ITEM 5: PRESENTATION OF FINANCIAL REPORT Report was given by Ms. Bishop. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CHANGE ORDER #1 A CHANGE ORDER TO A CONTRACT BETWEEN THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY AND YOCHAM ENTERPRISES INC.. DECREASING THE CONTRACT IN THE AMOUNT OF $117,270.60. Mr. Ray briefed the Authority on the meeting that was held with the contractor and a Tulsa County Engineer. Bid items and the contract amounts that are to be deleted were presented by Mr. Ray. Motion was made by Mr. Enzbrenner to approve Change Order #1 to a contract between the OEDA and Yocham Enterprises, decreasing the amount by $117,270.60 and authorizing the reduction of the Performance Bond in a prorated amount based on the new contract amount and authorizing the Chairman to execute the necessary documents relating to such. Motion was seconded by Ms. Lawrence. ITEM 7: DISCUSSION AND APPROPRIATE ACTION RELATING TO ACQUISITION OF RIGHT -OF -WAY FOR EXTENSION OF FIFTH AVENUE (NSP INDUSTRIAL ACCESS ROAD) Mr. Ray discussed the process of condemnation of right -of -way for public use with the Trustees. Mr. Cates explained the fees and the legal procedures associated with a condemnation process. Mr. Kimball suggested that Mr. Anderson have a letter delivered to Mr. Robinson requesting a meeting. There was no action taken on this item. OWASSO ECONOMIC DEVELOPMENT AUTHORITY February 13, 1997 Page No. 3 ITEM 8: DISCUSSION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR OEDA ASSISTANCE FROM MARTIN AND ROXANNE BLOM PERTAINING TO DEVELOPMENT OF THE CHILDREN'S DEPOT CHILD CARE CENTER. Mr. Ray stated that the Blom's no longer need the assistance of OEDA. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR A DONATION FROM THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY TO THE OWASSO HOME AND GARDEN SHOW COMMITTEE. Mr. Ray presented a report on the 1997 Greater Tulsa Home and Garden Show and suggested the Trustees take action on this item so an answer relating to the OEDA's participation in the event can be given to the Home and Garden Show Committee. Mr. Akin explained to the Authority what the Home and Garden Show would provide to the community. This item had been previously discussed at the July 11, 1996 OEDA meeting. Different views on this item were discussed by the Authority. Mr. Enzbrenner moved, seconded by Mr. Akin, to approve the funding of $1,000.00 to the Home and Garden Show. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSES OF A DISCUSSION REGARDING A PENDING CLAIM OF BROWN CONSTRUCTION COMPANY AGAINST THE OEDA RELATING TO ASSERTED UNFORSEEN SUBSURFACE CONDITIONS SUCH SESSION AUTHORIZED BY 25 OS SECTION 307114. This item was removed from the agenda. OWASSO ECONOMIC DEVELOPMENT AUTHORITY February 13, 1997 Page No. 4 ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO BROWN CONSTRUCTION COMPANY'S CLAIM FOR ADDITIONAL COMPENSATION FOR ASSERTED UNFORESEEN SUBSURFACE CONDITIONS RELATING TO THE PLASTICITY OF SOIL UNDER ALL PAVING AREAS SUBSURFACE CONDITIONS UNDER CONCRETE AREAS, AND SUBSURFACE CONDITIONS UNDER GRAVEL AREAS Mr. Ray discussed an anticipated claim relating to stabilization of silt beds at the ONG site with the Authority. Mr. Cates reminded the Authority that the bidders were advised to perform subsurface analysis, prior to bidding, so they would know exactly what they were up against concerning the subsoil. Following lengthy discussion, Mr. Kimball moved to authorize the City Manager and architect, Coleman, Irvin & Johnson, to deny an anticipated claim from Brown Construction relating to a request for additional compensation for work to stabilize silt beds found on the ONG Work Center site. Motion was seconded by Mr. Ramey. Mr Henderson currently owns and operates a highly successful company, Forensic Photograph, that specializes in photography for courtroom application. He is utilized as an "expert" witness in the area of photo interpretation and has a demonstrated track record of business success and business integrity over the past twenty years. Mr Henderson's goal in approaching the city was to develop a partnership with his hometown government that would produce a usable tool for growth management and economic development for the city, and get him on the road with a new aerial photography company. Toward that end, he proposed to undertake a comprehensive program of digitized photography of seventeen sections of Owasso. He then places those digitized photos on a computer program that allows manipulation to bring together sections of the community in a composite photo of any area desired. Additionally, his program would interface with our existing CAD (computer aided drafting) system, allowing all current CAD mapping data to be overlaid on the digitized photos (resulting in a valuable engineering and planning tool). As an inducement to partnering with his company, Mr Henderson offered to do the Owasso project for the cost of the job. Roughly, that meant that the cost to the city would be approximately one -fourth of what an established company like ADS would charge for the same service /product. Mr Henderson's rationale for that arrangement was that he needed a good "first job" that could be touted as an example of the quality product he would produce for other client/prospects (e.g. cities, utility companies, land developers, county assessors). Therefore, he could accomplish his goal by joining with the City of Owasso to offset his cost,.have a showcase for his product and help his community at the same time. The staff had previously (about two years ago) investigated the possibility of hiring a company to produce such photos, however, the cost at that time was in excess of $30,000 and they were not capable of computer manipulation. REQUEST TO FUND PROPOSAL MARCH 11, 1997 PAGE 2 After an initial meeting, Mr Henderson and his partner made a sample photo of a section of land between 86th St and 96th St east of 97th E Ave (golf course area). The staff had agreed to pay expenses ($250) for a test of his product. Upon inspection, the value of the concept was immediately recognized. However, the resolution of the photos was unacceptable for use by Public Works, Police, Engineering or Community Development Departments. Mr Henderson was asked to "re -fly" the same section again at a lower altitude and take more "shots" per section. The second test was accomplished within two weeks, but again, the staff (the review team consisted of Mike Knebel, Phil Lutz, Robert Carr, Erik Mikel and the City Manager) felt the resolution of the photos was not acceptable, and requested a third try at a still lower altitude and with even more "shots" per section. The staff evaluation of the photos from the third flight indicated it was a success in providing an acceptable product for all city departments. The photo map of the test section was very good and utilitarian in nature. The photo resolution would allow application for a variety of uses, from engineering to economic development presentations, all on a computer format. Additionally, Mr Henderson had completed a very preliminary and basic presentation format using the aerial photo mapping and ground level pictures. When used with the CAD mapping system and manipulated for a specific purpose, the program can be extremely effective for economic development presentations, trade show presentations, citizen public hearings for proposed improvements, grant proposals, comprehensive planning presentations, and simply selling Owasso to prospective residents or investors. The format can also be altered for use by the Police and Fire Departments for managing emergency situations. The city has long relied on blueline aerial photos provided by INCOG for our planning and presentation needs. These map /photos are usable, but lack the presentation quality or utility of the photos produced by Mr Henderson's company. Additionally, using the computer format, the staff can "zoom in" on an area and print a copy of that aerial. Additionally, by using the proper computer software, specific areas such as schools, hospitals, and government facilities can be highlighted for instant "links" to ground level pictures and information. FUTURE APPLICATIONS: Although still a future step, the photo mapping program will also interface with a GIS (Global Information System) and GPS (Global Positioning System) when the acquisition of those programs become affordable and an effective management tool. PROPOSAL: Mr Henderson has agreed to provide composite photos of seventeen sections of the City of Owasso in a finalized computer format that allows for manipulation of the digitized data by our REQUEST TO FUND PROPOSAL MARCH 11, 1997 PAGE 3 staff. He has agreed to do so at a cost of $4800 for the photographing and work related to putting the photos into a computer usable format. Additionally, Mr Henderson has agreed to develop a presentation system for the city at a cost of $1600. The presentation system would be in the form of a CD -ROM that can be displayed on a PC computer or mailed to a prospect or interested party. FUNDING: The staff believes this to be a unique opportunity to take a major technological step forward at a small portion of the normal cost of such a product. However, the source of funds for such a project is always a concern. The staff proposes that the photography files be funded 50% from the General Fund's General Government Budget (funds are available) and 50% from the OPWA's Administration Budget (funds. are available). Additionally, the staff proposes that the OEDA fund the $1600 presentation package and allow its use by other city entities when needed. The OEDA currently has a fund balance of approximately $38,000. DEMONSTRATION: Mr Henderson is available for a brief demonstration of the test photos and the preliminary presentation package on Thursday, March 13 at the OEDA meeting. Arrangements have been made for such a demonstration at the beginning of the meeting. RECOMMENDATION: The staff recommends Trustee approval of an expenditure of $1600 to Mr Doug Henderson, dba Forensic Photograph, for the purpose of developing a presentation program as outlined in the attached proposal; provided, however, that such approval is contingent upon the full funding and dompletion of the photo mapping required for the development of the presentation package. Cedar Owasso, Oklahoma 74055 Dear Mr. Ray: I purpose to put together a presentation system for the city of Owasso. This would be based on the digital aerial images discussed in a previous letter. It would be in the form of a CD -ROM that could be played from a Lap -top or freestanding computer, displayed on a conventional monitor or a video projector to one person or a thousand. Or the CD-ROM could be mailed to an interested patty for their private viewing. I envision this presentation consisting of some sort of opening sequence, followed by a satehte view of the planet or the North American continent, zooming in to an aerial view of our entire city. From this point a presenter could mouse -click on any portion of the city and zoom to a closer view, click again to an even closer view. Finaly clicking on individual buildings or points of interest to see ground -level photography or video clips of the subject. This could also have text, charts, diagrams, animations, audio narration or comments, graphics or about anything else you can imagine, displaying the finer points of our city to an audience. The presentation could close with some sort of sequence, perhaps the "end of the trail" indian on horseback. I would wish to work closely with the people who would actualy be making the presentations to tailor it to their specific needs. I could provide this as a turn-key project including furnishing the hardware orjust as the presentation on a CD -ROM. Assuming no hardware costs, I could provide this presentation for $1600. This price could be greatly influenced by how little or how much you wish to include in such a presentation. $1600 buys: the research and development time necessary to work with you in designing the presentation; the video and still photography; the graphics, text, and charts; compiling the presentation to a CD -ROM; multiple copies of the disk; and archiving the data to faciliate updates. Doug Henderson and Paul Kokes have worked out a system using computers and digital cameras to make digital aerial mapping photos. These are not engineering drawings or to -scale maps, but pictorial images. We wish to use the city of Owasso as a pilot project for this system. In exchange for working with us on this pilot project we would photographicaly map Owasso for 50 percent of our planned cost of six hundred dollars per square -mite section. Specificaly... we would photographicaly map Owasso for three hundred dollars per section. We would provide digital imaging of the city of Owasso in exchange for the sum of $4800. We would provide these images as bit - mapped computer files on CD -ROMs. We would work with city engineers or planners to arrange and index these files in a manner that would he the most practical for them. We would provide six copies of the CD -ROM and archive the data for future availability. Additional CDs would be available for $40. each. We anticipate updating or broading the project at a future time. Hopefully this information will be useful enough to justify updating it on a repeat basis, perhaps annualy. However with this first project no future commitment is expected or required. This work would primarily be available for the purposes of city planning. Should this work find use outside of this loosely defined scope( for instance, for the fire department) we would request fiuther discussion as opposed to ` just give them a copy". This work will not be copywrited and the city may make or distribute prints or pictures without consulting us or compensating us. We would complete this work in a timely manner, probably less than 45 days from the go ahead. We would submitt a final invoice at the time of delivery and anticipate being paid within the next accounting cycle. ENGINEERING PRO 4GER SUBJECT: CONTRACT FOR SURVEY, SANITARY SEWER OAK TREE BUSINESS PARK DATE: March 4, 1997 BACKGROUND: The construction contract for the Owasso ONG Roadway and Utility Improvements (Oak Tree Business Park) requires that the City provide construction staking for all facilities to be constructed under the contract. The construction staking was initially to be done for the City by Tuttle and Associates (the design architect/engineer) who had allowed $3,000 for the sanitary sewer survey. However, due to time constraints and work load, Tuttle was unable to do the surveys for the sanitary sewer, roadway, drainage structures or water line. The Notice to Proceed to the construction contractor (Yocham Enterprises) was issued on February 26, 1997. Initial work under the contract will be on the sanitary sewer line. Therefore, staking needed to be done quickly so as not to delay the contractor. The Public Works Department issued requests to three vendors for quotes to provide sanitary sewer line staking. Two quotes were received (see attached). The third potential vendor, Hammond Engineering, did not respond due to the time limitation. The low quote was from Cantrell And Associates of Owasso for $3,500. The City Manager authorized Cantrell to proceed since Yocham was ready to begin construction as soon as work conditions permitted. Additional construction staking will be required for the roadway, water line, and drainage structures. Tulsa County Engineering has agreed to stake the roadway alignment. Public Works Department Engineering Division personnel will be able to provide water line alignment staking once the roadway stakes are in place. Drainage structures will need to be staked by a surveyor and Cantrell and Associates has provided a quote of $2,200 for this service (see attached quote).
