGE AND STREET SYSTEMS CONSTRUCTED TO SERVE
CENTRAL PARK II AN ADDITION TO THE CITY OF OWASSO TULSA
COUNTY OKLAHOMA.
Mr Ray said that staff was awaiting receipt of the necessary bonds and requested that this item
be deferred until all other agenda items had been heard to allow time for the developer to
produce the bond. Mayor Barnhouse deferred the item.

DISCUSSING PERSONNEL MATTERS RELATING TO THE OFFICE OF
THE CITY MANAGER SUCH EXECUTIVE SESSION PROVIDED FOR IN
O S 25, SECTION 307(B)(1).
Mayor Barnhouse withdrew the item from the agenda after hearing no motion for an executive
session.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
CONTRACT FOR SERVICES BETWEEN THE CITY OF OWASSO AND
RODNEY J RAY.
Dr Standridge moved, seconded by Mr Wilken, to approve the contract for services between the
City of Owasso and Rodney J Ray for the time period July 1, 1997 through June 30, 1998.
AYE: Standridge, Wilken, Bode, Barnhouse
NAY: None
Motion carried 4-0.
Mayor Barnhouse again called for Item #8. Mr Lutz said that the bonds still had not been
received from the developer. The staff recommended that the item be withdrawn from the
agenda. Mayor Barnhouse declared the item withdrawn.

Mayor Barnhouse moved, seconded by Mr Wilken, to adjourn.

The Owasso City Council met in special session on Thursday, July 10, 1997 in the training room
at the Owasso Fire Station per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin Board at 10:00 a. m. on Monday, July 7, 1997.
ITEM 1: CALL TO ORDER AND ROLL CALL.
Mayor Barnhouse called the meeting to order at 6:30 p.m. Councilors present: Mary Lou
Barnhouse, Mayor; Denise Bode, Councilor; Mark Wilken, Councilor. Staff present: Rodney

SUBJECT: EXTENSION OF CONTRACT FOR SUPPLY AND CLEANING OF
UNIFORMS
DATE: July 11, 1997
BACKGROUND:
The Trustees of the Owasso Public Works Authority approved a contract with Yale Uniform
Rental for uniforms for the Public Works, Parks and Support Services Departments which
started on October 1, 1995. Included in the contract was an initial two-year term with
subsequent one-year renewal periods with the consent of both parties. The current term of the
contract is to expire on September 30, 1997. It is also stated that the contract can be extended
for a successive one year term if agreed to by both parties in writing not less than ninety days
prior to the expiration of the initial or successive one year terms.
Public Works staff wrote Yale on June 3, 1997 to determine their intentions concerning rates
for the period of October 1, 1997 to September 30, 1998. Yale responded on June 9, 1997 with
their intent to remain at the same rate. Service from Yale has been good.
Since there is no rate increase proposed for the supply and cleaning of uniforms for the contract
period of October 1, 1997 through September 30, 1998, staff recommends that the contract with
Yale Uniform Rental be extended.

In February of 1997, application was made to the State of Oklahoma District Attorney's Council for
a grant in support for the D.A.R.E. program. In June of 1997, this department was notified that a
grant was approved for this project. The amount awarded to the City and available for use over the
next year is $25,000. This amount is designed to supplement the salary and benefits of one officer
assigned to D.A.R.E. duties. This equates to approximately 75% of the officer's total salary and
benefit package. The cost to the city will be approximately $8,333.00 over the next year.
This is the seventh year that the City of Owasso has been involved in the D.A.R.E. education effort
an the six year o funding support. Including the funds received this year, over $190,000 has
been provided in grant support since 1991. It is expected that this will be the final year of grant
money in this area.
RECOMMENDATION:
Staff recommends City Council approval of the receipt of $25,000 from the District Attorney's
Council and for the Mayor to execute the appropriate paperwork.

BACKGROUND:
The project is located one-half mile north of 86th Street North, immediately south of the existing
Central Park I addition. (see attached location map). The water and sanitary sewer were
permitted for construction under ODEQ permit Nos. WL000072970327 and SL000072970328,
respectively. The water system consists of 2,536 LF of six-inch and 2,570 LF of eight-inch
lines. The sewer system consists of 7,206 LF of eight-inch lines.
Designs for all facilities were reviewed and construction inspected by Public Works personnel.
FINAL INSPECTIONS:
A final inspection for water and sewer was attended by Public Works and contractor personnel
on June 24, 1997 and the attached punch list was delivered to the developer on June 24th. All
' punch list items were completed on July 1, 1997.
A final inspection for streets and storm drainage was attended by Public Works and contractor
personnel on June 25, 1997 and the attached punch list was delivered to the developer on
June 25th. All punch list items were completed on July 1, 1997.
The developer has provided one-year maintenance bonds for the water, sewer and storm drainage
and a two-year maintenance bond for streets.
RECOMIM ENDATION:
Staff recommends acceptance of the Central Park II water, sanitary sewer, streets and storm
' drainage systems.

BACKGROUND:
Work consists of repairing two sections in the north-bound lane of 129th E. Avenue at the new
Wr 6th Grade Center (see attached map). The contract was awarded to Horizon . Construction
Company, Inc. on April 16, 1997 and the Notice to Proceed was issued on June 6th. Work
■ started on June 16th. The contract amount is $20,972.19.
The contract amount included bid items for additional work such as deeper excavation or
additional patch area at each site which could be anticipated during the course of the work. The
contract was awarded with the understanding that should additional work not be needed, no
payment would be made. Therefore, payment for the total contract work could be expected to
be less than the original contract award amount.
Work was inspected by Public Works personnel.
A one-year maintenance bond has been provided to become effective upon acceptance of the
contract work (see attached).
FINAL INSPECTION
Public Works personnel held a final inspection with the contractor on June 24, 1997. There
were no deficiencies noted.
CONTRACT COST AND FUNDING
Some of the additional work items were needed due to additional square yards of patch area and
additional subgrade preparation not evident at the time of award. This final pay request of
$20,932.35 is $39.84 less than the contract amount. There were no interim pay requests prior
to the final therefore no retainage was held and this final payment constitutes total payment
under the contract.

RECOMMENDATION:
Staff recommends acceptance of the Street Repairs, 129th E. Avenue at 6th Grade Center '
contract and authorization for final payment to Horizon Construction in the amount of
$20,932.35.

BACKGROUND
Mr. Bob Duenner has submitted a petition to the City of Owasso requesting annexation of
property totalling approximately 50 acres. The subject property is bordered on the north by E.
96th Street North, on the east by undeveloped property zoned RS-2 (Residential Single-Family
Medium Density) and RMT (Residential Multi-Family Townhomes), on the south by the Ator
Heights Fourth Addition zoned RS-3 (Residential Single-Family High Density), and on the west
by undeveloped property surrounding the golf course zoned PUD (Planned Unit Development).
The subject property is shown on the attached map and is currently undeveloped.
The subject property is zoned AG (Agriculture) in Tulsa County and would remain zoned AG
upon annexation. The applicant has indicated the intent to develop the property residentially,
tieing this property into the planned Phase III of The Fairways at Bailey Ranch. If annexation
is approved, the property would first have to obtain zoning and then proceed with all platting
requirements of the City of Owasso prior to any development. It should be noted that upon any
development of this property, acceleration/deceleration lanes, as well as sidewalks, would need
to be installed along E. 96th Street North.
Notification of the annexation request was published in the Owasso Reporter on June 26, 1997
to notify the public of the annexation request before the Planning Commission. That notification
was followed by notification published two consecutive weeks in the Owasso Reporter on July
3, and July 10, 1997 to notify the public of City Council action regarding the request. A copy
of the procedures for annexation, as well as the annexation policy, are also attached for your
review and information.
The Technical Advisory Committee reviewed this request at their June 25, 1997 meeting and had
no concerns regarding the annexation request. The Annexation Committee reviewed the request
at their July 3, 1997 Special Meeting and unanimously approved the request. The Owasso
Planning Commission reviewed the annexation request at their July 8, 1997 regular meeting and
also unanimously recommended approval.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be. annexed=into the city.limits as the
lowest zoning classification, that is. AG, agricultural.
Landowners may then petition for rezoning if -they desire -
further development of their property. All legal uses annexed
into the city will be legal, but non-conforming, which means
that they may continue but cannot be expanded without proper
zoning.

4. All public infrastructures that do not met city standards will
not be improved by the city until brought,to the city standard
and accepted by. the city council. Such public facilities must
be, improved at owners ` expense by the establishment of a special
asessment district or some other financing method.
5. Where a ",city limit boundary ends at a dedicated 'street, the
boundary, will not include the street righti-of=way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
r- considered for annexation' for a six month period after
rejection`. by the City Council

The City of Owasso has received a request to rezone a 5 acre portion of a 20 acre parcel of land
from RMT (Residential Multi-Family Townhome) to CS (Commercial Shopping Center). The
subject property is located south of the southwest corner of E. 96th Street North and Garnett
Road, immediately north of the Faith Lutheran Church, and is undeveloped. A copy of the
' complete staff report provided to the Planning Commission is attached for your information and
review. The subject property was annexed by the City of Owasso in April of this year.
As discussed in the staff report, a rezoning of this property to CS is similar to a request
reviewed and approved by the Planning Commission and Council in 1995 for the property
immediately north of the subject property. When this rezoning request was received, staff felt
it important to apply the same basic principle - that commercial zoning/development should not
extend any "deeper" than that which has been previously established. The request submitted by
the applicants does comply with that established pattern.
Letters were mailed to all property owners within 300 feet of the request and the legal ad was
published in the Owasso Reporter. No opposing comments have been received by the
Community Development Department. The Planning Commission unanimously recommended
approval of the request at their July 8, 1997 regular meeting.
If the request is approved by the City Council, an ordinance would be presented at the August
5, 1997 City Council meeting formally adopting the approval.
RECOMMENDATION:
Staff recommends Council approval of rezoning application OZ-97-02.

APPLICANT AND STATUS OF APPLICANT: Jeraldine Francis Haas Edison, applicant
and owner.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
RMT (Residential Multi-Family Townhomes) to CS (Commercial Shopping Center) which
would allow for commercial development at the site.
LOCATION AND SIZE: The property is located south of the southwest corner of E. 96th
Street North and Garnett Road, immediately north of Faith Lutheran Church. The entire
property owned by the applicants totals 20 acres, 5 of which are involved in the rezoning
application.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by undeveloped
property zoned CS (Commercial Shopping Center), while northwest of the subject property is
a single-family residence (Caudle) and addiitonal property zoned RS-2 (Residential Single-
Family Medium Density). Immediately west of the subject property is the additional
property owned by the applicants zoned RMT (Residential Multi-Family Townhomes). The
subject property is bordered on the south by Faith Lutheran Church zoned AG (Agriculture),
while further south is OL (Office Light) and CG (Commercial General) zoned property. The
subject property is bordered on the east by N. Garnett Road, while further east lies the
Hayward Smith property zoned Planned Unit Development representing a Commercial,
Office, and Residential mix.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 6 "Commercial land Uses".
SITE INFORMATION: Some moderate development hardships are expected as the terrain
of the subject property varies.
ANALYSIS
The applicants are requesting a rezoning of 5 acres of their 20 acre parcel of land from RMT
to CS in order to permit the development of the property in a commercial nature. The
subject property was annexed by the City of Owasso in April of this year.

In 1995, the Caudle property to the north was reviewed by the Planning Commission for a
similar rezoning request. In that request, the applicants were requesting a rezoning of
property from AG (Agriculture) to CS (Commercial Shopping Center) on an 8 acre portion
of a 20 acre parcel located on the southwest corner of E. 96th Street North. Staff
recommended only rezoning 5 acres to commercial, and the Planning Commission and
Council concurred.
The proposed rezoning, if approved, would create a 5 acre parcel of commercially zoned
property abutting Garnett Road. Recent intersection improvements in the area (E. 96th Street
North and Garnett Road), a concern when reviewing the Caudle request in 1995, appear to
have greatly reduced the traffic problem and safety cocerns and further support commercial
rezoning.
In 1995 when reviewing the Caudle request, staffs noted concern was the depth of
commercial zoning off of Garnett Road. The applicant was requesting commercial zoning
that would extend farther back into residentially zoned property than that which was
established on the north side of E. 96th Street. When staff met with the applicant's
regarding this request, staff once again made it quite clear that commercial zoning extending
westward beyound that which has been approved to the north would not be acceptable. The
applicant's request is in line with that which has been previously approved.
The applicant should be advised that accelleration/deceleration lanes, as well as sidewalk,
will be required along the Garnett Road frontage. This requirement would be realized during
the platting and/or site plan review process for proposed commercial development.
Notices were mailed to surrounding property owners on June 25, 1997 and the legal
advertisement was published in the Owasso Reporter on June 26, 1997. A copy of both have
been attached for your information and review. Additionally, the subject property was
posted on June 24, 1997. No comments oppossing the request have been received.
RECOMMENDATION
Staff recommends approval of the rezoning request from RMT to CS.

BACKGROUND:
The State Legislature recently strengthened the driving under the influence statutes. In response
to new legislation, the staff has developed a City Ordinance that, if adopted, prohibits any
person under the age of 21 to drive, operate or be in actual physical control of a motor vehicle,
who has any measurable amount of alcohol in their blood or on their breath as measured by an
approved instrument within two (2) hours after the arrest of the person.
The proposed ordinance requires violators to be arrested for driving under the influence while
under age. A minimum fine of $100 (maximum of $200) will be imposed and/or twenty hours
of community service and/or mandatory attendance to a alcohol treatment facility. Any violator
upon a second or subsequent offense shall be punished by a fine of $100-$200 and/or forty hours
of community service and/or mandatory attendance to an alcohol treatment program.
RECOMMENDATION:
The staff recommends City Council approval of Ordinance #550.

AS WELL AS PROVIDING PENALTIES THEREFOR,
CODIFYING SAME IN THE CODE OF. ORDINANCES OF

EXISTING SECTIONS 15-527 THROUGH 15-555,
DECLARING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT, TO-WIT:
Section One: Part 15, Traffic and Vehicles, Chapter 5, Driving, Overtaking, Passing, of
the Code of Ordinances of the City of Owasso, Oklahoma, is hereby amended by adoption as new
law and directing the codification of same as follows, to-wit:
15-527 - DRIVING UNDER THE INFLUENCE WHILE UNDER AGE
A. It is unlawful, and punishable as provided in subsection C of this section for any
person under twenty-one (21) years of age to drive, operate, or be in actual physical control of a
motor vehicle within this state who:
1. Has any measurable quantity of alcohol in the person's blood or breath at the
time of a test administered within two (2) hours after an arrest of the person;
2. Exhibits evidence of being under the influence of any other intoxicating
substance as shown by analysis of a specimen of the person's blood, breath, saliva, or
urine in accordance with the provisions of Section 752 and 759 of Title 47 of the
Oklahoma Statutes; or,
3. Exhibits evidence of the combined influence of alcohol and any other
intoxicating substance.
B. As used in this section, the term "other intoxicating substance" means any controlled
dangerous substance as defined in the Uniform Controlled Dangerous Substances Act, Section 2-
101 et seq. of Title 63 of the Oklahoma Statutes, or any other substance, other than alcohol,
which is capable of being ingested, inhaled, injected or absorbed into the human body and is
capable of adversely affecting the central nervous system, vision, hearing, or other sensory or
motor function.
C. 1. Any person under twenty-one (21) years of age who violates the provision of this
section, shall upon conviction, be guilty of driving under the influence while under age. A violator
shall be punished for a first offense by a fine of not less than One Hundred Dollars ($100.00) nor
more than Two Hundred Dollars ($200.00), or by completion of twenty (20) hours of community
services, or by requiring the person to attend and complete a treatment program, or by any
combination of fine, community service, or treatment.
2. Any violator, upon a second or subsequent conviction, shall be punished by a fine of
not less than One Hundred Dollars ($100.00) nor more than Two Hundred Dollars ($200.00), or
by completion of forty (40) hours of community service, or by requiring the person to attend and
complete a treatment program, or by any combination of fine, community service or treatment.
Section Two: That existing sections 15-527 through 15-555, of the Code of Ordinances
of the City of Owasso, Oklahoma, are hereby directed to be renumbered as 15-528 through 15-
556 respectively.
Section Three: That this ordinance shall become effective thirty (30) days from first
publication as provided by state law.
