Mr Ray Attachment #9 Staff will recommend Council approval of an agreement for grant funds in the amount of $200,000 to ODOC for the purpose of funding construction improvements associated with the CDBG National Steak & Poultry grant; and that the Mayor be authorized to execute such agreement. Consideration and Appropriate Action Relating to an Agreement Between the City of Owasso and Oklahoma Department of Commerce for Funding Construction Improvements and Rehabilitation to Wastewater Lines Within a District Approved by the ODOC. Mr Ray ' Attachment #10 Staff will recommend Council approval of an agreement for grant funds in the amount of ' $5500 with ODOC for the purpose of rehabilitating wastewater lines as a part of a CDBG grant; and that the Mayor be authorized to execute such agreement. 1 11. Consideration and Appropriate Action Relating to the Award of a Contract for Purchase and Installation of Barrier Free Door Operators at the Owasso Community Center. Mr Ray ' Attachment #11 Staff has solicited and reviewed quotes and will recommend the award of a contract in the ' amount of $2443 to Murray Womble Co, Owasso, OK for materials and labor to install barrier free door operators at the Community Center as per specifications. 1 12. Consideration and Appropriate Action Relating to the Award of a Contract for Firefighting ' Equipment. Mr Ray Attachment #12 ' Staff has solicited and reviewed bids and will recommend the expenditure of $3939 to Chief Fire & Safety, Chickasha, OK; $2963 to Kan-Ok Apparatus Co, Lawrence, KS; and ' $19,716 to Casco Equipment Co, Oklahoma City, OK, for firefighting equipment for the new fire truck. Consideration and Appropriate Action Relating to Ordinance #497, an Ordinance Providing for the Annexation of Approximately 100 Acres Located North and West of the Northwest Corner of East 116th Street North and Garnett Road (A & W Development, Petitioners). Consideration and Appropriate Action Relating to OZ- 95 -02, a Request to Rezone an 18.39 Acre Tract of Land from AG (Agriculture) to CG (Commercial General) and OM (Office Medium), Such Property Located North of Three Lakes Addition and West of Smith Elementary School. Consideration and Appropriate Action Relating to OPUD -13, a Request to Rezone a 126.805 Acre Tract of Land from AG (Agriculture) to PUD (Planned Unit Development), Such Property Located South and East of East 96th Street North and Garnett Road. Consideration and Appropriate Action Relating to a Request to Designate the Mayor as the City's Certifying Officer as Provided for by the National Environmental Policy Act of 1969 for the Purpose of Signing Certain Documents to Complete the Requirements of the Sewer Rehab CDBG ED Project. Mr Ray Attachment #16 ' Staff will recommend that the Council designate the Mayor as the City's certifying official for documents required by the CDBG grant and authorized by the Council. t ■ 17. Consideration and Appropriate Action Relating to a Request for City Council Approval of a "Finding of Categorical Exclusion /Exempt from Release of Funds Publication ", and that the Mayor be Authorized to Execute Such Documents as Required for the Sewer Rehab ' CDBG ED Project. Mr Ray See Attachment #16 ' Staff will recommend that the Council approve the Finding of Categorical Exclusion required by the CDBG grant and that the Mayor be authorized to execute such document. ' 18. Consideration and Appropriate Action Relating to a Request for Council Authorization for the Mayor to Execute an Environmental Certificate for the Sewer Rehab CDBG ED Project. Consideration and Appropriate Action Relating to a Request for City Council Approval of a "Request for the Release of Funds ", and that the Mayor be Authorized to Execute Such Documents as Required to Gain a Release of Funds for the Sewer Rehab CDBG ED Project. Mr Ray See Attachment #16 Staff will recommend that the Council authorize the Mayor to execute a "Release of Funds Request" as required by grant conditions. 20. Consideration and Appropriate Action Relating to a Request for Council Approval of an " Antidisplacement Plan" for the Sewer Rehab CDBG ED Project. Mr Ray See Attachment #16 Staff will recommend Council adoption of an Antidisplacement Plan for the Sewer Rehab project, and that the Mayor be authorized to execute such plan document. 21. Consideration and Appropriate Action Relating to a Request for Approval of Information ' to be Submitted as a Part of a Grant Application to the Justice Department for Funds to Employ an Additional Police Officer Under the "Cops Fast" Program, and Authorization for the Mayor to Execute the Necessary Documents. Mr Ray Attachment #21 The staff will present a proposed budget for the grant program and recommend Council approval of such budget, and that the Mayor be authorized to sign the document for submittal to the Justice Department. Consideration and Appropriate Action Relating toa Request for Final Acceptance of Work Performed Under a Contract for Owasso Sports Park Phase II Fencing, Between the City of Owasso and Builder's Unlimited Inc, and Authorization for Final Payment and Release of Retainage to the Contractor. Consideration and Appropriate Action Relating to a Request for the Council to Enter into Executive Session for the Purpose of Discussing Negotiations Concerning Employees, and Discussing the Employment of an Individual Salaried Employee, Such Purposes Authorized and Provided for by 25 O.S., Section 307 -B(1) and 307 -B(2). Mr Ray Attachment #28 Staff will recommend Council action allowing for an executive session to discuss the employment of a negotiator and to discuss negotiations with the FOP and IAFF for FY 1995 -96. 1 29. Consideration and Appropriate Action Relating to the Employment of a Labor Negotiator for the City of Owasso. ' Mr Ray This item is placed on the agenda in an effort to enable the City Council to take action to ' finalize the employment of a chief negotiator for the City should such action be desired. 30. Adjournment OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, April 4, 1995 The Owasso City Council met in regular session on Tuesday, April 4, 1995 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, March 31, 1995. W ITEM 1: CALL TO ORDER Mayor Duke called the meeting to order at 7:30 p.m. ' ITEM 2: INVOCATION The invocation was given during the Owasso Public Works Authority meeting preceding this ' meeting. ITEM 3: FLAG SALUTE The flag salute was held during the OPWA meeting. ITEM 4: ROLL CALL PRESENT ABSENT Jerry Duke, Mayor Charles Burris, Vice Mayor Mary Lou Barnhouse, Councilor Danny Ewing, Councilor Joe Ramey, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ' ITEM 5: READING OF MAYOR'S PROCLAMATION. Mayor Duke read a proclamation denoting Yale Cleaners as Business of the Quarter for the Second Quarter 1995. He invited Bill Rothrock to join him in the front of the room, where the proclamation was presented. Several of Mr Rothrock's staff were also present. Owasso City Council April 4, 1995 ITEM 6: REQUEST APPROVAL OF THE MINUTES OF MARCH 21 1995 REGULAR MEETING AND MARCH 29, 1995 SPECIAL MEETING Mr Burris moved, seconded by Ms Barnhouse, to approve the minutes as submitted, by reference made a part hereto. AYE: Burris, Barnhouse, Ewing, Ramey, Duke NAY: None Motion carried 5 -0. ITEM 7: REQUEST APPROVAL OF THE CLAIMS Mr Burris moved, seconded by Mr Ramey, that the following claims be approved: (1) General Fund $29,364.70; (2) Workers Comp Self -Ins Plan $778.33; (3) Ambulance Service Fund $329.70; (4) City Garage $2,253.51; (5) Capital Improvements $7,165.00 (6) Interfund Transfers $28,158.33; (7) General Fund Payroll $95,178.01; (8) City Garage Payroll $1,887.19. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO MAYOR'S APPOINTMENTS REQUIRING CONFIRMATION BY THE CITY COUNCIL A resignation by a member of the Sales Tax Watchdog Committee and a term expiration of a member of the Personnel Board have created vacancies on those two boards. Mayor Duke requested confirmation of John Stiger to the Sales Tax Watchdog Committee and Jim Hughes to the Personnel Board. IN FA 1 1 1 1 1 1 Owasso City Council April 4, 1995 ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A CONTRACT BETWEEN THE CITY OF OWASSO AND THE YMCA OF GREATER TULSA PROVIDING FOR THE YMCA'S MANAGEMENT OF THE MUNICIPAL SWIMMING POOL FOR THE 1995 SEASON. The City of Owasso has contracted with the YMCA of Greater Tulsa for the past two years for management and operational services of the municipal swimming pool. The arrangement has worked well and a contract for services for the 1995 season has been proposed. The contract has not changed from 1994. Mr John Swift, CEO of the YMCA of Greater Tulsa, was present to explain some of the summer programs. Mr Burris moved, seconded by Mr Ewing, to approve a management contract with the YMCA of Greater Tulsa for a continuation of management services for the municipal swimming pool. AYE: Burris, Ewing, Ramey, Bamhouse, Duke NAY: None Motion carried 5 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #496, AN ORDINANCE PROVIDING FOR THE REZONING OF AN 8.86 ACRE TRACT OF LAND LOCATED WEST OF THREE LAKES III AND NORTH OF WAL -MART. At the March 21, 1995 meeting, the City Council recommended approval of a rezoning request from AG (Agriculture) to CG (Commercial General) and OM (Office Medium) on an 8.86 acre tract of land located north of Wal -Mart. Ordinance #496 formally adopts that action. Mayor Duke moved, seconded by Mr Ramey, to approve Ordinance #496, rezoning the above - mentioned tract. AYE: Duke, Ramey, Ewing, Barnhouse, Burris NAY: None Motion carried 5 -0. 3 Owasso City Council April 4, 1995 , ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AWARD A CONTRACT FOR THE PURPOSE OF CONSTRUCTING A SAFETY FENCE AT THE OWASSO SPORTS PARK COMPLEX. As a part of the work being done at the Sports Park, a safety fence needs to be installed along the west side of an existing field next to the entry road. Bid documents were prepared and sealed bids opened on March 16. Five bids were submitted, with Owasso Fence being the low bidder. Mr Ramey moved to approve a contract with Owasso Fence in the amount of $2440 for the installation of a safety fence along the west side of Field "I ", with the addition of an offset opening in the fence. Motion seconded by Mr Ewing. AYE: Ramey, Ewing, Barnhouse, Burris, Duke NAY: None Motion carried 5 -0. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE AWARD OF A CONTRACT FOR REPAIR OF THE COMMUNITY CENTER ROOF. Bids were opened on March 20, 1995 for a contract on materials and labor to repair the upper level of the community center roof. Bid documents were mailed to five vendors and all five submitted bids. Bids ranged from a low of $2295 to a high of $6837. Staff recommended awarding a contract to the second low bidder, since that firm is local and the difference in the two low bids is a small amount. Also, the second lowest bidder did the initial repair work on the roof in December. Mr Ramey moved, seconded by Mr Ewing, to approve a contract with All Star Roofing of Owasso for the repair of the upper level of the community center roof in the amount of $2550. AYE: Ramey, Ewing, Barnhouse, Burris, Duke NAY: None Motion carried 5 -0. r 1 1 1 Owasso City Council April 4, 1995 ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ' MOWING CONTRACTS FOR CITY PROPERTIES. Mr Carr gave a short background review of the City's private sector mowing contracts. For ' several years the City of Owasso has utilized private sector contractors to provide mowing services for city properties. This has proved to be a cost - effective program. Twelve areas were ' advertized for bids, with bids being opened on March 16, 1995. In the bid documents the parks and medians were designated to be mowed once every ten days, with the contract beginning on April 17, 1995 and continuing through October 13, 1995 (18 mowings). The easement areas ' were designated to be mowed once a month, with the contract beginning on April 17, 1995 and continuing through September 30, 1995 (6 mowings). Mr Burris moved, seconded by Mr Ramey, to award the following mowing contracts for the 1995 mowing season: ' 1. Rayola Park - Mr Larry Turner at $165 per mowing 2. Elm Creek Park - Mr Arley Owens at $235 per mowing 3. Ator Heights Park - Mr Scott Nemecek at $80 per mowing ' 4. 86th St Park - Mr Larry Turner at $45 per mowing 5. Ator Utility Easement - Mr Scott Nemecek at $24 per mowing 6. El Rio Vista Center Medians & Frontage - Mr Scott Nemecek at $40 per mowing ' 7. El Rio Vista Drainage Easement - Arrow Lawn & Landscape at $61.80 per mowing 8. Three Lakes Drainage Easement - Arrow Lawn & Landscape at $455 per mowing 9. F, ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REOUEST FOR A SUPPLEMENTAL APPROPRIATION TO VARIOUS DEPARTMENTS OF THE GENERAL FUND. The City of Owasso's insurance carrier has paid a claim resulting from lightning damage on July 14, 1994. A supplemental appropriation to the revenues and expenditures in the various departments of the General Fund is needed to cover the unanticipated revenues and expenditures. 5 Owasso City Council April 4 1995 ' Mr Duke moved, seconded by Mr Burris, to approve a General Fund budget amendment of $3758 to revenue and $3758 to expenditures ($1499 Civil Defense; $1781 Finance; $478 General Government). ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST BY THE IAFF TO REOPEN CONTRACT NEGOTIATIONS WITH THE CITY FOR FISCAL YEAR 1994 -95 Following discussion on the request to reopen negotiations for FY94 -95, action was tabled until after the executive session, should one be approved. Following executive session, Mr Ramey moved to approve reopening negotiations with IAFF for FY94 -95. The motion died for lack of a second; thus denying the request. ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PENDING NEGOTIATIONS BETWEEN THE CITY OF OWASSO AND THE FOP AND IAFF SUCH SESSION PROVIDED FOR IN 25 O.S. SECTION 307 SUBSECTION B(2) Mayor Duke moved, seconded by Mr Burris, to enter into executive session for the purpose of discussing employee negotiations for FY 1994 -95 and FY 1995 -95. AYE: Duke, Burris, Ewing, Ramey, Barnhouse NAY: None Motion carried 5 -0. Into executive session at 8:43 p.m. Out of executive session and meeting reconvened at 9:50 I p.m. ITEM 17: REPORT FROM CITY MANAGER Mr Ray reported that four of the sirens which failed during the siren test have been repaired and the other three are being repaired. He also reported that March had the second highest number ' 0 Owasso City Council April 4, 1995 of building permits issued since 1984. He thanked inspectors Gary Orr and Mike Knebel, and firefighter Dan Salts for the work they have been doing making sure that all new construction is fully inspected. ITEM 20: UNFINISHED BUSINESS Mr Ewing suggested that the $500 donation received at a meeting earlier in the year from Mr Jim Shoulders be designated to the Fire Prevention Association. Additionally, the Council has authorized the Mayor to request a "release of funds" for the project. All that remains to finalize the grant and obtain access to the funds, is Council ' approval of an official contract between the City and ODOC. That contract has been prepared by ODOC and is attached for your review. A copy has been sent to Mr Cates for his review and comment. The contract is a standard ODOC CDBG agreement that requires the City to comply with certain federal regulations to be eligible for the grant. The funds may be expended on engineering and construction of water, wastewater and street improvements only. The City will recover the funds through reimbursement with proper documentation that the services or materials have been acquired. ' The total grant is for $200,000. The City may begin drawing on the funds from the grant as soon as the contract is executed by both parties. An engineering contract with Sack and Associates has previously been approved by the Council, conditioned upon execution of this ' contract. Work on that engineering contract will officially begin as soon as we are notified by ODOC that they have executed the attached CDBG contract. Additionally, the Council will be asked to authorize the Mayor to request a "release of funds" for the project (see item #19 on this agenda). All that remains ' to finalize the grant and obtain access to the funds, is Council approval of an official contract between the City and ODOC. That contract has been prepared by ODOC and is attached for your review. A copy has been sent to Mr Cates for his review and comment. ' The contract is a standard ODOC CDBG agreement that requires the City to comply with certain federal regulations to be eligible for the grant. The funds may be expended on engineering and construction of wastewater improvements only. The funds are reimbursable with proper ' documentation that the services or materials have been acquired. The total grant is for $197,800, however, this contract is for only $5500 of that amount. A ' second contract will be sent to the City for the remaining funds during this quarter. The ODOC wanted to deplete FY94 funds that were turned back in by other cities before they issued a contract on 1995 funds. Funds from the grant will be available as soon as the contract is ' executed by both parties. A construction contract has been awarded (4/4/95) contingent upon this contract and a release of funds. That works should begin within the next 60 days. RECOMMENDATION: Staff recommends Council approval of a contract between the City of Owasso and the Oklahoma Department of Commerce providing for $5500 in grant funds for repair of wastewater lines in the approved target area. At the beginning of December 1994, bids were solicited for this work. Bids were received from two vendors: Door Controls of Oklahoma, Tulsa, for $3223 and Murray Womble of Owasso for $2443. During the time of bid solicitation, repair work was done to the Community Center roof. In the process of this repair, it became evident that replacement, not just maintenance repair, of the upper level Community Center Roof would be necessary. Until we had bid out this roof job and had ascertained how much it would cost, we were unable to proceed with the lower priority door refurbishment. Now that we have contracted for the roof replacement, we know exactly how much will be left in the Community Center Fund upon completion of that repair. The balance will be $1559.33. If we apply this amount against the lower bid amount of $2443, we will be $883.67 short of being able to cover this expenditure from the remaining fund balance. FUNDING: Since we are unable to cover the door expense from the Community Center Fund, and since there are no regularly- budgeted funds from the Community Center operating budget that can be spent for this important item, I discussed with the Owasso Golden Agers the possibility of their assisting with this expenditure. They were very interested, inasmuch as they see this ' particular item as one that will enhance the access of our senior citizens to the facility, and they have agreed to pay the balance in the amount up to, but not exceeding, $1000.00 (see attached letter). When we received the engine in 1994, sufficient fire fighting equipment was not available to utilize the engine on structure fires. Because Engine 1 and 3 pumps were repaired at Boardman Company this year, equipment was transferred from either Engine 1 or 3 and placed on Engine 2. This procedure allowed us to place Engine 2 in service before the necessary equipment was purchased. The subject property is shown on the attached map ' and is currently undeveloped. The subject property is currently zoned AG (Agricultural) and would remain zoned AG upon ' annexation. All property annexed by the City of Owasso is required to be zoned the lowest zoning classification (AG) until any rezoning request is received and approved by the Planning Commission and the City Council. A copy of the City of Owasso's annexation policy is attached ' for your information and review. If annexation is approved, the subject property will have to go through all platting requirements of the City of Owasso prior to any development. The Technical Advisory Committee reviewed this request at their March 29, 1995 meeting and the Owasso Annexation Committee reviewed this request at their March 30, 1995 meeting. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing city limits. 3. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. The subject property was recently annexed by the City of Owasso and is currently zoned AG (Agriculture). The applicants are requesting a rezoning to CG (Commercial General) and OM (Office Medium) to allow for commercial and office development with a landscaped buffer zoned OM. The rezoning request by Tyann Development is unique in the sense that it is only the second commercial rezoning request reviewed by staff that has included a zoning and landscape buffer. The applicants are requesting the most easterly and southerly portions of the subject property (the portion which abuts the residential area of Three Lakes and Smith Elementary School) to be zoned OM (Office Medium). By incorporating the OM zoning into the request, the applicant has limited the type of use to strictly office uses and has limited the proximity of any structure to a minimum of 40 feet in relationship to the residential and school property. It is also the applicants intent to incorporate a six foot wooden fence along the shared property lines, along with the incorporation of extensive landscaping, in order to buffer the commercial uses from the residential property. A copy of the complete staff report, along with additional application materials submitted by the Tyann Development, are attached for your information and review. The Owasso Planning Commission reviewed the rezoning request at their April 11, 1995 regular meeting. Several area property owners attended that meeting and voiced concern regarding the proximity of development other than residential to their property and Smith Elementary School. In addition, concerns were also voiced into exactly what types of structures would be built on the property if the zoning was approved and the maintenance responsibilities of the screening wall and landscape buffer. It is important to note that platting of the property would be the stage in which maintenance responsibility of the "buffer" area is addressed and site plan review by the Planning Commission would also review the type of structure and the required landscaping. Both of these steps are public hearings in which the neighboring property owners would have opportunities for input. Staff feels that the development concept and rezoning request presented by the applicant is a solid one that has attempted to address any potential conflict in uses which sometimes occur when office and /or commercial development abuts residential. The inclusion of the OM zoning as a buffer area between the two types of development, as well as landscaping and a minimum setback of 40 feet from the residential property, is above and beyond what exists in any commercial area abutting residential development along the Owasso Expressway. The Planning Commission unanimously recommended approval of the rezoning request. RECOMMENDATION• Staff recommends approval of the rezoning request from Tyann Development to rezone the subject property from AG (Agriculture) to CG (Commercial General) and OM (Office Medium). Rooney - Community Development Director BACKGROUND APPLICANT AND STATUS OF APPLICANT: Tyann Development, applicant and owner. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from AG (Agricultural) to CG (Commercial General) and OM (Office Medium) to allow for commercial and office development, including a landscaped buffer. LOCATION AND SIZE: The property is located directly north of Three lakes III addition, east of Highway 169, west of Smith Elementary School. The complete legal description of the property is attached for your information and review. The subject property contains 18.399 acres, more or less. EXISTING LAND USE: The subject property is currently undeveloped. SURROUNDING LAND USE: The subject property is abutted on the north and west by Highway 169, on the south by the Three Lakes III Addition zoned RS -3 (Residential Single Family High Density) and on the east by the Smith Elementary School. COMPREHENSIVE PLAN: The Comprehensive Plan identifies this area as being appropriate for Low Intensity Residential (Single - Family Housing). However, it is important to note that the Comprehensive Plan may be outdated in this area. When the comprehensive plan was created in 1978, and updated in 1985, it was felt that the east service road north of the Three Lakes III entrance would not be extended. However, staff and city policy has changed since 1985, and any development in this area r uires the extension of the Highway 169 service road. With a service road extended along this frontage, the property becomes more in tune with for commercial development and less likely to be a desirable residential area. Staff would not recommend this area for any residential development if the Comprehensive Plan update were being performed today. APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", Chapter 6 "Commercial Land Uses ", and Chapter 5 "Office Land Uses ". SITE INFORMATION: No unusual development hardships are noted. Staff Report OZ -95 -02 Page 2 of 3 ANALYSIS The proposed rezoning, if approved, would create an 18.399 acre area of commercial /office zoned property for the applicant. The subject property is located just west of the Smith Elementary school and north of Three Lakes III Addition, is currently zoned AG (Agriculture) with a request to rezone to CG (Commercial General) and OM (Office Medium), and is unlikely to develop if the current zoning pattern was to remain AG. The subject property was recently annexed into the City of Owasso, but also was previously zoned AG when under Tulsa County's jurisdiction. As stated previously, the Owasso Comprehensive Plan, while identifying this area as being appropriate for Low Intensity Residential (Single - Family Housing) may be considered to be outdated when applied to the existing physical facts of the area surrounding the subject tract. Over 60% of all property along the east service road from E. 76th Street North through E. 86th Street North is zoned for CG or IL, a more intense use. Existing zoning patterns, as well as the commercial corridor along Highway 169, supports the applicants rezoning request. The Commercial General zoning requested by the applicant would allow for a myriad of commercial retail uses. A list of uses permitted under CG zoning is attached for your review. Sexually- oriented businesses would not be permitted to develop in this area due to its proximity to a school and residential area. Within the applicants text submitted with their application, some very important points were addressed. Once again, as staff pointed out in the applicant's first rezoning request processed in March, the inclusion of a buffer of OM (Office Medium) is very important regarding staffs recommendation for approval. While it is indeed true that approximately 60% of the land along the Owasso Expressway corridor has developed with a commercial or industrial classification, an extremely small portion of that zoning includes a buffer between their businesses and the abutting residential developments. The applicant's request includes such a buffer. The buffer area which would occur throughout the OM portion of the rezoning request, would require the construction of a site obstructing fence, an absolute minimum setback of 40 feet from any of the abutting residential and school property, and the requirement for substantial landscaping along the abutting lines with the residential property. Staff feels the applicant has addressed any potential conflicts of uses in this area by the inclusion of this buffer. In addition, the Planning Commission will also review any platting and all site plans that may occur within this property, again to ensure the buffer area serves its purpose. ■ Staff Report OZ -95 -02 Page 3 of 3 Letters were sent to surrounding property owners within 300' of the subject property and notification was published in the Owasso Reporter on March 23, 1995. The subject property was also posted the week of March 20th. To date, staff has received only one inquiry regarding the rezoning request and was referred to the applicants for additional information. RECOMMENDATION Staff feels a rezoning and use of this property in a commercial and office manner would be consistent with the existing zoning patterns along the Owasso Expressway service roads and would be adequately buffered from the residential development and school property. Abutting the tract on the east is Smith Elementary School. The tract has approximately 1,760 feet of frontage on the expressway. ZONING REQUEST MAP The rezoning application consists of a request for a combination of medium intensity commercial (Commercial General District - CG) and (09 �1 medium intensity office (Office Medium Intensity District - OM). See Zoning Request Map. , This request has been carefully researched and is strictly based on the three most common points typically considered when making zoning decisions. The three points are as follows; (1) current comprehensive development policies of the City ti �S00 LOOP � LANDSCAPED DETENTION AREA OM BUFFER of Owasso for the area in question, THREE LAKES 1II (2) current physical conditions and use(s) of the tract and surrounding area, and (3) planning principles and standards accepted by planning authorities at both the local and national levels. SMITH SCHOOL LI-1 ZI CONFORMANCE TO COMPREHENSIVE PLAN AND EXISTING ZONING PATTERNS: The e Owasso Comprehensive Plan 1978 -2000 1985 Update, shows the subject tract to be ' designated as Low Intensity Residential (Single - Family). However, it is the opinion of Tyann Development that the comprehensive plan is outdated and does not reflect the current city plans and policies for long -term development of the expressway corridor area. In 1978 when the ' existing plan was developed for this area it was assumed that the service road would not be extended, making this portion of the corridor questionable for commercial use. However, more recently the city's position has been that each development within the expressway corridor would be required to extend the service road through their property until ultimately a service road would be totally in place between 86th Street North and 96th Street North. Given this change in policy restricting the use of the subject tract to residential uses would seem unreasonable. At the same time, undeveloped land along the corridor is now due the same zoning consideration as has been allowed in the corridor area between 76th Street North and 86th Street North. Our research for f Zoning Case #OZ -95 -01 indicated that approximately 60% of the frontage land along the east P1 side of the expressway between 76th Street North and 86th Street North is zoned a combination of General Commercial and Light Industrial. This existing zoning patterns certainly supports the General Commercial and Medium Intensity Office zoning classifications being requested. ' It is Tyann Development's contention that the comprehensive plan developed in 1978 is outdated 0 as it pertains to the area in question and is no longer the correct guide to be used for evaluating zoning requests. It is also our opinion that we have shown the request to be, (1) in conformance with the city's comprehensive development policies for the area in question (2) and consistent with existing zoning patterns previously granted by the Owasso Planning Commission and City Council for undeveloped land adjacent to the expressway. DEVELOPMENT CONCEPT: In considering the matter of the proposed zoning request being consistent with prevailing planning principles and standards, two factors should be addressed. First, the appropriateness of the request in relation to the subject tract's location within the surrounding area and second, the appropriateness of the on site development concept in relation to the adjacent existing land use patterns. 'r Even though the city's long -term goal or policy is to require the extension of the service road, it will be several years before that goal is completed in its entirety. Therefore, it is necessary for us to consider the development of this tract based on a concept that is (1) compatible with the surrounding land uses, (2) still marketable given the current access, and (3) at the same time be consistent with the City's long -term development policies. Until the service road is completed it will serve as the primary access into and out of the area. But, this development concept requires that you visualize the area to be a business park that initially functions unto itself, then later becoming service road frontage (see Castle Point Commercial Park map). Because of this dual development strategy it is necessary to consider uses that will utilize the visibility, minimize the traffic, and still be marketable. Many of the typical commercial shopping uses require both visibility and accessible because they function entirely off of significant traffic flows. It is not Tyann's intent to force traffic into this area, that would be inappropriate and unwise for the city and not marketable for Tyann. We are asking for consideration of a commercial park that consists of a mixture of commercial, trade, wholesaling, and office uses. These uses minimize the commercial traffic flows, but can take advantage of the visibility. These uses are more consistent with those allowed by the Owasso Zoning Code in the General Commercial (CG) District and it would be our argument that in this case CG zoning is more appropriate and compatible with the area than Commercial Shopping (CS) District. To address site lay -out questions we would submit a DEVELOPMENT CONCEPT Development Concept. This plan should not be considered as a Site Plan; but rather, it should be considered as an "idea drawing ". It would be Tyann Development's intention that the subject tract, when finally completed would appear to be somewhat similar to the Development Concept. We would hope that this would be accomplished by using a combination of, (1) an on -site zoning pattern that restricted use of areas adjacent to residential properties, but at the same time still requires the construction of a screening fence; (2) the use of reasements on the Plat to reinforce the zoning pattern and insure that no commercial construction will occur closer than 40 feet to t the back property lines o� any residential use; (3) the use of restrictive covenants on the Plat to require perpetual landscape screening i Phase III Castle Point Commercial Park Smith School and maintenance of the storm water reserve area by the lot owners; and (4) the individual Site Plan Review conducted by the Owasso Planning Commission for each lot prior to development. CONCLUSION: t In summary, it has been shown that; (1) over 60% of the land abutting the east service road of the U.S. Highway 169 expressway between 76th Street North and 86th Street North is zoned either General Commercial or Light Industrial, (2) General Commercial uses exist along the expressway between 86th Street North and 96th Street North, (3) as development occurs the service road will ' be put into place to provide adequate traffic support, (4) commercial uses with an office buffer are the most appropriate uses for the area in question, as confirmed by Owasso Planning Commission and City Council actions taken on an 8 acre tract of land south of the subject tract, and (5) Tyann Development will provide all appropriate site development precautions to buffer adjacent school and residential uses. ' Therefore, it can be concluded that the request before you for General Commercial and Medium Intensity Office is appropriate and due strong consideration for approval. MEMORANDUM i 1 1 1 1 1 t 1 1 1 1 THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR OPUD -13 REZONING REQUEST April 12, 1995 The Owasso Planning Commission held a public hearing on April 11, 1995 to consider a rezoning request from Pittman, Poe & Associates for a Planned Unit Development to be located on a 126.805 acre subject tract recently annexed by the City of Owasso. The subject tract is located at the southeast corner of E. 96th Street North and Garnett Road. The proposal submitted by the applicants consists of a total request of 170 residential units within the subject tract, 100 of which would be initialized for single - family and 70 for multi- family /retirement villas. The densities being proposed by the applicants are well within the underlying zoning being requested for both areas (RS -1 and RM -1), which would allow for up to 192 residential dwellings. Both residential areas are located in close proximity to the E. 96th and Garnett intersection, while deeper within the subject tract the applicants are proposing high tech industrial, office, and commercial development with underlying zonings of IL, OL, and CS. Also included within the request is a 75 foot landscape easement, 25 feet of which would contain a landscape buffer area including a pedestrian jogging trail. This area is intended to buffer any residential development from the high tech industrial uses and staff is recommending that this area be installed prior to any industrial development of the site. This would insure that any residential areas would be buffered during the construction stages of development, not just at the completion. At the public hearing, several nearby property owners voiced concerns regarding the drainage in the area, as well as the volume of traffic through the 96th Street intersection. Staff is including the requirement of a detailed drainage report for the subject property at the time of platting and did identify the city and county efforts for improvements to that intersection. The proposal submitted by the applicants consists of a total request of 170 residential units within the subject tract, 100 of which would be initialized for single - family and 70 for multi- family /retirement villas. The densities being proposed by the applicants are well within the underlying zoning being requested for both areas (RS -1 and RM -1), which would allow for up to 192 residential dwellings. Both residential areas are located in close proximity to the E. 96th and Garnett intersection, while deeper within the subject tract the applicants are proposing high tech industrial, office, and commercial development with underlying zonings of IL, OL, and CS. Also included within the request is a 75 foot landscape easement, 25 feet of which would contain a landscape buffer area including a pedestrian jogging trail. This area is intended to buffer any residential development from the high tech industrial uses and staff is recommending that this area be installed prior to any industrial development of the site. This would insure that any residential areas would be buffered during the construction stages of development, not just at the completion. At the public hearing, several nearby property owners voiced concerns regarding the drainage in the area, as well as the volume of traffic through the 96th Street intersection. Staff is including the requirement of a detailed drainage report for the subject property at the time of platting and did identify the city and county efforts for improvements to that intersection. RECOMMENDATION: Staff recommended approval of the Planned Unit Development request with several conditions which are included within the detailed staff report. The Planning Commission also recommended approval of the PUD request (4 -1). This is the first Planned Unit Development request to be reviewed by the Council since April of 1994. OPUD -13 materials submitted by the applicant. 1 1 1 1 1 1 1 CITY OF OWASSO Planning Department OPUD -13 Staff Report CONCEPT OF A PUD The concept behind a Planned Unit Development is that it provides a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in planning and development of large parcels of land. In short, a PUD allows for forms of conditional zoning that would not be permitted if it was a typical rezoning request. The PUD concept allows the developer to "collect or pick -up" all the developable floor area allowed by the various parcels zoned commercial or office and all the lots allowed by those parcels zoned single- family, and "place" them back onto the subject tract based upon an approved master plan and text (including bulk and area standards) that considers the physical conditions on and around the entire tract. The Smith Farm Community Development PUD, does indeed contain commercial, single - family, multi - family, office, and light industrial land uses. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete, coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND Planned Unit Development #13 is 126.805 gross acres in size, all of which is undeveloped with the exception of the Smith's current residence on Garnett Road. The underlying zoning on the entire tract is AG (Agricultural) and the conceptual development plan allows for the Smith home and lot to become a portion of the planned residential area. The Smith Farm Community Development is located at the S/E corner of E. 96th Street North and Garnett Road. The subject tract is bordered by Highway 169 on its eastern boundary, E. 96th Street North on its northern boundary, Garnett Road on its western boundary and existing residential property zoned RE (Residential Estates) to the south. The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and Text. The plan and text call for the development of a single - family low density residential area as well a multi - family area which would be intended to develop at RM -1 (Residential multi- OPUD -13 ' Staff Report Page 2 of 6 ' family low density). The latter area is intended for villas and townhome development for retirement housing, allowing for the flexibility of rental units or outright purchase. ' Immediately abutting the 25 foot landscaped buffer area, is the planned office /research /light industrial area. The rear of these lots (the portions which would be abutting the single - family residential rear yards) will include a 75 foot landscape easement, 25' of which is a landscape buffer. This buffer would include a pedestrian trail system and extensive landscaping including berms. The rear setback requirement on this property is 75 feet ... this area combined with the required rear yard setback of 30 feet for the single - family dwelling area would ensure a minimum of 105 feet of area where no principal structure could be placed. Three large commercial tracts are also included in the development concept. These tract (two at the northeast portion of the tract, one at the southwest corner of the tract, would have ' high visibility from E. 96th Street North, Highway 169, and Garnett Road respectively. Maps for existing utilities, topography, slope, hydrology, soils, and surrounding zoning are all included within the applicants text for your information and review. STAFF ANALYSIS The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: (1) Whether the PUD is consistent with the Comprehensive Plan. (2) Whether the PUD is in harmony with the existing and expected development of surrounding areas. (3) Whether the PUD is a unified treatment of the development possibilities of the project site. (4) Whether the PUD is consistent with the stated purposes and standards of the PUD Ordinance. (a) Permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; (b) Permit flexibility within the development to best utilize the unique physical features of the particular site; (c) Provide and preserve meaningful open space; OPUD -13 Staff Report ' Page 3 of 6 (d) Achieve a continuity of function and design within the development. CONSISTENCY WITH COMPREHENSIVE PLAN The Comprehensive Plan is implemented through the use of the zoning process. This means that when zoning or PUD requests are presented to the Planning Commission and City Council, they should be consistent with the Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the subject tract to be developed at a Low Density Residential Density, with a Commercial node at the intersection of E. 96th Street North and ' Garnett Road to be developed at both medium and high densities. Once again, it is important to note that the Comprehensive Plan, last updated in 1985, is likely to be outdated and ' inaccurate in 1995 as it is applied to this area. While a substantial portion of the applicants proposal would call for residential development at the residential designation that the Comprehensive Plan called for in 1985, an equally substantial portion is being requested to ' be developed for residential multi - family, commercial and high tech industrial uses. Considering the portions that would be abutting Highway 169, Garnett, and E. 96th Street North, the applicants request is following existing development trends. Certainly, one can reach the conclusion that the Owasso area has grown leaps and bounds above what anyone would have anticipated. Therefore, the previous Comprehensive Plan has proven to be outdated in certain areas within its study boundary. Two forms of residential lots are proposed by the applicant. The majority of the residential area being requested in the PUD contains residential lots to be developed with RS -1 ' (Residential Single - Family Low Density) as its underlying zoning classification with slight variation on lot sizes. Currently, the minimum lot area for an RS -1 zoned development would be 13,500 square feet, while the applicant is requesting the minimum lot size at 12,000 square feet, however many lots would be substantially larger than the minimum size. The density permitted by RS -1 zoning would allow for up to 106 single family dwelling units on 39 acres - the applicants are currently proposing 75 single - family lots with their submittal, with the flexibility to expand that number to 100. A small portion of the PUD contains multi- family and single - family attached residential lots. This area would abut the southeast corner of E. 96th Street North and Garnett Road and contains 8.6 acres. The applicant has requested either of these forms of uses in the event that at the time of development completion, individual units can be sold or rented or a ' mixture of both. An RM -1 zoning district, the underlying zoning designation being requested by the applicant, would permit up to 86 dwelling units, while the applicants are requesting the amount to exceed 70 units. OPUD -13 Staff Report Page 4 of 6 The applicants are also requesting seven large lots for office or office /research /light industrial uses. One of the seven lots is reserved strictly for office uses and far exceeds the minimum development standards for the underlying OL designation. The other six lots, identified for office /research /light industrial, also exceed the minimum property development standards for IL, the requested underlying zoning designation. ' Three lots strictly reserved for commercial development are being requested by the applicants. The underlying zoning designation for these lots is CS (Commercial Shopping) ' and the proposal would also meet all property development standards in this area as well, allowing up to 718,087 square feet of commercial retail area. Harmony With Existing and Expected Development Any large development such as the proposed PUD is going to create rapid changes within a community and new demands will be placed upon our existing infrastructure. It is important to note, however, that in a community like Owasso, this growth would be likely to occur regardless of this development. The PUD simply increases the demand for services more quickly and thereby shortens the schedule for determining solutions. In reviewing existing development, it appears that the proposed PUD and subsequent subdivision would be a logical expansion of both residential and commercial development found to the south along the Highway 169 corridor. The City of Owasso is likely to see expanded residential development in this area has already occurred with the addition of Bailey Ranch Estates within a half -mile of this site and additional residential development is likely due to the proximity of the golf course. Legal, Planning and Site Engineering Concerns were noted regarding the ability of the developers to service this property with sanitary sewer when the property was reviewed for annexation, as well as what effect their would be on water pressure. Review of existing sanitary sewer loads as well as a K -pipe study will be performed on this area to ascertain the impact. As a reminder, staff will also be requiring acceleration and deceleration lanes along any entrances from E. 96th Street North and Garnett Road, as well as sidewalks along these frontages. F 1 1 1 1 i 1 1 1 OPUD -13 Staff Report Page 5 of 6 Unified Treatment of the PUD Subject Area A review of the applicant's Development Plan for "Smith's Farm" finds a wide - ranging utilization of the project site. A large area of the tract will be utilized for residential purposes, while the remaining areas are designated for office /research /industrial and commercial development. Existing farm ponds within the subject site are intended to be utilized as attractive areas to enhance development and act as a buffer between single - family and multi- family areas, as well as being a focal point at one end of the pedestrian trail through the landscaped buffer area. Neighboring Property Owner's Concerns As of April 5, 1995, no comments opposing the Planned Unit Development request have been received by this office. STAFF RECOMMENDATION Staff has reviewed the proposal by the applicant and feels it is a solid one. Because the subject property is bounded on three of its four sides by existing roadways and /or streets, objection from surrounding property owners is not likely. While industrial areas are identified within the PUD, these areas are fully contained within their boundaries and do not abut existing residential areas. The areas identified as light industrial are not likely to develop as an auto body shop and metal shop, however, and are likely to be in the form of high tech, computer type businesses. Nevertheless, safeguards have been taken by the applicants to lessen any possible negative impact. The applicants density requests are well within the requested underlying zoning, and it would be staff's request that the Planning Commission and /or Council not permit this application to be amended to increase these densities in the future. At the very minimum, requests in densities in this area should be delayed until substantial improvements are made at the E. 96th Street North and Garnett intersection. The use of the pedestrian trail within the buffer area, possibly to be utilized by both residents and office workers, is also a well- thought addition to a mixed use development. Staff would, however, request a detailed landscaping plan be reviewed and approved by the Planning Commission prior to final plat approval and require its installation prior to any construction in areas abutting residential designated areas. OPUD -13 Staff Report Page 6 of 6 Staff is recommending Owasso Planning Commission approval of OPUD -13 with the following conditions: (1) That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. MFMORAvDUM Ll TO: IFROM: ISUBJECT: IDATE: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO RODNEY J RAY CITY MANAGER RELEASE OF CDBG GRANT FUNDS FOR WASTEWATER INFRASTRUCTURE GRANT (REHAB) April 14, 1995 INTRODUCTION: A series of steps must be taken in order for the Oklahoma Department of Commerce (ODOC) to release the Community Development Block Grant (CDBG) funds for the infrastructure improvements connected with the Sewer Rehab project. The same series of steps was completed when the staff finalized the NSP - CDBG infrastructure grant in March. Each step requires formal action by the Council, however these steps are generally considered to be "house cleaning" type actions. First, an Environmental Review Record must be prepared. This record consists of a request for review being sent to various state and federal agencies and a documentation of their responses ' in the form of a statutory checklist and an environmental assessment. The INCOG staff has prepared the record as a part of their administration services contract with the City. They have determined that this project will have no significant effect on the environment. As a result of this determination, the Council is in a position to designate the Mayor as the certifying officer to execute the Environmental Certification and Release of Funds Request and to make finding of Categorical Exclusion /Exempt from Release of Funds Report. In addition the Council must approve an Anti-Displacement Plan, even though no displacement PP P will occur as a part of this project. INCOG staff has prepared this document as a part of their contract with the City. However, at this point the following is a specific explanation of each current request by agenda ' item. i I RELEASE OF GRANT FUNDS (SEWER REHAB) April 14, 1995 Page 2 AGENDA ITEM #16 DESIGNATION OF MAYOR AS CERTIFYING OFFICER BACKGROUND: Federal and state regulations require that each grant recipient designate a certifying official. This official is typically the mayor when the recipient of a grant is a city. The certifying official (through use of the staff and contractually with INCOG) assumes responsibility for the environmental review process, making findings, and signing certifications. In simple terms, it states that we have completed the preceding two items (see attached Environmental Certification). RECOMMENDATION: The staff recommends the City Council authorize the Mayor to execute the Environmental Certificate as required by grant conditions. AGENDA ITEM #19 REQUEST FOR RELEASE OF FUNDS BACKGROUND: The Request for Release of Funds is a document that identifies that the City has completed all the requirements of the grant, whether they are state, federal or local grant conditions. This document has been completed by INCOG and is included as an attachment. RECOMMENDATION: The staff recommends that the council authorize the Mayor to execute a "Request for Release of Funds" as required by grant conditions for the CDBG -Rehab Project. AGENDA ITEM #20 ANTI- DISPLACEMENT PLAN BACKGROUND: The Anti- Displacement Plan addresses the actual or unexpected demolition of low /moderate income dwelling units. There will be no demolition of dwelling units because of the construction of this project. No demolition or conversion of low /moderate- income dwelling units is anticipated by the City in conjunction with the activities assisted with these funds. Under Section 104 (d) of the Housing and Community Development act of 1974, as Amended, if such demolition or conversion unexpectedly occurs, before obligating or expending funds that will directly result in such demolition or conversion, the City will make public and submit to the Oklahoma Department of Commerce the following information in writing: 1. The request was for an additional three officers, however, on February 9, 1995, this department was notified that federal ' monies had been awarded to the City of Owasso which can be used to supplement one new police officer's salary and benefits. The amount awarded to the City and available for use over the next three years is $61,343. This amount is designed to supplement one additional officer's salary and benefits by 75%. Before any funds or hiring can take place, specific budget information and agreements must be submitted, approved and signed. Attached are the specifics which estimate what commitment will be required from the City over the next three year period. The budget summary requests information regarding a new officer's salary. The finance department has provided specific salary and fringe benefit estimates based on current information. These figures have been calculated for a three year period with a 1 reasonable cost of living increase each year. One officer's salary and benefit cost to the City for the next three years is estimated at approximately $96,787.71. The grant which was awarded to the city for this position was to be for approximately 75% of the cost of hiring a new officer for a three year period. The initial estimated figure is $61,343. However, that figure may be adjusted (more or less) upon completion of the required paperwork. Depending upon the amount of money received from this program and based on the figures provided, the total cost to the City by utilizing this grant is estimated at $24,196.93 to be paid over a three year period. Under this grant the federal share must decrease each year while the local share increases. This is designed to lead to full and total local funding at the conclusion of the three year period. Though the amounts to be paid each year may not be exact, it is anticipated that approximately $6,000 will be budgeted in 1995 -1996, $8,000 in 1996 -1997 and the remaining of the grant to be paid in 1997 -1998 at approximately $10,000. Washington, D.C- 20530 February 27, 1995 Dear COPS Grant Recipient: ' Many of you have contacted us concerning reports in the media about attempts to change the COPS police hiring grants from their current structure, made directly to your agency, into a formula block grant program administered by the Bureau of Justice Assistance. This has led to a great deal of confusion and r concern about how such a change might affect this Office and COPS grants that have already been awarded. I am writing to reassure you that we do not expect the block grant proposal in Congress will have any effect on any grant that has been awarded thus far by the COPS Office. Although we cannot predict the ultimate impact of the proposals, we are committed to continuing the direction taken so far, and to providing the level of customer service that you have come to expect. We also will advise you if ultimately there are any substantive changes to the COPS program. ' COPS grants awarded this year are to be paid completely out of funds which were appropriated to the COPS Office this fiscal year. This includes the upcoming programs which the COPS Office will announce this fiscal year. Thus, unless Congress were to rescind funds appropriated this year, Congressional changes to the COPS program — like the adoption of a block grant approach — would only affect the ability of the COPS Office to award and pay for grants in future fiscal years. There is currently no evidence of any intent on the part of the Congress to rescind COPS funds appropriated for this fiscal year. It is also important to note that many agencies receiving awards under one of the COPS hiring grant programs for this year received fewer than the total number of officers they requested. In the next fiscal year we expect to fund all reasonable requests for additional officers, and at this point we do not expect any additional application will be required. If the House or Senate Block Grant proposals were adopted, we would be unable to proceed using these existing applications, because under these proposals there are no assurances ' that any money would be specifically available for police hiring. The COPS Office has enjoyed great success in helping law enforcement agencies across the country increase the size of their force and expand community policing in the cities, towns and counties they serve. To date, we have announced three -year grants to nearly 11,000 local law enforcement agencies, making it possible for them to hire nearly 17,000 new officers. This represents significant progress toward fulfilling President Clinton's promise to put 100,000 new community police officers on America's streets. The request was for an additional three officers, however, on February 9, 1995, this department was notified that federal monies had been awarded to the City of Owasso which can be used to supplement one new police officer's salary and benefits. The amount awarded to the City and available for use over the next three years is $61,343. This amount is designed to supplement one additional officer's salary and benefits by 75%. Before any funds or hiring can take place, specific budget information and agreements must be submitted, approved and signed. Attached are the specifics which estimate what commitment will b� required from the City over the next three year period. The budget summary requests information regarding a new officer's salary. The finance department has provided specific salary and fringe benefit estimates based on current information. These figures have been calculated for a three year period with a reasonable cost of living increase each year. One officer's salary and benefit cost to the City for the next three years is estimated at $105,121.27. The grant which was awarded to the City for this position was to be for approximately 75% of the cost of hiring a new officer for a three year period. The initial estimated figure is $61,343. This figure may be adjusted (more or less) upon completion of the required pa-perwork. Depending upon the amount of money received from this program and based on the figures provided, the total cost to the City by utilizing this grant is estimated at $26,280.32 to be paid over a three year period. Under this grant the federal share must decrease each year while the local share increases. This is designed to lead to full and total local funding at the conclusion of the three year period. C. 10530 February 27, 1995 Dear COPS Grant Recipient: Many of you have contacted us concerning reports in the media about attempts to change the COPS police hiring grants from their current structure, made directly to your agency, into a formula block grant program administered by the Bureau of Justice Assistance. This has led to a great deal of confusion and concern about how such a change might affect this Office and COPS grants that have already been awarded. I am writing to reassure you that we do not expect the block grant proposal in Congress will have any effect on any grant that has been awarded thus far by the COPS Office. Although we cannot predict the ultimate impact of the proposals, we are committed to continuing the direction taken so far, and to providing the level of customer service that you have come to expect. We also will advise you if ultimately there are any substantive changes to the COPS program. COPS grants awarded this year are to be paid completely out of funds which were appropriated to the COPS Office this fiscal year. This includes the upcoming programs which the COPS Office will announce this fiscal year. Thus, unless Congress were to rescind funds appropriated this year, Congressional changes to the COPS program — like the adoption of a block grant approach — would only affect the ability of the COPS Office to award and pay for grants in future fiscal years. There is currently no evidence of any intent on the part of the Congress to rescind COPS funds appropriated for this fiscal year. It is also important to note that many agencies receiving awards under one of the COPS hiring grant programs for this year received fewer than the total number of officers they requested. In the next fiscal year we expect to fund all reasonable requests for additional officers, and at this point we do not expect any additional application will be required. If the House or Senate Block Grant proposals were adopted, we would be unable to proceed using these existing applications, because under these proposals there are no assurances that any money would be specifically available for police hiring. The COPS Office has enjoyed great success in helping law enforcement agencies across the country increase the size of their force and expand community policing in the cities, towns and counties they serve. To date, we have announced three -year grants to neariv 11,000 local law enforcement agencies, making it possible for them to hire nearly 17,000 new officers. This represents significant progress toward fulfilling President Clinton's promise to put 100,000 new community police officers on America's streets. As promised, I have made contact with several people who contract with municipalities to act in the capacity of labor negotiator. I have asked two individuals to attend the next regularly scheduled Council meeting in order that you may interview them and ask relevant questions. My discussions with Mr Cates indicate that an executive session is ' appropriate for such interviews. Therefore, I have placed on the agenda a request for an executive session so you can discuss various issues with each of the candidates. ' The persons are: 1. Ed Koepsel - Tulsa 2. Kathy Bottroff - Oklahoma City /Tulsa I have also requested that each person be prepared to discuss the cost of their services in terms of a two hour session in Owasso (with the understanding that the figure would be used to determine an hourly rate). My belief is that a negotiator will spend approximately five hours per week on negotiations for approximately five more weeks. I have not had an opportunity to collect and distribute resum6s from each person, but I have met personally with each candidate to brief them on the Council's interest and provide background.
