ITEM 1: CALL TO ORDER Mayor Duke called the meeting to order at 7:21 p.m. ITEM 2: INVOCATION The invocation was held during the OPWA meeting preceding this meeting. ITEM 3: FLAG SALUTE The flag salute was held during the OPWA meeting preceding this meeting. AYE: Duke, Barnhouse, Ewing NAY: None Motion carried 3 -0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN APPEAL OF A CITATION ISSUED BY THE CODE ENFORCEMENT OFFICER. Mr Ray relayed a staff request that this item be removed from the agenda. The area in question has been cleaned and the citizen was not present. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #94 -08, A RESOLUTION AUTHORIZING AND APPROVING OWASSO'S PARTICIPATION IN A METROPOLITAN TULSA HOME CONSORTIUM. Mr Rich Brierre, INCOG Deputy Director presented information relating to the purpose and concept of a proposed consortium comprised of cities and counties in the Tulsa metropolitan area. The consortium would submit a multi jurisdictional application for a major housing rehabilitation grant from the state. The program contains no funding requirements. N Owasso City Council June 7, 1994 ITEM 9: DISCUSSION OF DRAINAGE PROBLEM IN EL RIO VISTA SUBDIVISION AND REQUEST FOR STAFF ACTION TO ADDRESS THAT PROBLEM. Councilor Ewing and Mr Ray have met with a citizen residing at 9605 N 110th E Ave concerning a drainage problem in his rear yard. Councilor Ewing moved, seconded by Councilor Barnhouse, to direct the staff to taken whatever action is necessary to alleviate the problem. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A ' REQUEST FOR THE PURCHASE OF SUPPLIES TO BE USED IN THE DARE PROGRAM. Chief Alexander said that, because of cuts in federal programs, supplies for the Dare program cannot be purchased from 1994 grant funds; only salaries may be supplemented from those funds. She requested that additional supplies for the DARE program be purchased from 1993 grant funds, allowing for the stockpile of supplies for upcoming DARE classes. The request is for an expenditure of $2,171 to Dare America, as a sole source purchase, with 75% of this expenditure being reimbursed to the city through the DARE grant program. Ms Robinson, of the Owasso Reporter, asked if DARE Trust funds had been depleted. Chief Alexander said that they had not, and that those funds will be used if they are needed. Mayor Duke moved to approve the request. Seconded by Councilor Ewing. AYE: Duke, Ewing, Barnhouse NAY: None Motion carried 3 -0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE EXPENDITURE OF FUNDS FOR THE REPAIR OF STREET DEPARTMENT EQUIPMENT, AND APPROVAL OF A "SOLE SOURCE" DETERMINATION REGARDING THAT EXPENDITURE. Mr Carr told the Council that problems had developed with the rear axle on the 1984 John Deere backhoe used in the street division. The backhoe was transported to Keystone Equipment in Sand Springs for an evaluation of the problem. The transmission and hydraulic system of the backhoe was repaired by Keystone in February, and they have a fully qualified staff of Owasso City Council June 7, 1994 mechanics to work on this piece of equipment. They have quoted a cost of $2,988.39 to repair the backhoe. Councilor Ewing asked if the backhoe would be used long enough to justify the repair. Mr Carr said that the backhoe will be transferred to the Parks Department when a new backhoe is purchased for the street division, and there should be several years usage left in it with the lighter workload required in the Parks Department. Mayor Duke moved to approve a sole source expenditure of $2,988.39 payable to Keystone Equipment to repair the street division 1984 John Deere backhoe. Motion seconded by Mary Lou Bamhouse. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AWARD A BID FOR THE CONSTRUCTION OF IMPROVEMENTS AT 76TH ST NORTH AND MAIN. Mr Munn presented this item. He said that bids were opened on May 26 for the above -named project. Two bids were received, with ten separate items being bid. It is recommended that the lowest bid be awarded for each item, and the bidders are in agreement with this. Staff recommends awarding one contract to APAC - Oklahoma in the amount of $97,127.50 and one contract to Empire Construction for $39,600.00 for the construction of improvements of the 76th St North Phase II project. Mary Lou Barnhouse moved, seconded by Mayor Duke, to approve the staff request and award the contracts as requested. AYE: Barnhouse, Duke, Ewing NAY: None Motion carried 3 -0. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF A FINAL PLAT FOR DOUBLE OAKS EXTENDED, AN ADDITION TO THE CITY OF OWASSO LOCATED IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 14 EAST, CONTAINING 95 LOTS ON A 29.32 ACRE AREA. The final plat for Double Oaks Extended, the fifth and final phase of the Double Oaks development, and zoned RS -3, was review by the Planning Commission on May 10 and was unanimously approved. Mr Rooney said that all requirements have been met by the developer. He also said that the developer has expressed an interest in changing the name of the plat to Double Oaks IV, and that it may be filed under that name instead of Double Oaks Extended. 4 Owasso City Council June 7, 1994 Mayor Duke moved, seconded by Councilor Barnhouse, to approve the final plat for Double Oaks Extended. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF A FINAL PLAT FOR CENTRAL PARK, AN ADDITION TO THE CITY OF OWASSO, LOCATED IN THE EAST HALF OF SECTION 20, TOWNSHIP 21 NORTH, RANGE 14 EAST, CONTAINING 44 LOTS ON A 15.86 ACRE AREA. The final plat for Central Park was unanimously approved at the Planning Commission meeting on May 10. Acceleration and deceleration lanes will be added at the subdivision entrance on 129th East Avenue to assist in traffic flow. Mayor Duke moved to approve the final plat for Central Park. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF A FINAL PLAT FOR NOTTINGHAM ESTATES, AN ADDITION TO THE CITY OF OWASSO, LOCATED IN THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 31, TOWNSHIP 21 NORTH, RANGE 14 EAST, CONTAINING 46 LOTS ON A 26.49 ACRE AREA. The final plat for Nottingham Estates was unanimously approved at the Planning Commission meeting on May 10. At that meeting, concerns from property owners in the Pleasant View addition were aired regarding construction traffic through that addition. Property owners were concerned that heavy construction equipment would damage the residential streets and also present a hazard to children within the addition. Through a series of meetings between the applicant, County Commissioner Lewis Harris, and the City Manager, a working agreement was developed. The applicant indicated that he would erect a sign at the entrance of the Pleasant View addition and would open a construction entrance further to the east of 96th Street North and instruct his personnel to use it. He would also add a construction entrance sign at that point. At this time, none of this has been done. Ms Judy Pruitt, representing the Pleasant View 5 Owasso City Council June 7, 1994 homeowners, was present and requested that the final plat be denied until the problem with the developer can be worked out. City Attorney Ron Cates said that the only recourse Pleasant View residents would have is through Tulsa County, since that subdivision is not in the Owasso city limits. He said that if the plat meets the subdivision requirements, approval of the final plat cannot legally be withheld. The developer of Nottingham Estates, Charles Helschel, was present and said that he had agreed to construct a temporary dirt road to be used as a construction entrance, and asked that the city, the county, or Pleasant View homeowners assist in the cost of placing gravel on that road. Mr Cates said that the City cannot provide any assistance because this is a private project and it is illegal for the City to provide assistance for a private project. Mr Helschel said that the street through Pleasant View Estates had not been used for about three weeks, and he did not believe his personnel was responsible for the damage at the entrance. Mr Helschel reminded the residents of Pleasant View Estates that he is constructing a sanitary sewer which will be tied to the Brentwood Estates addition, and they will have the ability to tie in to that sanitary sewer. Currently Pleasant View Estates homes have septic systems. Following a lengthy discussion, Councilor Ewing moved to approve the final plat for Nottingham Estates. Motion seconded by Mary Lou Barnhouse. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0. Mayor Duke recessed the meeting at 8:30 p.m. and reconvened at 8:40 p.m. ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #/483. AN ORDINANCE REZONING A TRACT OF PROPERTY LOCATED IN THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 31, TOWNSHIP 21 NORTH, RANGE 14 EAST FROM RM -1 (RESIDENTIAL MULTI - FAMILY LOW DENSITY) AND AG (AGRICULTURAL) TO IL (INDUSTRIAL LIGHT) Mr Rooney presented this item. On May 17, the Council approved a rezoning request on the above captioned tract to allow the development of the selected National Steak and Poultry site. Ordinance ##483 formally adopts those action. Mayor Duke moved, seconded by Councilor Ewing, to approve Ordinance #483. AYE: Duke, Ewing, Barnhouse NAY: None Motion carried 3 -0. 0 Owasso City Council June 7, 1994 ITEM 17: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #94 -07, A RESOLUTION DECLARING SUPPORT FOR THE PROPOSED COUNTY -WIDE SALES TAX LEVY OF ONE -HALF PERCENT (1/2 %) FOR APPROXIMATELY ONE (1) YEAR FOR THE PURPOSE OF PROVIDING FINANCIAL ASSISTANCE TO THE WHIRLPOOL CORPORATION. Resolution #94 -07 expressed the support of the Owasso City Council for passage of a proposed sales tax levy in Tulsa County for approximately one year to aid in the location of a Whirlpool manufacturing facility in the Cherokee Industrial Park. Danny Ewing moved, seconded by Mary Lou Barnhouse, to approve Resolution #94 -07. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0. ITEM 18: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AWARD A BID FOR THE PURCHASE OF GASOLINE AND DIESEL FUEL. Mr Ray told the Council that the outsourcing of fuel management services since November 1993 has given the city a savings of approximately .16C per gallon compared to a bulk price purchase. This amount was nearly double what had been projected. An evaluation of the program indicated that this privatized program should be continued. Bid specifications were developed and bid packets mailed to three vendors and a notice was placed in the newspaper. Bids were opened on May 20. Staff recommended that a one -year contract for gasoline and diesel fuel be awarded to GO! Systems at a margin of .07C per gallon, based on the OPIS average wholesale cost of fuel on a weekly basis, and that the Mayor be authorized to execute the necessary documents. Mayor Duke moved to approve the staff recommendation. Motion seconded by Councilor Barnhouse. AYE: Duke, Barnhouse, Ewing NAY: None Motion carried 3 -0. 1 1 h Owasso City Council June 7, 1994 ITEM 19: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE PAYMENT AND TRANSFER OF GRANT FUNDS TO THE OWASSO PUBLIC GOLF AUTHORITY. At the March 15, 1994 City Council meeting, the acceptance of a grant in the amount of $27,860 by the City to reimburse the Owasso Public Golf Authority for construction of the golf course entrance road was approved. Those funds have been received and need to be transferred to OPGA. Councilor Ewing moved to approve the request for payment and transfer of $27,818.73 to the Owasso Public Golf Authority. Motion seconded by Councilor Barnhouse. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0. ITEM 20: DISCUSSION AND APPROPRIATE ACTION RELATING TO LABOR CONTRACT NEGOTIATIONS BETWEEN THE CITY OF OWASSO AND FOP LODGE #149. Kenny Yount, president of FOP Lodge #149, requested that this item be stricken from the agenda. Mayor Duke requested that this issue be resolved. ITEM 21: REPORT FROM CITY MANAGER No Report. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0 and the meeting was adjourned at 8:55 p.m. Marcia Boutwell, Council Clerk 0 Jerry Duke, Mayor June 7, 1994 OWASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Tuesday, June 14, 1994 The Owasso City Council met in special session at 5:30 p.m. on Tuesday, June 14, 1994 in the City Manager's office at Owasso City Hall, as part of the council chambers / courtroom renovation committee. Mayor Duke called the meeting to order at 5:45 p.m. and declared a quorum present. Committee members (Council) present were Mr Duke, Mr Burris, Ms Barnhouse, Mr Ramey and Mr Ewing. Committee members (staff) present were Mr Ray, Mr Knebel, Mr Compton and Ms Boutwell. Committee members absent were Mr Hilsabeck and Mr Ramsey. Architect Don Holmes presented the final concept plans for the project. In order for the project to stay within budget, Mr Holmes has prepared the plans and bid documents to include only essential items. Other items are included as alternates. There was discussion concerning zoned heating and air conditioning and ceramic tile floors in the restrooms, with the consensus being that these items should be included as alternates. Five alternates will be included in the specifications: 1) brick veneer behind council desk, 2) sound proof folding partition between meeting rooms, 3) zoned heating and air conditioning, 4) ceramic tile floors and base in restrooms, and 5) raised platform for movable seating. Charles Burris moved, seconded by Mary Lou Barnhouse, to approve the final drawings and recommendations of the architect, including all alternates, and place the item on the June 21, 1994 regular City Council agenda for approval and authorization to solicit bids. A vote on the motions was recorded as follows: AYE - Burris, Bamhouse, Ewing, Ramey, Duke; NAY - none. If approved at the regular City Council meeting, the first notice for bids will appear in the newspaper of June 30, mandatory pre -bid meeting on July 22, bid opening on August 2, to City Council to award a bid on August 16, and an approximate start date of September 1. ' Approximately 25 citizens and staff were in attendance. Following the presentation by Mr Ray and Ms Bishop, at 8:00 p.m., the Mayor declared a recess. The meeting was reconvened at 8:15 p.m, at which time the Mayor received questions and comments from the bench and the ' public, with response from the staff. The major items questioned concerned work at the Sports Owasso City Council June 14, 1994 Park, drainage in the Hale Acres subdivision, work at Rayola Park, competitive bidding, salaries, staff increases, City Clerk position, and due process safeguards. The proposed budget will be considered for action by the City Council and OPWA at the June 21, 1994 regular meeting. Legal notice was given and a public hearing conducted on June 14, 1994, wherein citizens were offered the opportunity to comment on the proposed budget. Copies of the proposed budget have been available for public review at the Owasso Library and at City Hall. To encourage citizen participation, more than thirty -five copies have been distributed to interested parties, civic groups and community organizations. State statute requires adoption of the annual budget by resolution. Resolution #94 -09 with Attachment A (Budget Summary) provides for the adoption of the fiscal year budget for the general fund and other funds of the City. RECOMMENDATION: Staff recommends Trustee approval of Resolution #94 -09 adopting the fiscal year 1994 -95 budget for all funds of the City. To provide cleaning for the 1994 -95 fiscal year, the following vendors (all within the Owasso city limits) were provided requests for quotes on dry cleaning of departmental uniforms: First Cleaners Imperial Cleaners Three Lakes Laundry Yale Cleaners Quotes were opened on June 10, 1994, at City Hall. Only two cleaners submitted bids as follows: Yale Cleaners - $15,660.00 Three Lakes Laundry - $16,556.40 Both vendors met the bid specifications and both stated that any alterations would be at an added cost to the specified contract. You have been provided with information from the City Manager as to uniform purchase and cleaning contracts for uniforms that were agreed upon by the previous administration. Police Dept Uniform Cleaning June 13, 1994 Page 2 COST COMPARISON: Prior to last year, all commissioned officers were paid a cleaning allowance of $25.00 per pay period. 21 officers X $25.00 X 26 pay periods = $13,650.00 Presently, 22 commissioned officers and 5 communications personnel wear uniforms which require dry cleaning, making a new total of 27 uniformed employees. 27 employees X $25.00 X 26 pay periods = $17,550.00 If the City had elected to provide a cleaning allowance to uniformed personnel for the next fiscal year and, based on the above figures as the anticipated expenditure, an immediate savings of $1,890 per year will be recognized by the city should it enter into the city paid cleaning contract instead. COMMENTS: In the past, uniform standards were habitually sacrificed by some officers in that the finances were used elsewhere. When the officers were responsible for their own cleaning, uniforms were often not cleaned and maintained to an acceptable standard. The new uniforms purchased this year have been maintained since the officers do not have to pay for the cleaning themselves, thus extending the life of the uniform and consistently providing a high appearance standard. The Owasso Police Department has been very pleased with the service provided by Yale Cleaners. FUNDING: The funding for this contract has been adequately covered in the 1994 -1995 budget proposal. RECOMMENDATION: Staff recommends that the City Council award a one -year contract for uniform dry cleaning to Yale cleaners at a cost of $15,660 to be paid in monthly increments of $1,305 and that the Mayor be authorized to execute said contract. J SPECIFICATIONS UNIFORM CLEANING General Description The following is a comprehensive list of specifications for cleaning of departmental uniforms for the fiscal year July 1, 1994 thru June 30, 1995. In general, the cleaning will include all police officers' uniforms, communicators uniforms and civilian attire for the Chief, lieutenant and detectives. This will also include an occasional laundering and starching of the animal control officer's uniform. General Provisions 1. Length of Contract - The cleaning contract shall be for a period of one year and shall be automatically extended until a new contract is awarded. Period of the contract is from 1 July 1994 through 30 June 1995. 2. Billing - The uniform cleaning bill shall be submitted monthly and monthly payments will be made by the City of Owasso. Alterations and repairs will be billed separately from cleaning. 3. Number of Uniforms - There are twenty -two (22) officers, five (5) communication officers, and one (1) animal control officer. The breakdown for cleaning services is as follows: 19 Officers full uniforms, 5 days a week 2 Officers civilian clothes, 5 days a week 1 Officer 50/50 split in uniform /civilian 5 Communicators full uniforms, 5 days a week 1 Animal control officer uniform, launder and starch, 2 days a month 4. Laundering /Cleaning Services - Services to include dry cleaning of all uniforms as shown above, dry cleaning or laundering of civilian clothes and replacement of buttons as needed. Minor alterations should occur approximately once a year or upon new officer uniform issue and will include: • Hemming of trousers • Affixing patches to shirts /jackets • Tailoring of uniforms 1 Cleaner must be able to handle and launder uniforms contaminated with blood or other body fluids in compliance with O.S.H.A. bloodborne pathogens and infectious disease control standards. The staff report reviewed by the Planning Commission is attached for your review. As stated within that report, land uses in this area are diverse and the Comprehensive Plan may be outdated when applied to this area specifically. In addition to the nearby uses such as Hughes Lumber, Bud's Discount Warehouse, and Super H Grocery Store, the tract is abutted on the east by undeveloped non - residential zoning, thus making it highly unlikely that it would develop in a low density residential manner. While IL zoning is indeed the classification that is required by the Owasso Zoning Code for a manufacturing use, one should not think of this business as your typical industrial development. Midwest Time Control, Inc. manufactures small parts for clocks and watches and all activity is conducted within an enclosed building. There is no noise or outdoor storage associated with this use. If approved, there are requirements within the zoning code to ensure that a compatible environment is maintained between the proposed use and the abutting mobile home district. First, the subject property will need to be fenced with a site obstructing fence or wall along the southerly property line. Midwest Time Control, Inc., is currently located in Owasso (off of Main Street) and is looking for an area in which to expand their operations. All related business operations of Midwest Time Control, Inc., are conducted entirely within the building with no outdoor storage. As stated previously, the Owasso Comprehensive Plan, while identifying this area as being appropriate for Low Density Residential Development, may be considered to be outdated when applied to the existing physical facts of the area surrounding the subject tract. Hughes Lumber, Bud's Discount Warehouse and Super H grocery store are all located within a 1/4 mile of this area. The Owasso Sports Park, also nearby, has increased the diversity of land uses found in this area. In addition, the tract is abutted by proposed or existing non- residential uses and therefore is highly unlikely to develop as low intensity residential. Staff feels the IL zoning classification may not necessarily be the zoning classification that is best suited for a use like Midwest Time Control, Inc., however the Owasso Zoning Code does not allow a use such as this to be placed in any form of Commercial district. Certainly, one can reach the conclusion that manufacturing small clock parts and a use such as what is being proposed by National Steak and Poultry are different. However, both uses are within the confines of an IL zoning district. Hopefully, items such as this can be addressed when the Owasso Zoning Code is updated. The zoning code does require several items as a safe guard or buffer for the residential district abutting the subject property. First, the subject property will need to be fenced with a site obstructing fence or wall along the southerly property line. Second, any actual building will need to be setback a minimum of 75 feet. At that meeting, staff made Council aware of several concerned property owners of the Double Oaks Estates addition who had concerns over the Double Oaks Extended final plat. Apparently, these residents were under the impression that the area to the north of Double Oaks Estates (the proposed Double Oaks Extended), was to be subdivided into larger lots. As I explained to you at the last Council meeting, the Double Oaks Extended final plat was meeting all city requirements regarding subdivisions and the zoning code, thus a denial of the plat should be avoided. However, as a portion of my presentation, I did state that it was likely that an amendment to the Double Oaks Extended plat was likely due to the concerns of the Double Oaks Estates residents. During the last month, three meetings were held at city hall regarding this issue. The third and final meeting involved the majority of land owners from Double Oaks Estates. At that meeting, several resolutions were obtained and the enclosed plat reflects the most significant of those agreements. As you can see, E. 80th Place North and N. 124th E. Avenue have now become E. 80th Court North. Residents felt that this would alleviate potential "through" traffic in their addition, while still leaving access via N. 123rd E. Avenue. City personnel felt it important to leave N. 123rd E. Avenue as a public right -of -way. While city staff does not have a strong opinion as to which proposal is "better ", we do feel that the option that was agreed upon by the Double Oaks Estates neighborhood seems to please everyone. The amended final plat meets all city requirements. Because of delays with the construction of the new Central Fire Station Project, it was recommended that the funding previously approved by the Council for the first two phases of the City Hall Renovation Project be moved forward and rescheduled to occur during FY 93 -94 and FY 94 -95. It was also recommended that $90,000 be allocated in the FY 93 -94 budget for the design and construction of a multi - purpose meeting room, located in the existing fire bays area. It was further recommended that $70,000 be allocated in the FY 94 -95 budget for constructing the second phase of remodeling, which would initiate the renovation of the remaining portion of City Hall. In April of 1993 the annual committee report was submitted to the Council and adopted. The City Council then appropriated $90,000 in the FY 93 -94 budget for the design and construction of a multi - purpose Council /Court Room. In January of 1994, a design team was created consisting of council members, court officials, and the city manager. This team was to coordinate the design and remodeling of the fire bays into a multi - purpose council /court room. The team met several times, including visits to other municipal facilities, and developed a conceptual plan. Holmes Architectural Services, Inc. was then used to provide architectural assistance and complete final design plans and bid documents. The final plans and bid documents have been developed by Mr. Holmes and were reviewed by both the design team and the city staff. The documents and plans are in order and meet all requirements (plans are included for you review). RECOMMENDATION• The design committee and the staff recommend that the City Council approve the design for the renovation of City Hall Council /Court Room, and authorize the solicitation of bids. An agreement has been reached by the negotiators, and that agreement has been ratified by the union membership and signed by their president. The proposed agreement provides an average salary increase of 7 %. (Individual increases range from 4.9 % to 8.4 % due to differences in longevity and pro -pay.) In addition to the salary increases, there are increases in the cost of health insurance and an increase in the City's contribution to the state retirement system (up 1/2%). The total new cost of the contract is $50,544, or an increase of 7.93 %. A spreadsheet has been attached indicating the specific cost of the contract items. Compensation increases in the contract are as follows: • An alternative compensation system consisting of a one -time payment of 4% of average annual salary. • Monthly longevity pay equal to $6 per year of service (eligible after three years). • Increase in pro -pay for paramedics (annual increase of $240), intermediate EMT (annual increase of $480), and basic EMT (annual increase of $120). • Annual allowance of $25 for the purchase of bed linens. Changes in contract language involving issues other than compensation are as follows: Sick leave incentive after an individual firefighter has accrued the maximum allowable sick leave hours. This new language is designed to reduce sick time in the department by IAFF Contract June 17, 1994 Page 2 creating an incentive that will give payments for a percentage of unused sick leave once the employee has accumulated the required number of hours. This plan is somewhat unique because it imposes strict limits on the amount of payment and requires the employee to save enough sick leave to cover needed time off when sick. I have traditionally opposed most sick leave incentive programs because I view sick leave as a benefit, not a right or compensation. However this incentive program is a common sense approach that I believe will be successful in meeting its goal. It should be noted that abuse of sick leave is not considered a problem in the department (a review of data does not indicate unusual patterns), but the incentive program could increase productive hours in the department. Definition of "hours worked" for the purpose of calculating FLSA overtime. Temporary pay increase for "working out -of- class." Generally, I consider the negotiated agreement as a win for both the firefighters and the City. While the final document cost is more than originally hoped for, the City did win concessions from the union in areas of overtime calculation and method of payment for this year's wage increase. The staff goals for negotiation were 1) to reword the language in the contract that defined the method of calculating overtime; and 2) tie pay increase to increased ability to produce. The current overtime language allows the employee to count any "leave time" (sick, vacation, military, family, etc) as "hours worked" in calculating overtime. That language was included in the contract last year after negotiations were "reopened" with the FOP. After operating under that language for five months, the staff estimates indicated that method of calculation would result in 1994 -95 cost to the City of $15,000 in the fire department alone. Changing that contract language was an important element in our plan of negotiations. The final wording does not allow the employee to use any leave except vacation as "hours worked" when calculating overtime payments. The use of vacation time as "hours worked" should not have a significant impact on overtime cost. Additionally, the staff goal of tying increased pay to the ability of an employee to deliver services was high on our list of things to accomplish during negotiations. As a result, increases in "pro -pay" for emergency medical technicians were included. The increase for a paramedic is $20.00 a month, intermediate EMT $40.00 a month, and basic EMT $10.00 per month. We also wanted to provide increased incentive for basic EMTs to advance to the intermediate level, thus the higher increase in the intermediate pro -pay. The firefighters' major goal appeared to be the inclusion of "longevity pay." After substantial discussion and research, my position was that denial of longevity pay would not survive a IAFF Contract June 17, 1994 Page 3 serious arbitration challenge. Therefore, the City offered to initiate longevity pay, but only on the condition that 94 -95 salary increase would be a one -time, lump sum payment that did not accrue to the employees' base pay. The net effect of such language is that the bottom line cost this year is higher than desired, but 4% of that increase will not have to be paid again in the 95 -96 budget. Those deferred savings will fund the longevity pay plan this year and next year (95 -96). However, it should be noted that after 95 -96, all pay increases should be viewed as a companion cost to the longevity pay for the employee. COMMENTS: This year's firefighter negotiations were carried out in a professional, mature manner that worked to produce an agreement that would accommodate both parties. The result was that this year's negotiations were, in my opinion, the best, most productive discussions we have had over the past eight years. I believe the relationship between the firefighters and city administration improved significantly because of the environment and attitude of both sides. There remain serious issues that will be addressed in the future, and in some cases there is serious disagreement. However, if those matters are addressed in the context of providing a win -win solution for both parties, they too will be resolved. Neither side came away from the table with all of their goals. RECOMMENDATION• The staff recommends Council approval of the proposed 1994 -95 contract between the City of Owasso and the IAFF Local 2789, and that the Mayor be authorized to execute such document on behalf of the City. PLANNING COMMISSION - At the June 14, 1994 Planning Commission meeting, the Best Western Motel Site Plan was approved, and it was identified that an estimated opening date will be October 12, 1994. CITY MANAGER'S REPORT June 17, 1994 Page 2 ENGINEERING: 96TH AND GARNETT SIGNALIZATION - As previously reported, a concept plan of the 96th Street North and Garnett Road intersection improvements has been prepared by Tulsa County. Based on the proposed plan, our Engineering Division is preparing the specifications for the signalization. The signalization plans will be completed within the next week. Authorization to bid the signalization will be presented to Council at the July 5th meeting. Due to the timing in receiving the concept plans from the County, we may have some difficulty in achieving our ultimate completion date. The current goal is still to have the intersection completed by the start of the coming school year. POLICE SERVICES: TRAINING - Officer Denton is completing his final phase of training and will be released for duty after evaluation in mid -July. The FTO (Field Officer Training) program is a newly designed program to better prepare new officers as to the expectations of the Owasso Police Department. Denton recently graduated second in a class of over 40 officers in CLEET (Council on Law Enforcement Education and Training) basic training. He is doing exceptional in his FTO training and will be a valuable part of the Owasso Police Department upon release. Officer Mozingo is completing the final week of canine training with 'Nick'. Mozingo also is performing exceptionally and is anxious to get back on the road with his new partner. TRAIL DAYS - Preparations and operations plans are being made for the 1994 Trail Days celebration. Coordination with parade officials promises this year to be the best ever. Officers will be periodically walking the carnival area and keeping a close patrol to prevent any criminal activity. DEPARTMENT POLICY REVIEW - As of this date, all current Police Department Policies have been reviewed and marked accordingly for update. Revisions to the policy manual have not occurred for several years. Reduced liability, in addition to new procedures and officer safety issues, are the prime focus for modifying current policies. Several new policies have been issued and several more are being targeted for revision. Contact with the city attorney for legal confirmation and input is made prior to the release of any policy. Two cities ' which have lower populations were also included, yet Owasso still maintained a lower crime index. ' I feel the information attached confirms that Owasso enjoys a much higher quality of life due to a reduced crime rate. Though I am very pleased with this report, I would be negligent in not taking this opportunity to advise that with the growth of Owasso, a growth within ' the police department must be considered. Simply because past statistics do not show an increase in the crime trend is not to assume that one will not occur. The water problem in our area was brought up, but due to time restrictions, all of your concerns could not be addressed, However, the Mayor (Jerry Duke), our district Councilman (Danny Ewing), the City Manager (Rodney Ray), and the city engineer agreed to come out to this area for a tour and a meeting to discuss our concerns in more detail. It would be very advantageous for as many as possible to attend this meeting and voice Your concerns on an individual basis.
