Unfinished Business ' OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING ' Tuesday, July 2, 1996 The Owasso City Council met in regular session on Tuesday, July 2, 1996 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, June 28, 1996. ITEM 1: CALL TO ORDER Mayor Ewing called the meeting to order at 7:35 p.m. ITEM 2: ROLL CALL PRESENT ABSENT Danny Ewing, Mayor Joe Ramey, Vice Mayor Mary Lou Barnhouse, Councilor Michael Helm, Councilor Tracy Standridge, Councilor STAFF ' Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk ITEM 3: READING OF MAYOR'S PROCLAMATION. ~ Mayor Ewing read and presented a proclamation to Depot Steak House as Business of the Quarter for the Third Quarter of 1996. Doris Williams accepted the proclamation for Depot Steak House and their employees. e 1 ITEM 4: REQUEST APPROVAL OF THE MINUTES OF JUNE 18 1996 REGULAR MEETING. Mr Ramey moved, seconded by Mr Standridge, to approve the minutes as submitted, by reference made a part hereto. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. ITEM 5: REQUEST APPROVAL OF THE CLAIMS. Mr Ramey moved, seconded by Ms Barnhouse, that the following claims be approved as submitted: (1) General Fund $11,558.26; (2) Workers Comp Self-Ins $651.20; (3) City Garage $5,560.01; (4) Capital Improvements $3,682.82; (5) Capital Projects Grant $7,476.57; (6) Payroll $108,549.28; (7) City Garage Payroll $2,097.33. Owasso City Council AYE: Ramey, Barnhouse, Helm, Standridge, Ewing NAY: None Motion carried 5-0. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #96-11. A RESOLUTION APPROVING A PORTION OF THE PROCEEDS OF A 3 % SALES TAX LEVIED BY THE CITY TO THE OWASSO PUBLIC- WORKS AUTHORITY: REVOKING RESOLUTION #87-07: APPROVING A SUPPLEMENTAL SECURING AGREEMENT: AND CONTAINING OTHER PROVISIONS RELATING THERETO. Mr Ray explained that Resolution #96-11 authorizes the appropriation of a portion of City sales tax to the OPWA if such is necessary, and approves a Supplemental Security Agreement adding the golf course to the assets of the City and using such as security for indebtedness. Following a lengthy discussion, Mr Ramey moved, seconded by Mr Standridge, to approve Resolution #96-11. AYE: Ramey, Standridge, Barnhouse, Helm NAY: Ewing Motion carried 4-1. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATION TO AUTHORIZED AND PROPER FUNCTION OF THE CITY: APPROVING THE INCURRENCE OF INDEBTEDNESS BY THE OWASSO PUBLIC WORKS AUTHORITY (THE "AUTHORITY") ISSUING ITS UTILITY REVENUE BONDS. SERIES 1996 IN AN APPROXIMATE AGGREGATE PRINCIPAL OF THE INDENTURES SECURING THE BONDS: DECLARING THE BONDS TO BE BANK OUALIFIED: DETERMINING THAT THE BONDS ARE QUALIFIED TAX-EXEMPT OBLIGATIONS: AND CONTAINING OTHER PROVISIONS RELATING THERETO. Mr Ray said that Resolution #96-12 provides legal determination that operation of a golf course is an authorized function of the City, approves the issuance of debt by the OPWA in the amount of $5,340,000, approves all of the other actions taken by the OPWA shown above, and July 2, 1995 2 Owasso City Council July 2, 1995 additionally, declares the Bonds to be Bank Qualified and tax exempt. Following discussion, ' Mr Helm moved, seconded by Mr Ramey, to approve Resolution #96-12. AYE: Helm, Ramey, Standridge, Baznhouse NAY: Ewing Motion carried 4-l. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO _ ORDINANCE #527, AN ORDINANCE RELATING TO THE LEASE OF RAYOLA PARK RECREATION CENTER AND APPURTENANT FACILITIES, APPROVING SUCH LEASE, AND DECLARING AN EFFECTIVE DATE. Ordinance #527 approves a lease agreement between the City of Owasso and the YMCA of Greater Tulsa for the lease of the Owasso Recreation Center. Two proposals to lease the Center were received -one from the YMCA of Greater Tulsa and the other from the Boys and Girls ~ Clubs of America. A committee comprised of Councilor Helm, Vice Mayor Ramey, Sherry Bishop and Ron Cates reviewed the proposals, and determined that the proposal received from the Boys and Girls Clubs of America did not meet the specifications listed in the Request for Proposals. The YMCA proposal did address the specifications, and the YMCA was contacted rr and asked to make a presentation to the committee. Based on that presentation, and a review of the proposal, the review committee developed a lease agreement. That lease agreement is an ' attachment to the ordinance. Mr Groth requested that the lease agreement contain a stipulation that the four sports fields located to the west of the building not be lighted. Mr Ramey moved, seconded by Mr Helm, to approve Ordinance #527, and that the lease agreement attached ~ contain a provision that the four sports fields to the west of the building not be lighted. AYE: Ramey, Helm, Baznhouse, Standridge, Ewing NAY: None Motion carried 5-0. Mayor Ewing recessed the meeting at 8:30 p.m. and reconvened at 8:40 p.m. ITEM 9: CONSIDERA REQUEST F~ POINT III. . DIRECTLY S OWASSO Hh ACRES. MOl TION AND APPROPRIATE ACTION RELATING TO A ~R APPROVAL OF THE FINAL PLAT FOR BARRINGTON AN ADDITION TO THE CITY OF OWASSO. LOCATED OUTH OF BARRINGTON POINT I & II. JUST NORTH OF THE 3H SCHOOL. CONTAINING 32 RESIDENTIAL LOTS ON 9.19 tE OR LESS. Kourtis Properties requested a review of the final plat for Barrington Point III. Barrington Point III received final plat approval in September of 1993. However, the plat was never filed. Because the developer has decided to develop the addition as a single family residential addition rather than as residential duplexes, staff required the developer to go through the platting 3 Owasso City Council July 2, 1995 procedure again. The final plat for Bazrington Point III was approved by the Planning Commission on May 14, 1996. There was some discussion concerning placing a requirement on the developer to build a sidewalk along 129th E Ave. Staff pointed out that there is no sidewalk going south from the addition along 129th E Ave west of Owasso High School. Staff also pointed out that the Subdivision Regulations in place at the time this platting process was begun did not require sidewalks to be constructed. Following further discussion, Mr Ramey moved, seconded by Mr Helm, to approve the final plat for Bazrington Point III as recommended by the Planning Commission, and without a requirement for the construction of sidewalks. ITEM 18: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE SALE OF PROPERTY LOCATED AT 42 SOUTH MAIN ADJACENT TO THE OWASSO HISTORICAL SOCIETY. The property under discussion was purchased by the City in 1991 as a pazt of the Main Street renovation project. Funding was provided through the Capital Improvements Fund 1988 Bond Issue. The property was placed on the mazket in May 1992. Since that time, there have been several inquiries, but no offers to purchase the property. The Historical Society would like to acquire the property in order to improve the Main Street azea. They plan to use a portion for an open, pazk-like setting, with the remainder utilized for off-street pazking. The Historical Society does not have the funds to meet the City's investment in the property, but have agreed to a lesser purchase price plus interest. If they should sell the property, then all of the proceeds from that sale would revert to the City, less the amount of the purchase price paid by the Historical Society. Since the property has been on the market so long, staff believes it to be in the best interest of the community for the Historical Society to acquire the property. Mr Ramey moved, seconded by Ms Baznhouse, to approve a contract for sale of the property at 42 South Main to the Owasso Historical Society, and that the Mayor, City Attorney, and City Manager be authorized to take all actions necessazy to finalize the sale under the terms of the contract. RAY CITY MANAGER FROM: M.A.ALEXANDER CHIEF OF POLICE SUBJECT: REQUEST TO PURCHASE POLICE VEHICLES AND EMERGENCY EQUIPMENT DATE: July 10, 1996 BACKGROUND: The 1996/1997 operating budget for the Police Department contains funding for the purchase of two new police vehicles for the patrol division. Funds were also appropriated for the necessary emergency equipment for these vehicles. In June of this year, the staff solicited bids from twelve vendors representing the three major vehicle manufacturers for two 1996 full size police vehicles. VEHICLES• On July 3rd, four bids were opened at the office of the Ciry Clerk. The results of the bids were: Jim Nelson Ford - Broken Arrow $17,741.00 Shawnee Mission - Shawnee, KS $18,662.00 (no warranty) Fred Jones Ford - Tulsa $20,758.50 Turnpike Ford - Tulsa $20,990.00 All bids were submitted on the Ford Crown Victoria. The state bid vehicle is also the Crown Victoria at a price of $18,268.00. The specifications sent out by this department did not include cruise control, electric door locks or cloth back seats. With those exceptions, the vehicles bid upon were, in fact, virtually the same as the state bid specifications. Marcia Boutwell, Contract Administrator SPECIFICATIONS FOR 1996 FULL SIZE POLICE AUTOMOBILE GENERAL DESCRIPTION: The following is a comprehensive list of specifications for two police vehicles to be purchased for the Owasso Police Department located at 101 N Main St, Owasso, OK 74055. In general, the vehicles proposed to be purchased are described as 1996 full size new four door sedans. All components of the vehicles shall be new and of original manufacture. ^ GENERAL PROVISIONS: Tax Exemption -Purchaser is exempt from payment of all Federal, State, and local taxes in connection with the purchase. Said taxes must not be included in bid prices. The City will provide necessary tax exemption certificates upon request. 2. Pricing -The price submitted in any proposal shall include all items of labor, materials, , tools, equipment, and other costs necessary to fully prepare the car for delivery. Any items of labor omitted from the specifications, which are clearly necessary for the proper delivery of the automobiles, shall be considered a portion of such specifications, although ' not directly specified or called for in these specifications. Prices quoted shall remain effective for a period of 60 days after opening of bids by the City. 3. Warranty - A manufacturer's and/or dealer's warranty shall be supplied to cover ' replacement parts and labor costs. The manufacturer agrees to promptly replace any part or parts which by reason of defective materials, workmanship, or installation, fail under ' normal use. Such replacement must be free of charge to the owner. Warranty will be for a period of 3 years or 36,000 miles, whichever comes first from the date of delivery. The City of Owasso shall expect the dealer and/or manufacturer to have adequate stock ' of replacement parts available to service the cars within a reasonable time. Tires are exempt from this warranty but must be covered by the tire manufacturer's standard warranty and serviced by the local authorized dealer of the tine manufacturer. 4. Bids -The purchaser reserves the right to reject any or all bids, and to waive any or all technicalities, informalities, or other minor deviations from the bid document. 5. Inspection - An acceptance inspection shall be conducted between the supplier and the ' City before delivery will be accepted. The inspection date shall be at the City's convenience. All discrepancies noted during the inspection shall be remedied, at the III supplier's expense, prior to payment for the vehicles. 6. Pam - As with all municipalities in Oklahoma, payment must be approved and signed on a claims list by the proper city authority. Payment shall be made only after complete and acceptable delivery of the vehicles in accordance with these specifications. The Owasso City Council meets regularly on the first and third Tuesday of every month. 7. Prime Contractor ResponsibilitX - If final delivery of the vehicles include the use of services of another company, the City of Owasso will hold the bidder responsible for those outside services. 8. Proposal Expenses -Expenses for developing the proposal are entirely the responsibility of the vendor and shall not be chargeable to the City of Owasso. 9. The property had been donated to the County in 1971, and the building was constructed on the property in 1972. Mayor Lamb signed Resolution 88-11, and it was presented to the County on August 19, 1988. The request for the return of the property was made pursuant to a reorganization plan adopted by the Health Depaztment that closed its facilities in each of the County's municipalities and concentrated its efforts on a regionalization of services (ie their Collinsville facility remained open and now serves Owasso, Collinsville, Sperry and Skiatook). With the closing of the Owasso facility, the City Council believed the building should be deeded back to the City since it was located on property donated to the County. Unfortunately, the County did not agree with our request and submitted acounter-proposal that included an offer to sell the building to the City. After further discussions, Commissioner Harris offered a compromise that would make the facility available to the City on an annual basis at a cost of one dollaz per yeaz. In October of ~,~, 1988, the City-County Health Depaztment agreed to the proposed lease concept. Subsequently, in Januazy of 1989, the City and County entered into a "one dollaz per yeaz" lease agreement that was renewed in July of 1989 to coincide with the two entities fiscal year. Since July 1989, the annual lease has been renewed each year. The attached lease agreement was received on July 3rd and has been placed on the Council agenda for action. Our review of the document ' indicates there aze no material changes from past yeaz's agreements. The agreement has been sent to Mr Cates for his review. CITY-COUNTY HEALTH DEPT LEASE JULY 11, 1996 PAGE 2 Please note that the City has sub-leased the facility to the Owasso Chamber of Commerce since January 1989. Additionally, it should be noted that the OEDA spent $4400 in August of 1989 to repair and improve the building. It should be further noted that the lease with the Chamber will be presented for approval in January (our lease with the Chamber has not been changed to ' a fiscal year because they use a calendar year). RECOMII~NDATION: The staff recommends Council approval of the lease agreement with the Tulsa City-County Health Department for fiscal year 1996-97, and that the Mayor be authorized to execute such document. Proposed lease agreement r TCCHD Contract #2-03 07-01-96 to 06-30-97 AGREEMENT THIS AGREEMENT made and entered into this 1st day of July by and between the City of Owasso, a municipal corporation, hereinafter referred to as "Lessee", and the Board of County Commissioners of Tulsa County, Oklahoma, on behalf of the Tulsa City- County Health Department, hereinafter referred to as "Lessor". RECITALS: WHEREAS, 74 Okl. St. Ann. Section 1008 provides authority for interlocal contracts for governmental services; and WHEREAS, 63 Okl. St. Ann. Section 1-216 provides authority for city-county health departments to enter into agreements with other municipalities; and WHEREAS, Lessee is desirous of obtaining a facility to house municipal offices on a continuous daily basis; and WHEREAS, Lessor is desirous of leasing the Owasso Health Center facility to facilitate the Lessor's regionalization plan for the provision of health services for the citizens of Tulsa County. NOW THEREFORE, for and in consideration of the mutual terms, covenants and conditions hereinafter set forth, the parties hereto agree as follows: 1. Lessor, in consideration of the rents, covenants and agreements hereinafter contained, does demise, rent and lease unto the Lessee the possession of: The Owasso Health Center located at: 319 South Cedar in Owasso, Oklahoma, together with any and all improvements now situated upon said premises for a ~' term beginning July 1, 1996, and ending on June 30, 1997. In consideration of the use and possession of these premises, Lessee agrees to pay Lessor the sum total of $1.00 due and payable on or before July 1, 1996. ~' 2. Lessee agrees that should Lessor need space to conduct clinics or other public health functions in the City of Owasso, space herein or at Alternative spaces as the City shall make available to Lessor by the Lessee, as needed. ~, 3. Lessee agrees to provide all janitorial services and utilities for the entire facility, including the provision of the necessary toilet and janitorial supplies, as well as the labor and materials for outside yard maintenance of the facility. ~ 4. Lessee further agrees to maintain the interior structural and nonstructural portions of the building, including painting and ordinary repairs and maintenance of plumbing, floor drains, floor covering, light fixtures, air conditioning and heating. The Lessee shall have the right to remove any and all furniture, equipment and improvements it may have installed on the premises, provided Lessee shall restore ~ any damage to the building as the result of such removal, and all permanent r alterations and improvements by Lessee shall become a part of the real estate and upon the expiration of this lease. This insurance should also name Tulsa County and the Tulsa City-County Health Department as additional insured, proof of which must be submitted to the Lessor prior to the beginning of this lease. 9. Other members of the task force are the City of Tulsa, Tulsa County and the Tulsa District Attorney. The purpose of the task force is to impede, interdict yand eliminate the distribution of illegal drugs in the Tulsa County azea. There have been successes in the task force's history. The administration's position is that those successes merit our continued participation. However, on Monday, July 15, the City Attorney was notified by the District Attorney's office that the group was operating without the appropriate interlocal agreement as required by enabling legislation. The failure of the four pazties to execute an "interlocal agreement" has been characterized by the Assistant District Attorney as a "serious defect" that must be rectified. To date, the County Commission has enacted a resolution and the City of Tulsa is expected to act this week on resolutions to authorize the appropriate interlocal agreement. Mr Cates has reviewed the proposed interlocal agreement (attached), as has the Chief of Police and City Manager. Additionally, Mr Cates has prepazed a resolution for City Council consideration (attached). Due to the serious nature of this oversight, and because of the "very serious legal and civil repercussions" that could result, it is planned to present this resolution to you at tonight's meeting under "NEW BUSINESS". In over nine years, the staff has never presented an item under new business. However, it is necessary to do so if we are to continue our pazticipation in this task force. After reviewing Ms. Greaves correspondence as well as the Interlocal Cooperation Agreement, I would submit that I concur with Ms. Greaves observations as set forth in her correspondence as well as approve the substance and form of the proposed Interlocal Agreement. Cates Owasso City Attorney 525 South Main, Suite 680 Tulsa, OK 74103 Dear Mr. Cates: It has come to the District Attorney's attention that although the Tulsa Police Department, the Tulsa County Sheriffs Office, the District Attorney's Office and the Owasso Police Department have been participating in a joint effort to enforce and prosecute drug laws through a Tulsa County Multi jurisdictional Drug Task Force for a lengthy period of time and with the aid of Federal grant monies, there has never been an interlocal agreement formally executed by the agencies involved so that the Task Force could be empowered to act. 1n an effort to rectify this potentially serious defect, I have enclosed a draft of an interlocal agreement for your review and two of the four resolutions needed in order to enter into the agreement. The District Attorney's resolution has been executed. The Tulsa County Board of County Commissioners will act on their resolution at the BOCC meeting Monday, July 15, 1996, at 9:30 am. Title 74 Section 1004 requires a resolution from the City of Owasso before the Owasso Police Department can legally participate. I am requesting that your office draft a resolution similar to the ones attached and present it to the City Council for action as soon as possible. A similar request is being forwarded to Tulsa Assistant City Attorney Mark Newbold for immediate action. After the resolution is passed by your City Council, please send me a certified copy so that we might proceed to forward all required documents to the Attorney General's oflice for approval. If you have any questions, suggestions, or revisions regarding the interlocal agreement, please contact me at 596-4841. Because your officers and ours have been actively participating in this cooperative endeavor without the benefit of this document, I believe there is a potential for very serious legal and civil repercussions. Therefore, time becomes of the essence in complying with the provisions of the Interlocal Cooperation Act at 74 O.S. §§ 1001 et seq.. Thank you for your expedient attention to this matter. Gre Assistant District Attorney . , INTERLOCAL AGREEMENT AUTHORIZING AND EMPOWERING THE TULSA COUNTY MULTI-JURISDICTIONAL DRUG TASK FORCE This Agreement is entered pursuant to the authority of The Interlocal Cooperation Act, 74 O.S. §§1001 et seq., Title 51 O.S. §6(A)(4), Title 11 O.S. §34-103, and Title 19 O.S. §547(C) which provide for cooperative agreements to promote better drug law enforcement services by the ;public agencies parties hereto. The Tulsa County District Attorney's Office, the Tulsa County Sheriff's Ofrce, the Tulsa Police Department, and the Owasso Police Department hereby enter into this agreement, each with the other, as of the date that each agency signs this agreement and receives authorization to do so by ordinance, resolution, or otherwise pursuant to the law of the governing bodies of each agency. The Tulsa County Multi-Jurisdictional Drug Task Force becomes operable upon the approval of this agreement by the Attorney General of the State of Oklahoma. PURPOSE Because it is in the mutual interests of counties and municipalities to coordinate drug law investigation, enforcement, awareness, education, intervention, and prosecution and to share resources available through various sources of funding; and because in the course of the investigation and enforcement of drug laws, it may become necessary for officers to act outside their respective jurisdictions; the above named parties enter into this agreement for the specific purpose of collecting and coordinating law enforcement resources to successfully identify, investigate, and prosecute ongoing criminal activity as it relates to the manufacture, importation, and distribution of controlled dangerous substances. DURATION This agreement begins on the day it is effective, as required by law, and ends one year from the date it becomes effective. It maybe renewed by the parties ,but only by affirmative, written renewal signed by all parties to any such renewal and contingent on adequate funding. MEMBERSHIP The Tulsa County Multi-Jurisdictional Drug Task Force shall be comprised of the following members: the Tulsa County District Attorney's Office, the Tulsa County Sheriff's Office, the Tulsa Police Department, and the Owasso Police Department. -Additional governmental agencies may join this Task Force with the prior approval of the majority of the body membership by filing and recording a copy of this agreement signed by the new member and the administrator of the joint board within 45 days of the approval of the body membership. TERMINATION OF AGREEMENT l ., Any party to this Agreement may terminate its membership in the Agreement by giving ~',. thirty days written notice of termination to all other parties setting out the effective date of `' termination. Such termination notice should also contemporaneously be provided to the Secretary of State and the county clerk in Tulsa County where the agreement is recorded. The Agreement shall terminate automatically upon the non-renewal of the Agreement.. Upon termination of the Agreement, all property real and personal that was on loan to the Task Force will be returned to the lending agency. Any property acquired and held by the Task Force, will become the property of the District Attorney's Office. FUNDING The the partial salaries of the Task Force Administrator, of three Task Force positions held by an Owasso officer, a officer, and a Tulsa County Deputy, the cost of the Task Force equipment, confidential buy money, and other costs for operation of the Task Force 2 shall be provided by the District Attorney's Office, Fourteenth District, Oklahoma, through its regular budget, its District Attorney's Drug Fund, and as subgrantee, through State and Federal Grants. The balance of the partially "grant-funded" positions will be paid by the individual respective agencies. All purchases made with the above cited funds shall remain the property of the District Attorney's Office. The District Attorney's Office will provide a fiscal officer to administer the grant and drug fund monies for the Task Force. In addition to the three paid positions on the Task Force, the parties to this agreement hereby expressly agree to loan to the Task Force, C.L.E.E.T. certified law enforcement officers to be used under the authority, direction and control of the Task Force Administrator, to carry out the purposes and operations of the Task Force as needed. Officers assigned to the Task Force shall be deputized by the Tulsa County Sheriff or the Tulsa County District Attorney to the extent allowed by 51 O.S. §6(A)(4), 19 O.S. §547(C), and 11 O.S. §34-103. All designated agencies or signatories hereby agree that each officer will be paid directly any and all compensation, salaries, and benefits to which the officer is or becomes entitled, by the original sending agency. Compensation includes all normal salary and benefits for services rendered and further includes worker's compensation benefits, injury leave benefits, and other benefits to which the ofFcer would be entitled under his employment contract with the original employing/sending agency. The above provisions include the three partially funded positions on the Task Force. ORGANIZATIONAL STRUCTURE A joint board is hereby created to administer the operations and functions of the Tulsa County Multi-Jurisdictional Drug Task Force. Tl~e Board shall be comprised of a representative from each of the member public agencies and who shall each have one vote. The representative from the District Attorney's office shall serve as the chairman of the Board and Administrator of the Task Force. The body membership shall have the power to adopt bylaws necessary for the appropriate implementation of this agreement. LIABILITY As provided in 74 O.S. § 1004(e), this agreement shall not relieve any public agency of any obligation or responsibility imposed upon it by law. Liability for all acts or omissions of individual officers, alleged to have been committed within the course of carrying out the duties and purposes of the Task Force, shall remain with the employing/sending agency to the same extent as otherwise provided by law. [See 19 O.S. §547(C)] No separate legal entity is or will be created. DRUG-FREE WORKPLACE All parties to this agreement agree to abide by the provisions of the Drug-Free Workplace Act of 1988. MISCELLANEOUS PROVISIONS A. In the event that any provision of this Agreement is found to be void or voidable by operation of statute, order of the court, or otherwise, all other provisions of this Agreement in whole or in part, shall remain in full force and effect and unaffected thereby. B.
