ALLEN AND DORIS L. ROBINSON REVOCABLE TRUST. The City of Owasso recognizes, however, that you possess certain contractual rights to erect and display billboards on a portion of that property along Highway 169. Purchase of this land by the City of Owasso will necessarily extinguish your contractual rights to display billboards on that property. In exchange for your willingness to relinquish those rights, the City of Owasso hereby authorizes a transfer of your billboard display rights from that property to a separate parcel of land along Fifth Avenue near Highway 169 which is also owned by the H. DATE: NOVEMBER 10, 2008 BACKGROUND: The City of Owasso has received an application for a special exception to allow a Church Facility to be constructed on property zoned OM (Office Medium), located at 13918 and 14008 East 96th Street North. PROPERTY CHARACTERISTICS: The property is located on the south side of East 96th Street North and about a half of a mile east of North 120" East Avenue. The property is currently zoned OM (Office Medium) and is developed with a single - family residential structure. The site is bordered to the south, east, and west by large lot residential structures, and to the north lies East 96th Street North. ANALYSIS: The subject property, as stated, is undeveloped and contains approximately 11.5 acres of land. It is the intent of Life Church to construct a one story church facility on the site. The staff has evaluated the request, and finds that approval of the variance will not result in any detrimental impact on the surrounding area. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including, but not limited to, paved streets and sidewalks. The proposed development will require no significant expansion of utilities or infrastructure. Staff published legal notice of the Special Exception Request in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. DATE: NOVEMBER 10, 2008 BACKGROUND: The City of Owasso has received an application for a variance to allow the encroachment of the rear yard setback on a property zoned RS -3 (single - family residential) with a pending application to be rezoned to RD (Residential Duplex), located at 108 West 2nd Street North. LOCATION: The property is located at 108 West 2nd Street North, in the Original Town of Owasso. A general area map is attached. EXISTING LAND USE: Undeveloped SURROUNDING LAND USE: North: Residential Duplex South: Single - Family Residence East: Single- Family Residence PRESENT ZONING: RS -3 (Single - Family Residential) APPLICABLE REGULATIONS: Owasso Zoning Code, Section 431.1— Bulk and Area Requirements in Residential Districts. ANALYSIS: The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the construction of a residence that encroaches 6.5' into the 20' rear yard setback, as shown in the site drawing. The subject is proposed to contain a residential duplex dwelling. It is the intent of Maven Investments to complete the project and rent the property. The staff has evaluated the request, and fmds that approval of the variance will not result in any detrimental impact on the surrounding area. It is the opinion of the staff that the character of the neighborhood will not be adversely affected by granting the variance. The application was submitted to staff concurrently with a rezoning request that will be heard by the Owasso Planning Commission on November 10, 2008. Any variance approval would be contingent upon a rezoning by the Planning Commission. Letters were mailed to all property owners within three - hundred (300) feet of the subject property on and the request was advertised in the Owasso Reporter. IQ ' N _ � D m� MEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: OBOA- 08 -14, A REQUEST FOR A SPECIAL EXCEPTION TO ALLOW FOR THE CONSTRUCTION OF A CARPORT DATE: NOVEMBER 10, 2008 The City of Owasso has received a request for a Special Exception from the Owasso Zoning Code, to allow for the construction of a carport. LOCATION: The subject property is located at 602 North Cedar in the Marywood Addition. EXISTING LAND USE: Residential SURROUNDING LAND USE: North: Residential South: Residential East: Residential West: Residential PRESENT ZONING: RS -3 (Residential Single - Family) ANALYSIS: The applicant owns a house in the Marywood addition without a garage on the property. The owners would like to protect their vehicles in addition to minimizing the risk of themselves being harmed by the elements (snow, ice and rain) as they transition from house to vehicle. They have two apparent options, either construct an attached garage or erect a connected carport. The applicant has chosen to build a carport. Carports are allowed in the City of Owasso by Special Exception requiring Board of Adjustment approval according to the Owasso Zoning Code as such the applicant has brought this request to the Board of Adjustment for review. "The Board of Adjustment shall hold the public hearing and, upon the concurring vote of three members, may grant the Special Exception after finding that the Special Exception will be in harmony with the spirit and intent of the code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Provided that the Board in granting a Special Exception shall prescribe appropriate conditions and safeguards, and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached." - Section 1480.4 Owasso Zoning Code. After reviewing the site and surrounding area staff found other carports in the area. The construction of a carport would not be detrimental to the public welfare as it will be entirely on the subject property and out of any possible driving site lines. Staff is inclined to believe that an upgrade in the materials selected for the construction of the carport could assist the carports ability to blend into the neighborhood, in the absence of a material change landscaping beside the carport and driveway could improve the carports appearance. Letters were mailed to all property owners within three- hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. Staff received no objections concerning OBOA 08 -14. RECOMMENDATION: Staff recommends approval of OBOA 08 -14 with the consideration of additional elements (whether landscaping or an upgrade in building materials) to improve the carports appearance or surroundings.
