Owasso. May I extend the congratulations of Wychavon District to you all on what I see
will shortly be the twenty -fourth anniversary of your City's Charter.
It was a great pleasure to meet Rev. Caudle and his colleagues during their recent visit to
Worcestershire and I hope that they enjoyed meeting us as much as we enjoyed meeting
them.
The plaque which was presented to me on that occasion is already on display at the Civic
Centre and is a permanent reminder of friends from whom we are separated only by

BACKGROUND:
Public Service Company of Oklahoma is desirous of locating overhead utility lines along
portions of East 96th Street North and Mingo Road, contiguous to golf course property. The
location of these lines would be further back from the road than the existing row of power lines
in order to accommodate the future widening of the roads. Such location would prevent a future
relocation when the road is widened and save possible expense to the City. Private property
owners along this stretch have indicated they would grant an easement along the same line.
RECOMMENDATION:
The staff recommends granting said utility easement to PSO.

UTILITY EASEMENT
KNOW ALL MCN BY THESE PRESENTS:
That the CITY OF OWASSO, OKLAHOMA, an Oklahoma municipal corporation, hereinafter
referred to as "Grantor(s) ", for the sum of One Dollar ($1.00) and other good and valuable
considerations in hand paid, the receipt and sufficiency of which as consideration for any and all
direct and indirect, current damage, injury or diminution in value to the property covered by this
easement, is hereby acknowledged, hereby grants, bargains, sells, and conveys unto PUBLIC
SERVICE COMPANY OF OKLAHOMA, an Oklahoma corporation, its successors and
assigns, hereinafter referred to as "Grantee ", an easement consisting of the perpetual right,
privilege and authority to construct, operate, maintain, reconstruct and remove a line or lines of
structures with wires, fixtures and other equipment related thereto (whether located on the
ground or on said structures) for the transmission of electrical current and other forms of energy
and for the transmission or communication of data, audio and video information upon, over,
under and across a portion of a tract or parcel of land owned by Grantor(s). Such tract or parcel
is located in Section 19, Township 21 North, Range 14 East, I. B & M, Tulsa County, State of
Oklahoma, and is described as follows-

5371 AND PAGE 1122, DATED DECEMBER 31, 1991
The easement and granted hereby is more fully described as follows
The South twenty -five (25) feet of the North fifty -five (55) feet of Tracts Three and Four AND
the East 33.5 feet of the West 50 feet of the North 608 10 feet of tract Four (4)
Said easement to be 25 feet in width.
For the same consideration, Grantor further grants unto said Grantee, the perpetual right,
privilege and authority: to cut down, trim, treat and dispose of any trees and undergrowth on said
easement or on the Grantor's property contiguous thereto which, in Grantee's sole judgment,
interfere or threaten to interfere with Grantee's structures, lines, fixtures and equipment, or with
Grantee's ability to construct, operate, maintain, reconstruct or remove said structures, lines,
fixtures, and equipment; to prevent the placement of any structure within said easement, to set the
necessary guy and brace poles or anchors and to attach all necessary guy wires thereto; to enter
upon the said easement over, under and across the Grantor's other property adjacent to said
easement without causing damage thereto for the purpose of constructing, operating, maintaining,
reconstructing and removing its said structures, lines, fixtures and equipment; and to construct,
operate, maintain, reconstruct, and remove such line or lines upon, over, under and across said
easement.
The failure of Grantee to exercise any of the rights granted hereby, in whole or in part, for any
period of time shall not be deemed to constitute a waiver, release, abandonment or limitation of
such easement, right, privilege or authority. Grantor(s) hereby reserves the right to make such
use of the land included within the easement as is not inconsistent with the rights, privileges and
authorities granted hereby, including, but not limited to, allow by easement, permit or otherwise,
other public utilities the right to locate within such easement provided that such location does not
unduly interfere with Grantee's use of the easement hereby granted.
Grantee agrees to relocate its facilities on said easement at its own cost if such relocation is
required due to the widening of the adjacent public roadway.
Grantor(s) hereby warrants unto Grantee that Grantor(s) will defend the easement and all rights,
privileges and authorities hereby granted against every person or persons who may lawfully claim
an interest in the property of Grantor(s) contrary thereto Grantor(s) hereby acknowledges that

The Owasso City Council met in regular session on Tuesday, October 15, 1996 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda

Mayor Ewing read and presented a proclamation to Terri Houdyshell and members of the
Owasso High School VICA Club, designating the week of October 21 -25 as Red Ribbon week
in Owasso.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A
CONTRACT FOR IMPROVEMENTS TO THE PARKING LOTS AT ELM
CREEK PARK, BETWEEN THE CITY OF OWASSO AND NEWMAN
CONTRACTING INC. AND AUTHORIZATION FOR FINAL PAYMENT
AND RELEASE OF RETAINAGE TO THE CONTRACTOR.
Mr Rooney said that this is one of two paving contracts approved by the City Council on August
20, 1996. The City Hall /Community Center parking lots still need to have some minor items
completed; however both Elm Creek parking lots have been completed and are ready for final
acceptance. Mr Standridge moved, seconded by Mr Ramey, to accept the Elm Creek Park
parking lot improvements and authorize final payment to Newman Contracting, Tulsa, Ok, in
the amount of $16,805.00.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND SANITARY
SEWER SYSTEMS CONSTRUCTED TO SERVE BARRINGTON ESTATES, I
TULSA COUNTY, OKLAHOMA.
Mr Lutz presented this item. He said final inspections have been conducted and DEQ permits
have been received. One year maintenance bonds for both utilities will be provided by the
developer and will be effective upon acceptance of the utilities. Mr Ramey moved, seconded

constructed to serve Barrington Estates.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF IMPROVEMENTS TO THE STREETS AND STORM
SEWER DRAINAGE SYSTEMS CONSTRUCTED TO SERVE WINDSOR
LAKE, TULSA COUNTY, OKLAHOMA.
Mr Lutz said that the construction of this subdivision began in the summer of 1992. The water
and sanitary sewer systems were accepted by the City Council in December 1992; however the
staff recommendation at that time was that the streets and storm drainage systems were not in
a condition to be accepted. A punch list was developed in February 1993 and an inspection in
May 1993 indicated that the work had not been done. At an inspection conducted in September
1993, areas of curbs and street paving needing repair were marked. At a neighborhood meeting
in July 1995, the developer indicated that needed repairs would be made. An inspection in May
1996 revealed that only part of the repairs had been made, and a punch list was developed. All
corrections on the punch list were completed by October 4, 1996. Discussion followed
Mr Lutz's presentation. Mayor Ewing asked about a two -year maintenance bond on the streets.
Mr Lutz said that a bond had been provided at the time the other utilities were accepted, and
staff is not requiring another bond at this time. Mayor Ewing moved to accept the street and
storm sewer drainage system constructed to serve Windsor Lake, contingent upon a two year
maintenance bond being provided. There was no second. Mayor Ewing moved to deny
acceptance of the infrastructure improvements. There was no second. Mayor Ewing moved to
table this item to a future meeting. There was no second. Mr Ramey moved, seconded by
Mr Helm, to accept the infrastructure improvements as recommended by staff.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL ACCEPTANCE OF A U.S. DEPARTMENT OF
JUSTICE GRANT TO THE OWASSO POLICE DEPARTMENT IN THE
' AMOUNT OF $1221, SUCH TO BE MATCHED WITH LOCAL FUNDS IN
THE AMOUNT OF $408.
Chief Alexander presented the item. The initial grant request included the salary for a full time
community service officer. That request was denied, but an award of $1221 was made to the
police department to assist in overtime costs incurred while performing public relations and

community policing programs. It is expected that approximately 80 hours of overtime will be
paid by this grant. Mayor Ewing moved, seconded by Mr Standridge, to accept the grant funds
totaling $1221, and that the Mayor be authorized to execute the documents necessary to that
acceptance.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR A SUPPLEMENTAL APPROPRIATION TO THE GENERAL
FUND'S POLICE DEPARTMENT BUDGET IN THE AMOUNT OF $1221
SUCH SUPPLEMENTAL FUNDING DERIVED FROM A GRANT TO THE
OWASSO POLICE DEPARTMENT FROM THE U.S. DEPARTMENT OF
JUSTICE.
Ms Bishop said that this supplemental appropriation will increase the overtime appropriation to
the General Fund Police Department Budget by $1221, as required by the grant just approved.
Mr Ramey moved, seconded by Mayor Ewing, to approve the supplemental appropriation as
requested.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST THAT THE MAYOR BE AUTHORIZED TO EXECUTE A SITE
AGREEMENT BETWEEN THE CITY OF OWASSO AND THE TULSA
SENIOR NUTRITION PROGRAM FOR THE PURPOSE OF CONTINUING
THE USE OF THE OWASSO COMMUNITY CENTER AS A NUTRITION
SITE FOR PROVIDING NOON MEALS.
Ms Worley presented the item to renew the site agreement authorizing use of the Community
Center as a nutrition site. This program has been in existence for four years and is funded
through the Tulsa Senior Nutrition Program under the direction of Sodexho Management
Services, which receives its funding from the Oklahoma Department of Aging. This site
agreement will be effective for the project year beginning October 1, 1996 and ending
September 30, 1997. Mayor Ewing moved, seconded by Mr Standridge, to approve the Senior '
Nutrition Site Agreement for the period of October 1, 1996 through September 30, 1997,
between the City of Owasso and Sodexho Management Services, and that the Mayor be
authorized to execute the document. ,

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE PURCHASE OF TABLES AND CHAIRS AND
RENOVATION OF FURNITURE FOR THE OWASSO COMMUNITY
CENTER.
1 Funds to replace tables and chairs at the Community Center and reupholster the lobby furniture
have been included in the 1996 -97 budget. Quotes were received from four companies for the
purchase of tables and chairs. Quotes were also received from three vendors to reupholster three
' couches, two ottomans and three chairs in the Community Center lobby. Ms Worley
recommended that the lowest quotes be accepted. Mr Ramey moved, seconded by
Mr Standridge, to approve an expenditure in the amount of $1920 to Harold Kight of Owasso
for upholstering services; $2090 to Adirondack Wholesale Business Furniture of Long Island,
1 New York for the purchase of 100 chairs; and $2481.50 to Adirondack Wholesale Business
Furniture for the purchase of 15 round tables.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST BY THE GREEN COUNTRY YMCA FOR CITY COUNCIL
APPROVAL OF PLANS FOR THE RENOVATION OF A BUILDING LEASED
FROM THE CITY BY THE YMCA.
' The lease agreement between the YWCA and the City of Owasso requires City Council approval
of any renovation projects undertaken by the "Y" at the facility previously used as the
Recreation Center. Mr McElrath introduced Mr John Swift, Chief Executive Officer of the
Greater Tulsa YMCA, who presented the renovation plans. The first phase of the renovation
plans calls for a complete remodel of the downstairs locker room and office areas, with the
completion of a second floor area for cardiovascular equipment. The renovation will include
' 7200 square feet of remodel and additional space. Estimated cost is $250,000, with an
additional outlay for equipment of $100,000. Future plans include building a youth activity
center, air conditioning the gymnasium, and upgrading the swimming pool and ball field
' facilities. Mr Helm moved, seconded by Mr Ramey, to approve the YMCA plans for the
renovation of the Recreation Center as presented by Mr Swift.

REQUEST FOR COUNCIL CONFIRMATION OF A MAYOR'S
APPOINTMENT TO THE OWASSO PLANNING COMMISSION SUCH
APPOINTMENT TO FILL A VACANCY CREATED BY THE RESIGNATION
OF COMMISSIONER GARY WELLS AND FOR THE REMAINDER OF THE
TERM TO WHICH MR WELLS WAS APPOINTED
Mayor Ewing requested confirmation of the appointment of Mr Bill Ellison to the Owasso
Planning Commission, filling a vacancy created by the resignation of another member of the
Commission. The term expires on June 30, 1999. Mayor Ewing moved for the appointment
of Mr Bill Ellison to the Planning Commission. Motion seconded by Mr Ramey.

The Owasso City Council met in special session on Tuesday, October 29, 1996 in the Owasso
City Hall Conference Room per the Notice of Public Meeting and Agenda posted on the City
Hall bulletin board at 4:00 p.m. on Friday, October 25, 1996.

ITEM 3: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF A FINAL PLAT FOR
BARRINGTON ESTATES, AN ADDITION TO THE CITY OF OWASSO.
A request has been received for the approval of a final plat for Barrington Estates. Barrington
Estates is located immediately east of Barrington Points I, II, and III, and immediately north of
the Owasso Eighth Grade Center. The subject plat contains 127 lots on 40.13 acres, more or
less. Construction plans have been received and approved and permits for water and sanitary
sewer have been issued by the DEQ. Mr Ramey moved, seconded by Ms Barnhouse, to approve
the final plat for Barrington Estates.

ITEM 4: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST TO CLOSE A PORTION OF A UTILITY EASEMENT LOCATED
ON LOT 43, BLOCK 5, THREE LAKES II ADDITION
The City of Owasso has initiated a request for the closing of a portion of a utility easement
located at 8810 N 121st E Ave. An in- ground pool encroaches into the rear utility easement
approximately 4.2 feet. Area utility companies have reviewed the request and have no
objections to the request. The City of Owasso has a sewer line located within the utility
easement and will require the dedication of additional easement if the closing is approved. Mr
Ramey moved, seconded by Ms Barnhouse, to approve the closing of the northerly 40 feet of
the easterly 6 feet of the rear 15 foot utility easement, with the owner granting an additional
10 foot utility easement adjacent to and to the west of the existing utility easement.

ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR AN AMENDMENT TO THE FINAL PLAT OF CENTRAL
PARK, AN ADDITION TO THE CITY OF OWASSO
The City of Owasso received a request for a plat amendment to the Central Park subdivision.
The request was to change the setback of a side yard from 25 feet to 15 feet. This request is
in compliance with the Owasso Zoning Code and the Subdivision Regulations. For a plat to be
amended, 100% of all property owners within the subdivision must approve and sign the
amendment request. That requirement was met. The Planning Commission approved the plat
amendment at a meeting on October 25, 1996 and staff offered no objections to the request.
Mr Ramey moved, seconded by Ms Barnhouse, to approve an amendment to the final plat of
Central Park, amending the building line on the east side of Lot 22, Block 1, from 25 feet to
15 feet.

ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO COUNCIL
APPROVAL OF THE EXPENDITURE OF FUNDS FOR THE PURCHASE OF
GENERAL LIABILITY INSURANCE.
For several years the City of Owasso has carried general liability insurance through the
Oklahoma Municipal Assurance Group. Prior to the renewal of the policy, a local independent
insurance agent was contacted to obtain a quote for the liability coverage. J -P Hogan Insurance
Agency of Owasso submitted a quote from National American Insurance Company which was
approximately $20 more than the existing carrier. The coverage from both companies was the
same in many areas, but there were some major differences in other areas. In the final analysis,
the liability coverage offer by NAICO offered the best plan for the City, and included the
availability of a local agent for claims handling assistance. Mr Ramey moved, seconded by
Mayor Ewing, to approved the expenditure of $50,510 to National American Insurance Company
for the purchase of a one -year general liability insurance policy.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
CONTRACT BETWEEN THE CITY OF OWASSO AND A THIRD PARTY
ADMINISTRATOR FOR THE CITY'S WORKERS COMPENSATION SELF -
INSURANCE FUND.
A Third Party Administrator is utilized by the City to administer the self - insured workers
compensation fund. The City's contract with the administrator comes up for renewal each year
in October. Quotes were received from four firms to administer the workers compensation fund,
with Berkley Administrators, our current administrator, providing the best quote. Mr Ramey
moved, seconded by Ms Barnhouse, to approve a one -year contract with Berkley Administrators
' in the amount of 41C, per $100 of payroll, to serve as the third party administrator for the self -
insurance workers compensation program.

APPROVAL FOR THE EXPENDITURE OF FUNDS FOR SELF - INSURED
WORKERS COMPENSATION EXCESS COVERAGE
One part of the risk management system utilized by the City for its self - insured workers
compensation program is the purchase of excess insurance for catastrophic claims. The current
carrier for excess workers compensation coverage is Midwest Employers Casualty Company.
The renewal premium they have provided reflects a reduction of 03C per $100 of payroll, with
the estimated annual premium at $17,012. Mr Ramey moved, seconded by Ms Barnhouse, to
approve the expenditure of .5680 per $100 of payroll to Midwest Employers Casualty Company
for the purchase of workers compensation excess insurance.

At the October 29, 1996 special meeting, the Owasso City Council recommended approval of
a request to close a portion of a utility easement located on Lot 43, Block 5, Three Lakes II
Addition.
Attached is a copy of Ordinance No. 531 which formally adopts the City Council's action of
October 29, 1996.
RECOMMENDATION:

AN ORDINANCE CLOSING TO PUBLIC USE A PORTION OF A UTILITY EASEMENT
LOCATED WITHIN LOT FORTY THREE (43), BLOCK FIVE (5), THREE LAKES II
ADDITION, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, STATE
OF OKLAHOMA, AND RETAINING UNTO SAID CITY OF OWASSO, OKLAHOMA,
THE ABSOLUTE RIGHT TO REOPEN SAME WITHOUT EXPENSE TO THE
MUNICIPALITY, AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and expedient to close .r
to public use a portion of a certain utility easement, and
WHEREAS, said utility easement is described as follows:
The northerly 40' of the easterly 6' of the rear 15' utility easement of Lot 43, Block 5,
Three Lakes II Addition, located within the City of Owasso, Tulsa County, State of P
Oklahoma; and
WHEREAS, pursuant to Title 11, Oklahoma Statutes, Section 42 -110, the only holders of
a franchise or purported holders of a franchise that may purport to have a special right or privilege
to use said utility easement are Public Service Company of Oklahoma and /or Oklahoma Natural Gas
Company, and /or Southwestern Bell Telephone Company, and /or TCI Cable Television Company;
and
WHEREAS, the above holders of franchise or purported holders of a franchise that may
purport to have a special right or privilege to use said utility easement have waived their objections
to the closure of said easement, if any.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA:
SECTION 1. That the following described utility easement, be, and the same is hereby
closed to the public use, to -wit: The northerly 40' of the easterly 6' of the rear 15' utility easement
of Lot 43, Block 5, Three Lakes II Addition, located within the City of Owasso, Tulsa County,
State of Oklahoma. '
SECTION 2. That the municipality shall retain the absolute right to reopen the public way
or easement without expense to the municipality. Closing of the public way or easement shall not
affect the right to maintain, repair, reconstruct, operate or remove utility, public service corporation, ,
or transmission company facilities of service therein, nor shall a closing affect private ways existing
by operation of law unless released in writing executed by the owners thereof.
SECTION 3. That all ordinances or parts of ordinances in conflict herewith be, and the
same hereby are, expressly repealed.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Owasso,

SUBJECT: THE FAIRWAYS H AT BAILEY RANCH
FINAL PLAT
DATE: October 31, 1996
BACKGROUND
The City of Owasso has received a request to review the final plat for The Fairways II at Bailey
Ranch, an addition to the City of Owasso. The Fairways II at Bailey Ranch is located north and
west of The Fairways at Bailey Ranch, and is best described as a continuation of the residential
development surrounding the northern portion of the golf course (that area between E. 86th
Street North and E. 96th Street North). The entire subject property is zoned PUD (Planned Unit
Development) and allows for several different size residential lots. No commercial, office, or
multi- family development is included within this final plat area. The preliminary plat for The
Fairways II at Bailey Ranch was approved at the December 1995 regular Planning Commission
meeting.
The final plat for The Fairways II at Bailey Ranch was reviewed by the Technical Advisory
Committee at their May 1, 1996 meeting. At that meeting, the area utility companies were
present to comment on the final plat. The comments on the Fairways II plat were limited to the
following:
1. A utility easement crossing along Larkin Bailey Blvd. This crossing request
has been included within your plat.
2. An 11' utility easement (filed by separate instrument) will be needed along
the north perimeter.
3. Several requests for street light utility easements were also made and are
included on the plat within your packet.
Staff comments regarding the final plat were as follows:
1. Addresses for this plat are available. They are included within the enclosed
plat.
The final plat for The Fairways II was approved at the May 12, 1996 regular Planning
Commission meeting.
Due to the time that had elapsed between the Planning Commission approval of the final plat and
the request for City Council approval of the final plat, staff requested that the plat be reviewed
one additional time at the October 30, 1996 TAC meeting. At that meeting, no utility companies
had requests for additional easements.
One concern, a concern the developer is aware of, still remains regarding The Fairways II.
Acceleration /Deceleration lanes are still needed at the entrance to this development area. The
developer has assisted with this process by constructing the entrance off of Mingo Road,
however it is the Bailey Trust's and Mr. Cartwright's responsibility to complete the required
acceleration /deceleration lanes. Staff has stated in all correspondence, and continues to state,
that these lanes must be completed prior to the occupancy of any building within Phase II. In
short, building permits can be issued but no final inspections will be conducted unless the lanes
are completed.
The construction plans have been reviewed by the Engineering Division of the Public Works
Department. Permits to construct the water and sewer lines from the Department of
Environmental Quality have been issued and Mr. Lutz will be in attendance to answer any
questions you may have regarding the construction plans.
The Owasso Subdivision Regulations require that if the plat is approved by the City Council,
building permits can not be issued for the Fairways II until:
1. Water and Sewer lines are accepted and a one year maintenance bond or
other Surety equal to 100% of the entire cost of materials for all water and
sewer line improvements has been provided by the developer.
2. Street and Storm Sewer improvements have been accepted and a two year
maintenance bond or other Surety equal to 100% of the entire cost of all
materials for all street and storm sewer improvements has been provided by
the developer;
or
In the event that Street and Storm Sewer improvements have not been
completed, a two -year performance bond or other Surety equal to 100% of
the cost of materials has been provided by the developer.
RECOMMENDATION
Having had all items from the TAC meeting addressed, staff recommends approval of the final
plat for The Fairways II at Bailey Ranch.

BACKGROUND:
At the August 20, 1996 meeting, the Owasso City Council unanimously approved two paving
contracts - the City Hall /Community Center parking lot and the Elm Creek Park parking lots.
A copy of the site plan for the City Hall /Community Center parking lot is attached for your
information and review. The Elm Creek Park parking lots were accepted at the October 15,
1996 Council meeting.
APAC - Oklahoma of Tulsa was awarded the paving and striping of the City Hall /Community
Center parking lot for the amount of $24,982.00. All bid specifications have been met by the
contractor and a final inspection has been conducted by staff.
' Funding for the City Hall /Community Center parking lot improvements was also approved by
the City Council at the August 20, 1996 regular meeting through a carry -over budget request.
A copy of the memorandum is attached for your information and review.
RECOMMENDATION:
Staff recommends final acceptance of the City Hall /Community Center parking lot improvements
and authorization of final payment to APAC - Oklahoma of Tulsa in the amount of $24,982.00.

The City of Owasso FY 1995 -96 Budget contained an appropriation for the purpose of providing
paving improvements for the City Hall /Community Center parking lot and both the west and
south parking lots at Elm Creek park. All three lots are used extensively by the public, two of
which are not paved (Elm Creek parking lots). Staff developed a bid packet for the paving
improvements in the late spring of 1996, and bid packets were available to prospective bidders
in July of 1996.
The bid packets included specifications for base repair of identified failure areas within the City
Hall /Community Center parking lot as well as the entire overlay of the parking lot; and the
paving and adding of curb areas within the Elm Creek Park parking lots. Three alternates were
also proposed within the bid packets; removal of 2" of all remaining areas that did not contain
base failure within the City Hall /Community Center parking lot, and striping alternates for all
three parking lots. Please note that the bid packets contained language reserving the right to
award the bids to the lowest individual bidder on individual base items, as well as individual
alternates.
A total of six area contractors supplied bids for the paving improvements and they were opened
on July 31, 1996 and a copy of the complete bid tally sheet is attached for your information and
review. Upon review of the submitted bids, it was determined to award each parking lot
improvement separately, rather than aggregately, as a significant cost savings could be realized.
The difference between the lowest aggregate bid amount without alternates ($45,265.00) and the
total of all the valid lowest bids on each individual project without alternates ($41,537.00) is
$3,728.00.

The base bids received for the City Hall /Community Center parking lot are as follows:

A review of these bids would indicate that APAC - Oklahoma is the lowest bid for the
improvement to this parking lot. The City of Owasso has utilized APAC- Oklahoma in the past
(E. 76th Street North and Main Street intersection) and has been pleased with their performance.
In addition, APAC - Oklahoma was also submitted the lowest bid for the striping of the City
Hall /Community Center parking lot. A review of this bid indicates that striping should also be
awarded to APAC - Oklahoma as this would be more cost effective than city personnel performing
the striping.
ELM CREEK PARK PARKING LOTS:
The base bids received for both of the Elm Creek Park parking lots are as follows:

When reviewing these bids, staff was prepared to recommend to award the Elm Creek Park west
parking lot to Newman Contracting and the Elm Creek Park south parking lot to Horizon
Construction. However, staff has concerns regarding the bid provided by Horizon Construction
because it was more than 58% lower than the next lowest bid. When Mr. Wolfe of Horizon
Construction was contacted, he stated that he was not aware that the city was prepared to award
each individual lot separately (specific language contained on page 5 of the bid packet) and that
the only way he could possibly honor that bid would be if he received both of the Elm Creek
Park parking lots.
While Horizon Construction would be the lowest bid if both of the Elm Creek parking lots were
combined ($14,369.00 vs $16,805,00), staff does not feel it would be proper to award those
projects to Horizon Construction because if the bids were awarded to the individual best bidder,
the total cost would be $12,870.00 versus the $14,369.00. While the combined $14,369.00
offered by Horizon is certainly less expensive than selecting the combined next lowest bids of
$16,805.00, remember that if Horizon Construction honored its lowest bid individually, the cost
to the city would only be 12, 870.00. Therefore, staff feels it improper to award the contract
to Horizon Construction and recommends that the Elm Creek Park West parking lot be awarded
r.+ to Newman Contracting of Tulsa (individual lowest bid), as well as the Elm Creek Park South
parking lot (individual second lowest bid).
FUNDING:
Funding for the Elm Creek Park parking lot improvements was included in the FY 1995 -96
Capital Outlay portion of the Park Maintenance budget in the amount of $8,250.00, however that
R money was not spent due to other project priorities. Therefore, staff is requesting a carry -over
budget in the amount of $16,805.00 from the Capital Outlay portion of the FY 1995 -96 budget
in order to fund these improvements. (See Agenda Item # 11)
Funding for the City Hall /Community Center parking lot was included in the FY 1995 -96
Capital Improvement Fund in the amount of $12,000.00 and was also not completed last year.
Therefore, staff is requesting the carry -over of that $12,000.00. Additionally, staff is requesting
a carry -over budget in the amount of $12,982.00 from General Government, in order to provide
the remaining funding needed for this improvement. (See agenda item #11)
RECONIl4ENDATION:
Staff recommends that the contract for the paving improvements to the City Hall /Community
Center parking lot be awarded to APAC- Oklahoma of Tulsa in the amount of $24,982.00; and
further recommends that the contract for the Elm Creek Park parking lot improvements be
awarded to Newman Contracting of Tulsa in the amount of $16,805.00.

BACKGROUND:
In August of 1996, the City of Owasso applied to the USDA Forest Service and the Oklahoma
' Department of Agriculture - Forestry Services for an "Urban and Community Forestry Grant. "
The intent of the program is to educate the people in our community about the benefits of
healthy urban forest and promote the care and maintenance of trees in urban and community
areas.
On October 4, 1996, the City of Owasso was notified by the Department of Agriculture that the
City of Owasso had been awarded the grant in the amount of $2,502. The project and program,
to be titled "A Walk in the Park ", is designed to provide information and educational
opportunities to citizens and school children regarding the importance of trees in an urban
environment, as well as provide aesthetic beauty and passive activity to the Owasso community.
` A description of the planned project outlining the complete details is included within the
application information which is attached for your information and review. The completion date,
if acceptance of the grant is approved, is scheduled for March of 1997 in order to coincide with
the first celebration of Arbor Day in Owasso.
The estimated total cost to implement the project /program is $5,451. The City of Owasso's
share is $1,705 of "in- kind" donations consisting of park labor and volunteer hours, mulch, and
an auger for planting and $1,244 of "cash outlay" for the purchase of 22 trees and t -posts for
a total local share of $2949. The total federal share of $2,502 consists of the purchase of
identification markers, drip line supplies, educational brochures and 10 trees.
' It is anticipated that the local cash outlay of $1,244 can be absorbed by the current FY 1996 -97
Park Maintenance Budget. However, staff is requesting Council approval of an amendment to
' the Park Maintenance Budget, increasing revenue by $2,502 and increasing expenditures by the
same amount, in order to provide proper administration of the proposed grant and existing
budget.

RECOMMENDATION:
Staff recommends Council acceptance of the Community Forestry Grant in the amount of
$2,502, and an amendment to the FY 1996 -97 Park Maintenance Budget, increasing revenue and
expenditures by $2,502.

"A WALK IN THE PARK"
The City of Owasso Parks Department is requesting funding through The Oklahoma Department
of Agriculture - Forestry Services, in cooperation with the U.S.D.A. Forest Service and the
Oklahoma Urban and Community Forest Council, in order to develop the only arboretum in the
Owasso area. ■
The project and program, to be titled "A Walk in the Park" is designed to provide information
and educational opportunities to citizens and school children regarding the importance of trees
in an urban environment, as well as provide aesthetic beauty and passive activity to the Owasso
community.
The Owasso Sportspark, located in the northern portion of the City of Owasso, is publicly
owned land and is maintained by the City of Owasso Parks Department. The Sportspark is the
current home for all youth baseball, football, soccer, and softball programs and boasts an annual
increasing user attendance, and was the site of NIT tournaments for softball in 1995 and 1996.
"A Walk in the Park" will be the first phase of a walking trail that will eventually encompass
the 80 acre Sportspark. Designed primarily as an educational tool, "A Walk in the Park" would
allow for individual tours through the use of a brochure. The brochure would include
fundamental forestry information, tree trivia, and a detailed site plan and narrative for each tree.
In addition to the self - guided tours, group tours would also be conducted by park personnel
when approached by the Owasso Public Schools, Boy Scouts, Girl Scouts, and the YMCA
regarding field trips within the city's park system.
In addition to the brochure, identification markers will be located throughout the project
containing information about each tree. The initial phase calls for the planting of 32 trees, all
of which would be of a different species, with all maintenance of the trees being performed
exclusively by park personnel. A drip irrigation system for the trees is proposed in order to
ensure an adequate water supply to each tree. Tree planting, mulching, and staking will be
organized in cooperation with Network Owasso, a United Way sponsored program in Owasso
which organizes volunteer efforts within the community. Irrigation installation, tree marker
design and installation, as well as pamphlet layout will be performed by city personnel.
Completion date of "A Walk in the Park" is scheduled for March of 1997 in order to coincide
with the first celebration of Arbor Day in Owasso, Oklahoma. It is hoped that Phase II of the
program will be a natural progression of Phase I, with additional trees being planted annually
by the City of Owasso on Arbor Day and through trees "sponsored" by area merchants and
private citizens.

BACKGROUND:
The subdivision is located between East 76th Street North and 86th Street North, about one -
fourth mile east of North Mingo Road (see attached map). The utilities consist of 1,200 LF of
8 -inch, 2,500 LF of 6 -inch and 1,330 LF of 4 -inch water lines and 8,405 LF of 8 -inch sanitary
sewer lines. Oklahoma Department of Environmental Quality construction permits No.
WL000072960745 for water and SL000072960746 for sewers have been issued (see attached).
Designs for these systems were reviewed and construction inspected by Public Works personnel
in accordance with City of Owasso standards..
A final inspection for the water and sewer systems was conducted by Public Works personnel
on October 30, 1996 and a punch list of required corrections needed to meet City of Owasso
standards was forwarded to the developer on October 31st (see attached list). All corrections
were completed by October 31, 1996.
One -year maintenance bonds for the water has been provided (see attached) and the bond for the
sewer system will be provided prior to acceptance. The bonds will become effective upon
Council acceptance of the utilities.
RECOMMENDATION•
Staff recommends Council acceptance of the water and sanitary sewer systems for Fairways II
subdivision.

Pursuant to O.S. 27A 2 -6 -401, the City of Owasso is hereby granted this permit to construct
8405 I.f. of eight (8) inch sewer line and appurtenances to serve the Fairways II at Bailey
Ranch, located in the W/2 of Section 19, T -21 -N, R14 -E, I.M., Tulsa County, Oklahoma, in
accordance with the plans and specifications approved on September 12, 1996.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in
accordance with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the
state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date
of approval or the phases not under construction will be resubmitted for approval as
a new project.
3) That no significant information necessary for a proper evaluation of the project has
been omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with OAC 252:655 -9 -1 (h) of the
Standards for Water Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer
lines will prevent excessive infiltration and that the leakage will not exceed 200 gallons
per inch of pipe diameter per mile per day.

1200 I.f. of eight (8) inch water line, 2500 I.f. of six (6) inch water line, 1300 Lf. four (4) inch
water line and appurtenances to serve the Fairways II at Bailey Ranch, located in the W/2 of
Section 19, T -21 -N, R -14 -E, I.M., Tulsa County, Oklahoma, in accordance with the plans
approved on September 12, 1996.
By acceptance of this permit, the permittee agrees to operate and maintain the facility in
accordance with the Public Water Supply Operation rules (OAC 252:630) and to comply with
the State Certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date
of approval or the phases not under construction will be resubmitted for approval as a
new project.
3) That no significant information necessary for a proper evaluation of the project has been
omitted or no invalid information has been presented in applying for the permit.
4) That the State Department of Environmental Quality shall be kept informed on
occurrences which may affect the eventual performance of the works or that will unduly
delay the progress of the project.
5) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with Public Water Supply
Construction Standards (OAC 252: 625- 17 -4).

DATE: October 30, 1996
BACKGROUND:
Public Works Department staff compiled information pertaining to needed street repairs in
response to the establishment of funding in the FY96 -97 Capital Improvement Fund budget.
Sites within the city limits were visited, investigated and scope of work identified. Costs for
each repair site were estimated. The estimated cost for 104 identified projects was $869,802
compared to budgeted funds of $68,000 (Fund 51- 410 - 5461). Because the estimated cost for all
projects exceeded available funds, a prioritized list based on affordability, visibility, and
previously identified projects was developed. The prioritized list of 23 projects with an
estimated cost of $66,330 was approved by the Council on August 6, 1996. A map and
summary of projects approved by Council are at Attachments 1 and 2.
PERFORMANCE OF WORK:
Approved projects were anticipated to be performed by either City forces or by contract
depending on scope of work and locations which could be effectively repaired by the City. The
larger repair sites were to be contracted. This resulted in eight projects with an estimated cost
of $11,665 to be done by City forces and 15 projects with an estimated cost of $54,675 to be
contracted. The contract project list and locations are shown on Attachment 3.

Specifications and drawings were prepared by Engineering Division commensurate with those
developed for the FY95 -96 street repair project. The solicitation was for each site as a bid item
with award of the total project based on the total lump -sum bid. Contract payments will be
based on the actual amount of work item done under each project.
Bids were received on October 28, 1996. A total of 10 bids were received with a bid range
from $36,201.50 to $93,077.00. The engineer's estimate is $54,765. A bid tabulation is at
Attachment 4.
BID ANALYSIS•
AM Rail Construction of Tulsa, Oklahoma, was the apparent low bidder with a bid of
$36, 201.50. AM Rail complied with all solicitation requirements, has provided evidence of
similar work and provided references for previous work done by the firm. Staff has contacted
these references and verified that AM Rail has a good reputation for quality of work and
timeliness. Due to the large difference between the low bid and the engineer's estimate and
other bids, AM Rail was asked to verify his bid. Attachment 5 are letters which constitute this
verification.
FUNDING SOURCE:
Funds for this project are included in the FY96 -97 Capital Improvement budget (Fund 51 -410-
5461).
RECOMAlENDATION:
The staff recommends Council approval for award of the FY96 -97 Streets Repairs and
Modifications contract to AM Rail Construction in the amount of $36,201.50.

BACKGROUND:
The Owasso Police Department has been working toward updating the current "Animal
Regulations" found in "Part Four (4)" of the Owasso City Code. This update of the city code
was necessary to meet the challenges that the Animal Control Division is faced with in a
community that is growing as quickly as Owasso has been. Many of the revisions found in
Section 4, 101 through 4, 180 (inclusive) of the ordinance are minor in nature. There are six
(6) major changes, however, that are included in this new ordinance. These changes are as
follows:
1. Under the new Wild and Exotic Animal Section - boas, pythons, and iguanas will
be allowed with a permit. All other wild or exotic animals (by definition) are
prohibited.
2. No bees or bee hives are proposed to be allowed within the city limits.
3. There are proposed limitations to the number of animals that may be kept by
Owasso residents.
4. Cruelty to Animal Sections have been expanded to cover a number of abuse cases
which were not addressed previously.
5. No animals will be allowed to be given away in a public places (i.e. businesses,

While in the process of updating this ordinance, input from the City Attorney was included in
regard to all changes, and the final document has been reviewed and approved by him.
Additionally, a Public Hearing on the proposed ordinance was held October 3, 1996 at the
Owasso Public Library.
EMERGENCY CLAUSE:
While it is the normal policy of the staff to avoid the use of emergency clauses except in those
cases where a true emergency exists, in this case the staff believes it to be in the best interest
of the city to attach an emergency clause to this ordinance. The reason for such action is to save
substantial expense to the city. State Statute requires that, upon Council adoption of an
ordinance, the entire content of the ordinance must be published in a newspaper's "legal notice"
section. However, the law also exempts from that requirement any ordinance that has an
emergency clause attached. In those cases, only the title of the ordinance must be published.
Since this ordinance is approximately 30 pages in length, the estimated cost of publication is
$800.00. However, if we attach an emergency clause and publish only the title, the estimate
cost of publication is $70.00, a savings of $730.00. Additionally, if the emergency clause
contains language that provides for an effective date of December 7, 1996 (as the language in
this ordinance does), then the intent of the publication law will have been met without the cost
to the city.
RECOMMENDATION:
The staff recommends Council adoption of Ordinance #532, amending and revising Part Four,
Section 101 through Section 180 (inclusive) of the Owasso City Code. It is further
recommended that the Council attach an emergency clause to Ordinance #532 providing for an
effective date of December 7, 1996.

IDATE: October 4, 1996
The Public Hearing for the proposed revisions to the animal control ordinance was held at the
Owasso Public Library on October 3, 1996, from 7:00 - 8:00 pm. Eight persons were in
attendance. The review of the ordinance and the questions which arose included;
1. A consideration of a Grandfather clause for those individuals who currently have situations
which under the new ordinance would be in violation.
2. Fostering and /or harboring wild animals for the purpose of care was discussed.
3. Further specificity was requested with regard to prohibited animals, reptiles and insects.
4. Requirement of veten*nary personnel to notify animal control should a prohibited pet be brought
in for medical attention.
r 5. Annexation concerns regarding areas which had previously had no prohibition in this area and
upon annexation would be required to conform to current city ordinances was also discussed.
The meeting revealed areas which would require further research into the state statute. Mr Cates
assured the audience that research would be performed and the ordinance revised accordingly prior
to the proposal to City Council.
4- Those who attended the meeting were advised that the ordinance was expected to go to City Council
on Tuesday, October 15, 1996. Participant were also advised to notify the animal control division
or the police department if further questions arose.
