9. Consideration and Appropriate Action Relating to a Request for City Council Approval of
an Addendum to a Contract Between the City of Owasso and Sack and Associates for the
Purpose of Adding to the Original Scope of Work and Increasing the Amount of the
Contract from $34,194.25 to $49,579.25.

increases the scope of work to be performed by the engineer, and increases the contract
payment by $15,385; the staff further recommends that the City Manager be authorized to
develop and execute the documents necessary for such addendum.

The Owasso City Council met in regular session on Tuesday, August 5, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, August 1, 1997.

ITEM 5: RECOGNITION OF OUTSTANDING EMPLOYEES.
Mayor Barnhouse recognized Tracy Tremain and Chris Colgan, Owasso firefighters and medics,
for outstanding action in their efforts to save the life of a young child who was the victim of a
near drowning.
ITEM 6: READING OF MAYOR'S PROCLAMATION.
Mayor Barnhouse presented a proclamation to Nancy Gomez and Maribeth Tomca, recognizing
Owasso Chimi's as Business of the Quarter for the Third Quarter of 1997.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR APPROVAL OF THE CONSENT AGENDA
A. Approval of the Minutes of July 15, 1997 Regular Meeting.
B. Approval of Claims.
C. Action Relating to Ordinance #551, an Ordinance Providing for the
Annexation of an Approximate 50-Acre Parcel of Land Located South of
East 96th St N and North of Ator Heights IV, Bounded on the West by
Undeveloped Property Surrounding the Golf Course and on the East by
the Caudle and Edison Properties.
D. Action Relating to Ordinance #552, an Ordinance Providing for the
Rezoning of a 5-Acre Tract Located South of the Southwest Corner of
East 96th St N and Garnett Rd, from RMT (Residential Multi-Family
Townhome) to CS (Commercial Shopping Center).
The consent agenda included minutes of the July 15, 1997 regular meeting, by reference made
a part hereto. Item B on the consent agenda included the following claims: (1) General Fund
$45,493.76; (2) Workers Comp Self-Insurance Plan $2,496.60; (3) Ambulance Service Fund
$1,348.01; (4) E-911 $1,847.62; (5) City Garage $2,752.16; (6) Capital Improvements
$4,478.60; (7) Interfund Transfers $33,995.08; (8) Payroll $122,246.96; (9) City Garage Payroll
$3,121.34. Item C approved Ordinance #551 annexing 50 acres, such annexation approved by
the Council on July 15, 1997. Item D approved Ordinance #552 rezoning 5 acres from RMT
to CS, as approved by the Council on July 15, 1997. Dr Standridge moved, seconded by
Mr Wilken, to approve the consent agenda.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A BID TO
CONSTRUCT A RESTROOM FACILITY AT THE SPORTS PARK.
Mr Rooney presented the item. He said that only one bid had been received for the construction
of a restroom facility at the Sports Park, and that bid was considerably higher than the amount
budgeted. Community Development staff contacted area builders to determine why they had not
bid on the project. Most builders said they were too busy at this time, but that they would
probably be able to bid on the project in the fall. The staff recommended that the bid be
rejected, and Mr Rooney said it is staff's intention to request authorization to rebid the project
later in the fall. Dr Standridge moved, seconded by Dr Bode, to reject the bids received for the
construction of a restroom facility at the Sports Park.

E ITEM 9: RCONSIDERATION AND EQUEST FOR F OR THE PURCHASE OF THREE AUTOMATIC EXTERNAL

DEFIBRILLATORS AND ONE LIFEPAK 10.
Chief Allen said that the fire department has recently received approval from the Oklahoma state
Department of Health for the utilization of Automatic External Defibrillators, a device for
treating and reversing lethal cardiac dysrythmias. This piece of equipment is fully automatic and
is able to make a diagnosis. Two defibrilliators will be placed in the two ambulances and one
will be assigned to the department's rescue vehicle. The "Life Pak 10" will be placed in the
"second out" ambulance. Bid specifications were prepared and sent to four vendors, with bids
being received from two. $15,000 was appropriated in the 1997-98 budget for the equipment
purchase, and the $1421 over the budgeted amount will reduce the appropriation for a new
ambulance by that amount. Mr Wilken moved, seconded by Dr Standridge, to award a contract
to Physio-Control, Redmond, WA, for the purchase of three Automatic External Defibrillators
r and one Lifepak 10, at a cost $16,421; and authorization for payment.

ITEM 10: REPORT FROM CITY MANAGER
Mr Ray announced an informational public hearing relating to a proposed bond issue. The
hearing will be on Thursday, August 7 at 1:00 p.m. in the Council chambers. Two other
hearings have been held. An informational memorandum explaining the issues is available. He
also announced that the Mayor has called a special meeting of the Council for 7:00 p.m. on
Monday, August 11, for the purpose of calling an election on a bond issue. Mr Ray said that,
in relation to a restroom facility for the Sports Park, the staff realizes the important of such a
facility and will continue to pursue avenues for its construction. Relative to the issue of the
extension of utilities to subdivisions outside the city limits, rules and regulations are being
developed and should be ready within two weeks.

Owasso City Council August 11, 1997
Mr Ray briefed the City Council relative to the proposed bond issue. He said that Ordinance
#395, enacted on August 18, 1988, extended the third penny sales tax to 2007. It also restricted
revenue from the third penny to capital improvement projects, established a Capital Future Fund,
and created a citizens oversight committee to report to the public. On July 17, 1997, the Capital
Improvements Committee voted to recommend to the City Council a proposal that would include
funds for street projects, building projects, and Sports Park projects. The proposal would issue
debt to be repaid from the third penny sales tax, provide access to funds accumulated in the
Capital Future Fund through FY 2001, and call an election to gain voter approval or rejection
of the issue. Three public hearings were conducted to gain citizen input relative to the proposal.
The process required to enact the proposal includes enactment of an ordinance that includes the
specifics of the program and requires approval by a majority of the voters in a special election,
and adoption of a resolution authorizing the calling of an election and the establishment of a
ballot title. Ordinance #553 details the project list, allows for additions and deletions based on
the funds available, sets forth the funding process to allow debt of not to exceed $8,500,000,
allows the use of Capital Future Funds accumulated through 2001, and requires voter approval
of the ordinance. Dr Bode moved, seconded by Mr Wilken, to adopt Ordinance #553, subject
to approval of the voters of the city of Owasso.

RESOLUTION #97-08 A RESOLUTION AUTHORIZING THE CALLING
AND HOLDING OF AN ELECTION IN THE CITY OF OWASSO
OKLAHOMA (THE "CITY") FOR THE PURPOSE OF SUBMITTING TO THE
REGISTERED QUALIFIED ELECTORS OF SAID CITY THE QUESTION OF
APPROVAL OR REJECTION OF ORDINANCE #553 OF THE CITY WHICH
AMENDS ORDINANCE #326 OF THE CITY (AS HERETOFORE
AMENDED) BY CHANGING THE PURPOSE FOR WHICH CERTAIN
SALES TAX MAY BE USED ALL AS MORE SPECIFICALLY SET OUT IN
ORDINANCE #553 OF SAID CITY
Mr Ray said that Resolution #97-08 authorizes the Mayor to issue a proclamation calling an
election to be held on October 14, 1997, and setting forth the ballot title. Mr Wilken moved,
seconded by Dr Bode, to approve Resolution #97-08.

The Owasso City Council met in special session on Thursday, August 14, 1997 in the Lower
Level Conference Room at City Hall per the Notice of Public Meeting and Agenda posted on
the City Hall bulletin Board at 10:30 a.m. on Monday, August 11, 1997.
ITEM 1: CALL TO ORDER AND ROLL CALL.
Mayor Barnhouse called the meeting to order at 6:35 p.m. Councilors present: Mary Lou
Barnhouse, Mayor (out at 8:15); Tracy Standridge, Vice Mayor, Denise Bode, Councilor; Mark
Wilken, Councilor. Staff present: Rodney J Ray, City Manager. Several other department
directors were also present.
A quorum was declared present.
ITEM 2: DISCUSSION OF ISSUES OF IMPORTANCE TO THE CITY OF OWASSO.
A general discussion of several issues of importance to the City of Owasso took place, including
t a discussion of the 1997-98 street repair program by Mr Carr; a discussion of proposed
community assessment program by Mr Tobias; a discussion of a contractor's license revocation
by Mr Rooney; a discussion of rules and regulations regarding city utilities by Mr Ray; and a
discussion bond election neighborhood meetings by Mr Ray. No formal action was requested
and no vote taken.

BACKGROUND:
Current city ordinances (Part 10, Chapter 3, Section 10-309, "Code of Ordinances, Owasso,
Oklahoma) prohibits the discharge of weapons inside the corporate limits. An exception
contained in that section allows for the discharge of weapons only "...when necessary for the
protection of life or property in accordance with the law. "
Construction of a police department operated firearms range is anticipated in the near future at
a site located directly south of the city's wastewater treatment plant. That site is located within
the corporate limits of the City of Owasso and is, therefore, subject to Section 10-309 of the
Code of Ordinances as cited above. Therefore, use of the facility by both police officers and
civilians for training would be prohibited absent changes in the current law.
Since its inception, the potential uses of the police firearms range has included the concept of
conducting civilian training classes and target shooting for a fee. That concept was developed
in an effort to partially recover some of the capital and maintenance costs of the facility.
However, such non-police use of the facility would also clearly be in violation of the city's
ordinances.
The department's staff reviewed the existing ordinance and conferred with the City Attorney to
determine options available to allow use of the range for both purposes. The result of that
discussion was the development of an amendment to the existing Code of Ordinances. That
amendment, if adopted, will allow for the discharge of weapons by police officers and by
civilians "under the direction of a duly commissioned police officer of the City of Owasso,
Oklahoma while participating in training or tournament activities on the Owasso Police
Department firing range..." Thus, the effect of the amendment would be to allow the
department's personnel to train at the facility and allow the department to participate in an
entrepreneurial endeavor if a positive financial result was anticipated.

SUBJECT: REQUEST TO RENEW JUVENILE JURISDICTION AGREEMENT
BETWEEN THE CITY OF OWASSO AND OKLAHOMA DISTRICT
COURT SERVING TULSA COUNTY
DATE: August 15, 1997
BACKGROUND:
On February 16, 1993, the City Council first authorized the Owasso Municipal Court to enter
into an agreement with the Tulsa County District Court for the purpose of allowing the
Municipal Court to assume jurisdiction over certain juvenile misdemeanor offenses. Those
offenses covered in the agreement included vandalism, shoplifting, trespassing, assault,
assault and battery, battery, truancy, disorderly conduct, and public intoxication. The
purpose of the arrangement is to encourage local communities to provide some form of "early
intervention" in an effort to prevent young offenders from re-entering the justice system again
and again.
Subsequently, on August 16, 1994, July 11, 1995, and September 3, 1996, the Council
approved renewals of that agreement. Even though the Council has approved and renewed
this agreement, the Attorney General has ruled that these types of interlocal agreements must
be renewed each year. Since initiating the agree tolversations nt, the Owasso Court system has
processed a total of 584 juvenile offenders. In cwith the Police Chief, City
Prosecutor, Municipal Judge and City Attorney, it is apparent that all of the involved parties
agree that the program is worthwhile and should be continued.
The agreement was reviewed and slightly modified from the renewal agreement from the
1996 document. City Attorney, Ron Cates, advised that the modification allows the Court
system to hold the parent accountable for unpaid fines and/or incomplete community service
hours. The agreement should have been reviewed for renewal no later than May, but the
District Court was later in submitting the renewal contract to the participating cities due to
the due to the lengthy evaluation process and the desire to make various changes.

offenders. By implementing such a program, the resources available to the District Court can
be focused more efficiently on more serious juvenile offenders, including felony offenders and
juveniles with significant histories of repeat offenses.
1. TERMITERMINATION
This Agreement shall be effective after July 1, 1997 upon approval of both parties and
the Oklahoma Office of the Attorney General. The Agreement shall be effective until
terminated as provided herein, contingent upon the availability of sufficient funds each fiscal
year.
Either party may request a modification of the Agreement by making a written request
identifying the desired amendments, or the subject matter thereof, at least forty-five (45) days
in advance of the negotiations concerning such amendment. Either party may terminate the
Agreement by providing written notice to the other party forty-five (45) days prior to the date of
termination.
II. OBLIGATIONS OF THE CITY
1) The City shall assume jurisdiction of offenders who meet the following criteria:
a. Are under eighteen (18) years of age;
b. Are not presently under the supervision or treatment of the Tulsa County District
Court system and do not have charges pending there;
C. Have been charged for violating municipal ordinances relating to trespassing,
public intoxication, vandalism, shoplifting, assault, battery, assault and battery,
truancy, curfew, possession of low-point beer, possession of alcoholic
beverages, disorderly conduct, failure to appear for a court appearance or
comply with a court order, or any other municipal ordinance as agreed by the
District Court, District Attorney and the City;
d. Have not been certified as an adult for any purpose pursuant to 10 O.S. § 7303-
4.3 to the best of the City's knowledge.
2) Upon conviction or upon admission to a deferred sentence program, punishment and
conditions of probation imposed may include any one or all of the following:
a. A fine not to exceed the statutory maximum of the Municipal Court;
b. Community service work, not to exceed ninety (90) hours, in lieu of a fine if the
product of multiplying the number of hours of community service work by the
prevailing minimum wage does not result in a number which exceeds the
maximum fine authorized by law; or effective November 1, 1997, community
service work, not to exceed ninety (90) hours, in lieu of or in addition to a fine if
the product of multiplying the number of hours of community service work by the
prevailing minimum wage, plus any fine imposed, does not result in a number
which exceeds the maximum fine authorized by law;
C. Restitution; Counseling or other community-based services; and
e. Court costs.
3) Effective November 1, 1997, if a child fails to complete community service ordered by
the municipal court, a parent or guardian of the child who knew or should have known
that the child failed to complete the community service may be fined an amount that is
equal to the number of community service hours that are uncompleted by the child
multiplied by the hourly minimum wage amount.
4) In addition, during any calendar year that any child:
a. fails to appear for a court date on more than one occasion,
b. is convicted of two or more of the offenses listed in this Agreement, which offenses
occurred on different days, or
c. fails to pay any fine or cost properly assessed by the municipal court,
and after the expiration of ninety (90) days, the court clerk shall mail notice of such
occurrence to the Department of Public Safety, which department shall thereafter q
suspend or deny driving privileges for such child for six (6) months. This suspension
may be modified as provided in Section 6-107.2 of Title 47 of the Oklahoma Statutes.
5) Any fines and costs properly assessed against any child and which remain unpaid after
three (3) months may be assessed by the municipal judge against the child's parent,
parents, legal guardian or legal custodian and collected and paid as provided for in

Articles XXVII and XXVIII of Title 11 of the Oklahoma Statutes. Provided however, prior
to such latter assessment the court clerk shall give such child's parent, parents, legal
guardian or legal custodian notice by certified mail to their place of residence or
personal service of such action proposed to be taken.
6) The City shall keep all municipal arrest records, prosecution records, court records and
court proceedings for cases involving prosecutions under this contract confidential and
shall not open them for public inspection except by order of the Municipal Court or in
conformity with the statutes or regulations adopted pursuant to 10 O.S. § 620.6 and 10
~s O.S. § 7005-1.1 through § 7005-1.8. Effective November 1, 1997, municipal conviction
records involving children less than eighteen years of age convicted of violating
municipal ordinances relating to one or more of the offenses listed in this Agreement
shall be open to public inspection.
7) If a municipal citation is written to a juvenile meeting the above criteria, the Municipal
Court hearing date shall be indicated on the citation and notification of the citation(s)
shall be mailed to the parents, guardian, or responsible adult relative of the juvenile. If
the juvenile is arrested and meets the criteria set forth under the contract, under
circumstances where the citation and release procedure would not be appropriate (e.g.
intoxication), the City shall make reasonable efforts to locate the parent, guardian, or
responsible adult to take custody of the juvenile or may temporarily detain the juvenile
pursuant to 10 O.S. § 7303-1.2(E)(2)(3) and (4).
8) The City shall provide to the District Court law enforcement reports and related
documents for all juveniles referred to the District Court for prosecution and all juveniles
who will be prosecuted for misdemeanor criminal offenses in the Municipal Court.
Reports regarding juveniles who will not be prosecuted in either court shall not be
forwarded to the District Court. It is expressly understood that prosecution in Municipal
Court will constitute a bar of double jeopardy against any subsequent prosecution in
District Court for the same offense.

9) All fines and administrative fees generated as a result of prosecution of juveniles under
this contract shall be placed in one or more special accounts, and used solely to fund:
a. Local programs which address problems of juvenile crime, including without
limitation offender counseling, early intervention, community service and teen
court programs;
b. The costs of prosecution;
C. The costs of detention; and
d. Administrative costs related to local programs that address problems of juvenile
crime or related to the prosecution, detention, or punishment authorized by
statute.
10) The City shall provide the District Court a copy of the most recent audit report of its
Municipal Court operations for each year during the life of this contract or any extension
thereof. It is understood, however, that this Agreement does not impose any additional
recordkeeping requirements on municipal governments or officials.
11) Representatives of the District Court and the City shall meet periodically to share
information and to review and evaluate the success of procedures implemented to
prosecute and treat juvenile offenders.
III. STATUS OF VARIOUS EMPLOYEES/JOINT PROPERTY
No joint employment is created by this agreement for any purpose and each party will
be solely responsible for the payment of their respective expenses, including, but not limited
to, wages, salaries, and consideration paid on subcontracts. No joint property shall be
acquired.

Since the juvenile program was approved by the City Council and initiated in 1993, it has proven
to be a successful program. We have had 584 juveniles successfully complete a combination of
community service, counseling, and restitution, along with various safety reports, and pay the
minimal court cost. It would appear that this agreement is helping the City of Owasso and the
State of Oklahoma reach the goal of curbing the number of repeat offenders, thus reducing the
number of juveniles that would be transferred to the Juvenile Bureau District court. Based on
our experience, I would recommend that the City Council approve the renewal agreement and
authorize the Judge and Mayor to execute the document.

BACKGROUND:
On June 5, 1997, representatives of the City of Owasso (Rodney J. Ray, City Manager and Robert Carr, Public Works Director) and the Oklahoma Department of Transportation
(ODOT)(Dr. Alan Soltani, Chief Traffic Engineer and Mark Brown, Division VIII Traffic
Engineer) met to discuss improvements at the subject intersection. A project was proposed by
both parties to achieve realignment of the entrance/exit ramps and service roads at the
interchange. In addition, signalization would be relocated to be consistent with the ramp/service
~r road alignment.
Dr. Soltani indicated that funding was available through his office for this project. It was
discussed at that time that design, right-of-way acquisition and utility relocation would be the
responsibility of the City of Owasso. A rough construction cost estimate was calculated at that
time in the amount of approximately $1,000,000 and applicable design services was estimated
to be approximately $100,000 (equating to 10% of the estimated construction cost). Anticipating
this project in FY 97-98, the approved Capital Improvement Fund budget included $100,000 for
design services (Line item 81-410-5468).
RESOLUTION REOUIREMEN'TS:
A formal request for funding of the project was sent to ODOT on July 16, 1997. A response
to the request was received on June 30, 1997 requiring a City resolution. As indicated in their
letter, before a proposed project can be submitted to the Transportation Commission for
approval, the City must provide ODOT with a resolution stating commitment to providing the
following:

NSP ROADWAY AND UTILITY IMPROVEMENTS DESIGN
DATE: August 15, 1997
BACKGROUND:
Sack and Associates, Inc. was awarded a contract for professional engineering services in the
design, bidding and contract administration of roadway and utility improvements for the NSP
Building at the Council meeting on February 21, 1995. Construction plans and specifications
were completed and bids received on October 26, 1995. The City has received a grant from the
Oklahoma Department of Commerce (ODOC) to fund water and sewer improvements. Street
improvements are funded through the State of Oklahoma Department of Transportation (ODOT)
for construction of the roadway and box culvert bridge required.
The purpose of this project is to provide roadway access to the Owasso Expressway Service
Road from the NSP facility currently located on East 5th Avenue. The project was originally
intended to be designed and constructed in conjunction with construction of the building and
utilities to serve NSP. Due to probable effects of elevating the Service Road with the closing
of 66th Street North by ODOT, the project was been divided into two (2) phases of construction.
Phase I provided access to NSP by extension of 5th Avenue and utilities to their east property
line. This phase of construction was completed in 1996. Phase II extends 5th Avenue to the
service road, provides for drainage channel improvements and a multiple-box drainage structure
under the roadway. Work on Phase II has not been completed. Right-of-way and drainage
easements had to be obtained in order to authorize finalizing the contract documents and proceed
with construction.
The original engineering services contract with Sack and Associates was in the amount of
$33,915. Amendment No. 1 to the contract in the amount of $7,865 was approved by council
on November 21, 1995 as a result of dividing the project into phases and provide for design
adjustments.

RIGHT-OF-WAY ACQUISITION:
To complete Phase II design, two (2) documents are required:
1 - Deed of Dedication for the road, and
2 - Drainage easement for the channel improvements.
Meetings were held over the past year with the property owner (Alan Robinson) to discuss
obtaining these documents. On August 13, 1997, Mr. Robinson agreed to provide these
documents in return for provisions to extend the drainage channel south to his south property
line with reasonable assurance that the property could be filled to enable building construction.
A major portion of the Robinson property currently lies within the Bird Creek 100-year
floodplain and the Bird Creek Tributary 5 (Elm Creek) designated floodway. Staff has contacted
the Federal Emergency Management Agency (FEMA) and determined that an improved channel
through the property must carry the projected 100-year runoff within the channel limits in order
to change designated floodway location. At that time, earth fill to elevate the property, 'M
compensated by removal of material in the floodplain, could be placed to enable construction
above the 100-year floodplain elevation.
ENGINEERING SERVICES SCOPE CHANGE:
To accomplish the above floodway modifications, a proposed design and hydrologic analysis for
the channel improvements need to be submitted to FEMA. Sack and Associates has provided
an amendment to the scope of work for these items. The amendment includes engineering
services to extend the drainage channel (including surveying, design and drafting) and obtain
Corps of Engineers Section 404 permit. The amendment also includes performing a hydraulic
study to document reduction of the floodway and provide information necessary for submittal
to FEMA for a conditional letter of map revision.
The fee calculation included in the amendment is as follows:

DESIGN SCHEDULE:
In order to proceed with obtaining the needed right-of-way and drainage easements, work on the
above items will need to be initiated as soon as possible. Sack and Associates indicate that the
design phase and preparation of final construction documents for all work would be completed
within 45-days of receipt of a Notice to Proceed. The hydraulic study phase would be completed p
in approximately 90-days for submittal to FEMA for review.

SCOPE OF SERVICES
AMENDMENT NO.2 - CITY OF OWASSO
NSP ROADWAY AND UTILITY IMPROVEMENTS
' This Scope of Services describes the additional work requested by the City of Owasso to extend
the channel improvements associated with the National Steak & Poultry Roadway and Utility
Improvement Project. The Scope of Services is divided into two distinct phases, each phase
having several tasks. The first phase will be the design phase, the second the hydraulic study
phase.
DESIGN PHASE:
The Design Phase would encompass essentially two separate tasks as follows:
■ TASK A:
Design channel improvements from the existing termination of the proposed improvements
approximately 200' south of 5th Street to convey the 100-year flow downstream approximately
1,600'. This channel section will be designed to contain the 100-year flow and reduce the
regulatory floodway for Bird Creek Tributary 5A to within the banks of the channel as well as the
100-year floodplain from the local stream (i.e. Bird Creek Tributary 5A.)
This work would include completion of all plan and profile sheets, surveying, quantity
calculations, and the addition of appropriate specifications to the contract documents completed
under the original contract and Amendment No. 1.
TASK B:
Task B will be to assist City of obtaining a current Section 404 permit for discharges in the waters
of the United States. It will include coordination with the Tulsa District, Corps of Engineers and
the City of Owasso, Department of Public Works as necessary to obtain said permit.
HYDRAULIC STUDY PHASE:
This phase of the Scope of Services will include the work necessary to obtain a conditional letter '
of Map Revision from the Federal Emergency Management Agency for the proposed channel
improvements documenting the reduction in the regulatory floodway to within the channel banks ,
and removing adjacent properties from the floodway (Note: the adjacent properties will still be
located within the regulatory floodplain due to the fact that the floodplain is associated with the
floodplain from Bird Creek and will not be changed until fill on the adjacent properties is provided
for.) I
TASK A:
Task A of this phase will be to develop a hydraulic model of the stream and calibrate it to the
existing conditions of the current Flood Insurance Study (FIS) for Bird Creek Tributary 5A
(BCTSA).
TASK B:
Utilizing the hydraulic model developed for the stream in the previous task. This task will include
■
performing multiple frequency computer runs to determine the water surface profiles for the 10,
50, 100, and 500-year storms to demonstrate that the 100-year floodway is contained within the
channel banks for the improved channel conditions. This task will also include the information
necessary for submittal to the FEMA for a conditional letter of map revision (i.e. revised mapping,
computer print-outs, report summarizing work).
TASK C:
Ii
Task C will be to provide complete documentation including forms from FEMA's MT-2
document as appropriate for this project (i.e. forms 1, 2, 4, 6, and 7) for submittal to FEMA by
the City of Owasso.
The above scope of services and associated fee include only preparation of all engineering
documentation required for submittal to FEMA and do not include travel or meeting time to meet
with FEMA or any of its contractors which might be reviewing the conditional letter of
Map Revision documentation. These services could be included as additional services if necessary.
These services also do not include any development of the final submittal of letter of
Map Revision once all construction is complete. (Note: Depending on how closely the
construction follows the proposed plans, this could be a very simple task or could include some
additional report/documentation work.)

BACKGROUND:
The City of Owasso has received a request to rezone a 50 acre parcel of land from AG
(Agriculture) to RS-3 (Residential Single-Family High Density). The subject property is located
west of the southwest corner of E. 96th Street North and Garnett Road, immediately north of
the Ator Heights IV addition, and is undeveloped. A copy of the complete staff report provided
to the Planning Commission is attached for your information and review. The subject property
was recently annexed by the City of Owasso.
A rezoning of the subject property to RS-3 would appear to be a harmonious continuation of
both existing and proposed development in the area. If the zoning request is approved, the
subject property would tie into the existing Ator Heights IV Addition (also zoned RS-3) and the
proposed future phases of The Fairways at Bailey Ranch (zoned PUD with underlying RS-3
zoning).
Letters were mailed to all property owners within 300 feet of the request and the legal ad was
published in the Owasso Reporter. No opposing comments have been received by the
Community Development Department. The Planning Commission unanimously recommended
approval of the request at their August 12, 1997 regular meeting.
If the request is approved by the City Council, an ordinance would be presented at the
September 2, 1997 City Council meeting formally adopting the approval.
RECOMMENDATION:
Staff recommends Council approval of rezoning application OZ-97-03.

REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from

LOCATION AND SIZE: The subject property is described as the Northwest Quarter of the ,
Northeast Quarter and the Northwest Quarter of the Southwest Quarter of the Northeast
Quarter of Section 19, T21N, R14E and totals 50 acres, more or less. The subject property

EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by E. 96th
Street north while further north lies the El Rio Vista subdivision zoned RS-3 (Residential

Single-Family High Density). The subject property is bordered on the east by property
which is largely undeveloped with the exception of a residential dwelling. The subject
property on the east has several owners and is zoned RS-2 (Residential Single-Family t
Medium Density), CS (Commercial Shopping Center District, and RMT (Residential Multi-
Family Townhomes). The subject property is bordered on the south by Ator Heights IV
Addition which is zoned RS-3. The subject

APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 4 "Residential Land Uses".
SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The applicants are requesting a rezoning of a parcel of land totalling 50 acres in area from
AG (Agriculture) to RS-3 (Residential Single-Family High Density) in order to allow for
single-family residential development. The subject property was recently annexed by the
City of Owasso with an accompanying AG zoning.

A rezoning of the subject property to RS-3 would allow for the applicant to "tie" the subject
property together with proposed residential development within the Bailey Ranch Golf Club
and the existing residential development located in Ator Heights IV. While the proposed
residential development of The Fairways III is zoned Planned Unit Development, its
underlying zoning is RS-3 which is identical to the zoning being requested for approval, as
well as the existing zoning in Ator Heights IV.
When reviewing the request, it would appear consistent and harmonious with surrounding
existing development as well as proposed development. A majority of the nearby property
has developed, or will be developed, under the RS-3 property development standards. In
short, the request is a logical extension of existing zoning patterns in the area and staff has
no identified concerns with the request.
The applicant should be advised that acceleration/deceleration lanes, as well as sidewalk, will
be required along E. 96th Street North. This requirement would be realized during the
platting process.
Notices were mailed to surrounding property owners on August 4, 1997 and the legal
advertisement was published in the Owasso Reporter on July 24, 1997. A copy of both have
been attached for your information and review. Additionally, the subject property was
posted on July 18, 1997. Many calls requesting information regarding the request have been
received by the Community Development Department, however no comments opposing the
request were received upon explanation of the rezoning request.
RECONEMENDATION
Staff recommends approval of the rezoning request from AG (Agriculture) to RS-3
(Residential Single-Family High Density).

BACKGROUND:
The City of Owasso has received a request to rezone a 20 acre parcel of land from AG
(Agriculture) to RS-2 (Residential Single-Family Medium Density). The subject property is
located east of the northeast corner of E. 96th Street North and N. 129th E. Avenue,
immediately north of the Pleasant View Addition (Tulsa County), and is undeveloped. A copy
of the complete staff report provided to the Planning Commission is attached for your
information and review. The subject property was annexed by the City of Owasso in July of
this year.
As discussed in the staff report, a rezoning of this property to RS-2 is consistent with the
development trend that has occurred in the square mile area to the south. Windsor Lake,
Windsor Lake II, Camden Park, Barrington Point, Barrington Estates, Nottingham Estates, and
Brentwood Estates all contain the RS-2 zoning being requested by the applicant. While most
lots that are developed residentially in the square mile area that contains the rezoning request
are larger than minimum RS-2 standards, this is largely due to the size lot required to obtain a
septic system due to previous inaccessibility of sanitary sewer.
Letters were mailed to all property owners within 300 feet of the request and the legal ad was

The RS-2 zoning being requested by the applicant represents a milestone of sorts regarding
future development in the City of Owasso. Within the last six years (1991 thru 1997), an
' overwhelming majority of the square mile section to the south of the subject property (that
area bounded by E. 96th Street North, N. 145th E. Avenue, E. 86th Street North, ad N.
129th E. Avenue) has been rezoned to and developed under the RS-2 property development
standards. The applicant's request would now continue a very successful and established
development pattern into this square mile section.
A majority of the property in the square mile section that contains the rezoning request is,
however, zoned a lower density than the RS-2 being proposed by the applicant. This is due,
in large part, to the lot sizes required within Tulsa County in order to obtain and support a
septic system for each dwelling. With the recent extension of sanitary sewer lines in the
Pleasant View Addition, the accessibility and ability for the applicant to utilize sanitary sewer
allows for a higher density development. Requests of this nature within this square mile area
are likely to become more common in the future.

The City of Owasso has received a request to review the final plat for Owasso Industrial Park.
The subject property is located immediately south of the National Steak and Poultry facility and
would contain 6 lots on 7.41 acres, more or less. The subject property is zoned IL (Light
Industrial).
A preliminary plat for Owasso Industrial Park was reviewed and approved by the Planning
Commission at the July 8, 1997 Planning Commission meeting. As you may recall, the plat at
that time contain 5 lots with the rear of those lots being identified/designated for stormwater
detention. The final plat proposal contains 6 lots, one more than the preliminary plat. This lot
was created by identifying the size of the necessary stormwater detention, locating that detention
on one lot as opposed to all of the lots, thus creating an additional sixth lot. Access to this lot
is proposed via a mutual access easement along the east lot line of Lot 3.
The final plat for Owasso Industrial Park was reviewed by the Technical Advisory Committee
at their July 29, 1997 regular meeting. At that meeting, area utility companies and staff are
provided an opportunity to request corrections and/or additions to the request. No
comments/requests were noted from the area utility companies and staff's comments were limited
to the labeling of the street and the inclusion of addresses on the plat. Please note that Lot 6
is not addressed on the final plat within your packet. Staff would recommend that Lot 6 receive
the address of 322 East Fifth Avenue, with Lots 3 thru 5 being addressed 332, 342, and 352 E.
Fifth Avenue as a condition of approval.
The final plat was unanimously approved by the Planning Commission at their August 12, 1997
regular meeting.
RECOMMENDATION
Staff recommends approval of the final plat for Owasso Industrial Park.
