Consideration and Appropriate Action Relating to OZ -9403, A Request to Rezone a Tract of Land in the Northeast Quarter of Section 31, Township 21 North, Range 14 East, from AG (Agriculture) and RM -1 (Residential Multi- Family Low Density) Districts to IL (Industrial Light), Generally Located Directly South of Cedercrest Apartments. Consideration and Appropriate Action Relating to Resolution #94 -06, a Resolution Proclaiming April of Each Year as "Fair Housing Month ", and Identifying Activities to Further Fair Housing Opportunities Within the City of Owasso. Mr Compton Attachment #9 Staff will recommend Council adoption of Resolution #94 -06 as a part of the City's overall economic development strategy. Such a resolution is a state (Department of Commerce) and Federal (HUD) requirement as a condition of receiving CDBG economic development grants and loans. 10. Consideration and Appropriate Action Relating to a Contract for Services Between the City of Owasso and the Tulsa Metropolitan YMCA. Mr Compton Attachment #10 Staff will recommend Council approval of a contract providing for management and operational services for the City's municipal pool. Compensation for such services to be derived solely from revenues generated by the pool facility. 11. Consideration and Appropriate Action Relating to a Request for Council Approval of the Purchase of a Utility Vehicle for Use by the Animal Control Department. Chief Alexander Attachment #11 Staff will recommend Council approval of an expenditure in the amount of $11,181 to Boyd Chevrolet, Oklahoma City, Oklahoma for the purchase of one 1994 one -half ton Chevrolet (C -1500) utility vehicle. Such purchase price established by state bid #007 -48 -10 -100 through the Oklahoma Department of Central Services. Owasso City Council May 17, 1994 Page 4 . 12. Consideration and Appropriate Action Relating to a Request for Council Approval of Annual Oklahoma Municipal Assurance Group (OMAG) Ballot and Authorization for the Mayor to Execute Such Ballot. Mr Ray Attachment #12 Staff has transmitted a list of candidates for the two available positions to the Council and will recommend Council approval of a ballot voting for Mayor G L Hollingsworth (Perry) and City Manager Richard Gertsan (Bethany). 13. Discussion, Consideration and Appropriate Action Relating to Selection and Appointments of Council Members to Vacancies on Various Boards, Commissions and Committees. Mayor Duke Attachment #13 As a result of recent Council changes, there are vacancies on the Owasso Economic Development Authority, Owasso Capital Improvements Committee, and the Legislative Consortium. In all three cases, the seats are reserved for members of the City Council. Staff recommends that, due to the nature of business currently being conducted by these three groups, Council appointments be made at this time. 14. Consideration and Appropriate Action Relating to a Request for an Executive Session for the Purpose of Discussing Personnel Matters Related to the Office of the City Manager, Such Session Pursuant to OS 25, Section 302, Subsection (13)(1). New Business 19 .2T Adjournment 11 OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING 11 Tuesday, May 3, 1994 The Owasso City Council met in regular session on Tuesday, May 3, 1994 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda ' posted on the City Hall bulletin board at 4:00 p.m. on Friday, April 29, 1993. I M ITEM 1: INVOCATION 1 .° The invocation was offered by Ms Juanita Barnes. ITEM 2: SWEARING OF NEWLY ELECTED CITY COUNCIL MEMBERS District Judge Clifford Hopper administered the oath of office to newly - elected councilors Jerry Duke, Joe Ramey, and Danny Ewing, and to current councilors, Mary Lou Barnhouse and Charles Burris. ITEM 3: COMMENTS FROM COUNCILORS Each councilor was provided an opportunity for comments. They thanked their families and ' supporters. Councilor Burris introduced Tulsa Mayor Susan Savage and other guests and thanked Judge Hopper for his participation. ' ITEM 4: CALL TO ORDER Councilor Charles Burris called the meeting to order at 7:10 p.m. ITEM 5: FLAG SALUTE ' Councilor Burris led the flag salute. Mr Burris nominated Jerry Duke, seconded by Councilwoman Barnhouse. AYE: Burris, Barnhouse, Ramey, Ewing, Duke NAY: None Motion carried 5 -0. ITEM 8: ELECTION OF VICE -MAYOR Councilor Burris opened the floor for nominations for Vice- Mayor. Joe Ramey nominated Charles Burris. Motion was seconded by Danny Ewing. AYE: Ramey, Ewing, Barnhouse, Burris, Duke NAY: None Motion carried 5 -0. Mayor Duke presided for the remainder of the meeting. ITEM 9: REQUEST APPROVAL OF THE MINUTES OF APRIL 19, 1994 REGULAR MEETING AND APRIL 25, 1994 SPECIAL MEETING. Charles Burris moved, seconded by Danny Ewing, to approve the minutes, by reference made a part hereto. AYE: Burris, Ewing, Barnhouse, Ramey, Duke NAY: None Motion carried 5 -0. ITEM 10: REQUEST APPROVAL OF THE CLAIMS Mayor Duke reminded those present that the councilors receive a packet of information prior to the meeting, which contains a detailed list of the claims, thus providing them an opportunity to review the claims prior to the meeting. AYE: Burris, Barnhouse, Ewing, Ramey, Duke NAY: None Motion carried 5 -0 and the meeting was adjourned at 7:15 p.m. Marcia Boutwell, Council Clerk 3 Jerry Duke, Mayor May 3, 1994 u 1 OWASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Monday, May 9, 1994 The Owasso City Council met in special session at 5:00 p.m. on Monday, May 9, 1994 as part of the council chambers / courtroom renovation committee. Mayor Duke called the meeting to order and declared a quorum present. Committee members (Council) present were Mr Duke, Ms Barnhouse, Mr Burris and Mr Ewing. Committee members (staff) present were Mr Ray, Mr Knebel, Mr Compton and Ms Boutwell. Committee members absent were Mr Ramey, Mr Hilsabeck and Mr Ramsey. Others present were Ms Bishop and Architect Holmes. Mr Holmes said that some cosmetic changes in the interior are necessary in order for the project to stay within budget. These changes will include painted walls instead of paneling, and no glass bricks. Consensus of the committee was that Mr Holmes should prepare the bid documents with the essentials that will keep the project within the budget, and include other items as alternates. The committee also viewed the fire bay area, including the exterior. Charles Burris moved for adjournment at 6:10 p.m. Motion seconded by Danny Ewing and carried 4 -0. Since that time, River City has provided four hundred nine (409) non - emergency transports. We entered into the referral agreement with River City in order to free our ambulances for emergency response. The transition went very well for all concerned, and we have had- no complaints regarding River City. A Non - Emergency Transfer Review Committee was assigned the responsibility of scheduling and conducting meetings with the staff at Evergreen Care Center, Sequoyah Pointe Nursing Center, and River City. Also, I met with Dr. Ambrose Solano to review River City's protocols and our procedures for maintaining quality medical care for our citizens. The volume of emergency medical calls has steadily increased due to the city's growth; therefore, substantiating the need for the renewal of the referral agreement between the Owasso Fire Department and River City Ambulance Service. Enclosed are attachments from last year's Ambulance Transfer Service Survey for your review. We feel the referral agreement with River City Ambulance Service has been very beneficial to the City of Owasso and recommend Council approval of a referral contract providing for the transport of routine, non - emergency medical transfers by River City Ambulance Service. We explained the reason for our decision to use Rivercity Ambulance Service for all our routine transfers. Everyone seemed to be very receptive to the idea and understood our need to free both ambulances for emergency runs only. In approximately thirty (30) days, we will randomly call on patients that have utilized Rivercity Ambulance Service for transfers, and make sure they are getting the same quality care that Owasso E.M.S. provides. Also, we will receive a monthly report from Rivercity, with a list of the patients transferred. We instructed the Administrators and Nursing Staff at both nursing homes, to contact us with any problems and we will make sure the problem is resolved. Both nursing homes have been advised to call Rivercity Ambulance Service direct for all routine transfers and were provided the proper phone number to call.. ' Originally, several other ambulance services were contacted. These companies were Elite Medical Transport and Lifestat Ambulance Service. Elite Medical Transport is no longer available in Oklahoma and Lifestat Ambulance Service is in the process of being purchased by Rivercity Ambulance Service. Rivercity Ambulance Service is owned by a corporation located ' in Tulsa, Oklahoma, they also appear to be financially sound. The owner and administrator have substantial experience in operating ambulance services. All office records are computerized and the business appears to run very efficiently. The equipment and ambulances are well maintained and two (2) mechanics are on duty daily. Since the first contact with Rivercity Ambulance Service in June of 1992, their emergency call volume has increased significantly, as well as personnel. In addition, they now have a unit staffed twenty four (24) hours a day. Rivercity Ambulance Service's owner pledged that our citizens would receive quality care with no additional expense than they currently have. ' The committee has made the decision to recommend Rivercity Ambulance Service based on their equipment, personnel, location and business ethics. The subject property is located south of Cedarcrest Apartments on Cedar, east of the Max Buchanan Company. The subject property, while bordered on the north by Residential Multi- Family and on the south by Agriculture zoning, is bordered on two sides by Industrial Light zoning. In both cases, the industrial zoning is developed with industrial /manufacturing uses. This area of Owasso has seen expansion of industrial development, most recently with the addition of the Max Buchanan facility in 1993. The expansion of IL zoning to the subject property is logical in the sense that it is currently abutted on two sides with industrial zoning and development. A rezoning allows for a continuity not currently found on the subject property and also increases its development potential. The Owasso Planning Commission reviewed the rezoning request at their May 10, 1994 meeting and by a vote of 4 -1 -0 recommended approval. RECOMMENDATION: The rezoning of this property is a sensible expansion of the area's industrial zoning and development and recommends approval of the rezoning request from RM -1 and AG to IL. LOCATION AND SIZE: The property is generally located within the NE /4 of Section 31, T21N, R14E of the I.B.M. The complete legal description of the property is attached for your information and review. The property is more specifically defined as being immediately south of the Cedarcrest Apartments located at 401 S. Cedar. The entire subject property contains approximately 16.56 acres, more or less. EXISTING LAND USE: Subject property is undeveloped. SURROUNDING LAND USE: Property immediately north of the subject property is zoned RM -1 and contains Cedarcrest Apartments, while abutting the subject property on the south contains undeveloped land zoned AG (Agriculture). Property to the east of the subject site is zoned IL (Industrial Light) and contains the properties and businesses that abut the west service road of Highway 169. Property to the west of the subject property is zoned IL also and contains the Max Buchanan operations, while further west are the city's Public Works garages, recycle center, animal control, and sewage treatment facility. COMPREHENSIVE PLAN: The Comprehensive Plan identifies this area as being appropriate for Residential Uses. However, it is important to note that the Comprehensive Plan may be outdated in this area. (See OZ- 94 -04) APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", and Chapter 7 "Industrial District Provisions." SITE INFORMATION: The subject property lies in an area that is known to become wet and marshy following heavy rains and flooding of the Bird Creek. Fill dirt is likely to be necessary in this area prior to any development which would occur. Staff Report OZ -94 -03 Page 2 of 3 ANALYSIS The proposed rezoning, if approved, would create an additional 16.56 acre area of undeveloped property for industrial development purposes. Currently, the Owasso Economic Development Authority is working with a possible manufacturer which could locate on this site. The subject site, while being bordered on the north by Residential Multi- Family and on the south by Agriculture zoning, is bordered on two sides by Industrial Light zoning. This abutting zoning also contains actual uses and is not undeveloped. This portion of Owasso has been expanding with industrial/ manufacturing uses, most recently with the addition of the Max Buchanan facility in 1993. The recently completed portion of South Main Street, through the city facilities and looping back to the Max Buchanan facility, has also made the immediate area - more specifically the subject property - much more attractive for industrial development. The eventual completion of Fifth Avenue to the service road will provide more convenient access to Highway 169 and hopefully eliminate industrial traffic on Cedar. Cedar, in the future, will become a "dead - end" street serving local traffic only. As stated in the previous zoning case, the expansion of a zoning of this intensity should be of a logical planned pattern, rather than "spot zoning" to be surrounded by a largely different zoning classification. This site is abutted on two sides by industrial zoning and development and a rezoning of this property to the same classification is logical. In fact, without a rezoning, one is likely to never see the subject property develop further in any manner. The Owasso Zoning Code requires a 75 foot buffer from abutting residential districts and staff feels this buffer can be utilized in a manner which would prevent an adverse impact on the nearby apartments. If approved ,creative landscaping in the buffer area is likely to be a requirement of city staff at site plan review stages as there are numerous of trees located on the north end of the subject property today. RECOMMENDATION Staff feels the rezoning of the subject property is a logical expansion of area industrial zoning and development and recommends approval of the rezoning request from RM -1 and AG to IL. Because of the CDBG Economic Development Grants the City has recently received, it is necessary for two affirmative actions to be taken. The staff is proposing that one of these actions be the adoption of a resolution proclaiming April of each year as Fair Housing Month in the City of Owasso (see attached Resolution #94 -06). The second action proposed is the design and distribution of a Fair Housing Brochure (see attached Brochure). The resolution and brochure were prepared by INCOG as a part of a contract the City has with that agency to assist the staff with grant administration. The staff has reviewed both and find that they meet the requirements of the City's contract with the Oklahoma Department of Commerce. It should be noted that even though furthering fair housing is extremely important, these actions that the Council is being requested to take are generally considered to be "housing cleaning" matters. Following is a step -by -step process. 1. File a written complaint within 30 days of the alleged violation with the City's Fair Housing Council. The complaint must be in writing and filed under oath. The Fair Housing Council may file a complaint on its own Initiative at any time. 2. The Fair Housing Council has 6 days to investigate, confer and conciliate the complaint. 3. If the Fair Housing Council determines that a complaint is not well founded, the complaint will be dismissed and both the complainant and person complained against (respondent) will be notified in writing of this action. 4. If the Fair Housing Council determines that a complaint is well founded, an effort to adjust the complaint by conference and conciliation will be made. Should this fail, the Fair Housing Council will serve a notice in writing to the respondent. 5. The respondent will be asked to answer to charges of discriminatory practices at a hearing before the Fair Housing Council. 6. A written response to the complainant's allegations will be required of the respondent at the hearing. 7. The Fair Housing Council will allow both complainant and respondent (or their representatives) to present evidence, witnesses, etc. at the hearing. All testimony shall be given under oath. 8. If the Fair Housing Council finds that a violation has occurred, it shall state its findings in a written report which shall be forwarded to the City Attorney for appropriate action. 9. The 1988 Federal Fair Housing Amendment Act added two new categories of protected citizens to that group: the handicapped and families with children. It also strengthened procedures for enforcing Fair Housing Laws. BASES FOR A HOUSING DISCRIMINATION COMPLAINT The Fair Housing Act prohibits discrimination in housing because of: • Race or color • National origin • Religion • Sex • Familial status (including children under the age of 18 living with parents or legal custodians; pregnant women and people securing custody of children under 18) • Handicap The Fair Housing Act covers most housing. WHAT CONSTITUTES A VIOLATION OF THE ACT? Mortgage Lending No one may take any of the following actions based on race, color, national origin, religion, sex, familial status or handicap: • Refuse to make a mortgage loan • Refuse to provide information regarding loans • Impose different terms or conditions on a loan • Discriminate in appraising property • Refuse to purchase a loan or • Set different terms or conditions for purchasing a loan. It is also illegal for anyone to: • Threaten, coerce, intimidate or interfere with anyone exercising a fair housing right or assisting others who exercise that right • Advertise or make any statement that Indicates a limitation or preference based on race, color, national on in, religion, sex, familial status or handicap. This prohibition against discriminatory advertising applies to single family and owner occupied housing that is otherwise exempt from the Fair Housing Act. REQUIREMENTS FOR NEW BUILDINGS In buildings that were ready for first occupancy after March 13, 1991, and have an elevator and four or more units: • Public and common areas must be accessible to persons with disabilities • Doors and hallways must be wide enough for wheelchairs • All units must have: - an accessible route into and through the unit - accessible light switches, electrical outlets, thermostats and other environmental controls - reinforced bathroom walls to allow later installation of grab bars and - kitchens and bathrooms that can be used by people in wheelchairs It a building with four or more units has no elevator and was ready for first occupancy after March 13, 1991, these standards apply to ground floor units. These requirements for new buildings do not replace any more stringent standards In State or local law. HOUSING OPPORTUNITIES FOR FAMILIES Unless a building or community qualifies as housing for older persons, it may not discriminate based on familial status. That is, it may not discriminate against families in which one or more children under 18 live with: • A parent • A person who has legal custody of the child or children and • The designee of the parent or legal custodian, with the parent or custodian's written permission. Familial status protection also applies to pregnant women and anyone securing legal custody of a child under 18. Owner desires the benefit of the experience and the services of Manager upon the terms set forth in this agreement, and Manager is willing to accept such employment on the terms set forth in this agreement. For the reasons set- forth above and in consideration of the promises of the parties herein, the parties agree as follows: SECTION ONE TERMS OF AGREEMENT The term of this agreement shall extend from the 22n.�day of April, 1.994, to the _2-�day of April, 1995. SECTION TWO TERMINATION OF AGREEMENT This agreement may be canceled at any time by either party with or without cause upon thirty (30) days written notice to the other. SECTION THREE ACCEPTANCE OF EMPLOYMENT Owner employs Manager to operate the swimming pool facility and other recreational programs as set forth on Exhibit "A" hereto, and render the services herein stated, and Manager accepts such employment-and shall discharge such such duties all in accordance with the terms herein set forth. SEC`T'ION FOUR SERVICES OF MANAGER Manager shall be the exclusive manager_ of the swi- mm.ing pool facility, and manager_ shall provide Owner with the services customarily provided for in such instances, including the following: a. Accounting. Manager shall keep all accounts and supervise all bookkeeping and submit monthly statements to Owner showing the details of the swimming pool operations. All such records shall be open for inspection of owner or owner's agents, counsel, or auditors at all reasonable hours. b. Buying. Manager shall make available to the Owner_ its buying power, without profit on any purchase which may be made. c. Referrals and advertising. Manager shall exert reasonable efforts to direct patronage to Owner's swimming pool and recreation facility and will follow a program of displaying advertising of such. d. Resident manager. Manager will appoint a capable resident manager and necessary personnel, deemed capable of maintaining and operating Owner's property as a first -class swimming pool and recreation facility. if a resident manager shall not prove to be satisfactory to Owner, Owner may in writing request Manager to discharge a resident manager, setting .forth therein the reasons for such action. If the grounds of the removal set forth by Owner shall be sufficient to constitute a violation of the terms of this agreement, a resident: manager shall be discharged by Manager. SECTION FIVE BONDING OF EMPLOYEES Manager shall maintain adequate fidelity bonds on employees engaged in the operation of the swimming pool, the premiums for which shall be charged as operating costs. SECTION SIX CONTROL OF EMPLOYEES Manager shall have full power and authority to take all actions to bring about an efficient operation of the swimming pool and recroaLi_onal programs. Manager shall have exclusive authority to hire and discharge all employees necessary for the operation of the swimming pool and recreational program and to fix and pay their_ compensation. Such employees shall be the employees of the Manager and not the Owner. SECTION NINE ' MANAGER'S COMPENSATION As compensation for services to be rendered hereunder, Manager ' shall receive the net cash receipts derived from the operation of the swimming pool and recreational program as set forth in this agreement. SECTION TEN MAINTENANCE OF OPERATING EQUIPMENT ' The swimming pool_ and recreational program property and all furniture, fixtures, machinery, appliances, operating equipment, and all personal property used in the operation of the swimming pool and recreational program shall be maintained by Owner in first -class repair, and in such condition that such equipment shall be satisfactory for the oper_at. ion of a first-class swimming pool and recreational program. Manager shall. be responsible for performing light maintenance on the aforesaid, including, but not limited to, cleaning, painting, removal of debris and obstructions or articles which endanyer the health and safety of invitees. SECTION ELEVEN ASSIGNMENT Neither party may assign this agreement or any of the rights and duties expressed herein. SEC`1'ION TWELVE ' COMPLIANCE WITH LAWS Manager will comply with applicable regulatory requirements including federal, state and local laws, rules, regulations, orders, codes, criteria and standards. Manager shall procure the permits, certificates, and licenses necessary to allow Manager to perform Lhe services contemplated by this Agreement. (Pool Operator On Location) and Aquatic Facility Management (AFM) Don Boatman current Owasso Program Director The Pool will be directly managed by Mike Goettel currently certified in P.O.O.L, Aquatic Facility Management,Life Guard Instructor and Water Safety Instructor. 10 years experience in pool facilities. 24 years old with a B.S. in Physical Education from Oklahoma State University. All Staff will be 18 years old and have completed Lifeguard training, CPR, and First Aid. They will receive training in handling of hazardous materials (Blood Borne Pathogens) and the appropriate record keeping. All Staff will be required to wear the appropriate uniform and bathing suits. Hours of Operation The pool will open on Saturday May 28th and close on Sunday August 14th for regular operations. Plans are to provide for a special evening schedule 4 to 7 pm for Rec Swim. Saturday and Sunday 2 to 5pm after August 15th to August 28th. The weather at the time will determine how long the pool is open. We will guarantee only May 28- August 16 for the purpose of Summer Passes. Any time beyond is a bonus and hopefully will eliminate those who feel that they paid for it and the pool should be open. MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: STEVE COMPTON ASSISTANT CITY MANAGER SUBJECT: CONTRACT WITH YMCA FOR MANAGEMENT OF MUNICIPAL POOL DATE: May 14, 1994 BACKGROUND: The staff discussions with representatives of the YMCA regarding continued privatization of the pool operations have been completed. A contractual agreement has been prepared by Mr. Cates for final action by both the YMCA Board and the Owasso City Council (see attached Management Contract). The YMCA Board approved said contract at their April 22nd meeting. The scope -of- service identified for each party is a follows: YMCA - Provide management services for the complete operation of the pool including accounting, hiring and terminating personnel, scheduling existing and new programs, and routine daily maintenance and cleaning of the facility. City of Owasso - Provide for supplies, maintenance of equipment and structure, and ' mutually agreed upon capital outlay expenditures. Additionally, the City is to ensure the facility's equipment meets health department standards for certification. ' In order to more clearly define the YMCA's daily management practices, a detailed Management Plan was requested to be submitted along with the Management Plan (see Attached Management ' Plan). The staff has reviewed both the contract and the management plan and find them to be acceptable. ' It is anticipated that given the YMCA's expertise in this type of recreation management and with the addition of other pool related programs, their presence will enhance the swimming opportunities available to Owasso citizens. As compensation for their services, the YMCA will ' receive the net cash receipts derived from the operation of the pool facility and expanded program schedule. ' The City will continue to budget annually for the operating and maintenance supplies and for capital outlay expenditures to maintain the building and equipment. The cost to the City will be the same regardless of the privatization of the management operations. In staffs opinion there will be no impact on the financial position of the City; however, this agreement will have 11 a positive impact on the programs provided to our citizens in terms of better service and efficient program management. RECOMMENDATION• The staff recommends approval of the Management Contract with the YMCA and request that the Mayor be authorized to execute the contract. ALEXANDER CHIEF OF POLICE SUBJECT: ANIMAL CONTROL VEHICLE PURCHASE DATE: May 10, 1994 BACKGROUND: The Animal Control division of the Owasso Police Department has operated a 1983 Ford pickup truck for the past four years. This vehicle was acquired as the result of a drug seizure forfeiture in the Fall of 1989, and now has over 115,000 miles on it. During the Winter of 1993, major mechanical problems developed with the vehicle resulting in the decision to remove it from operation due to costs of major repairs and safety concerns. In the interim, the Public Works department has allowed the Animal Control division to use one of their vehicles. The 1993 -94 budget allowed $8,600 for the purchase of a new truck for animal control; however, due to the state of the Police Department's current budget, this expenditure was delayed to utilize finances needed to cover the basic operations of all three divisions (animal control, communications, and police) . Upon review of the current budget, it is anticipated that this expenditure may now be made from the 1993 -94 budget. State bids were obtained from the Oklahoma Department of Central Services, Central Purchasing Division, and the following vendors provided the costs listed below for 1994 vehicles: Boyd's Chevrolet, OKC Chev C1500 Full Size, Base Bid: $10,979 Option #2, Air Conditioner, Add: 675 Option #5, 3.9 Liter, V6, Deduct: 470 Total Purchase Price $11,184 Robert Carter Chevrolet, Guymon Chev S -10 Mid Size, Base Bid: $ 8,698 Option #3, Air Conditioner, Add: 671 Option #5, Longer Bed, Add: 299 Total Purchase Price $-9,668 The difference in the price of the small size and full size truck is $1,516. Contact was made with surrounding dealerships in an attempt to ascertain if they could be competitive with the state bid. No dealership would provide any indication of competing with state bid prices. The need to purchase an animal control vehicle is apparent. The Public Works Department needs to recover their vehicle for departmental use and the animal control officer must have a safe vehicle to operate. The decision of whether to purchase a small sized vehicle and save $1,516 or to purchase the full size vehicle must be made. In deciding which vehicle to recommend, the following considerations were addressed. It is the ultimate goal to place an animal transport unit in the bed of the truck for transporting stray, vicious, and impounded animals. Currently, the division has only two single plastic portable animal carriers secured in the bed of the vehicle. The full size truck will carry the weight of the animal transport unit with no damage to the vehicle bed or base. The full size vehicle offers more interior space in which to store catch poles, traps and other paraphernalia necessary to animal capture. Both vehicles are anticipated to meet the needs of the Animal Control division for the next decade; however, a full size truck will provide a broader range of uses to the department than will a short bed or small size vehicle (i.e. stolen property transport, etc.) FUR, � Funds are currently available and have been appropriated for this purchase. RECOMMENDATION: Staff recommends approval of the purchase of the 1994 Chevrolet C1500 full size vehicle from Boyd's Chevrolet for $11,184. The group was created in response to a crisis created by the withdrawal of municipal insurance coverage by most Oklahoma insurance companies. Finding themselves without liability coverage prompted the cities to join together to form what is best termed as a "modified self insurance program" for its members. Since its formation, the agency /trust has evolved to a full service insurance provider for its members and currently offers liability, property, workers compensation, auto and specialty insurance coverage to its members. The City of Owasso purchases only liability insurance from OMAG. The city's workers compensation and auto insurance are funded through self insurance programs and property coverage is with a local agent. However, the city is a full member of the OMAG, with the voting rights accorded such membership. As an Interlocal Cooperative Agency, the OMAG is governed by a Board of Trustees elected by the membership. Elections are held annually for a prescribed number of trustees. There are seven trustees serving terms of three years. Trustees must be elected from the officers and staff of member cities through a nomination and election process detailed in the organization's by- laws. This year there are two trustees "up" for election for terms ending on June 30, 1997. The nominating process has produced four candidates for those two positions (see attachment). As a member of OMAG, Owasso may cast votes for two of the four candidates. Members of OMAG must have their ballots returned by May 31, 1994 in order for their vote to be included in the final count. Upon completion of the count, the two nominees with the highest vote totals will be declared the winners and will be seated effective July 1, 1994. As a result of those inquiries and reviews, the staff feels comfortable in making a recommendation to the Council relating to the election. The committee also adopts a revised Capital Improvements Plan each year for recommendation to the Council. Meetings last from one to two hours. Staff members and City Council membership on the committee is determined by virtue of their position. Other members are appointed by the Mayor with Council confirmation. LEGISLATIVE CONSORTIUM The Legislative Consortium was formed in 1988 after a study indicated a need for an increased legislative activity on behalf of Tulsa area municipal governments. The Consortium is comprised of the following governmental entities: 1. City of Tulsa (Priscilla Harris, Mayor's Office) 2. City of Broken Arrow (City Attorney) 3. City of Sand Springs (City Manager) 4. City of Owasso (City Manager serving as alternate) 5. City of Sapulpa (City Manager) 6. City of Jenks (City Manager) 7. City of Bixby (City Manager 8. Tulsa County (Commissioner John Selph) During the legislative session, the Consortium meets every other Friday. The Consortium members each have one vote and rules allow any one member to veto any position or action proposed by any other member. The Consortium employs a legislative consultant for the purpose of providing a Tulsa area presence in the State Capital. Meetings of the Consortium are held at 10:00 a.m. on Fridays and require approximately two hours to complete. The session is requested in accordance with state statutes enacting the open meeting act. .'W MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: RODNEY J RAY CITY MANAGER SUBJECT: CITY MANAGER'S REPORT DATE: May 13, 1994 CEMETERY: CEMETERY WORK DAY - Another work day for the public has been scheduled at Fairview Cemetery for Saturday, May 21, 1994. The work day is the saturday immediately prior to the Memorial Day weekend, when we expect to have a number of visitors. Anyone interested in helping to clean up the grounds, cut grass, weedeat, and provide general assistance to city personnel is invited to participate in the event. Citizens assisting are asked to bring lawn mowers, weedeaters, grass clippers, etc. Trash containers will be provided. If you have questions, contact Ms Boutwell. POLICE SERVICES: SEAT BELT SURVEY - Between 4 -26 -94 and 5 -6 -94, a seat belt survey was conducted at the Owasso High School with the results showing 57% of all operators utilizing their safety belts. This is a much lower usage than was hoped; however, this information provided interesting statistical data and can benchmark future seat usage education. TRAINING - One -third of the department will have completed Total Quality Management training on May 12th. This program has been extremely beneficial to the department in setting CITY MANAGER'S REPORT May 13, 1994 Page 2 up committees to work on processes and improvements within the agency. Another 10 employees will begin their TQM training in June. Training is continuing in the arena of Gang Prevention and Major Incident Preparedness, and Management Training, which is scheduled in May. TORCH RUN - Owasso Police Department is participating in the Oklahoma Law Enforcement Torch Run for Special Olympics and will take part in opening ceremonies in Stillwater this month. STREETS: TREE REMOVAL - The Public Works Department projects schedule includes a project for the removal of trees along the west side of 129th E Ave at the entrances to Double Oaks. Drivers of vehicles entering 129th E Ave from the subdivision have a difficult time observing traffic traveling north or south. Recently, an accident occurred between an automobile and concrete truck as a result of this situation. The work was to begin last week, but was delayed because of conditions too wet for our equipment. Work was started on May 11th, once the area had been allowed to dry out. MOWING HIGHWAY RIGHT -OF -WAY - City personnel have begun mowing the Highway 169 right -of -way. Work is being performed by Public Works and Parks Departments personnel after normal work hours on overtime. This portion of the seasonal mowing contracts was determined to be more cost - effective for the city to pay existing employees overtime than to contract with an outside mowing company. The savings to the City will amount to approximately $850 per month or $3400 over the mowing season. RECREATION CENTER: HOME BUYING SEMINAR - The Recreation Center and the Owasso Home Owners Association are in the planning stage of a seminar. It will be a one -day seminar on home buying, loan applications, etc. Additional details will be available in the next two weeks and will be included in this report at that time. WATER DISTRIBUTION: WATER LINE REPLACEMENT - Design plans and specifications for rehabilitation and replacement of water distribution lines in the older sections of town have been completed by 1 1 1A CITY MANAGER'S REPORT May 13, 1994 Page 3 NOVA Engineering. A memorandum from Public Works indicating specifics of the project is attached for review. As designed, the project consists of replacement and upgrading approximately 15,000 feet of 6, 4, and 2 -inch cast iron water lines with 6 and 4 -inch PVC piping. An engineering estimate of the cost of the project is $521,000. The loan from the Oklahoma Water Resources Board is the source of funding for the project. A complete set of design plans and contract documents will be included in the agenda packet for the June 7th Council meeting. WASTEWATER COLLECTION: 1 COMPLIANCE INSPECTION REPORT - Public Works recently received a copy of the Oklahoma Department of Environmental Quality (ODEQ) compliance inspection report for the Owasso Wastewater Treatment Facility. An inspection of the facility was conducted on February 14, 1994 to evaluate the facility for compliance with the ODEQ /EPA issued discharge permit. The findings for this inspection are consistent with those of past years. A summary of the findings is listed below: • The facility appeared to be well operated and maintained; therefore, most areas evaluated were considered satisfactory. • Although operation and maintenance appeared to be satisfactory, it was recommended that the system have more than one operator on site per shift and that the plant be manned 24 hours per day. • Sludge disposal was considered unsatisfactory because of sludge that has not been removed from the abandoned lagoon. • There may be a need for increasing the capacity of the plant in the near future. Robert Carr Public Works Director SUBJECT: Water Line Replacement Project (Owasso Project Number G3.100 -94) Construction Plans and Specifications DATE: May 10, 1994 BACKGROUND: A current problem with the water distribution system in the older sections of town (essentially south from 86th Street North /west of Highway 169 and south of 76th Street North /east of Highway 169) is that approximately 15,500 linear feet of cast iron water lines are old and deteriorated. These lines are located in the oldest, most mature section of the city. The cast iron lines are filled with deposits which restrict the water pressure and hamper the flow of water to the customers and inhibit the flow of water for fire fighting purposes. Conditions causing deterioration of these lines will continue because of the types of chemicals in the treated water needed to comply with drinking water standards, soil characteristics, and weather conditions. Therefore, deterioration of this portion of the system requires replacement of the lines to provide for proper pressure, flow and safety for the community. The City of Owasso secured a low interest loan from the Oklahoma Water Resources Board for improvements to the water distribution system, wastewater collection system and wastewater treatment plant. Approval of the loan required selection of an engineering firm for the design of the improvements. After interviewing five engineering firms, the Council selected NOVA Engineering to design the improvements to the water distribution and wastewater collection systems As designed, the water line project consists of replacement and upgrading of approximately 15,000 linear feet of 6 -, 4 -, and 2 -inch cast iron water lines with 6- and 4 -inch AWWA C -900 polyvinylchloride (PVC) piping. Staff has reviewed and approved the design and contract documents. Estimated cost of construction is $521,000. PROJECT SCHEDULE: The following is a revised schedule for the referenced project. We delayed the completion of the final design plans and specifications to allow for adequate time to review the submittal by NOVA Engineering. Barring unforeseen circumstances, this schedule should be accurate. Start of construction has been shifted by three weeks and completion of construction been changed slightly to allow for this delay. Upon consideration, the following breakdown are ordinances that may very well be applicable and need legal counsel consideration for clarification, and /or a waiver by City Counsel. Please bear in mind that my review was conducted without specifics of the anticipated events, and based on my training, and personal experience in attendance of such events, the following subjects are considerations which I believe should be considered by the sponsoring agency. This memorandum should in no way be relied upon as legal advice, and appropriate legal counsel should be retained. ANIMALS Our Code of Ordinances does not specifically address the harboring or importing of exotic animals, per se. The language contained in Section 4, et. al. is broad enough for the most part to include verbiage such as "any other animal or fowl." The specific sections of Section 4 which I found to be potentially applicable are: 4 -111 Clean and devoid of rodents, free of objectionable odors 4 -112 Disposal of manure: hauled outside of City within health and safety regulations. Does not specify particular method or manner to conform to such issues. 4 -116.9 ...any animal which emits sounds, noises, which disturb peace or quietude of neighborhood. It is my understanding that t h i s circus i s to be located near the Wildwood Apartment Complex, which by the very nature of said area is directly adjacent to residential zones. Interoffice /circus ordinances 1 4 -101.7 Viciousness of animal, or their nature to be vicious. Is adequate information or history of any bites or attacks available for consideration for exotic animals intended to be used. HEALTH AND SANITATION Several issues were addressed that I believe may be applicable to a circus or carnival event. The equipment that will be used to provide electricity, sound or public address systems, or the like may be in violation due to the nearby locality of the Wildwood Apartment Complex, and adjacent homes. 8- 307(9) Continued making of loud or unusual noises, including keeping of animals which disturb. (10) Electrical apparatus or machines which causes TV interference. (19) (animal stables)- obnoxious /annoying sounds and /or odors. LICENSING Upon review of this section of the Code of Ordinances, I was unable to find an ordinance which specifies a Circus, only to carnivals. However, a section was devoted to the issue of carnivals which may be somewhat applicable. Further, more specific information is necessary to assess licensing fees, and it is my understanding that the City Council has eliminated business licenses altogether. This is my understanding only, and will need to be clarified by legal counsel. 9- 113(B)7A -8 Carnivals: up to 25 cars $250 for first day up to 40 cars $300 for first day more than 40 cars, $350 for first day, then $50.00 per day thereafter. 9- 113C(3) defines carnival, and stipulates that there must be an admission fee charged. The question of whether or not a circus would fall under the itinerant vendor ordinance arose. We will need to determine Interoffice /circus ordinances 2 whether the circus is applicable, and whether or not the show is ' incorporated. See 9 -203 and 205. PARKING 10 -216 In the event that we intend to use the vacant field pe located behind the Owasso Lumber Company, we should secure written tacit permission from the owner thereof. 2XI &I M11 10-312(2) Radio, phono , musical instruments between 1 1 pm and 7am are prohibited. We need to determine the hours of operation anticipated.. (6) Generator Noises. I presume the circus will have some type of power generator, etc. These will have to be shut down, or muffled to the point of no complaint, past 11pm. (12) Sound systems. The use of public address systems for hawkers, or announcers may be a source of complaint due ' to the close proximity of the Wildwood apartments. Again, we need to determine the hours of operation and have a contingency for a noise complaint in general. BAWDY HOUSE /GIRLIE SHOWS 10 -407 & 10 -408 These ordinances would probably apply, and would prompt a pro- active investigation for arrest, and would probably generate numerous complaints from local prudent residents. , SHOOTING GALLERIES 10 -308 Air rifles prohibited 10 -309 Discharge of firearm unlawful within city limits. ALCOHOLIC BEVERAGES a It is my considered opinion that alcoholic beverages should not be sold or allowed on the premises of the circus. I would recommend that an alcoholic beverage ban be stipulated prior to contracting the show. In the event beer, or other alcoholic beverage is sold, those ordinances are provided for in the Code of Ordinances, and the licensing is quite expensive. In addition to the purported grievance, it is important to note the above referenced correspondence also referred to "an unfair labor practice." The City considers such allegations to be serious charges. If the FOP, in fact, believes that the City has engaged in an unfair labor practice, I would strongly encourage representatives of the lodge to contact the Public Employees Relations Board (PERB) for the purpose of initiating appropriate action in accordance with state law. If, however, the claim of an unfair labor practice is nothing more than a phrase used without a real understanding of the term; then I would strongly encourage the lodge to become better acquainted with the history and reasons as to why the charges of unfair labor practices are dealt with in a significantly more legal environment. As to the issue of the claimed grievance, I direct your attention to Article 5, Section 2, Subsections (A) and (I) of the 1993 -94 contract between the City of Owasso and the FOP Owasso Lodge #149. Such sections specifically reserve the right of the City to determine policy and rules for the department. Specifically, Subsection (A) reserves management's right "to determine Police Department policy, including the to manage the affairs of the department in all respects .... ". Additionally, Subsection (I) provides for the City "to establish and enforce Police Department rules, regulations and orders;... ". Michael Kennedy May 2, 1994 Page 2 Based on my review of your grievance, the contract language, and discussions with the City Attorney, it is my decision to deny your request for relief. The Owasso Police Department has traditionally promulgated rules and regulations based on the above referenced contractual language. That practice is allowed, and will continue, in order to promote the health, welfare and benefit of the department and its employees. Thank you for your interest in the department. I look forward to working with the FOP for the betterment of the work environment, service to citizens and general public safety. The grievance pertains to the unilateral implementation of rules, regulations, departmental practices, and changes in working conditions, during the effective dates of the collective bargaining agreement, without reopening negotiations. The above listed action is in clear violation of Article 9, as well as being an unfair labor practice. The Membership, of the Lodge, prays for relief, and in accordance with Article 7 Section 3 (C), this matter is now presented to you. The relief sought is the nullification of all rules, regulations, departmental practices, and changes in working conditions, that have been implemented.
