Dated at Owasso, Oklahoma, this 14th day of October, 2008 Marsha Hensley Assistant City Planner MEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: OBOA- 08 -11, A REQUEST FOR A SPECIAL EXCEPTION TO ALLOW FOR A USED CAR SALES FACILITY IN A COMMERCIAL SHOPPING DISTRICT DATE: OCTOBER 20, 2008 BACKGROUND The City of Owasso has received a request from Jeff Aitken for a Special Exception of the Owasso Zoning Code, Section 610, Principle uses permitted in commercial districts, to allow for a used auto sales facility on property zoned CS (Commercial Shopping). LOCATION The subject property is located on the southeast comer of East Ile Street North and North Garnett Road, more commonly described as 11535 North Garnett Road. EXISTING LAND USE Vacated QuikTrip SURROUNDING LAND USE Northeast: Church Use South: Burlingames Center West: Atwoods & Las Americas East: A &Z Signs PRESENT ZONING CS (Commercial Shopping Center District) APPLICABLE REGULATIONS Owasso Zoning Code, Section 610 — Principle uses permitted in commercial districts, Table 1 - Board of Adjustment. ANALYSIS According to the Owasso Zoning Code, the Board of Adjustment may grant a special exception. Provided that the Board in granting a special exception shall prescribe appropriate conditions and safeguards, and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached. The applicant is requesting a special exception from the Owasso Zoning Code to allow for a used auto sales facility in a commercial shopping district. The proposed use of the property is permitted by special exception in a commercial shopping district. A site map is included with your packets. Staff believes that all criteria have been met relative to the special exception language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning code and will not be injurious to the surrounding areas or otherwise detrimental to the public welfare. Letters were mailed to all property owners within three- hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. MEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: OBOA -08 -10, A REQUEST FOR A SPECIAL EXCEPTION TO ALLOW CHRIST'S CHURCH OF OWASSO TO LOCATE ON A PROPERTY ZONED RE (RESIDENTIAL ESTATE). DATE: OCTOBER 20, 2008 BACKGROUND The City of Owasso has received an application for a special exception to allow Christ's Church of Owasso to locate on property zoned RE (Residential Estate) located on the north side of East 96a' Street North and about a half of a mile east of North 129' East Avenue. PROPERTY CHARACTERISTICS: The property is located on the north side of East 961' Street North and about a half of a mile east of North 129x` East Avenue. The property is currently zoned Residential Estate and is undeveloped. The site is bordered to the north, east, and west by large lot residential structures, and to the south lies East 96h Street North. ANALYSIS: The subject property, as stated, is undeveloped and contains approximately 14.5 acres of land. It is the intent of Christ's Church of Owasso to construct a church facility on the property. The staff has evaluated the request, and fords that approval of the variance will not result in any detrimental impact on the surrounding area. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including, but not limited to, paved streets and sidewalks. The proposed development will require no significant expansion of utilities or infrastructure. Staff published legal notice of the Special Exception Request in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius.
