Mr Rooney Attachment #10 The staff presented this request to the Council on June 21, 1994 for preliminary approval and will recommend Council adoption of Ordinance #484. 11. Consideration and Appropriate Action Relating to a Request to Award a Contract for the Construction of Improvements to the West Parking Lot of Elm Creek Park. Mr Compton Attachment #11 The staff will recommend Council approval of a contract in the amount of $2500 to Miser Asphalt, Owasso, OK for the construction of six parking spaces, two handicapped accessible and four others, as a part of the park grant that constructed the Elm Creek picnic shelter. 12. Consideration and Appropriate Action Relating to a Request for Authorization for the Submittal of a Grant Application to the Oklahoma Department of Commerce. (CDBG -ED- NSP) Mr Compton Attachment #12 The staff will recommend that Council authorize the submission of a $200,000 CDBG- Economic Development infrastructure grant to assist in the relocation of the National Steak and Poultry facility to Owasso. u� Owasso City Council ' July 5, 1994 Page 4 ' 13. Consideration and Appropriate Action Relating to a Request for Authorization for the Submittal of a Grant Application to the Oklahoma Department of Commerce. (CDBG - Rehab) Mr Compton Attachment #13 The staff will recommend that Council authorize the submission of a $250,000 CDBG rehabilitation grant for the replacement of wastewater lines in eligible portions of the city. 14. Consideration and Appropriate Action Relating to a Request for Council Approval of Citizen Participation Plans for two CDBG Grant Applications. Mr Compton Attachment #14 The staff will recommend Council approval of citizen participation plans for an Oklahoma Department of Commerce CDBG -ED (NSP) grant and a CDBG - (Rehab) grant. 15. Consideration and Appropriate Action Relating to a Request for Council Approval of an Expenditure of Funds for the Purpose of Purchasing Material for the Construction of Improvements to Drainage Facilities. Mr Carr Attachment #15 The staff has completed the design of improvements to the El Rio Vista Addition drainage system and will recommend Council approval of the expenditure of $ Ito for the purchase of 180 linear feet of drainage pipe in order that the project may be initiated. Consideration and Appropriate Action Relating to a Request for the Solicitation of Bids for ' the Construction of Signalization Improvements at the intersection of 96th Street North and Garnett Road. Mr Munn Attachment #16 The staff will recommend that Council authorize the solicitation of bids for the signalization of 96th St N and Garnett intersection as a part of the joint City- County project to improve traffic safety at that location. 17. Consideration and Appropriate Action Relating to a Request for Council Approval of Two ■ Agreements Between the City of Owasso and the Oklahoma Tax Commission Providing for the Commission's Administration of the Owasso "Sales Tax Ordinance" and "Use Tax Ordinance ", and authorizing the Mayor to execute such agreements. Consideration and Appropriate Action Relating to a Request to Award a Contract for the Purchase of a UHF Radio "Repeater" for the Police Department Communications System. Consideration and Appropriate Action Relating to a Request to Extend Beyond its Original Term an Agreement Between the City of Owasso and FOP Lodge #149. Adjournment OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, June 21, 1994 The Owasso City Council met in regular session on Tuesday, June 21, 1994 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, June 17, 1994. ITEM 1: CALL TO ORDER Mayor Duke called the meeting to order at 7:05 p.m. ITEM 2: INVOCATION The invocation was given by Robert Carr. ITEM 3: FLAG SALUTE The flag salute was led by Mayor Duke. ITEM 4: ROLL CALL PRESENT ABSENT Jerry Duke, Mayor Charles Burris, Vice Mayor Mary Lou Barnhouse, Councilor Danny Ewing, Councilor Joe Ramey, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, Council Clerk A quorum was declared present. ITEM 5: REQUEST APPROVAL OF THE MINUTES OF JUNE 7. 1994 REGULAR MEETING AND June 14, 1994 SPECIAL MEETINGS. Charles Burris moved, seconded by Mary Lou Barnhouse, to approve the minutes, by reference made a part hereto. ' AYE: Burris, Barnhouse, Ramey, Ewing, Duke NAY: None Motion carried 5 -0. 1 Owasso City Council June 21, 1994 ITEM 6: REQUEST APPROVAL OF THE CLAIMS Mayor Duke moved, seconded by Charles Burris, that the following claims be approved: (1) General Fund $14,387.10 (2) Workers Comp Self- Insurance $916.80; (3) Ambulance Service Fund $812.65; (4) E -911 $92.50 (5) City Garage $4,290.80; (6) Capital Improvements $781.25; (7) Interfund Transfers $3,071.11; (8) General Fund Payroll $99,393.51; (9) City Garage Payroll $2,346.33. AYE: Duke, Burris, Barnhouse, Ramey, Ewing NAY: None Motion carried 5 -0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL ADOPTION OF RESOLUTION 94 -09 A RESOLUTION ADOPTING A FY 1994 -95 BUDGET FOR ALL FUNDS ADMINISTERED BY THE CITY. Mr Ray said that staff has responded to comments made at the budget hearing on June 14 by making two changes. One change is to increase the capital outlay section of the police department by $5,000 for building improvements. The other change is to add a project - Hale Acres Drainage Improvements at $15,000 - from carryover funds in capital improvements, for a new total of $313,000. Mayor Duke asked how the proposed budget relates to the ongoing negotiations with the police union. Mr Ray said that if more funds are needed, the Council will be asked to approve a supplemental appropriation. Following questions and comments, Charles Burris moved that, with the assurance that the OWRB $1.2 million loan be approved by the City Council before execution, Resolution #94 -09 adopting a FY 1994 -95 budget for all funds administered by the City, be approved. Motion seconded by Mary Lou Barnhouse. AYE: Burris, Barnhouse, Ewing, Ramey, Duke NAY: None Motion carried 5 -0. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF A CONTRACT FOR POLICE UNIFORM CLEANING SERVICES The Owasso Police Department currently has a contract with Yale Cleaners for the cleaning of all police uniforms at an annual cost of $13,020. The contract expires on June 30, 1994. Chief Alexander said that quotes were requested from four cleaning establishments, with bids being 2 1 IOwasso City Council June 21, 1994 received by two - Yale Cleaners and Three Lakes Laundry. The lowest quote was from Yale Cleaners at $15,660 annually. Charles Burris moved, seconded by Danny Ewing, to a award a one -year contract for uniform dry cleaning to Yale cleaners at a cost of $15,660 to be paid in monthly installments of $1305, and that the Mayor be authorized to execute the contract. AYE: Burris, Ewing, Ramey, Barnhouse, Duke NAY: None Motion carried 5 -0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO OZ- 94 -04, 19 A REQUEST TO REZONE A TRACT OF LAND DESCRIBED AS THE EAST HALF OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 7, TOWNSHIP 21 NORTH, RANGE 14 EAST, FROM RMH (RESIDENTIAL MOBILE HOME) DISTRICT TO IL (INDUSTRIAL LIGHT, GENERALLY LOCATED AT THE SOUTHEAST CORNER OF EAST 116TH STREET NORTH AND NORTH 109TH EAST AVENUE. The Owasso Planning Commission held a public hearing on June 14, 1994 to review the above captioned case, and unanimously recommended approval of the rezoning request. Following questions and discussion, Charles Burris moved to approve OZ- 94 -04. Motion seconded by Joe Ramey. AYE: Burris, Ramey, Ewing, Barnhouse, Duke NAY: None Motion carried 5 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ' REQUEST FOR COUNCIL APPROVAL OF AN AMENDMENT TO A PREVIOUSLY APPROVED FINAL PLAT FOR DOUBLE OAKS EXTENDED. A SUBDIVISION TO THE CITY OF OWASSO. The Owasso City Council approved a final plat for Double Oaks Extended at their June 7, 1994 meeting. Because of concerns expressed by property owners in the area, some changes were made to streets, and the covenants will be changed to require larger homes on the north and south side of East 79th Court North. Trees will be planted along the rear yards abutting Double Oaks Estates, and a second walled entrance will be constructed where North 123rd East Avenue enters the addition. The Planning Commission reviewed the amended plat at their June 14, 1994 meeting and recommended approval. i Owasso City Council June 21, 1994 Joe Ramey moved, seconded by Mary Lou Barnhouse, to approve the amended final plat for Double Oaks Extended. AYE: Ramey, Barnhouse, Ewing, Burris, Duke NAY: None Motion carried 5 -0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE DESIGN CONCEPT FOR THE RENOVATION OF CITY HALL COUNCIL CHAMBERS /COURTROOM AND AUTHORIZATION TO SOLICIT BIDS. Architect Don Holmes presented the final plans for the renovation of the multi - purpose council /courtroom as recommended by the design committee and staff. The bid documents include a base bid and five alternates. Charles Burris moved to approve the final plans and authorize the solicitation of bids, and that the bids be opened and publicly read at a City Council meeting. Motion seconded by Joe Ramey. AYE: Burris, Ramey, Barnhouse, Ewing, Duke NAY: None Motion carried 5 -0. Mr Burris requested that all bids over $1000 be opened and publicly read at a City Council meeting. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF A CONTRACT BETWEEN THE CITY OF OWASSO AND THE IAFF LOCAL #2789• SUCH CONTRACT PROVIDING FOR WAGES, BENEFITS AND OTHER WORKING CONDITIONS AND ESTABLISHING A TERM FOR THAT CONTRACT Mr Ray said that the City's negotiating team has been meeting since April with representatives of the IAFF Local #2789. An agreement has been reached and that agreement has been ratified by the union membership and signed by the president. The proposed agreement provides an average salary increase of 7%, however individual increases range from 4.9% to 8.4%. Charles Burris moved, seconded by Mayor Duke, to approve the proposed 1994 -95 contract between the City of Owasso and the IAFF Local 2789, and that the Mayor be authorized to execute the document on behalf of the City. ITEM 13: REPORT FROM CITY MANAGER Mr Ray reported on a structure fire that caused heat related injuries to three firefighters. None are seriously injured. As it prepares to enter its third year, the Senior Nutrition Program has established itself as an important part of out efforts to have as well- rounded a senior program as possible. Mrs. Perry (Babs) Cline, Owasso Site Director, continues to provide the care and leadership necessary to the success of the program. Mrs. Cline's skill and attitude of cooperation are both exemplary. During the second year the program has averaged daily from forty to forty -five meals served. Participants consist of those who fall into the three major target categories for nutrition programs: those of low income, those with need for socialization, and those with need for a more balanced diet. The Nutrition Program continues to increase use of the Community Center by our senior citizens. Many of those who eat and who would formerly have come to the Center only on Wednesdays and Fridays now come every day. The average daily number of riders on the Senior Citizens Van is fifteen per day, approximately two and one -half times the number prior to the start of the nutrition program. It should be noted that costs for the nutrition program are funded through the Tulsa Senior Nutrition Program, under the auspices of Tulsa Community Action Agency, which in turn receives its funding from monies provided by the Department on Aging. The program pays for the cost of the meals, the Site Director's salary, serving supplies, etc. The senior participants in the program are asked, if they are able, to make a donation toward the cost of the meals. RECOMMENDATION The staff recommends continuation of the Nutrition Program for the coming year, October 1, 1994 through September 30, 1995. After completing the picnic shelter portion of the park development project, we have determined that there is approximately $2600.00 remaining to be used for minor improvements to the west ' parking lot. The staff evaluated the current condition of the lot and determined the following deficiencies. ' 1. The entry from the existing street contains several potholes that are continually in a state of disrepair. 2. The east side of the parking lot is unpaved and poorly drained. 3. The existing provisions made for handicapped parking are inadequate. It was determined that all three of these deficiencies could be corrective using the $2,600.00 remaining in the budget. Quotes were requested for a project that consisted of (A) grading and paving the east section of the parking lot to make 6 parking spaces, two of which will meet the handicapped parking requirements; (B) clean, tack and patch existing potholes; and (C) overlay ' 30 feet of the parking lot entry. The following bids were received, reviewed, and found to be appropriate. In the case of the National Steak and Poultry Company, it will be necessary for the City to apply for grants to satisfy the company's infrastructure needs (water, wastewater, and streets). The staff is currently in the process of preparing the required applications and providing all needed information. We are applying to the Oklahoma Department of Commerce for a $200,000 CDBG -ED grant. These monies will be used for on -site water and wastewater line extensions and for constructing the base for the extension of the street. We are also applying to the Oklahoma Department of Transportation for an Industrial Access Road grant for a minimum of $250,000. These monies will be used to construct off -site street improvements and to surface the entire length of the new industrial street. As was noted in previous correspondence, the staff, with Council approvals, will prepare the application, submit the application, complete all documentation for Release Of Funds, select a design engineer, bid the project and select a contractor, supervise and inspect construction. Each step of the process will require different Council actions. The current action requested is for authorization to submit to the Department of Commerce a CDBG -ED application for the amount of $200,000. RECOMMENDATION• The staff recommends that the Council authorize the Mayor to execute and submit a $200,000 CDBG -ED grant application for infrastructure construction to assist in the relocation of the National Steak and Poultry Company to Owasso. MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: STEVE COMPTON COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: AUTHORIZATION TO SUBMIT CDBG INFRASTRUCTURE REHAB GRANT APPLICATION FOR SOUTH OWASSO DATE: June 30, 1994 BACKGROUND: As was noted by the City Manager at the June 7th Council meeting, it appears that because of new criteria being used by the Department of Commerce two small areas of our community may be able to meet the Department of Commerce's requirements to qualify for a CDBG Infrastructure Rehab Grant. The first would be that area within the city limits and south of 76th Street. The second would be an irregular shaped area generally located north of 76th Street, south of 2nd Street, and east of Atlanta Street. The staff is in the process of conducting an income survey within the proposed project areas to make a final determination. However, the application must be submitted prior to the next council meeting, July 19, 1994. The current action being requested is for authorization to submit to the Department of Commerce a CDBG Rehab grant application for the amount of $250,000, if it is determined that the necessary requirements can be met. ' It is the staff's hope, the CDBG qualifications can be met and that our current water /wastewater rehab project (funded by Water Resource Board loan) can be expanded in those areas of the community where there is an existing predominance of low /moderate income households. The addition of the grant monies ' can greatly enhance our present rehab project and significantly reduce the long -term schedule for infrastructure rehab in the "old town" area. It has also been determined that this same general area may meet the required qualifications to be classified as an Enterprise Zone. The staff is in the process of analyzing the existing data and comparing that to the Department of Commerce's requirements. It is anticipated that authorization to submit an ' application for Enterprise Zone designation will be processed in the near future. This designation will significantly improve incentives that can be offered to potential economic development investors. Most of these actions are considered to be "house cleaning" matters that are necessary to insure that the projects meet all requirements and is open to public comment/input. It is a requirement that the City adopt a Citizen Participation Plan showing how the public will be kept informed of all steps of the process from initial planning to the final release of funds. The plan must also identify the points in the process when the public has an opportunity to provide input. A Citizen Participation plan has been developed for each of the above -cited projects and has been strictly followed. However, these plans have not been submitted to the Council for formal action because of scheduling conflicts created by "fast tracking" the process to meet set due dates. All meetings previously conducted were held as shown in each plan and all notices were properly placed in the newspaper. All future meetings will be conducted in compliance with all regulations and as outlined in the plans. Remaining meetings and notices will be concerned with environmental reviews, release of funds, and grantee performance activities. N. & GARNETT ROAD MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: SHERRY BISHOP FINANCE DIRECTOR SUBJECT: AGREEMENT WITH THE OKLAHOMA TAX COMMISSION FOR ADMINISTRATION OF THE SALES TAX ORDINANCE AND THE USE TAX ORDINANCE DATE: July 1, 1994 BACKGROUND: ' The City of Owasso levies a 3 % sales tax and a 3 % use tax on the sales of eligible merchandise as allowed by statute. Collection of the sales and use tax is currently performed by the ' Oklahoma Tax Commission (OTC) under an agreement between the OTC and the City. The agreement with the OTC requires annual renewal by the City Council. In return for collection and administration of the tax, the OTC retains one percent of the total amount collected. Without this agreement, the OTC would not collect Owasso's portion of the sales tax. The 1 % fee retained by the Commission during the past fiscal year was $34,318. Several cities and the OML have studied alternate methods of collecting the sales tax. At this time, there does not appear to be a more cost - effective option. The attached agreements with the Commission are identical (except for dates) to the agreements approved in previous years. Mr. Cates has reviewed the documents and indicated that they are appropriate for Council consideration. RECOMMENDATION• Staff recommends Council approval of the "Agreement for Administration of the Sales Tax Ordinance" and "Agreement for Administration of the Use Tax Ordinance" with the Oklahoma Tax Commission. This Agreement is based upon the provisions contained in the Ordinance of the Municipality, a certified copy of which is attached hereto and made a part hereof. Any amendment to the Ordinance ' which the Commission determines is inconsistent with the terms of the Agreement shall constitute grounds for termination by the Commission of this Agreement. 2. The Commission shall administer and enforce the Ordinance and collect the municipal sales tax in the manner herein provided.. It is recognized and acknowledged that the ordinance levies a municipal sales tax upon all sales which are subject to the sales tax levied by Sections 1350, et seq. of Title 68 of the Oklahoma Statutes, hereinafter referred to as "Oklahoma Sales Tax Code,"; that all sales exempt from state sales tax are exempt from the municipal sales tax, unless otherwise provided by the Oklahoma Sales Tax Code; and, that in administering, enforcing and collecting the municipal sales tax, the term "sale" as used herein shall mean "sale" as defined by state statute and the Commission's determination of what constitutes a sale shall be binding on the Municipality. 3. The Commission and the Municipality acknowledge that the bracket system should be adopted for the convenience of vendors in collecting both the state and municipal sales tax, as authorized in Section 1362 of Title 68 of the Oklahoma Sales Tax Code. 4. The Municipality agrees that vendors' claims for the discount allowed in Section 1367 of the Oklahoma Sales Tax Code shall be applicable to both state and municipal sales tax remittances and the Commission's determination of the validity of the claims shall be binding on the Municipality. 5. The Municipality agrees that the Commission shall retain, for its services rendered, an amount not to exceed one and three - fourths percent (1 -3/4 %) of the amount of such tax, penalty and interest, collected by the Commission. 6. Except as otherwise provided in this Agreement or Amendment hereto, the Commission shall give no preference in applying money received for state and municipal sales taxes owed by a taxpayer. All monies collected shall be applied pro rata to the satisfaction of the claims of the Commission and the claims of the Municipality in amounts calculated on a percentage equal to the proportion of their respective claims to the total sales tax liability of the taxpayer. 0 7. The Municipality acknowledges that the municipal sales tax received and collected pursuant to this Agreement will be deposited in the State Treasury as required by law. The I• Commission agrees that as early as possible each month, and so long as the Commission has any funds due the Municipality under this Agreement, it will cause to be paid over to the Treasurer of the Municipality, all municipal sales tax, penalty and interest received by the Commission during the preceding calendar month, except any amount refunded to taxpayers and less any sums withheld under Paragraph 5 above. 8. The Commission agrees to require reports of municipal sales tax from vendors, to ' maintain records of reports and collections from vendors and to maintain the records in such a manner that the total amount due the Municipality each month can be determined by the Commission. And, the Commission agrees to transmit to the Municipality a monthly statement of the municipal sales tax collected the preceding month and the amount refunded. The Municipality W shall have no other claim under this Agreement against the Commission for any funds other than for the municipal sales tax, penalty and interest thereon collected hereunder by the Commission. 9. The Municipality agrees that refunds of municipal sales tax previously paid over to the Treasurer of the Municipality shall be paid from subsequent collections of the municipal sales tax. The Commission's determination of claims for refund shall be binding on the Municipality. 10. Both parties agree that nothing herein shall be construed to affect the applicability of the Supreme Court's decision in the consolidated case of Kay Electric Cooperative, Inc. v. State of Oklahoma ex rel. Oklahoma Tax Commission and Cotton Electric Cooperative, Inc. v. State of Oklahoma ex rel. Oklahoma Tax Commission, 62 O.B.A.J. 2233 (July 20, 1991), to circumstances 2 that may arise hereunder. 1 1 . The Municipality agrees that any municipal sales tax, penalty and interest paid under protest received by the Commission during a preceding calendar month shall be paid over to the Treasurer of the Municipality. If the protested municipal sales tax is refunded, the municipal sales tax, penalty and interest paid under protest and interest required to be paid thereon will be paid out of current collections and deducted from the amount due the Municipality. 12. The Municipality acknowledges that the provisions of Section 205 of Title 68 of the Oklahoma Statutes, making the records and files of the Commission confidential and prohibiting disclosure of same, includes the Commission's records and files in respect to the collection of municipal sales tax and that sales . tax reports, records, files and any information obtained therefrom, cannot be divulged or disclosed except as authorized by statute. 13. In the event of termination of this Agreement, the Commission will cause to be paid over to the Municipality, all municipal sales tax funds in its possession then due and payable under this Agreement, and the Municipality shall thereafter be liable for and shall pay any refunds of municipal sales tax required by law to be made, including refunds of the amount of such municipal sales tax, penalty and interest paid under protest that must be refunded and any interest required thereon. After such termination, the Commission's liability shall extend only to the amount of such funds being held by it. The Municipality agrees to pay any interest required by law to be paid on such refunds. 14. The Municipality agrees that the Commission shall have the authority to assess, to collect, to enforce and to prosecute the municipal sales tax penalties and interest thereon, including any tax, penalty and interest liability existing on the date of this Agreement. The Municipality agrees that the Commission shall have all the powers of enforcement in regard to municipal sales tax, penalties and interest as are granted to or vested in the Municipality. And, the Municipality ' agrees to refrain from any assessment, collection, enforcement or prosecution of the municipal sales tax except as specified in this Agreement. 15. It is recognized and acknowledged that the Ordinance includes criminal sanctions for violation of the Ordinance. The Commission agrees that the Municipality may prosecute, in its Courts, any criminal violations of the Ordinance. And, the Commission agrees to fully cooperate ' with the Municipality in its prosecution efforts and to disclose information to the Municipality as 3 required by law. The Municipality agrees that the Commission will not prosecute violations of the Ordinance. 16. The Municipality agrees that any payment of tax, penalty or interest thereon, generated as a result of criminal prosecution or enforcement activity by the Municipality, shall be paid by the taxpayer directly to the Commission and shall be applied pro rata to the satisfaction of the respective liabilities owed to the State and the Municipality in amounts calculated on a percentage equal to the proportion of each liability to the total sales tax liability of such taxpayer. 17. It is recognized and acknowledged that the Municipality may elect to augment the Commission's enforcement of municipal sales tax. The Municipality agrees to refrain from any efforts to augment the Commission's enforcement of municipal sales tax except as specified by written Amendment to the Agreement approved by the Municipality and the Commission. 18. The Municipality agrees that the Commission has the sole authority to enter into an installment agreement with any taxpayer, including a taxpayer prosecuted under a municipal sales tax ordinance, for state and municipal sales taxes owed by the taxpayer, and that all monies collected pursuant to an installment agreement are to be applied pro rata to the satisfaction of the respective liabilities owed to the State and the Municipality in amounts calculated on a percentage equal to the proportion of each liability to the total sales tax liability of such taxpayer. 19. The Municipality agrees that if the constitutionality or legality of the Ordinance or any provisions thereof, shall be attacked in any Court, it shall be the duty of the Municipality to defend such litigation. 20. The Municipality agrees to promptly give the Commission a notice in writing of any annexation or de- annexation of territory to the Municipality. The notice shall include a verified copy of the street or physical boundaries of the newly annexed or de- annexed territory. All Municipality limit lines shall be designated by street name, or other physical boundaries, shown in map form, and certified to the Commission. 21. This Agreement shall be in effect from July 1 , 19 94 , until June 30, 19 95 . This Agreement is based upon the provisions contained in the Ordinance of the 'Municipality, a certified copy of which is attached hereto and made a part hereof. The Municipality agrees to forthwith provide the Commission with a certified copy of each amendment to the Ordinance enacted during the time this Agreement is in effect. Any amendment to the Ordinance — which the Commission determines is inconsistent with the terms of the Agreement shall constitute ' grounds for termination by the Commission of this Agreement. 2. The Commission shall administer and enforce the Ordinance and collect the municipal use 'tax in the manner herein provided. It is recognized and acknowledged that the ordinance levies a municipal use tax upon all use within the Municipality of property, the sales of which, if made within the Municipality, would be subject to the municipal sales tax. The municipal use tax should be administered in the same manner as the use tax levied by Sections 1401, et seq. of Title 68 of the Oklahoma Statutes, hereinafter referred to as "Oklahoma Use Tax Code, "; that all exemptions from state use tax are exempt from the municipal use tax, unless otherwise provided by the Oklahoma Use Tax Code; and, that in administering, enforcing and collecting the municipal use tax, M the terms use or "sale" as used herein shall mean "sale" as defined by state statute and the Commission's determination of what constitutes a sale shall be binding on the Municipality. IP 3. The Commission and the Municipality acknowledge that the bracket system should be adopted for the convenience of vendors in collecting both the state and municipal use tax, as authorized in Section 1410 of Title 68 of the Oklahoma Use Tax Code. 4. The Municipality agrees that vendors' claims for the discount allowed in Section 1410 M of the Oklahoma Use Tax Code shall be applicable to both state and municipal use tax remittances 44 and the Commission's determination of the validity of the claims shall be binding on the Municipality. 5. The Municipality agrees that the Commission shall retain, for its services rendered, an amount not to exceed one and three - fourths percent (1 -3/4 %) of the amount of such tax, penalty and interest, collected by the Commission. 6. Except as otherwise provided in this Agreement or Amendment hereto, the Commission shall give no preference in applying money received for state and municipal use taxes owed by a taxpayer. All monies collected shall be applied pro rata to the satisfaction of the claims of the Commission and the claims of the Municipality in amounts calculated on a percentage equal to the proportion of their respective claims to the total use tax liability of the taxpayer. 7. The Municipality acknowledges that the municipal use tax received and collected pursuant to this Agreement will be deposited in the State Treasury as required by law. The Commission agrees that as early as possible each month, and so long as the Commission has any funds due the Municipality under this Agreement, it will cause to be paid over to the Treasurer of the Municipality, all municipal use tax, penalty and interest received by the Commission during the preceding calendar month, except any amount refunded to taxpayers and less any sums withheld under Paragraph 5 above. 8. The Commission agrees to require reports of municipal use tax from vendors, to maintain records of reports and collections from vendors and to maintain the records in such a manner that the total amount due the Municipality each month can be determined by the Commission. And, t the Commission agrees to transmit to the Municipality a monthly statement of the municipal use tax collected the preceding month and the amount refunded. The Municipality shall have no other claim under this Agreement against the Commission for any funds other than for the municipal use tax, penalty and interest thereon collected hereunder by the Commission. ' 9. The Municipality agrees that refunds of municipal use tax previously paid over to the Treasurer of the Municipality shall be paid from subsequent collections of the municipal use tax. The Commission's determination of claims for refund shall be binding on the Municipality. 10. Both parties agree that nothing herein shall be construed to affect the applicability of , the Supreme Court's decision in the consolidated case of Kay Electric Cooperative, Inc. v. State ' of Oklahoma ex rel. Oklahoma Tax Commission and Cotton Electric Cooperative, Inc. v. State of Oklahoma ex rel. Oklahoma Tax Commission, 62 O.B.A.J. 2233 (July 20, 1991), to circumstances that may arise hereunder. 11 . The Municipality agrees that any municipal use tax, penalty and interest paid under protest received by the Commission during a preceding calendar month shall be paid over to the Treasurer of the Municipality. If the protested municipal use tax is refunded, the municipal use tax, penalty and interest paid under protest and interest required to be paid thereon will be paid out of current collections and deducted from the amount due the Municipality. 12. The Municipality acknowledges that the provisions of Section 205 of Title 68 of the Oklahoma Statutes, making the records and files of the Commission confidential and prohibiting disclosure of same, includes the Commission's records and files in respect to the collection of municipal use tax and that use tax reports, records, files and any information obtained therefrom, ' cannot be divulged or disclosed except as authorized by statute. 13. In the event of termination of this Agreement, the Commission will cause to be paid over to the Municipality, all municipal use tax funds in its possession then due and payable under this Agreement, and the Municipality shall thereafter be liable for and shall pay any refunds of municipal use tax required by law to be made, including refunds of the amount of such municipal use tax, penalty and interest paid under protest that must be refunded and any interest required 'thereon. After such termination, the Commission's liability shall extend only to the amount of such funds being held by it. The Municipality agrees to pay any interest required by law to be paid on such refunds. 14. The Municipality agrees that the Commission shall have the authority to assess, to collect, to enforce and to prosecute the municipal use tax penalties and interest thereon, including any tax, penalty and interest liability existing on the date of this Agreement. The Municipality ,,agrees that the Commission shall have all the powers of enforcement in regard to municipal use ,tax, penalties and interest as are granted to or vested in the Municipality. And, the Municipality agrees to refrain from any assessment, collection, enforcement or prosecution of the municipal use tax except as specified in this Agreement. Ilr 15. It is recognized and acknowledged that the Ordinance includes criminal sanctions for violation of the Ordinance. The Commission agrees that the Municipality may prosecute, in its Courts, any criminal violations of the Ordinance. And, the Commission agrees to fully cooperate 0" 3 with the Municipality in its prosecution efforts and to disclose information to the Municipality as required by law. The Municipality agrees that the Commission will not prosecute violations of the Ordinance. 16. The Municipality agrees that any payment of tax, penalty or interest thereon, generated as a result of criminal prosecution or enforcement activity by the Municipality, shall be paid by the taxpayer directly to the Commission and shall be applied pro rata to the satisfaction of the respective liabilities owed to the State and the Municipality in amounts calculated on a percentage equal to the proportion of each liability to the total use tax liability of such taxpayer. 17. It is recognized and acknowledged that the Municipality may elect to augment the Commission's enforcement of municipal use tax. The Municipality agrees to refrain from any efforts to augment the Commission's enforcement of municipal use tax except as specified by written Amendment to the Agreement approved by the Municipality and the Commission. 18. The Municipality agrees that the Commission has the sole authority to enter into an installment agreement with any taxpayer, including a taxpayer prosecuted under a municipal use tax ordinance, for state and municipal use taxes owed by the taxpayer, and that all monies collected pursuant to an installment agreement are to be applied pro rata to the satisfaction of the respective liabilities owed to the State and the Municipality in amounts calculated on a percentage equal to the proportion of each liability to the total use tax liability of such taxpayer. 19. The Municipality agrees that if the constitutionality or legality of the Ordinance or any provisions thereof, shall be attacked in any Court, it shall be the duty of the Municipality to defend such litigation. 20. The Municipality agrees to promptly give the Commission a notice in writing of any annexation or de- annexation of territory to the Municipality. The notice shall include a verified copy of the street or physical boundaries of the newly annexed or de- annexed territory. All Municipality ' limit lines shall be designated by street name, or other physical boundaries, shown in map form, and certified to the Commission. 21. This Agreement shall be in effect from July 1 1994 , until 1 June 30, 19 95 . Either party may terminate this contract for any reason upon thirty (30) days written notice of its intent to terminate to the other party. This 24 -hour block of training is designed to educate senior citizens in the judicial process. SALT (Seniors i and Lawmen Together) is the sponsor. This training will teach interested senior citizens in the judicial process in the event of crimes against seniors. These advocates can be called on to answer any questions that the victims may have and assist with providing guidance. This ' program has been in effect for a number of years in Tulsa and has proven to be very successful. RECREATION CENTER: SUMMER CAMPS - On June 6, 1994 the following camps will begin: baseball, basketball, tennis, twirling, and art camp. These camps will continue all summer until school starts. GIRL SCOUT SLEEP -OVER - The Girl Scouts will have their third annual sleep -over at the Recreation Center on June 16, 1994. The sleep -over will begin at 4:00 p.m. and will conclude with a picnic in Rayola Park at 1:00 p.m. on June 17, 1994. This is always a fun event; the ' girls are working on different craft badges. All the _ area builders and real estate agencies will be on hand to answer any questions on building and loan applications. 1 I f MEMORANDUM ' TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO t FROM: RODNEY J RAY CITY MANAGER ' SUBJECT: REQUEST FOR COUNCIL ACTION TO EXTEND CONTRACT BETWEEN CITY OF OWASSO AND FOP LODGE #149 DATE: June 29, 1994 BACKGROUND: Negotiations between the City and the FOP were initiated in April of this year and have continued on a regular basis since that time. It is now certain that a new agreement and ratified ' contract will not be in place prior to the end of the term of the current contract. In 1992, the Oklahoma Supreme Court ruled that contracts between cities and employee bargaining units were not allowed to contain "evergreen" clauses (Del City vs IAFF). "Evergreen" clauses were originally designed to allow a labor contract to remain in effect after its term had expired if a new contract had not been negotiated and executed. That ruling was ' in question until 1993 due to a petition filed with the court for a rehearing. However, in its 1993 session, the court denied the petition, thus implementing its previous ruling on the case. ' Because of that ruling, all municipal contracts with employee bargaining units expire on the date set forth in the contract. While there can be advantages in such a requirement, it does allow for abuses if a city council wanted to exploit that ruling by allowing a contract to expire, then arbitrarily cease to abide by the previously agreed upon contractual provisions. My position is that, in most cases, it would be unfair and poor employee relations to cease abiding by a previously agreed upon contract because the term had expired. Therefore, I agreed Im in pre- negotiation meetings to support the extension of our current contracts with the IAFF and FOP in the event our 1994 -95 negotiations had not produced executed contracts by June 30, 1994. We have, in fact, executed a new contract with firefighters, but have not successfully completed work on the FOP contract. Since we do not have a new FOP contract and the June 30, 1994 expiration date has arrived, it is incumbent upon management to fulfill our promise to the FOP lodge and request Council action to extend the 1993 -94 contract between the City and FOP Lodge #149 until such time as FOP Contract June 29, 1994 Page 2 a new contract is approved and executed. Mr Cates has been consulted and advises that the Council needs only to approve a motion to extend the current contract in order to implement that action. Officer Rinkle requested, and was granted, a waiver of the notice requirements contained in the Personnel Policy in order that his resignation may become immediately effective. I have authorized Chief Alexander to initiate the process to recruit, test, screen, employ and train a replacement for this position as soon as possible. REQUEST FOR ACTION FORM - As a part of the City Council agenda packet, you will see a new form being used by some departments. This form is entitled REQUEST FOR ACTION and has been initiated as a pilot project in the Community Development and Public Works departments. The form is similar to one that is being used by the City of Tulsa, and was designed to allow information to be quickly routed to the proper body or person, as well as giving a brief summary of what is contained in the information. We hope that this will also assist you as you review the information in the agenda packets. The initial use of the form will be for a 30 -day period. At the end of that time, we will evaluate its use and determine if it is something we want to continue. If you have questions or comments, contact Ms Boutwell or me. 1 CITY MANAGER'S REPORT July 1, 1994 Page 2 COMMUNITY DEVELOPMENT: I BUILDING PERMITS - Residential building permits for the month of June set a ten -year record. Twenty -three residential permits were issued by the Community Development , Department for an estimated $2,430,432 (very conservative value estimates) in new housing for the community. Year -to -date figures show that 1994 has been the busiest year for builders since 1986, and projections are that the remainder of the year will continue to show strong growth. There are 1100 acres currently in some stage of residential development. Based on previous studies, that translates into a potential 3500 to 5000 residential lots being developed. Additionally, there have been eight commercial building permits issued that were valued at $1,000,000 construction cost. POLICE SERVICES• TRAINING - Training has been completed in the SALT (Seniors and Lawmen Together) victim advocacy program. Owasso was host for this valuable training which was 24 hours in length and had 10 students from Tulsa and Owasso. The training was conducted by certified instructors as to judicial process, domestic violence, rape investigation and crime scenes, in addition to enhancement of listening skills. Upon receiving this training, these victim advocates may be summoned by police to respond to crime scenes to render assistance as needed. Owasso was proud to be the host of this training and will conduct additional training in this area as needed. MERCHANT WARNING SYSTEM - Chief Alexander has submitted a proposal to the Chamber ' of Commerce relative to a merchant warning system. This manual call system will be activated by the police department when scam games, stolen property or any criminal activity is taking place in the Owasso community. The process would allow businesses in the area to be alerted , to activity and provide information to the police department. Barbara Delgrosso has been provided the information and is working on the implementation of the project. VEHICLE PURCHASE - In October of 1993, the state bid for police vehicles was awarded to Larry Spencer Chevrolet in Norman, OK. Because the police department was unable to requisition for funds prior to the allocation of the new budget adopted by Council in June, there were no state police vehicles available for purchase at the time the budget was approved. Bids are going out on July 1 to over eight dealerships in the local and surrounding area for four police vehicles as approved in the FY94 -95 budget. Though it is doubtful that a state bid price will be obtained, the lowest bidder who meets the specifications will be presented to Council for approval at the July 19th Council meeting. Because police vehicles are desperately needed now and the state bid price is expected to increase over $2,000 in October of 1994, the purchase of ' the vehicles now should be considered if we are to avoid a bigger cost increase. If you should have any additional questions, please contact Chief Alexander at 272 -2244. 1 ' CITY MANAGER'S REPORT July 1, 1994 ' Page 3 1 1 1 1 1 1 1 1 1 1 1 FIRE SERVICES: DONATION - I have been notified by Senator Don Nickles that our request for the donation of a fire truck from McDonnell - Douglas Corporation has been approved by the corporate headquarters. In fact the truck, certified as a 1250 gallon per minute pumper, has already been delivered to the department so our firefighters can begin training (each truck has different controls and characteristics). However, the official ceremony for the donation will be scheduled at a future date in order to allow Sen Nickles and McDonnell- Douglas officials to attend. At this point it is expected that we will also have the official dedication of the new fire station at that time. It should be noted that there were several people who played key roles in securing the donation. The fire chief and his staff were instrumental in preparing appropriate data used in justifying the need for the truck, finance department employees developed data used to prove our budget capabilities to maintain the equipment, and the community development department pulled together growth information and maps to present to the company. But this acquisition could absolutely not have happened without the assistance of Sen Nickles and his staff. Even after the company initially turned down our request. Sen Nickles persisted in his efforts on our behalf and finally won approval of the donation. Both Mayor Duke and Vice Mayor Burris have offered our thanks to the Senator's staff and an official letter will soon be on its way to the Senator from the Mayor. In order to place the importance of this donation in perspective, I offer the following points: • The donated truck has better capabilities than any other pumper truck in the fire department. • The purchase of a truck with capabilities like this one would cost $185,000 - $200,000. • Our ISO rating review is coming up and, without this pumper, we may have been in trouble. • Our other two pumpers both need work on their pumps and engines; neither one met test requirements this year. Having another truck will allow us to get our existing trucks "in the shop" without causing a loss of protection to the community. • This truck is equipped with "foam" capabilities to fight fuel fires and some types of structure fires. ' A special thanks goes to the Council for allowing this request to proceed, the staff who worked together to put the presentation together, and certainly to Sen Nickles for believing in our community enough to go the extra mile on his own initiative. CITY MANAGER'S REPORT ' July 1, 1994 Page 4 ' STREETS: I BACKHOE PURCHASE - The FY94 -95 budget includes provisions for the purchase of a new backhoe in the Streets Division of Public Works. In order to adequately evaluate the types of equipment that are available for the budgeted amount of $42,000, the division will be requesting demonstrator units from various manufacturers. It is expected that demonstrators will be tested from John Deere, Case and Caterpillar. These units may be seen on the streets of Owasso in the next few weeks as our crews are evaluating the operating characteristics while they are working on scheduled projects. OPWA ADMINISTRATION: SUMMER WORK SCHEDULE - Effective Monday, June 20th, most of the Public Works Department personnel began a summer work schedule. The purpose of the summer schedule is to try to help the employees keep from working outside during the high heat hours of the day. After discussion with all department employees, it was decided that the Wastewater Collection, Streets and Cemetery divisions would work the hours of 7:00 a.m. to 3:30 p.m. Water Division personnel and Refuse Collection will keep the hours of 8:00 a.m. to 4:30 p.m. The Recycle Center hours will be unchanged. 1 ATTACHMENTS 1. The money from the sale of these vehicles has been placed into an account by the US District ' Attorney's office to be used exclusively by the Owasso Police Department in drug eradication efforts. I anticipate using this money for purchases to enhance the drug operations of the Owasso Police Department. In our review we considered long term use, mechanical condition, pumping capabilities, fire fighter safety, maintenance costs, compliance with Insurance Service Organization (I.S.O.) requirements, and life expectancy. ' After completing our review, the results are less than satisfactory. As the enclosed attachments indicate, our engines ' are in need of major repair. At the present time, the City of Owasso could sustain large fire loss due to the condition of our engines. Also, Engine III has developed a mechanical problem that while pumping at a structure fire the engine will die and takes ' approximately five (5) minutes to restart. This problem has developed in the last year. ' Please be assured that policies and procedures have been implemented to ensure adequate engines are available in the event of a structure fire. However, these policies are for short term ' use only. Presently, our structural fire fighting capabilities rely on the availability of mutual aid with our surrounding cities. The problem with relying totally on mutual aid is that it takes approximately thirty (30) minutes before mutual aid arrives. Extensive damage, fire loss, and possibly loss of life can occur while waiting on mutual aid assistance. ' The City of Owasso has grown to a point that we require three (3) engines to adequately provide fire protection for our city. In consideration of the three (3) engines we are assigned, we are requesting approval to complete the following mechanical repairs and replacement of Engine II: po IN o 1. Engine I This engine is twenty (20) years old and is not capable of passing the complete pumping service test. Recommendation: Contact a Certified Engine Repair Company, such as Boardman Company and have the Engine placed in 100% complete working condition. 2. Engine II This vehicle is thirty (30) years old and is in need of major mechanical, fire pump, and body repair. Recommendation: Due to the condition and age of this engine, we request Engine II be taken out -of- service. 3. Engine III This engine is ten (10) years old and is not capable of passing a pumping service test. Recommendation: Same as Engine I. In order for the above repair work to be completed, we will need a replacement engine while repairs are completed. We have contacted Tulsa Fire Department for approval of the use of their reserve engines. We have been given approval to utilize one of their reserve engines as soon as one is available. As for Engine II, this engine needs to be replaced immediately. I realize the city funding situation and understand money at this time is not available. However, replacement of Engine II is an emergency priority for the safety and well being of the city. This design works fine for smaller less aggressive departments, but does have limitations. We can only carry three (3) fire fighters safely on our present apparatuses and are unable to don S.C.B.A.'s in route, (if we were able to don S.C.B.A. equipment in route, it would allow quicker entry into fire buildings for rescue and fire suppression). The gasoline engines have limited horsepower which is needed to power the pumps at their rated capacity, (which may be part of E -III's inability to meet its Service Test Requirements). Our engines come very close to exceeding their Gross Vehicle Weight Ratings (G.V.W.R.) and vehicle braking capabilities when carrying the needed water, hoses, tools and equipment. The compartment size and design limits the size of auxiliary equipment we are able to carry on the apparatus. An apparatus with a Five (5) Man Cab configuration would allow our fire fighters to don S.C.B.A. equipment in route to an emergency scene while seatbelted and would increase our ability to make quicker entry into structures or other hazardous environments. This type of truck is custom built for the fire service, and the manufacturers take into consideration the use of the apparatus and build in greater safety factors. These apparatuses are built with a stronger chassis and springs, larger cooling systems, higher capacity brake systems, diesel engines and automatic transmissions. Diesel engines are more economical, require less maintenance, are more reliable and perform better under very hot or cold conditions. An unfortunate yet graphic example of the safety of these units occurred in Tulsa only weeks ago when two ( 2 ) fire engines collided at a high rate of speed with no serious injuries. This Apparatus is primary outfitted for structure fires. It is the "First Out" Apparatus on most structure fires including: residential, commercial, and manufacturing properties. On this apparatus, we carry the largest selection of fire fighting equipment which includes hoses, nozzles, hose tools, hand tools, ladders, self contained breathing apparatus (SCBA), power equipment, saws, ventilation fans, etc. ENGINE I - 1974 Ford Boardman Pumper with a one thousand (1000) gallon /minute pump and carries fire hose and five hundred (500) gallons of water. Engine One is outfitted to serve as a multi- purpose truck. It is used as the back up structure apparatus, "ie ". If more pumping capacity and equipment are needed on a fire scene, or another structure fire is reported while Engine Three is busy. It is also equipped for combatting vehicle fires, for rescue operations, and for providing vehicle extrication services. ENGINE II - 1965 Ford Boardman Pumper with a five hundred (500) gallon /minute pump. This unit has been out of service since 1985. TANKER I - 1994 Ford F -700 with an eighteen hundred (1800) gallon water tank. This truck is used to shuttle water to fire scenes where the water supply is marginal or non - existent. This truck is equipped to dump water into holding tanks at the pumper location on the fire scene. This enables the tanker to leave and SQUAD I - 1979 Chevrolet C -30 - 4X4 with a utility box bed. This truck has a "skid unit" type water tank and high pressure pump. It is used mainly for grass and wildland fires. Some salvage and overhaul equipment is also carried on this vehicle. This tournament was played by area 12- under, girls, fast -pitch softball teams. I'm excited to tell you that through the efforts of 35 Owasso and Tulsa sponsors, 30 area volunteers and 11 quality softball teams, our first annual tournament cleared $4,160. 1 These proceeds have since been deposited into the Jennifer Gibson Memorial Scholarship Fund. The Fund has recently presented its first awards to three 1994 graduates of Owasso High School. ' This year's awards total $2,300. We intend to use the annual tournament as the Fund's primary fund- raising event each year. As we approach next year's tournament, we'll be back in touch. This tournament was played by area 12- under, girls, fast -pitch softball teams. I'm excited to tell you that through the efforts of 35 Owasso and Tulsa sponsors, 30 area volunteers and 11 quality softball teams, our first annual tournament cleared $4,160. 1 These proceeds have since been deposited into the Jennifer Gibson Memorial Scholarship Fund. The Fund has recently presented its first awards to three 1994 graduates of Owasso High School. ' This year's awards total $2,300. We intend to use the annual tournament as the Fund's primary fund- raising event each year. As we approach next year's tournament, we'll be back in touch. As the event grows both in size and interest, I am certain more local businesses will be interested in becoming involved. Perhaps you can help us get the word out.
