for a Safety Training Program for City Employees; Such Agreement Between the City of
Owasso and MESO (Municipal Electric Systems of Oklahoma).

Citizens - Golden Agers to Provide Transportation Services for Department of Corrections
Workers.

Tuesday, August 2, 1994
The Owasso City Council met in regular session on Tuesday, August 2, 1994 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, July 29, 1904.
ITEM 1: CALL TO ORDER
Mayor Duke called the meeting to order at 7:03 p.m.
ITEM 2: INVOCATION
6 The invocation was given by Pastor David Froese of the Westport Mennonite Brethren Church.

ITEM 6: REQUEST APPROVAL OF THE CLAIMS
August 2, 1994 ,
Mr Burris moved, seconded by Mayor Duke, that the following claims be approved: (1) General ,
Fund $99.684/15 (2) Workers Comp Self- Insurance $1,928.53; (3) Ambulance Service Fund
$1,245.48; (4) E -911 $1,740.29 (5) Park Development $1,275.00 (6) City Garage $2,732.13;
((7) Interfund Transfers $28,947.44; (8) General Fund Payroll $95,042.71; (9) City Garage ,
Payroll $2,096.09.

Motion carried 5 -0.
At this time Mayor Duke recognized Lt Roy Day and Dispatcher Trusy Soloshenko, who were
recently recognized by Hardees Restaurants as Northeastern Oklahoma Good Cops. Lt Day
received recognition for the role he played in resolving a domestic disturbance. Ms Soloshenko
was able to provide emergency CPR instructions over the phone to the parents of an 18 -month
old child. Lt Day and Ms Soloshenko were presented their awards by Mayor Duke and Vice
Mayor Burris.
ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE APPOINTMENT OF A CITY CLERK
Vice Mayor Burris presented this item, which was postponed from the previous meeting. The
Vice Mayor said that he felt this City Council should appoint their own City Clerk. Mr Burris
moved that Ms Bishop be removed from the position of City Clerk and that Ms Boutwell be
appointed Acting City Clerk. Mr Burris further moved that two members of the City Council,
one of them the Mayor, be appointed to interview applicants for the position of City Clerk.
Motion seconded by Mr Ramey.
Ms Barnhouse asked if there was a job description for City Clerk. Mr Ray responded that there
is no written job description, however, there are statutory, Charter, and traditional duties.
Mayor Duke suggested that before a City Clerk is hired, a job description be developed.

Motion carried 4 -1.
Vice Mayor Burris introduced Ms Paula Unruh, a candidate for United States Congress from
District l; and her husband, Jim.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST BY THE OWASSO FRATERNAL ORDER OF POLICE LODGE
#149 FOR COUNCIL APPROVAL OF THE CONTRACT BETWEEN THE
CITY OF OWASSO AND OWASSO FOP LODGE #149 FOR FISCAL YEAR
1994 -1995, AS PROPOSED BY OWASSO FOP LODGE #149.
Mr Dobrinski, President of FOP Lodge #149, presented the proposed contract for the lodge.
Mr Burris commented that an independent CPA had looked at the proposal from the lodge and
the proposal from the City and provided written comments. A lengthy discussion on the pay
scale followed.
Break at 8:00 p.m. Reconvened at 8:20 p.m. and proceeded to item 10.
ITEM 10: PUBLIC OPENING AND READING OF BIDS FOR THE CITY HALL
RENOVATION PROJECT.
Ms Bishop opened and read the four bids received for the city hall renovation project.
Following the opening, bids were referred to the architect for review. A recommendation will
come to the Council at the August 16th meeting.
The agenda returned to the discussion concerning the FOP contract. Both salary and
administrative questions were discussed. Several citizens asked questions and made comments
regarding the contract, negotiations, and Council options. Mr Cates explained the difference
between mediation and arbitration and discussed approximate costs. Mayor Duke deferred action
on this item until after the executive session.
ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF
DISCUSSING PENDING NEGOTIATIONS BETWEEN THE CITY AND THE
' FOP: SUCH DISCUSSION ALLOWED PURSUANT TO 25 O.S., SECTION
307-B(2).

Mr Burris moved, seconded by Ms Barnhouse, to enter into executive session.
AYE: Burris, Barnhouse, Ewing, Ramey, Duke
NAY: None
Motion carried 5 -0.
Into executive session at 9:30 p.m. Meeting reconvened at 11:45 p.m. At this time the
discussion returned to item 9 for action. Mayor Duke moved to not accept the contract as
proposed by the FOP for FY94 -95. Motion seconded by Mr Ramey.

' BACKGROUND:
' Late in 1993, the Owasso School Board initiated a process that would locate a new elementary
school immediately west of the El Rio Vista subdivision on 96th Street North. Soon after that
announcement there were several meetings with citizens from that area that focused on a traffic
safety problem at the intersection of 96th and Garnett. Subsequent to those events, the staff
worked with the county and school officials to address several issues relating to safety and traffic
control at the 96th and Garnett intersection and along 96th Street to the new school site.

In June of 1994, the City Council adopted a budget that included $40,000 for 96th Street
improvements from Garnett west to the new school site. Those planned improvements included
a street overlay (estimated cost of $31,000 if county provides labor and equipment as agreed)
and construction of a four foot wide sidewalk from 109th East Avenue (El Rio Vista entrance
on 96th St) west to the school entrance (estimated cost of turnkey job at $9,000).
Additionally, funds were budgeted to provide appropriate traffic control signage for the new
school implementing a school zone and posting speed limits. These funds were included in the
street department's operating fund line items.
Originally, we had been promised that the Garnett and 96th St intersection improvements, as
well as the 96th Street overlay project, would be completed before the opening of school. The
staff determined that it would be in our best interest to avoid constructing the sidewalk until the
overlay was completed (often the county's heavy equipment is parked without regard to existing
improvements and can damage sidewalks). The sidewalk is also located very close to the
school's new water and sewer lines. Construction of those lines are just now being completed.
Because of those reasons, the staff delayed as long as possible the construction of the sidewalk.
However, it is now apparent that the street overlay will not occur in time for the school opening.
It is just as apparent that it is an unacceptable risk to allow children to use 96th Street surface

as a pedestrian walkway to school. The traffic will be heavy and, in some areas, there is no
place to get off the road to avoid traffic.
Therefore, the staff began the bidding process for the sidewalk construction several weeks ago
in order to have the sidewalk in place shortly after the opening of the school. If a contract is
awarded at the August 16th Council meeting, the project can be completed by Friday, August
26th, one week after school opens. It should be noted, however, that the schedule is dependent
upon the school's contractor completing the final water /wastewater installations. It would not
be a wise decision to initiate sidewalk construction prior to the school's contractor completing
the water /wastewater lines.
Sealed quotations for providing labor, reinforcement, forming material, and excavation were
opened on August 11th and are listed below:
Shipley Construction $4,280
Gruenwald Construction $4,400
NOTE: Bids were solicited for labor only because the city can purchase concrete from the
county's central purchasing bid. While that bid ($47.00 per yard) is not significantly lower than
the street price and, in some cases, not any lower than the price to big customers, it does allow
the city to insure against a price markup by the contractor. Additionally, the purchase of the
concrete by the city directly from the supplier reduces the risk to the contractor, thus, we hope,
reducing the cost of the labor bid.
RECOMMENDATION•
The staff recommends Council approval of a contract in the amount of $4,280 to Shipley
Construction for the purpose of providing labor, excavation and forming material for 1,500
linear feet of sidewalk along 96th Street between 109th E Ave and the entrance to the Larkin
Bailey Elementary School.

OP This agenda item concerns the purchase of concrete to be used in constructing the four foot
wide, 1500 feet long sidewalk. As noted in the information presented in item #7, the staff opted
to recommend that the concrete for this job be purchased directly by the City rather than through
' the contractor.
By utilizing the current county bid for concrete (from Mid - Continent Concrete on a county
' purchase order), the City's price is $47.00 per yard. It should be noted that the $47.00 price
is about three dollars less than the price quoted to smaller users, but it is not cheaper than the
price quoted to a company's bigger customers. One of the advantages of a direct purchase is
that the City is assured of the county price and the contractor cannot include a price markup on
the material. A second advantage is that the direct purchase allows the contractor to avoid
having to "front" the material cost, thereby avoiding the risk involved and use of his money for
the material cost. Hopefully the avoidance of that risk would result in a lower labor contract.
The 96th Street sidewalk is estimated to require not more than 103 yards of 3000 psi concrete.
At a $47.00 per yard county price, the total cost of material is $4,841.
Using the low bid for labor of $4,280 and a total cost for material of $4,841, the total cost of
the sidewalk project is $9,121.
RECOMMENDATION:
' The staff recommends Council approval of an expenditure not to exceed $4,900 to Mid -
Continent Concrete, utilizing the current Tulsa County purchase order at $47.00 per yard for
concrete to construct 1500 linear feet of sidewalk.

BACKGROUND:
The new Larkin Bailey Elementary School will open on Monday, August 22nd, and some
citizens from the El Rio Vista neighborhood have expressed concerns about that opening. Staff
has received a written request from Mr Sloan to bring their concerns to the Council, however,
those citizens have not requested a meeting with staff to address the issues.
Several plans have been developed by staff which relate to the issues and concerns expressed by
the citizens of the El Rio Vista neighborhood. We will be happy to share those plans with the
Council and citizens at any time. Additionally, items 7 and 8 on the City Council agenda
address the issue of the construction of a sidewalk to the new school.

STREET NORTH

BACKGROUND:
The Owasso School District will be opening the Larkin Bailey Elementary School on Monday,
August 22nd. Improvements to the 96th Street North and Garnett road intersection have not
been started and the present schedule for Tulsa County to begin work remains uncertain at this
time.
The safety and well -being of the children attending the new school is a concern. Therefore,
control is vehicle speed in the area of the school is needed.
PROPOSED SCHOOL ZONE SIGNAGE:
A sketch showing proposed signage on 96th Street North from Garnett to 97th E. Avenue is
attached in a memorandum from Public Works. Signs that will be posted on 96th Street North
include: School Zone Ahead, School Zone (7:30am to 4:00pm), Speed Limit 20 mph, and End
School Zone.
Tulsa County has agreed to prepare and provide the signs as indicated on the sketch. City of
Owasso Streets Division personnel will install the signs. Installation will be completed by
Friday, August 19th.

PAVEMENT STRIPING:
When the intersection improvements are completed, 96th Street North will receive an asphalt
overlay from Garnett to 97th E. Avenue. Lane striping will be performed at that time that will
indicate no passing through the school area. In addition, the pavement east and west bound
lanes will be painted to indicate "Caution School Zone".
RECOMMENDATION:
Staff recommends the installation of the proposed school zone signage along 96th Street North.

BACKGROUND:
Mr. and Mrs. Joe Caudle have submitted to the City of Owasso a petition for annexation of their
jointly owned property totaling more than 16.41 acres. The subject property is shown on the
attached map and is currently undeveloped.
The property is currently zoned AG (Agricultural) and would remain zoned AG if annexed by
the City of Owasso. All property annexed by the City of Owasso is required to be zoned the
lowest zoning classification (AG) until any rezoning request is received. A copy of the City of
Owasso's annexation policy is attached for your information and review.
If annexation is approved, the subject property will have to go through all platting requirements
of the City of Owasso prior to any development. Initial development challenges presented to
the owner /developer consist of extending sewer /water service to the site and storm water
detention on site.
Notification of the annexation request was published in the Owasso Reporter on July 28, 1994
to notify the public of the annexation request before the Planning Commission on August 9,
1994. That notification was followed by notification published two consecutive weeks in the
Owasso Reporter on August 4 and 11, 1994 to notify the public of any possible City Council
action regarding the request. A copy of the procedures for annexation is also attached for your
information and review.
The Owasso Annexation Committee reviewed the annexation request at their July 28, 1994
meeting. At that meeting, the Committee unanimously recommended approval of the annexation
request noting that drainage detention when this site is developed is likely to be of a concern
with the city and private property owners in the Ator Addition. A copy of the Annexation
Committee's minutes is attached for your information and review.
RECOMMENDATION:
Staff recommends approval of the annexation request.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the
r lowest zoning classification, that is, AG, agricultural.
Landowners may then petition for rezoning if they desire
' further development of their property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
' 4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
' and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation for a six month period after
rejection by the City Council.

1. CALL TO ORDER - Mr. Rooney called the meeting to order at 5:02 PM.
2. CONSIDER APPROVAL OF THE MINUTES OF JUNE 30, 1994 - Charles Willey,
motioned, seconded by Rohn Munn, to approve the minutes. Motion carried 3 -0.
ANNEXATION REVIEW
3. Joe & Iva Caudle - An approximate 20 acre tract located at the southwest corner of E.
96th Street North and Garnett Road, further described as the N/2 of the NE /4 of the
NE /4 of Section 19, T21N, R14E of the Indian Base and Meridian, Tulsa County,
Oklahoma.
Mr. Rooney presented the annexation item. It was explained that the property is
currently zoned AG (Agriculture) and would remain zoned that way until any formal
rezoning was received by the city. In addition to the zoning requirements prior to
development, all platting requirements would need to be met. It was also explained that
both water and sewer would need to be extended into the property.
Mr. Rooney stated that if this item was approved, it would be forwarded to the Owasso
Planning Commission on August 9, 1994 and possibly to the City Council as early as
August 16, 1994.
Mr. Munn explained that staff would be looking very closely at any development on the
subject property to ensure that drainage detention requirements are met. Mr. Willey,
living in the area, is also concerned with drainage and also commented that the Planning
Commission would look closely at drainage issues as well.
4. ADJOURNMENT - Rohn Munn moved, seconded by Charles Willey for adjournment.
The meeting was adjourned at 5:27 PM.

SUMMARY:
The Owasso Planning Commission reviewed a request for a plat amendment from the property owners of
Double Oaks Estates at their August 9, 1994 meeting. The property owners are requesting city approval
of a name change from Double Oaks Estates to Broadmoor Heights.
Oklahoma state law requires that in order to amend a subdivision plat, 100% of all property owners
within the addition must sign and approve of the amendment request. Attached is a copy of the
amendment request from the Double Oaks Estates property owners containing 100% of their signatures.
The Owasso Planning Commission unanimously approved the amendment request.

On February 16, 1993, the Council authorized the Owasso Municipal Court to enter into an
agreement with the Tulsa County District Court for the purpose of allowing the municipal court
to assume jurisdiction over certain juvenile misdemeanor offenses. Those offenses covered in
the agreement included vandalism, shoplifting, trespassing, assault, assault and battery, battery,
truancy, and public intoxication. The purpose of the arrangement is to encourage local
I communities to provide some form of "early intervention" in an effort to prevent young
offenders from re- entering the justice system again and again.

Subsequently, on July 20, 1993, the Council approved a renewal of that agreement. Since
initiating the agreement, the Owasso court system has conducted trials for a total of 93 juvenile
offenders. In conversations with the Police Chief, City Judge, Municipal Judge, Court Clerk
and City Attorney, it is apparent that all of the involved parties agree that the program is
worthwhile and should be continued.
Initially, there had been a concern relating to the potential cost of the program. While those
concerns are still present and should be considered, the program to this point has not created any
unanticipated costs.
Even though the Council has approved and renewed this agreement, the Attorney General has
ruled that these types of interlocal agreements must be renewed each year. The proposed
renewal agreement contains minor changes from the original document due to legislative actions
resulting from House Bill 2640, and extends the agreement to June 30, 1995. One of the
changes allows cities to detain juveniles in local jails once charges have been filed, provided the
mail meets specific criteria. The agreement and correspondence from Ms Domin (INCOG) are
attached for your review.

During its first year, the juvenile program approved by the Council in 1993 has proven to be
successful. We have had 93 juveniles successfully complete a combination of community
service, counseling, and restitution, along with various safety reports and pay the minimal
court cost. It would appear that this agreement is helping the City of Owasso and the State
of Oklahoma reach the goal of curbing the number of repeat offenders, thus reducing the
number of juveniles that would be transferred to the Juvenile Bureau District Court. Based
on our experience, I would recommend that the City Council approve the renewal agreement
and authorize the Judge and Mayor to execute the document.

Enclosed is a revised Agreement for Municipal Court Jurisdiction of Juveniles between
Tulsa area cities and the Tulsa District Court. The Agreement was revised to reflect
changes in Title 10 of the Oklahoma Statutes resulting from House Bill 2640 passed
this past legislative session.
House Bill 2640 requires that these Agreements be made through the Interlocal
Cooperation Act. Joe McCormick of the Oklahoma Attorney General's Office has
reviewed the Agreement and has verbally advised me that it meets the requirements of
law. Once the Agreements are signed, he will provide the Attorney General approval
within a couple of days.

AGREEMENT FOR MUNICIPAL COURT
JURISDICTION CONCERNING JUVENILES
This agreement is made by and between the Oklahoma District Court
serving Tulsa County, otherwise known as Judicial District 14
(District Court) and the Municipal Court of the City of
Own gg0 (Municipal Court) , under authority of 10 Oklahoma
Statutes §1102 E under which municipal courts are authorized to assume
jurisdiction of certain specified juvenile misdemeanor offenders,
pursuant to agreements with the District Courts.

matter thereof, at least forty -five (45) days in advance of the
negotiations concerning such amendment.
OBLIGATIONS OF THE CITY:
1) The Municipal Court shall assume jurisdiction of offenders
who meet the following criteria:

Are under eighteen (18) years of age;
b.
Are not presently under the supervision or treatment of
the Tulsa County District Court system and do not have
charges pending there;
C.
Have been charged for violating municipal ordinances
relating to Trespassing, Public Intoxication, Vandalism,
Shoplifting, Assault, Battery, Assault and Battery,
Truancy, Curfew Violation, Possession of
Non - Intoxicating Beverages, Possession of Alcoholic
Beverages, Disorderly Conduct or other offense listed in
10 O.S. §1102 E;
d.
Have not been certified as an adult for any purpose
pursuant to 10 Oklahoma Statutes §1112, to the best of
the City's knowledge.

2) Upon
conviction or upon admission to a deferred sentence
program,
punishment and conditions of probation imposed may
include
any one or all of the following:
a.
A fine not to exceed the statutory maximum of the
Municipal Court;
b.
Community service work, not to exceed twenty hours, in
'
lieu of a fine if the product of multiplying the number
of hours of community service work by the prevailing
minimum wage does not result in a number which exceeds
the maximum fine authorized by law;
C.
Restitution;
d.
Counseling or other community -based services; and

3) All municipal arrests and prosecution records for cases
involving prosecutions under this contract shall be kept
confidential and shall not be open for public inspection
except by order of the District Court or in conformity with
the statutes or regulations adopted pursuant to 10 O.S.
§620.6 and 10 O.S. §1125- 1125.4.
4) If a municipal citation is written to a juvenile meeting the
criteria, the Municipal Court hearing elate shall be
indicated on the citation and notification of the citation
shall be mailed to the parents, guardian, or responsible
adult relative of the juvenile. If the juvenile is arrested
and meets the criteria set forth under the contract, under
circumstances where the citation and release procedure would
not be appropriate (e.g. intoxication), the City shall make
reasonable efforts to locate the parent, guardian, or
responsible adult to take custody of the juvenile.
5) The Municipal Court shall provide to the District Court law
enforcement reports and related documents for all juveniles
referred to the District Court for prosecution and all
juveniles who will be prosecuted for misdemeanor criminal
offenses in the Municipal Court. Reports regarding
,
juveniles who will not be prosecuted in either court shall
not be forwarded to the District Court. It is expressly

understood that prosecution in Municipal Court will
constitute a bar of double jeopardy against any subsequent
prosecution in District Court for the same offense.

' 6) All fines and administrative fees generated as a result of
prosecution of juveniles under this contract shall be placed
in one or more special accounts, and used solely to fund
local programs which address problems of,, juvenile crime,
including without limitation offender counseling, early
intervention, community service and teen court programs.
7) The City shall provide the District Court a copy of the most
on recent audit report of its Municipal Court operations for
each year during the life of this contract or any extension
thereof. It is understood, however, that this Agreement
does not impose any additional recordkeeping requirements on
municipal governments or officials.
' 8) Representatives of the District Court and Municipal Court
shall meet periodically to share information and evaluate
the success of procedures implemented to prosecute and treat
juvenile offenders.
STATUS OF VARIOUS EMPLOYEES
No joint employment is created by this agreement for any purpose
and each party will be solely responsible for the payment of their
® respective expenses, including, but not limited to, wages, salaries,
! and consideration paid on subcontracts.

BACKGROUND
The 1991 legislative session passed House Bill No. 1761 that amended Title 10, O.S. Section
1102(E). The legislation allowed local municipal courts, if authorized by their City Council,
to enter into an agreement with the district court to assume jurisdiction of cases involving
children under eighteen (18) years of age who have been charged with violation of municipal
ordinances relating to vandalism, shoplifting, trespassing, assault, battery, assault and
battery, truancy and public intoxication. Under the enabling legislation, the municipal court
may impose fines, community service requirements, restitution to victim(s) or any
combination as authorized by law. Additionally, the court may require the child to receive
counseling or other community-based services designed for prevention or early intervention
impact.
The legislation focused on two goals. One of those goals was to allow the local jurisdiction
an opportunity to get involved in juvenile cases early with local programs and local,
knowledgeable people. The rationale being that local people will have a stronger
commitment to solving their own juvenile problems as well as a better knowledge of what
solutions best meet the offenders' needs. The second goal of the program is to reduce the
district's juvenile court case load so that it can focus on the more serious (felony) juvenile
offenders within a reasonable timeframe.
The agreement is attached for your review and requires Council approval and the Mayor's
signature as well as the signature of the Municipal Judge. This agreement is an opportunity
for the municipal court to deal with a misdemeanor juvenile offender quickly and in a
manner that will have a positive impact on the youth. It should be noted, however, that
there are costs that may be incurred. In approving this agreement, it should be understood
that the municipal court must provide each juvenile offender with those same statutory and
constitutional protection as does the district court. The right to counsel is one of those
statutory guarantees. In cases involving indigent persons (in this case juveniles) wherein the
accused cannot financially afford an attorney, the municipal court must appoint and attorney
and pay the costs of representation. While that situation is a possibility, the staff projections

are that it will not occur. This agreement allows local jurisdiction only in misdemeanor
cases, wherein, court- appointed counsel generally would not be an issue. Last year, the
Owasso police filed 54 juvenile cases in District Court and no one requested public defense.
It should also be noted that any revenue derived from fines assessed to juvenile offenders is
required to be used for funding local programs which address problems of juvenile crime.
Those monies must be in special accounts and will not go to the general fund. Two of the
uses being considered for those funds is to employ a part-time Community Service
Coordinator with counseling experience, or the establishment of a teen court program. It is
not expected, however, that the program will actually produce substantial revenue and it may
well be that very little fine money is generated by this program.

1. This program is strongly supported by the municipal court. The Judge has been
involved in our staff discussions since the contract was received. Additionally, the
City Attorney and City Prosecutor have been a part of the evaluation team and both
are supportive of the program.
2. Because of the juvenile court's caseload, juveniles who violate minor misdemeanor
ordinances are often not dealt with until three or four months after the offense. Even
then, the sentence usually consists of probation. This kind of "slow" justice gives rise
to a feeling that the system can be beaten and often results in additional offenses
while the youth is awaiting adjudication of his /her first offense. Hopefully, the
agreement will allow city courts to act quickly and effectively in dealing with the
offender and therefore mandate that juveniles must be accountable for their actions.
3. Mr. Cates has rendered an opinion relating to the statutory guarantee of legal counsel.
That opinion is attached for your review.
RECOMMENDATION
The staff recommends Council approval of the attached contract between the Owasso
Municipal Court and the District Court providing for Municipal Court jurisdiction for certain
juvenile offenders as provided for by law and authorization for the Mayor to execute the
contract.

In Re: City Attorney Opinion 93 -2; Agreement for Municipal
Court Jurisdiction Concerning Juveniles
Dear Mr. Ray:
I am corresponding with you for purposes of addressing the
issue that we have discussed frequently of late concerning whether
or not the City of Owasso, Oklahoma, would be required to appoint
counsel for a child found to be without sufficient financial means
to retain counsel when such child has been charged in the Municipal
Court under authority of the Agreement for Municipal Court
Jurisdiction Concerning Juveniles now before the City Council for
consideration.
I must at the outset advise you that there is a divergence of
opinion on the part of citys' attorneys around the state on this
point. Such differing views are essentially attributable to
disagreement over whether the Sixth and Fourteenth Amendments of
the United States Constitution, compel provision of counsel to a
child without sufficient financial means to obtain counsel. It is
opined that such Constitutional provisions do not mandate provision
of counsel for an indigent child unless the child faces the
possibility of incarceration or the proceeding itself could result
in a termination of the parent /child relationship. Neither of such
actions can result in a municipal court prosecution pursuant to the
jurisdiction assumed under the Agreement for Municipal Court
Jurisdiction Concerning Juveniles.
However, I am of the opinion that the foregoing does not end
the inquiry concerning the existence of a right to counsel which
may have as it's genesis something other than Constitutional
mandate. Unfortunately, as is evident from the foregoing, there
exists no opinion dealing with this issue from the Supreme Court
In of the State of Oklahoma or the Court of Criminal Appeals of the
State of Oklahoma. Accordingly, resolution of this issue requires
consideration of pertinent statutory provisions contained within
the Oklahoma Juvenile Code, 10 O.S. Section 1101 et seq.
Initially, it should be observed that the proposed Agreement

virtue of enabling legislation now codifed in 10 O.S. Section
1102(e). Such section provides in part as follows, to -wit:
A Municipal Court, if authorized by the governing body
of the municipality, may enter into an agreement with the
District Court to assume jurisdiction of cases involving
children under eighteen (18) years of age charged with
violating municipal oridinances relating to vandalism,
shoplifting, trespassing, assault, battery, assault and
battery, truancy, curfews, possession of non - intoxicating
beverages as defined in Section 161.2 of Title 37 of the
Oklahoma Statutes, possession of alcoholic beverages as
defined in Section 506 of Title 37 of the Oklahoma
Statutes, and public intoxication. A child under
eighteen (18) years of age may be charged and prosecuted
for violating such municipal ordinance provided that the
maximum fine which may be imposed shall not exceed the
maximum fine authorized by law. ...
Such statutory provision, as well as the remaining portions of the
enabling legislation codified in this section, provides no express
guidance on the procedures or protections to be afforded in the
Municipal Courts exercise of this jurisdiction. In the absence of
such express legislative direction, the municipality is essentially
left to speculate on what was the legislative intent on such point.
In that regard, I am of the opinion that the silence on the part
of the Leglislature suggests an intent, even if unexpressed, that
the procedure to be employed in the Municipal Court when exercising
jurisdiction over the juveniles in the delineated offenses, is the
procedure and protections heretofore required of the District Court
in it's exercise of such jurisdiction. Support for this position
may be found in recognition that essentially the enabling
legislation, as well as the agreement provided for therein, results
in the delegation to the municipality of jurisdiction possessed by
the District Court. It is important to note in this regard that
the District Court is not divested of jurisdiction in the juvenile
offenses but merely authorized by the enabling legislation to, by
agreement, delegate same. Reason would suggest that the statutory
procedure and protections now required of the District Court would
likewise be required of the Municipal Court as a delegate to whom
has been delegated or commissioned to act on behalf of the District
Court in these categories of juvenile offenses.
With the foregoing in mind, reference to statutory provisions

of the Juvenile Code of the State of Oklahoma, 10 O.S. Section 1101
li et seq, in particular Section 1109 thereof, provides the following,
to -wit:

purview of Chapter 51 of this title; (2) the name, age
and residence of the child; (3) the names and residences
of his parents; (4) the name and residence of his legal
guardian, if there be one; (5) the name and residence of
the person or persons having custody or control of the
child; (6) the name and residence of the nearest known
relative; (7) the relief requested; and (8) the specific
federal law, state law or municipal ordinance under which
the child is charged, and an endoresment or witnesses
intended to be called by the petitioner, where the child
is sought to be adjudged a delinquent child under Chapter
51 of this title.
As may be gleaned from the foregoing, were a child to be dealt with
by the District Court in a juvenile proceeding for violation of a
federal, state or municipal law, such would result in application
of the requirements of 10 O.S. Section 1109(b). Therefore, reason
suggests that a proceeding in the Municipal Court pursuant to the
Agreement For Municipal Court Jurisdiction Concerning Juveniles for
the delineated offenses is in essence one and the same and would
allow no less. Accordingly, if one accepts the foregoing as a
sound comparison, then one must assume that the statutory dictates
above set forth would compel provision of counsel.
Based upon the foregoing anaiysis, I am of the opinion that
the municipality must provide counsel for a child charged in the
municipal court pursuant to this assumption of jurisdiction if the
child is not otherwise represented by counsel and it is found that
said child is.without sufficient financial means by which to obtain
counsel. Although provision of counsel to a child without
sufficient financial means to obtain counsel may not, under
existing United States Supreme Court pronouncements, be mandated
by the Sixth and Fourteenth Amendments to the United States
Constitution, I nevertheless am of .the opinion that it is under the
statutes of the State of Oklahoma. Accordingly, it is my
recommendation to the City of Owasso, Oklahoma, that if the City
is desirous of entering into the agreement for Municipal Court
Jurisdiction Concerning Juveniles, then a procedure should be
designed to assure provision of counsel to a child charged in the

BACKGROUND:
As federal and state regulations governing municipalities increased during 1993, the City began
to carefully review all safety training offered to employees. To assist municipalities in meeting
various requirements, the Oklahoma Municipal Assurance Group, in conjunction with the
Municipal Electrical Systems of Oklahoma (MESO), developed a safety training program for
cities. The training is conducted by MESO and is primarily designed for those employees
engaged in water, sewer, street, park, refuse and recreation activities. In June of 1993, the City
Council approved an agreement that brought the MESO training program to our employees. The
program supplied 20 hours, per employee, of safety training. Staff recommends the continuation
of the agreement with MESO to furnish safety training programs which would consist of 10
sessions of 2 hours per session (20 hours per employee) during 1994 -95.
' During the first year with MESO, the City encountered some problems which were of concern
to the City. Problem areas appeared in the form of: representatives presenting training in a non-
' professional manner, materials were used that were of interest or concern to only a few workers,
safety topics were changed the day of presentation, and there was no input from the City of
Owasso regarding the subject matter these programs covered.
If approved by the Council, the training program for 1994 -95, will be more "Owasso specific"
and will be announced 3 months in advance. This will allow department directors to have only
' those workers attend who can benefit from that specific training session. The MESO program
has also asked for our input regarding their purchase of additional safety training materials to
be used in that program; those same materials will also be available for use in the safety training
program for all City employees. With the continuation of the services provided by MESO, we
will be able to better address those safety issues that are of concern to the City and meet the
mandates required by the state and federal government.
Additionally, personnel have been hired y new p and trained by MESO to help present the training.

confident his ability will allow these programs to be well received by those attending the session.
MESO's basic program offering was good, however, they did encounter several "growth"
problems and appear to have met the challenges those problems presented..
COST:
Although the "letter of agreement" specifies a cost of $2,900 for the MESO safety training
program, the actual cost to the City is "zero ". Our insurance carrier, (Oklahoma Municipal
Assurance Group) has agreed to reduce the cost of the liability insurance premium by the '
amount of the training program. Therefore, the training program has no cost to the City, other
than the employee cost for the training time (approximately 2 hours per month).
SUMMARY:
The MESO agreement would add to the safety training program in the following ways:
* Make employees more aware that their safety is a top priority for the City of Owasso.
* Help instill and maintain a positive attitude about "practicing safety."
* Assist in meeting OSHA and Department of Labor requirements.
* Eliminate time and cost of acquiring some safety training materials.
* Help reduce number of worker accidents, keeping Workers Comp costs down.
* Improved training means less abuse of machinery and equipment.
* Proper safety instruction reduces liability and litigation costs.
RECOMMENDATION:
Staff recommends Council approval for continuation of an agreement with MESO for a safety
training program from July 1, 1994 to June 30, 1995, and that the Mayor be authorized to
execute the necessary documents formalizing that agreement.

This Letter of Agreement is made by and between the City of
Owasso, hereinafter known as the Utility, and the Municipal
Electric Systems of Oklahoma, hereinafter known as MESO.
Whereas, the Utility desires to have a job training and safety

Whereas, MESO has staff appointed to provide job training and
safety program services under the direction of the safety officer
of the contracting utility, now

IBACKGROUND:
Since February, 1993, the City has transported Department of Correction (DOC) workers on a
twenty -three passenger International School Bus. The fuel cost for bus operation varies from
$.04 to $.05 per mile, or about $30.00 per week. The cost of paying a driver for the bus,
�► which requires an operator with a "C" license, averages out to about $12.00 per hour or $120.00
per week, using city workers at an overtime rate. (This rate is comparable to that which the
school system pays to school bus drivers.) The combined total of operating costs of the
International bus during time of actual use comes to $170.00 per week, or $8,840.00 per year
(includes estimated maintenance and repair cost, based upon history of vehicle.)
Owasso Senior Citizens /Golden Agers have developed a proposal that offers the City an
alternative to using the above - mentioned vehicle. They own a 1988 Dodge 15 passenger
Maxiwagon van that has 53,000 miles on it. The present cost of maintenance /repair on the
Senior van is $.07 per mile, or approximately $900.00 a year based upon the last eighteen
months' usage. Factoring in the additional mileage occasioned by City use for DOC, the yearly
amount would increase to $1908.00 per year. Fuel costs for the miles used for DOC transport
' would be approximately $1100.00 per year. Operator cost for DOC transport would be reduced
to $10.00 per day or $50.00 per week. Combined total yearly costs to the City for using this
vehicle would be $5,608.00.
In exchange for daily use of the bus for DOC transport the City would agree to take care of
routine maintenance and repair of the Senior Van, up to the first $500.00 of any repair. Based
upon the fact that the City would be putting more miles on the van than the Seniors, repairs
costing over $500.00 would be split between the City and the Seniors /Golden Agers on a 75 %
City and 25% Senior basis. Also, the City would be responsible for purchase of that portion
of the fuel costs directly related to the DOC transport.
SAVINGS:
Staff estimates savings to the City based on the above statistics to be at least $3,000.00 per year.
We will decrease our costs of operation, as will the Seniors, and we will both mutually benefit.

The Board of the Owasso Golden Ager's, at a regular meeting on June 9, 1994,
approved a motion to let the City use the Owasso Golden Ager's van for

2) The City would purchase that portion of gasoline used for DOC

van. The City would be responsible for the first $500 of any repair. Repairs
costing more than $500 for any one repair would be split on the basis of

The Board wanted to strongly emphasize that use of the van for Senior activities
would have first priority. In cases of conflict the City would have to arrange for
alternate transportation. Also that this arrangement could be terminated by either
party with thirty (30) days notice.

This agreement, made and entered into as of the 16th day of August, 1994, by and
between the Owasso Golden Agers Incorporated, organized under the laws of the State of
Oklahoma, with offices at 301 S. Cedar, Owasso, Oklahoma, 74055, ( "OGA "),

WITNESSETH:
WHEREAS, OGA holds full title and all rights of ownership to a fifteen passenger 1988
Dodge Maxiwagon van, Serial # 2B5WB31W6JK142287; and
WHEREAS, the use of said van is for transportation of seniors involved in the City of
Owasso's Senior Program or for any other purposes consistent with such non - profit purposes for
which the OGA might wish to utilize it; and
WHEREAS, in a spirit of cooperation and for the good of the OGA, the Owasso Senior
Program, and the needs of the City of Owasso, Contractor and OGA agree as follows:
1. In return for the use of the Senior Van for daily transport of Department of
Correction ( "DOC ") workers assigned to the City of Owasso, the City of Owasso agrees to take
responsibility for all routine maintenance and repairs of said van, up to and including any repairs
of $500.00. Repairs costing more than $500.00 for any one repair or occurrence would be
divided between Contractor and OGA on a 75 % (Contractor) and 25 % (OGA) basis.
2. The Contractor would purchase that portion of gasoline actually used for transport
of DOC workers, such amount to be determined on a percentage basis of total miles driven
during a given period.
3. The Contractor would extend to the OGA the privilege of fuel purchases for the van's
needs for uses consistent with the operation of the City of Owasso Senior Program.
4. OGA would retain priority of usage of the van in the event of conflict of schedule
with Contractor, and in such event Contractor would be responsible to arrange for alternate
transportation
5. Contractor and OGA further agree that this Agreement may be terminated upon thirty
(30) days written notice either party to the other at the respective office address above set forth.

BACKGROUND:
On June 21, 1994, City Council approved the 1994 -1995 budget for the Police
Department which included $5, 000 in building improvements.
To date, complete insulation has been performed to enhance the heating and cooling
ability of the facility and to reduce the monthly utilities cost. This was a portion of the
building improvements budget.
The Police Department currently has a mini - storage unit with a local business. Rent in
the amount of $60 a month is paid to store found property, bicycles and other large
pieces of evidence for which there is no room at the department.
Quotes have been received from five vendors for a portable storage building to be
placed on the northeast side of the police department parking lot. This building will be
used to store the above listed items in addition to files and documents which must be
accessible for retrieval. The five quotes were received from the following vendors:

COST SAVINGS:
Since November 1991, approximately $2,000 has been spent for the use of storage
facilities at other locations. The purchase of this building will eliminate the money
needed for the mini - storage bill, saving $720 in rent per year. It will take a little less
than 3 years to recognize the savings; however, this purchase will aid the department
in much needed storage space, freeing up the interior of the department which is
greatly needed, in addition to the department owning the equipment. Current monies
are available in the police department's capital expenditures budget to make this purchase.
RECOMMENDATION:
Staff recommends council approval on the purchase of one 12 X 24 wood storage building
from Stephens Buildings for $2,060.

A RESOLUTION PROVIDING FOR THE DESIGNATION OF THE
SERVICE ROADS BETWEEN 66TH STREET NORTH AND 86TH STREET
NORTH AS "OWASSO EXPRESSWAY ".
WHEREAS, the City Council of the City of Owasso has executive jurisdiction over the
designation, construction, and maintenance and repair of all of the city streets and bridges
therein; and
WHEREAS, a majority of the east and west service roads serving Highway 169 between
East 66th Street North and East 86th Street North are located within the City of Owasso and
currently named North Mingo Valley Expressway and Forrest Drive; and
WHEREAS, in order to promote economic development efforts in the City of Owasso,
as well as attract new residents to the community, it is the desire of the City Council of the City
of Owasso to change the name of both service roads between East 66th Street North and East
86th Street North.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA that those portions of the Highway 169 service road lying
between East 66th Street North and East 86th Street North are hereby designated as "Owasso
Expressway ".
BE IT FURTHER RESOLVED that this designation becomes effective immediately
upon approval and adoption of this resolution.

During January, February, and March of 1993, the Capital Improvements Committee conducted
its annual review and made recommendations for the FY93 -94 budget, which included the City
Hall Renovation Project. Delays in the construction of the new central fire station caused the
' City Hall project to be rescheduled to occur later in FY93 -94 and into FY94 -95. $90,000 was
allocated for the design and construction of a multi - purpose council /court room /meeting room
to be located in the existing fire bay area.
' In January of 1994, a design team consisting of council members, court officials, and city staff
was created to coordinate the design and remodeling of the fire bays. After several team
meetings to develop a conceptual plan, Holmes Architectural Services Inc was hired to provide
architectural assistance and complete final design plans and bid documents. Of the original
$90,000 allocated to the project, $10,500 was paid for architectural services, leaving a balance
1 of $79,500 for the actual construction.
The City Council approved the design plans and authorized the solicitation of bids at the June
16, 1994 meeting. Bids on the project were advertized as prescribed by law, with the bids being
publicly opened at the August 2, 1994 City Council meeting. Four bids were received and have
been reviewed by the architect and staff. It is the opinion, following that review, that all bids
are excessively high and should be rejected (see attached bid tab).
Staff members have visited with two independent Owasso builders and believe that it is possible
to develop an alternative approach to constructing the project. Such an approach would allow
the City to hire a construction manager, with the work being subcontracted by the City. Some
' modification to the plans would also be made. It is the belief of staff that this would be a
workable solution, and that the project could be kept within budget.

Staff recommends that Council reject all bids for the renovation of the existing city hall fire bay
area, and that staff be directed to develop an alternative approach to constructing the I

MANAGERIAL:
LABOR NEGOTIATIONS - Mediation with the FOP will begin on Thursday, August 18th. The
two parties will meet with a representative of the Federal Mediation and Conciliation Service
in an attempt to resolve the issues at impasse. I remain confident that mediation will resolve
those issues and an agreement will be attained. At this point I also believe it is important for
the City Manager to be directly involved in the process, therefore, I will take an active and lead
role in the mediation process on behalf of the City. Mr Cates has reached agreement with the
firefighters and has done an excellent job in the FOP negotiations. However, I believe it is the
right time for the Chief Executive Officer of the organization to become involved in the face -to-
face meetings with the FOP.
LAWSUIT - The City has been notified that our insurance company (OMAG) has settled a
lawsuit filed against the City by Tisha and Charles Harlan in July of 1993. The lawsuit claimed
damages that resulted from a fall through one of the city's water meter "cans". The court
prohibited the details of the settlement from being disclosed, but I am of the opinion that the
settlement was not greater than the medical bill incurred as a result of the fall. As a result of
the settlement, all actions against the City have been dismissed and a release of all claims has

COMMUNITY DEVELOPMENT:
BUILDING PERMITS - Residential permits continue to show increases over last year's
numbers. TO date, residential permits are up 25% over 1993 and close to the peak building
years of 1985 and 1986. When compared to past years, the dollar value of residential
construction in 1994 will far exceed gay previous year. As of July 31st, the value of
construction exceeds $10,000,000 for 1994. Based on projections for the remaining five months,
it is expected that the total value of residential construction for 1994 will be approximately
$15,000,000, topping the previous high of $12,200,000 set in 1993.
ENGINEERING:
BRIDGE INSPECTIONS - A program is being developed by the Public Works Department to
monitor and perform necessary repairs to bridges located within the City of Owasso. Thirteen
bridges have become the responsibility of the City as a result of the Oklahoma Department of
Transportation shift in 1990 to have inspections done by local jurisdictions. The attached
memoranda contain additional perspective about the City responsibilities and the program.
The City program will monitor the bridges, implement needed repairs and appropriate
anticipated costs to provide the needed data using qualified consultants. Yearly data pertaining
to longevity of each bridge, structural integrity, maintenance required due to visual
cracking /settling and a pictorial history of each structure will be collected.
Anticipated work elements that will be needed in the near future include the preparation of
Requests for Proposals for engineering firms to provide the yearly inspection on the bridges,
determination of the funds required and funding sources, and monitoring the data collected each
year in order to recommend changes in the program. Questions concerning this program should
be directed to Mr Munn or Mr Carr.
RESIDENT PROJECT REPRESENTATIVE SERVICES -WATER AND SEWER
REHABILITATION PROJECT - As a follow -up to the City Manager's Report dated July 15th,
staff has prepared a Request for Proposals (RFP) for Resident Project Representative Services
for inspection of the construction on the upcoming water line replacement and wastewater
collection system rehabilitation projects in the old portion of town. The projects have been
budgeted in a combined amount of $3,170,500.
To ensure compliance with the contract documents, to maintain adequate coordination with the
design engineers during the project, and to effectively respond to citizen concerns during
construction, staff believes a full -time person needs to be in the field working with the residents

and contractor(s) selected for the projects. Limited available city staff makes it difficult to
assign an existing employee to these projects.
Therefore, a packet of proposal information has been sent to thirteen area engineering firms.
Responses are to be submitted by August 24th. All proposals that are received by the deadline
and in the manner required in the RFP will be opened and evaluated by a Review Committee.
The evaluation will be based upon criteria presented in the RFP. Proposals will be ranked
according to the total number of evaluation points assigned by the Review Committee. Based
upon the initial evaluation, the Review Committee will identify one or more firms as "Qualified
and Highly Responsive Firms ". All Engineers selected as "Qualified and Highly Responsive
Firms" will be requested to submit a detailed Scope of Services and proposed fee for said
services for final evaluation by the Review Committee. For questions and additional
information, contact Mr Carr.
POLICE SERVICES:
NEW VEHICLES DONATION - The community will begin to see more Owasso police
vehicles with the new designs soon. Four 1994 Chevrolet Caprices have been purchased and
striped and will be on the road shortly. The Owasso Police Department is extremely proud of
the new designs which were developed by officers within the department. The new Chevrolet
Blazer donated by Classic Chevrolet for the canine vehicle will also be on the road soon.
Additionally, Classic has donated a brand new lightbar for use on this unit. The department will
be seeking donations for the purchases of radio, siren, and striping for this new vehicle.
TOTAL QUALITY MANAGEMENT - The second round of TQM training is due to begin on
August 16th. Training has already been completed by one -third of the department, and one -third
will be participating in this session.
FIRE SERVICES:
Senator Nickles has notified the staff that, due to the continuing debate on the President's health
care bill and crime bill, he will be unable to attend the ceremonies planned for August 25th.
However, since Senator Nickles was the key to the donation of the McDonnell- Douglas truck,
the Chief and I thought it would be appropriate to postpone those ceremonies until the Senator
could attend. Senator Nickles does want to be here for that event and expressed appreciation
for the postponement. As soon as the congressional schedule is clear, the Senator's office and
our staff will coordinate a new date. If you have questions, call me.

STREETS:
LARKIN BAILEY ELEMENTARY SCHOOL: 96TH STREET NORTH SIGNAGE - The
Owasso School District will be opening the Larkin Bailey Elementary School on Monday,
August 22nd. Improvements to the 96th Street North and Garnett Road intersection have not
been started, and the present schedule for Tulsa County to begin work remains uncertain at this
time.
The safety and well -being of the children attending the new school is a concern. Therefore,
control of vehicle speed in the area of the school is needed.
A sketch showing proposed signage on 96th Street North from Garnett to 97th East Avenue is
attached in a memorandum from Mr Carr. Signs posted on 96th Street North include "School
Zone Ahead ", "School Zone (7:30 a.m. to 4:00 p.m.) ", "Speed Limit 20 mph ", and "End
School Zone ". Tulsa County provided the signs indicated on the sketch. City of Owasso street
division personnel placed the signs on Thursday, August 11th.
When the intersection improvements are completed, 96th Street North will receive an asphalt
overlay from Garnett to 97th East Avenue. Lane striping indicating no passing through the
school area will then be completed. In addition, the pavement east and west bound lanes will
be painted to indicate "Caution School Zone ".

IBACKGROUND:
In May 1993 a memorandum was prepared outlining the inspection results of the thirteen (13)
bridges located in the City of Owasso. These bridges are now the City's responsibility to monitor
and perform necessary repairs because the Oklahoma Department of Transportation (ODOT) does
not have the time or funding to do the inspections for each city.
Each year, the City must decide whether to use the consultant used previously to conduct these
inspections or hire another one. We are required to inspect and repair as necessary every bridge.
Currently, this department is not equipped, nor professionally certified, to properly monitor each of
the thirteen bridges. Therefore, it is very important that we hire each year a qualified consultant
(one approved /qualified by ODOT) to inspect our bridges and provide us with pictures, reports, and
any documentations in order for us to ascertain a yearly maintenance schedule of the bridges.
Over the past several years, the City has agreed to have Craig & Keithline, Inc. provide all the
' necessary inspections and documentations required by ODOT.
The City has paid less than $1000.00 per year (from 1990 to 1993) for the inspection service
required by the Oklahoma Department of Transportation. Therefore, budgeting $300.00 this year
should be sufficient to cover the two bridges that need inspecting prior to December 1994.
1 The remaining eleven bridges do not need inspecting until 1995, and $1000.00 should be
appropriated in a subsequent budget.
' The cycle will run in the following manner; bridges #1 &2 will be inspected every year starting in
1994 while the remaining eleven will be inspected every other year starting in 1995. This process
will continue until there is a reason to change or add more bridges.
1 CONCLUSION:
The City must develop a program to monitor all of its bridges as soon as possible, implement it and

appropriate each year the anticipated funds to cover the costs necessary to provide all of the required
data.
Each bridge currently has a file with inspection reports and pictures and is filed in the engineering
department.
ACTION ITEMS:
The following work items are anticipated:
1) Prepare RFP's on providing the inspection service required.
2) Distribute the RFP's to the respective consultant(s).
3) Evaluate the consultant(s) proposals.
4) Establish a funding source (if necessary) and amount to be added to the budget each year.

Prior to 1990, ODOT was conducting bridge maintenance inspections on all City and County
bridges. In 1990, the City received a letter from Mr. Neal McCaleb of ODOT relating to the
City/County Bridge Inspection Program. In that letter, Mr. McCaleb explained that the City
needed to select an engineering firm to provide ODOT with the bridge maintenance
inspections on all required bridges under our jurisdiction from the list provided or choose
someone else. Then He asked the City to let the Division Engineer at Division Eight know
who the firm is in order to check their qualifications. The City chose Craig and
Keithline,Inc. to do the first series of inspections.
In July 1991, Craig and Keithline,Inc. sent a report of the thirteen bridges ( 1- 4,6 -14) along
' with pictures and diagrams. Two of the bridges had a load rating of less than twenty tons and
were requested to have a post limit signs placed at each bridge location. Minor repairs were
mentioned in the report yet, nothing serious had developed since the bridges were
constructed. Each bridge was given a rating from 1 to 10. One being serious and 10 being
great. The following are results:

Each bridge that has a rating of five or less needs to be monitored on a yearly basis while
the others can go to every other year provided ODOT hasn't requested otherwise.
On July 16,1991, the City Manager requested a staff meeting to review Craig and Keithline's
report, who can use the data, when to preform maintenance, etc. It was recommended that
the Engineering office maintain current files on each bridge and schedule Ted McCord to
take pictures yearly.
On June 2, 1992, Mr. Bobby Green from ODOT, sent the City a letter requesting one of
three choices to accomplish the bridge inspection program for bridges under our jurisdiction.
These choices are:
1. City will do bridge maintenance inspections with their own forces.
2. Retain an engineering consultant and negotiate your own contract to be
paid for 100% with local government funds.
3. Select one of ODOT's sixteen engineering consultants in order to use
federal funds for 80% of the total cost. The names of the newly
selected engineering consultants, their addresses, and phone numbers
were shown on the attached list.
In reviewing the list of consulting engineering firms, the staff chose Craig and Keithline,Inc.
to once again provide the City with a inspection report for the 1993 year. So, on June
29,1992, a letter was sent to Mr.David Butler of ODOT requesting the City wants to use
Craig and Keithline,Inc. to do the bridge inspections, and that the City chooses to accept
choice number three from Mr. Green's letter(dated June 2,1992).
On June 30,1992, a memorandum was prepared and sent to the City manager requesting that
the City budget approximately $450.00 for the FY 1992 -93. Furthermore, the City was
required to use Craig and Keithline,Inc. for the 1993 bridge inspection.
On October 30,1992, Ted McCord began to schedule picture taking of the thirteen bridges
for future reference. Mr. McCord finished taking pictures of all bridges around the second
week of November 1992.

On March 29,1993, Craig and Keithline,Inc. and myself began the 1993 bridge inspection
process of the thirteen bridge that are assigned to our jurisdiction. Craig and Keithline,Inc.
prepared the forms and submitted them along with our 20% ($893.14) on March 31,1993.
SUNIMARY:
The following is a summary of those reports by Craig and Keithline,Inc. concerning the
thirteen bridges that ODOT has requested the City to monitor and full routine maintenance.
BRIDGE NO.1 Clean-out in front of the pipe at the NW wingwall on the west
barrel, downstream channel area. Repair the settlement of
approach sidewalks.
BRIDGE NO.2 Recommend filling voids under approach sidewalks and level
slight depression in asphalt, curb and gutter section along the
west end. Repair settled approach sidewalk at the SW corner.
BRIDGE NO.3 Recommend cleaning sedimentation from the east barrel and
downstream. Repair settlement of approach sidewalks.
BRIDGE NO.4 No comments.
BRIDGE NO.6 Recommend repairing apron and end of pipe that is being
undermined on the south end.
BRIDGE NO.7 Recommend removing sedimentation in RCB and downstream.
BRIDGE NO.8 Recommend repairing settlement of approach sidewalks.
BRIDGE NO.9 Recommend cleaning channel downstream.
BRIDGE NO. 10 Recommend repairing settled curb /gutter and asphalt near NE
corner. Place additional backfill behind NE wingwall. Clean
sediment from west barrel and channel downstream.
BRIDGE NO. 11 Recommend repairing minor settlement of asphalt paving NE &
SW corners and settlement of approach sidewalks.
BRIDGE NO. 12 No comments.
BRIDGE NO. 13 No comments.
BRIDGE NO. 14 Recommend removing drift at center wall and downstream from
RCB. Repair soft spot in approach roadway that is
approximately 75' east of RCB in the west bound lane.
RECOMMENDATION:
The following are recommended steps for the ongoing bridge inspections and maintenance
program. These steps are:
1. If satisfied with the engineering firm that's providing the inspection, then continue
to let them inspect per ODOT's requirements. Otherwise, select another firm to do
the work.
2. To schedule staff to monitor inspections yearly of bridges 1 &2 and every other
year for bridges 3 through 14.
3. Take pictures yearly of all thirteen bridges.
4. Make all recommended repairs that the engineering firm has requested.
5. Budget each year enough funds to cover the City's responsibility of the 80/20
federal funding source agreement.
6. Monitor all cracks that have been mentioned in the inspection reports.
7. More frequent inspections are needed if the following occur;
* bridge rating of five or less.
* inventory ratings less than the state's legal load.
* structures with spans greater than 100 feet in length.
* structures without load path redundancy.
* structures susceptible to vehicle damage.
* uncommon designs or designs that have little performance history.
CONCLUSION:
Bridges 1 and 2 need yearly monitoring due to the load requirements and there age. Presently
the cracks that are visible, are not detrimental to the structural integrity. Yet they need to be
monitored very carefully. The remaining bridges need to be monitored yearly but, inspected
every other year until the integrity of the structure changes.

The Owasso Public Works Authority will receive proposals from qualified engineers and /or
engineering firms (hereinafter called Engineer) pursuant to entering into a contractual agreement
for the performance of engineering services required to complete the project outlined below.
The proposals will be received in the office of the Contracts Administrator at Owasso City Hall
(207 S. Cedar) until 2:00 p.m., August 24, 1994. Following submittal, each proposal will be
reviewed by the Selection Committee.
The proposals shall be for providing Resident Project Representative (Resident) services for
proposed improvements as outlined in the "CONTRACT DOCUMENTS AND
SPECIFICATIONS FOR SEWER LINE REPLACEMENT (PROJECT NO. G2.100 -94) AND
CONTRACT DOCUMENTS AND SPECIFICATIONS FOR WATER LINE REPLACEMENT
(PROJECT G3.100 -94)" dated April 1994 and June 1994, respectively. Copies of the contract
documents and specifications are available for review upon request in the Public Works
Administration offices (320 S. Dogwood) during the proposal process. The proposed
improvements are briefly described below.
The Authority has received a loan from the Oklahoma Water Resources Board (OWRB) to make
improvements to the water and sanitary sewer systems in the City of Owasso. Cost of the total
project is budgeted at $3,170,500. These improvements consist of the following:
Water Line Replacement Project
As designed, the water line project consists of replacement and upgrading of approximately
15,000 linear feet of 6 -, 4 -, and 2 -inch cast iron water lines with 6- and 4 -inch AWWA C -900
polyvinylchloride (PVC) piping. The location of the lines to be replaced are shown on the
attached Figure 1.
The project is anticipated to start construction in September 1994. The construction period is
expected to be 180 days and should be completed in February 1995.

Manhole and Sewer Line Replacement Project
The project consists of approximately 290 items of manhole rehabilitation and replacement,
approximately 6,600 LF of cured -in -place pipe lining, approximately 41,300 LF of high density
1 polyethylene slip lining and approximately 12,500 LF of removal of existing line and
replacement with 8 -inch PVC pipe. The locations of sewer lines included in the limits of this
project are shown on the attached Figure 2.
The project is anticipated to start construction in November 1994. The construction period is
expected to be 365 days and should be completed in October 1995.
' It is anticipated that the construction contract(s) will be executed on dates consistent with the
above schedule. Engineering proposals will be evaluated on several factors, including the ability
to expedite the completion of these projects in a timely manner.
' I. GENERAL INFORMATION
A. The purpose of this Request for Proposals (RFP) is to obtain professional
engineering services for providing a resident project representative during
replacement of sewer and water lines within the city of Owasso systems.

4. Provide Workmans' Compensation insurance in accordance with the
applicable state statute.
5. During the course of the work the Engineer will be required to submit
proof of the required insurance coverage.
' 6. It is a requirement that the firm and Resident Project Representative be

the majority of other project team members be allowed to office greater
than 40 miles distant from the project location.
III. SERVICES OF THE RESIDENT

1. The Resident agrees to perform professional services in connection with the

2. The Resident will serve as the Authority's professional representative in those
phases of the Project to which this RFP applies, and will give consultations and
advice to the Authority during the performance of these services.
3. The Resident will be required to coordinate routinely with the Design Engineer.
Coordination may include matters related to design intent, submittals review, and
pay request processing. Each project has been designed by NOVA Engineering,
Inc. (5727 S. Lewis, Suite 300, Tulsa, Oklahoma 74105. Telephone: (918)745-
6682). The Resident will be responsible for working with the design engineer for
this project should questions arise during construction.

B. CONSTRUCTION PHASE
1. General Administration of Construction Contract: Resident shall consult with and
advise the Authority and act as the Authority's representative during this phase.
All of the Authority's instructions to Contractor(s) will be issued through the
Resident who shall have authority to act on behalf of the Authority to the extent
provided herein.
2. Preconstruction Conference: The Resident will be present at the preconstruction
conference(s) with Contractor(s).
3. Visits to Site and Observation of Construction: Provide general engineering
inspection of the work of Contractor(s) as work progresses. In connection with
observations of the work of Contractor(s) while it is in progress:
a) Resident shall be present at the site(s) at intervals appropriate to the
various stages of construction as Resident deems necessary in order to
observe as an experienced and qualified professional, the progress and
quality of the various aspects of the Contractor(s)' work. Based on
information obtained during such visits and on such observations, Resident
shall endeavor to determine in general if such work is proceeding in
accordance with the Contract Documents and Resident shall keep the
Authority informed of the progress of the work.
b) The Resident shall coordinate with the designated project representative(s)
of the Owasso Public Works Authority to provide representation at the
project site during construction.
C) The purpose of the representation of the Resident Project Representative
at the site will be to enable the Resident to better carry out the duties and
responsibilities assigned to, and undertaken by the Resident during the
Construction Phase, and, in addition, by exercise of Resident's efforts as
an experienced and qualified professional, to provide for the Authority a
greater degree of confidence that the completed work of Contractor(s) will
conform generally to the Contract Documents and that the integrity of the
design concept as reflected in the Contract Documents has been
implemented and preserved by Contractor(s). On the other hand, the
Resident shall not, during such visits or as a result of such observations
of Contractor(s)' work in progress, supervise, direct or have control over
Contractor(s)' work nor shall Resident have authority over or
responsibility for the means, methods, techniques, sequences or

procedures of construction selected by Contractor(s), for safety
precautions and programs incident to the work of Contractor(s) to comply
with laws, rules, regulations, ordinances, codes or orders applicable to
Contractor(s) furnishing and performing their work. Accordingly,
Resident can neither guarantee the performance of the construction
contracts by Contractor(s)' nor assume responsibility for Contractor(s)'
failure to furnish and perform their work in accordance with the Contract
Documents.
d) Defective Work: During such visits and on the basis of such
observations, Resident may disapprove or reject Contractor(s)' work while
it is in progress if Resident believes that such work will not produce a
completed project that conforms generally to the Contract Documents or
that it will prejudice the integrity of the design concept of the project as
reflected in the Contract Documents. Any action that the Resident may
take is subject to review and approval by the Authority and the Design
Engineer.
e) Interpretations and Clarifications: Resident shall issue necessary
interpretations and clarifications of the Contract Documents and, after
consultation with the Design Engineer and the Authority, prepare work
directive changes and change orders as required.
f) Shop Drawings: Resident shall review Shop Drawings, samples and other
data which Contractor(s) are required to submit for conformance with the
design concept of the project and compliance with the information given
in the Contract Documents. Such reviews and approvals or other action
shall not extend to means, methods, techniques, sequences or procedures
of construction or to safety precautions and programs incident thereto.
g) Substitute: Resident shall evaluate and determine the acceptability of
substitute materials and equipment proposed by Contractor(s), but subject
to the approval of the Design Engineer and the Authority.
h) Inspection and Tests: Resident shall have authority, with the approval of
the Authority and the Design Engineer, to require special inspection or
testing of the work, and shall receive and review all certificates of
inspections, testings and approvals required by laws, rules, regulations,
ordinances, codes, orders or the Contract Documents (but only to
determine generally that their content complies with the requirements of,
and the results certified indicates compliance with, the Contract
Documents).

i) Disputes between the Authority and Contractor: Resident shall act as
initial interpreter of the requirements of the Contract Documents and judge
the acceptability of the work or the interpretation of the requirements of
the Contract Documents pertaining to the execution and progress of the
work.
j) Applications for Payment: Based on on -site observations as an
experienced and qualified professional, on information provided by the
Resident Project Representative(s) and on review of applications for
payment and the accompanying data and schedules:
i) Resident shall determine the amounts owing to Contractor(s) and
recommend in writing payments to Contractor(s) in such amounts. Such
recommendations of payment will constitute a representation to the
Authority, based on such observation and review, that the work has
progressed to the point indicated, and that, to the best of knowledge,
information and belief, the quality of such work is generally in accordance
with the Contract Documents (subject to an evaluation of such work as a
functioning whole prior to or upon substantial completion, to the results
of any subsequent tests called in the Contract Documents and to any other
qualifications stated in the recommendation). In the case of unit price
work, recommendations of payment by the Resident will include final
determinations of quantities and classifications of such work (subject to
any subsequent adjustments allowed by the Contract Documents).
ii) Resident's review of Contractor(s)' work for the purposes of
recommending payments will not impose on the Resident the responsibility
to supervise, direct or control such work or for the means, methods,
techniques, sequences, or procedures of construction or safety precautions
or programs incident thereto or Contractor(s)' compliance with laws,
rules, regulations, ordinances, codes or orders applicable to their
furnishing and performing the work. It will also not impose responsibility
on the Resident to make any examination to ascertain how or for what
purposes any Contractor has used the moneys paid on account of the
contract price, or to determine that title to any of the work, materials or
equipment has passed to the Authority free and clear of any lien, claims,
security interest or encumbrances, or that there may not be other matters
at issue between the Authority and Contractor that might affect the amount
that should be paid.

k) Contractor(s)' Completion documents. Resident shall receive and review
maintenance and operating instructions, schedules, guarantees, bonds and
certificates of inspection, tests and approvals which are to be assembled
by Contractor(s) in accordance with the Contract Documents (but such
review will only be to determine that certificates of inspection, tests and
' approvals of the results certified indicate compliance with, the Contract
Documents); and shall transmit them to the Authority with written
comments.
1) Inspections: In company with the Authority and Design Engineer, the
Resident shall conduct an inspection to determine if the completed work
is acceptable so that the Resident may recommend, in writing, final
payment to Contractor(s) and may give written notice to the City and the
Contractor(s) that the work is acceptable (subject to any conditions therein
expressed), but any such recommendation and notice will be subject to the
limitations expressed in Section II, Section 13.3J.ii.
m) Record Drawy n : Resident shall provide the Authority with two (2) sets
of prints of the record (as built) drawings and one (1) set of mylar
' reproducible prints. These shall be provided at no additional cost to
either.
1 M. PAYMENT FOR SERVICES
Invoices for the Resident Project Representative services shall be submitted monthly to
the Authority based on actual labor costs and direct expenses incurred. Invoices shall
be reviewed and approved by the Authority prior to payments being made for the
' services. Payments shall be made within thirty (30) days of approval.
IV. PROPOSAL CONTENT
i All sections A through G must be included to receive points in Section V. Consulting
engineering firms desiring consideration should submit proposals in the following format:
A. Cover letter
B. Project Understanding and Approach
This section shall demonstrate understanding of the scope of the Project and
summarize the approach to providing each of the services included in Section II

of the RFP. This section should not merely restate the contents of the Request
for Proposals.
C. Qualifications of the ENGINEER
This section shall discuss prior relevant resident project representative experiences
of the firm. Particular mention should be made regarding previous experience
on similar construction projects. References shall be included. The section shall
also include a discussion of projects performed within the past twelve (12) months
involving design and construction management of municipal water and sewer
systems. The discussion of each project shall include information concerning a
description of any similar facilities designed, project schedules, both design and
construction, and special circumstances encountered in the project. All current
or pending litigation, against the firm shall be provided.
D. Qualifications of the RESIDENT PROJECT REPRESENTATIVE
The firm or engineer selected for this project shall demonstrate the following
minimum experience: possess five (5) years of relevant construction
administration and resident project representative experience; successful
completion of three (3) similar projects including references, contact persons and
their telephone numbers.
E. Project Organization and Staffing
This section shall discuss staffing requirements including key personnel and their
qualifications. Project managers shall be identified. Resumes of key personnel
and project managers shall be included as an appendix. This portion of the
proposal shall also include a listing of all projects currently in progress by the
firm and their anticipated completion date.
F. Proposal Affidavit
The attached proposal affidavit shall be completed, executed and included with
the proposal.
G. Description of Additional or Supporting Services
The consulting engineering firm shall submit a description of other capabilities
to provide the Authority with additional information which may be used as a
reference should they desire the firm or Resident to perform additional or
supporting services.

H. Number of Copies of Proposal
Engineer shall submit one (1) original and four (4) copies of proposal to the
Authority in response to the RFP.
CAUTION: All information requested or otherwise considered common to proposals shall be
included in the proposal at the time of submittal. Incomplete proposals will be considered
informal and may be subject to rejection on that basis.
V. REVIEW CRITERIA FOR THE PROPOSALS RECEIVED
All proposals that have been received by the deadline and in the manner required in this
RFP will be opened and evaluated by a Review Committee. The evaluation will be based
upon the criteria presented in Section V, Paragraph A. Proposals will be ranked
according to the total number of evaluation points assigned by the Review committee.
Based upon this initial evaluation, the Review Committee will identify one or more firms
as "Qualified and Highly Responsive Firms ".
All Engineers selected as "Qualified and Highly Responsive Firms" will be requested to
submit a detailed Scope of Services and proposed fee for said services for final evaluation
by the Review committee. The detailed Scope of Services will consist of all
modifications and refinements made to the original RFP Scope of Services. Said
modifications will be based upon review of the original Engineer's proposal, any and all
RFP Addenda, oral or written communications between the engineer and Authority, and
all other pertinent factors relating to the scope or conditions of the project. If warranted,
the Review Committee may, at its discretion, select one or more of the "Qualified and
Highly Responsive Firms" for an interview in order to exchange additional information
or clarify portions of the proposal contents.
Based upon the evaluation process outline above, the Review Committee will contact an
Engineer and negotiate the terms of the contract for services. If the contract negotiations
are successful, then the Review Committee will make a recommendation to the Owasso
Public Works Authority for approval of the Engineering Services Contract.
A. A point system will be used to rank the proposals from which the review
committee will then recommend an award to the Engineer that will provide the
best service to the Owasso Public Works Authority and the City of Owasso.

B. A weighted point system will be utilized for review of the proposals to determine
the best proposal. The review form is attached and indicates the point range
available for each review point. The Engineers must realize that many items will
require judgement calls or rankings by the review committee.
C. Proposals will be reviewed in terms of content and completeness. Any or all
references may be contacted. Each required proposal item, as defined in Section
IV, will be reviewed and rated according to the criteria described below. The
following factors will be assessed throughout the review process.
1. Experience and technical competence of the Engineer, Resident and project
staff in the required areas of expertise.
2. Capacity to perform all required services.
3. Evaluation of Engineer /Resident record on similar projects which shall include
quality of work and cost control.
D. All written material, oral interviews and other information relative to the RFP ,
obtained during the review process will be treated confidentially, except as
required pursuant to local and state laws.

BACKGROUND:
The Owasso School District will be opening the Larkin Bailey Elementary School on Monday,
August 22nd. Improvements to the 96th Street North and Garnett road intersection have not
been started and the present schedule for Tulsa County to begin work remains uncertain at this
time.
The safety and well -being of the children attending the new school is a concern. Therefore,
control is vehicle speed in the area of the school is needed.
PROPOSED SCHOOL ZONE SIGNAGE:
A sketch showing proposed signage on 96th Street North from Garnett to 97th E. Avenue is
attached in a memorandum from Public Works. Signs that will be posted on 96th Street North
include: School Zone Ahead, School Zone (7:30am to 4:00pm), Speed Limit 20 mph, and End
School Zone.
Tulsa County has agreed to prepare and provide the signs as indicated on the sketch. City of
Owasso Streets Division personnel will install the signs. Installation will be completed by
Friday, August 19th.

PAVEMENT STRIPING:
When the intersection improvements are completed, 96th Street North will receive an asphalt
overlay from Garnett to 97th E. Avenue. Lane striping will be performed arthat time that will
indicate no passing through the school area. In addition, the pavement east and west bound
lanes will be painted to indicate "Caution School Zone ".
RECOMMENDATION:
Staff recommends the installation of the proposed school zone signage along 96th Street North. r

' Dear Mr. Jefferson:
We have read your "Declaration of Independence" with great
' interest. Certainly, it represents a considerable undertaking,
and many of your statements do merit serious consideration.
Unfortunately, the Declaration as a whole fails to meet recently
adopted specifications for proposals to the Crown, so we must
return the document to you for further refinement. The questions
' which follow might assist you in your process of revision;
1. in your opening paragraph you use the phrase "the Laws of
Nature and Nature's God." What are these laws? In what
way are they the criteria on which you base your central
' arguments? Please document with citations from the recent
literature.
2. In the same paragraph you refer to the "opinions of
' mankind." Whose polling data are you using? Without
specific evidence, it seems to us the "opinions of mankind*
are a matter of opinion.
3. You hold certain truths to be "self- evident." Could you
please elaborate. If they are as evident as you claim then
it should not be difficult for you to locate the appropriate
supporting statistics.
4. "Life, Liberty, and the pursuit of happiness" seem to be the
' goals of your proposal. These are not measurable goals.
If you were to say that "among these is the ability to
sustain an average life expectancy in six of the 13 colonies
of at least 55 years, and to enable newspapers in the
colonies to print news without outside interference, and to
raise the average income of the colonists by 10 percent in
the next 10 years," these could be measurable goals. Please
clarify.
' 5. You state that "Whenever any Form of Government becomes
destructive of these ends, it is the Right of the People to
alter or to abolish it, and to institute a new
Government...." Have you weighed this assertion

against all the alternatives? What are the trade -off
considerations?
6. Your description of the existing situation is quite
extensive. Such a long list of grievances should precede
the statement of goals, not follow it. Your problem
statement needs improvement.
7. Your strategy for achieving your goal is not developed at
all. You state that the colonies "ought to be Free and
Independent States," and that they are "Absolved from All
Allegiance to the British Crown." Who or what must change
to achieve this objective? In what way must they
change? What specific steps will you take to overcome the
resistance? How long will it take? We have found that a
little foresight in these areas helps to prevent careless
errors later on. How cost - effective are your strategies?
8. Who among the list of signatories will be responsible for
implementing your strategy? Who conceived it? Who provided
the theoretical research? Who will constitute the advisory
committee? please submit an organization chart and vitas of
the principal investigators.
9. You must include an evaluation design. We have been
requiring this since Queen Anne's War.
10. What impact will your problem have? Your failure to
include any assessment of this inspires little confidence in
the long -range prospects of your undertaking.
11. Please submit a PERT diagram, an activity chart, itemized
budget, and manpower utilization matrix.
We hope that these comments prove useful in revising your
"Declaration of Independence." We welcome the submission of your
revised proposal. Our due date for unsolicited proposals is July
31, 1776. Ten copies with original signatures will be required.

For the past two months, the OEDA has been aware that the Max Buchanan Company has
planned to sell most of its manufacturing capabilities at the Owasso plant to Zebco and move the
remaining operations to Springfield, MO. During that time, the OEDA has worked with several
prospects and Tulsa Property Company to locate and attract a solid company to move into the
Max Buchanan building. About two weeks ago the staff, OEDA Chairperson, and some
members of the OEDA began meeting with a "hot" prospect for the facility. Those meetings
and subsequent negotiations with the two local lenders on the project (RCB Bank and First Bank
of Owasso) have resulted in a preliminary agreement that, if finalized, will locate a
manufacturing facility here in Owasso with an initial employment of 73 people.
While the details of the financing package and specific language are still being developed, we
are at a point that indicates there should be no roadblocks in the finalization of the agreement.
