Mr Ray Attachment #5 The staff will recommend Trustee adoption that will place, as a prerequisite for obtaining access to the municipal water and wastewater systems, specific development requirements on subdivisions located outside the municipal corporate boundaries. 6. Consideration and Appropriate Action Relating to a Request by Charles Burris for Extension of Water and Wastewater Service to an Area Outside the City's Corporate Boundaries, Such Extension for the Purpose of Serving a Subdivision of Tulsa County. Mr Ray Attachment #6 The staff has reviewed the request for service and will present its finding to the Trustees. The staff recommendation is directly dependent upon OPWA policy, therefore Trustee action on item #5 will impact that recommendation. 7. Consideration and Appropriate Action Relating to a Request to Award a Contract for the Purchase of Residential Refuse Containers (Polycarts), and Authorize Payment for the Purchase of an Initial Order of 100 Green Carts at $5700.00. Mr Carr Attachment #7 Staff has completed the bidding process, reviewed the bids received, and will recommend a contract be awarded to Williams Refuse Equipment Co Inc, Owasso, OK for a time period through June 30, 1998 to supply residential refuse containers consistent with bid specifications, at a cost of $57.00 per green cart and $59.00 per red cart; and for Trustee authorization for the payment of $5700.00 for the purchase of an initial order of 100 green carts. MEMORANDUM TO: THE HONORABLE OWASSO PUBLIC FROM: RODNEY J RAY CITY MANAGER SUBJECT: RECOMMENDED FOR MUNICIPAL SUBDIVISIONS 01 DATE: July 11, 1997 BACKGROUND: r u During the June 17, 1997 meeting of th extension of municipal water and waste made. The request, made by the develo utilities to a subdivision located outside request focused on the concern that th contiguous to the city's current boundary street construction, drainage improvem assumption that there would be future a potential homeowners would not know ti and, therefore, make a decision to p jurisdictional issues or who would be jurisdictional issues raised by residents o for street maintenance assistance in a sub similar problems the city currently faces. AND TRUSTEES AUTHORITY ILICY STATEMENT RELATING TO REQUEST ATER/WASTEWATER SERVICE TO SIDE THE CITY'S CORPORATE BOUNDARIES Owasso Public Works Authority, a request for the ater service to a newly developing subdivision was er, Mr Charles Burris, was for the extension of those f the city's co orate boundaries. Discussion of the subdivision for which the request was made was but did not meet the city's development standards for nts, or lot size. That concern was based on an tempts to annex the subdivision into the city, or that t the area was outside the city's corporate boundary chase a home without clearly understanding the responsible for infrastructure maintenance. Recent subdivisions outside the city's boundary and requests division with private streets, are cited as examples of As a part of that discussion, the staff was asked if there was existing policy relating to the extension of municipal utilities to areas outside the corporate limits. The staff response indicated that there was no existing policy relat' ig to extra- territorial service. Based on the above - described discussion and the staff responses, the Councilors voted to table further consideration of the request for thirty days. The Council further directed the staff to research and develop- during that interim a policy relating to the extension of municipal utilities to develonin subdivisions located outside the city's corporate boundaries. POLICY STATEMENT - WATER/WASTEWATER JULY 11, 1997 PAGE 2 RESEARCH AND SURVEY: The staff has conducted a survey of seventeen cities that are considered to have similar growth patterns as our community. (Greater emphasis was placed on the location and growth trends of the communities selected than was similar size to Owasso.) The cities surveyed were located in Oklahoma and five other states (Arkansas, Kansas, Texas, Missouri, and Arizona). All of the cities are experiencing (or have experienced) rapid growth, both in their corporate boundaries and in the area immediately outside of those boundaries. The survey discovered that, while all of the cities immediately recognized the issue and indicated a like concern, almost none had adopted a written policy that specifically addressed the issue of extending municipal utilities to developing subdivisions outside the city's boundaries. Interestingly, most of those surveyed initially indicated that their city not only had a policy, but had a written policy that required annexation in order to obtain municipal utility services. However, upon their spokespersons closer review or our review of their faxed policies, it was found that the policy of requiring annexation was one that most of the cities "simply required" and had evolved over the years, but was not a written policy. While seventeen cities were contacted, only thirteen of those cities responded to questions. Nine of the thirteen cities that provided answers to our questions have a policy that requires annexation into the city in order to receive municipal services. Of the nine, seven cities claimed to have written policies requiring annexation prior to granting municipal utility service to subdivisions outside the city. However, of the seven cities who claimed to have written policies requiring annexation in order to extend municipal utility service, only two (Olathe, KS; Broken Arrow, OK) have actual specific written policy regarding such. It should be noted that a third city (Kingman, AZ) has a "may require annexation" clause in its policy that is unique in that it requires developers who desire city utilities for property outside the city to submit a petition for annexation. That petition is apparently maintained on file in the event the city decides, at a future date, to annex the property. (Evidently, once the city decides to annex, they simply "activate" the previously submitted petition and then take action to attach.) In summary, of the thirteen cities that responded, only three actually have a written policy, while ten enforce some form of required annexation prior to receiving municipal services. After reviewing the results of the survey, the conclusion of the staff is that it is obviously the policy and intent of a significant majority of the communities surveyed to require developments outside the city boundaries to meet their design standards before the extension of municipal utilities will be allowed. STAFF DISCUSSION AND RATIONAL: Prior to the survey, staff discussions relating to this issue were focused on developing a criteria that a policy statement should meet. The staff determined that a viable policy should consider POLICY STATEMENT - WATER /WASTEWATER JULY 11, 1997 PAGE 3 first the long -term effects and impacts of its results. A workable policy should also focus on the desired result of the policy as it relates to the community's quality of life and image. It should promote the city's integrity as a representative and responsive government and finally, a viable policy should be based on a rational of common sense and an understanding that public policy is a viable tool to be used to protect and serve the people of the community. While the initial goal of the staff had been to develop a "set" of options for Council consideration, it became evident early in the process that there was only one truly viable option that addressed the criteria and accomplished the desired outcomes. That led the staff to the development of a recommended policy statement that addresses the issues of long -term effects; encourages quality development; allows the city to be responsive to citizen concerns, requests and expectations; is defendable as a public policy; and is founded on the principal that it just makes good sense to proactively seek to avoid future problems when it is clearly obvious that a lack of action will eventually cause those problems. If there is a commitment to really consider the long -term effect of a decision in this matter, thought must be given to what the future "look" of this city will be without an effective policy relating to the extension of municipal services to newly developing subdivisions. The central issue and question under discussion does not relate to the extension of utility services or, in the immediate case, the city's ability to deliver those services. The real issue is: "Will the City of Owasso implement the appropriate planning concepts to manage growth and will it develop policies that are strategic in nature so as to avoid to the extent possible future problems and future cost to the community and its citizens ?" Consider an Owasso in 2015 where there are numerous "pockets" of residential (and perhaps commercial) developments that do not lie within the corporate boundary of the city. Then consider the additional issue of each of those developments having streets that are maintained by the county, drainage that does not integrate with the neighboring subdivision, lot sizes that are significantly smaller than their neighbors, and a lack of sidewalks. Clearly, the issue in 2015 will not be could the city have served the subdivision, but SHOULD the city have served the development without requiring minimum standards and thus allowed the creation of a problem that was obvious. Additionally, the city has long valued its responsiveness to citizen /customers. That responsiveness is, however, dependent upon the legal authority to act in response to requests and concerns. Using the above scenario of considering the "look" of Owasso in the year 2015 ' without a policy regarding the extension of utilities; consider the frustrations of homeowners who believe themselves to be Owassons, who are surrounded by other "city" subdivisions, but can't get access to local government resources to address problems. Problems and issues such as juvenile crime, speeding, use of fireworks, parks and playgrounds, and zoning will all be handled by officials at the county level rather than what they consider as their local government. It is inevitable that these homeowners will look to the City of Owasso as the responsible r POLICY STATEMENT - WATERIWASTEWATER JULY 11, 1997 PAGE 4 government entity to assist in their effort to resolve those problems. Just as inevitable is the response that future city officials will give, "the city cannot utilize public resources to address street or crime issues in areas outside the city ". It is also predictable that pointed comments regarding the lack of vision of city officials in 1997 was what created the problems in 2015. Once again, the question at that time will not be, "Is the city responsive to citizens ?" But, "Should the city have been responsive in 1997 to its clear obligations and responsibilities to avoid future problems ?" By adopting a policy that is responsive to the community's desire for quality that lasts, the Council will be helping to ensure that a future Council can be responsive t to citizen /customers in 2015. One only has to look to "Three Lakes Village" and areas like 99th St N to know that a common ' sense approach now will avoid problems in the future. STAFF POSITION/PROMULGATION OF R I RULES AND PROCEDURES: Therefore, it is the staffs position that the attached policy statement be adopted by the City Council and that the staff be directed to promulgate administrative rules to implement that policy. Such administrative rules should, at a minimum, address the following areas: 1. That property outside the city's corporate boundary be allowed access to water and wastewater service only after such extension of service is approved by the Trustees of ' the OPWA; and, 2. The site is outside the City limits in Tulsa County. By letter dated March 28, 1997 (see attached), the developer requested approval to connect the subject subdivision utilities to City water and sewer systems. Public Works letter dated June 5, 1997 (see attached) informed the developer that City utilities are available for the connections and that sufficient water pressures exist to serve the development. Water service to Kelly Ann will have minimal effect on existing pressures. The development is within the Ator Lift Station drainage basin. Proposed future sewer system improvements include a relief line which will eliminate the lift station. Costs associated with the relief line are to be allocated to future basin development via escrow deposits which amount to $325 per acre. The escrow required for Kelly Ann (15.132 acres) is $4,917.90 which should be on deposit prior to final acceptance of the improvements. RECOMMENDATION: The technical evaluation indicates that water and sanitary sewer service is available to serve the proposed Kelly Ann subdivision. Based on this evaluation, staff recommends approval for Kelly Ann water and sewer connection to the city system, subject to an escrow deposit prior to final acceptance of the sanitary sewer system. The plastic cart collection system has proven to be successful and cost- effective by providing a uniform container that is sturdy, easily identifiable and is compatible with the one -man per route side - loading refuse collection vehicle system. Through the bid process, the city has been able to obtain a consistent price per cart unit and maintain a supply of carts for replacement needs and to supply new customers. Staff solicited bids for the bulk purchase of green refuse carts for use in residential trash collection and red carts for use by yardwaste separation customers. The specifications (see attachment) requested a unit price bid for each color of 90 -gallon cart. The carts will be ordered in a minimum of fifty (50) unit quantities. The bid price per cart and the price of replacement parts is guaranteed for any orders placed until June 30, 1998. ' The proposed contract guarantees a fixed price for FY 97 -98, regardless of the number of carts ordered. Therefore, staff will not request Trustee approval for the purchase of carts again until ' next fiscal year. Payment for a bulk purchase must be approved by the Trustees.
