the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and

Dr Bode moved, seconded by Mr Wilken, to approve the consent agenda. The consent agenda
included minutes of the August 19, 1997 meeting, by reference made a part hereto. Item B on
the consent agenda included the following claims: (1) OPWA Fund $15,776.79; (2) OPWA
Capital Improvement Fund $1,290.41; (3) OPWA Sales Tax Fund $50,931.63; (4) Interfund
Transfers $37,447.83; (5) Payroll $26,802.64.

ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR TRUSTEE APPROVAL OF A BUDGET AMENDMENT
DECREASING THE EXPENSES IN THE OPWA ADMINISTRATION
DEPARTMENT AND INCREASING THE TRANSFER TO THE GENERAL
FUND FROM THE OPWA FUND.
Ms Bishop presented the item, stating that at the time of his resignation Mike Knebel's salary
and benefits were a part of the OPWA Administration budget. The funds that remain in that
budget need to be reassigned to cover the functions of his job now being handled by other
departments. It is proposed that the budget be amended to assign $12,000 to the Community
Development Department to cover the cost of electrical inspections, and $25,000 to the Support
Services Department for computer and phone operations costs. Mr Wilken moved, seconded
by Dr Standridge, to approve an amendment to the FY 1997 -98 OPWA Fund budget, increasing
the transfer of funds to the General Fund by $37,000 and reducing appropriations to the OPWA
Fund's Administration Department by the same amount.

ITEM 6: REPORT FROM OPWA MANAGER
Mr Carr reminded those present about the Household Pollutants Disposal which will be held on

SUBJECT: SUBSTITUTE AGREEMENT
DATE: September 16, 1997
The attached "Agreement" between the Owasso Public Works Authority and Charles Burris
represents a substitute to the agreement contained in the background information you received
in the Authority meeting packet. The changed language is highlighted and adds the words
"including, but not limited to, lot size" after the words "all development" in the second line of
the first "Whereas ". The words "including, but not limited to" are also added after the word
"infrastructure" in the second line of the first "Whereas ".
Additionally, the same two changes have been made to Section One, lines one, two, and three.
The substitute is offered subsequent to concerns raised by Councilors that the language could be
made more definitive by adding the changes. The staff concurs, and Mr Cates has reviewed and
approved the changes.
Councilor Wilken suggested clarifying the intent of the agreement and was faxed a copy of the
agreement for review this afternoon. Mr Burris has been notified of the change and did not
express any concern.
AGREEMENT
EXHIBIT "C"
This Agreement dated this 5th day of September , 1997, by and
between CHARLES L. BURRIS , (hereinafter referred to as Developer), having its
address located at 12005 East 87th Pl., No., Owasso, OK 74055 , and the Owasso Public
Works Authority, an Oklahoma Public Trust, having the City of Owasso, Oklahoma, as its
beneficiary, (hereinafter referred to as Authority), having its address at 207 South Cedar,
Owasso, Oklahoma 74055.
WHEREAS, Developer is in the process of developing a subdivision outside of the
corporate limits of the City of Owasso, Oklahoma, and in conjunction with such development
Developer is desirous of obtaining from Authority water and wastewater to such subdivision;
and,
WHEREAS, by Resolution of the Trustees of the Owasso Public Works Authority on the
15th day of July, 1997, all development, including, but not limited to, lot size, and construction
of infrastructure, including, but not limited to, water, wastewater, streets and storm sewer in any
area outside of the City of Owasso's corporate boundary sought to be served by municipal water
mainline and /or wastewater mainline must be done in accordance with all present and future
codes, ordinances and regulations adopted by the City of Owasso and /or the Owasso Public
Works Authority which would be then applicable to similar construction and development inside
the City of Owasso's corporate limits; and,
WHEREAS, Developer and Authority are entering into this agreement for the express
purpose of provision of such municipal water and wastewater services in accordance with the
aforementioned policy.
NOW, THEREFORE, in consideration of the mutual covenants hereinafter contained,
the parties agree as follows, to -wit:
Section One. Developer covenants unto Authority that all development, including, but
not limited to, lot size, and construction of infrastructure, including, but not limited to, water,
wastewater, streets and storm sewer in the subdivision known as:
KELLEY ANN SUBDIVISION , located 107th E. Ave. & 98th Street North ,
presently outside of the corporate limits of the City of Owasso, Oklahoma, will be done in
accordance with all codes, ordinances and regulations adopted by the City of Owasso, and /or
the Owasso Public Works Authority which are applicable at the time of Developer's development
and construction of such infrastructure to similar construction and development inside the
corporate limits of the City of Owasso, Oklahoma.
Section Two. Developer covenants unto Authority that Developer will allow inspectors
of the City of Owasso, Oklahoma, to inspect such infrastructure development and construction
in the manner and at the times that the inspectors of the City of Owasso, Oklahoma would
inspect development and construction of infrastructure in subdivisions lying within the corporate
limits of the City of Owasso, Oklahoma.
Section Three. Authority covenants unto Developer that Authority will provide
municipal water and wastewater service to the above referred to subdivision upon it being
determined by the Trustees of the Authority that Developer's development and construction of
infrastructure in the above referred to subdivision lying outside the corporate limits of the City
of Owasso, Oklahoma, is in compliance with all existing codes, ordinances and regulations
adopted by the City of Owasso and /or the Owasso Public Works Authority presently applicable
to similar construction and development inside the corporate limits of the City of Owasso,
Oklahoma.

SUBJECT: APPLICATION FOR EXTENSION OF WATER/SEWER SERVICES
OUTSIDE THE CORPORATE BOUNDARY OF THE CITY OF
OWASSO - KELLEY ANN SUBDIVISION (CHARLES L. BURRIS,
DEVELOPER)
DATE: September 11, 1997
BACKGROUND:
City Council on July 15, 1997 adopted a Policy governing the extension of municipal water and
sewer utility services. Rules and Regulations (see attached) necessary to implement the Policy
were promulgated by staff as required by Council policy and have been distributed to
developers.
Included in the Rules and Regulations is an action plan to be followed to receive consideration
by the Authority for services outside the corporate boundary of the City of Owasso. The steps
required are summarized as follows:
1. An Application must be made to the Owasso Public Works Authority through the
office of the Director of Public Works. (The form for this application is included in
the Rules and Regulations as Exhibit "B".)
2. Included with the Application shall be a concept drawing showing:
- Location of the property
- Proposed layout of development
- Lot configuration and sizes
- Location of on -site detention
- Streets rights -of -way
- Utilities location and sizes, and
- Anticipated points of connection with off -site facilities.

3. A signed Agreement must be provided with the Application stipulating that
infrastructure (water, wastewater, streets and storm sewer), lot size and other
necessary improvements will be constructed in accordance with existing codes,
ordinances and regulations adopted by the City of Owasso and /or the Owasso Public
Works Authority.
4. Upon receipt of the concept drawing and Agreement, the proposed water and /or
wastewater system for the property will be modeled and evaluated by the Public
Works Department Engineering Division.
5. Application, Agreement, concept drawing and model results will be submitted to the
Authority for consideration as an application for extension of service.
The Application contains sections for review and recommendation by the Public Works
Engineering Division and the Public Works Director.
SUBMITTED INFORMATION
In accordance with the Rules and Regulations, an Application, Agreement and concept drawing
has been submitted for the Kelley Ann Subdivision proposed to be located west of El Rio Vista
and north of 96th Street North. Public Works Engineering Division staff have modeled
extending water and sewer to the subdivision and find minimal effects on the present system.
Preliminary review of other improvements proposed indicate that they are in conformance with
existing codes, ordinances and regulations adopted by the City of Owasso and /or the Owasso
Public Works Authority. Lot sizes have been reviewed by Community Development and are
consistent with the zoning code of the City of Owasso and the contiguous property.
As included in the Rules and Regulations, detailed plans for water, wastewater, streets and storm
sewer will be provided by the Applicant for approval by the Public Works Director. Approval
of the detailed water and wastewater plans will be required prior to commencement of
construction and to obtain permitting by the Oklahoma Department of Environmental Quality
(ODEQ) .
RECOMMENDATION: I
Staff recommends Trustees approval of the Application for extension of water and sewer services '
for Kelley Ann Subdivision located in Tulsa County.

This Agreement dated this 5th day of September , 1997, by and between ,
MTATZT TVq T RTTRT2TC , (hereinafter referred to as Developer), having its
address located at 12005 East 87th P1 . No,, Owasso, ox 74055 , and the Owasso Public
Works Authority, an Oklahoma Public Trust, having the City of Owasso, Oklahoma, as its '
beneficiary, (hereinafter referred to as Authority), having its address at 207 South Cedar,
Owasso, Oklahoma 74055.
WHEREAS, Developer is in the process of developing a subdivision outside of the '
corporate limits of the City of Owasso, Oklahoma, and in conjunction with such development
Developer is desirous of obtaining from Authority water and wastewater to such subdivision;
and,
WHEREAS, by Resolution of the Trustees of the Owasso Public Works Authority on the
15th day of July, 1997, all development and construction of infrastructure (water, wastewater,
streets and storm sewer) in any area outside of the City of Owasso's corporate boundary sought
to be served by municipal water mainline and/or wastewater mainline must be done in
accordance with all present and future codes, ordinances and regulations adopted by the City of
Owasso and /or the Owasso Public Works Authority which would be then applicable to similar
construction and development inside the City of Owasso's corporate limits; and,
WHEREAS, Developer and Authority are entering into this agreement for the express
purpose of provision of such municipal water and wastewater services in accordance with the
aforementioned policy.
NOW, THEREFORE, in consideration of the mutual covenants hereinafter contained,
the parties agree as follows, to-wit:
Section One. Developer covenants unto Authority that all development and construction
of infrastructure (water, wastewater, streets and storm sewer) in the subdivision known as _
KELLEY ANN SUBDIVISION , located 107th E. Ave". & 98th Street North ,
presently outside of the corporate limits of the City of Owasso, Oklahoma, will be done in
accordance with all codes, ordinances and regulations adopted by the City of Owasso, and/or
the Owasso Public Works Authority which are applicable at the time of Developer's'development
and construction of such infrastructure to similar construction and development inside the
corporate limits of the City of Owasso, Oklahoma.
Section Two. Developer covenants unto Authority that Developer will allow inspectors
of the City of Owasso, Oklahoma, to inspect such infrastructure development and construction
in the manner and at the times that the inspectors of the City of Owasso, Oklahoma would
inspect development and construction of infrastructure in subdivisions lying within the corporate
limits of the City of Owasso, Oklahoma.
' Section Three. Authority covenants unto Developer that Authority will provide
municipal water and wastewater service to the above referred to subdivision upon it being
determined by the Trustees of the Authority that Developer's development and construction of
' infrastructure in the above referred to subdivision lying outside the corporate limits of the City
of Owasso, Oklahoma, is in compliance with all existing codes, ordinances and regulations
adopted by the City of Owasso and/or the Owasso Public Works Authority presently applicable
to similar construction and development inside the corporate limits of the City of Owasso,
Oklahoma.

1. In response to a request for service outside the city limits (see attached letters), pre- and post -
development water pressures have been modeled at locations in the vicinity of the subject
development. Based on a water model analysis for nodes marked on the attached map, the
following pressures are indicated:

The water model includes all existing or planned subdivisions. Therefore, the indicated
pressures are somewhat lower than those which presently exist.
Development of Kelly Ann has minimal effect on pressures.
2. The proposed development is within the Ator Lift Station drainage basin. Improvements have
been proposed to enable construction of a relief line which will eliminate the Ator Lift Station.
Costs associated with the construction of this line have been estimated and allocated to
undeveloped property in the basin. The required escrow deposit for the lift station relief line is
5325 per acre. Based on an area of 15.132 acres, Kelly Ann would be required to contribute
54,917.90 to escrow.

' THE EXTENSION OF MUNICIPAL UTILITY SERVICES
(WATER AND SEWER)
' CITY OF OWASSO, OKLAHOMA
OWASSO PUBLIC WORKS AUTHORITY
' The following Rules and Regulations are promulgated pursuant to Policy adopted by the Owasso
City Council on July 15, 1997 and attached hereto as Exhibit "A ":
' 1. APPLICATION: Application must be made to the Owasso Public Works Authority
(hereinafter referred to as the "Authority") through the office of the Director of Public Works
' in the form provided (Application attached as Exhibit "B ").
2. FACILITIES: The Applicant agrees to lay and construct said water distribution
and /or wastewater collection system, lines and appurtenances (hereinafter referred to as the
r "facilities ") pursuant to the plan and profile thereof showing the location of lines, sizes of lines,
location of valves and other appurtenances, such plans having been prepared by the Applicant,
tapproved by the Director of Public Works, and made a part hereof.
PROVIDED HOWEVER, if the property to be served lies outside the corporate boundary of the
' City of Owasso, Oklahoma the following must be submitted /performed prior to submittal of
plans as described above (enclosed to the Director of Public Works):
a. Concept drawing(s) showing the location of the property and proposed layout of
development. The drawing(s) shall be submitted in a scale of sufficient detail on
11 "x17" paper suitable for clear reproduction. Information to be included on the
' drawing must include, but not be limited to, lot configuration and sizes, location
of on -site detention, street rights -of -way, utilities location and sizes, and
anticipated points of connection with off -site facilities.
' b. Signed Agreement stipulating that infrastructure ( water , wastewater, streets , and
' storm sewer), lot size and other necessary improvements will be constructed in
accordance with existing codes, ordinances and regulations adopted by the City
of Owasso and /or the Owasso Public Works Authority (Agreement attached as
Exhibit "C ").
C. Upon receipt of the concept drawing and agreement, the proposed water and /or
' wastewater system for the property will be modeled and evaluated by the Public
Works Department Engineering Division.

d. Concept drawing, agreement and model results will be submitted to the Authority
for consideration as an application for extension of service.
e. Petition for exception to the policy relating to serving utilities outside the
corporate limits of the City of Owasso may be submitted by the Applicant for
action by the Authority (Petition form attached as Exhibit "D ").
3. PRIOR TO COMMENCEMENT OF WORK: Before commencing any of the work
herein agreed upon, the Applicant shall, at his own expense, acquire and provide evidence of
such to the Director of Public Works good and sufficient right -of -way, either by perpetual
easements, ownership, or otherwise, of all lands necessary for the said facilities. Evidence that
the approved plans and the applicable permit fee have been forwarded to the Oklahoma
Department of Environmental Quality (ODEQ) for permitting is to be furnished. Authorization
to proceed with construction will be provided from the Director of Public Works or his
authorized representative following receipt of the ODEQ permit. The Applicant shall give notice
of the desire to commence with such construction to the Public Works Department, in writing,
prior to the commencement thereof.
4. PRE - CONSTRUCTION CONFERENCE: A pre - construction conference will be held
with Public Works Department Engineering Division personnel, the contractor for the project,
and any other interested utility companies that may be affected by the construction. A copy of
the contract for construction should be provided before or at the pre - construction conference.
This document will serve as the basis for determination of the value of the constructed facilities,
which will be added to the City assets upon acceptance of the project.
5. CONSTRUCTION: The Applicant shall, in good and first class workmanlike
manner, and at his own cost and expense, furnish all the materials, equipment and labor
required; and construct the said facilities together with all necessary appurtenances thereto, in
a manner conforming to the specifications, requirements and plans as approved by the Authority.
In no event shall such materials, and the installation thereof, be below the minimum standards
set therefor by the City of Owasso, Oklahoma. The Applicant agrees to hold the Authority
harmless against any liability for damages of claims by reason of such construction.
At completion of construction, a final inspection will be made by Public Works
Department Engineering Division personnel, a representative from Water distribution and /or
Wastewater Collections Divisions and the contractor. A list of corrective actions to be taken
prior to acceptance of the construction, if any, will be prepared at that time.
6. ACCEPTANCE: Upon completion of said work and any identified corrective actions,
the Public Works Department Engineering Division will prepare documentation for acceptance
of the project by the Authority.

The Applicant and /or Applicant's Contractor shall furnish a maintenance bond running
to the Owasso Public Works Authority in the amount of one hundred percent (100%) of the
construction Contract guaranteeing the said work for a period of one (1) year after its completion
and acceptance by the Authority.
7. INSPECTION OF WORK: At all times during the progress of said construction
work, the Authority shall have the right, at its own cost and expense, to inspect the materials,
workmanship and all parts of the construction of said facilities; and all materials furnished and
' work done shall be completed to the satisfaction of the Authority. Any material furnished or
work done not conforming to the specifications of the Authority for said material or work shall
be removed and replaced to the satisfaction of the Authority at the expense of the Applicant.
' 8. OWNERSHIP OF SYSTEM: Upon completion of the location, construction and
installation of the facilities same shall, by these presents, be dedicated unto the Authority by the
Applicant. Such dedication shall be understood to include warranty relating thereto by the
Applicant that the facilities located, constructed and installed are free and clear of any liens
and /or encumbrances, or any other interests possessed by others adverse to that of the
' Authority's, and precluding the Authority's full use and enjoyment of the facilities herein
dedicated. In that regard, Applicant covenants to defend the title to same, at its own expense,
if necessary. The Authority, by these presents hereby, under the foregoing conditions, accepts
Isuch dedication.
The facilities referred to herein and contemplated hereby upon completion in accordance
�■ with the terms and provisions hereof shall be the sole and exclusive property of the Authority.
■ Applicant and the persons to whom Applicant sell shall have no interest, right, title, or
ownership therein. Authority shall have the right to extend, improve, maintain, enlarge the
' same as it deems necessary, fix rates applicable thereto, change the same from time to time, and
adopt any and all rules and regulations to control, regulate, and govern the use of such facilities.
' 9. CONNECTION TO AUTHORITY SYSTEM: Upon completion of said facilities as
herein provided, and acceptance thereof by the Authority, and the performance by the Applicant
of all the requirements herein, the Authority agrees to permit the connection for said facilities
to the system of the Authority, such connection to be at the sole expense of the Applicant, but
under the supervision and direction of the Authority, and subject to its inspection.
' 10. AS -BUILT CONSTRUCTION DRAWINGS: Within sixty (60) days following
completion of said facilities herein provided and acceptance thereof by the Authority, the
' Applicant is to provide a complete set of construction drawings certified as -built by the design
engineer. A complete set of drawings is meant to include two (2) sets of blueline drawings, one
(1) set of reproducible drawings on mylar and Computer -Aided Drafting (CAD) file.

The following statement shall be considered to be the policy of the City of Owasso and the '
Owasso Public Works Authority relating to the access to, and extension of, municipal water and
wastewater service to properties outside the corporate boundary of the City of Owasso,
Oklahoma.
"ALL DEVELOPMENT AND CONSTRUCTION OF INFRASTRUCTURE (WATER, ,
WASTEWATER, STREETS AND STORM SEWER) IN ANY AREA OUTSIDE OF THE
CITY OF OWASSO'S CORPORATE BOUNDARY TO BE SERVED BY A MUNICIPAL
WATER MAIN LINE AND /OR WASTEWATER MAIN LINE (HEREINAFTER REFERRED
TO AS MUNICIPAL UTILITY SERVICES), MUST BE DONE IN ACCORDANCE WITH
ALL PRESENT AND FUTURE CODES, ORDINANCES, AND REGULATIONS ADOPTED '
BY THE CITY OF OWASSO AND /OR THE OWASSO PUBLIC WORKS AUTHORITY
WHICH WOULD BE THEN APPLICABLE TO SIMILAR CONSTRUCTION AND
DEVELOPMENT INSIDE THE CITY'S CORPORATE LIMITS. ■
MUNICIPAL UTILITY SERVICES MAY BE APPROVED AND EXTENDED AT THE SOLE
DISCRETION OF THE OWASSO PUBLIC WORKS AUTHORITY, WITHOUT THE
RESTRICTIONS OF THIS POLICY STATEMENT APPLYING, TO SUBDIVISIONS
LOCATED OUTSIDE THE CITY'S CORPORATE LIMITS, BUT HAVING EXISTING AND
FULLY OPERATIONAL INFRASTRUCTURE (WATER, WASTEWATER, STREETS AND
STORM SEWER) DEVELOPED AND CONSTRUCTED PRIOR TO JULY 15, 1997.
FOR SUBDIVISIONS COMPLETED SUBSEQUENT TO JULY 15, 1997, THE OWASSO
PUBLIC WORKS AUTHORITY, AT ITS SOLE DISCRETION, AND UPON SUCH TERMS
AND CONDITIONS AS MAY AT SUCH TIME BE IMPOSED, AND ONLY UPON
PETITION OF A MAJORITY OF THE RESIDENTS OF THE REQUESTING SUBDIVISION,
MAY APPROVE THE EXTENSION OF MUNICIPAL UTILITY SERVICES TO
SUBDIVISIONS OUTSIDE OF OWASSO'S CORPORATE LIMITS, PROVIDED THAT ALL
EXISTING INFRASTRUCTURE (WATER, WASTEWATER, STREETS AND STORM
SEWER) IS TOTALLY COMPLETED AND FULLY OPERATIONAL.
RULES, REGULATIONS AND PROCEDURES NECESSARY TO IMPLEMENT THIS
POLICY SHALL BE DEVELOPED AND DISTRIBUTED BY THE CITY MANAGER.
SUCH RULES, REGULATIONS AND PROCEDURES SHALL BE NOTICED TO THE CITY
COUNCIL."
