PROCLAMATION
CITY OF OWASSO, OKLAHOMA
' WHEREAS, Last year 16,600 Americans were killed and almost half a million were injured
in impaired driving crashes. That's one death about every 30 minutes. Many
were innocent victims, not the impaired drivers themselves; and,

WHEREAS, In recent years society has experienced a dramatic shift in attitude regarding
impaired driving, thanks to the combined efforts of law enforcement and
community groups. Society no longer tolerates those who choose to drink and
drive; and
WHEREAS, Americans will not tolerate the senseless death and injury on our nation's
roadways. Drivers arrested for driving under the influence can expect no
sympathy from the police, employers, or neighbors. Driving under the influence
is unacceptable; and,
WHEREAS, During the holidays Owasso residents can take a stand against impaired drivers
by joining law enforcement, businesses, government agencies and private citizens
in keeping their vehicle headlights on as they drive during the day on Friday,
December 15, 1995, to participate in "Lights On for Life ", an observance
designed to remember persons killed and injured in alcohol - related crashes and
as a reminder of law enforcement's watchful eye on drunk drivers. "Lights On
for Life" is the showcase event for National Drunk and Drugged Driving (31))
Prevention Month, held in December,
NOW, THEREFORE, I, Charles L Burris, by virtue of the authority vested in me as Mayor
of the City of Owasso, do hereby proclaim Friday, December 15, 1995 as
LIGHTS ON FOR LIFE DAY
in Owasso, Oklahoma, and call upon all motorists to drive with their vehicle headlights on
throughout that day as a memorial to the victims of impaired driving, and as a reminder of the
dangers of drunk and drugged driving.
IN WITNESS THEREOF, I have hereunto set my hand and caused the seal of the City of
Owasso to be affixed this 5th day of December, 1995.

The Owasso City Council met in regular session on Tuesday, November 21, 1995 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, November 17, 1995.

Mayor Burris called the meeting to order at 7:03 p.m.

ITEM 6: REQUEST APPROVAL OF THE CLAIMS
Mr Ramey moved, seconded by Mayor Burris, that the following claims be approved:
(1) General Fund $22,960.12; (2) Workers Comp Self -Ins Fund $854.17; (3) Ambulance Service
Fund $4,057.24; (4) E -911 $257.32; (5) City Garage $3,678.40; (6) Capital Improvements
$1,159.65; (7) Capital Projects Grant $5,866.28; (8) General Fund Payroll $108,193.44;
(9) City Garage Payroll $2,064.54.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR ENGINEERING SERVICES ASSOCIATED
WITH THE CONSTRUCTION OF A PARKING LOT AND DRAINAGE
IMPROVEMENTS FOR PRECISION COMPONENTS.
Mr Carr presented the background on this item. Precision Components needs additional parking
spaces to accommodate their work force. A grant has been received from the Oklahoma
Department of Commerce to fund improvements that include a parking lot and stormwater
detention facility. Engineering firms were invited to submit qualification statements and fee
proposals for the design, bidding and contract administration of the project. Four firms
submitted proposals. A review committee ranked the proposals according to the total number
of evaluation points assigned to various items. Two firms were identified as qualified and highly
responsive and were invited to submit a detailed Scope of Services, including fees. The two
firms were again ranked, with The Breisch Company Inc receiving the highest number of points,
with staff recommending that they receive the contract. Mr Ramey moved, seconded by Mr
Ewing, to approve an agreement for engineering design services with The Breisch Company Inc,
Sand Springs, OK for the design, bidding and construction administration of parking lot and
drainage improvements at the Precision Components building in the lump sum amount of
$8,322.50, and authorization for the Mayor to execute the agreement.

ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN
AMENDMENT TO THE CONTRACT WITH SACK & ASSOCIATES FOR
ENGINEERING AND DESIGN SERVICES ASSOCIATED WITH THE NSP
UTILITY AND ROADWAY SYSTEM IMPROVEMENTS.
■ Sack & Associates Inc was awarded a contract for professional engineering services in the
design, bidding and contract administration of roadway and utility improvements for the NSP
' building on February 21, 1995. The original contract did not include the sanitary sewer line and
additional surveying, engineering and drafting are required to develop the project plans. Sack
& Associates have requested an amendment to include, those services. An additional $7865 is
requested to complete the project. Funds are available in the ODOC grant for this project.
Mayor Burris moved, seconded by Mr Ramey, to approve an amendment to the engineering
design services agreement with Sack & Associates Inc for the NSP roadway and utility
■ improvements in the amount of $7865 and authorization for the Mayor to execute the agreement.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
. ORDINANCE #506, AMENDED. AN ORDINANCE CORRECTING THE
LEGAL DESCRIPTION IN ORDINANCE #506.
At the May 16, 1995 meeting, Council approved a request to close a portion of a utility
easement located on Lot 16, Block 4, Barrington Point II. That ordinance contained an error.
Ordinance #506, amended would correct that error. An emergency clause is included so the
' legal action currently under way to finalize the closing of the easement is not slowed. Mr Ewing
moved, seconded by Mr Ramey, to approve Ordinance #506, Amended, and inclusion of an
emergency clause to allow legal action to be finalized.

REQUEST FOR AN EMERGENCY CLAUSE TO BE ATTACHED TO
ORDINANCE #506. AMENDED. PROVIDING FOR THE ORDINANCE TO
BECOME EFFECTIVE IMMEDIATELY UPON PUBLICATION OF THE
ORDINANCE.
Mr Ewing moved, seconded by Mr Ramey, to approve the emergency clause on Ordinance
#506, Amended.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
JOURNAL ENTRY OF JUDGMENT WHEREIN THE CITY ATTORNEY
WOULD BE AUTHORIZED TO EXECUTE, ON BEHALF OF THE CITY
ALL DOCUMENTS RELATING TO THE PERMANENT CLOSING OF A
PORTION OF A UTILITY EASEMENT ON LOT 16 BLOCK 4
BARRINGTON POINT SUBDIVISION.
On May 16, 1995 the City Council approved initial action to close a utility easement located on
Lot 16, Block 4, Barrington Point II. After the ordinance is approved, the party requesting the
ordinance must take legal action to formally remove any rights the. City of Owasso would have
on reopening the easement. A Journal Entry of Judgment has been received in that matter. Mr
Ramey moved, seconded by Ms Barnhouse to authorize the City Attorney to execute the Journal
Entry of Judgment in Tulsa County Case No CJ 95 -4365, Baswell vs City of Owasso, an
easement closing approved by the Council.

Mr Ray expressed the appreciation of the City Council to Miss Owasso 1996, Teressa Sorenson,

Hensley for taking minutes at the meeting.

Mr Ewing asked about some clean -up work being done on a punch list form Bailey Ranch
Estates subdivision. That work is complete. Staff is preparing a new policy relating to the
acceptance of developer's infrastructure improvements. Requests for acceptance of infrastructure
improvements will not be brought to the Council until, the punch list is 100% complete.

SUBJECT: APPROVAL OF NOISE ORDINANCE #517
DATE: November 27, 1995
BACKGROUND:
The November 3rd City Manager's report introduced an ordinance proposal that would assist
in controlling nuisance noise produced by "extra loud" vehicle music systems. Complaints in
this area have increased over the past several months. It is anticipated that as our community
continues to grow and as our youth population increases proportionately, that complaints in this
area will also increase.
The objections range from vibrating music to obscene lyrics played when younger children are
within earshot. This matter has been raised in the past and the problem of fair enforcement was
a concern. The City Attorney has proposed an ordinance which has been used in an adjacent
suburban city with great success. The criteria is very specific and definable so that any
challenges would be sustained in court as long as the ordinance is followed.
The education of the ordinance has proven very successful in the youth arena in the city which
passed a similar ordinance recently. Contact was made with a police official in that city who
stated that there has been virtually no complaints from the community since the passing and
enforcement of the ordinance.
The enforcement will be at the discretion of the police officer and will be intended for use in
the most extreme cases and when warnings have not been obeyed. The purpose of the ordinance
is not to prevent the youth from their freedom to listen to music or enjoy themselves, but rather
to not disturb others who may not share their same taste in audio entertainment.

AMPLIFICATION SYSTEMS FROM A MOTOR VEHICLE;
PROVIDING FOR DEFINITIONS AND PROVIDING FOR PENALTY
OF VIOLATION THEREOF; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH;
DECLARING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA:
Section 1. That Part 15 - Traffic and Vehicles, Chapter 3, Section 15, Vehicle Equipment,
of the Code of Ordinances of the City of Owasso, Oklahoma, be and the same is hereby amended by
there being provided as Section 15 -309 the following, to -wit:
Section 15 -309: Loud Sound Amplification Systems Prohibited.
a. No person operating or occupying a motor vehicle on a street, highway, alley, parking
lot, or driveway shall operate or permit the operation of any sound amplification system from
the vehicle so that the sound is plainly audible at a distance of fifty (50) or more feet from the
vehicle.
b. "Sound amplification system" is defined as any radio, tape player, compact disc player,
loud speaker, or other electronic device used for the amplification of the human voice, music,
and /or musical instruments.
C. "Plainly audible" is defined as any sound produced by a sound amplification system
from the vehicle which clearly can be heard at a distance of fifty (50) feet or more.
Measurement standards shall be by the auditory senses, based upon direct line of sight.
Words or phrases need not be discernible and base reverberations are included. The motor
vehicle may be stopped, standing, parked or moving on a street, highway, alley, parking lot,
or driveway.
d. It is an affirmative defense to a charge under this section that the operator is
authorized by law to operate the sound amplification system, for any of the following
circumstances:
(1) The system was being operated to request medical or vehicular assistance or
to warn of a hazardous road condition;
(2) The vehicle was an emergency or public safety vehicle,
(3) The vehicle was owned and operated by the City of Owasso, or public or
private utility company,
(4) The vehicle was used in authorized public activities, such as parades,
fireworks, sports events, or other activities which have been approved by the appropriate city
official or body.
e. Any person who violates any provision of this section, upon conviction, shall be
subject to a fine in the amount of Fifty Dollars ($50.00), exclusive of cost.

Section 2: REPEALER. Any ordinance or parts of ordinances inconsistent with the terms
and provisions of this Ordinance is hereby repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of
other ordinances regulating and governing the subject matter covered by the Ordinance.
Section 3: SEVERABILITY. If, regardless of cause, any section, subsection, paragraph,
sentence, or clause of this ordinance or the application of said ordinance is rendered or declared
invalid or unconstitutional by any court action, or by reason of any existing or subsequently enacted
legislation, the remaining sections, subsections, paragraphs, sentences, or clauses shall continue in full
force and effect and shall be construed thereafter as being the entire provisions of this Ordinance.
Section 4: This ordinance shall, upon passage, become effective thirty (30) days from the
date of first publication as provided by state law.

BACKGROUND:
On November 7, 1995, the Owasso City Council approved an expenditure of $16,492 to Quality
Chevrolet for the purchase of a 1996 Chevrolet Caprice through state contract bid process for
full size police vehicles. The vehicle was picked up from Yukon, Oklahoma the next day where
the fleet manager informed the department of a $260 shortage in payment.
The initial price of the 1995 state vehicle was $16,752, however, when the vehicle was ordered
earlier in the year, several options were deducted from the initial price, reducing the vehicle
order to $16,492. When the vehicle which was ordered for our department was given to another
department (because our fiscal year had not begun), the replacement vehicle was ordered with
all the options available, at the original state bid price.
The requisition and subsequent purchase order should have read $16,752, rather than $16,492.
The cost difference of $260 is still owed to Quality Chevrolet.
This error should have been detected before bringing the issue to council for approval.
RECOMMENDATION:
Staff recommends approval of an additional payment of $260 to Quality Chevrolet for a 1996
Chevrolet Caprice purchased at State bid price.

This letter is a follow -up to our earlier conversation pertaining to the Owasso Police
Department's purchase of a 1996 Chevrolet Caprice for the 1995 State bid cost of
$16,752.
I had indicated our interest in January of this year and due to our budget year not
beginning until 1 July, we were unable to purchase any of the 1995 models. I do
understand that some production of the 1996 Caprice models will be manufactured in
September with an expected delivery date of sometime in October. I am anxiously
waiting the arrival of this vehicle and appreciate your cooperation and assistance in
making this occur.

requisitioning funds which are not yet available. Additionally, the process that the
City of Owasso follows mandates City Council approval on expenditures such as this.

BACKGROUND:
In August, the City of Owasso conducted a public auction to rid the departments of excess
' property and to sell items which had been collected as lost, stolen or found by the Owasso Police
Department. Among these items were several weapons which were not made available to the
general public. These weapons were requested to become the property of the City of Owasso
' for disposition. The presiding judge stipulated that should these weapons become the property
of the City of Owasso, they could not be sold to the general public. The majority of these
weapons cannot be used by this department in any official capacity, however may be offered for
' sale or trade to licensed gun dealers in exchange for equipment which may be used.
As per City policy, before any sale or trade of City property can take place, the City Council
must determine the property as excess to the needs of the City.
' RECOMMENDATION:
Staff recommends Council approval to declare the weapons described in the attachment as excess
property of the City of Owasso and that these weapons may be sold or traded to certified gun
dealers through a specific approved process.

SECTION 7 -108 SALES, COUNCIL TO DECLARE SURPLUS OR OBSOLETE COM-
PETITIVE BIDDING.
No surplus or obsolete supplies, materials or equipment of a value of more than
Five Hundred Dollars ($500.00) may be sold until the council shall have declared them
obsolete or surplus. Before the city manager sells any surplus or obsolete supplies,
materials or equipment, except as otherwise provided below, he shall advertise them for
sale in a newspaper of general circulation in the city or give notice in such other
manner as he deems necessary adequately to reach prospective buyers to give them
opportunity to make bids. All bids shall be sealed and shall be opened in public at a
designated time and place, except when the sale is by auction. The city manager may
repeatedly reject all bids and advertise or give notice again. He shall sell such supplies,
materials or equipment to the highest responsible bidder for cash. In case of a tie, he
may sell to either of the bidders tying, or may divide the sale among two (2) or more
tying, always selling to the highest responsible bidder or bidders for cash. (Prior Code,

SECTION 7 -109
WHEN COMPETITIVE BIDDING IS NOT REQUIRED.
The city manager may sell the following without giving an opportunity for
competitive bidding:
I. Surplus or obsolete supplies, materials or equipment whose total value
does not exceed One Thousand Five Hundred Dollars ($1,500.00) in a single transaction;
and
2. Supplies, materials or equipment when sold at a price at least as great as
that paid by the city for the same.

SECTION 7-110
MAINTENANCE BONDS REQUIRED ON PUBLIC
IMPROVEMENTS; CONTRACTS.
A. Anyone, hereinafter referred to as "principal ", constructing improvements

COMES NOW the City of Owasso, Oklahoma, a municipal cor-
poration, on behalf of Maria A. Alexander, Chief of Police of said
City, and acting pursuant to 11 O.S. 534 -104, presents this
Application to the Court seeking judicial supervision by the Court
over the disposition of certain property presently secured in the
Property Room of the Owasso Police Department. In support hereof,
your Applicant states:
1. Attached hereto, made a part hereof and identified as
Exhibit "A ", is a true and correct list of personal property items.
This exhibit identifies each item of property proposed for sale,
together with any identifying numbers or marks, the date the
property came into the possession of the City of Owasso, Oklahoma,
if known, and the name and address, if known, of any person
presently assumed to own any of such itemized property.
2. That each item of property has been in the custody of the
City of Owasso Police Department for at least six (6) months prior
to the date hereof, and its continued retention by the City of
Owasso, Oklahoma, is not needed for evidentiary purposes or for
any other purpose in connection with any litigation.
3. That insofar as the dangerous or deadly weapons identi-
fied on Exhibit "A" hereto are concerned, your Applicant would
state that such property was never filed as an Exhibit in a crimi-

nal proceeding, or alternatively, if such was, no dispositional
order relating thereto was ever obtained by the Office of the
District Attorney for the Fourteenth Judicial District, Tulsa
County, State of Oklahoma, except as relates to 9MM pistol, a copy
of such attached as Exhibit "B ". Relating thereto, and by reason
thereof, your Applicant requests this Court authorize and order the
authoriztion to sell to duly licensed gun dealers the dangerous or
deadly weapons indicated on Exhibit "A ".
4. That insofar as the legal tender identified on Exhibit
"A" hereto is concerned, your Applicant requests the Court's order
authorizing transfer of same to the General Fund of the City of
Owasso, Oklahoma.
5. That this Court, pursuant to 11 O.S. §34 -104 as well as
common law, has jurisdiction and authority to act upon the pre-
sented Application.
WHEREFORE, premises considered, it is requested that the Court
set this Application for hearing. After issuance of Notice of such
hearing and a hearing held hereon, it is requested that the Court
adjudicate any uncertain or disputed claims of ownership of the
listed property and, with reference to any property for which
ownership claim is not presented or proven, that your Applicant be
authorized to sell or transfer salable items in the manner provided
by law, authorized to sell to duly licensed gun dealers all
dangerous or deadly weapons, and allow transfer of legal tender
unto the General Fund of the municipality.

SUBJECT: RIDING LAWN MOWER - CEMETERY

BACKGROUND:
Fairview Cemetery currently utilizes a 36- inch -cut Duetz -Allis riding lawn mower. This
mower is nine years old and now requires numerous repairs. The engine consumes large
quantities of oil and the deck no longer provides the quality appearance of finished cut grass
required in the Cemetery. Mowing at the Cemetery is augmented by use of a 60 -inch
Gravely mower. The smaller mower is required to mow between head and foot stones and
in areas too confined for the Gravely.
PRICE QUOTES:
Price quotes were obtained from three local vendors for five models of mowers. The quotes
are summarized in the following table and all mowers would meet the requirements of the
Cemetery.

Cemetery Riding Lawn Mower
FUNDING SOURCE:
Funds for the purchase of the riding lawnmower were approved in the FY 94 -95 carryover
budget for the Cemetery for Machinery and Equipment (51- 230 -5441) in the amount of
$2,400.00.
RECOMMENDATION:
Staff recommends Council approval of the purchase of a 36 -inch Regent riding lawn mower
from Standard Auto Supply, Owasso, Oklahoma in the amount of $1,850.00.

86TH STREET NORTH AND MAIN STREET ROADWAY
IMPROVEMENTS - FHC, INC.
DATE: November 29, 1995
' BACKGROUND:
The FY95 -96 Capital Improvements Program approved by the Owasso City Council includes an
0
arterial street construction project at 86th Street North from Main Street to North Cedar Street.
This project was split off from a previously identified project by the Capital Improvements
Committee.
The committee recommended for FY95 -96 that $30,000 be funded for this project to cover
engineering services, right -of -way acquisition and utility relocation. The remaining portion of
the total funds allocated for the project would be applied to construction expenses.
SCOPE OF WORK:
Generally, the improvements consist of widening and reconstruction of the roadway to provide
turn lanes, curb and gutter, and a closed drainage system on 86th Street North from Cedar Street
to approximately 300 feet west of Main Street and on Main Street from 9th Street to 14th Street.
Plans and specifications for this work were originally prepared by FHC, Inc. in December 1988
as part of a larger improvement project on 86th Street North that extended east to 129th East
Avenue.
The design project consists of updating the previous design drawings and preparing additional
construction drawings, as needed. Contract documents, including signalization improvements
at the Main Street intersection, are to be prepared.
Specific scope of work items included:
• Review, update and revision of the original design for the project;
• Review of rights -of -way requirements and preparation of necessary documents for
the acquisition of additional right -of -way;
• Performance of utilities surveys for needed relocations;
• Preparation of final construction plans and specifications; and
• Preparation of estimated total project costs, including right -of -way, construction,
utility relocations, and engineering.

REVIEW PROCESS:
Staff received qualifications statements on September 22, 1995. A packet of proposal
information was sent to twenty area engineering firms. Responses were received from five
firms.
All qualifications statements were received by the deadline and in the manner required in the
announcement. They were evaluated by a Review Committee consisting of Robert Carr and
Doug Groves. Proposals were ranked according to the total number of evaluation points
assigned by the Review Committee. Engineering submittals were evaluated using several
factors, including the ability to expedite the completion of the project in a timely manner.
Based upon the initial evaluation, the Review Committee identified FHC, Inc., HUB +Garver
and CTE Engineers as "Qualified and Highly Responsive Firms ". These three firms were
requested to submit a detailed Scope of Services containing their proposed fee for services for
final evaluation by the Review Committee.
Each firm submitted their detailed scope of services on November 10, 1995 and each proposal
was evaluated by the Review Committee. A final ranking of firms based upon the scope of
services was prepared (see attached ranking summary). Comparison of proposed manhours and
fee is summarized below:

Scope of work items were provided in detail in the FHC proposal. Fee proposals were found ,
to be very similar for both FHC and HUB +Garver; however, FHC included surveying
expenses. CTE Engineers were considered to have misunderstood the complexity of the project. '

As a result, the firms were ranked in the following order for negotiation of contract items and
' fee:

SCOPE OF WORK AND FEE PROPOSAL:
The FY95 -96 CIP budget for this project was prepared in April 1995 based on discussion with
FHC personnel to revise the previous contract documents. At that time, they had indicated re-
design engineering would be expected to be $20,000 with an additional $9,000 in direct expenses
(i.e., surveying and geotechnical). The scope of work and fee as submitted (see attachment)
reflects all required work elements for the project and is consistent with items submitted by
HUB +Garver. The scope submitted does not include bidding and services during construction.
The ability to complete the design in a timely manner is important for this project. It is
anticipated that construction funding will be included in the FY96 -97 CIP program. To insure
conformance with this anticipated schedule, design services will be completed by the end of
April 1996.
The fee proposed by FHC, Inc. for this project is as follows:
Scoping Phase $3,041.00
Pre -final Design Phase 15,535.00
6 Construction Phase 9.910.00
TOTAL $28,486.00
Staff has reviewed the fee proposal and believes the manhours and fee to be consistent with a
project of this nature.
FUNDING SOURCE:
Funds for the engineering services are included in the FY95 -96 Capital Improvement Fund
budget (line item 81 -410- 5462).
RECONU4ENDATION:
Staff recommends Council award of an agreement for engineering design services with FHC,
Inc., Tulsa, Oklahoma for design of the 86th Street North Roadway Improvements (from Cedar
street to Main Street) in the lump sum amount of $28,486.00 and authorization of the Mayor to
execute the agreement.

SCOPE OF SERVICES
The following scope of services shall be made a part of the Agreement dated the
day of , 1995.
SCOPE OF PROJECT
The project shall consist of updating previous design drawings and preparing
additional construction drawings as needed, as well as contract documents for the
86th Street North roadway improvements from Cedar Street to Main Street, including
the intersection at Main Street and signalization improvements at Main Street
intersection. The project shall utilize existing roadway as foundation for the
improvements, which will consist of asphalt widening and overlay with concrete curb
and gutter. Also included in the project is construction drawings for relocation of
owner -owned utilities in conflict with the project.
BASIC SERVICES OF THE ENGINEER
The basic services of the engineer shall include, but are not necessarily limited to, the
following tasks:
1. Designate a representative to coordinate all information between the
engineer and the owner.
2. Document all meetings, conferences, coordination, etc., and send
documentation to owner within five working days.
3. Attend one (1) public meeting for the project as directed by the owner.
4. Perform all necessary design surveys for the project.

5. Furnish surveying and engineering design data, where necessary, for the
coordination of the project with other local projects or with state or
federal authorities.
SCOPING PHASE
Upon receipt of a notice -to- proceed, the Engineer shall proceed with the
scoping phase. The work performed during this phase of the Services shall
include, but is not necessarily limited to, the following tasks:
A. Confer with the Owner to review project requirements, to discuss
scheduling of the work, and to discuss submittal requirements for this
phase of the work.
B. Control surveys.
1. Re- establish previous survey base line as shown on current plan
sheets and establish local coordinate system in project area.
C. Utility surveys.
1. Contact Okie for basic information on utility companies and
investigate all known utilities within the project limits.
2. Request Owner to contact utilities for necessary flagged locations
by each underground utility whose physical plant may be involved.
3. Locate all flagged underground utility locations horizontally.
4. Locate all above ground utility locations horizontally.
5. Probe where possible and practical and at regular intervals all
underground utilities within the limits of the proposed
construction.
D. Horizontal and vertical surveys.
1. Update horizontal locations of all physical features within the
project area that may interfere with construction.
2. Full cross sections will be taken at 50 -foot intervals and where
possible will extend a minimum of 25 feet beyond the right -of -way
limits.

3. Full sections will be taken along both edges of existing driveways.
4. Elevations will be taken for flowlines and tops of existing
manholes and structures.
5. Elevations will be taken for existing surfaces that must be met or
matched.
6. Confirm and verify previous design benchmarks. Establish

IL PRE -FINAL DESIGN PHASE
Upon confirmation of the project scope and upon receipt of a notice -to- proceed,
the Engineer shall prepare the pre -final design plans. These plans shall be
prepared in a manner and detail so that they may be used as part of the final
design plans. Work performed during this phase of the Services shall include,
but is not necessarily limited to, the following tasks:
A. Cover sheet indicating "Preliminary Plans" shall include, as minimum:
1. Cover sheet indicating "Preliminary Plans."
2. Summary sheets for:
a. Pay quantities and pay items notes.
b. Storm sewer design.
C. Storm inlet design.
3. Right -of -way maps with current ownership and easements.
4. Reflected drainage maps.
5. NPDES sheet (if needed).
6. Typical section drawings upon receipt of geotechnical information
provided by Owner.
7. Geometric drawings.
8. Plan and profile drawings including relocated City utilities.
9. Sketch plans for all special drainage structures, retaining walls, or
other special items for the project.
10. Preliminary construction phase drawings indicating traffic patterns
during construction but without signage, barrels, etc.
11. Cross - section drawings showing existing ground lines with dashed
lines and proposed ground lines with solid lines. Full cross -
sections shall be shown at 50 -foot intervals, and full sections shall
be shown at each edge of all existing and proposed driveways.

B. Additional written information, such as calculations for drainage
structure sizing, detention facilities, construction cost estimates, or other
pertinent documents to the project, as requested by the Owner.
C. Prepare base plan and profile sheets.
1. Existing centerline profile.
2. Design horizontal and vertical alignment for each leg of the project
and intersection.
3. Prepare typical sections showing pavement, medians, sidewalks,
shoulders, side slopes, and ditches.
D. Drainage /storm sewers.
1. Verify previous design and /or determine drainage areas and
compute runoffs for 5 -year, 10 -year, and 100 -year frequency
storms.
2. Locate inlets and manholes for the 100 -year storm.
3. Design and configure carrier pipes for the 100 -year storm.
4. Determine discharge points and velocities.
E. Right -of -way requirements.
1. Verify additional right -of -way required.
2. Research and confirm current ownership.
3. Investigate the possibilities of using temporary right -of -way in
some work areas and side slope areas.
4. Prepare a right -of -way map including all existing and statutory
right -of -way and easements.
F. Prepare cross - sections.
1. Sufficient to illustrate conditions, minimum 50 -foot intervals.
2. Note existing utilities and obstructions.

3. Maintain vertical tolerances between sub -base and tops of
pipes /utilities.
G. Utility coordination.
1 . Coordinate the design with the various utility companies whose
facilities may be affected by the proposed construction.
2. Request Owner to obtain from such companies the location of
existing and planned future facilities and extensions.
3. Assist the Owner in negotiations with affected utility companies
for the adjustment and /or relocation of their utilities.
H. Owner's facilities.
1. Verify if any existing or proposed City of Owasso water lines
and /or sanitary sewer lines will conflict with the proposed
construction.
2. Prepare preliminary plans for adjustment and /or relocation of any
water lines and /or sanitary sewer lines that may conflict with the
proposed construction.
I. Submittal.
1. Meet with the Owner to review the project at "plan -in- hand"
meeting.
2. Prepare draft contract documents for review.
3. Incorporate appropriate comments into the "Final Plans."
4. Submit estimated total project costs including right -of -way,
construction, utility relocations, and engineering costs.
III. FINAL DESIGN PHASE
Upon approval of the pre -final design and upon receipt of a notice -to- proceed,
the Engineer shall prepare the final design plans. Work performed during this
phase of the Services shall include, but is not necessarily limited to, the
following tasks:

INFRASTRUCTURE GRANT (PRECISION COMPONENTS)

INTRODUCTION:
A series of steps must be taken in order for the Oklahoma Department of Commerce (ODOC)
to release the Community Development Block Grant (CDBG) funds for the infrastructure
improvements connected with the Precision Components site development. The same series of
steps was completed when the staff finalized the Woods Precision Products, Inc. loan package
and the NSP project. Each step requires formal action by the Council, however these steps are
generally considered to be "house cleaning" type actions.
First, an Environmental Review Record must be prepared. This record consists of a request for
review being sent to various state and federal agencies and a documentation of their responses
in the form of a statutory checklist and an environmental assessment. The INCOG staff has
prepared the record as a part of their administration services contract with the City. They have
determined that this project will have no significant effect on the environment. As a result of
this determination, the Council is in a position to designate the Mayor as the certifying officer
to execute the Environmental Certification and Release of Funds Request and to make finding
of No Significant Environmental Impact and Exemption of Administrative and Engineering
Services.
It is anticipated that future actions will have to be taken by the Council to complete other
requirements for "Release of Funds" that are not directly related to environmental concerns.
However, at this point the following is a specific explanation of each current request by agenda
item.

DESIGNATION OF MAYOR AS CERTIFYING OFFICER
BACKGROUND:
Federal and state regulations require that each grant recipient designate a certifying official.
This official is typically the mayor when the recipient of a grant is a city. The certifying official
(through use of the staff and contractually with INCOG) assumes responsibility for the
environmental review process, making findings, and signing certifications.
RECOMMENDATION:
The staff recommends that the Council designate the Mayor as the City's certifying official for
documents required by the CDBG Grant and authorized by the Council.
AGENDA ITEM #1-S 14'
NO SIGNIFICANT IMPACT ON THE ENVIRONMENT FINDING
BACKGROUND:
This is a finding that the "project is not a major federal action which will have a significant
effect on the human environment and that a request to the State for the release of project funds
will not require an Environmental Impact Statement". In order to make this finding, it is
necessary to complete a Statutory Checklist, an Environmental Assessment Checklist, and
maintain documentation of the Environmental Review Record information. All of these have
been completed by INCOG, reviewed by the staff, and the documentation has been placed in the
project's permanent file. Attached is a copy of the Statutory Checklist completed by Andy
Armstrong of the INCOG staff.
RECOMMENDATION:
The staff recommends that the Council approve the INCOG reports and finding of no significant
impact on the environment as a result of the Precision Components infrastructure project and that
the Mayor be authorized to execute such document.

ADMINISTRATIVE AND ENGINEERING SERVICES EXEMPTION
' BACKGROUND:
This finding is that the administrative and engineering services for the Project (Precision
Components Infrastructure Grant) are exempt from the requirements of the National
Environmental Policy Act (NEPA) of 1969. INCOG has reviewed the federal regulations and
determined that these activities (administration and engineering) are identified by 24 CFR, Part
58 as being activities which are exempted from NEPA. Attached is the Finding of Exemption
signed by Andy Armstrong.
RECOMMENDATION:
The staff recommends Council approval of the certification of exemption of administrative and
engineering services from the requirements of NEPA and that the Mayor be authorized to
execute such documents.

EXECUTE AN ENVIRONMENTAL CERTIFICATE
BACKGROUND:
The Environmental Certification is a document which identifies that the City has carried out its
responsibilities for environmental review in accordance with all state and federal regulations and
that it has been determined that a full Environmental Impact Statement is not required. In
simple terms, it states that we have completed the preceding three items (see attached
Environmental Certification).
RECOMMENDATION:
The staff recommend the City Council authorize the Mayor to execute the Environmental
Certificate as required by grant conditions.

BACKGROUND:
The Request for Release of Funds is a document that identifies that the City has completed all
the requirements of the grant, whether they are state, federal or local grant conditions. This

RECOMMENDATION
The staff recommends that the council authorize the Mayor to execute a "Request for Release
of Funds" as required by grant conditions for the Precision Components Project.

I The INCOG Staff has started an Environmental Review Record for the Precision
Components CDBG ED Project by sending out letters about the parking and drainage
improvement activities to several Federal and State Agencies. These agencies, i.e.,
Department of Environmental Quality, Oklahoma Archeological Survey, etc., have
oversight responsibilities for several Federal Statutes related to the environment.
Responses to those letters have been received and a finding of no significant effect in
regard to the effect of the project on the environment can be made and a finding has been
prepared and included for your use. You will also need to make a finding of exemption
IP, in regard to administration and engineering services. This process is identical to similiar
!� findings that you have made on previous CDBG projects. Therefore, it is requested that
the City Council take the following actions:
1. Designate the City's Chief Executive Officer, the Mayor, as the certifying officer
under the National Environmental Policy Act of 1969 to assume overall
' responsibility for the environmental review process.
2. Make a Finding of No Significant Impact on the Environment for the Precision
Components CDBG ED Project.
3. Make a Finding of Exemption for Administrative and Engineering Costs for the

A. Description of Need:
Precision Machine and Manufacturing Company has opened a subsidiary corporation,
Precision Components, Inc., in an existing industrial building, located at 209 E. 5th Ave.
in the City of Owasso. This 20,000 sq. ft. facility was previously built and leased to the
Max Buchannan Company. A site plan, showing the existing building and parking spaces
along with the proposed improvements has been included for your use. The original
parking space allocation and layout was sufficient to accommodate the number of
employees for the original tenant for the site. Due to the fact that at least 50 new
employees will be hired in the near future by Precision Components, Inc., additional
parking will be necessary. The 50 employees to be hired will be allocated on a two shift
basis and the company has plans to go to a three shift basis, with a resulting increase in
employment within the next eighteen months to two years. The additional parking space
will be necessary to support the company's proposed job expansion efforts.
B. Professionally Prepared Cost Projection:
The City Engineer for the City of Owasso has prepared a cost projection for the parking
and drainage improvements. This cost projection is attached for your use.
C. Project Location Description:
A project location map and floodplain map are included for your use.
