RESOLUTION NO 95-13
A RESOLUTION ACCEPTING BENEFICIAL INTEREST IN AND TO THE
TULSA COUNTY CRIMINAL NSTICE AUTHORITI' IN ACCORDANCE
WITH ITS AMENDED AND RESTATED DECLARATION OF TRUST
ESTABLISHING THE CITI' OF OWASSO AS A BENEFICIARY OF SAID
TRUST.
WHEREAS, the Tulsa County Criminal Justice Authority ("Authority"), a public trust,
has heretofore, on September 1, 1995, been created by the Boazd of Commissioners of Tulsa
County, Oklahoma ("Boazd") for the express purpose of administering sales tax funds relating
to the construction and operation of a county jail and/or other detention facilities ("Facilities")
within Tulsa County, Oklahoma, to serve, in the manner provided by law, all residents of said
county living both within and without the limits of all cities and towns in said county; and,
WHEREAS, the registered voters of Tulsa County, on September 12, 1995, approved
the passage of afive-twelfths percent (5/12%) County sales tax to be administered by the
Authority for the purpose of acquiring a site and erecting, furnishing, equipping, operating,
maintaining, remodeling and repairing a county jail and other detention facilities owned or
operated by Tulsa County, of which two/twelfths percent (2/12%) is required to end on
October 1, 2001, or upon payment or provision for payment of all Facility indebtedness,
whichever date occurs first; and,
WHEREAS, the entirety of the Authority's stated functions exclusively relate to the
funds generated by said County sales tax, as administered by a seven ('~ person Board of
Trustees comprised of three (3) Tulsa County Commissioners, the Mayor of the City of Tulsa
(Ex Officio Trustees"), and the Mayors of three (3) additional cities situated in whole or in part
within the limits of Tulsa County, Oklahoma ("Appointive Trustees"); and,
WHEREAS, on October 20, 1995, the settlor Trustor and each of the Ex Officio
Trustees, acting in their individual capacities and not as holders of public office, duly approved
an Amended and Restated Declazation of Trust of (The) Tulsa County Criminal Justice Authority
which establishes Tulsa County, Oklahoma, and named cities and/or towns situated in whole or
in pazt within the limits of Tulsa County, Oklahoma, to-wit: Bixby, Broken Arrow, Collinsville,
Glenpool, Jenks, Owasso, Sand Springs, Skiatook, Sperry and Tulsa, as beneficiaries of said
Authority, subject to acceptance of beneficiary status by their respective governing bodies and
the payment of the sum of one dollaz ($1.00) as contribution to the corpus of said trust; and,
WHEREAS, the laws of the State of Oklahoma expressly allow a city Mayor to serve
as a Trustee for a public trust which is created for the benefit of the Mayor's municipality, and
the amendment of the Tulsa County Criminal Justice Authority's Trust Indenture to establish the
City of Owasso and other municipalities situated wholly or in part within Tulsa County as named
Authority beneficiaries satisfies a commitment to the voters of Tulsa County made by the Tulsa
County Board of Commissioners on September 1, 1995, in approving the Authority's Trust
Indenture identifying four (4) Mayoral Trustees and, additionally, promotes cooperative relations
between county and city governments; and,
WHEREAS, establishment of the City of Owasso and other Tulsa County municipal
governments as named beneficiazies of the Authority will permissibly allow the named cities
discretion to individually facilitate, in the manner provided by law, the Authority's funding and
thereby substantially reduce the amount of sales tax funds required to pay for said facilities, to
the end that the two-twelfths percent (2/12%) temporary sales tax can be retired earlier than
possible by any other type of debt funding; and
WHEREAS, it is the desire of the City Council, as the governing body of the City of
Owasso, to accept beneficial interest in and to the Authority, as established by its Amended and
Restated Declaration of Trust, for and on behalf of the City of Owasso, Oklahoma, and in all
respects in accordance with the laws of the State of Oklahoma, the Amended Charter of the City
of Owasso, and the terms of the said Amended and Restated Declazation of Trust.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA:
SECTION 1. That the Council herewith accepts beneficial interest in and to the Tulsa
County Criminal Justice Authority.
SECTION 2. That the Mayor is herewith authorized to execute on behalf of the City of
Owasso any and all documents as may be required by law or by the terms of the Authority's
Amended and Restated Declazation of Trust to establish the City of Owasso as a Beneficiary of
the Authority.
PASSED, APPROVED AND ADOPTED this 30th day of October, 1995 by the City
Council of the City of Owasso, Oklahoma.

SUBJECT: SIDEWALK INSTALLATION PROGRAM
DATE: October 25, 1995
BACKGROUND:
In May of 1995, the Owasso City Council unanimously adopted the FY 95-96 Capital
Improvements Program. Included within that program were various capital improvement
projects identified by the committee to receive funding in FY 95-96. One of the projects
identified by the committee, a sidewalk program, was to be allocated $40,000 for the installation
of sidewalks throughout different areas in the community that currently did not have sidewalks
with the emphasis being placed on areas near the schools. A copy of the transmittal
memorandum from the Capital Improvements Committee is attached for your information and
review.
Community Development staff, with the assistance of the Public Works Department, have
compiled information pertaining to the areas of the community that did not have sidewalks. The
various areas were visited, estimates for total construction cost were made, and prioritization of
that list was then performed based on the direction provided by the Capital Improvements
Committee.
PRIORITIZATION•
As a result of the direction provided by the Capital Improvements Committee, all projects
identified by staff have been divided into three lists. Once again, the available funding for this
project is budgeted at $40,000 (Fund 81-410-5471). The total estimated costs for all projects
listed is $88,220. Therefore, a prioritization of projects identified by staff is required.
The listings and accompanying location maps have been made according to the following:
LIST 1 Contains areas near schools that will allow at least one side of the
street to have sidewalks. Currently sidewalks are completely
absent in these areas. These projects are deemed as critical needs.
LIST 2 Contains areas that are not necessarily near schools, but do receive
a high amount of student pedestrian traffic. These projects are
certainly desirable, but not as critical as those in List 1.
LIST 3 Contains areas near the Owasso High School that are needed, but
the costs involved to complete these projects are substantial. If
these are areas are selected, very little if any of the other project
areas could be selected due to funding limitations.
FUNDING AVAILABILITY:
As previously stated, the FY 95-96 Capital Improvements Fund available budget is $40,000
(Fund 81-410-5471). Therefore, sufficient funds should be available to complete all identified
projects within List 1 with remaining monies to be allocated at a total of $7,380. Staff
recommends that Council direct staff to develop a bid packet and request bid submittals for the
identified sidewalk projects in List 1.
Staff would recommend that the remaining available monies to be allocated be handled in the
following manner. The first would be to include an option in the bid packet which would also
include List 2. List 2 has an estimated total cost of $11, 647, however when it is combined with
List 1, the total combined cost could be under $40,000.
The second would be to include Project No. 33 as an option. The beneficial result of project
No. 33, would be the installation of a sidewalk from the High School property to the Barrington
Point entrance. With the addition of this sidewalk, pedestrian access from the High School to
the Barrington Point Addition could be achieved immediately, while access to Camden Park,
Windsor Lake, Windsor Lake II, Nottingham Estates, and Pleasant View would be obtained
when the area between Barrington Point and Camden are developed. This would then route the
pedestrian traffic through the residential areas rather than on a major arterial street.
RECOMMENDATION:
Staff recommends Council adoption of the prioritization of the sidewalk program as outlined
above, therefore directing staff to develop a bid packet and request bid submittals for the
programs identified in List 1, with List 2 and Project No. 33 as additional alternatives.

BACKGROUND:
Attached for your information and review is the executive summary of the Capital Improvements
Committee as it relates to the FY 95-96 Capital Improvements Plan. The FY 95-96 Capital
Improvements Plan includes partial and/or total funding for the following projects:
East 86th Street North (Main to Cedar)
Residential Street Overlay Program
Hale Acres Drainage Improvements
Police Firearms Range
Water Department/Parks Department Building
Sports Park
Sidewalk Program
Fire Department Ladder Truck
The FY 95-96 Committee held meetings bi-weekly throughout the months of February, March,
and April in order to determine the recommendations included within their report. The Capital
Improvements Plan, upon adoption by the City Council, becomes a significant portion of the FY
95-96 Budget. Please note that the proposed budget submitted for your review does include the
proposed FY 95-96 Capital Improvements Plan.
If you have misplaced the Capital Improvements Plan sent to you earlier in May, please contact
me so that you may receive an additional copy.
RECOMMENDATION•
The Owasso Capital' Improvements Committee recommends Council adoption of the FY 95-96
Capital Improvements Plan.
