RE: Proposed. Deeds of Dedication -Bailey Ranch Golf Course
Initially, please accept. my apologies for this eleventh hour submission of a matter for your
consideration; however, due to the tinning of the submitted request to me as well as the
Thanksgiving Holiday a more timely submission to yourselves under the circumstances as
hereinafter will be more fully explained was virtually impossible.
By way of background, as you are aware, I am sure, pursuant to a Development
Agreement for Bailey Ranch Golf Club House among I{ourtis Properties, LLC, Larkin Bailey
Foundation under date of August 28, 1995, and the Owasso Public Golf Authority, proceeds from
a land sales transaction between 1C.aurtis 1?rvperties, LLC, as purchaser and Larkin Bailey
Foundation under date of August 28, 1995, as Se11or, are to be utilized t4 build a golf club house
facility to be dedicated to the Owasso Public Golf Authority. In accordance therewith, there is
presently pending the proposed land sales transaction the closing of same awaiting only action by
the City Cc~tutcil of the City of Owasso, Oklahotaxa, and the Trustees of the Owasso Public Works
Authority in the farm of providing deeds of dedication deemed necessary by attorneys for Kourtis
Properties, LLC, to provide for public access and public utility connections ove: portions of
Bailey Golf Ranch. to facilitate the residential development in the vicinity of the golf course. ,More
specifically, one Deed of Dedication from the City of Owasso, Oklahoma, to the public is to
enable connection between Phase Iz of Fairways with the proposed Phase III of Fairways. Such is
on the East side of the golf course. The nezrt Deed of Dedication is merely far purposes of
allowing connection between two tracts of what constitutes Phase IV of Fairways. It is important
to note that the Deeds of Dedication are from the City of Owasso, Oklahoma, to the public. As
such, the City, as custodian of all public progeny lying within the corporate limits of the City,
remaia~s in control of the dedicated portions. Additionally, the approval of the Owasso Public
Works ,Authority is being sought due to the fact that the Owasso Public Works Authority is the
Lessee of the Gaff Course pursuam to Lease Agreement between the City of Owasso, Oklahoma,
and the Owasso Public Works Authority.
After havinzg reviewed this matter and discussing such with representatives of Kourtis
Properties, LLC, as well as the Larkin Bailey Foundation under date of August 28, 1995, it is my
recamrnendatiorr that the City Council of the City of Owasso, Oklahoma, as well as the Trustees
of the Owasso Public Works Authority approve the proposed Deeds of Dedication. I have
attached copies of such proposed Deeds of Iaedicati~n with this memorandum.

The Owasso City Council met in regular session on Tuesday, November 18, 1997 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, November 14, 1997.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
WORKERS' COMPENSATION CLAIM AGAINST THE CITY OF OWASSO
BY KENNETH YOUNT.
Ms Guthrie presented the item. She said that Officer Yount was injured in an automobile
accident on September 25, 1996, while riding in a Tulsa County sheriff's vehicle assisting Tulsa
County. Officer Yount has reached the maximum medical improvement and has been evaluated
as having a 10% disability rating. All parties involved have agreed that this disability should
be settled by Joint Petition Agreement, which will close the claim. Dr Bode moved, seconded

by Dr Standridge, to approve a negotiated settlement by joint petition with Officer Kenneth
Yount wherein the city would pay $9231.39 for injuries received in an accident on September
25, 1996, and that such payment be in return for complete elimination of future medical claims
against the city of those injuries, and to authorize payment for the claim. She further moved
to accept a payment of $3293.91 from Landmark American Insurance Company in payment of
a subrogated claim relating to the injuries.

Items #9 & 10 were explained together. Mr Rooney said that the 1997-98 budget contains an
appropriation for the construction of a restroom facility at the Sports Park. Bid specifications
were developed and available to prospective bidders in late June. Only one bid was received,

and that bid exceeded the budgeted amount. Therefore, the City Council rejected the bid. New
bid documents with revised specifications were made available to prospective bidders in October.
Five contractors submitted bids, with amounts ranging from $85,405 to $106,553. The lowest
bid exceeds the budgeted amount by $20,405. Two possible options are available concerning
the construction of the restroom: downsize the restroom, which would require a new set of
drawings and a rebid of the project; or allocate the additional funds necessary to construct the
facility as bid. The additional funds could be allocated to the project through the availability of
excess, unbudgeted revenues that have accrued within the Capital Improvements Fund. The staff
recommended that the contract for the construction of a restroom facility at the Sports Park be
awarded to Pettijohn Construction in the amount of $85,405.
Ms Bishop explained that, during the budget process, the staff estimates revenues based on
previous collections and sales tax trends. That generally results in an underestimate of the actual
year-end revenue. At the end of the 1996-97 fiscal year, the ending Capital Improvements fund
balance was $7995 greater than projected, and actual collection of revenue was $10,271 more
than projected. The accrued interest on the fund balance was $20,000 more than budgeted,
through October 1997. The total additional revenue available to the fund is $38,266. In order
for a contract to be awarded for the construction of a restroom facility, a supplemental
appropriation to the Sports Park line item is a legal requirement. The staff recommended
Council action to amend the FY 1997-98 Capital Improvements Fund budget by increasing
estimated revenues by $38,266 and increasing appropriations to the Sports Park line item by
$20,861, the amount by which the Sports Park restroom bid exceeds the budget.
The Council voted on item #10 and then on item #9.

Capital Improvements Fund budget, increasing estimated revenues by $38,266 and increasing
expenditures in the Sports Park line item by $20,405.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A BID
FOR THE PURCHASE OF VEHICLES FOR THE STREET DEPARTMENT
AND ENGINEERING DEPARTMENT.
Mr Carr said that bid documents were sent to fourteen potential vendors on October 1 for the
purchase of the above-named vehicles. All bids received exceeded the budgeted amount. After
analyzing the bids, staff believes the purchases should be delayed until the state bid list is
available (around December 10th), and recommends the rejection of all bids. Dr Bode moved,
seconded by Mr Wilken, to reject all bids received for the purchase of vehicles for the Street
Department and the Engineering Department.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #97-12 A RESOLUTION STATING THE POSITION OF THE
OWASSO CITY COUNCIL REGARDING THE STATE HIGHWAY 20
CORRIDOR STUDY BEING CONDUCTED BY THE OKLAHOMA
DEPARTMENT OF TRANSPORTATION.
Mr Ray said that the Owasso Chamber of Commerce and the Owasso Economic Development
Authority have adopted positions regarding the future alignment of State Highway 20. That
position statement by the Chamber and Resolution adopted by the OEDA is that the future
alignment of the highway should, within the Owasso fenceline, be consistent with its existing
alignment. Resolution #97-12 takes the same stand as a position of the Owasso City Council.
Mr Wilken moved, seconded by Dr Standridge, to approve Resolution #97-12, adopting a
position that the alignment/route of SH20 should remain on its existing alignment and that the
construction of improvements to the highway should not be delayed beyond the current schedule
of funding.

Councilor Helm asked if there are any plans to put any kind of screening fence along the north
and east sides of Fairview Cemetery. Mr Ray showed the Council a computer rendering of a
proposed cement block fence, which would screen the houses from view and would also
eliminate some of the noise from pets. Councilor Helm also asked if special time could be set

Thursday, November 13, 1997
The Owasso City Council met in emergency session on Thursday, November 13, 1997 in the
Lower Level Conference Room at City Hall.
ITEM 1: CALL TO ORDER AND ROLL CALL.
Mayor Barnhouse called the meeting to order at 8:26 p.m. Councilors present: Mary Lou
' Barnhouse, Mayor; Tracy Standridge, Vice Mayor; Michael Helm, Councilor; Denise Bode,
Councilor; Mark Wilken, Councilor. Staff present: Rodney J Ray, City Manager; Ronald D
Cates, City Attorney; Tim Rooney, Community Development Director; Robert Carr, Public
Works Director; Sherry Bishop, Director of Finance.
A quorum was declared present.
ITEM 2: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
OWASSO SIXTH GRADE CENTER.
Mr Ray presented the issues regarding the Sixth Grade Center, more specifically the flow of
traffic and the safety of the school children. He explained that the school is not prepared to
participate in no left turns off of N 129th E Ave as agreed to by Mr Johnson at the Planning
t Commission meeting. Mr Ray said that he is prepared to deviate from the Planning
Commission's requirements if a method can be worked out so that there is a smooth traffic flow,
and safety of school children in the area. Councilor Bode asked what the repercussions would
~ be if the Council deviated from the Planning Commission decision. Mr Cates explained the
issue further and said that the City Council may give the City Manager the authority to take
whatever action is necessary regarding the Sixth Grade Center. Councilor Bode moved (with
regret, but out of a desire to allow the school to open), seconded by Councilor Wilken, to
authorize the City Manager to take all steps necessary to facilitate the opening of the Sixth Grade
Center by ensuring the safety of school children and the smooth flow of traffic in the area.

AN ORDINANCE CLOSING TO THE PUBLIC USE A PORTION OF A
UTILITY EASEMENT LOCATED WITHIN LOT EIGHT (8), BLOCK ONE
(1), THE FAIRWAYS AT BAILEY RANCH ADDITION, AN ADDITION
TO THE CITY OF OWASSO, TULSA COUNTY, STATE OF
OKLAHOMA, AND RETAINING UNTO SAID CITY OF OWASSO,
OKLAHOMA, THE ABSOLUTE RIGHT TO REOPEN SAME WITHOUT
EXPENSE TO THE MUNICIPALITY, AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and expedient
to close to public use a portion of a certain utility easement;
WHEREAS, said utility easement is described as follows:
The westerly 4' of the easterly 11' utility easement of Lot 8, Block 1, The Fairways
at Bailey Ranch Addition, from a point at the 25' building line for a distance of 40
feet.
WHEREAS, pursuant to Title II, Oklahoma Statutes, Section 42-110, the only holders
of a franchise or purported holders of a franchise that may purport to have a special
right or privilege to use said utility easement are Public Service Company of
Oklahoma, and/or Oklahoma Natural Gas Company, and/or Southwestern Bell
Telephone Company, and/or TCI Cable Television Company; and,
WHEREAS, the above holders of franchise or purported holders of a franchise that
may purport to have a special right or privilege to use said utility easement have
waived their objections to the closure of said easement, if any.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT,
Section 1. The following described utility easement, be, and the same is hereby closed to
the public use, to-wit:

Fairways at Bailey Ranch Addition, from a point at the 25' building line for a
distance of 40 feet.
Section 2. The municipality shall retain the absolute right to reopen the public way or
easement without expense to the municipality. Closing of the public way or
easement shall not affect the right to maintain, repair, reconstruct, operate or
remove utility, public service corporation, or transmission company facilities
of service therein, nor shall a closing affect private ways existing by operation
of law unless released in writing by the owners thereof.
Section 3. All ordinances or parts of ordinances in conflict herewith be, and the same are
hereby expressly repealed.

BACKGROUND•
Mr. Greg Simmons of Simmons Homes has requested a closing of a portion of a utility easement
located within Lot 8, Block 1, The Fairways at Bailey Ranch Addition (10215 E. 89th Street
North). The portion of the easement to be closed is described as the westerly 4 feet of the
easterly 11 foot utility easement, from a point beginning at the 25' building line for a distance
of 40 feet. A case map is enclosed for your information and review with the proposed portion
of the utility easement to be closed shaded in.
The subject property is currently developed with asingle-family residence. Area utility
companies reviewed the easement closing request at the October 29, 1997 Technical Advisory
Committee meeting and had no comments regarding the request. City staff has also reviewed
the request and has no concerns.
The Planning Commission reviewed the request at their November 11, 1997 regular meeting and
unanimously recommended approval of the easement closing request. If approved by the Ciry
Council, the applicant would still need to process a case through district court to permanently
close on the city's right to reopen the easement.
RECOIVIlVIENDATION:
Staff recommends approval of the easement closing request, closing the westerly 4 feet of the
easterly 11 foot utility easement, from a point beginning at the 25' building line for a distance
of 40 feet.

BACKGROUND
Mr. Allen Robinson has submitted a petition to the Ciry of Owasso requesting detachment of a
portion his property from the Ciry Limits of Owasso. The subject property is undeveloped and
is located at the extreme southern boundary of the existing city limits of Owasso and is zoned
IL (Light Industrial). The subject property is bordered on the north by additional property zoned
IL, while further north lies Worley's Nursery also zoned IL. The subject property is also
bordered to the south and west by IL zoned property, while farther west lies AG (Agriculture)
property. The subject property is bordered on the east by the Owasso Expressway. An area
map is attached for your information and review.
The City of Owasso has been in negotiations with the applicant to obtain right-of--way for the
proposed extension of S. Fifth Avenue from the National Steak and Poultry facility to the service
road. As a portion of that negotiation process, the applicant expressed a desire to construct a
billboard on his property, more specifically, at the location described in the detachment request.
Because the subject property is on the southern boundary of the city limits and because
billboards are not permitted in the Ciry of Owasso, staff advised the applicant to seek a
detachment request from the city rather than a Variance from the Board of Adjustment. Quite
simply, a billboard would be permitted on the neighboring property to the south (outside the city
limits) and to extend that ability eighty (80) feet to the north was more desirable than opening
the door for additional billboards throughout the city if the Board of Adjustment were to grant
a Variance.
Notification of the detachment request was published in the Owasso Reporter and is attached for
your information and review. The Technical Advisory Committee reviewed this request at their
October 29, 1997 meeting. At that meeting, area utility companies and staff are afforded the
opportunity to address any problems or concerns they have with the detachment request. No
comments opposing the request for detachment were received at that meeting.
While the Ciry of Owasso policy and procedure regarding annexation does not contain any
requirements for action on a detachment request from the Annexation Committee, staff felt it
would be more consistent to forward this type of request to the Annexation Committee. The
Annexation Committee reviewed this request at their November 10, 1997 special meeting and
unanimously recommend approval.
The Planning Commission reviewed the detachment request at their September 11, 1997 regular
meeting and also unanimously recommended approval. ^+~

BACKGROUND:
The project is located between 76th Street North and 86th Street North, about one-fourth mile
east of Mingo Road (see attached location map).
The Fairways II water and sanitary sewer systems were accepted by Council on November 5,
1996.
Designs for the streets and storm drain system were reviewed and construction inspected by
Public Works personnel.
FINAL INSPECTION
Public Works personnel held final inspections with the contractor on August 26, 1997 and all
punch list items identified during the inspection (see attached) have been completed.
The developer's contractors have provided aone-year maintenance bond for the storm drain
system and atwo-year maintenance bond for streets. The bonds will become effective upon
Council acceptance of the work (see attached).
RECOMMENDATION:
Staff recommends acceptance of the Fairways II streets and storm drain system.

BACKGROUND:
The City's (including OPWA and OPGA) insurance policy for property, buildings, contents, and
equipment will expire on January 20, 1998. Each year, equipment, contents, property and
buildings are reviewed so that accurate listings and values can be insured. That inventory is then
analyzed, tabulated and furnished to an independent agent (Moe Hogan, Hogan Insurance,
Owasso) to obtain quotes from companies capable of insuring our needs. This year's audit
resulted in a total insurance need of:
1. scheduled equipment listing of $ 658,939
($445,692- Golf and $ 213,247- City and OPWA)
2. total property, building and contents listing of $ 8,612,177
~ ($565,875- Golf and $ 8,046,302- City and OPWA).
The property and building coverage amount includes not only building structures, but such things
as lights and poles at recreation facilities, bleachers, park shelters, sirens on poles, radio
~ antenna, traffic lights, lift stations, water tower tank, etc. The contents coverage covers such
things as desks, supplies, computers and small hand tools. The scheduled equipment listing is
only those items that have a value over $ 500 and cannot be considered as contents.
Three insurance companies provided the City with quotes for this coverage. All three are well
' known companies who have provided this type coverage to businesses for many years. The
companies submitting quotes, in addition to the current carrier Hartford Insurance Company, are
Hanover Insurance Company and National American Insurance Company.

In a memorandum to the City Manager (attached) dated November 7, 1997, quotes received
were analyzed in detail. All quotes were for the same coverage and the same deductibles.

ANALYSIS:
Although the City has done business with Hartford for a number of years, and have been
satisfied with their performance; National American Insurance will provide the same coverage
at a premium that is $ 11,300 lower (34%) than the quote from Hartford, the current carrier.
RECOMMENDATION:
Staff recommends Council approve acceptance of the offer of insurance coverage from National
American Insurance Company for 1998-99 in the amount of $ .19 per hundred for building and
property coverage and $ .80 per hundred for equipment coverage, and authorize payment of
same.

BACKGROUND:
The City's insurance policy for property, buildings, contents, and equipment expires January 20,
1998. Each year, inventory listings of property, buildings, contents and equipment are reviewed
so that accurate listings and values can be insured. That inventory is then analyzed, tabulated
and furnished to an independent agent (Moe Hogan, Hogan Insurance, Owasso) to obtain quotes
from companies capable of insuring our needs. This audit resulted in a total insurance need of:
1. A Scheduled equipment listing of $ 658,939
($445,692- Golf and $ 213,247- City -including OPWA)
2. A Property, building and contents listing of $ 8,612,177
($565,875- Golf and $ 8,046,302- City -including OPWA).
The property and building coverage amount includes not only building structures, but such things
as lights and poles at recreation facilities, bleachers, park shelters, sirens on poles, radio
antenna, traffic lights, lift stations, and water tower tanks, etc. The contents coverage covers
such things as desks, supplies, computers and small hand tools. The scheduled equipment listing
is only those items that have a value over $ 500 and cannot be considered as contents.
Three insurance companies provided the City with quotes for this coverage. All three are well
known companies who have provided this type coverage to businesses for many years. The
companies submitting quotes, in addition to the current carrier Hartford Insurance Company, are
Hanover Insurance Company and National American Insurance Company.

During 1997-98 the City paid $ .242 per hundred dollars of coverage for property, buildings
and contents coverage and $ 1.50 per hundred dollars of coverage for equipment coverage from
Hartford Insurance. Their renewal rate for coverage is $ .27 and $ 1.39 respectively.
The quote received from National American Insurance Company (who also furnishes the City's
general liability coverage) is $ .19 per hundred dollars of coverage for property, buildings and
contents coverage and $ .80 per hundred dollars of coverage for equipment coverage, $ 11,380
less than the quote from the existing carrier, Hartford Insurance. The reason that the National
American Insurance Company's quote is much less than the Hartford's quote is that a discount
credit was applied by National American due to creating a multiple business products package
(General Liability and Property, Buildings, Contents and Equipment). It was also mentioned
that we could expect the same type discount (multiple business) from National American for the
General Liability product, should we choose to renew with them next year.
Hanover Insurance Company's quote is very similar to the National American Insurance quote.
There is only a $161 premium difference between National American and Hanover. However,
in light of the application of a discount for multiple business against future General Liability
premiums, and the fact the quote is $ 161 more than National American, further consideration
does not appear to be warranted.

The Building and Equipment policy will expire January 20, 1998. This policy covers all Ciry
(including golf) property and equipment. Hartford Insurance Company currently provides this
coverage at an annual premium of $ 28,229, (City $ 20,449 and Golf $ 7,780).
A listing of buildings and equipment-has been furnished to department directors. They have
been asked to review for values of same and to determine that appropriate equipmentlbuildings
are listed. Any changes will be reviewed. That information is due on October 1, 1997. After
a review of that information, determination of values for the coming year will be completed.
I would expect to "shop" this coverage with at least two other carriers for 1997-98 The
renewal information and any additional quotes received will be reviewed and my
recommendation- will be submitted to you on or before November 7, 1997.
