Adjournment 1 1 1 1 OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, November 5, 1996 ' The Owasso City Council met in regular session on Tuesday, November 5, 1996 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, November 1, 1996, and ' Addendum to Agenda posted on the City Hall bulletin board at 11:00 a.m. on Monday, November 4, 1996. ITEM 1: CALL TO ORDER Mayor Ewing called the meeting to order at 7:05 p. m. s ~ ITEM 2: INVOCATION The invocation was given by Councilor Dr Tracy Standridge. ITEM 3: FLAG SALUTE Mr Ramey led in the flag salute. ' ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #531 AN ORDINANCE PROVIDING FOR THE CLOSING OF A PORTION OF A UTILITY EASEMENT LOCATED ON LOT 43 BLOCK 5 THREE LAKES II ADDITION TO THE CITY OF OWASSO TULSA COUNTY. OKLAHOMA At the November 5, 1996 meeting, the Owasso City Council approved a request to close a '~ portion of a utility easement located on Lot 43, Block 5, Three Lakes II addition. Ordinance #531 formally adopts that action. Mr Ramey moved, seconded by Mr Standridge to approve Ordinance #531. AYE: Ramey, Standridge, Barnhouse, Ewing NAY: None Motion carried 4-0. 2 Owasso City Council November 5, 1996 ' ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE ZUEST FOR COUNCIL APPROVAL OF A FINAL PLAT FOR THE FAIRWAYS II AN ADDITION TO THE CITY OF OWASSO TULSA COUNTY. OKLAHOMA. The City of Owasso has received a request to review the final plat for The Fairways II. The subject property is located north and west of The Fairways at Bailey Ranch, and is a continuation of the residential development surrounding the northern portion of the golf course. It contains 84 lots on 28.90 acres; more or less. The plat has been reviewed by the Technical Advisory Committee and the Planning Commission, with both bodies recommending approval. Mr Ramey moved, seconded by Ms Barnhouse, to approve the final plat for the Fairways II. AYE: Ramey, Barnhouse, Standridge, Helm, Ewing NAY: None Motion carried 5-0. ' ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT FOR IMPROVEMENTS TO THE PARKING LOT AT CITY HALL/COMMUNITY CENTER BETWEEN THE CITY OF OWASSO AND APAC-OKLAHOMA INC AND AUTHORIZATION FOR PAYMENT IN THE AMOUNT OF $24,982. Mr Rooney said that this is one of two paving contracts approved by the City Council on August 20, 1996. The parking lots at Elm Creek park were accepted at the October 15, 1996 City Council Meeting. However, the City Ha1UCommunity Center parking lot still needed to have some minor items completed at that time. Those items have now been completed, and staff recommended final acceptance of the work. Mr Ramey moved, seconded by Mr Standridge, to accept the City Hall/Community Center parking lot improvements and authorize final payment to APAC-Oklahoma, Tulsa, Ok, in the amount of $24,982.00. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. ~ ' Owasso City Council November 5, 1996 ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR ACCEPTANCE OF A GRANT FROM THE OKLAHOMA DEPARTMENT OF AGRICULTURE AND THE UNITED STATES FOREST SERVICE. In August 1996, the City of Owasso applied to the USDA Forest Service and the Oklahoma Department of Agriculture-Forestry Services for an Urban and Community Forestry Grant. The purpose of the program is to educate the citizens of our community about the benefits of healthy urban forests and to promote the care and maintenance of trees in urban and community areas. On October 4, 1996, notification was received of the award of the grant in the amount of $2502. Various activities, including the planting of trees at the Sports Park, are included in the project. If the grant is accepted, the targeted completion date is scheduled for March of 1997, in order to coincide with the first celebration of Arbor Day in Owasso. Mr Standridge moved, seconded by Mr Ramey, to accept the above-mentioned grant in the amount of $2502. AYE: Standridge, Ramey, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR A SUPPLEMENTAL APPROPRIATION TO THE GENERAL FUND'S PARK MAINTENANCE BUDGET IN THE AMOUNT OF $2502, SUCH SUPPLEMENTAL FUNDING DERIVED FROM A GRANT TO THE CITY OF OWASSO FROM THE USDA FOREST SERVICE AND THE OKLAHOMA DEPARTMENT OF AGRICULTURE-FORESTRY. The requested supplemental appropriation will increase revenues and expenditures in the General Fund Park Maintenance Budget by $2402, the amount of the grant approved in the previous item. Mayor Ewing moved, seconded by Ms Barnhouse, to approve the supplemental ~ appropriation as requested. AYE: Ewing, Barnhouse, Standridge, Helm, Ramey NAY: None Motion carried 5-0. 4 Owasso City Council November 5, 1996 ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND SANITARY SEWER SYSTEMS CONSTRUCTED TO SERVE THE FAIRWAYS II, AN ~,,. ADDITION TO THE CITY OF OWASSO, TULSA COUNTY OKLAHOMA. Mr Lutz presented this item. He said final inspections have been conducted and DEQ permits have been received. A one year maintenance bond for the water system has been provided and the bond for the sewer system will be provided by the developer. Both bonds will be effective upon acceptance of the utilities. Mr Ramey moved, seconded by Mr Standridge, to accept the improvements to the water and sanitary sewer systems constructed to serve The Fairways II. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE AWARD OF A BID FOR STREET REPAIRS AND MODIFICATIONS AT VARIOUS LOCATIONS WITHIN THE CITY OF OWASSO. The FY96-97 Capital Improvement Fund Budget contains funding for street repairs at various sites throughout the city of Owasso. The Public Works Department has identified and prioritized a list of projects to be completed, and the City Council approved the prioritized list on August 6, 1996. Bid documents were prepared and bids solicited for street repairs. The solicitation was for each site as a bid item, with award of the total project based on the total lump sum bid. Ten bids were received and opened on October 28, 1996. The bid range was from $36,201.50 to $93,077.00. The engineer's estimate was $54,765.00. References of the low bidder were checked, and the low bidder was asked to verify his bid. Mr Ramey moved, seconded by Mr Standridge, to awazd the bid for street repairs and modifications at vazious locations within the city of Owasso to AM-Rail Construction, Tulsa, OK in the amount of $36,201.50. AYE: Ramey, Standridge, Barnhouse, Helm, Ewing NAY: None Motion carried 5-0. 5 Owasso City Council November 5, 1996 ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #523 AN ORDINANCE AMENDING PART 4~ ANIMALS CHAPTER 1 ANIMAL REGULATIONS OF THE CODE OF ORDINANCES OF THE CITY OF OWASSO For several months the Police Department has been working toward updating the current animal regulations found in Part 4 of the Owasso City Code. Many of the changes are minor in nature, but there are six major changes suggested: 1. Under the new Wild and Exotic Animal section -boas, pythons, and iguanas will be allowed with a permit. All other wild or exotic animals (by definition) are prohibited. 2. No bees or bee hives are proposed to be allowed within the city limits. 3. There are proposed limitations to the number of animals that may be kept by Owasso residents. 4. Cruelty to Animal sections have been expanded to cover a number of abuse cases which were not addressed previously. 5. No animals will be allowed to be given away in a public place (i.e. businesses, parks, shopping centers, etc). 6. No animal can be adopted without first insuring that shots and spaying/neutering will occur. The City Attorney was included in the preparation of the document, and a Public Hearing on the proposed ordinance was held. Following a lengthy discussion focused primarily on the removal or animal waste and the penalty for not following the code, Mayor Ewing moved to table the item to the next regular City Council meeting to allow time for answers to be provided for the questions that were raised. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE ATTACHMENT OF AN EMERGENCY CLAUSE TO ORDINANCE #532 Because of the motion to table item 14, this item wasn't needed and was stricken from the agenda. 6 Owasso City Council November 5, 1996 ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE GRANTING OF A UTILITY EASEMENT TO PUBLIC SERVICE COMPANY OF OKLAHOMA FOR THE LOCATION OF AN ELECTRICAL SYSTEM, GENERALLY LOCATED ON THE SOUTH SIDE OF 96TH STREET NORTH ALONG THE NORTHERN BOUNDARY OF BAILEY GOLF RANCH. PSO has requested a utility easement along a portion of East 96th Street North and Mingo Road contiguous to golf course property in order to locate overhead utility lines. The lines would be located far enough from the existing row of power lines to accommodate the future widening of the streets. Mr Helm moved, seconded by Ms Barnhouse, to grant the requested utility easement to PSO. AYE: Helm, Barnhouse, Standridge, Ewing NAY: None Motion carried 4-0. ITEM 17: REPORT FROM CITY MANAGER No report. ITEM 18: REPORT FROM CITY ATTORNEY No report. ITEM 19: REPORT FROM CITY COUNCILORS Mayor Ewing read a letter from Mr Ralph Mason, Chairman of the Wychavon District Council located near Worcester, England. Mr Mason thanked the City Council and the citizens of Owasso for a placque that Rev Bill Caudle presented to him on a recent visit to England. ITEM 20: UNFINISHED BUSINESS None. While it is only speculation on my behalf as to exactly what Mr. Johnson will be requesting, I am anticipating that the Owasso Public Schools is unhappy with the site plan requirements of the Owasso Sixth Grade Center and will be requesting leniency. In order for a public school (defined as a Use Unit 5 by the Owasso Zoning Code) to be permitted for development and use in any residential district, it is first necessary to obtain a ~' Special Exception from the Owasso Board of Adjustment. A Special Exception allows a development or use of property that would not ordinarily be permitted in a zoning district to occur. The Owasso Board of Adjustment reviewed the request for the Owasso Sixth Grade Center at their August 27, 1996 regular meeting. At that meeting, the Owasso Board of Adjustment recommended approval of the Special Exception request for the Owasso Sixth Grade Center with the following condition: 1. All site plan and platting requirements that are requested by TAC and the Planning Commission be met by the applicant. A copy of the minutes from the Owasso Board of Adjustment's August 27, 1996 regular meeting are attached for your information and review. The Owasso Planning Commission reviewed the site plan for the Owasso Sixth Grade Center at their September 10, 1996 regular meeting. While it was previously thought that applicants had the ability to appeal site plan decisions made by the Planning Commission to the City Council, there is no language contained within the Owasso Zoning Code that directly or indirectly describes an appeal process for the review of site plans. Also, because the Owasso Board of Adjustment conditioned the approval of the Special Exception of the Owasso Sixth Grade Center on all platting and site plan requirements of the Planning Commission and TAC being met by the applicant, it would appear that not only is there no appeal process on the site plan recommendations through the City Council, but also legally the City Council has no ability to intervene even if you so desired. It would appear that if Owasso Public Schools is desirous of deviating from the site plan requirements, two options are currently available: 1. The applicant may request reconsideration of the conditions of approval of the Owasso Sixth Grade Center site plan from the Planning Commission, or 2. The applicant may request reconsideration of the conditions of approval for the Special Exception of the Owasso Sixth Grade Center through the Board of Adjustment. The applicant may appeal the decision of the Owasso Planning Commission or the Owasso Board of Adjustment to the District Court depending upon which of the above procedures is pursued. The purchase was scheduled for the second half of the fiscal year. Subsequently, on November 27, 1995, bids were received for that purchase, and the City Council awarded a contract on January 2, 1996 to Sinor Emergency Vehicle Sales Inc, Clinton, OK, to build the ambulance according to the published specifications. The delivery of the ambulance was delayed on several occasions and it was not delivered until October 11, 1996, three months after the end of FY 1995-96. One June 18, 1996, the City Council adopted a FY 1996-97 budget that did not include funds for the ambulance. The staff determined that acarry-over budget request for the purchase would be made, along with other such carry-over requests. However, at the time of the normal carry- over request, the ambulance had still not been delivered and questions were raised regarding the ability of the company to deliver on the contract. Thus, no request was made for acarry-over appropriation at that time. Those questions were resolved, and on October 4 & 5, 1996, a quality inspection of the ambulance was conducted by the Owasso Fire Department. Subsequently, on October 11, 1996, the contractor delivered the ambulance to the Owasso Fire Department. The ambulance was placed in service on October 18, 1996. Upon receipt and acceptance of the ambulance, a check in the exact amount of the bid was delivered to the contractor (the evening the ambulance was shown at the Council meeting). Unfortunately, however, the required supplemental appropriation was not presented to the City Council prior to the payment being made, an oversight on the part of the City Manager that technically was not in compliance with statutes requiring funds to be appropriated prior to their expenditure. The City Treasurer discovered the problem and relayed it to the City Manager with a recommendation that action be taken to remedy the problem. The action necessary to correct SUPPLEMENTAL APPROPRIATION NOVEMBER 12, 1996 PAGE 2 the problem is a supplemental appropriation to the Ambulance Capital Fund in the amount of $91, 684, the exact amount of the bid. Attached for your review are memoranda and information that follows the progress of the ambulance purchase and Council action relating to that purchase. FUNDING: Funding for the requested appropriation is available in the Ambulance Capital Fund and was anticipated to be expended in the purchase of a replacement ambulance. After paying for this purchase, approximately $100,000 will remain in the Ambulance Capital Fund, providing a reserve for emergency equipment replacement or the next regular ambulance replacement. RECOMMENDATION• The City Manager recommends City Council approval of a supplemental appropriation in the amount of $91,684 to the Ambulance Capital Fund from reserves held by that fund. The committee has provided a detailed report concerning the outcome of bids and the committee recommendation. Continuous Quality Improvement (CQI) process was utilized by the committee. We feel assured that all customer requirements were identified. Specifications were developed to ensure that the present and future needs of the city were taken into consideration. This year we specified that the ambulance being replaced (Medic-2) be considered as a trade-in unit. We are currently at the ten (10) year point in our ambulance replacement program, requiring the purchase of a complete new unit rather than just a chassis remount. As part of our bid review process, we contacted Public Works Director Robert Carr to see if his department was interested in purchasing the trade-in ambulance. Mr Carr stated that the trade-in ambulance would be a very valuable asset to his department. If we are allowed to transfer Medic-2 to the Public Works Department, a fund transfer of $7500.00 from OPWA to the Ambulance Capital Outlay Fund would be necessary. The motion to table action at the November 5th meeting included language that required it to be brought back to the Council on November 19th. However, discussion with Chief Alexander indicates that members of the Council have questions that, as of this date, have not been addressed because of scheduling conflicts that have prevented the parties coming together for a meeting. Many of the changes are minor in nature, but there are six major changes suggested: 1. Under the new Wild and Exotic Animal section -boas, pythons, and iguanas will be allowed with a permit. All other wild or exotic animals (by definition) are prohibited. 2. No bees or bee hives are proposed to be allowed within the city limits. 3. There are proposed limitations to the number of animals that may be kept by Owasso residents. 4. Cruelty to Animal sections have been expanded to cover a number of abuse cases which were not addressed previously. 5. No animals will be allowed to be given away in a public place (i.e. businesses, parks, shopping centers, etc) . 6. No animal can be adopted without first insuring that shots and spaying/neutering will occur. The City Attorney was included in the preparation of the document, and a Public Hearing on the proposed ordinance was held. LOCATION AND SIZE: The general location of the subject property is the northwest ' corner of E. 86th Street North and N. 145th E. Avenue. A copy of the complete legal descriptions for both areas involved in the rezoning are attached for your information and review, as well as subject maps. The subject property contains approximately 141.30 acres, ' more or less. The portion requesting rezoning to RS-2 is comprised of 136.30 acres, while the portion requesting CS zoning totals 5 acres. ~ EXISTING LAND USE: The subject property is currently undeveloped. SURROUNDING LAND USE: The subject property is abutted on the north by the proposed phase III of Nottingham Estates and several large parcel land owners with single- family residences. To the east of the subject property lies N. 145th E.Avenue, while further ' east lies undeveloped land and single-family residential development zoned RS-40 (Roger's County). To the southeast lies Pamela Hodson Elementary School zoned C-1 (Roger's County), while south of the subject property lies E. 86th Street North and the undeveloped ' Kaiser Francis property zoned OL (Office Light) and RS-2 (Single-Family Residential Medium Density). The Owasso Board of Adjustment recently approved a Special Exception request in order to allow for the development and use of a church on a portion of the Kaiser- ' Francis RS-2 property. West of the subject property lies the proposed Brentwood Park and future phases of Brentwood Estates, also zoned RS-2. . APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments", Chapter 4 "Residential District Provisions" and Chapter 6 "Commercial district Provisions". SITE INFORMATION: No unusual development hardships are noted. ANALYSIS The proposed rezoning, if approved, would create the needed underlying zoning in order for OPUD-14 to be considered by the Planning Commission. While a more detailed review of the overall plans for the subject property are contained within the OPUD-14 staff report (next agenda item), it is important to review some of the basic facts when reviewing this rezoning request. A majority of the land located within this square mile section, and the square mile section to the south, is currently zoned for residential development at an RS-2 density or higher. These areas would consist of Windsor Lake I and II, Windsor Lake II Extended, Camden Park, Barrington Point I, II, and III, Barrington Estates, Brentwood Estates, Brentwood Park, Copper Meadows, and a large portion of the Kaiser-Francis property. Not only is the request for RS-2 zoning consistent with the past development trends in the area, it also meets the Comprehensive Plan of the area. ~ The 5 acre parcel which is requested to receive CS (Commercial Shopping Center) zoning also is consistent with the Comprehensive Plan and its recommendations for creating ' commercial nodes at the intersections of arterial streets. The "activity centers", as they are described by the Comprehensive Plan, call for 20 acres of commercial zoning at each _ intersection with 5 acres being located at each corner. If the zoning request is approved by the Council, as well as OPUD-14, all development review processes will occur. CITY OF OWASSO Community Development Department OPUD-14 Staff Report CONCEPT OF A PUD The concept behind a Planned Unit Development is to provide a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in planning and development of large parcels of land. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete. coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND Planned Unit Development #14 is 141.30 acres in size, all of which is undeveloped. A portion of the subject tract is zoned RS-2 (Residential: Single-Family Medium Density) District, while a majority of the subject tract is zoned AG (Agriculture). It is located between 86th and 96th Street North, west of 145th East Avenue. PUD #14 will lie northeast of the existing Brentwood Estates addition and the proposed Brentwood Park addition. Portions of the subject tract are abutted on the west by the proposed Brentwood Park Addition and undeveloped RS-2 zoned property. Northern portions of the subject tract are bordered by the proposed additional phases of the Nottingham property and several large acre home sites outside of the city limits zoned AG (Agriculture). The subject tract is bordered on the east by 145th East Avenue and on the south by E. 86th Street North. (See Case Map) The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and Text. The plan and text call for the development of 5 acres of Commercial development with an underlying zoning of CS at the southeast corner of the subject site, abutting N. 145th E. Avenue and E. 86th Street North, and 136.3 acres of residential development which would include allowance for the development of three different sized residential lots. This PUD application is accompanied by a zoning application (OZ-96-O1) requesting a zoning consisting of 5 acres of CS (Commercial Shopping) and 136.3 acres of RS-2 (Residential Single-Family Medium Density). The staff has recommended approval of Zoning Case OZ- 96-01, and the following analysis is based upon zoning case OZ-96-O1 being approved by the Council. Staff Report ' OPUD-14 Page 2 of 9 STAFF ANALYSIS ' Because PUD's are not a normal agenda item at every City Council meeting, I feel it is important to establish a quick review of the PUD requirements and process. The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall ' determine: (1) Whether the PUD is consistent with the Comprehensive Plan. (2) Whether the PUD is in harmony with the existing and expected development of surrounding areas. (3) Whether the PUD is a unified treatment of the development possibilities of the project site. (4) Whether the PUD is consistent with the stated purpose and standards of the PUD Ordinance. This means that when zoning or PUD requests are presented to the Planning Commission and City Council, they should be consistent with the Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the majority of the subject tract to be developed as Low Density Residential. In addition, a portion of the subject tract located in the southeast corner is designated to be utilized as Medium Density Residential and Commercial-Office. When one reviews the applicant's submittal of residential areas of varying lot sizes throughout the M ~~ Staff Report OPUD-14 '~ Page 3 of 9 development with the Comprehensive Plan, one may conclude that the request adheres to the guidelines. N A majority of the land that has developed within the square mile section bounded by N. 129th E. Ave, 96th Street, N. 145th E. Ave, and 86th Street has developed in a medium density format or higher. When the Comprehensive Plan was completed in 1985, it was stated that necessary infrastructure (water and sewer lines) were not anticipated to be located within this area in the near future and thus the lower density. Also, the Comprehensive Plan states that if, for example, an area designated for Low Density Residential Development and ~~ a rezoning to RS-3 (Residential High Density) is requested, this is not in conflict with the plan. Three different sized residential lots are proposed within the area designated for residential development. The southern one-third of the subject property is designated for 70 x 125' (average) titled executive homesites. The second area is located within the northern two- thirds of the subject property and will feature 80 x 130' lots (average) titled premier homesites. The third area is located east of the planned Nottingham III addition and around the existing pond with average lot sizes of 100 x 135' lots. Planning Staff would recommend R allowing slight deviations in density of dwelling units (15 %) from one form of single-family residential area to another single-family residential area providing no significant change in the character of the either area is created. '° The Comprehensive Plan also designates 20 acres of proposed commercial development at the intersections of arterial streets (5 on each corner) termed "activity centers. " The ' "activity centers" would allow for commercial, office, and multi-family housing development. The applicants have indicated a preference for commercial development at this area as described within their PUD application. OZ-96-O1 would provide for an underlying ' zoning of CS (Commercial Shopping Center). Due to the proximity of Pamela Hodson Elementary, staff encouraged the applicants to ' include language within the PUD that limited the type of commercial activity that could possibly accompany commercial development. The applicants have included language within the Outline Development Plan that prohibits free standing bars or taverns and adult ' entertainment businesses. With the previous facts in mind, it would be staff's opinion that the PUD proposed by the applicant would be consistent with the Comprehensive Plan. rt Staff Repo OPUD-14 Page 4 of 9 Harmonx With Existing and Expected Development Any large development such as the proposed PUD is going to create changes within a community and new demands will be placed upon our existing infrastructure. It is important r1 to note, however, that in a community like Owasso, this growth would be likely to occur regardless of this development. The PUD simply has the potential to increase the demand for services more quickly and therefore shortens the schedule for determining solutions. In reviewing existing development, it would appear that the proposed PUD and subsequent subdivision would be a logical expansion of the Brentwood Estates, proposed Brentwood Park, and Nottingham Estates area. When reviewing future development possibilities south of E. 86th Street North (Kaiser Francis Property), zoning exists on this property to develop predominately in a residential manner. This is also the case along a large portion of the subject property's east boundary with residential lots in Roger's County. The 5 acre commercial area being proposed would also appear to be consistent with development trends at arterial intersections. Property at the southwest corner of the E. 86th Street and N. 145th E. Avenue intersection is zoned OL (Office Light) and has not developed. Property at the southeast corner (Rogers County) is developed as Pamela Hodson Elementary School, however it is zoned C-1 which would have permitted a multitude of commercial uses. Property at the northeast corner is zoned AR (Roger's County) and contains a large portion of undeveloped land. It is staff's opinion that development which would be permitted with both the requested underlying zoning, as well as the proposed PUD, would be consistent with existing and expected development with one exception. (See Unified Treatment of the PUD .Subject Area) Legal, Planning and Site Engineering While the applicants have stated within the application that both the proposed detention pond and the existing pond will contain and address their drainage needs, staff would recommend the requirement of a detailed drainage report and certification of such document by an engineer at time of platting. If the report indicates that a larger drainage detention area is needed, a result of fewer residential lots is likely to occur. Typically, these items are addressed during the platting stages of the subject property. Staff Report OPUD-14 Page 5 of 9 Internal street patterns and the connections to future stages of Brentwood Estates' streets appear to be of a logical and sensible pattern. A possibility of "thru" traffic traversing the subdivision exists; however staff would also state that if the proposed lot layout proceeds in the manner indicated by the PUD submittal, a stop sign should be required at the third 4-way intersection from E. 86th Street North in order to discourage "thru" traffic. This would meet current spacing requirements contained within the City of Owasso's Residential Neighborhood Traffic Control Policy. The applicants have indicated one access off of E. 86th Street North and two off of N. 145th E. Avenue. Staff has no concerns with the number of access points being proposed, but would suggest that the northernmost access point on N. 145th E. Avenue line up with that of the southernmost access point of the residential addition in Roger's County (Whispering Pines). Furthermore, staff would also recommend the inclusion of acceleration deceleration lanes at each entrance point off of any arterial street. Pedestrian traffic is likely to be in demand due to the proximity of the Pamela Hodson Elementary School and any commercial development that would take place at the intersection. Staff would also recommend the inclusion of sidewalks along both E. 86th Street North and N. 145th E. Avenue. The lot layout proposed within the PUD conceptual development plan is relatively solid and would appear to meet the requirements of the Owasso Subdivision Regulations. The first cul-de-sac off of the southernmost access from N. 145th E. Avenue, however, contains what would appear to be a "flag lot." In order to be consistent with staff and Council comments regarding "flag lots", staff would also recommend that no flag lots be permitted. Unified Treatment of the PUD Subject Area A review of the applicant's Illustrative Site Plan for "Silver Creek" finds an excellent utilization of the project site. As stated within the applicant's submittal, drainage within the undeveloped project site is oriented mostly from north to south in nature. The utilization of the existing lake within the northerly portion of the site is appropriate. In addition, the applicant's have indicated a second detention area along the southern portion of the proposed development and have also indicated that this detention area not resemble a "square-hole" detention facility but rather one that is aesthetically pleasing, with surrounding azea usable by the residents of Silver Creek. As a result, this area has also been designated as a private park. Staff Report OPUD-14 ~ Page 6 of 9 Although it may not be necessary at the time of development, staff would recommend that the possibility of requiring on-site detention for the commercial development area not be restricted and should be addressed during site plan review, if needed. Staff further recommends that CS (Commercial Shopping Center District) development standards contained within the Owasso Zoning Code be designated as the development standard for the commercial area. As staff has indicated in the past, the importance of some form of buffer between any commercial and residential areas cannot be stressed enough. Often times, conflict between the two different land uses occur, usually resulting in an unhappy resident more often than an unhappy commercial business. A large part of a Planner's responsibility is not only the ' "technical" review of a proposed development but also to anticipate any potential conflicts which could arise. ' While there is no specific buffer requirement, staff has recommended the utilization of a more dense residential development (i.e. multi-family housing) or significant landscaping as buffer's in the past. While the area surrounding the proposed commercial node is slightly ' denser than a typical RS-2 addition, staff still feels some form of buffer in addition to the Zoning Code's requirement of a 6 foot "privacy" fence should be included. Staff recommends that detailed landscaping plans (type, species, size, location, irrigation) be required to be submitted with any building site plan within the commercial area. Said landscaping plans would then be reviewed by staff to ensure that compatible relationships ~ between the differing uses are maintained. The Planning Commission would also be required to review and approve these plans. While PUD submittals are often times complex in nature and not easily understood, it is extremely beneficial in two significant manners. The first, is it allows for staff, Planning .. Commission, Council and most importantly -citizens - to see a complete picture of how an entire subject area will develop. This prevents a "piece-mewled" community and eliminates potential surprises. It assists in knowing the entire infrastructure needs of the addition and assists the city in planning and scheduling other improvements. The second is that it essentially allows for conditional zoning. While many of the requirements recommended by staff to be conditions of approval are currently contained within other development documents of the city, some are not. If this were a standard rezoning, not only would the flexibility of the applicant to shift densities be restricted, but it would also result in limited ability for staff, the Planning Commission, and Council to address areas that are unique to the subject property but not found within development documents. Staff Report OPUD-14 Page 7 of 9 In short, providing a PUD is well-thought by the applicant and reviewed by the staff, ~ Planning Commission and Council properly, it can be an asset to both the applicant and the community. 0 Attached for your information and review is a copy of the case map, as well as letters of notification sent to property owners within 300' of the subject property, the legal advertisement that appeared in the Owasso Reporter, and a copy of the application. Enclosed within your packet of information is a large case map as well as the applicants submitted materials. The subject property was posted with notification at the intersection of E. 86th Street North and N. 129th E. Avenue on October 18, 1996. RECOMMENDATION: Given the above analysis, it is the staff's opinion that OPUD-14 is consistent with the Comprehensive Plan and the PUD Chapter of the Zoning Code and, therefore, staff recommends Council approval subject to the following conditions: 1. That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. That unless specifically set out in the standards and conditions of this PUD, single-family lots shall meet the requirements of a typical RS-2 district. That unless specifically set out in the standards and conditions of this PUD, all commercial development shall meet the requirements of a typical CS district. 4. That within the PUD, the maximum number of dwellings shall not exceed 467 (Underlying RS-2 zoning would permit up to 525 dwelling units). 5. That the reference on page 16 of the PUD text pertaining to a lien being placed on a Homeowner's Association member's "personal property" be changed to "real property. That minor transfers (15 % increase in a development area's density) of dwelling units from one residential development area to another can occur if a ~ significant change in the character of either development area is not created. 7. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 8. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 9. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 10. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. 11. That if the eventual street layout is similar to that which is proposed, a stop sign shall be required at the third 4-way intersection from E. 86th Street North. 12. That the northernmost access point to N. 145th E. Avenue from the PUD property shall line up with the southernmost access point of the Whispering Pines Addition (Rogers County). 13. Acceleration/Deceleration lanes will be required on E. 86th Street North and N. 145th E. Avenue. 14. Sidewalks will be required along E. 86th Street North and N. 145th E. Avenue. 15. No flag lots are permitted within any portion of the PUD. 16. If needed, commercial area may be required to provide on-site detention.
