Roll Call 3. Consideration and Appropriate Action Relating to a Request for an Executive Session for the Purpose of Discussing Pending Negotiations Between the City and the FOP; Such Discussion Allowed Pursuant to 25 O.S., Section 307-B(2). Mayor Duke The Mayor will recommend that the Council approve an executive session for the purpose of discussing negotiation-related issues. 4. Consideration and Appropriate Action Relating to a Request for Council Approval of a Contract Between the City of Owasso and the FOP Lodge #149; Such Contract Providing for Wages, Benefits and Other Working Conditions and Establishing a Term for that Contract. Consideration and Appropriate Action Relating to Resolution #94-12, Authorizing Incurrence of Indebtedness by the Owasso Economic Development Authority for the Location of Precision Machine and Manufacturing Co Inc, Waiving Competitive Bidding Requirements, and Authorizing the Mayor or Vice Mayor and City Clerk or Deputy City Clerk to Execute Any and All Documents Necessary. Mr Ray The staff will recommend Council adoption of Resolution #94-12. 6. Consideration and Appropriate Action Relating to the Award of a Contract Providing for Construction of 1500 Linear Feet of Sidewalk Along 96th Street North Between the El Rio Vista Subdivision and a Newly Constructed Elementary School. Mr Ray The contractor awarded the bid at the August 16, 1994 Council meeting has been disqualified, and staff will recommend Council action to award a contract in the amount of $$4,280 to Gruenwald Construction. 7. Adjournment CITY OF OWASSO, OKLAHOMA RESOLUTION N0. 94-12 A RESOLUTION APPROVING ACTION TAKEN BY THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY AUTHORIZING ISSUANCE, SALE AND DELIVERY OF TWO (2) PROMISSORY NOTES OF THE AUTHORITY TO FIRST BANK OF OWASSO AND RCB BANK; WAIVING COMPETITIVE BIDDING, AND CONTAINING OTHER PROVISION RELATED THERETO. WHEREAS: The Owasso Economic Development Authority (the "Authority") did, by its Resolution adopted on August 10, 1994, authorize the issuance, sale and delivery of its (i) Promissory Note to First Bank of Owasso and (ii) Promissory Note to RCB Bank, in order to finance the Precision Machine and Manufacturing Company, Inc. economic and industrial development project; and WHEREAS: The City Council hereby determines that the actions taken by the Authority should be authorized and approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA: Section 1. Issuance of Note. That the issuance, sale and delivery of (i) The Owasso Economic Development Authority, Tulsa County, Oklahoma, Promissory Note to First Bank of Owasso in the principal amount of $281,226.43, and (ii) The Owasso Economic Development Authority, Tulsa County, Oklahoma, Promissory Note to RCB Bank in the principal amount of not to exceed $93,585.19, all as approved by said Authority on August 10, 1994 hereby is authorized, approved and ratified. Section 2. Approval. That all actions heretofore taken by the Authority in connection with the issuance, sale and delivery of the First Bank of Owasso Note and the RCB Bank Note, and all other aspects of the transaction be and are hereby authorized, approved and ratified. Section 3. Waiver of Competitive Bidding. In accordance with the provisions of 60 O.S. Section 176 et seq., the City Council hereby authorizes the Waiver of Competitive Bidding of the notes and authorizes the direct placement thereof with First Bank of Owasso and RCB Bank as above setforth. Section 4. Necessary Action. That the Mayor or Vice Mayor and City Clerk or Assistant City Clerk be and hereby are authorized an empowered to execute and deliver for an on behalf of the City any and all other documents or instruments reasonably necessary to accomplish the issuance, sale and delivery of the First Bank of Owasso Note and Rogers County Bank and all other aspects of the transaction.
