' WHEREAS, The OEDA, the Owasso Chamber of Commerce, the Owasso Re oo rter, and the
City of Owasso have developed a special business recognition program as a
means of honoring the valuable contributions of local, community-minded

Tuesday, March 19, 1996
The Owasso City Council met in regular session on Tuesday, March 19, 1996 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, March 5, 1996.

Mayor Burris called the meeting to order at 7:00 p. m.

The invocation was given by Pastor David Hall of the Baptist Retirement Center.

ITEM 5: MAYOR'S RECOGNITION OF CITIZEN VOLUNTEER EFFORTS TO
t BENEFIT THE PUBLIC.
Mayor Burris presented a certificate of appreciation to Brandi Weeks, an Owasso Girl Scout,
' in recognition of her Elm Creek Park clean-up project. Miss Weeks, assisted by Matt Lotter
and Scott Sharitt, cleaned debris from Elm Creek pond. Elisa Norman also assisted in the
project by serving as a lifeguard. Mr Lotter, Mr Sharitt, and Miss Norman were also presented
certificates of appreciation.

ITEM 6: RECOGNITION OF OUTSTANDING EMPLOYEES.
Mayor Burris, assisted by City Clerk Marcia Boutwell and City Manager Rodney Ray, presented
certificates of appreciation to several groups of city employees for special efforts during the last
few weeks. Certificates were presented to the following fire department employees for their
outstanding response to a recent rash of dangerous grass fires: Chief Bob Allen, Capt Lowell
Thompson, Lonny Fisher, Dan Salts, Randy Mills, John Partin, Kris DeMauro, Max Downing,
Mike Holcomb, Tom Robinson, Tracy Tremain, Shannon Saddoris, Ron Stuckey, Mark Stevens,
Don Taylor, Danny Scruggs, Travis Holmes, and Bryan Stovall. Certificates were presented
to members of the Owasso police department for their efforts in developing and implementing
a certified reserve academy. The following employees received recognition: Coordinator Randy
Brock, Darryl Jones, Mark Cleveland, Tony Klahr, Randy Cunningham, Doug Driver, Kenny
Yount, and Rick Parsley. Gary Orr, David Warren, Brian Dempster, Tim Rooney, and Marcia
Boutwell were recognized for their contributions to the Home & Garden Show booth.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
~ ORDINANCE #521. AN ORDINANCE PROVIDING FOR AN INCREASE IN
THE MAXIMUM SIZE OF LPG CONTAINERS ALLOWED WITHIN THE
CORPORATE LIMITS.
Chief Allen said that Mr Pat Conley of Equipment One Rentals has requested that the city
ordinance relating to LPG containers be amended to allow the installation of a 1000 gallon
container. The code currently restricts those containers to 500 gallons. Chief Allen said that
the proposed ordinance would also amend the code to allow only one container on each premise
instead of the current two. Mr Ewing moved, seconded by Ms Barnhouse, to approve Ordinance
#521, increasing from 500 gallons to 1000 gallons the maximum capacity of an LPG container
lawful with the corporate limits and decreasing the number of containers allowed on a premises
at the same time from two to one.

' ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION #96-06. A RESOLUTION ESTABLISHING AND CLARI_FYING
MINIMUM STREET WIDTH STANDARDS FOR THE CONSTRUCTION OF
RESIDENTIAL STREETS AND ESTABLISHING AN EFFECTIVE DATE.
Mr Ray presented this item, stating that the purpose of the resolution is to establish a clear and
enforceable standard for street width that leaves no need for interpretation. The City Attorney
has indicated that the existing standard is of questionable enforceability because of the lack of
a single standard and because we are requiring the use of a set of standards that have not yet
been officially adopted. The proposed resolution firmly establishes 26 feet as the standard for
minor residential streets, measured inside-of--curb to inside-of-curb. Ms Barnhouse moved,
seconded by Mr Helm, to approve Resolution #96-06, providing for minimum street widths on
minor residential streets of 26 feet, residential collector streets of 36 feet and industrial-
commercial streets of 40 feet.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST TO CLOSE THE SOUTH 10' OF THE NORTH 60' OF THE WEST
1' OF THE EAST 11' UTILITY EASEMENT LOCATED ON LOT 7 BLOCK
2 DOUBLE OAKS III ADDITION (7902 NORTH 126TH EAST AVENUEZ
The home constructed on this lot is encroaching approximately 5 to 6 inches into this easement a
according to Mr Rooney. There are no utilities located within the easement, however, PSO has
asked that only a 10' portion of the easement that is affected by the encroachment be closed. '
The Technical Advisory Committee and the Planning Commission have reviewed the request and
have recommended approval. Mayor Burris moved, seconded by Ms Barnhouse, to approve the
requested easement closing. ~

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A
CONTRACT FOR THE CONSTRUCTION OF ROADWAY AND UTILITY
IMPROVEMENTS FOR NATIONAL STEAK AND POULTRY BETWEEN
THE CITY OF OWASSO AND YOCHAM ENTERPRISES INC AND
AUTHORIZATION FOR FINAL PAYMENT AND RELEASE OF '
RETAINAGE TO THE CONTRACTOR
Mr Groves presented this item. On November 7, 1995, the City Council awarded a contract to '
Yocham Enterprises for construction of roadway and utility improvements to serve NSP. The
work has been completed and all items on the punch list have been taken care of. There was ,
discussion concerning the maintenance bond requirement for streets, which is three years as
opposed to one year on other projects. The maintenance bond for this project is two years
because it was written incorrectly in the bid document. Mr Helm moved, seconded by Mr '
Ewing, to accept the work performed under the contract for the construction of roadway and
utility improvements for National Steak and Poultry, to release retainage, and authorize final
payment to Yocham Enterprises Inc in the amount of $65,531.02. ~

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
MOWING CONTRACTS FOR CITY PROPERTIES.
For the past six years, the City of Owasso has utilized private sector contractors for the purpose
of providing mowing services for city properties during the summer growing months. This
program continues to be cost effective. The 1996 mowing bid packets were sent to 20
prospective mowing contracts and the bid was advertised in the Owasso Reporter. Bids were
received from nine contractors. Mr King said that the bids received for mowing city parks
showed no increase, and the total for mowing four parks at 18 moorings each is $9450. The
bids for easements, medians and right-of-way areas showed an increase of $97.20 for the
mowing season. These areas are mowed a total of six times during the season at a cost of
~ $6870. Total expense for all the contracts would be $16,320. Bids were also received for
mowing the US Highway 169 right-of--way, but is not recommended for award because of the
t high bid. City personnel will continue to mow this area. Mayor Burris moved, seconded by
Mr Helm, to approve the following contracts for the 1996 mowing season and authorize
payment:
1. Rayola Park - Mr Larry Turner at $165 per mowing
2. Elm Creek Park - Mr Arley Owens at $235 per mowing
3. Ator Heights Park - Mr Arley Owens at $80 per mowing
4. 86th St Park - Mr Larry Turner at $45 per mowing
5. Ator Utility Easement - Mr Dudley Jones at $29 per mowing
6. El Rio Vista Center Medians & Frontage - Mr Dudley Jones at $67 per mowing
7. El Rio Vista Drainage Easement - Mr Dudley Jones at $24 per mowing
8. Three Lakes Drainage Easement -Brush Hog Services at $500 per mowing
9. Lakeridge Drainage Easement -Brush Hog Services at $450 per mowing
10. Owasso Expressway West Side Easement - Mr Arley Owens at $75 per mowing
11. Main St, Fifth St Drainage, & Third & Main St Easements - Mr Dudley Jones
at $52 per mowing

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
R~)UEST FOR APPROVAL OF THE FINAL PLAT FOR THE SUMMIT AT
SOUTHERN LINKS AN ADDITION TO THE CITY OF OWASSO.
The final plat for The Summit at Southern Links has been reviewed by the Technical Advisory
Committee, and the Planning Commission has reviewed the plat and recommended approval.
Mr Rooney said that this is the third plat to be brought to the Council for approval for the

Southern Links development. All comments made by the Technical Advisory Committee have ~
been addressed, construction plans have been approved by the Public Works Department, and
permits to construct water and sewer lines have been issued by the DEQ. Mayor Burris moved,
seconded by Ms Barnhouse, to approve the final plat for The Summit at Souther Links.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR RENEWAL OF THE E-911 INTERLOCAL AGREEMENT
On January 17, 1989, the City of Owasso executed an Interlocal Governmental Agreement for
the purpose of joining 26 other governmental entities to initiate an enhanced emergency phone
system. This agreement must be renewed annually prior to May 1 in order for the City to
continue to receive a surcharge from local telephone bills and to continue the E-911 service.
Mayor Burris moved, seconded by Mr Ewing, to approve the Notice of Renewal of Interlocal
Agreement and authorize the mayor to execute the document.

BACKGROUND:
The last session of the legislature passed a law that allows cities to increase fines for "non-jury"
trial offenses from a maximum of $100 to a maximum of $200. Currently the amount assessed
in a non jury trial for offenses such as shoplifting, driving with a suspended or revoked license,
disturbing the peace or prowling (naming just a few), is $100 plus the court costs. The proposed
ordinance will allow the maximum fine in these offenses to be increased to $200 (plus court
costs). This ordinance would not necessitate a jury trial and the possibility of incarceration does
not exist.
RECOMMENDATION:
Staff recommends City Council approval of Ordinance #522, which would implement an increase
in the General Penalty Provisions of the Owasso Code of Ordinances from $100 to $200.

in the General Penalty Provisions of the Code of Ordinances of the City of Owasso, Oklahoma,
increasing the fine limit from One Hundred Dollars ($100.00), excluding costs, to Two Hundred

It is unlawful for any person to change or amend by additions or deletions any part or portion of this

OKLAHOMA:
SECTION 1. That the following described utility easement, be, and the same is hereby
closed to the public use, to-wit: The south 10 feet of the north 60 feet of the westerly 1 foot of the
easterly 11 foot utility easement located in Lot 7, Block 2 of the Double Oaks III Addition to the
City of Owasso, Tulsa County, State of Oklahoma.
SECTION 2. That the municipality shall retain the absolute right to reopen the public way

affect the right to maintain, repair, reconstruct, operate or remove utility, public service corporation,
or transmission company facilities of service therein, nor shall a closing affect private ways existing
by operation of law unless released in writing executed by the owners thereof.
SECTION 3. That all ordinances or parts of ordinances in conflict herewith be, and the

SUBJECT: VHS CAMCORDER PURCHASE REQUEST

BACKGROUND:
For the past several years, the City has found the need to utilize video photography for
special functions and certain training purposes. Generally a video camera has been borrowed
from individual employees to accommodate these needs. With the current trend of rapid
growth within the City, the demand for video photography has been increasing. Several
departments have requested custom training/orientation tapes and the Owasso Economic
Development Authority is interested in a new Owasso promotional tape. A city owned
commercial grade camcorder would allow work on these projects and enhance the City's "in-
house" capabilities for future projects.
PROPOSED USAGE
Two projects ready for immediate work are specific in nature. They are as follows:
1. Municipal Court's "Owasso Early Intervention Program"
The City of Owasso recently terminated an agreement with the Victim's Impact
Panel of Oklahoma Inc and initiated its own program. As part of this
~+ separation, all video tapes and materials associated with the previous
organization must be returned. Owasso's Court Clerk now requires new video
tapes for the early intervention program. Ms Garbee has requested several
custom videos including:
A. A dedication tape,
B. Alive taping of a panel discussion,
C. Personal testimonies of victims and offenders, and
D. Actual footage of alcohol related offenders.

2. Owasso Economic Development "Promotional Video"
Over the last five years the OEDA has been instrumental in attracting new
industry to the Owasso area and creating approximately 1,500 new jobs. Their
function is accomplished through the use of many techniques including
promotion and marketing of the city. A video presentation that illustrates some
of the highlights would be used for presentations and also sent to prospective
businesses.
Two other broad based usages are the following: ^,
1. Personnel Department
This department has an ongoing need for custom employee and supervisor
training videos and orientation videos for new employees. Special videos for
summarizing city benefit changes to employees on evening and night shifts '
would also be helpful. .,~
2. Other departments '
The Police and Fire Departments, as well as the risk management coordinator
have all requested future training videos for employee training. Currently, the '
State of Oklahoma requires all employees to receive a minimum of 4 hours of
safety training each quarter.
CAMERA REQUIREMENTS
After careful analysis of the specific present and future usages required, it was determined
that a commercial grade S-VHS camcorder with several special editing modes, high quality
sound capabilities, and a quality lens system would be the best investment. Specifications for
bid were written using these and other factors. Copies of the completed bid packets were
mailed to three potential vendors on February 21, 1996. All three vendors responded with
sealed bids which were opened on March 13, 1996. The prices bid are as follows.

Staff has reviewed all of the submitted bids and all meet the bid specifications contained
within the bid packet.
FUNDING
Funding for the purchase of the VHS Camcorder would come from two different funding
sources. The first funding source is the Juvenile Court Fund (38-141-5310). This fund is
used to account for fines generated as a result of prosecution of juveniles under the
"Agreement for Municipal Court Jurisdiction Concerning Juveniles." Funds from the
Juvenile Court Fund are used for local programs which address problems of juvenile crime.
Judge Hilsabeck recently endorsed the city's purchase of a VHS Camcorder, allotting
$1,000.00 from this fund.
The second source of funding is from the Community Development Department's Capital
Outlay Budget (51-130-5441). In October of 1995, the Community Development requested,
and the Owasso City Council approved a carry over budget in the amount of $3,000.00 for
the purpose of purchasing a video camera. A copy of this memorandum is attached for your
information and review. Of the $3,000.00, staff is requesting an expenditure of $1,147.00
from this fund.
RECOMMENDATION:
Staff recommends approval of the expenditure of $2,147.00 to TESI, Tulsa, OK, for the
purchase of one Panasonic AG456U camcorder with standard accessories and one spare
rechargeable battery. Of the total cost of $2,147.00, $1,000.00 shall be charged to the
Juvenile Court Fund (38-141-5310) and $1,147.00 shall be charged to Community
Development Capital Outlay (51-130-5441).

The following item is being requested by the Community Development Department to be funded
through the carry over budget process. It is my understanding that the Community Development
~ Budget has a carry over of 4,498.31 from FY 94-95, from which staff is requesting $3,000.00.
Video Camera
This item has been a previously budgeted item in previous years but has never been
purchased. The City of Owasso currently does not have a~ video production equipment
' outside of the police patrol units. As the culture continues to move toward a video
dominated format, the demand for video documentation of different scenarios is needed.
Not only would this item be beneficial for use within the Code Enforcement division, it
~ could also be utilized by the Owasso Economic Development Authority, the Owasso
Police Department, the Owasso Recycle Center, programs for the Owasso Recreation
Center, Subdivision Infrastructure Inspections, the monitoring of drainage concern areas
etc. Currently, whenever a video camera is needed for any city purpose, it must be
borrowed from individual staff members.

BACKGROUND:
By city charter, the council must designate an accountant to make an independent audit of all
accounts and financial transactions of the City. Last year, proposals for audit services were
~ solicited from accounting firms. The proposal for audit services included a fixed fee for each
of three years. The firm of Carlson & Cottrell of Shawnee was selected during that process last
year. Their proposed fee for fiscal year 1995-96 audit services is $13,625 including expenses.
' This will be the second year for Carlson & Cottrell to serve as auditors for the City. Retaining
the same audit firm for more than one year provides consistency in audit methods and
' requirements from year to year. Staff can prepare for the audit, knowing what information and
records the auditors will need. Council is able to become familiar with the audit philosophy and
report format.
The audit work performed by Carlson & Cottrell during the previous year was satisfactory and
staff would like to continue that relationship for the next fiscal year.
RECOMMENDATION:
^ Staff recommends that Council renew the contract with Carlson & Cottrell for the purpose of
conducting an independent audit for the fiscal year ended June 30, 1996 for a fee not to exceed
$13,625.

Dear Mr. Ray:
This letter confirms our mutual understanding of the professional services we will provide your
organization for the year ending June 30, 1996. We will audit the financial statements of the
organization in accordance with generally accepted auditing standards and Government Auditing
Standards, for the purpose of expressing an opinion on them. The financial statements are the
responsibility of management. Our responsibility is to express an opinion on the financial statements
based on our audit.
Audit standards require that we plan and perform the audit to obtain reasonable assurance about
whether the financial statements are free of material misstatement. An audit includes examining,
on a test basis, evidence supporting the amounts and disclosures in the financial statements. An
audit also includes assessing the accounting principles used and significant estimates made by
management, as well as evaluating the overall financial statement presentation. We believe that our
audit will provide a reasonable basis for our opinion.
Our procedures will include tests of documentary evidence supporting the transactions recorded in
the accounts, tests of the physical evidence of inventories, if any, and direct confirmation of
receivables and certain other assets and liabilities by correspondence with selected customers,
creditors, legal counsel, and banks. At the end of the audit, we will request certain written
representations from you about the financial statements and matters related thereto. Our audit is
subject to the inherent risk that material errors and irregularities, including fraud or defalcation, if
they exist, will not be detected. We will inform you of irregularities that come to our attention.
You have assured us of your cooperation in facilitating the progress of the audit and, more
specifically, in furnishing us upon request with schedules, analysis, reconciliations, other such
working papers as necessary to complete the audit, secretarial support, communications, and copying
support and a suitable working area. You have agreed that if schedules, etc. as requested are not
ready on the first day of field work, then additional professional fees may be billed by us to
compensate for the necessary schedules, analysis, etc. we have to complete. We will discuss with
you the need for any additional professional fees and obtain your approval prior to doing any work.
Professional fees and expenses for these services will be $ 13,625.
