Adjournment OWASSO PUBLIC WORKS AUTHORITY MINUTES OF REGULAR MEETING Tuesday, June 7, 1994 The Owasso Public Works Authority met in regular session on Tuesday, June 7, 1994 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4 :00 p.m. on Friday, June 3, 1994. ITEM 1: CALL TO ORDER. Chairman Duke called the meeting to order at 7:00 p.m. ITEM 2: INVOCATION Robert Carr gave the invocation. ITEM 3: FLAG SALUTE. The flag salute was led by Chairman Duke. ITEM 4: ROLL CALL. PRESENT ABSENT Danny Ewing, Trustee Charles Burris, Vice Chair Mary Lou Barnhouse, Trustee Joe Ramey, Trustee Jerry Duke, Chair STAFF Rodney J Ray, City Manager Ronald D Cates, Authority Attorney Marcia Boutwell, Recording Secretary A quorum was declared present. ITEM 5: REQUEST APPROVAL OF THE MINUTES OF MAY 17, 1994 REGULAR MEETING. Mary Lou Barnhouse moved to approve the minutes as written, by reference hereto; seconded by Mayor Duke. AYE: Barnhouse, Duke, Ramey NAY: None Motion carried 3 -0. Owasso Public Works Authority June 7, 1994 ITEM 6: REQUEST APPROVAL OF CLAIMS. Danny Ewing moved, seconded by Mary Lou Bamhouse, to approve the following claims as submitted: (1) OPWA Fund $84,592.97; (2) OPWA Capital Improvements $2,613.60; (3) Interfund Transfers $31,884.24; (4) Payroll #1 $21,847.04; (5) Payroll #2 $22,326.91. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0. ITEM 7: REPORT FROM CITY STAFF RELATING TO DISCUSSIONS WITH THE CITY'S INSURANCE COMPANY REGARDING CLAIMS FILED AGAINST THE CITY /OPWA FOR PAYMENT OF DAMAGES RESULTING FROM A WASTEWATER BACKUP IN THE HALE ACRES SUBDIVISION• AND APPROPRIATE COUNCIL ACTION IN RESPONSE TO THAT REPORT: AND REPORT FROM STAFF RELATING TO SPORTS PARK PROJECT PROMISED TO BE COMPLETED PRIOR TO JUNE 7. City Attorney Ron Cates reported that he had visited with Mary Ellis of Sedgwick James Company, the claims investigator for Oklahoma Municipal Assurance Group. Ms Ellis conducted an investigation of claims received on the sewer line (106th St) and their history did not reveal receiving notification of claims arising from deficiency in the line. Mr Cates told Ms Ellis that the City's historical evidence showed that there had been notification to the City, and provided her with names and addresses of individuals who had notified the City of problems on that sewer line. At this time, the insurance company has not resolved the issue. Mr Ray recommended that the Council direct the staff to prepare the claims from Mr Carmean and Mr Cook for payment at the June 21st Council meeting; and that the City pay the claims as presented by the two citizens. He further recommended that the staff be directed to take whatever actions are necessary against the insurance company to recover any payments made to the citizens by the City. Mr Ray also reported on the Sports Park project. He said he had visited with Mr Carmean and Mr Carmean stated that he was satisfied with the work that had been done on the berm, the drainage, and the gap that was in the berm. Mr Ewing moved to approve the staff recommendation relating to the claims filed against the City as a result of a sewer line backup. Motion seconded by Mary Lou Barnhouse. Pa Owasso Public Works Authority June 7, 1994 ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE AUTHORIZATION TO SOLICIT BIDS FOR REPLACEMENT OF WATER LINES IN THE OLD SECTION OF OWASSO. Mr Carr said that approximately 15,500 linear feet of cast iron water lines are located in the older sections of town. These lines have deteriorated to the point that the flow of water has been restricted. The Oklahoma Water Resources Board provided the City of Owasso with a low interest loan to improve the water distribution system, wastewater collection system and wastewater treatment plan. Nova Engineering has completed the design phase of the improvements to the water distribution and wastewater collection systems. If approved, construction should begin in August, with a February 1995 completion date. Danny Ewing moved, seconded by Chairman Duke, to authorize advertisement for bids for the water line replacement project. AYE: Ewing, Duke, Barnhouse NAY: None Motion carried 3 -0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE PURCHASE OF MATERIALS TO CONSTRUCT A WATER LINE TO THE SERVICE AREA ACQUIRED FROM ROGERS COUNTY RURAL WATER DISTRICT #3. Mr Carr requested that the Trustees approve the purchase of materials needed to construct a 4" water line to connect Glenn -Murr Acres II and City Vue Estates to the city water system. The customers in these areas were in the Rogers County Rural Water District #3 prior to a buyout by the OPWA in March 1993. Written quotes for materials were requested from four suppliers. Chairman Duke moved to authorize the purchase of materials from Ferguson Enterprises Inc in the amount of $1873.24 to construct the requested 4" water line. Motion seconded by Mary Lou Barnhouse. AYE: Ewing, Barnhouse, Duke NAY: None Motion carried 3 -0 and the meeting was adjourned at 7:20 p.m. Marcia Boutwell, Recording Secretary 4 Jerry Duke, Chairperson June 7, 1994 OWASSO CITY COUNCIL / OWASSO PUBLIC WORKS AUTHORITY MINUTES OF SPECIAL MEETING Tuesday, June 14, 1994 The Owasso City Council and the Owasso Public Works Authority met in a joint special session on Tuesday, June 14, 1994 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Public Hearing and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Tuesday, June 7, 1994. ITEM 1: CALL TO ORDER Mayor Duke called the meeting to order at 7:05 p.m. ITEM 2: INVOCATION The invocation was given by Jim McElrath. ITEM 3: FLAG SALUTE Mayor Duke led in the salute to the flag. ABSENT ITEM 5: PRESENTATION AND OPEN DISCUSSION, INCLUDING PUBLIC COMMENT, OF THE FISCAL 1994 -95 BUDGET. Mr Ray and Ms Bishop presented the proposed FY94 -95 budget at a public hearing. Approximately 25 citizens and staff were in attendance. Following the presentation by Mr Ray and Ms Bishop, at 8:00 p.m., the Mayor declared a recess. The meeting was reconvened at 8:15 p.m, at which time the Mayor received questions and comments from the bench and the public, with response from the staff. The major items questioned concerned work at the Sports Owasso Public Works Authority June 14, 1994 Park, drainage in the Hale Acres subdivision, work at Rayola Park, competitive bidding, salaries, staff increases, City Clerk position, and due process safeguards. The proposed budget will be considered for action by the City Council and OPWA at the June 21, 1994 regular meeting. Legal notice was given and a public hearing conducted on June 14, 1994, wherein citizens were offered the opportunity to comment on the proposed budget. Copies of the proposed budget have been available for public review at the Owasso Library and at City Hall. To encourage citizen participation, more than thirty -five copies have been distributed to interested parties, civic groups and community organizations. State statute requires adoption of the annual budget by resolution. OPWA Resolution #94 -01 provides for the adoption of the fiscal year budget for the Owasso Public Works Authority. RECOMMENDATION: Staff recommends Trustee approval of Resolution #94 -01 adopting the fiscal year 1994 -95 budget. ATTACHMENTS: Resolution #94 -01 OWASSO PUBLIC WORKS AUTHORITY OPWA RESOLUTION NO 94 -01 A RESOLUTION PROVIDING FOR THE ADOPTION OF AN ANNUAL OPERATING BUDGET FOR THE OWASSO PUBLIC WORKS AUTHORITY; CLASSIFYING REVENUES; ESTABLISHING LEVELS OF EXPENDITURES BY CLASSIFICATION AS PROVIDED BY STATUTE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS: It is the intent of the Owasso Public Works Authority to adopt an operating budget for fiscal year 1994 -95; and WHEREAS: The adoption of such budget is vital to the continuation of services to the citizens of Owasso; and WHEREAS: Public access to the adopted budget is desired; and WHEREAS: Certain publication and filing requirements are mandated by State Statutes.
