Recognition will be given to members of the Owasso Fire Department for outstanding
response to a recent rash of dangerous grass fires, to members of the Owasso Police
Department for their efforts in developing and implementing a certified reserve academy,
and to members of the Community Development Department for their efforts on behalf of
the community in constructing a display for the Metropolitan Tulsa Home and Garden
Show.

SUBJECT: ELM CREEK PARK CLEAN -UP ON FEBRUARY 24, 1996
DATE: March 5, 1996
In November of 1995, Mr. Warren was contacted by Miss Brandi Weeks regarding a project she
needed to perform in order to earn her Girl Scout Gold Award. Miss Weeks selected a clean -up
effort for Elm Creek Park. This clean -up effort was performed on February 26, 1996.
Miss Weeks navigated Elm Creek Pond, with the help of Scott Sharitt and Matt Lotter (both
have earned merit badges in rowing), and removed three large trash bags of debris. In addition,
all materials needed for her clean -up were donated and Elisa Norman, an Owasso High School
student, was the lifeguard on shore.
Miss Weeks accomplishments have had an outstanding result on Elm Creek Park. The pond is
noticeable cleaner and numerous area residents have commented positively regarding its current
condition. Miss Weeks will finish her project by painting the large slide at the park.
I would like to recommend that Miss Weeks receive formal recognition from the Owasso City
Council and Mr. Warren at the March 19, 1996 Council meeting. Please let me know what I
can do to assist you with this agenda item.

Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ,
REPORT FROM THE CHAIR OF THE CHARTER REVIEW COMMITTEE
Mr Mark Wilkin presented the report of the Charter Review Committee. This citizens
committee has been meeting for several months to review the city charter. Through this
process, two areas were identified for proposed change. The first change related to Article 4,
Section 1 of the Charter. The proposed revised language would provide the City Council with
some oversight in the hiring or firing of the City Treasurer if such action is recommended by
the City Manager. The second item is a proposed ordinance change whereby City Council
approval would be needed for purchases and bidding in excess of $5000. The current limits are
$1000 for purchases and $2000 for bidding. A proposed ordinance was drafted by the City
Attorney and presented to the Council. Mr Helm moved, seconded by Mr Ramey, to approve
Ordinance #520, an ordinance amending the City of Owasso Code of Ordinances by increasing
the purchasing and bidding limits to $5000.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
AGREEMENT WITH THE LOCAL GOVERNMENT TESTING
CONSORTIUM FOR THE PURPOSE OF SERVING AS A THIRD -PARTY
' ADMINISTRATOR TO ASSIST IN COMPLIANCE TO FEDERALLY
MANDATED RANDOM ALCOHOL AND DRUG TESTING.
' Random alcohol and drug testing of all employees who have commercial drivers license status,
and all safety sensitive employees has been federally mandated by the Department of
Transportation. The city of Owasso has 25 employees falling into this category. A consortium
has been established to administer this regulation. The cost for the consortium to perform this
service is significantly less than an independent testing facility. Mr Ramey moved, seconded
by Mr Helm, to enter into an agreement with the Local Government Testing Consortium to serve
as a third -party administrator for federally mandated random alcohol and drug testing of all
safety sensitive and commercial drivers license status employees for a period of one year at a
cost of $90 setup fee and $32.50 for each employee enrolled, for a total cost of $902.50; and
authorization for payment.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
AGREEMENT FOR MUNICIPAL STREET LIGHTING SERVICE.
On July 1, 1987, the City Council approved a contract with Public Service Company of
Oklahoma for the purpose of providing street lighting services to the city of Owasso. No
changes have been made to the contract since it was executed. A resolution was approved in
September 1991 authorizing additional street lighting to be added to the contract. An agreement
has been drafted and reviewed covering the period July 1, 1996 through June 30, 1997 in order
that both entities can accurately account for billing and placement /relocation of street lights. The
rates for municipal street lighting are set by the Oklahoma Corporation Commission, with the
amount budgeted for 1995 -96 at $18,000. Mr Ramey moved, seconded by Mayor Burris, to
op approve an Agreement and authorization for payment for Municipal Street Lighting Service with

Public Service of Oklahoma for the period July 1, 1996 through June 30, 1997, and
authorization for the Mayor to execute the document.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #96 -04. AMENDED. A RESOLUTION MANDATING
EMPLOYMENT AND BENEFICIARY INFORMATION BE FURNISHED TO
THE OKLAHOMA DEPARTMENT OF COMMERCE BY PRECISION
COMPONENTS INC.
The City Council adopted Resolution # 96 -04 at the February 20, 1996 meeting, which provided
for the tracking of employment at Precision Components and the reporting of employment levels
to ODOC. This was a requirement to obtain a Release of Funds for the project. ODOC has
made a requirement that the words "and the project closed out" be added to the last line of the
resolution. Resolution #96 -04, Amended complies with this requirement. Mr Ramey moved,
seconded by Mayor Burris, to approve Resolution #96 -04, Amended.

BACKGROUND:
In November 1992, Mr Pat Conley with Equipment One Rental Company requested the Fire
' Department to perform an inspection of his business for the purpose of installing an LPG tank.
After completion of the inspection, Mr Conley was notified that the proposed site was acceptable
and conformed to National Fire Protection Association (NFPA) requirements.
In December 1992, Mr Conley filed a request to increase the size of the LPG tank from one
thousand (1000) pounds to five hundred (500) gallons. Mr Conley's request was denied due to
the fact that he was unable to comply with all the NFPA requirements.
In January 1993, Mr Conley refiled his request to allow for the installation of an LPG container
larger than one thousand (1000) pounds.
In March 1993, Mr Conley was granted approval to install a five hundred (500) gallon L.P.G.
tank. The approval contained the following restrictions:
1. Must be approved by State LPG Administrator
r 2. Must be in compliance with Owasso Code of Ordinances

COMMENTS:
Currently Equipment One is located at 7808 Owasso Expressway. Equipment One is in the
process of constructing a new and larger facility at 11421 E 80th St N. Equipment One
submitted plans for their new building. They also requested to increase the LPG container from
five hundred (500) gallons to one thousand (1000) gallons.
The Fire Department has conducted a review of NFPA requirements. Also, we have completed
an impact study of surrounding cities. The result of our impact study indicated that if the
applicant complied with NFPA 58 and all safety measures were completed, one thousand (1000)
gallon LPG containers are approved. Also, the state LPG Administrator has reviewed '
Equipment One's request and has approved the installation of a larger LPG tank contingent on
compliance with City Ordinances.
RECOM IENDATION:
After careful review of NFPA requirements and the approval from State LPG Administrator, we '
recommend approval of ordinance #521 increasing from 500 gallons to 1000 gallons the
maximum capacity of an LPG container lawful within the corporate limits.

The Owasso Code of Ordinances (Building Regulations and Codes Chapter 5 Section #501 -503
and related Ordinance #178) allows the installation of propane tanks within the City of Owasso.
Such installation must 11 conform to the restrictions contained within the Code of Ordinances
and 2) be approved by tMe state's L.P.G. Administrator prior to installation.
Equipment One has made application to the City of Owasso for permission to install one (1,000
pound capacity) propane! tank at 7808 N. Mingo Valley Expressway. Initial review of the site
and the application indicates that the request will meet the applicable restrictions of the
ordinance. A final inspection, however, must be accomplished after installation to insure
compliance.
After the City receives notice of installation and approved confirmation from the state L.P.G.
Administrator, a final in lion will be conducted by the Fire Department. Ordinance #502
does allow the installation of such tanks, therefore, the city cannot and will not prohibit such
installation provided thl requirements of the ordinance are met. At this point, the Fire
Department has informed this office that the proposed site is acceptable and can meet these
requirements.

In March of 188 we requested the council approve passage of
ordinance 378. i The ordinance consisted
of increasing, Liquefied
Petroleum Gas (L.P.G) containers from two hundred fifty (250)
pounds to one thousand (1000) pounds. This change was requested
by U -Haul Trailers.
The owners stated that it was not financially
feasible to install L.P.G containers any
smaller than one thousand
(1000) pounds. 'After carefully reviewing National Fire Protection
Association (N.P.P.A.) standard 58, the Fire Department recommended
approval of ordinance 378.

of the standards

standards are updated. Depending on the code or standard, some are

updated annually. The N.F.P.A. standard dealing with L.P.G was
updated in 19921. The update now allows for the installation of
five hundred (560) gallon L.P.G containers to be utilized. Also,

SUBJECT: RESOLUTION x{96 -06 ESTABLISHING MINIMUM STREET WIDTHS

BACKGROUND:
The proposed resolution will, if adopted, clarify the required width of residential streets
constructed within Owasso. The purpose of the resolution is to establish a clear and enforceable
standard for street width that leaves no need for interpretation. The City Attorney has indicated
that the existing standard is of questionable enforceability because of the lack of a single
_ standard and because we are requiring the use of a set of standards that have not yet been
officially adopted (but are required by the staff). Additionally, the Attorney has indicated that
' we cannot enact resolutions or ordinances that are retroactive (ex post facto laws are prohibited).
Therefore, the resolution establishes an effective date for enforcement as of March 19, 1996 and
clearly requires any subdivision platted as of that date to strictly comply, without exception, with
the resolution requirements.

This resolution and its concept was developed during discussions with Councilor Barnhouse and
reflects a need to clearly define the street width standards for those subdivisions now in the
planning stage. The ordinance does not address existing subdivisions or subdivisions in the
process of construction. However, it does address the need for clarification of the standard for
street widths and uses as a reason for that need the clarification of a standard of present
questionable enforceability.
' Mr Carr and Mr Cates have developed the language and drawings for the resolution, and have
attached such for your review.
' The proposed resolution firmly establishes twenty-six (26) feet as the standard for minor
residential streets, measured inside -of -curb to inside -of -curb.

' WHEREAS, pursuant to the provisions of Part 14 - Streets and Public Works, Chapter 7 -

A reduced copy of the Double Oaks III subdivision plat is attached for your information and
review, as well as the site plan for the dwelling that has been constructed on the subject
property.
The request for easement closing was sent to the Owasso Technical Advisory Committee via
facsimile on March 5, 1996. All utility companies, with the exception of PSO, have responded
that they have no objections to the request as they have no utilities located within that portion
of the easement. PSO commented that they had no utilities in the area but would rather close
only a 10' portion of the easement that is effected by the encroachment, rather than the entire
length of the property. A site plan, depicting the exact area where the utility easement would
be closed, is attached for your information and review.
All side yard setbacks have been met by the applicant and the structure is in compliance with
the property development standards of an RS -3 (Residential Single - Family High Density) zoning
district. The Planning Commission reviewed this request at their March 12, 1996 regular
meeting and recommended approval.
If the Council approves the easement closing request, an ordinance formally adopting your
actions will be presented to you at the April 2, 1996 meeting.
RECOMMENDATION:
Staff recommends approval of the easement closing request, closing the south 10' of the north

' Please place on the agenda of the next Planning Commission meeting the following
request for consideration and action:
' The vacation of the western most 1 foot of the eastern 11' utility
easement contained within Lot 7, Block 2, Double Oaks III, an
addition to the City of Owasso, Oklahoma.
The home constructed on this lot is encroaching approximately 5 to 6 inches into this
easement. No utilities are located within this portion of the easement and all property
development setbacks are currently, and would continue to be, in compliance with the
City of Owasso.

SUBJECT: FINAL ACCEPTANCE - NSP ROADWAY AND UTILITY
IMPROVEMEN'T'S (YOCHAM ENTERPRISES)
DATE: March 14, 1996
BACKGROUND:
On November 7, 1995, Council awarded a contract for construction of roadway and utility
improvements to serve NSP to Yocham Enterprises, Inc. in the amount of $180,772.74. The
project consisted of an extension of 5th Avenue to the east property line of NSP, 2,638 LF of
8 -inch water line, and 403 LF of sanitary sewer lines. The project was funded by the Oklahoma
Department of Commerce (ODOC) and the Oklahoma Department of Transportation (ODOT).
The Oklahoma Department of Environmental Quality reviewed and approved the utility plans
' on December 21, 1995. Copies of the water permit No. WL000072950922 and sewer permit
No. SL000072950923 were filed January 29, 1996 with the Public Works Department.
' The notice to proceed was issued on December 6, 1995 with a stated 60 -day time of completion.
Work was completed on February 23, 1996. Additional days were required to complete the
project due to documented weather delays. All punch list items have been completed (see
attached).
' MAINTENANCE BOND EXTENSION:
On Saturday, February 10, 1996, the contractor started paving the street. The City was not
advised of this anticipated schedule; therefore, the project inspector was unable to observe and
verify conditions of the base material prior to and during paving.
Base stabilization that was previously completed and tested had been damaged by wet weather
conditions and vehicle traffic. Compaction tests performed on February 9th did not verify all
base had been adequately restablized. Should our inspector have been present, it may have been
rpossible to direct testing to specific locations prior to paving to insure adequate base preparation.
Additional subgrade tests were requested by staff and Yocham had these tests performed. All
or
tests passed at the indicated locations.
Based upon these problems, City staff requested Yocham extend the maintenance period for
paving for two (2) years from the date of acceptance (the original maintenance bond included

in the contract provides for one (1) year from the date of acceptance). Staff believes the
extended time is warranted to insure the workmanship, since no inspection was conducted. ,
FINAL CONSTRUCTION COSTS:
Staff has monitored the progress of work and overall costs as work has been conducted. The
original contract amount of $180,772.74 consisted of $58,326.92 for water lines, $13,226.22
for sanitary sewer lines, and $109,219.60 for roadway improvements. In the submitted final pay
request, the total for all work completed is $180,812.74. A resultant increase of $40.00 was
submitted for the project.
The difference in cost is due to quantity adjustments between those originally estimated by the
design engineer and the actual materials required during construction. Specifically, one
additional fire hydrant extension was necessary and two less 1 -inch corporation stops were
needed to complete the project.
FINAL PAY RE U ST•
A punch list has been prepared and all items have been completed on the project. In the final
pay request, Yocham Enterprises has invoice for the estimated quantities of asphalt pavement
and curb and gutter when our records indicate more quantities were used in those items. The
total pay request is $65,531.02, consisting of $47,449.75 in unit price items and $18,081.27 in
retainage (10% of the submitted contract pay estimates).
FUNDING SOURCE•
Funds are available in the grants from the Oklahoma Department of Commerce (ODOC) and the
State of Oklahoma Department of Transportation (ODOT) which totaled $611,516.00.
RECONIlVIENDATION:
Staff recommends Council acceptance, release of retainage and authorization for final payment
to Yocham Enterprises, Inc. in the amount of $65,531.02 for the NSP roadway and utility
improvements.

REQUEST FOR APPROVAL OF MOWING CONTRACTS

For the past six years, the City of Owasso has utilized private sector contractors for the
purpose of providing mowing services during the summer growing months. The program
was developed to privatize the service and provide support so that city crews can continue to
carry out their job assignments.
Staff evaluation of the program indicates that it continues to be cost - effective. We have
continued to make progress on other projects (i.e. street repair, drainage ditch renovation and
small construction projects). The use of these private sector contracts have continued to
provide the citizens of Owasso with a more efficient delivery of services. The use of full -
time employees to perform seasonal mowing is reduced, allowing for more efficient response
to the needs of both the Street and Parks Departments.
By continuing the privatization of mowing in specified areas, the city full -time work force is
able to attend to the other street right -of -way mowing and seasonal maintenance needs that
must be accomplished during the spring, summer and fall.
There are four criteria used to evaluate the mowing program: quality, timeliness, cost and
citizen reaction. Historically, privatized mowing has met or exceeded our expectations in
each of these areas. An annual review of the program is used to make adjustments to the
program in order to maintain effectiveness.
BID ANALYSIS:
The 1996 mowing bid packages were sent to twenty (20) perspective mowing contractors.
Nine mowing contractors placed bids which staff believe are very competitive.

The 1996 mowing bids for the parks had no increase and the total remains at $525.00 per
mowing. The Parks mowing season is eighteen (18) mowings. Total cost for the season
$9,450.00.
The 1996 mowing bids for the easements, medians and right -of -way areas had only a slight
increase of $116.20 to $1,145.00 per mowing (an increase of $97.20 for the mowing
season). The mowing season calls for six (6) mowings. Total cost for the season will be
$6,870.00.
The total expense for all awarded contract mowing of the parks, medians and easements is
$16,320.00.

Mowing Contracts
ADDITIONAL AREAS:
In 1995, mowing of the U.S. Highway 169 right -of -way was awarded to Earth Enterprises
for a bid of $1,100.00 per mowing. Unfortunately, Earth Enterprises was unable to perform
as required and the responsibility fell back to City employees.
City employees were able to mow this large area for approximately $1,370.00 per mowing.
The cost includes salaries, benefits, fuel and repairs to mowing equipment.
Bids again were taken for U.S. Highway 169 in 1996 in an attempt to privatize the mowing.
Three (3) bids were received for this area. The lowest bid was $2500.00 per mowing.
A summary comparison of U.S. Highway 169 mowing costs is as follows:
Analysis of the above costs indicates it is not cost - effective to privatize mowing the U.S.
Highway 169 right -of -way in 1996. City personnel will continue to mow this area.

*PARKS: Rayola, Elm Creek, 86th Street and Ator Heights
Mow the entire park area with a riding lawn mower or hand mower. "Brush Hog" type mower
shall not be used. All grass should be cut 1 to 11f2 inches in height.
Mow within four inches (4 ") of any obstruction; fences, trees, poles, etc. Creeks and
embankments should be mowed per agreeable distance from the water.
The city crews will be responsible for "weed - eating" all ditches; around all trees, light poles,
picnic tables, and fences; and steep hills and slopes. It is the intent of the City to have the
"mowing contractor" mow as close to all structures, fences, trees, and drainage ditches as is
possible.
The City is requiring the parks be mowed once every ten days.
No mowing is to be done on the weekends (from 6:00 p.m. on Friday until 8:00 a.m. on
Monday.
The walking /jogging trail(s) shall be kept free of grass clippings or other yardwaste.
•EASEMENTS: Ator Heights Utility; El Rio Vista Drainage; Three Lakes Drainage;

SUBJECT: FINAL PLAT FOR THE SUMMIT AT SOUTHERN LINKS

BACKGROUND
The City of Owasso has received a request to review the final plat for The Summit at Southern
Links, an addition to the City of Owasso. The Southern Links development is located south of
E. 86th Street North, and is best described as the residential development surrounding the
southern portion of the golf course. The subject property is zoned PUD (Planned Unit
Development) and allows for several different size residential lots. No commercial, office, or
multi - family development is included within this portion of the PUD.
The platting of Southern Links has been divided into several portions, two of which have already
received City Council approval. The final plats for The Estates and The Village at Southern
Links were approved in April of 1995. Copies of these plats are attached for your information
and review. The preliminary plat for The Summit at Southern Links was approved by the
Planning Commission in December of 1994. The final plat for the Summit was approved by the
Planning Commission in March of 1995.
The final plat for The Summit at Southern Links was reviewed by the Technical Advisory
Committee at their March 29, 1995 meeting. At that meeting, the developers and their engineer
(CH2M Hill) were provided with a list containing all of the staff corrections regarding the plat.
This list is attached for your information and review. In addition to that list, several utility
company representatives as well as the Owasso Golf Authority also added easement requests and
covenant comments regarding the plats. The following are a list of comments from the
Technical Advisory Committee for the Summit:

1. A 10' utility easement needs to be added within the building line along the
north side of the street and along each cul -de -sac.
r, 2. Remove overhead provisions for East and South boundaries.
i 3. A 5' utility easement needs to be added along the west lot line of Lot 5,
Block 2.
4. A 5' utility easement needs to be added along the west lot line of Lot 6,
Block 2.

All comments presented by staff and utility companies were addressed by the applicant and are
included in the plat enclosed within your packet. The developers have met with the Owasso
Golf Authority and are in agreement over the content of the covenants. The Owasso Planning
Commission reviewed the final plat at their April 11, 1995 regular meeting and unanimously
recommended approval.
Construction plans have been approved by the Public Works Department. Permits to construct
water and sewer lines have been issued by the State of Oklahoma Department of Environmental
Quality as well (WL#000072950351 and SL#000072950352).
RECOMMENDATION
Having had all comments addressed by the applicant, staff is recommending approval of the final
plat for The Summit at Southern Links.

serve the Southern Links Addition, City of Owasso, Tulsa County, Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans
approved by this department on June 12, 1995. Any deviations from the approved plans and
specifications affecting capacity, flow or operation of units must be approved, in writing, by
the Executive Director before changes are made.
Receipt of this permit should be noted in the minutes of the next regular meeting of the City
of Owasso, after which it should be made a matter of permanent record.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this permit to construct
5,797 I.f. of six (6) inch, 1,400 I.f. of eight (8) inch, 2,421 I-f. of twelve (12) inch water line,
and appurtenances to serve Southern Links Addition, located in the W/2 of Section 30, T -21-
N, R -14 -E, I.M., City of Owasso, Tulsa County, Oklahoma, in accordance with the plans
approved on June 12, 1995.
By acceptance of this permit, the permittee agrees to operate and maintain the facility in
accordance with the Public Water Supply Operation rules (OAC 252:630) and to comply with
the State Certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date
of approval or the phases not under construction will be resubmitted for approval as a
new project.
3) That no significant information necessary for a proper evaluation of the project has
been omitted or no invalid information has been presented in applying for the permit.
4) That the State Department of Environmental Quality shall be kept informed on
occurrences which may affect the eventual performance of the works or that will
unduly delay the progress of the project.
' 5) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with Public Water Supply
' Construction Standards (OAC 252: 625- 17 -4).

6) That before placing this facility into service, at least two samples. of the water, taken on
different days, shall be tested for bacteria to show that it is safe for drinking purposes. '
7) That any deviations from approved plans or specifications affecting capacity, flow or
operation of units must be approved by the Executive Director before any such deviations '
are made in the construction of this project.
8) That the recipient of the permit is responsible for the continued operation and maintenance
of these facilities in accordance with rules and regulations adopted by the Environmental
Quality Board, and that this department will be notified in writing of any sale or transfer of
ownership of these facilities.
9) That any notations or changes recorded on the official set of plans and specifications in the
State Department of Environmental Quality files shall be part of the plans as approved.
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will
constitute acceptance of the permit and all conditions and provisions. I

SUBJECT: REQUEST TO RENEW ANNUAL E -911 INTERLOCAL AGREEMENT
DATE: March 13, 1996
BACKGROUND:
On January 17, 1989, the City of Owasso executed an Interlocal Governmental Agreement for
the purpose of joining 26 other governmental entities to initiate an enhanced emergency phone
system (E -911). Since its inception, the Enhanced -911 system has proven to be a vital link to
both the police and fire departments for area residents in an around Owasso, including portions
of Rogers County.
The interlocal agreement provides that all communities and counties involved will jointly fund
the system by collecting a surcharge on local telephone bills. Though the City of Owasso
collects only 3 %, the statutes allow up to 5 % of the base phone bill. The fee is used exclusively
for costs incurred to maintain the E -911 system. In order to maintain compliance with an
Attorney General's ruling, the interlocal agreement must be renewed annually prior to May 1.
If the interlocal agreement is not renewed, the City would lose its ability to impose the surcharge
and would no longer be able to continue this valuable service.
INCOG is facilitating the renewal process and has provided a "Notice of Renewal" form which
is attached for your review.
RECOMMENDATION:
Staff recommends Council approval of the "Notice of Renewal of Interlocal Agreement ".
